Holta Za\u00e7aj deklaroi mbylljen e procesit gjyq\u00ebsore, teksa pohoi se trupa e gjyqtar\u00ebve t\u00ebrhiqet p\u00ebr vendimin p\u00ebrfundimtar. Shpallja e vendimit p\u00ebrfundimtar, pra n\u00ebse do t\u00eb shfuqizohet apo jo vendimi me \u00e7mimet e reja t\u00eb referenc\u00ebs, do t\u00eb komunikohet sipas parashikimeve ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u201cN\u00eb lidhje me k\u00ebrkes\u00ebn p\u00ebr pezullim, Gjykata Kushtetuese vendosi nj\u00ebz\u00ebri rr\u00ebzimin e k\u00ebrkes\u00ebs p\u00ebr pezullim, pasi nuk u provuan pasojat e pariparueshme q\u00eb sjell zbatimi i VKM nr.457 2023, n\u00eb kuptim t\u00eb nenit 45 t\u00eb ligjit Organik t\u00eb Gjykat\u00ebs Kushtetuese. Deklarojm\u00eb mbylljen e procesit gjyq\u00ebsor. Trupa e Gjykat\u00ebs t\u00ebrhiqet p\u00ebr t\u00eb marr\u00eb vendim. Dita dhe ora e shpalljes s\u00eb vendimit do t\u2019u komunikohet sipas parashikimeve ligjore\u201d<\/em>, u shpreh Kryetarja e Gjykat\u00ebs Kushtetuese Holta Za\u00e7aj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas parashikimeve ligjore afati p\u00ebr dh\u00ebnien e vendimit mund\u00ebson deri n\u00eb 30 dit\u00eb koh\u00eb referuar ligjit \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebri\u201d Nr.8577, dat\u00eb 10.2.2000 (ndryshuar me ligjin nr.99\/2016).<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjat\u00eb seanc\u00ebs nga pal\u00ebt u paraqit\u00ebn konkluzionet p\u00ebrfundimtare.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb konkluzionet e tij p\u00ebrfaq\u00ebsuesi i Shoqat\u00ebs s\u00eb Nd\u00ebrtuesve pohoi se mb\u00ebshtetur n\u00eb analizat konkrete p\u00ebr lejet e miratuara t\u00eb nd\u00ebrtimit, llogaritja e taks\u00ebs s\u00eb ndikimit n\u00eb infrastruktur\u00eb me \u00e7mimet e reja t\u00eb referenc\u00ebs rrit 80% barr\u00ebn fiskale te nd\u00ebrtuesit. Sipas tij kjo do t\u00eb rris\u00eb \u00e7mimet e apartamenteve.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa i p\u00ebrket llogaritjes s\u00eb barr\u00ebs fiskale, n\u00eb mor\u00ebm n\u00eb analiz\u00eb disa leje konkrete t\u00eb an\u00ebtar\u00ebve t\u00eb shoqat\u00ebs, q\u00eb kan\u00eb paguar taks\u00ebn e ndikimit n\u00eb infrastruktur\u00eb 8% para hyrjes n\u00eb fuqi t\u00eb vendimit. Rezulton se taksa \u00ebsht\u00eb llogaritur sipas \u00e7mimeve t\u00eb reja t\u00eb referenc\u00ebs, t\u00eb p\u00ebrcaktuara n\u00eb VKM q\u00eb \u00ebsht\u00eb objekt gjykimi n\u00eb seanc\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">VKM-ja e re, p\u00ebr aspektin e fuqis\u00eb prapavepruese, nuk mund t\u00eb zbatohet p\u00ebr k\u00ebto leje nd\u00ebrtimi, shqyrtimi dhe miratimi i t\u00eb cilave \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb momente t\u00eb ndryshme kohore. Rritja e barr\u00ebs fiskale shkon deri n\u00eb 80%.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00c7mimi i ri i kontratave p\u00ebr apartamente q\u00eb do t\u00eb lidhen pas hyrjes n\u00eb fuqi t\u00eb VKM-s\u00eb do t\u00eb diktohet \u00e7mimi i ri. P\u00ebr t\u00eb nj\u00ebjtin objekt disa nj\u00ebsi banimi do t\u00eb shiten me \u00e7mim tjet\u00ebr, disa me \u00e7mim m\u00eb t\u00eb lart\u00eb p\u00ebr shkak t\u00eb zbatimit me fuqi prapavepruese t\u00eb VKM-s\u00eb.\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrfaq\u00ebsuesja e K\u00ebshillit t\u00eb Ministrave n\u00eb paraqitjen e konkluzioneve p\u00ebrfundimtare vuri theksin se akti n\u00ebnligjor nuk cenon parimet kushtetuese dhe k\u00ebrkoi pezullimin e k\u00ebrkes\u00ebs. Sipas saj nga k\u00ebrkuesit nuk u arrit t\u00eb argumentohet n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb sesi cenohet nga pik\u00ebpamja Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu nga p\u00ebrfaq\u00ebsuesja e K\u00ebshillit t\u00eb Ministrave u theksua se \u00ebsht\u00eb zbatuar kriteri i propocionalitetit, duke respektuar interesat e k\u00ebrkuesit dhe t\u00eb publikut.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Padia<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Seanca e par\u00eb p\u00ebr shqyrtimin e padis\u00eb s\u00eb Shoqata e Nd\u00ebrtuesve u mbajt n\u00eb 13 Shtator 2024 n\u00eb Gjykat\u00ebn Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb padi nd\u00ebrtuesit kan\u00eb k\u00ebrkuar shfuqizimin e aneksit 1 t\u00eb vendimit ku p\u00ebrcakton \u00e7mimet e ndryshuara t\u00eb referencave t\u00eb shitblerjes s\u00eb apartamenteve dhe shkronj\u00ebs \u201cdh\u201d t\u00eb aneksit 2 t\u00eb vendimit q\u00eb p\u00ebrcakton veprime prapavepruese p\u00ebr \u201c\u00e7mimi p\u00ebr met\u00ebr katror sip\u00ebrfaqe nd\u00ebrtimore p\u00ebr nd\u00ebrtimet e reja regjistruar sipas lejes s\u00eb p\u00ebrdorimit n\u00eb ASHK, pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij vendimi, do t\u00eb indeksohet me koeficientin 0.2 (zero pik\u00eb dy) her\u00eb m\u00eb i lart\u00eb se \u00e7mimi i sip\u00ebrfaqes s\u00eb apartamentit t\u00eb banimit sipas list\u00ebs s\u00eb p\u00ebrcaktuar aneksin 1 q\u00eb i bashk\u00eblidhet k\u00ebtij vendimi, p\u00ebr 5 vitet e para pas regjistrimit t\u00eb lejes s\u00eb p\u00ebrdorimit n\u00eb ASHK.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cShfuqizimin e pjessh\u00ebm t\u00eb vendimit nr. 457, dat\u00eb 26.07.2023 t\u00eb K\u00ebshillit t\u00eb Ministrave \u201cP\u00ebr disa ndryshime n\u00eb vendimin nr. 132, dat\u00eb 07.03.2018 t\u00eb K\u00ebshillit t\u00eb Ministrave \u201cP\u00ebr metodologjin\u00eb p\u00ebr p\u00ebrcaktimin e vler\u00ebs s\u00eb taksueshme t\u00eb pasuris\u00eb s\u00eb paluajtshme \u201cnd\u00ebrtesa\u201d, e baz\u00ebs s\u00eb taks\u00ebs p\u00ebr kategori specifike, natyr\u00ebn dhe prioritetin e informacionit dhe t\u00eb dh\u00ebnave p\u00ebr p\u00ebrcaktimin e baz\u00ebs s\u00eb taks\u00ebs, si dhe t\u00eb kritereve dhe rregullave p\u00ebr vler\u00ebsimin alternativ t\u00eb detyrimit t\u00eb taks\u00ebs\u201d, t\u00eb ndryshuar\u201d (VKM nr. 457\/2023) shkronj\u00ebs \u201cdh\u201d t\u00eb Aneksit 2, si dhe n\u00eb pjes\u00ebn q\u00eb ka em\u00ebrtuar t\u00eb p\u00ebrcaktoje n\u00eb Aneksin 1, pika a.2) se \u00e7mimet mesatare referuese t\u00eb shitblerjes s\u00eb nd\u00ebrtesave q\u00eb p\u00ebrdoren p\u00ebr q\u00ebllime banimi p\u00ebr Bashkin\u00eb Tiran\u00eb, do t\u00eb zbatohen p\u00ebr lejet e nd\u00ebrtimit t\u00eb dh\u00ebna pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij vendimi, si t\u00eb papajtuesh\u00ebm me Kushtetut\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb padi nga Shoqata e Nd\u00ebrtuesve \u00ebsht\u00eb k\u00ebrkuar edhe pezullimi i zbatimit t\u00eb shkronj\u00ebs \u201cdh\u201d t\u00eb Aneksit 2, si dhe pik\u00ebs a.2) t\u00eb Aneksit 1, p\u00ebr lejet e nd\u00ebrtimit t\u00eb dh\u00ebna p\u00ebrpara hyrjes n\u00eb fuqi t\u00eb VKM-s\u00eb nr. 457\/2023 deri n\u00eb hyrjen n\u00eb fuqi t\u00eb vendimit t\u00eb Gjykat\u00ebs Kushtetuese\u201d, citohet n\u00eb objektin e padis\u00eb d\u00ebrguar Gjykat\u00ebs Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\"><strong>VINI RE<\/strong><\/span>: Ky material \u00ebsht\u00eb pron\u00ebsi intelektuale e <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/monitor.al\/kushtetuesja-rrezon-kerkesen-e-ndertuesve-per-pezullimin-e-referencave\/\">Monitor<\/a><\/span><\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Gjykata Kushtetuese ka rr\u00ebzuar k\u00ebrkes\u00ebn e Shoqat\u00ebs s\u00eb Nd\u00ebrtuesve p\u00ebr pezullimin e VKM-s\u00eb p\u00ebr rritjen e \u00e7mimeve t\u00eb referenc\u00ebs s\u00eb apartamenteve n\u00eb Tiran\u00eb.
