N\u00eb nj\u00eb takim me gjyqtar\u00eb, Sadushi vuri theksin te mungesa e burimeve njer\u00ebzore n\u00eb sistemin gjyq\u00ebsor, si edhe financiare, ndon\u00ebse thot\u00eb se ka nj\u00eb p\u00ebrmir\u00ebsim t\u00eb ndjesh\u00ebm. Sadushi thot\u00eb se kjo situat\u00eb \u00ebsht\u00eb kritike n\u00eb t\u00eb gjitha gjykatat e vendit.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\"><em>\u201cMegjith\u00ebse Gjykata e Lart\u00eb ka nj\u00eb p\u00ebrmir\u00ebsim t\u00eb ndjesh\u00ebm t\u00eb situat\u00ebs post-reform\u00eb, fal\u00eb pun\u00ebs dhe angazhimit maksimal t\u00eb gjyqtar\u00ebve dhe stafit administrativ, por edhe K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor q\u00eb ka plot\u00ebsuar numrin e gjyqtar\u00ebve, ajo vijon t\u00eb ket\u00eb pamjaftueshm\u00ebri t\u00eb burimeve njer\u00ebzore, materiale dhe financiare. N\u00eb fakt, kjo \u00ebsht\u00eb situata n\u00eb t\u00eb gjitha gjykatat e Republik\u00ebs, q\u00eb do ta konsideroja problematike, n\u00eb mos edhe kritike\u201d, tha Sadushi.<\/em><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">P\u00ebrgjegj\u00ebsin\u00eb p\u00ebr k\u00ebt\u00eb situat\u00eb Sadushi nuk ia \u2018faturon\u2019 vet\u00ebm ekzekutivit dhe legjislativit, por sipas tij r\u00ebndon edhe mbi pushtetin gjyq\u00ebsor t\u00eb cil\u00ebt duhet t\u00eb k\u00ebrkojn\u00eb prej tyre p\u00ebrmbushjen e detyrimeve kushtetuese e ligjore.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb thot\u00eb se gjyqtar\u00ebt po p\u00ebrballen dosjet q\u00eb po rriten n\u00eb m\u00ebnyr\u00eb drastike.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\"><strong>Nga Kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb, Prof. Sokol Sadushi:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">T\u00eb nderuar gjyqtar\u00eb, 10 maji sh\u00ebnon nj\u00eb dat\u00eb t\u00eb r\u00ebnd\u00ebsishme p\u00ebr gjyq\u00ebsorin shqiptar. E njohim si \u201cDita e Drejt\u00ebsis\u00eb\u201d, por n\u00eb fakt \u00ebsht\u00eb e lidhur ngusht\u00ebsisht me krijimin p\u00ebr her\u00eb t\u00eb par\u00eb t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb. Kjo e b\u00ebn edhe m\u00eb t\u00eb ve\u00e7ant\u00eb. N\u00eb 10 maj 1913 nuk u dha ndonj\u00eb vendim gjyq\u00ebsor, por cil\u00ebsimi si Dita e Drejt\u00ebsis\u00eb synon t\u00eb lart\u00ebsoj\u00eb dhe rr\u00ebnjos\u00eb thell\u00eb nevoj\u00ebn dhe r\u00ebnd\u00ebsin\u00eb q\u00eb ka gjyq\u00ebsori n\u00eb 111 vjet t\u00eb ekzistenc\u00ebs s\u00eb shtetit shqiptar.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Tashm\u00eb \u00ebsht\u00eb b\u00ebr\u00eb e zakont\u00eb, q\u00eb n\u00ebn aureol\u00ebn q\u00eb mban kjo dit\u00eb e sh\u00ebnuar, t\u00eb organizohen takime ose veprimtari q\u00eb lidhen me drejt\u00ebsin\u00eb dhe posa\u00e7\u00ebrisht me sistemin gjyq\u00ebsor. Ato mund t\u00eb jen\u00eb me natyr\u00eb nd\u00ebrgjegj\u00ebsuese, p\u00ebrkujtimore, festive, kritike, ose t\u00eb gjitha bashk\u00eb. Secili prej nesh, natyrsh\u00ebm, b\u00ebn nj\u00eb bilanc t\u00eb arritjeve, v\u00ebshtir\u00ebsive, mos realizimeve, objektivave t\u00eb v\u00ebna dhe atyre t\u00eb munguara, vler\u00ebsimeve a pak\u00ebnaq\u00ebsive, t\u00eb shprehura e t\u00eb n\u00ebnkuptuara, t\u00eb cilat jan\u00eb pjes\u00eb e pandar\u00eb e procesit t\u00eb pun\u00ebs n\u00eb sistem.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb takim mes gjyqtar\u00ebve, fokusi do t\u00eb jet\u00eb n\u00eb dy \u00e7\u00ebshtje kryesore: marr\u00ebdh\u00ebniet mes gjykatave dhe organeve t\u00eb qeverisjes s\u00eb sistemit dhe kontrolli rishikues i vendimeve gjyq\u00ebsore. T\u00eb dy \u00e7\u00ebshtjet jan\u00eb lidhura ngusht\u00eb me m\u00ebnyr\u00ebn se si administrohet drejt\u00ebsia. N\u00eb fjal\u00ebn time do t\u00eb p\u00ebrqendrohem kryesisht te e para.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">\u00cbsht\u00eb fakt i pakund\u00ebrshtuesh\u00ebm q\u00eb v\u00ebshtir\u00ebsit\u00eb n\u00eb administrimin e drejt\u00ebsis\u00eb kan\u00eb qen\u00eb t\u00eb konsiderueshme, ashtu si\u00e7 vijojn\u00eb t\u00eb jen\u00eb t\u00eb pranishme. E kujtoj p\u00ebrher\u00eb rinisjen e pun\u00ebs s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb n\u00eb prill 2020, n\u00eb kulmin e pandemis\u00eb s\u00eb shkaktuar nga Covid-19, me vet\u00ebm 3 gjyqtar\u00eb, me gjysm\u00ebn e administrat\u00ebs n\u00eb dispozicion dhe me 36.000 \u00e7\u00ebshtje n\u00eb pritje p\u00ebr t\u2019u gjykuar! Megjith\u00ebse Gjykata e Lart\u00eb ka nj\u00eb p\u00ebrmir\u00ebsim t\u00eb ndjesh\u00ebm t\u00eb situat\u00ebs post-reform\u00eb, fal\u00eb pun\u00ebs dhe angazhimit maksimal t\u00eb gjyqtar\u00ebve dhe stafit administrativ, por edhe K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor q\u00eb ka plot\u00ebsuar numrin e gjyqtar\u00ebve, ajo vijon t\u00eb ket\u00eb pamjaftueshm\u00ebri t\u00eb burimeve njer\u00ebzore, materiale dhe financiare.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">N\u00eb fakt, kjo \u00ebsht\u00eb situata n\u00eb t\u00eb gjitha gjykatat e Republik\u00ebs, q\u00eb do ta konsideroja problematike, n\u00eb mos edhe kritike, p\u00ebr shkak t\u00eb nivelit t\u00eb performanc\u00ebs s\u00eb administrimit t\u00eb drejt\u00ebsis\u00eb, mang\u00ebsive n\u00eb kryerjen e analiz\u00ebs dhe diagnostikimit t\u00eb problemeve, munges\u00ebs s\u00eb vizionit n\u00eb planifikimin strategjik p\u00ebr t\u00eb kuptuar se \u00e7far\u00eb duhet b\u00ebr\u00eb, dhe n\u00eb ve\u00e7anti p\u00ebr t\u00eb nd\u00ebrgjegj\u00ebsuar dy pushtetet e tjera se n\u00eb \u00e7far\u00eb gjendje ndodhemi dhe se ku duhet t\u00eb shkojm\u00eb.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">P\u00ebrgjegj\u00ebsia r\u00ebndon mbi t\u00eb gjith\u00eb Ne gjyqtar\u00ebt e Republik\u00ebs, ashtu, si edhe mbi K\u00ebshillin e Lart\u00eb Gjyq\u00ebsor, q\u00eb n\u00ebp\u00ebrmjet reagimit institucional dhe legjitimitetit t\u00eb vendimmarrjes duhet t\u00b4i d\u00ebshmojm\u00eb ekzekutivit dhe legjislativit se sistemi i drejt\u00ebsis\u00eb nuk zgjat dor\u00ebn p\u00ebr l\u00ebmosh\u00eb, por k\u00ebrkon prej tyre p\u00ebrmbushjen e detyrimeve kushtetuese e ligjore, n\u00eb funksion t\u00eb parimeve dhe vlerave, mbi t\u00eb cilat vepron nj\u00eb shtet i s\u00eb drejt\u00ebs.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Thelbi i administrimit t\u00eb drejt\u00ebsis\u00eb konsiston n\u00eb premtimin p\u00ebr nj\u00eb drejt\u00ebsi t\u00eb barabart\u00eb para ligjit dhe respektimin e garancive kushtetuese q\u00eb k\u00ebrkon nj\u00eb proces i rregullt. Kjo e b\u00ebn t\u00eb domosdoshme nevoj\u00ebn e gjykatave p\u00ebr mir\u00ebmenaxhim, q\u00eb nuk mund t\u2019ia japin gjyqtar\u00ebt e mbingarkuar me nj\u00eb v\u00ebllim \u00e7\u00ebshtjesh n\u00eb rritje drastike. Ne kemi nevoj\u00eb p\u00ebr nj\u00eb trup\u00eb administrator\u00ebsh t\u00eb aft\u00eb p\u00ebr t\u00eb menaxhuar dhe drejtuar, n\u00eb m\u00ebnyr\u00eb q\u00eb gjyqtar\u00ebt t\u00eb p\u00ebrqendrohen n\u00eb detyr\u00ebn par\u00ebsore, t\u00eb gjykuarit. Gjykatat nuk mund t\u00eb kryejn\u00eb si\u00e7 duhet misionin e tyre, n\u00ebse struktura, qeverisja, vizioni strategjik, programet dhe veprimet q\u00eb nd\u00ebrmerren, nuk krijojn\u00eb nj\u00eb perceptim t\u00eb merituar n\u00eb publik se gjyq\u00ebsor \u00ebsht\u00eb i p\u00ebrgjegjsh\u00ebm.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Tri jan\u00eb drejtimet kryesore, q\u00eb evidentojn\u00eb mir\u00eb apo keq administrimin e drejt\u00ebsis\u00eb.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">S\u00eb pari: Ne t\u00eb gjith\u00eb e dim\u00eb se gjykatat kan\u00eb mang\u00ebsi t\u00eb theksuara n\u00eb infrastruktur\u00eb, q\u00eb evidentohet me:<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">\u2013 godina t\u00eb amortizuara dhe me kufizime t\u00eb ndjeshme t\u00eb hap\u00ebsir\u00ebs s\u00eb duhur p\u00ebr pun\u00eb,<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">\u2013 zyra t\u00eb pamjaftueshme dhe m\u00eb e r\u00ebnda, n\u00eb disa gjykata, pa salla gjykimi, ku seancat gjyq\u00ebsore zhvillohen n\u00eb zyrat e gjyqtar\u00ebve dhe pa regjistrimin e procesit n\u00eb audio,<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">\u2013 nj\u00eb sistem elektronik, pothuajse anakronik, q\u00eb nuk siguron informacion menaxherial, por vet\u00ebm informacion t\u00eb kufizuar statistikor mbi numrin e \u00e7\u00ebshtjeve t\u00eb regjistruara e t\u00eb p\u00ebrfunduara,<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">\u2013 problematika t\u00eb ndjeshme n\u00eb m\u00ebnyr\u00ebn e administrimit dhe t\u00eb arkivimit t\u00eb dosjeve, t\u00eb \u00e7\u00ebshtjeve t\u00eb siguris\u00eb, apo t\u00eb krijimit t\u00eb hap\u00ebsirave t\u00eb p\u00ebrshtatshme p\u00ebr publikun etj.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Nuk arrihet t\u00eb kuptohet se p\u00ebrse \u00ebsht\u00eb n\u00eb at\u00eb gjendje kritike Gjykata e Shkall\u00ebs s\u00eb Par\u00eb t\u00eb Juridiksionit t\u00eb P\u00ebrgjithsh\u00ebm n\u00eb Tiran\u00eb (dhoma Penale dhe Civile), q\u00eb detyron zhvillimin e seancave gjyq\u00ebsore n\u00eb zyr\u00eb dhe gjyqtari nuk guxon t\u00eb dal\u00eb prej saj, sepse n\u00eb \u00e7do moment do t\u00eb ndeshet n\u00eb korridoret e gjykat\u00ebs me pal\u00ebt dhe me avokat\u00ebt? P\u00ebrse duhet t\u00eb pranojm\u00eb Ne gjyqtar\u00ebt t\u00eb kemi drejt\u00ebsi, q\u00eb perfomon me dy standarde, ku n\u00eb nj\u00eb gjykat\u00eb, qoft\u00eb edhe periferike, seancat gjyq\u00ebsore zhvillohen n\u00eb salla gjykimi, nd\u00ebrsa n\u00eb gjykat\u00ebn e kryeqytetit seancat zhvillohen n\u00eb zyrat e gjyqtar\u00ebve?<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">P\u00ebrse n\u00eb Gjykat\u00ebn e Posa\u00e7me kemi rregulla standarde p\u00ebr hyrjen e pal\u00ebve n\u00eb godin\u00eb dhe solemnitetin e zhvillimit t\u00eb seancave gjyq\u00ebsore, nd\u00ebrsa n\u00eb gjykatat e tjera pal\u00ebt p\u00ebrballen me nj\u00eb tjet\u00ebr standard, q\u00eb ve\u00e7se e delegjitimon drejt\u00ebsin\u00eb? Si \u00ebsht\u00eb e mundur q\u00eb \u00ebsht\u00eb pranuar nga t\u00eb gjith\u00eb Ne dhe, n\u00eb ve\u00e7anti nga KLGJ, q\u00eb dy gjykatat e apelit t\u00eb kryeqytetit t\u00eb mos ken\u00eb mjaftuesh\u00ebm zyra dhe salla gjykimi p\u00ebr gjyqtar\u00ebt? A kemi ndonj\u00eb zgjidhje afatshkurt\u00ebr apo afatgjat\u00eb p\u00ebr to?<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">S\u00eb dyti: Gjykata kan\u00eb mungesa t\u00eb ndjeshme n\u00eb burime njer\u00ebzore, kryesisht n\u00eb k\u00ebshilltar\u00eb\/ndihm\u00ebs ligjor\u00eb, sekretar\u00eb gjyq\u00ebsor\u00eb dhe stafin ndihm\u00ebs administrativ. Menaxhimi i burimeve njer\u00ebzore nuk duhet par\u00eb si nj\u00eb rol administrativ, por si rol strategjik e thelb\u00ebsor p\u00ebr suksesin e gjyq\u00ebsorit. Mungon nj\u00eb strategji e qart\u00eb se si mund t\u00eb realizohet p\u00ebrmbushja e k\u00ebtij detyrimi nga KLGJ, kur pengesat p\u00ebr t\u00eb shtuar numrin e ndihm\u00ebsve ligjor\u00eb, sekretareve gjyq\u00ebsore apo t\u00eb stafit administrativ rezultojn\u00eb t\u00eb jen\u00eb sa ligjore, aq edhe financiare e strukturore, sidomos kur planifikohet buxheti dhe nuk parashikohet dhe as insistohet te ekzekutivi dhe legjislativi p\u00ebr nevoj\u00ebn e rritjes s\u00eb numrit t\u00eb punonj\u00ebsve n\u00eb gjykata.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">S\u00eb treti: Mbetet ende shqet\u00ebsim trajtimi i buxhetit financiar q\u00eb Kuvendi i akordon Gjykat\u00ebs s\u00eb Lart\u00eb dhe t\u00eb gjith\u00eb gjykatave, n\u00ebp\u00ebrmjet KLGJ, e cila nuk duket se e ka kuptuar drejt pavar\u00ebsin\u00eb buxhetore t\u00eb gjyq\u00ebsorit. N\u00eb disa raste jan\u00eb v\u00ebn\u00eb re prirje p\u00ebr t\u00eb konfonduar mbik\u00ebqyrjen administrative me mbik\u00ebqyrjen gjyq\u00ebsore. KLGJ sipas kushtetut\u00ebs \u00ebsht\u00eb organ administrativ, nd\u00ebrsa Gjykata e Lart\u00eb dhe t\u00eb gjitha gjykatat jan\u00eb organ gjyq\u00ebsor. I pari \u00ebsht\u00eb krijuar p\u00ebr t\u00eb leht\u00ebsuar pun\u00ebn dhe mir\u00ebfunksionimin e t\u00eb dytit, i cili duhet t\u00eb fokusohet tek dh\u00ebnia e drejt\u00ebsis\u00eb. Nj\u00eb pjes\u00eb e madhe e koh\u00ebs dhe energjis\u00eb s\u00eb gjykatave shpenzohet me komunikime t\u00eb p\u00ebrs\u00ebritura p\u00ebr \u00e7\u00ebshtje t\u00eb buxhetit, gj\u00eb e cila jo vet\u00ebm \u00ebsht\u00eb konsumim i koh\u00ebs, por mbi t\u00eb gjitha nuk pajtohet me kultur\u00ebn institucionale n\u00eb nj\u00eb shtet demokratik.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Pik\u00ebrisht, k\u00ebto tri tregues thelb\u00ebsor\u00eb q\u00eb d\u00ebshmojn\u00eb p\u00ebr gjendjen e gjykatave, nuk i p\u00ebrshtaten nevojave dhe k\u00ebrkesave q\u00eb imponon koha p\u00ebr t\u00eb pasur nj\u00eb drejt\u00ebsi eficente dhe funksionale. Shqet\u00ebsimi publik p\u00ebr efektivitetin e sistemit gjyq\u00ebsor, problematika e gjykatave p\u00ebr t\u00eb p\u00ebrballuar ritmin e lart\u00eb t\u00eb \u00e7\u00ebshtjeve, aksesi n\u00eb drejt\u00ebsi, transparenca, solemniteti, respektimi i afateve kohore t\u00eb gjykimit, cil\u00ebsia n\u00eb vendimmarrje etj, jan\u00eb faktor\u00eb q\u00eb kontribuojn\u00eb n\u00eb administrimin e drejt\u00ebsis\u00eb.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Nj\u00eb vit pas fillimit t\u00eb funksionimit t\u00eb hart\u00ebs gjyq\u00ebsore, perceptimi i opinionit publik p\u00ebr administrimin e drejt\u00ebsis\u00eb nuk rezulton t\u00eb jet\u00eb i k\u00ebnaqsh\u00ebm. U krijua nj\u00eb Gjykat\u00eb Apeli e Juridiksionit t\u00eb P\u00ebrgjithsh\u00ebm p\u00ebr t\u00eb gjith\u00eb Republik\u00ebn, me nj\u00eb organik\u00eb prej 78 gjyqtar\u00ebsh, nd\u00ebrkoh\u00eb q\u00eb rezulton me vet\u00ebm 26 gjyqtar\u00eb, ose 30% e kapacitetit, shif\u00ebr kjo tep\u00ebr e ul\u00ebt, krahasuar me gjykatat e tjera. P\u00ebr k\u00ebt\u00eb gjykat\u00eb situata paraqitet m\u00eb kritike edhe p\u00ebr shkak t\u00eb infrastruktur\u00ebs s\u00eb pap\u00ebrshtatshme t\u00eb saj, n\u00eb t\u00eb cil\u00ebn zyrat dhe sallat e gjykimit nuk mjaftojn\u00eb as p\u00ebr 30 gjyqtar\u00eb. Ky organ \u00ebsht\u00eb formatuar me p\u00ebrb\u00ebrje mikse, gjyqtar\u00eb dhe jo gjyqtar\u00eb. Me sa duket, ky miksim p\u00ebrvojash, megjith\u00ebse me gjyqtar\u00eb n\u00eb shumic\u00eb, nuk po arrin t\u00eb ket\u00eb eficenc\u00ebn e d\u00ebshiruar. Indiferenca, zvarritjet, mungesa e reagimit ndaj \u00e7\u00ebshtjeve sensitive p\u00ebr shkak t\u00eb konformizmit ose interesit t\u00eb \u00e7astit, apatia burokratike, mungesa e vizionit apo demotivimi nuk duhet t\u00eb jen\u00eb t\u00eb pranishme tek an\u00ebtar\u00ebt gjyqtar\u00eb, sepse ata zgjidhen pik\u00ebrisht p\u00ebr t\u00eb p\u00ebr\u00e7uar z\u00ebrin dhe nevojat e koleg\u00ebve t\u00eb tyre n\u00eb organin qeveris\u00ebs.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\">Gjyqtar\u00ebt duhet t\u00eb ken\u00eb nj\u00eb z\u00eb m\u00eb t\u00eb fuqish\u00ebm p\u00ebr t\u00eb nd\u00ebrgjegj\u00ebsuar organin ku jan\u00eb zgjedhur, p\u00ebr tu p\u00ebrballur me dy pushtetet e tjera dhe p\u00ebr t\u2019i imponuar atyre zgjidhjet e domosdoshme. Gjyqtar\u00ebt q\u00eb jan\u00eb t\u00eb mbingarkuar dhe me presionin n\u00eb rritje p\u00ebr t\u00eb dh\u00ebn\u00eb m\u00eb shum\u00eb vendime, u duhet t\u00eb ndajn\u00eb koh\u00ebn e tyre p\u00ebr t\u00eb p\u00ebrmbushur funksione administrative dhe gjyq\u00ebsore.
