Partit\u00eb e vogla kishin k\u00ebrkuar rr\u00ebzimin e paktit PS-PD p\u00ebr listat e kandidat\u00ebve duke k\u00ebrkuar \u201cshfuqizimin e Kodit t\u00eb ri Zgjedhor\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Shtat\u00eb partit\u00eb e vogla u b\u00ebn\u00eb bashk\u00eb kund\u00ebr paktit PD-PS p\u00ebr mbylljen e listave dhe sot Gjykata Kushtetuese pati nj\u00eb seanc\u00eb t\u00eb hapur, ku d\u00ebgjoi pretendimet e 7 partive dhe p\u00ebrfaq\u00ebsuesit ligjor t\u00eb Lulzim Bash\u00ebs, si dhe p\u00ebrfaq\u00ebsuesit e Kuvendit, Mimoza Arbri dhe Viktor Gumi, t\u00eb cil\u00ebt\u00a0 kund\u00ebrshtuan pezullimin.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas gjykat\u00ebs<em>, &#8220;pretendimet e ankimuesve nuk jan\u00eb t\u00eb bazuara sepse lidhen me rezultat e votimit, q\u00eb i korrespondon shp\u00ebrndarjes s\u00eb mandateve, nd\u00ebrsa sipas nenit 64 t\u00eb Kushtetut\u00ebs, kjo shp\u00ebrndarje dhe masa e shtrirjes s\u00eb votimit parap\u00eblqyes i \u00ebsht\u00eb deleguar ligjv\u00ebn\u00ebsit, nd\u00ebrkoh\u00eb q\u00eb garancia kushtetuese p\u00ebr ushtrimin e s\u00eb drejt\u00ebs s\u00eb vot\u00ebs parap\u00eblqyese n\u00eb nenin 64, pika 3 t\u00eb Kushtetut\u00ebs lidhet me procesin e votimit&#8221;.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Njoftimi i Gjykat\u00ebs Kushtetuese<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u201cGjykata Kushtetuese mori n\u00eb shqyrtim n\u00eb seanc\u00eb plenare publike \u00e7\u00ebshtjen me k\u00ebrkues shtat\u00eb parti politike, nj\u00eb organizat\u00eb dhe kat\u00ebr individ\u00eb[1], me objekt shfuqizimin e neneve 67 dhe 163, pikat 2 dhe 3 t\u00eb Kodit Zgjedhor, si t\u00eb papajtueshme me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, si dhe interpretimin p\u00ebrfundimtar t\u00eb nenit 64 t\u00eb Kushtetut\u00ebs ose shfuqizimin e tij.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sa i takon pretendimit p\u00ebr interpretimin e nenit 64 t\u00eb Kushtetut\u00ebs ose shfuqizimin e tij, Gjykata vler\u00ebsoi se interpretimi n\u00eb vetvete i dispozit\u00ebs kushtetuese nuk b\u00ebhet i shk\u00ebputur nga themeli i \u00e7\u00ebshtjes, prandaj do t\u00eb analizohet s\u00eb bashku me pretendimet e ngritura nga k\u00ebrkuesit; nd\u00ebrsa shfuqizimi i k\u00ebsaj dispozite kushtetuese, nuk b\u00ebn pjes\u00eb n\u00eb juridiksionin kushtetues, pasi sipas nenit 131, pika 2 t\u00eb Kushtetut\u00ebs, Gjykata ka juridiksion t\u00eb kufizuar vet\u00ebm p\u00ebr kontrollin e respektimit t\u00eb procedur\u00ebs s\u00eb parashikuar nga Kushtetuta, \u00e7ka nuk \u00ebsht\u00eb pretenduar nga k\u00ebrkuesit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Lidhur me themelin e pretendimeve, Gjykata v\u00ebrejti se k\u00ebrkuesit kan\u00eb pretenduar se neni 67, pika 1 i Kodit Zgjedhor duke vendosur lidh\u00ebz\u00ebn \u201cdhe\u201d midis shkronjave \u201ca\u201d dhe \u201cb\u201d t\u00eb saj p\u00ebrcakton detyrimin e subjekteve zgjedhore p\u00ebr paraqitjen e dy listave shum\u00ebem\u00ebrore, at\u00eb me renditje t\u00eb fiksuar dhe at\u00eb me kandidat\u00eb q\u00eb i n\u00ebnshtrohen votimit parap\u00eblqyes duke cenuar parashikimin e nenit 64, pika 3 t\u00eb Kushtetut\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjykata mori n\u00eb shqyrtim pretendimet e pal\u00ebve p\u00ebr cenimin e s\u00eb drejt\u00ebs s\u00eb vot\u00ebs, n\u00eb dy aspekte, s\u00eb drejt\u00ebs p\u00ebr t\u2019u zgjedhur dhe p\u00ebr t\u00eb zgjedhur, t\u00eb parashikuar n\u00eb nenet 45 dhe 64 t\u00eb Kushtetut\u00ebs, t\u00eb lidhur me parimin e barazis\u00eb p\u00ebrpara ligjit. Gjykata vler\u00ebsoi se pretendimet e k\u00ebrkuesve nuk jan\u00eb t\u00eb bazuara sepse lidhen me rezultat e votimit, q\u00eb i korrespondon shp\u00ebrndarjes s\u00eb mandateve, nd\u00ebrsa sipas nenit 64 t\u00eb Kushtetut\u00ebs, kjo shp\u00ebrndarje dhe masa e shtrirjes s\u00eb votimit parap\u00eblqyes i \u00ebsht\u00eb deleguar ligjv\u00ebn\u00ebsit, nd\u00ebrkoh\u00eb q\u00eb garancia kushtetuese p\u00ebr ushtrimin e s\u00eb drejt\u00ebs s\u00eb vot\u00ebs parap\u00eblqyese n\u00eb nenin 64, pika 3 t\u00eb Kushtetut\u00ebs lidhet me procesin e votimit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Bazuar po n\u00eb k\u00ebt\u00eb premis\u00eb, Gjykata nuk konstatoi as cenim t\u00eb parimit t\u00eb barazis\u00eb p\u00ebrpara ligjit si p\u00ebr partit\u00eb politike ashtu dhe p\u00ebr organizatat dhe individ\u00ebt n\u00eb dy aspektet e m\u00ebsip\u00ebrme, s\u00eb drejt\u00ebs p\u00ebr t\u2019u zgjedhur dhe p\u00ebr t\u00eb zgjedhur, p\u00ebr sa koh\u00eb q\u00eb n\u00eb analiz\u00eb t\u00eb pretendimeve t\u00eb k\u00ebrkuesve dhe t\u00eb dispozitave objekt shqyrtimi, rezultoi se parashikimet ligjore i drejtohen n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebjt\u00eb t\u00eb gjith\u00eb subjekteve zgjedhore dhe zgjedh\u00ebsve, prandaj, p\u00ebr rrjedhoj\u00eb, nuk b\u00ebjn\u00eb diferencim mes tyre n\u00eb procesin e votimit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sa i takon pretendimit t\u00eb llogaritjes s\u00eb numrit t\u00eb kandidat\u00ebve t\u00eb list\u00ebs me renditje t\u00eb fiksuar n\u00eb var\u00ebsi t\u00eb presjes dhjetore m\u00eb t\u00eb vog\u00ebl ose m\u00eb t\u00eb madhe se 0.5 t\u00eb parashikuar n\u00eb pik\u00ebn 2 t\u00eb nenit 67 t\u00eb Kodit Zgjedhor, Gjykata vler\u00ebsoi se pretendimet e k\u00ebrkuesve jan\u00eb t\u00eb pabazuara. P\u00ebr t\u00eb arritur n\u00eb k\u00ebt\u00eb p\u00ebrfundim, Gjykata mbajti n\u00eb konsiderat\u00eb se lista shum\u00ebem\u00ebrore e subjekteve politike p\u00ebrb\u00ebhet nga lista me renditje t\u00eb fiksuar dhe lista q\u00eb i n\u00ebnshtrohet votimit parap\u00eblqyes (neni 67, pika 1 i Kodit Zgjedhor). Kjo e fundit si komponent i list\u00ebs shum\u00ebem\u00ebrore t\u00eb subjekteve politike garanton parashikimin kushtetues t\u00eb nenit 64, pika 3 \u201c q\u00eb votimit parap\u00eblqyes t\u2019i n\u00ebnshtrohet jo m\u00eb pak se dy t\u00eb tretat e list\u00ebs shum\u00ebem\u00ebrore\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr sa i p\u00ebrket pretendimit t\u00eb k\u00ebrkuesve p\u00ebr procedur\u00ebn e miratimit t\u00eb ligjit, Gjykata nuk arriti numrin e k\u00ebrkuar t\u00eb votave p\u00ebr vendimmarrje sipas parashikimeve t\u00eb nenit 133, pika 2 t\u00eb Kushtetut\u00ebs, t\u00eb detajuar n\u00eb nenin 72, pika 2, t\u00eb ligjit nr. 8577\/2000.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb p\u00ebrfundim t\u00eb shqyrtimit t\u00eb \u00e7\u00ebshtjes, p\u00ebr arsyet e m\u00ebsip\u00ebrme, Gjykata vendosi me shumic\u00eb votash:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2013 Rr\u00ebzimin e k\u00ebrkes\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Vendimi p\u00ebrfundimtar do t\u00eb shpallet i arsyetuar brenda afateve ligjore t\u00eb parashikuara nga ligji nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, i ndryshuar dhe nga Rregullorja p\u00ebr Procedurat Gjyq\u00ebsore t\u00eb Gjykat\u00ebs Kushtetuese.\u201d<\/em><\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Gjykata Kushtetuese ka rr\u00ebzuar ankimimin e partive t\u00eb vogla p\u00ebr Kodin Zgjedhor.
