M\u00eb shum\u00eb m\u00eb kan\u00eb t\u00ebrhequr ato t\u00eb ERRE, AKEP, ERRU, Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb apo Autoritetit t\u00eb Mbik\u00ebqyrjes Financiare. Por sot, me distanc\u00eb dhe p\u00ebrvoj\u00eb konkrete me sistemin e drejt\u00ebsis\u00eb, m\u00eb \u00ebsht\u00eb b\u00ebr\u00eb e qart\u00eb se Kuvendi i Shqip\u00ebris\u00eb ka d\u00ebshtuar p\u00ebr dy vite rresht me raportimet e institucioneve t\u00eb pavarura si KLGJ, KLP, ILD, etj.<br \/>\nDrejtuesit e k\u00ebtyre institucioneve iu shmang\u00ebn p\u00ebrgjigjeve p\u00ebr pyetjet konkrete, sepse jan\u00eb t\u00eb pavarur. Dhe, n\u00eb nj\u00eb far\u00eb m\u00ebnyre, kan\u00eb t\u00eb drejt\u00eb. Aq m\u00eb tep\u00ebr kur vet\u00eb ata q\u00eb u kan\u00eb dh\u00ebn\u00eb me vot\u00eb pavar\u00ebsin\u00eb, nuk mund t\u00eb jen\u00eb ata q\u00eb ua cenojn\u00eb.<br \/>\nKa edhe deputet\u00eb q\u00eb fshihen pas t\u00eb nj\u00ebjtit justifikim: \u201cjan\u00eb institucione t\u00eb pavarura, nuk duhen ngacmuar.\u201d<br \/>\nPor pavar\u00ebsia nuk do t\u00eb thot\u00eb munges\u00eb llogaridh\u00ebnieje. N\u00ebse ligji ua ka dh\u00ebn\u00eb k\u00ebt\u00eb pavar\u00ebsi, Kuvendi ka detyrimin ligjor dhe moral t\u00eb verifikoj\u00eb si po ushtrohet ajo pavar\u00ebsi.<br \/>\nNuk jam jurist, por p\u00ebrvoja n\u00eb jet\u00ebn publike dhe p\u00ebrballja e viteve t\u00eb fundit me drejt\u00ebsin\u00eb m\u00eb kan\u00eb ndihmuar t\u00eb p\u00ebrpiloj nj\u00eb list\u00eb pyetjesh joshteruese, por thelb\u00ebsore, q\u00eb Kuvendi d\u00ebshtoi t\u2019i b\u00ebj\u00eb.<br \/>\nI. Pyetje t\u00eb p\u00ebrgjithshme dhe institucionale<br \/>\n1. Si \u00ebsht\u00eb e mundur q\u00eb nuk u trajtua fare \u00e7\u00ebshtja e p\u00ebrgjimit t\u00eb an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese? A u hetua kush e urdh\u00ebroi, si u krye dhe a u respektuan garancit\u00eb ligjore? Pavar\u00ebsia e gjyqtar\u00ebve kushtetues nuk mbron vet\u00ebm disa individ\u00eb, por mbron baraspesh\u00ebn e gjith\u00eb sistemit.<br \/>\n2. Si \u00ebsht\u00eb e mundur q\u00eb Apeli i GJKKO-s\u00eb nuk zbaton vendimet e Gjykat\u00ebs Kushtetuese? Kur Kushtetuta thot\u00eb se vendimet e saj jan\u00eb \u201ct\u00eb detyrueshme p\u00ebr zbatim t\u00eb menj\u00ebhersh\u00ebm\u201d, kush mban p\u00ebrgjegj\u00ebsi p\u00ebr moszbatimin e tyre?<br \/>\n3. Si \u00ebsht\u00eb e mundur q\u00eb prej gjasht\u00eb vitesh KLGJ nuk ka em\u00ebruar asnj\u00eb kryetar gjykate, por t\u00eb gjitha jan\u00eb me drejtues t\u00eb komanduar? Komandimi i p\u00ebrhersh\u00ebm \u00ebsht\u00eb kontradikt\u00eb. Pa drejtues t\u00eb q\u00ebndruesh\u00ebm, s\u2019ka as vizion, as llogaridh\u00ebnie.<br \/>\n4. Si \u00ebsht\u00eb e mundur q\u00eb kolegje t\u00eb ndryshme penale t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb japin vendime t\u00eb kund\u00ebrta p\u00ebr t\u00eb nj\u00ebjt\u00ebn \u00e7\u00ebshtje juridike dhe Gjykata nuk nxiton t\u00eb nxjerr\u00eb vendim nj\u00ebsues? Kur praktika p\u00ebr\u00e7ahet, drejt\u00ebsia b\u00ebhet lotari.<br \/>\n5. Si \u00ebsht\u00eb e mundur q\u00eb pas gjasht\u00eb vitesh funksionimi, Prokuroria e Posa\u00e7me ende nuk ka kuptuar qart\u00eb kush \u00ebsht\u00eb \u201cfunksionar i lart\u00eb\u201d sipas Kushtetut\u00ebs dhe Kodit t\u00eb Procedur\u00ebs Penale? Sa vendime t\u00eb Gjykat\u00ebs s\u00eb Posa\u00e7me jan\u00eb rr\u00ebzuar pik\u00ebrisht sepse akuzat jan\u00eb ngritur ndaj personash q\u00eb nuk hynin n\u00eb kategorin\u00eb e funksionar\u00ebve t\u00eb lart\u00eb? Pavar\u00ebsisht kompetenc\u00ebs materiale, kompetenca personale nuk mund t\u00eb shpiket p\u00ebr raportim statistikor.<br \/>\n6. Si \u00ebsht\u00eb e mundur q\u00eb pragu financiar p\u00ebr t\u00eb kualifikuar nj\u00eb vep\u00ebr penale si \u201cme pasoja t\u00eb r\u00ebnda\u201d ende mb\u00ebshtetet n\u00eb nj\u00eb vendim nj\u00ebsues t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb t\u00eb vitit 2003? N\u00eb nj\u00eb vend ku \u00e7mimet, kostot dhe pagat jan\u00eb rritur disa her\u00eb, drejt\u00ebsia vazhdon t\u00eb gjykoj\u00eb me \u201cvler\u00ebn e paras\u00eb\u201d s\u00eb para 22 viteve. Sa \u00ebsht\u00eb rritur nd\u00ebrkoh\u00eb paga vjetore e vet\u00eb prokuror\u00ebve q\u00eb zbatojn\u00eb ende at\u00eb prag? N\u00ebse ligji nuk ec\u00ebn me koh\u00ebn, drejt\u00ebsia ngelet n\u00eb muze.<br \/>\n7. Sipas nenit 222 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale, p\u00ebrgjimet lejohen me vendim gjykate p\u00ebr nj\u00eb periudh\u00eb 15-ditore dhe mund t\u00eb zgjaten vet\u00ebm me nj\u00eb vendim tjet\u00ebr, po aq t\u00eb arsyetuar. Por kur pas disa 15-dit\u00ebsh radhazi p\u00ebrgjimet nuk evidentojn\u00eb asgj\u00eb t\u00eb dyshimt\u00eb, pse gjykata miraton k\u00ebmb\u00ebnguljen e verb\u00ebr t\u00eb prokuroris\u00eb p\u00ebr t\u2019i vazhduar? Ligji k\u00ebrkon \u201carsyetim t\u00eb posa\u00e7\u00ebm\u201d, jo \u201cmiratim rutin\u00eb\u201d. P\u00ebrndryshe, kontrolli gjyq\u00ebsor humbet kuptimin dhe p\u00ebrjashtimi kthehet n\u00eb norm\u00eb.<br \/>\n8. Pse \u00ebsht\u00eb shnd\u00ebrruar p\u00ebrjashtimi i nenit 223\/3 t\u00eb K.Pr.P. (shtyrja e depozitimit t\u00eb proceseve t\u00eb p\u00ebrgjimit) n\u00eb rregull t\u00eb p\u00ebrgjithsh\u00ebm? N\u00eb \u00e7do k\u00ebrkes\u00eb t\u00eb par\u00eb k\u00ebrkohet q\u00eb procesverbalet t\u00eb mos depozitohen p\u00ebr pes\u00eb dit\u00eb, por \u201cderi n\u00eb fund t\u00eb hetimeve\u201d. P\u00ebrjashtimi nuk \u00ebsht\u00eb m\u00eb p\u00ebrjashtim, por \u00ebsht\u00eb kthyer n\u00eb praktik\u00eb t\u00eb q\u00ebndrueshme, duke hequr \u00e7do kontroll real t\u00eb gjykat\u00ebs.<br \/>\n9. Si \u00ebsht\u00eb e mundur q\u00eb afati 15-ditor i p\u00ebrcaktuar n\u00eb nenin 110 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale p\u00ebr t\u2019u shprehur me vendim mbi k\u00ebrkesat e mbrojtjes shkelet haptazi nga prokurorit\u00eb, pa asnj\u00eb pasoj\u00eb? Kur vet\u00eb organi q\u00eb k\u00ebrkon zbatimin rigoroz t\u00eb ligjit e shkel at\u00eb me heshtje procedurale, \u00e7do garanci b\u00ebhet formale. Ligji nuk \u00ebsht\u00eb \u201corientues\u201d. \u00cbsht\u00eb detyrim.<br \/>\n10. Si \u00ebsht\u00eb e mundur q\u00eb tarifa p\u00ebr nj\u00eb faqe fotokopje n\u00eb Prokurorin\u00eb e Posa\u00e7me t\u00eb jet\u00eb 6.6 lek\u00eb p\u00ebr qytetarin, nd\u00ebrsa vet\u00ebm 2.2 lek\u00eb p\u00ebr gjykat\u00ebn? N\u00eb nj\u00eb sistem drejt\u00ebsie q\u00eb predikon barazi para ligjit, si justifikohet q\u00eb vet\u00eb shteti paguan tri her\u00eb m\u00eb pak se pala q\u00eb mbron veten? Tarifa me p\u00ebrkufizim duhet t\u00eb mbuloj\u00eb kostot. Pak r\u00ebnd\u00ebsi ka kush e k\u00ebrkon sh\u00ebrbimin.<br \/>\nII. Pyetje teknike dhe procedurale<br \/>\n11. Si \u00ebsht\u00eb e mundur q\u00eb prokurorit\u00eb anashkalojn\u00eb jurisprudenc\u00ebn e detyrueshme p\u00ebr provat digjitale? Po p\u00ebrmend disa prej tyre: Vendimi nj\u00ebsues i Gjykat\u00ebs s\u00eb Lart\u00eb nr. 147, dat\u00eb 23.12.2021, \u201cLapsi.al\u201d; Vendimi i Gjykat\u00ebs Kushtetuese nr. 21, dat\u00eb 24.04.2025, \u201cE.Q.\u201d; Vendimi i Gjykat\u00ebs Kushtetuese, korrik 2025, \u201cO.Y.\u201d. K\u00ebto nuk jan\u00eb opinione, por standarde t\u00eb detyrueshme.<br \/>\n12. Si \u00ebsht\u00eb e mundur q\u00eb prokurorit\u00eb i k\u00ebrkojn\u00eb t\u00eb dh\u00ebna personale kompanive celulare pa vendim gjykate, n\u00eb kund\u00ebrshtim me nenet 208\/a dhe 209 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale? Privat\u00ebsia nuk mund t\u00eb shkelet me \u201clet\u00ebr k\u00ebrkese\u201d.<br \/>\n13. Si \u00ebsht\u00eb e mundur q\u00eb k\u00ebrkohen t\u00eb dh\u00ebna p\u00ebr korrespondenc\u00ebn postare pa vendim gjykate, n\u00eb kund\u00ebrshtim me nenin 209 t\u00eb K.Pr.P.? Posta nuk \u00ebsht\u00eb kuti e hapur p\u00ebr \u00e7do prokuror t\u00eb zellsh\u00ebm.<br \/>\n14. Si \u00ebsht\u00eb e mundur q\u00eb prokurorit\u00eb k\u00ebrkojn\u00eb t\u00eb dh\u00ebna p\u00ebr korrespondenc\u00ebn elektronike nga AKSHI pa vendim gjykate (nenet 208\/a dhe 209 K.Pr.P.)? Shteti nuk mund t\u2019i k\u00ebrkoj\u00eb nj\u00eb institucioni shtet\u00ebror t\u00eb shkel\u00eb t\u00eb nj\u00ebjtin ligj q\u00eb duhet t\u00eb zbatoj\u00eb.<br \/>\n15. Si \u00ebsht\u00eb e mundur q\u00eb k\u00ebrkesat p\u00ebr sekuestrim sendesh formulohen n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrgjithshme: \u201cpajisje elektronike si kompjuter\u00eb, laptop\u00eb, hard disqe, USB, servera, aparate telefoni, pavar\u00ebsisht kujt i p\u00ebrkasin\u201d, dhe gjykatat i miratojn\u00eb pa asnj\u00eb kufizim? K\u00ebto jan\u00eb \u201ccartabianca\u201d q\u00eb bien ndesh me nenin 207 t\u00eb K.Pr.P., i cili k\u00ebrkon p\u00ebrcaktim konkret t\u00eb sendeve q\u00eb mund t\u00eb sekuestrohen.<br \/>\n16. Kur do t\u00eb ndalojn\u00eb prokurorit\u00eb dhe gjykatat s\u00eb shkeluri haptazi Konvent\u00ebn e Budapestit, t\u00eb ratifikuar me ligjin nr. 8888\/2002? Standardet ekzistojn\u00eb, thjesht mungon vullneti p\u00ebr t\u2019i zbatuar.<br \/>\n17. Kur do t\u00eb pajisen laborator\u00ebt e kriminalistik\u00ebs me standardet ISO q\u00eb k\u00ebrkojn\u00eb udh\u00ebzuesit e K\u00ebshillit t\u00eb Evrop\u00ebs dhe t\u00eb GJEDNJ-s\u00eb p\u00ebr provat elektronike? T\u00eb pakt\u00ebn ISO\/IEC 27037 dhe ISO\/IEC 27042 jan\u00eb parakusht p\u00ebr \u00e7do hetim t\u00eb besuesh\u00ebm digjital.<br \/>\n18. Kur do t\u00eb ndalojn\u00eb laborator\u00ebt s\u00eb p\u00ebrdoruri algoritme hash t\u00eb papranueshme si SHA-1 apo MD5? Mjafton nj\u00eb k\u00ebrkim i thjesht\u00eb n\u00eb \u201cGoogle\u201d p\u00ebr t\u00eb m\u00ebsuar se jan\u00eb t\u00eb cenueshme. Integriteti i prov\u00ebs digjitale nuk mund t\u00eb mbrohet me teknologji t\u00eb viteve 2000. Minimalisht, standardizohet SHA-256\/SHA-3, me zinxhir t\u00eb plot\u00eb ruajtjeje.<br \/>\n19. Kur do t\u00eb akreditohen laborator\u00ebt tan\u00eb t\u00eb kriminalistik\u00ebs? Pa akreditim sipas ISO\/IEC 17025, \u00e7do raport ekspertize mbetet i diskutuesh\u00ebm dhe drejt\u00ebsia s\u2019ka dot siguri mbi provat q\u00eb p\u00ebrdor.<br \/>\nKjo list\u00eb, sigurisht, nuk \u00ebsht\u00eb e plot\u00eb. Por edhe kaq mjafton p\u00ebr t\u00eb treguar se Kuvendi nuk mund t\u00eb mjaftohet me d\u00ebgjime formale. Duhet t\u00eb th\u00ebrras\u00eb jo vet\u00ebm KLGJ, KLP e ILD, por edhe Dhom\u00ebn e Avokatis\u00eb si pal\u00eb t\u00eb interesuar. T\u00eb k\u00ebrkoj\u00eb p\u00ebrgjigje konkrete, afate dhe masa korrigjuese dhe pastaj t\u00eb k\u00ebrkoj\u00eb llogari n\u00eb raportimin e ardhsh\u00ebm.<br \/>\nE di se pas k\u00ebtij sh\u00ebnimi do t\u00eb m\u00eb thon\u00eb:<br \/>\n\u201cShih pun\u00ebn t\u00ebnde e mos na jep mend.\u201d<br \/>\n\u201cPo e thua tani, se ke hallin t\u00ebnd.\u201d<br \/>\n\u201cTi ke qen\u00eb vet\u00eb aty kur u miratuan ligjet e reform\u00ebs, s\u2019ke pse ankohesh tani.\u201d<br \/>\nMund t\u00eb ken\u00eb t\u00eb drejt\u00eb n\u00eb nj\u00eb pjes\u00eb. Por r\u00ebnd\u00ebsi nuk ka kush i thot\u00eb k\u00ebto gj\u00ebra.
