Vonesa n\u00eb k\u00ebt\u00eb proces ndikon drejtp\u00ebrdrejt n\u00eb karrier\u00ebn e magjistrat\u00ebve, n\u00eb plot\u00ebsimin e vendeve vakante dhe n\u00eb kapacitetin real t\u00eb gjykatave e prokurorive p\u00ebr t\u2019iu p\u00ebrgjigjur ngarkes\u00ebs s\u00eb tyre.<\/em><\/p>\n<p><em>Pik\u00ebrisht k\u00ebtu q\u00ebndron lidhja thelb\u00ebsore me funksionimin e sistemit. Vler\u00ebsimi n\u00eb koh\u00eb \u00ebsht\u00eb kusht p\u00ebr nj\u00eb karrier\u00eb t\u00eb bazuar n\u00eb merit\u00eb; karriera e bazuar n\u00eb merit\u00eb \u00ebsht\u00eb kusht p\u00ebr plot\u00ebsimin e drejt\u00eb dhe t\u00eb shpejt\u00eb t\u00eb vendeve vakante; nd\u00ebrsa plot\u00ebsimi n\u00eb koh\u00eb i gjykatave dhe prokurorive \u00ebsht\u00eb nj\u00eb nga parakushtet kryesore p\u00ebr uljen e backlog-ut.<\/em><\/p>\n<p><em>Kjo \u00e7\u00ebshtje ka edhe nj\u00eb tjet\u00ebr dimension. Vler\u00ebsimi etik dhe profesional ishte nj\u00eb nga pikat m\u00eb t\u00eb dob\u00ebta t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb para reform\u00ebs. Pik\u00ebrisht pamund\u00ebsia p\u00ebr t\u00eb garantuar nj\u00eb vler\u00ebsim t\u00eb besuesh\u00ebm, t\u00eb shpejt\u00eb dhe transparent t\u00eb magjistrat\u00ebve ishte nj\u00eb nga arsyet e riformatimit institucional. Reforma n\u00eb drejt\u00ebsi nuk synoi thjesht ndryshimin e emrave t\u00eb institucioneve, por ndryshimin e m\u00ebnyr\u00ebs se si sistemi vet\u00ebqeveriset, si zgjedh, si promovon, si kontrollon dhe si mban p\u00ebrgjegj\u00ebsi.<\/em><\/p>\n<p><em>Prandaj sot duhet t\u00eb jemi t\u00eb kujdessh\u00ebm q\u00eb t\u00eb mos riprodhojm\u00eb, me institucione t\u00eb reja, dob\u00ebsi t\u00eb vjetra. Kemi KLGJ dhe KLP t\u00eb dala nga reforma, me legjitimitet t\u00eb ri kushtetues, me kompetenca t\u00eb qarta dhe me p\u00ebrgjegj\u00ebsi t\u00eb drejtp\u00ebrdrejt\u00eb p\u00ebr karrier\u00ebn e magjistrat\u00ebve. Pik\u00ebrisht p\u00ebr k\u00ebt\u00eb arsye pritshm\u00ebria \u00ebsht\u00eb m\u00eb e lart\u00eb. Nuk mjafton t\u00eb kemi ligj t\u00eb ri, apo metodologji dhe rregullore t\u00eb reja. Pyetja themelore \u00ebsht\u00eb: a po funksionon vler\u00ebsimi n\u00eb koh\u00eb dhe a po sh\u00ebrben ai realisht p\u00ebr administrimin e karrier\u00ebs dhe p\u00ebr uljen e vonesave n\u00eb sistem?<\/em><\/p>\n<p><em>Duhet ta pranojm\u00eb hapur se, pavar\u00ebsisht p\u00ebrpjekjeve t\u00eb b\u00ebra, vler\u00ebsimi etik dhe profesional nuk ka arritur ende t\u00eb funksionoj\u00eb me ritmin, rregullsin\u00eb dhe ndikimin q\u00eb k\u00ebrkon ligji dhe q\u00eb pret sistemi. Ende konstatohet prapambetje e ndjeshme n\u00eb kryerjen e vler\u00ebsimeve; ende ka magjistrat\u00eb p\u00ebr t\u00eb cil\u00ebt vler\u00ebsimi nuk \u00ebsht\u00eb kryer n\u00eb koh\u00ebn e duhur; ende ka procedura karriere q\u00eb ndikohen nga mungesa e vler\u00ebsimeve t\u00eb p\u00ebrdit\u00ebsuara.<\/em><\/p>\n<p><em>Kur vler\u00ebsimi kryhet me vones\u00eb, ai nuk e p\u00ebrmbush plot\u00ebsisht q\u00ebllimin e tij. Ai nuk orienton n\u00eb koh\u00eb karrier\u00ebn, nuk mb\u00ebshtet n\u00eb koh\u00eb ngritjen n\u00eb detyr\u00eb, nuk ndihmon n\u00eb koh\u00eb plot\u00ebsimin e vakancave dhe nuk i sh\u00ebrben n\u00eb m\u00ebnyr\u00eb efektive uljes s\u00eb \u00e7\u00ebshtjeve t\u00eb prapambetura. Prandaj problemi nuk \u00ebsht\u00eb vet\u00ebm sa vler\u00ebsime jan\u00eb kryer, por n\u00ebse ato jan\u00eb kryer n\u00eb koh\u00ebn kur sistemi ka pasur nevoj\u00eb p\u00ebr to.<\/em><\/p>\n<p><em>K\u00ebt\u00eb e ka evidentuar edhe Progres Raporti i Komisionit Evropian, kur thekson se efikasiteti i k\u00ebshillave n\u00eb em\u00ebrimin, promovimin, transferimin dhe vler\u00ebsimin e magjistrat\u00ebve mbetet ende problematik dhe ndikon n\u00eb cil\u00ebsin\u00eb dhe efikasitetin gjyq\u00ebsor n\u00eb t\u00eb gjitha nivelet. Po ashtu, zhvillimi i karrier\u00ebs mbi baz\u00eb merite dob\u00ebsohet n\u00eb praktik\u00eb kur vler\u00ebsimet cil\u00ebsore t\u00eb magjistrat\u00ebve kryhen me rit\u00ebm t\u00eb ngadalt\u00eb.<\/em><\/p>\n<p><em>Kjo \u00ebsht\u00eb nj\u00eb kamban\u00eb alarmi, sepse meritokracia nuk matet me deklarata. Meritokracia matet me procedura q\u00eb mbyllen n\u00eb koh\u00eb, me vler\u00ebsime q\u00eb jan\u00eb t\u00eb besueshme, me renditje q\u00eb jan\u00eb t\u00eb qarta, me promovime q\u00eb nuk vonohen dhe me gjykata q\u00eb plot\u00ebsohen.<\/em><\/p>\n<p><em>Ligji e sheh gjykat\u00ebn jo thjesht si godin\u00eb apo si struktur\u00eb formale, por si institucion q\u00eb duhet t\u00eb funksionoj\u00eb realisht, me num\u00ebr t\u00eb mjaftuesh\u00ebm gjyqtar\u00ebsh, me administrat\u00eb t\u00eb organizuar dhe me sh\u00ebrbime mb\u00ebshtet\u00ebse efektive. Megjithat\u00eb, organizimi n\u00eb let\u00ebr nuk mjafton. Nj\u00eb gjykat\u00eb e parashikuar n\u00eb organik\u00eb, por e paplot\u00ebsuar me gjyqtar\u00eb, nuk \u00ebsht\u00eb funksionale n\u00eb kuptimin real t\u00eb sh\u00ebrbimit q\u00eb i detyrohemi qytetarit.<\/em><\/p>\n<p><em>Nj\u00eb sistem q\u00eb vonon vler\u00ebsimin, vonon promovimin; nj\u00eb sistem q\u00eb vonon promovimin, l\u00eb bosh gjykatat; dhe nj\u00eb sistem q\u00eb l\u00eb bosh gjykatat, prodhon backlog.<\/em><\/p>\n<p><em>P\u00ebrvoja e Gjykat\u00ebs s\u00eb Lart\u00eb \u00ebsht\u00eb nj\u00eb shembull q\u00eb duhet par\u00eb me kujdes. Kur procedurat e em\u00ebrimit dhe plot\u00ebsimit t\u00eb trup\u00ebs gjyq\u00ebsore ec\u00ebn, rezultatet u b\u00ebn\u00eb t\u00eb matshme. Gjykata e Lart\u00eb arriti t\u00eb ul\u00eb ndjesh\u00ebm stokun e \u00e7\u00ebshtjeve t\u00eb prapambetura. Ky shembull nuk duhet p\u00ebrdorur p\u00ebr vet\u00ebk\u00ebnaq\u00ebsi institucionale, por p\u00ebr nj\u00eb mesazh t\u00eb thjesht\u00eb: backlog-u nuk \u00ebsht\u00eb fatalitet; backlog-u ulet kur institucionet funksionojn\u00eb n\u00eb koh\u00eb, kur vakancat plot\u00ebsohen dhe kur organizimi i brendsh\u00ebm mb\u00ebshtetet nga vendimmarrje t\u00eb shpejta dhe t\u00eb p\u00ebrgjegjshme.<\/em><\/p>\n<p><em>Megjithat\u00eb, pik\u00ebrisht p\u00ebr shkak se p\u00ebrvoja e Gjykat\u00ebs s\u00eb Lart\u00eb tregon sa shum\u00eb ndikon plot\u00ebsimi n\u00eb koh\u00eb i trup\u00ebs gjyq\u00ebsore n\u00eb uljen e backlog-ut, duhet t\u00eb themi qart\u00eb se kjo p\u00ebrvoj\u00eb nuk mund t\u00eb mbahet si e mir\u00ebqen\u00eb n\u00ebse vendet vakante nuk plot\u00ebsohen n\u00eb koh\u00eb. Objektivat p\u00ebr uljen e \u00e7\u00ebshtjeve t\u00eb prapambetura n\u00eb k\u00ebto gjykata jan\u00eb ambicioze, por ato nuk mund t\u00eb arrihen n\u00ebse mekanizmat e karrier\u00ebs, vler\u00ebsimit dhe plot\u00ebsimit t\u00eb vakancave nuk ecin me rit\u00ebm shum\u00eb m\u00eb t\u00eb lart\u00eb.<\/em><\/p>\n<p><em>Prandaj, sot duhet t\u00eb flasim p\u00ebr masa konkrete, p\u00ebrgjegj\u00ebsi t\u00eb qarta dhe afate reale p\u00ebr p\u00ebrfundimin e vler\u00ebsimeve. \u00cbsht\u00eb e v\u00ebrtet\u00eb se procesi i vler\u00ebsimit \u00ebsht\u00eb kompleks, pasi k\u00ebrkon t\u00eb dh\u00ebna statistikore t\u00eb sakta, staf t\u00eb dedikuar, bashk\u00ebpunim me gjykatat dhe prokurorit\u00eb, administrim dokumentacioni, verifikim ankesash dhe koordinim nd\u00ebrinstitucional. T\u00eb gjitha k\u00ebto jan\u00eb arsye p\u00ebr t\u00eb vepruar m\u00eb shpejt, jo p\u00ebr t\u00eb pranuar ngadal\u00ebsin\u00eb si normalitet.<\/em><\/p>\n<p><em>KLGJ dhe KLP duhet ta trajtojn\u00eb vler\u00ebsimin etik dhe profesional si prioritet strategjik. Jo si nj\u00eb proces dyt\u00ebsor administrativ, por si nj\u00eb proces me afate t\u00eb qarta, objektiva t\u00eb matshme, p\u00ebrgjegj\u00ebsi t\u00eb p\u00ebrcaktuara dhe raportim publik periodik.<\/em><\/p>\n<p><em>Ajo q\u00eb duhet t\u00eb k\u00ebrkohet nga sot e tutje \u00ebsht\u00eb e qart\u00eb: kalimi nga konstatimi i problemit te nj\u00eb plan konkret veprimi, me p\u00ebrgjegj\u00ebsi t\u00eb ndara dhe rezultate t\u00eb matshme.<\/em><\/p>\n<p><em>S\u00eb pari, duhet nj\u00eb plan i p\u00ebrbashk\u00ebt pune, i matsh\u00ebm dhe realist, p\u00ebr eliminimin gradual t\u00eb prapambetjes s\u00eb vler\u00ebsimeve. Jo vet\u00ebm program vjetor, por kalendar i qart\u00eb me objektiva konkrete, afate, p\u00ebrgjegj\u00ebsi t\u00eb p\u00ebrcaktuara dhe raportim periodik.<\/em><\/p>\n<p><em>S\u00eb dyti, duhet forcim i kapaciteteve njer\u00ebzore t\u00eb nj\u00ebsive t\u00eb vler\u00ebsimit. Nuk mund t\u00eb k\u00ebrkojm\u00eb rit\u00ebm t\u00eb lart\u00eb pa staf t\u00eb dedikuar, t\u00eb trajnuar dhe t\u00eb mjaftuesh\u00ebm.<\/em><\/p>\n<p><em>S\u00eb treti, duhet digjitalizim real i t\u00eb dh\u00ebnave statistikore. Vler\u00ebsimi nuk mund t\u00eb mb\u00ebshtetet n\u00eb t\u00eb dh\u00ebna t\u00eb vonuara, t\u00eb paplota ose t\u00eb mbledhura manualisht me v\u00ebshtir\u00ebsi. Pa statistika t\u00eb sakta nuk ka vler\u00ebsim objektiv dhe pa vler\u00ebsim objektiv nuk ka meritokraci t\u00eb besueshme.<\/em><\/p>\n<p><em>S\u00eb kat\u00ebrti, duhet thjeshtim i metodologjis\u00eb aty ku ajo prodhon ngarkes\u00eb t\u00eb panevojshme, pa cenuar cil\u00ebsin\u00eb.
