ofertat e p\u00ebrmbajtura, n\u00eb rastet kur konkurrent\u00ebt bien dakord q\u00eb t\u00eb mos ofertojn\u00eb apo t\u00eb t\u00ebrhiqen nga nj\u00eb ofert\u00eb e paraqitur n\u00eb m\u00ebnyr\u00eb q\u00eb oferta e p\u00ebrcaktuar fituese n\u00eb marr\u00ebveshje t\u00eb pranohet si e till\u00eb; ofertat n\u00eb rotacion, kur konkurrent\u00ebt merren vesh t\u00eb ofertojn\u00eb, duke r\u00ebn\u00eb dakord paraprakisht q\u00eb fituesi t\u00eb jet\u00eb nj\u00ebri prej tyre sipas nj\u00eb radhe t\u00eb caktuar; ndarja e tregut, fenomen i cili ndodh kur konkurrent\u00ebt ndajn\u00eb n\u00eb pjes\u00eb tregun dhe bien dakord q\u00eb t\u00eb mos konkurrojn\u00eb p\u00ebr nj\u00eb pjes\u00eb t\u00eb caktuar konsumator\u00ebsh, ose nj\u00eb pjes\u00eb t\u00eb caktuar gjeografike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Projektligji i shton shprehimisht edhe kategorit\u00eb e marr\u00ebveshjeve n\u00eb oferta n\u00eb procedurat e prokurimit si marr\u00ebveshje t\u00eb ndaluara.<\/span><\/p>\n<p><span style=\"color: #000000;\">Projektligji parashikon edhe ngritjen e sistemit t\u00eb menaxhimit t\u00eb informacionit t\u00eb Autoritetit t\u00eb Konkurrenc\u00ebs, q\u00eb do t\u00eb nd\u00ebrveproj\u00eb me bazat e t\u00eb dh\u00ebnave t\u00eb Drejtoris\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Tatimeve, Drejtoris\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Doganave, Qendr\u00ebs Komb\u00ebtare t\u00eb Biznesit dhe Agjencis\u00eb s\u00eb Prokurimit Publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Tregu i prokurimeve publike \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb disa raste objekt i hetimeve t\u00eb Autoritetit t\u00eb Konkurrenc\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Disa prej formave t\u00eb marr\u00ebveshjes n\u00eb oferta, t\u00eb p\u00ebrkufizuara m\u00eb lart, jan\u00eb b\u00ebr\u00eb objekt dyshimesh nga opozita dhe media n\u00eb vitet e fundit, ve\u00e7an\u00ebrisht n\u00eb tenderat e infrastruktur\u00ebs rrugore, kur ndodh q\u00eb disa kompani ndajn\u00eb me nj\u00ebra-tjetr\u00ebn lotet e punimeve, duke konkurruar n\u00eb m\u00ebnyr\u00eb fiktive me nj\u00ebra-tjetr\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb p\u00ebrmbajtjen e ligjit n\u00eb fjal\u00eb do t\u00eb shtohet gjithashtu koncepti i praktik\u00ebs s\u00eb bashk\u00ebrenduar, q\u00eb p\u00ebrkufizohet se koordinimi nd\u00ebrmjet nd\u00ebrmarrjeve t\u00eb cilat, pa arritur n\u00eb faz\u00ebn e lidhjes s\u00eb nj\u00eb marr\u00ebveshjeje formale, bashk\u00ebpunojn\u00eb me vet\u00ebdije n\u00eb praktik\u00eb duke kufizuar, deformuar ose shtremb\u00ebruar konkurrenc\u00ebn n\u00eb treg.<\/span><\/p>\n<p><span style=\"color: #000000;\">Projektligji parashikon zgjatjen e afatit q\u00eb subjektet kan\u00eb p\u00ebr t\u00eb ankimuar n\u00eb gjykat\u00eb vendimet e Autoritetit t\u00eb Konkurrenc\u00ebs, nga 30 n\u00eb 45 dit\u00eb. Por, n\u00eb ndryshim nga ligji aktual, projektligji p\u00ebrcakton se subjektet nuk do t\u00eb ken\u00eb t\u00eb drejt\u00eb p\u00ebr t\u00eb ankimuar n\u00eb gjykat\u00eb vendimet e Komisionit t\u00eb Konkurrenc\u00ebs p\u00ebr hapjen e hetimit paraprak.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb, projektligji p\u00ebrmban p\u00ebr her\u00eb t\u00eb par\u00eb edhe parashikime t\u00eb qarta p\u00ebr afatet e parashkrimit p\u00ebr vendosjen e gjobave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Afatet e parashkrimit p\u00ebr vendosjen e gjobave do t\u00eb jen\u00eb 3 vjet n\u00eb rastin e shkeljeve t\u00eb dispozitave n\u00eb lidhje me k\u00ebrkesat p\u00ebr informacion ose me zhvillimin e inspektimeve dhe 5 vjet n\u00eb rastin e t\u00eb gjitha shkeljeve t\u00eb tjera.<\/span><\/p>\n<p><span style=\"color: #000000;\">Afati i parashkrimit llogaritet q\u00eb nga dita n\u00eb t\u00eb cil\u00ebn \u00ebsht\u00eb kryer shkelja. N\u00eb rastin e shkeljeve t\u00eb vazhdueshme ose t\u00eb p\u00ebrs\u00ebritura, parashkrimi duhet t\u00eb filloj\u00eb t\u00eb llogaritet nga dita n\u00eb t\u00eb cil\u00ebn shkelja nd\u00ebrpritet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Projektligji propozon gjithashtu nj\u00eb ndryshim t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb pavar\u00ebsin\u00eb financiare t\u00eb Autoritetit t\u00eb Konkurrenc\u00ebs.
