Udh\u00ebrr\u00ebfyesi \u00ebsht\u00eb ne fakt nj\u00eb kujtes\u00eb e vazhdueshme se drejt\u00ebsia duhet t\u00eb realizohet vet\u00ebm p\u00ebrmes ketyre garancive.\u00a0<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb kat\u00ebrti, p\u00ebr avokat\u00ebt dhe praktikantet e ligjit \u2013\u00a0Udh\u00ebrr\u00ebfyesi ofron nj\u00eb burim t\u00eb vlefshem p\u00ebr t\u00eb interpretuar sakt\u00eb ligjin kushtetues si dhe qart\u00ebsi mbi standardet dhe precedent\u00ebt, p\u00ebr nj\u00eb aplikim t\u00eb duhur t\u00eb k\u00ebtyre t\u00eb fundit. Duke p\u00ebrdorur k\u00ebt\u00eb dokument, institucionet ekzekutive mund t\u00eb veprojn\u00eb me m\u00eb shum\u00eb p\u00ebrgjegjshm\u00ebri, transparenc\u00eb dhe respekt p\u00ebr vlerat kushtetuese, duke forcuar m\u00eb tej rolin e tyre n\u00eb ruajtjen e demokracis\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb gjashti,\u00a0p\u00ebr qytetar\u00ebt dhe shoq\u00ebrin\u00eb civile \u2013\u00a0Udh\u00ebrr\u00ebfyesi b\u00ebn t\u00eb aksesueshme dhe t\u00eb kuptueshme parimet kushtetuese duke u mund\u00ebsuar qytetar\u00ebve t\u00eb angazhohen m\u00eb mir\u00eb p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb tyre. Ai forcon besimin e publikut n\u00eb sistemin e drejt\u00ebsis\u00eb duke siguruar q\u00eb vendimet e Gjykat\u00ebs Kushtetuese t\u00eb mos jen\u00eb vet\u00ebm koncepte abstrakte, por instrumente mbrojtjeje, konkrete dhe praktike, t\u00eb t\u00eb drejtave dhe lirive t\u00eb individit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb fundi, p\u00ebr studiuesit dhe akademik\u00ebt\u00a0\u2013 Udh\u00ebrr\u00ebfyesi ofron nj\u00eb thesar t\u00eb pasur dhe t\u00eb strukturuar dijesh \u2013 nj\u00eb burim t\u00eb pa\u00e7muar p\u00ebr studimin e zhvillimit t\u00eb s\u00eb drejt\u00ebs kushtetuese n\u00eb Shqip\u00ebri. Ai fton p\u00ebr analiz\u00eb m\u00eb t\u00eb thell\u00eb dhe inkurajon e nxit kritik\u00ebn e sh\u00ebndosh\u00eb dhe debatin akademik mbi drejt\u00ebsin\u00eb kushtetuese, rolin e pushteteve t\u00eb shtetit dhe dinamikat midis institucioneve shtet\u00ebrore.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Duke diskutuar p\u00ebr ndikimin e thell\u00eb t\u00eb vendimeve t\u00eb Gjykat\u00ebs Kushtetuese, \u00ebsht\u00eb e r\u00ebnd\u00ebsishme t\u00eb theksojm\u00eb se k\u00ebto vendime nuk jan\u00eb thjesht me vler\u00eb historike\u2014ato vazhdojn\u00eb t\u00eb form\u00ebsojn\u00eb dhe pasurojn\u00eb peizazhin aktual ligjor p\u00ebrmes autoritetit t\u00eb tyre precedencial.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebto vendime kan\u00eb udh\u00ebhequr arsyetimin e sot\u00ebm ligjor e gjyq\u00ebsor, por Gjykata, n\u00eb interpretimin e Kushtetut\u00ebs si nj\u00eb \u201cinstrument i gjall\u00eb\u201d kujdeset q\u00eb teksti i saj t\u00eb jet\u00eb i aft\u00eb t\u00eb p\u00ebrshtatet me sfidat dhe zhvillimet e reja, duke zhvilluar k\u00ebshtu edhe konceptet e saj.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00cbsht\u00eb po aq e r\u00ebnd\u00ebsishme t\u00eb n\u00ebnvizohet se autoriteti i k\u00ebtyre vendimeve nuk \u00ebsht\u00eb teorik. P\u00ebrpjekjet p\u00ebr t\u00eb kund\u00ebrshtuar apo p\u00ebr t\u00eb v\u00ebn\u00eb n\u00eb diskutim ekzekutimin e vendimeve t\u00eb Gjykat\u00ebs Kushtetuese jo vet\u00ebm minojn\u00eb besimin e publikut n\u00eb sistemin e drejt\u00ebsis\u00eb, por edhe destabilizojn\u00eb qeverisjen demokratike.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Mos t\u00eb harrojm\u00eb \u2013 Vendimet e Gjykat\u00ebs Kushtetuese nuk jan\u00eb as k\u00ebshilluese, as opsionale p\u00ebr t`u zbatuar\u2014ato jan\u00eb t\u00eb detyrueshme dhe ekzekutimi i tyre p\u00ebrb\u00ebn nj\u00eb detyrim kushtetues p\u00ebr t\u00eb gjitha pushtetet.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>D\u00ebshtimi n\u00eb ekzekutimin e k\u00ebtyre vendimeve v\u00eb n\u00eb diskutim vet\u00eb Kushtetut\u00ebn dhe k\u00ebrc\u00ebnon integritetin e sundimit t\u00eb ligjit, i cili k\u00ebrkon q\u00eb t\u00eb gjitha institucionet shtet\u00ebrore, jo vet\u00ebm t\u00eb respektojn\u00eb vendimet e Gjykat\u00ebs por edhe t\u00eb veprojn\u00eb n\u00eb shina kushtetuese.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo vlen gjithashtu per te mbajtur n\u00eb v\u00ebmendje se\u00a0kur institucionet p\u00ebrfshir\u00eb edhe ato gjyq\u00ebsore krijojn\u00eb konflikte kushtetuese apo veprojn\u00eb jasht\u00eb kuadrit kushtetues \u2013 kjo minon vet legjitimitetin e sistemit ligjor dhe g\u00ebrryen besimin e publikut.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ndaj Kushtetutshm\u00ebria si m\u00ebnyr\u00eb t\u00eb q\u00ebni dhe t\u00eb sjelluri \u00ebsht\u00eb pasaporta jon\u00eb e vetme n\u00eb rrug\u00ebn e integrimit drejt Evrop\u00ebs s\u00eb Bashkuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ne jetojm\u00eb n\u00eb nj\u00eb moment historik jo vet\u00ebm n\u00eb Shqip\u00ebri por edhe n\u00eb bot\u00eb dhe\u00a0na duhet t\u00eb kujtojm\u00eb se vet\u00ebm\u00a0demokracia,\u00a0nuk mjafton.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sundimi i shumic\u00ebs, edhe kur \u00ebsht\u00eb i ligjsh\u00ebm, mund t\u00eb \u00e7oj\u00eb n\u00eb ligje q\u00eb kufizojn\u00eb ose shkelin t\u00eb drejtat themelore. Prandaj, \u00ebsht\u00eb e domosdoshme q\u00eb\u00a0demokracia t\u00eb jet\u00eb kushtetuese, me kufij p\u00ebr pushtetet, respekt t\u00eb sundimit t\u00eb ligjit dhe nj\u00eb pushtet gjyq\u00ebsor t\u00eb pavarur.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Vet\u00ebm k\u00ebshtu\u00a0demokracia nuk \u00ebsht\u00eb thjesht dhe vet\u00ebm nj\u00eb mekaniz\u00ebm qeveris\u00ebs por nj\u00eb kultur\u00eb lirie, p\u00ebrgjegjshm\u00ebria dhe llogaridh\u00ebnijeje.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Megjithate, edhe vet\u00eb Kushtetuta, sado perfekte t\u00eb jet\u00eb, nuk \u00ebsht\u00eb e mjaftueshme. \u00cbsht\u00eb\u00a0Gjykata Kushtetuese\u00a0ajo q\u00eb i jep kuptim, zbatim dhe mbrojtje asaj. Duke interpretuar vlerat mbi t\u00eb cilat mb\u00ebshteten dinjiteti njer\u00ebzor, barazia, liria dhe drejt\u00ebsia, ajo siguron q\u00eb parimet kushtetuese dhe t\u00eb drejtat themelore t\u00eb ruhen dhe te garantohen.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb k\u00ebt\u00eb k\u00ebndv\u00ebshtrim, do t\u00eb doja t\u00eb theksoja se mbetet nj\u00eb sfid\u00eb e vazhdueshme q\u00eb\u00a0drejt\u00ebsia t\u00eb jet\u00eb jo vet\u00ebm e drejt\u00eb, por mbi t\u00eb gjitha kushtetuese.\u00a0Duhet t\u00eb mbajm\u00eb mend se q\u00ebllimi nuk justifikon mjetet.\u00a0Drejt\u00ebsia q\u00eb nuk respekton parimet themelore t\u00eb Kushtetut\u00ebs rrezikon t\u00eb b\u00ebhet nj\u00eb mjet pushteti n\u00eb vend q\u00eb t\u00eb jet\u00eb nj\u00eb mjet mbrojtjeje dhe ligjshm\u00ebrie.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>T\u00eb drejtat dhe lirit\u00eb themelore nuk mbrohen sepse njihen nga shteti; p\u00ebrkundrazi, ato jan\u00eb universale dhe duhet t\u00eb respektohen p\u00ebr t\u00eb gjith\u00eb dhe nga t\u00eb gjith\u00eb\u2014pa p\u00ebrjashtim.\u00a0Nj\u00eb sistem drejt\u00ebsie q\u00eb nuk u jep p\u00ebrpar\u00ebsi t\u00eb drejtave t\u00eb njeriut rrezikon te humbas\u00eb kredibilitet pavar\u00ebsisht rezultateve.\u00a0Vet\u00ebm duke respektuar dhe garantuar k\u00ebto t\u00eb drejta mund t\u00eb nd\u00ebrtojm\u00eb nj\u00eb sistem drejt\u00ebsie legjitim, kushtetues dhe me besim nd\u00ebr qytetar\u00ebt.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebrpara se t\u00eb p\u00ebrfundoj, do t\u00eb doja t\u00eb ndaja me ju di\u00e7ka personale. Q\u00eb nga momenti kur mora detyr\u00ebn si gjyqtare kushtetuese kuptova boshll\u00ebkun dhe nevoj\u00ebn urgjente p\u00ebr nj\u00eb instrument t\u00eb till\u00eb si Udh\u00ebrr\u00ebfyesi i jurisprudenc\u00ebs kushtetuese.
