Prej fundit t\u00eb muajit korrik drafti \u00ebsht\u00eb publikuar n\u00eb faqen e Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb dhe ka hyr\u00eb n\u00eb faz\u00ebn e konsultimeve.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb par\u00eb konsultimesh Profesionist\u00ebt e Aleanc\u00ebs t\u00eb Profesionist\u00ebve t\u00eb Lir\u00eb (APL) n\u00ebp\u00ebrmjet nj\u00eb letre d\u00ebrguar ministrit t\u00eb Drejt\u00ebsis\u00eb Ulsi Manja kan\u00eb k\u00ebrkuar rishikim t\u00eb kujdessh\u00ebm t\u00eb dispozitave problematike, duke theksuar nevoj\u00ebn p\u00ebr respektim t\u00eb parimit t\u00eb proporcionalitetit dhe mbrojtje t\u00eb lirive ekonomike dhe liris\u00eb s\u00eb fjal\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke ngritur shqet\u00ebsimin p\u00ebr zgjerimin e panevojsh\u00ebm t\u00eb nd\u00ebrhyrjes penale n\u00eb fusha q\u00eb tradicionalisht jan\u00eb trajtuar nga e drejta civile apo administrative, APL sjell n\u00eb v\u00ebmendje disa nene q\u00eb sipas tyre mund t\u00eb sjellin pasoja negative n\u00eb marr\u00ebdh\u00ebniet mes bizneseve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 537, q\u00eb penalizon \u201ctarifat e pap\u00ebrshtatshme t\u00eb sh\u00ebrbimit\u201d, duhet t\u00eb rishikohet me prioritet, pasi n\u00eb nj\u00eb ekonomi tregu, \u00e7mimet p\u00ebrcaktohen nga marr\u00ebdh\u00ebnia k\u00ebrkes\u00eb\u2013ofert\u00eb dhe natyra e sh\u00ebrbimit, jo nga sanksione penale. Ekspert\u00ebt tan\u00eb jan\u00eb angazhuar tashm\u00eb n\u00eb analizimin e dispozitave t\u00eb propozuara dhe kemi nisur identifikimin e fushave ku nevojiten qart\u00ebsime, harmonizim me legjislacionin ekzistues dhe p\u00ebrafrim me standardet nd\u00ebrkomb\u00ebtare, e sidomos t\u00eb Bashkimit Europian, ku ne po b\u00ebjm\u00eb p\u00ebrpjekje p\u00ebr t\u2019u b\u00ebr\u00eb pjes\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ne mbetemi t\u00eb gatsh\u00ebm t\u00eb kontribuojm\u00eb drejtp\u00ebrdrejt n\u00eb k\u00ebt\u00eb proces, duke v\u00ebn\u00eb n\u00eb dispozicion ekspertiz\u00ebn ton\u00eb ligjore dhe burimet njer\u00ebzore t\u00eb nevojshme, me synimin p\u00ebr t\u00eb ndihmuar n\u00eb p\u00ebrgatitjen e nj\u00eb Kodi Penal t\u00eb balancuar, t\u00eb zbatuesh\u00ebm dhe t\u00eb harmonizuar me parimet kushtetuese e detyrimet nd\u00ebrkomb\u00ebtare t\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi fillestar, n\u00ebnvizojm\u00eb disa \u00e7\u00ebshtje q\u00eb k\u00ebrkojn\u00eb vler\u00ebsim t\u00eb kujdessh\u00ebm gjat\u00eb faz\u00ebs s\u00eb diskutimit:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><strong><u>Shtrirja e p\u00ebrgjegj\u00ebsis\u00eb penale n\u00eb fushat civile dhe tregtare<\/u><\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Projekt-Kodi p\u00ebrfshin dispozita q\u00eb zgjerohen p\u00ebrtej fush\u00ebs tradicionale t\u00eb s\u00eb drejt\u00ebs penale, duke penalizuar sjellje q\u00eb deri m\u00eb tani jan\u00eb trajtuar p\u00ebrmes instrumenteve civile ose administrative. Nj\u00eb qasje e till\u00eb k\u00ebrkon vler\u00ebsim t\u00eb kujdessh\u00ebm p\u00ebr t\u00eb ruajtur parimin e proporcionalitetit dhe p\u00ebr t\u00eb shmangur mbivendosjen e panevojshme t\u00eb mekanizmave nd\u00ebshkues. Disa shembuj p\u00ebr ilustrim:<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Shembulli i Nenit 537<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 537 i projekt-ndryshimeve n\u00eb Kodin Penal, q\u00eb parashikon nd\u00ebshkime p\u00ebr \u201ctarifa t\u00eb pap\u00ebrshtatshme t\u00eb sh\u00ebrbimit\u201d, duhet t\u00eb rishikohet me prioritet. N\u00eb nj\u00eb ekonomi tregu, \u00e7mimet p\u00ebrcaktohen nga marr\u00ebdh\u00ebnia k\u00ebrkes\u00eb\u2013ofert\u00eb dhe natyra e sh\u00ebrbimit, jo nga sanksione penale. Vet\u00eb nocioni \u201ctarif\u00eb e pap\u00ebrshtatshme\u201d \u00ebsht\u00eb juridikisht i paqart\u00eb dhe nuk mund t\u00eb p\u00ebrb\u00ebj\u00eb objekt t\u00eb s\u00eb drejt\u00ebs penale, p\u00ebrve\u00e7 rasteve t\u00eb provuara t\u00eb mashtrimit ose fiktivitetit. P\u00ebrfshirja e tij n\u00eb Kodin Penal rrezikon t\u00eb penalizoj\u00eb padrejt\u00ebsisht ofrues sh\u00ebrbimesh, duke nd\u00ebrhyr\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb panevojshme n\u00eb marr\u00ebdh\u00ebnie kontraktuale q\u00eb tradicionalisht trajtohen nga e drejta civile ose administrative.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Shembulli i Nenit 604<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 604 i projektit parashikon se mospagimi, brenda afatit ligjor, i detyrimeve tatimore t\u00eb vet\u00ebdeklaruara p\u00ebrb\u00ebn kund\u00ebrvajtje penale, e d\u00ebnueshme me gjob\u00eb ose burgim deri n\u00eb nj\u00eb vit. Ky \u00ebsht\u00eb nj\u00eb zgjerim i konsideruesh\u00ebm i nd\u00ebrhyrjes penale n\u00eb marr\u00ebdh\u00ebnie fiskale, pasi situata t\u00eb tilla kan\u00eb qen\u00eb m\u00eb par\u00eb objekt i procedurave administrative ose civile. Penalizimi penal i mospagimit, pavar\u00ebsisht n\u00ebse buron nga pamund\u00ebsia objektive (p.sh., pagesa t\u00eb vonuara nga klient\u00ebt apo institucionet publike) apo nga harresa, nuk dallon mes q\u00ebllimit p\u00ebr shmangie dhe v\u00ebshtir\u00ebsive reale t\u00eb tregut. Nj\u00eb qasje e till\u00eb cenon parimin e proporcionalitetit dhe mund t\u00eb d\u00ebmtoj\u00eb bashk\u00ebpunimin nd\u00ebrmjet tatimpaguesve dhe administrat\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Shembulli i Nenit 625<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 625 t\u00ebrheq v\u00ebmendjen p\u00ebr shkak se parashikon nd\u00ebshkime penale p\u00ebr ofertat alternative t\u00eb mallrave apo sh\u00ebrbimeve n\u00eb marr\u00ebdh\u00ebnie tregtare, kur ekziston nj\u00eb marr\u00ebveshje paraprake me nj\u00eb pal\u00eb t\u00eb tret\u00eb. Kjo do t\u00eb thot\u00eb se penalizohet tentativa p\u00ebr t\u00eb konkurruar nj\u00eb marr\u00ebveshje ende t\u00eb pafinalizuar, edhe n\u00eb munges\u00eb t\u00eb mashtrimit apo fiktivitetit. Nj\u00eb parashikim i till\u00eb kufizon lirin\u00eb e konkurrenc\u00ebs dhe sjell nd\u00ebrhyrje penale n\u00eb marr\u00ebdh\u00ebnie q\u00eb natyrsh\u00ebm i p\u00ebrkasin s\u00eb drejt\u00ebs civile dhe tregtare. Formulimet e paqarta si \u201cofert\u00eb e b\u00ebr\u00eb me dijeni t\u00eb nj\u00eb marr\u00ebveshjeje paraprake\u201d krijojn\u00eb hap\u00ebsir\u00eb p\u00ebr interpretim subjektiv dhe rrezik penalizimi t\u00eb padrejt\u00eb. N\u00eb \u00e7do sistem modern, zgjidhja e k\u00ebtyre \u00e7\u00ebshtjeve duhet t\u00eb bazohet n\u00eb nevoj\u00eb t\u00eb qart\u00eb, q\u00ebllim t\u00eb ligjsh\u00ebm dhe proporcionalitet t\u00eb sakt\u00eb.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\"><strong><u>Ndikimi mbi lirit\u00eb politike dhe ekonomike<\/u><\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Disa parashikime mund t\u00eb krijojn\u00eb kufizime mbi t\u00eb drejtat dhe lirit\u00eb themelore, t\u00eb mbrojtura nga Kushtetuta dhe marr\u00ebveshjet nd\u00ebrkomb\u00ebtare ku Shqip\u00ebria \u00ebsht\u00eb pal\u00eb. \u00cbsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb k\u00ebto dispozita t\u00eb rishikohen n\u00eb drit\u00ebn e standardeve t\u00eb BE-s\u00eb dhe jurisprudenc\u00ebs nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb garantuar p\u00ebrputhshm\u00ebri t\u00eb plot\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si p\u00ebr shembull, draft\u2011Kodi i ri parashikon deri n\u00eb 3 vjet burg p\u00ebr \u201cprofanim\u201d t\u00eb Republik\u00ebs, duke p\u00ebrfshir\u00eb simbolet shtet\u00ebrore, institucionet ose individ\u00ebt me statusin e \u201cMartirit t\u00eb Atdheut\u201d. P\u00ebrkufizimi p\u00ebrfshin shprehje t\u00eb paqarta si \u201cfyerje\u201d, \u201ctallje\u201d apo \u201cp\u00ebrbuzje\u201d ndaj k\u00ebtyre subjekteve. Ky nen cenon lirin\u00eb e shprehjes, q\u00eb \u00ebsht\u00eb nj\u00eb element themelor i \u00e7do demokracie. P\u00ebr m\u00eb tep\u00ebr, p\u00ebrkufizimet e gjer\u00eb dhe subjektive rrisin rrezikun e interpretimeve t\u00eb gabuara dhe t\u00eb shtr\u00ebngimit t\u00eb hap\u00ebsir\u00ebs p\u00ebr kritik\u00eb ndaj institucioneve shtet\u00ebrore.<\/span><\/p>\n<p><span style=\"color: #000000;\">Organizatat si \u201cSafe Journalists\u201d dhe ato t\u00eb shoq\u00ebris\u00eb civile kan\u00eb v\u00ebn\u00eb n\u00eb dukje se ndryshimet e propozuara (p\u00ebrfshir\u00eb nenet p\u00ebr shpifjen, ndikimin n\u00eb pavar\u00ebsin\u00eb e gjykat\u00ebsve etj.) do t\u00eb dob\u00ebsojn\u00eb rolin mbik\u00ebqyr\u00ebs t\u00eb medias dhe do t\u00eb rrezikojn\u00eb transparenc\u00ebn n\u00eb nj\u00eb shtet ligjor funksional<strong>.\u00a0<\/strong>Kriminalizimi i gazetar\u00ebve apo kufizimi i fjal\u00ebs s\u00eb lir\u00eb p\u00ebrmes Kodit penal jo vet\u00ebm krijon frym\u00eb frike, por k\u00ebrc\u00ebnon edhe funksionin ky\u00e7 t\u00eb medias si kontrollues i pushtetit dhe garantues i transparenc\u00ebs.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\"><strong><u>Nevoja p\u00ebr koh\u00eb t\u00eb mjaftueshme konsultimi dhe gjith\u00ebp\u00ebrfshirje<\/u><\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Duke qen\u00eb se Kodi Penal \u00ebsht\u00eb nj\u00eb nga aktet m\u00eb themelore t\u00eb rendit juridik, procesi i konsultimit duhet t\u00eb jet\u00eb i zgjeruar n\u00eb koh\u00eb dhe p\u00ebrmbajtje, duke p\u00ebrfshir\u00eb t\u00eb gjith\u00eb aktor\u00ebt relevant\u00eb, organet e drejt\u00ebsis\u00eb, profesionist\u00ebt e ligjit, biznesin, akademin\u00eb dhe shoq\u00ebrin\u00eb civile. Koh\u00ebzgjatja aktuale e konsultimit \u00ebsht\u00eb e kufizuar p\u00ebr nj\u00eb analiz\u00eb t\u00eb plot\u00eb t\u00eb t\u00eb gjitha aspekteve ligjore dhe praktike.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb tjera \u00e7\u00ebshtje t\u00eb identifikuara nga ne t\u00eb ngritura si shqet\u00ebsim nga pal\u00ebt e tret\u00eb, koleg\u00ebt dhe organizatat partnere. Ekspert\u00ebt e drejt\u00ebsis\u00eb kritikojn\u00eb Kodin e Ri Penal p\u00ebr formulime t\u00eb paqarta n\u00eb disa nene, q\u00eb l\u00ebn\u00eb hap\u00ebsira p\u00ebr interpretime arbitrare nga gjykatat dhe prokuroria. Kjo rrezikon t\u00eb cenoj\u00eb drejt\u00ebsin\u00eb dhe t\u00eb rris\u00eb korrupsionin. Shum\u00eb v\u00ebzhgues dhe organizata t\u00eb shoq\u00ebris\u00eb civile ngren\u00eb shqet\u00ebsime p\u00ebr rritjen e kompetencave t\u00eb prokuroris\u00eb dhe policis\u00eb n\u00eb kod, pa mekanizma efektiv\u00eb kontrolli, duke rrezikuar lirin\u00eb dhe privat\u00ebsin\u00eb e qytetar\u00ebve. Media dhe ekspert\u00ebt kritikojn\u00eb p\u00ebrfshirjen e disa shkeljeve t\u00eb vogla ose mesatare me masa penale, duke i b\u00ebr\u00eb kodin m\u00eb t\u00eb ashp\u00ebr se sa duhet dhe duke mbingarkuar sistemin gjyq\u00ebsor.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>P\u00ebrfundim<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Ne e shohim k\u00ebt\u00eb reform\u00eb si nj\u00eb mund\u00ebsi t\u00eb \u00e7muar p\u00ebr t\u00eb forcuar kuadrin penal n\u00eb vendin ton\u00eb, duke e b\u00ebr\u00eb at\u00eb m\u00eb efektiv, m\u00eb t\u00eb drejt\u00eb dhe n\u00eb harmoni me parimet e shtetit t\u00eb s\u00eb drejt\u00ebs.
