Edhe pse riafirmon ndalimin e d\u00ebnimit pa ligj (neni 2), mungon nj\u00eb dispozit\u00eb q\u00eb t\u00eb p\u00ebrmbledh\u00eb filozofin\u00eb moderne t\u00eb s\u00eb drejt\u00ebs penale: se nd\u00ebshkimi \u00ebsht\u00eb mjeti i fundit, nd\u00ebrsa liria \u00ebsht\u00eb parimi themelor<\/span><\/p>\n<p><span style=\"color: #000000;\">V\u00ebrehet se dispozita ky\u00e7e p\u00ebrmbajn\u00eb formulime t\u00eb paqarta, q\u00eb krijojn\u00eb hap\u00ebsir\u00eb p\u00ebr interpretime t\u00eb ndryshme nga gjykatat, duke cenuar parimin nullum crimen, nulla poena sine lege certa. N\u00eb disa dispozita thelb\u00ebsore, si neni 18 q\u00eb p\u00ebrkufizon \u201cvepr\u00ebn penale\u201d, nd\u00ebrthuren n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb element\u00eb material\u00eb me nocione procedurale, duke cenuar qart\u00ebsin\u00eb dhe koherenc\u00ebn e norm\u00ebs; neni 20 e p\u00ebrcakton lidhjen shkak\u00ebsore p\u00ebrmes shprehjes \u201cprobabilitet i lart\u00eb\u201d, nd\u00ebrsa n\u00eb dispozitat q\u00eb trajtojn\u00eb p\u00ebrgatitjen, tentativ\u00ebn, bashk\u00ebpunimin dhe format e faj\u00ebsis\u00eb etj, gjuha e p\u00ebrdorur krijon paqart\u00ebsi dhe hap\u00ebsir\u00eb p\u00ebr interpretime subjektive.<\/span><\/p>\n<p><span style=\"color: #000000;\">Dispozitat q\u00eb lidhen me nd\u00ebrhyrjet n\u00eb lirin\u00eb e shprehjes dhe t\u00eb drejt\u00ebn p\u00ebr informim, si p\u00ebr shembull nenet 235, 509, 517, 863, 865 t\u00eb projektit, k\u00ebrkojn\u00eb rishikim t\u00eb kujdessh\u00ebm p\u00ebr t\u00eb mos u kthyer n\u00eb nj\u00eb nd\u00ebrhyrje t\u00eb panevojshme n\u00eb nj\u00eb shoq\u00ebri demokratike. Normat e reja duhet t\u00eb garantojn\u00eb ekuilibrin midis mbrojtjes s\u00eb autoritetit t\u00eb pushtetit gjyq\u00ebsor, t\u00eb drejtave t\u00eb t\u00eb tjer\u00ebve dhe liris\u00eb s\u00eb shprehjes, p\u00ebrfshir\u00eb t\u00eb drejt\u00ebn p\u00ebr informim.<\/span><br \/>\n<span style=\"color: #000000;\">N\u00eb projekt v\u00ebrehen gjithashtu dispozita jasht\u00ebzakonisht t\u00eb gjata me mbi dy faqe t\u00eb formatit A4, si neni 175 p\u00ebr krimet e luft\u00ebs dhe neni 224 p\u00ebr aktet terroriste, \u00e7ka p\u00ebrb\u00ebn nj\u00eb shmangie serioze nga standardet e teknik\u00ebs legjislative dhe cenon qart\u00ebsin\u00eb e ligjit penal.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb gjuh\u00eb p\u00ebrshkruese, n\u00eb vend t\u00eb nj\u00eb gjuhe normative, e dob\u00ebson funksionin kufizues t\u00eb ligjit penal dhe rrezikon ta zhvendos\u00eb gjykimin nga analiza juridike te perceptimi personal, duke e b\u00ebr\u00eb ligjin m\u00eb pak t\u00eb parashikuesh\u00ebm dhe zbatimin e tij potencialisht arbitrar. <\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb fush\u00ebn penale, ku n\u00eb loj\u00eb \u00ebsht\u00eb liria e njeriut, \u00e7do paqart\u00ebsi \u00ebsht\u00eb rrezik, sepse hap rrug\u00eb p\u00ebr interpretim ose zbatim me analogji, gj\u00eb q\u00eb \u00ebsht\u00eb e ndaluar. Prandaj k\u00ebrkohet nj\u00eb rishikim i kujdessh\u00ebm i terminologjis\u00eb dhe struktur\u00ebs s\u00eb dispozitave, q\u00eb Kodi t\u00eb jet\u00eb i qart\u00eb, i kuptuesh\u00ebm dhe i parashikuesh\u00ebm, si nj\u00eb instrument q\u00eb forcon besimin e qytetar\u00ebve te drejt\u00ebsia.<\/span><\/p>\n<p><span style=\"color: #000000;\">Koherenca sistemike dhe p\u00ebrputhshm\u00ebria evropiane<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb Kod Penal i ri nuk mund t\u00eb q\u00ebndroj\u00eb i shk\u00ebputur nga trupi i s\u00eb drejt\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Koherenca sistemike dhe p\u00ebrputhshm\u00ebria evropiane n\u00ebnkuptojn\u00eb q\u00eb \u00e7do dispozit\u00eb penale t\u00eb jet\u00eb n\u00eb harmoni me kodet dhe ligjet e tjera themelore dhe me standardet e s\u00eb drejt\u00ebs evropiane.<\/span><\/p>\n<p><span style=\"color: #000000;\"> N\u00eb disa pjes\u00eb t\u00eb projektit v\u00ebrehet nj\u00eb p\u00ebrzierje e paqart\u00eb midis dispozitave materiale dhe atyre procedurale, si dhe mosp\u00ebrputhje me Kodin Civil, Kodin e Procedur\u00ebs Penale dhe ligjet e tjera. Disa nene q\u00eb trajtojn\u00eb \u00e7\u00ebshtje t\u00eb natyr\u00ebs procedurale, si ato p\u00ebr masat mjek\u00ebsore dhe edukuese ndaj t\u00eb miturve (nenet 116\u2013120), p\u00ebr lirimin me kusht (nenet 175\u2013176) apo pezullimin e veprimtaris\u00eb s\u00eb personave juridik\u00eb (neni 125), duhen rregulluar n\u00eb Kodin e Procedur\u00ebs Penale, jo n\u00eb Kodin Penal.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu, neni 546 q\u00eb parashikon vepr\u00ebn e vet\u00ebgjyq\u00ebsis\u00eb p\u00ebrs\u00ebrit rregullime q\u00eb tashm\u00eb trajtohen nga Kodi Civil, nd\u00ebrsa neni 539, p\u00ebr mosparaqitjen n\u00eb seanc\u00eb gjyq\u00ebsore, trajton \u00e7\u00ebshtje q\u00eb jan\u00eb objekt i legjislacionit disiplinor p\u00ebr gjyqtar\u00ebt, prokuror\u00ebt dhe avokat\u00ebt. Po ashtu, p\u00ebrfshirja e disa shkeljeve t\u00eb Kodit Rrugor si vepra penale krijon dublim normativ dhe e ngarkon pa nevoj\u00eb sistemin penal.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebto raste tregojn\u00eb munges\u00eb koherence nd\u00ebrkodike, q\u00eb c\u00ebnon integritetin e sistemit dhe zbatimin e unifikuar t\u00eb ligjit. Nj\u00eb Kod Penal modern duhet t\u00eb jet\u00eb i lidhur organikisht me rendin juridik dhe n\u00eb p\u00ebrputhje me standardet evropiane p\u00ebr proporcionalitetin dhe parashikueshm\u00ebrin\u00eb. <\/span><\/p>\n<p><span style=\"color: #000000;\">Vet\u00ebm nj\u00eb kod i till\u00eb, i integruar dhe i harmonizuar me parimet evropiane, mund t\u00eb garantoj\u00eb siguri juridike dhe besueshm\u00ebri n\u00eb procesin e integrimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Dekriminalizimi dhe kufijt\u00eb e nd\u00ebrhyrjes penale \u2013 parimi i \u201cultima ratio\u201d<\/span><br \/>\n<span style=\"color: #000000;\">Shteti nd\u00ebshkon vet\u00ebm kur nuk ka mjete t\u00eb tjera p\u00ebr t\u00eb parandaluar.<\/span><br \/>\n<span style=\"color: #000000;\">Ky \u00ebsht\u00eb themeli i \u00e7do sistemi penal modern: nd\u00ebshkimi si mjet i fundit, jo si zgjidhje e par\u00eb. Ligji penal nuk duhet t\u00eb nd\u00ebrhyj\u00eb atje ku mjetet administrative, civile apo disiplinore jan\u00eb t\u00eb mjaftueshme p\u00ebr t\u00eb korrigjuar sjelljen. N\u00eb projektkod, ky parim nuk del qart\u00eb si filozofi udh\u00ebheq\u00ebse. P\u00ebrkundrazi, neni 3 zgjeron pa kriter fush\u00ebn e nd\u00ebrhyrjes penale, duke p\u00ebrfshir\u00eb sjellje q\u00eb n\u00eb sistemet evropiane trajtohen p\u00ebrmes p\u00ebrgjegj\u00ebsis\u00eb administrative ose civile. Disa dispozita, si nenet 599\u2013604 p\u00ebr detyrimet tatimore e fiskale, parashikojn\u00eb nd\u00ebshkime penale p\u00ebr vonesa n\u00eb pagesa mbi baz\u00eb vet\u00ebdeklarimi, mosparaqitje informacioni apo mosmbajtje dokumentacioni, sjellje q\u00eb duhet t\u00eb mbeten n\u00eb sfer\u00ebn administrative, p\u00ebr sa koh\u00eb nuk p\u00ebrb\u00ebjn\u00eb mashtrim apo fshehje t\u00eb q\u00ebllimshme. Neni 651, q\u00eb sanksionon mbajtjen e padrejt\u00eb t\u00eb dy cil\u00ebsive n\u00eb funksione publike, p\u00ebrb\u00ebn \u00e7\u00ebshtje disiplinore, jo penale. Po k\u00ebshtu, neni 667 p\u00ebr shkeljen e rregullave t\u00eb siguris\u00eb n\u00eb pun\u00eb dublon norma ekzistuese p\u00ebr \u201cvrasje apo plagosje nga pakujdesia\u201d duke ngat\u00ebrruar p\u00ebrgjegj\u00ebsin\u00eb profesionale me at\u00eb penale. Ve\u00e7an\u00ebrisht shqet\u00ebsuese jan\u00eb neni 301 q\u00eb p\u00ebrfshin konfliktin e interesit si vep\u00ebr penale, megjith\u00ebse kjo rregullohet nga ligji administrativ, dhe neni 522 \u201cDh\u00ebnia e vendimit n\u00eb keqbesim\u201d, i cili, n\u00eb munges\u00eb kriteresh t\u00eb qarta, rrezikon t\u00eb c\u00ebnoj\u00eb pavar\u00ebsin\u00eb e gjyq\u00ebsorit dhe t\u00eb shnd\u00ebrrohet n\u00eb nj\u00eb mjet presioni ndaj gjykat\u00ebs.<\/span><br \/>\n<span style=\"color: #000000;\">Nj\u00eb sistem penal i drejt\u00eb nuk matet me numrin e veprave t\u00eb reja, por me racionalitetin e kufizimit t\u00eb nd\u00ebrhyrjes. Ligji penal duhet t\u00eb veproj\u00eb vet\u00ebm kur \u00e7do mjet tjet\u00ebr d\u00ebshton. Vet\u00ebm at\u00ebher\u00eb ai \u00ebsht\u00eb shprehje e drejt\u00ebsis\u00eb, jo e forc\u00ebs s\u00eb shtetit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Filozofia humane e drejt\u00ebsis\u00eb penale<\/span><br \/>\n<span style=\"color: #000000;\">Q\u00ebllimi i d\u00ebnimit nuk \u00ebsht\u00eb hakmarrja, por rikthimi i njeriut n\u00eb shoq\u00ebri.<\/span><br \/>\n<span style=\"color: #000000;\">Sistemet moderne penale nd\u00ebrtohen mbi parimin e humanizmit dhe risocializimit, mbi iden\u00eb se shteti nd\u00ebshkon p\u00ebr t\u00eb korrigjuar, jo p\u00ebr t\u00eb shkat\u00ebrruar. Suksesi i nj\u00eb sistemi penal nuk matet me ashp\u00ebrsin\u00eb e d\u00ebnimeve, por me aft\u00ebsin\u00eb p\u00ebr t\u00eb kthyer individin n\u00eb pjes\u00eb t\u00eb dobishme t\u00eb shoq\u00ebris\u00eb. N\u00eb k\u00ebt\u00eb kuptim, neni 64 i projektit p\u00ebrmend riintegrimin e t\u00eb d\u00ebnuarit, por e kufizon at\u00eb vet\u00ebm n\u00eb faz\u00ebn e vuajtjes s\u00eb d\u00ebnimit, duke e trajtuar si detaj teknik e jo si filozofi q\u00eb duhet t\u00eb p\u00ebrshkoj\u00eb gjith\u00eb struktur\u00ebn e Kodit. Projekti, n\u00eb vend q\u00eb t\u00eb nd\u00ebrtohet mbi humaniz\u00ebm, zgjeron logjik\u00ebn nd\u00ebshkuese: neni 72 dhe neni 151 e \u00e7ojn\u00eb burgimin maksimal deri n\u00eb 45 vjet, duke devijuar nga standardet evropiane dhe duke e kthyer d\u00ebnimin maksimal n\u00eb koncept t\u00eb pafund. Rritja e p\u00ebrgjithshme e d\u00ebnimeve dhe mungesa e fleksibilitetit n\u00eb caktimin e tyre rrezikon ta zhvendos\u00eb drejt\u00ebsin\u00eb nga humanizmi drejt form\u00ebsimit mekanik.<\/span><br \/>\n<span style=\"color: #000000;\">D\u00ebnimi nuk mund t\u00eb jet\u00eb formul\u00eb aritmetike; ai k\u00ebrkon gjykim njer\u00ebzor, ndjeshm\u00ebri dhe balanc\u00eb. Tendenca p\u00ebr t\u00eb paracaktuar numrin dhe llojin e d\u00ebnimeve plot\u00ebsuese e kufizon rolin e gjykat\u00ebs n\u00eb individualizimin e nd\u00ebshkimit. Risocializimi duhet t\u00eb jet\u00eb parim themelor i Kodit, jo thjesht faz\u00eb e ekzekutimit. Nj\u00eb Kod Penal me filozofi humane duhet t\u00eb ruaj\u00eb ekuilibrin mes mbrojtjes s\u00eb shoq\u00ebris\u00eb dhe dinjitetit njer\u00ebzor, duke e par\u00eb d\u00ebnimin si mjet drejt\u00ebsie, jo shenj\u00eb t\u00eb forc\u00ebs s\u00eb shtetit. P\u00ebrndryshe, drejt\u00ebsia rrezikon t\u00eb kthehet n\u00eb nj\u00eb mjet frike, jo besimi. Nj\u00eb sistem q\u00eb nd\u00ebshkon mekanikisht dhe pa hap\u00ebsir\u00eb p\u00ebr arsyetim njer\u00ebzor, nuk edukon, por d\u00ebmton besimin qytetar. Qytetari duhet ta shoh\u00eb ligjin si mbrojtje, jo si k\u00ebrc\u00ebnim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Proporcionaliteti dhe diskrecioni gjyq\u00ebsor<\/span><br \/>\n<span style=\"color: #000000;\">Drejt\u00ebsia k\u00ebrkon baraspesh\u00eb: d\u00ebnimi duhet t\u00eb jet\u00eb i drejt\u00eb, jo thjesht i rrept\u00eb.<\/span><br \/>\n<span style=\"color: #000000;\">Nj\u00eb nga problematikat m\u00eb t\u00eb ndjeshme t\u00eb projektit \u00ebsht\u00eb tendenca drejt d\u00ebnimeve fikse, q\u00eb cenon parimin kushtetues t\u00eb individualizimit t\u00eb d\u00ebnimit. Kjo prirje e kufizon diskrecionin gjyq\u00ebsor dhe e dob\u00ebson aft\u00ebsin\u00eb e gjykat\u00ebs p\u00ebr t\u00eb dh\u00ebn\u00eb nj\u00eb d\u00ebnim t\u00eb drejt\u00eb dhe t\u00eb arsyetuar sipas rrethanave konkrete.<\/span><br \/>\n<span style=\"color: #000000;\">Nj\u00ebkoh\u00ebsisht, me rritjen e kufirit maksimal n\u00eb 45 vjet dhe me shtimin e formulave fikse, projekti e b\u00ebn sistemin m\u00eb t\u00eb ashp\u00ebr dhe m\u00eb pak fleksib\u00ebl. Kjo prirje e zhvendos v\u00ebmendjen nga cil\u00ebsia e drejt\u00ebsis\u00eb te sasia e nd\u00ebshkimit. N\u00eb disa dispozita, d\u00ebnimi nuk \u00ebsht\u00eb m\u00eb rezultat i gjykimit individual, por i nj\u00eb formule t\u00eb paracaktuar q\u00eb e redukton gjyqtarin n\u00eb zbatues mekanik t\u00eb ligjit. K\u00ebshtu, neni 139 parashikon ulje t\u00eb fiksuara p\u00ebr rrethanat leht\u00ebsuese, dhe neni 141 p\u00ebrcakton shtesa t\u00eb detyrueshme p\u00ebr rrethanat r\u00ebnduese. Vet\u00ebm duke garantuar diskrecion gjyq\u00ebsor t\u00eb arsyesh\u00ebm dhe duke shmangur formulat fikse, ligji penal mund t\u00eb siguroj\u00eb drejt\u00ebsi reale dhe humane.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb nderuar pjes\u00ebmarr\u00ebs,<\/span><br \/>\n<span style=\"color: #000000;\">Nj\u00eb reform\u00eb penale pa metod\u00eb dhe reflektim nuk \u00ebsht\u00eb reform\u00eb, por rrezikon t\u00eb kthehet n\u00eb nj\u00eb ndryshim pa p\u00ebrmbajtje. Ajo duhet t\u00eb ngrihet mbi tri shtylla themelore: metod\u00eb, transparenc\u00eb dhe mir\u00ebbesim institucional. Kjo nuk \u00ebsht\u00eb thirrje p\u00ebr ndalim, por ftes\u00eb p\u00ebr p\u00ebrmir\u00ebsim e bashk\u00ebpunim, sepse vet\u00ebm nj\u00eb reform\u00eb e nd\u00ebrtuar mbi mir\u00ebbesim mund t\u00eb sjell\u00eb drejt\u00ebsi q\u00eb afron, jo q\u00eb nd\u00ebshkon; q\u00eb forcon besimin te ligji dhe te shteti, jo frik\u00ebn ndaj tyre.<\/span><br \/>\n<span style=\"color: #000000;\">Gjykata e Lart\u00eb mbetet e angazhuar t\u00eb kontribuoj\u00eb me p\u00ebrvoj\u00ebn dhe ekspertiz\u00ebn e saj n\u00eb k\u00ebt\u00eb proces, si partner institucional n\u00eb nd\u00ebrtimin e nj\u00eb sistemi penal modern, t\u00eb drejt\u00eb dhe t\u00eb q\u00ebndruesh\u00ebm.
