{"id":686917,"date":"2024-07-09T19:23:17","date_gmt":"2024-07-09T17:23:17","guid":{"rendered":"https:\/\/www.hashtag.al\/?p=686917"},"modified":"2024-07-09T19:23:17","modified_gmt":"2024-07-09T17:23:17","slug":"ligji-per-komisionet-hetimore-gjykata-kushtetuese-pranon-pjeserisht-kerkesen-e-opozites","status":"publish","type":"post","link":"https:\/\/www.hashtag.al\/index.php\/2024\/07\/09\/ligji-per-komisionet-hetimore-gjykata-kushtetuese-pranon-pjeserisht-kerkesen-e-opozites\/","title":{"rendered":"Ligji p\u00ebr komisionet hetimore, Gjykata Kushtetuese pranon pjes\u00ebrisht k\u00ebrkes\u00ebn e opozit\u00ebs","gt_translate_keys":[{"key":"rendered","format":"text"}]},"content":{"rendered":"<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/01\/Gjykata-Kushtetuese-1-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-650365\" src=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/01\/Gjykata-Kushtetuese-1-1.jpg\" alt=\"\" width=\"700\" height=\"467\" srcset=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/01\/Gjykata-Kushtetuese-1-1.jpg 700w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/01\/Gjykata-Kushtetuese-1-1-300x200.jpg 300w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata Kushtetuese i ka pranuar pjes\u00ebrisht k\u00ebrkes\u00ebn 33 deputet\u00ebve t\u00eb opozit\u00ebs, t\u00eb cil\u00ebt k\u00ebrkuan shfuqizimin e ligjit p\u00ebr Komisionet Hetimore.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata ka konstatuar t\u00eb papajtueshme me Kushtetut\u00ebn nenit 4 t\u00eb ligjit nr. 106\/2023, q\u00eb lidhet me nism\u00ebn p\u00ebr krijimin e komisionit hetimor, p\u00ebr shkak t\u00eb boshll\u00ebkut ligjor n\u00eb p\u00ebrmbajtjen e k\u00ebsaj dispozite.<\/span><\/p>\n<p><span style=\"color: #000000;\">Boshll\u00ebku ligjor ka t\u00eb b\u00ebj\u00eb me nevoj\u00ebn p\u00ebr \u201cformulime alternative t\u00eb objektit t\u00eb hetimit\u201d, si\u00e7 \u00ebsht\u00eb shprehur Gjykata n\u00eb jurisprudenc\u00ebn e saj (vendimi nr. 30\/2014), pasi cenon, n\u00eb thelb, t\u00eb drejt\u00ebn e pakic\u00ebs parlamentare p\u00ebr ngritjen e komisionit hetimor.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Vendimi:<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata Kushtetuese, e mbledhur sot m\u00eb 09.07.2024, mori n\u00eb shqyrtim \u00e7\u00ebshtjen e paraqitur nga 33 deputet\u00eb me objekt\u00a0shfuqizimin e ligjin nr. 106\/2023, q\u00eb ndryshoi disa dispozita t\u00eb ligjit nr. 8891\/2002 \u201cP\u00ebr organizimin dhe funksionimin e komisioneve hetimore\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata vler\u00ebsoi, fillimisht, se p\u00ebr pretendimet p\u00ebr procedur\u00ebn e miratimit t\u00eb ligjit nr. 106\/2023 k\u00ebrkuesi nuk ka parashtruar argumente t\u00eb nivelit kushtetues. Asnj\u00eb nga shkeljet procedurale t\u00eb pretenduara nuk \u00ebsht\u00eb argumentuar n\u00eb drejtim t\u00eb cenimit t\u00eb normave kushtetuese. P\u00ebr m\u00eb tep\u00ebr, mungesa e shqyrtimit t\u00eb nismave t\u00eb dy deputet\u00ebve t\u00eb tjer\u00eb nuk \u00ebsht\u00eb provuar t\u00eb ket\u00eb prekur pajtueshm\u00ebrin\u00eb e ligjit t\u00eb kund\u00ebrshtuar me Kushtetut\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me themelin e \u00e7\u00ebshtjes, Gjykata vendosi pranimin pjes\u00ebrisht t\u00eb k\u00ebrkes\u00ebs, si m\u00eb posht\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa m\u00eb sip\u00ebr, Gjykata, pa v\u00ebn\u00eb n\u00eb diskutim fuqin\u00eb detyruese t\u00eb vendimeve t\u00eb saj, v\u00ebren se, edhe pse gjat\u00eb gjykimit u konstatua se kjo dispozit\u00eb ka pasur si q\u00ebllim t\u00eb reflektoj\u00eb jurisprudenc\u00ebn kushtetuese, ky reflektim \u00ebsht\u00eb i paplot\u00eb, p\u00ebr sa koh\u00eb jan\u00eb reflektuar vet\u00ebm tre kriteret: i) \u00e7\u00ebshtja duhet t\u00eb ket\u00eb t\u00eb b\u00ebj\u00eb me funksionin ligjv\u00ebn\u00ebs dhe funksione t\u00eb tjera\u00a0 t\u00eb Kuvendit; ii) objekti i hetimit duhet t\u00eb fokusohet n\u00eb \u00e7\u00ebshtje ose subjekte konkrete; iii) duhet t\u00eb ekzistojn\u00eb t\u00eb dh\u00ebna ose indicie t\u00eb mjaftueshme p\u00ebr ekzistenc\u00ebn e \u00e7\u00ebshtjes p\u00ebr t\u00eb cil\u00ebn k\u00ebrkohet ngritja e komisionit hetimor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke l\u00ebn\u00eb jasht\u00eb k\u00ebtyre kritereve \u201cformulimin alternativ\u201d t\u00eb objektit t\u00eb hetimit, si nj\u00eb nga elementet q\u00eb mund\u00ebson ngritjen e komisionit hetimor, formulimi aktual i dispozit\u00ebs ligjore passjell cenimin deri n\u00eb pamund\u00ebsin\u00eb e ushtrimit t\u00eb s\u00eb drejt\u00ebs s\u00eb pakic\u00ebs parlamentare.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata theksoi se kontrolli parlamentar \u00ebsht\u00eb i lidhur me legjitimitetin e drejtp\u00ebrdrejt\u00eb demokratik t\u00eb Parlamentit dhe n\u00ebp\u00ebrmjet tij merr legjitimitet edhe vet\u00eb qeverisja.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimi i nd\u00ebrmjet\u00ebm p\u00ebr refuzimin e provave duhet t\u00eb jet\u00eb p\u00ebrjashtim nga rregulli i p\u00ebrgjithsh\u00ebm, sipas t\u00eb cilit provat e k\u00ebrkuara nga pakica parlamentare duhet t\u00eb merren. Vendimi p\u00ebr refuzimin e provave duhet t\u00eb jet\u00eb i arsyetuar n\u00eb drejtim t\u00eb shkaqeve. Nj\u00eb vendim refuzimi mund t\u00eb \u00e7oj\u00eb edhe n\u00eb lindjen e nj\u00eb mosmarr\u00ebveshjeje kompetencash nd\u00ebrmjet organeve kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata, duke mbajtur n\u00eb konsiderat\u00eb se procedura e hetimit parlamentar ndjek q\u00ebllime t\u00eb ndryshme nga ajo e procedimit penal, duke synuar qart\u00ebsimin e nj\u00eb \u00e7\u00ebshtjeje p\u00ebr arsye politike, thekson se ky q\u00ebllim p\u00ebrputhet me parimin e ndarjes s\u00eb pushteteve.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa m\u00eb sip\u00ebr, Gjykata arriti n\u00eb k\u00ebt\u00eb p\u00ebrfundim p\u00ebr shkak t\u00eb paqart\u00ebsis\u00eb n\u00eb formulimin e k\u00ebtyre parashikimeve ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me pik\u00ebn 1\/2, Gjykata vler\u00ebsoi se formulimi nuk \u00ebsht\u00eb i qart\u00eb n\u00eb drejtim t\u00eb parimit t\u00eb ndarjes dhe balancimit nd\u00ebrmjet pushteteve, si dhe nevoj\u00ebs p\u00ebr k\u00ebt\u00eb nd\u00ebrhyrje. Q\u00ebllimi i ruajtjes s\u00eb sekretit hetimor mund t\u00eb p\u00ebrmbushet nga pyetja e d\u00ebshmitar\u00ebve me dyer t\u00eb mbyllura.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kurse n\u00eb lidhje me pik\u00ebn 2\/4, Gjykata v\u00ebren se ndon\u00ebse n\u00eb thelb duket se i referohet p\u00ebrmbajtjes s\u00eb nenit 32 t\u00eb Kushtetut\u00ebs, lidhur me garantimin e s\u00eb drejt\u00ebs kushtetuese p\u00ebr t\u00eb mos deklaruar kund\u00ebr vetvetes ose familjes s\u00eb vet, kjo e drejt\u00eb \u00ebsht\u00eb e zbatueshme n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb jo vet\u00ebm nga norma kushtetuese, por garantohet edhe n\u00eb kuad\u00ebr t\u00eb parimit t\u00eb procesit t\u00eb rregullt ligjor, sipas p\u00ebrmbajtjes s\u00eb nenit 3, shkronja \u201cb\u201d, t\u00eb ligjit nr. 106\/2023. N\u00eb \u00e7do rast ajo plot\u00ebsohet edhe nga garancit\u00eb q\u00eb ofron Kodi i Procedur\u00ebs Penale, i cili \u00ebsht\u00eb i zbatuesh\u00ebm n\u00eb procedur\u00ebn hetimore t\u00eb kontrollit parlamentar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata vler\u00ebson t\u00eb theksoj\u00eb se n\u00eb trajtimin e pretendimeve dhe prap\u00ebsimeve mbi k\u00ebt\u00eb dispozit\u00eb ballafaqohen e drejta p\u00ebr informim dhe transparenc\u00eb e organeve t\u00eb zgjedhura, n\u00eb kuptim t\u00eb nenit 23, pika 3, t\u00eb Kushtetut\u00ebs, n\u00eb raport me t\u00eb drejtat e tjera t\u00eb njeriut (si\u00e7 jan\u00eb ajo e jet\u00ebs private, personale, jet\u00ebs, sh\u00ebndetit etj.). Gjykata arriti n\u00eb p\u00ebrfundimin se, si rregull, veprimtaria e komisionit hetimor duhet t\u00eb jet\u00eb publike dhe vet\u00ebm p\u00ebrjashtimisht ajo mund t\u00eb zhvillohet me dyer t\u00eb mbyllura, kur t\u00eb drejtat e njeriut prevalojn\u00eb n\u00eb raport me t\u00eb drejt\u00ebn p\u00ebr informim.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrve\u00e7 sa m\u00eb sip\u00ebr, n\u00eb lidhje me \u201csekretin tregtar\u201d, sipas shkronj\u00ebs \u201cc\u201d, Gjykata vler\u00ebsoi se n\u00eb zbatimin e k\u00ebsaj dispozite duhet t\u00eb zbatohet p\u00ebrkufizimi i tij sipas legjislacionit n\u00eb fuqi. Nd\u00ebrsa n\u00eb lidhje me \u201csekretin n\u00eb interes t\u00eb shtetit\u201d, sipas shkronj\u00ebs \u201cd\u201d, Gjykata vler\u00ebsoi se ai duhet t\u00eb interpretohet si \u00e7do e dh\u00ebn\u00eb e parashikuar si informacion i klasifikuar n\u00eb baz\u00eb t\u00eb ligjit, p\u00ebrfshir\u00eb edhe \u201csekretin hetimor\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa u p\u00ebrket dispozitave t\u00eb tjera t\u00eb ligjit nr. 106\/2023 t\u00eb kund\u00ebrshtuara nga k\u00ebrkuesi, Gjykata vler\u00ebsoi rr\u00ebzimin e tyre si t\u00eb pabazuara.<\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Gjykata Kushtetuese i ka pranuar pjes\u00ebrisht k\u00ebrkes\u00ebn 33 deputet\u00ebve t\u00eb opozit\u00ebs, t\u00eb cil\u00ebt k\u00ebrkuan shfuqizimin e ligjit p\u00ebr Komisionet Hetimore.
