N\u00ebp\u00ebrmjet nj\u00eb vendimi paraprak ajo (ECJ), n\u00eb Interpretim t\u00eb Direktiv\u00ebs 2014\/41 t\u00eb BE ka qart\u00ebsuar kushtet e p\u00ebrdorimit t\u00eb k\u00ebtyre provave si\u00e7 do shpjegoj m\u00eb gjat\u00eb n\u00eb analiz\u00ebn ligjore. Ndaj gjykoj se ky ngaz\u00ebllim \u00ebsht\u00eb i pajustifikuar. <\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ngaz\u00ebllim ndjehet normalisht tek ata q\u00eb kan\u00eb p\u00ebrdorur ket\u00eb komunikim, q\u00eb jan\u00eb pjes\u00eb e hetimeve t\u00eb SPAK apo dhe tek zyrtar\u00ebt e lart\u00eb shqiptar\u00eb, t\u00eb cilat si\u00e7 raportojn\u00eb mediat jan\u00eb t\u00eb shumt\u00eb n\u00eb num\u00ebr. I ngaz\u00ebllyer mund t\u00eb jet\u00eb ndier edhe zyrtari shqiptar q\u00eb ka p\u00ebrfituar or\u00ebn 400 mij\u00eb euroshe sipas mediave belge n\u00eb megaprocesin \u201cBlack Eagle\u201d. Por para se t\u00eb shpjegoj se pse ky ngaz\u00ebllim \u00ebsht\u00eb i pajustifikuar n\u00eb syrin e analiz\u00ebs ligjore t\u00eb k\u00ebtij vendimi t\u00eb ECJ, le t\u00eb shpjegojm\u00eb p\u00ebr lexuesin nj\u00eb hyrje t\u00eb shkurt\u00ebr mbi k\u00ebt\u00eb histori fantastike ligjore n\u00eb bot\u00eb.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">BACKGROUNDI I NJ\u00cb APLIKACIONI IKONIK SI \u2018SKY ENCROCHAT\u2019<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Padyshim q\u00eb p\u00ebrgjimi i komunikimeve dhe sekuestrimi i mjeteve t\u00eb komunikimit, (telefonave) \u00ebsht\u00eb \u00e7el\u00ebsi i k\u00ebrkimit dhe marrjes s\u00eb provave p\u00ebr \u00e7do prokuror n\u00eb bote dhe \u00ebsht\u00eb kthyer n\u00eb \u201ctrendy\u201d. Sekuestrimi i tyre n\u00eb vitet e fundit n\u00eb bot\u00eb e ka justifikuar k\u00ebt\u00eb teori. <\/span><\/p>\n<p><span style=\"color: #000000;\">Nga New York e deri n\u00eb Rumani e Rusi, prokuror\u00ebt jan\u00eb t\u00eb bindur se sekuestrimi i celular\u00ebve t\u00eb personave t\u00eb dyshuar (kryetar\u00ebve t\u00eb bashkive, zyrtar\u00ebve dhe organizatave kriminale) ka qen\u00eb \u00e7el\u00ebsi i zgjidhjes s\u00eb enigmave t\u00eb hetimit. \u00cbsht\u00eb naive t\u2019i besosh celularit apo ndonj\u00eb aplikacioni se \u00ebsht\u00eb i pad\u00ebgjuesh\u00ebm, nga dita kur jan\u00eb p\u00ebrgjuar kryetar\u00eb shtetesh nga vendet m\u00eb t\u00eb larg\u00ebta e deri tek ato af\u00ebr nesh si Gjermani, Itali, France, Greqi etj..<\/span><\/p>\n<p><span style=\"color: #000000;\"> Numri i celular\u00ebve t\u00eb sekuestruar n\u00eb Shqip\u00ebri n\u00eb 2 vitet e fundit \u00ebsht\u00eb aq i madh sa as mund t\u00eb krahasohet me numrin e celulareve t\u00eb sekuestruar n\u00eb 20 vjet n\u00eb Shqip\u00ebri, ku prokuror\u00ebt thuhet se kan\u00eb gjetur \u00e7el\u00ebsin p\u00ebr t\u00eb ngritur akuza, fal\u00eb kjo edhe naivitetit, por edhe arroganc\u00ebs s\u00eb zyrtar\u00ebve se ne i kemi t\u00eb gjith\u00eb n\u00ebn kontroll.<\/span><\/p>\n<p><span style=\"color: #000000;\">E nd\u00ebrsa organet ligjv\u00ebn\u00ebse n\u00eb bot\u00eb mbyll\u00ebn betej\u00ebn ligjore me BBM n\u00eb vitin 2015 (Black Berry Messenger q\u00eb pretendonte biseda t\u00eb encryptuara, t\u00eb pap\u00ebrgjueshme) dhe vijuan n\u00eb luft\u00ebn ndaj krimit t\u00eb organizuar dhe terrorizmit, krimi dukej q\u00eb ishte nj\u00eb hap para. <\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb fund t\u00eb vitit 2015 nj\u00eb bande holandeze e krimit te organizuar sipas mediave holandeze, financoi krijuesit e \u2018EncroChat\u2019.1 Encrochat, p\u00ebrdorte nj\u00eb kompani guask\u00eb (Shell Company) n\u00eb Panama dhe nj\u00eb llogari bankare nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb transferuar fonde.2 Identiteti i themeluesit dhe pronar\u00ebt e \u2018EncroChat\u2019 nuk dihen ende por ata duhet t\u00eb jen\u00eb t\u00eb lumtur n\u00eb pranver\u00ebn e vitit 2016 kur lan\u00e7uan p\u00ebr here te pare telefonat dhe arrit\u00ebn deri mbi 60.000 abonent\u00eb n\u00eb gjith\u00eb bot\u00ebn me nj\u00eb sh\u00ebrbim t\u00eb paguar shtrenjt\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Jean-Francois Eap, CEO i \u2018Sky ECC\u2019, \u00ebsht\u00eb akuzuar nd\u00ebrkoh\u00eb p\u00ebr konspiracion dhe shantazh p\u00ebr shp\u00ebrndarjen e kokain\u00ebs, heroin\u00ebs dhe metatik\u00ebs, krime q\u00eb mbartin nj\u00eb d\u00ebnim t\u00eb p\u00ebrjetsh\u00ebm n\u00eb Shtetet e Bashkuara. Ai pretendon se nuk ka lidhje me kriminel\u00ebt por nj\u00eb raport i Xhandarmeris\u00eb Komb\u00ebtare Franceze thot\u00eb se 90% e p\u00ebrdoruesve ishin kriminele dhe se Agjencia Komb\u00ebtare Britanike (NCA) thot\u00eb se ende nuk ka gjetur prova q\u00eb k\u00ebta telefona t\u00eb jen\u00eb p\u00ebrdorur nga jokriminel\u00eb. <\/span><\/p>\n<p><span style=\"color: #000000;\">Dhe p\u00ebr t\u2019u rikthyer pak n\u00eb Shqip\u00ebri, \u00e7far\u00eb do ti duhej nj\u00eb qytetari aq m\u00eb shume zyrtari, nj\u00eb telefon i encryptuar dhe aq i shtrenjt\u00eb n\u00ebse nuk do e p\u00ebrdorte p\u00ebr nj\u00eb veprimtari kriminale? E v\u00ebshtire t\u00eb bind\u00ebsh nj\u00eb prokuror apo gjyqtar p\u00ebr t\u00eb kund\u00ebrt\u00ebn e k\u00ebsaj, gjithsesi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por dogma se krimi \u00ebsht\u00eb nj\u00eb hap para, duket se nuk funksionoi plot\u00ebsisht. Fundjava e par\u00eb e shtatorit 2018 ka qen\u00eb nj\u00eb dite e bukur p\u00ebr organet ligjzbatuese, teksa nj\u00eb skuad\u00ebr hetimi e p\u00ebrbashk\u00ebt (joint investigation team) me ekspert\u00eb nga Holanda dhe Franca, krijuan nj\u00eb software Trojan dhe i k\u00ebrkuan nj\u00eb autorizim gjyq\u00ebsor Gjykat\u00ebs Penale t\u00eb Lille.<\/span><\/p>\n<p><span style=\"color: #000000;\"> Ky software u ngarkua n\u00eb server atje dhe u instalua n\u00eb ato telefona celular\u00eb p\u00ebrmes nj\u00eb p\u00ebrdit\u00ebsimi t\u00eb IMITUAR. Policia franceze arriti t\u00eb siguronte t\u00eb dh\u00ebna fantastike nga server i EncroChat t\u00eb cil\u00ebn me t\u00eb drejt\u00eb e quajn\u00eb \u201cthesar\u201d t\u00eb komunikimeve t\u00eb krimit. Nga nj\u00eb total prej 66\u2019134 p\u00ebrdoruesish t\u00eb regjistruar, u prek\u00ebn 32\u2019477 p\u00ebrdorues n\u00eb 122 vende, p\u00ebrfshir\u00eb rreth 4\u2019600 p\u00ebrdorues n\u00eb Gjermani.<\/span><\/p>\n<p><span style=\"color: #000000;\">Komunikimet p\u00ebrfshijn\u00eb trafikun m\u00eb t\u00eb madh t\u00eb dograve n\u00eb bot\u00eb, vrasje dhe korrupsion, lidhje t\u00eb krimit me politik\u00ebn, t\u00eb cilat edhe n\u00eb vendin ton\u00eb t\u00eb vog\u00ebl po ekzaminohen \u00e7do dit\u00eb edhe pse me ngadal\u00ebsi. Por qershori i 2020 do ishte fatal p\u00ebr p\u00ebrdoruesit anemban\u00eb botes kur mor\u00ebn njoftimin nga kompania pronare e \u2018Sky Encrochat\u2019 se policia ishte infiltruar.<\/span><\/p>\n<p><span style=\"color: #000000;\"> Mbyllja e telefonave, zhdukja e tyre nuk kishte me vlere dhe prej asaj dite m\u00eb shume se 6.500 t\u00eb arrestuarit n\u00eb mbar\u00eb bot\u00ebn dhe ata q\u00eb ende nuk jan\u00eb arrestuar nuk e b\u00ebn\u00eb m\u00eb kurr\u00eb gjumin e qet\u00eb. Ata angazhuan avokat\u00eb t\u00eb mir\u00ebpaguar dhe profesionist\u00eb p\u00ebr t\u00eb zhb\u00ebre sa t\u00eb mundin operacionin m\u00eb t\u00eb madh t\u00eb k\u00ebtij shekulli nga viti 2000 kund\u00ebr krimit t\u00eb organizuar dhe terrorizmit.<\/span><\/p>\n<p><span style=\"color: #000000;\"> N\u00eb Shqip\u00ebri vjeshta e vitit 2020 po ashtu ishte dramatike p\u00ebr p\u00ebrdoruesit e tyre. Ka nj\u00eb ngatht\u00ebsi ende n\u00eb zbulimin dhe identifikimin e lidhjeve t\u00eb krimit me politik\u00ebn n\u00eb Shqip\u00ebri dhe zhurma e avokat\u00ebve t\u00eb t\u00eb arrestuarve se po u zbardhen t\u00eb gjitha do dal\u00eb ky dhe ai, ka b\u00ebr\u00eb t\u00eb vet\u00ebn n\u00eb k\u00ebt\u00eb frenim aspak ligjor dhe aspak te mir\u00ebpritur p\u00ebr qytetar\u00ebt dhe drejt\u00ebsin\u00eb. Por pak dite m\u00eb par\u00eb ata u ngaz\u00ebllyen nga vendimi i ECJ. Po a \u00ebsht\u00eb i justifikuesh\u00ebm ky ngaz\u00ebllim?<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">5 PYETJE DHE 5 P\u00cbRGJIGJE LIDHUR ME PROCESIN PARA GJED-S\u00cb (ECJ)<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Vendimi i ECJ \u00ebsht\u00eb nj\u00eb vendim paraprak q\u00eb ka lidhje me interpretimin e Direktiv\u00ebs 2014\/41, lidhur me Urdhrin Evropian t\u00eb Hetimit (EIO) n\u00eb \u00e7\u00ebshtjet penale me k\u00ebrkes\u00eb t\u00eb Gjykat\u00ebs Rajonale e Berlinit e cila ngriti dyshime mbi ligjshm\u00ebrin\u00eb e Urdhrave Evropian t\u00eb Hetimit, duke shtruar 5 pyetje. GJED ka juridiksion vet\u00ebm p\u00ebr vendet an\u00ebtare te BE dhe ne ende nuk jemi, por meqen\u00ebse u hap ky diskutim dhe me gjasa vendimet e saj mund te shfryt\u00ebzohen nga te akuzuarit k\u00ebtu p\u00ebr t\u00eb shkuar ne GJEDNJ (Strasburg) le t\u00eb shohim me radh\u00eb n\u00ebse jan\u00eb ose jo relevante p\u00ebr Shqip\u00ebrin\u00eb.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">P\u00cbR PYETJET E NGRITURA, GJED ARSYETOI DHE U P\u00cbRGJIGJ SI M\u00cb POSHT\u00cb:<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"color: #0000ff;\">P\u00ebr pyetjen nr. 1<\/span><\/em> \u2013 \u201cA \u00ebsht\u00eb e nevojshme p\u00ebrfshirja e nj\u00eb gjyqtari p\u00ebr l\u00ebshimin e nj\u00eb EIO kur provat jan\u00eb tashm\u00eb n\u00eb Shtetin ekzekutues, ve\u00e7an\u00ebrisht n\u00ebse ligji vendas n\u00eb shtetin l\u00ebshues k\u00ebrkon autorizim gjyq\u00ebsor p\u00ebr mbledhjen e provave t\u00eb ngjashme?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata n\u00ebnvizoi interpretimin e Nenit 1(1) dhe Nenit 2(c) t\u00eb Direktiv\u00ebs 2014\/41, t\u00eb cilat k\u00ebrkojn\u00eb l\u00ebshimin ose miratimin e EIO nga nj\u00eb \u201cautoritet gjyq\u00ebsor\u201d. Nd\u00ebrsa direktiva nuk e p\u00ebrcakton k\u00ebt\u00eb term n\u00eb m\u00ebnyr\u00eb t\u00eb shprehur, ai \u00ebsht\u00eb shpjeguar p\u00ebrmes nj\u00eb reference te Neni 2(c), ku nj\u00eb prokuror njihet si \u201cautoritet l\u00ebshues\u201d n\u00ebse \u00ebsht\u00eb kompetent n\u00eb rastin p\u00ebrkat\u00ebs, dhe n\u00ebse p\u00ebrfshihet nj\u00eb gjykat\u00ebs apo jo varet nga ligji i brendsh\u00ebm i shtetit l\u00ebshues. <\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse, n\u00eb nj\u00eb situat\u00eb t\u00ebr\u00ebsisht komb\u00ebtare, marrja fillestare e provave k\u00ebrkon autorizim gjyq\u00ebsor p\u00ebr shkak t\u00eb ndikimit t\u00eb tyre n\u00eb t\u00eb drejtat themelore, nj\u00eb prokuror nuk mund t\u00eb konsiderohet si nj\u00eb autoritet l\u00ebshues kompetent sipas direktiv\u00ebs. Gjithashtu, Gjykata shqyrtoi legjislacionin gjerman, ku Paragrafi 100e(6)(1) i Kodi i Procedur\u00ebs Penale(Strafprozessordnung) lejon transmetimin e provave midis autoriteteve hetimore pa miratim gjyq\u00ebsor. N\u00ebse ky skenar p\u00ebrputhet me k\u00ebrkesat e direktiv\u00ebs mbetet p\u00ebr t\u2019u vendosur nga gjykata referuese(Gjykata e Berlinit).<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\">Konkluzion<\/span>: Gjykata u shpreh se nd\u00ebrsa l\u00ebshimi i EIO-s\u00eb zakonisht p\u00ebrfshin autoritet gjyq\u00ebsor, n\u00ebse ligji i brendsh\u00ebm i shtetit l\u00ebshues lejon transmetimin e provave nga nj\u00eb prokuror pa miratim gjyq\u00ebsor, nj\u00eb EIO e till\u00eb nuk nevojitet t\u00eb l\u00ebshohet nga nj\u00eb gjykat\u00ebs. Ky konkluzion nuk implikon aspak hetimet n\u00eb Shqip\u00ebri dhe nuk \u00ebsht\u00eb relevant, ndaj nuk ka vend p\u00ebr ndonj\u00eb ngaz\u00ebllim t\u00eb sforcuar.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #0000ff;\"><em>P\u00ebr pyetjen nr. 2<\/em><\/span> \u2013 \u201cMundet t\u00eb l\u00ebshohet nj\u00eb EIO p\u00ebr transmetimin e t\u00eb dh\u00ebnave t\u00eb marra p\u00ebrmes masave t\u00eb p\u00ebrgjimit, pa prova konkrete t\u00eb veprimeve serioze kriminale, dhe ku padhunueshm\u00ebria e t\u00eb dh\u00ebnave nuk mund t\u00eb verifikohet, p\u00ebrputhet me Nenin 6(1)(a) t\u00eb Direktiv\u00ebs 2014\/41?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me pyetjen nr. 2, Gjykata interpretoi Nenin 6(1) t\u00eb Direktiv\u00ebs 2014\/41 n\u00eb kontekstin e l\u00ebshimit t\u00eb EIO p\u00ebr transmetimin e provave q\u00eb tashm\u00eb jan\u00eb n\u00eb posedim t\u00eb autoriteteve t\u00eb shtetit ekzekutues, ve\u00e7an\u00ebrisht t\u00eb dh\u00ebnat e marra p\u00ebrmes masave t\u00eb p\u00ebrgjimit. <\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr t\u2019ju p\u00ebrgjigjur pyetjes s\u00eb dyt\u00eb, Gjykata u fut n\u00eb detajet e kushteve substanciale p\u00ebr l\u00ebshimin e EIO-ve, duke u fokusuar n\u00eb nevoj\u00ebn, proporcionitetin dhe integritetin e t\u00eb dh\u00ebnave t\u00eb marra. Gjykata shpjegoi se Direktiva 2014\/41 nuk k\u00ebrkon v\u00ebrtetim konkret t\u00eb shkeljeve t\u00eb r\u00ebnda kundrejt \u00e7do individ n\u00eb momentin e l\u00ebshimit t\u00eb nj\u00eb EIO-je, as nuk p\u00ebrjashton automatikisht l\u00ebshimin e EIO-s\u00eb kur nuk mund t\u00eb verifikohet padhunueshm\u00ebria e t\u00eb dh\u00ebnave, n\u00ebse e drejta p\u00ebr nj\u00eb gjykim t\u00eb drejt\u00eb garantohet n\u00eb procedurat e m\u00ebtejshme.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\">Konkluzion<\/span>: Gjykata konfirmoi se l\u00ebshimi i EIO-s\u00eb p\u00ebr transmetimin e t\u00eb dh\u00ebnave t\u00eb p\u00ebrgjuara nuk \u00ebsht\u00eb i ndaluar sipas Nenit 6(1)(a) t\u00eb Direktiv\u00ebs 2014\/41, edhe n\u00eb munges\u00eb t\u00eb provave p\u00ebr veprime t\u00eb r\u00ebnd\u00eb kriminale p\u00ebr sa koh\u00eb do t\u00eb garantohet e drejta p\u00ebr nj\u00eb gjykim t\u00eb drejt\u00eb n\u00eb procedurat e m\u00ebtejshme. Edhe kjo p\u00ebrgjigje s\u00ebrish nuk krijon probleme p\u00ebr hetimet n\u00eb Shqip\u00ebri, megjithat\u00eb ajo q\u00eb duhet th\u00ebn\u00eb \u00ebsht\u00eb se nuk mund t\u00eb akuzohet dhe d\u00ebnohet nj\u00eb person vet\u00ebm se ka p\u00ebrdorur nj\u00eb pajisje t\u00eb till\u00eb dhe as n\u00ebse verifikohet se ai ka shkruar ose jo mesazhe me nj\u00eb tekst t\u00eb caktuar. \u00cbsht\u00eb e domosdoshme q\u00eb p\u00ebr provueshm\u00ebrin\u00eb e akuz\u00ebs duhet t\u00eb ekzistojn\u00eb provat q\u00eb lidhin p\u00ebrmbajtjen me realitetin.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"color: #0000ff;\">P\u00ebr pyetjen nr. 3<\/span> <\/em>\u2013 \u201cA \u00ebsht\u00eb nj\u00eb EIO n\u00eb p\u00ebrputhje me Nenin 6(1)(b) t\u00eb Direktiv\u00ebs 2014\/ 41, kur p\u00ebr transmetimin e t\u00eb dh\u00ebnave t\u00eb telekomunikacioneve, jan\u00eb marr\u00eb p\u00ebrmes masave t\u00eb p\u00ebrgjimit t\u00eb ndaluara n\u00ebn ligjin e shtetit l\u00ebshues?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr pyetjen e tret\u00eb, gjykata shqyrton n\u00ebse l\u00ebshimi i EIO \u00ebsht\u00eb subjekt i kushtet t\u00eb nj\u00ebjta substanciale si ato n\u00eb ligjin e brendsh\u00ebm t\u00eb shtetit l\u00ebshues lidhur me mbledhjen e provave. Gjykata n\u00ebnvizon se ligjshm\u00ebria e k\u00ebtyre EIOve p\u00ebrputhet me t\u00eb nj\u00ebjtat kushte q\u00eb aplikohen n\u00eb rastet e ngjashme komb\u00ebtare. Megjithat\u00eb, Gjykata thekson se l\u00ebshimi i EIO-s\u00eb nuk \u00ebsht\u00eb i varur nga ligjet e shtetit ekzekutues q\u00eb rregullojn\u00eb mbledhjen e provave, pavar\u00ebsisht n\u00ebse provat jan\u00eb mbledhur n\u00eb territorin e tij dhe n\u00eb interesin e tij. N\u00eb p\u00ebrgjith\u00ebsi, interpretimi shpreh parimin e njohjes reciproke dhe besimit midis shteteve an\u00ebtare t\u00eb BE-s\u00eb n\u00eb bashk\u00ebpunimin gjyq\u00ebsor, si\u00e7 \u00ebsht\u00eb e parashikuar n\u00eb Direktiv\u00ebn 2014\/41.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\">Konkluzion<\/span>: Ligjshm\u00ebria e EIO, p\u00ebr transmetimin e provave, duhet t\u00eb p\u00ebrputhet me t\u00eb nj\u00ebjtat kushte q\u00eb aplikohen n\u00eb rastet e ngjashme komb\u00ebtare. P\u00ebr Shqip\u00ebrin\u00eb duke qen\u00eb se nuk jemi pjes\u00eb e BE dhe nuk aplikojm\u00eb Direktiv\u00ebn m\u00eb sip\u00ebr, komunikimi bazohet n\u00eb Marr\u00ebveshjet p\u00ebr bashk\u00ebpunimin gjyq\u00ebsor mes vendeve respektive, gj\u00eb e cila \u00ebsht\u00eb relevante p\u00ebr Franc\u00ebn, Belgjik\u00ebn apo Gjermanin\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"color: #0000ff;\">P\u00ebr pyetjet nr. 4(a) dhe nr. 4(b)<\/span><\/em> \u2013 \u201cA paraqet nj\u00eb mas\u00eb q\u00eb p\u00ebrfshin infiltrimin e pajisjeve terminale p\u00ebr q\u00ebllim t\u00eb mbledhjes s\u00eb t\u00eb dh\u00ebnave t\u00eb trafikut, vendndodhjes dhe komunikimit t\u00eb nj\u00eb sh\u00ebrbimi t\u00eb komunikimit n\u00eb internet n\u00eb kuptimin e Nenit 31 t\u00eb Direktiv\u00ebs 2014\/41? dhe Cili \u00ebsht\u00eb autoriteti kompetent q\u00eb duhet t\u00eb adresohet njoftimi n\u00ebn Nenin 31(1) i Direktiv\u00ebs 2014\/41?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Pyetjet 4(a) dhe 4(b), shqyrtojn\u00eb n\u00ebse nj\u00eb mas\u00eb q\u00eb p\u00ebrfshin infiltrimin e pajisjeve terminale p\u00ebr t\u00eb mbledhur t\u00eb dh\u00ebna t\u00eb komunikimit t\u00eb internetit p\u00ebrfshihet si \u201cp\u00ebrgjim (interceptim) i telekomunikacionit\u201d parashikuar n\u00eb Nenin 31 t\u00eb Direktiv\u00ebs 2014\/41. Gjykata qart\u00ebsoi se nj\u00eb infiltrim i till\u00eb, q\u00eb synon t\u00eb mbledh\u00eb t\u00eb dh\u00ebna p\u00ebr komunikim, trafik dhe vendndodhje, bie n\u00ebn parashikimin e \u201cp\u00ebrgjimit t\u00eb telekomunikacionit\u201d si\u00e7 \u00ebsht\u00eb p\u00ebrcaktuar n\u00eb direktiv\u00eb. Kjo do t\u00eb thot\u00eb q\u00eb duhet t\u00eb njoftohet autoriteti p\u00ebrkat\u00ebs i Shtetit An\u00ebtar ku \u00ebsht\u00eb vendosur objekti i p\u00ebrgjimit. <\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrve\u00e7 k\u00ebsaj, Pyetja 4(a) k\u00ebrkon sqarime n\u00eb lidhje me autoritetin kompetent p\u00ebr pranimin e k\u00ebtyre njoftimeve. Gjykata shpjegon se, megjith\u00ebse direktiva nuk specifikon n\u00ebse autoriteti duhet t\u00eb jet\u00eb administrativ ose gjyq\u00ebsor, \u00e7do Shtet An\u00ebtar \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr p\u00ebrcaktimin e autoritetit t\u00eb p\u00ebrshtatsh\u00ebm. N\u00ebse Shteti An\u00ebtar p\u00ebrgjues nuk mund t\u00eb identifikoj\u00eb autoritetin kompetent t\u00eb Shtetit An\u00ebtar t\u00eb njoftuar, njoftimi mund t\u2019i dor\u00ebzohet \u00e7do autoriteti q\u00eb Shteti An\u00ebtar p\u00ebrgjues e konsideron t\u00eb p\u00ebrshtatsh\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\">Konkluzion<\/span>: Gjykata konkludoi se infiltrimi i pajisjeve terminale p\u00ebr t\u00eb mbledhur t\u00eb dh\u00ebna t\u00eb komunikimit t\u00eb internetit p\u00ebrfshihet si \u201cp\u00ebrgjim (interceptim) i telekomunikacionit\u201d parashikuar n\u00eb Nenin 31 t\u00eb Direktiv\u00ebs 2014\/41. N\u00ebse Shteti An\u00ebtar p\u00ebrgjues \u00ebsht\u00eb i pasigurt p\u00ebr autoritetin kompetent t\u00eb Shtetit An\u00ebtar t\u00eb njoftuar, ai mund t\u00eb dor\u00ebzoj\u00eb njoftimin \u00e7do autoriteti q\u00eb e konsideron t\u00eb p\u00ebrshtatsh\u00ebm. Kjo siguron p\u00ebrputhjen me direktiv\u00ebn dhe leht\u00ebson komunikimin efektiv mes Shteteve An\u00ebtare n\u00eb \u00e7\u00ebshtjet e p\u00ebrgjimit.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"color: #0000ff;\">P\u00ebr pyetjen nr. 4(c)<\/span><\/em> \u2013 \u201cA shtrihet mbrojtja e ofruar nga Neni 31 i Direktiv\u00ebs 2014\/41 p\u00ebr p\u00ebrdoruesit individual\u00eb t\u00eb telekomunikacionit deri te p\u00ebrdorimi i t\u00eb dh\u00ebnave p\u00ebr ndjekjen penale n\u00eb Shtetin e njoftuar, dhe n\u00eb qoft\u00eb se po, a \u00ebsht\u00eb kjo mbrojtje e vler\u00ebsuar n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb si mbrojtja e sovranitetit t\u00eb Shtetit t\u00eb njoftuar?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Pyetja 4(c) k\u00ebrkon t\u00eb sqaroj\u00eb n\u00ebse Neni 31 i Direktiv\u00ebs 2014\/41 synon t\u00eb mbroj\u00eb t\u00eb drejtat e individ\u00ebve t\u00eb prekur nga masat e p\u00ebrgjimit t\u00eb telekomunikacionit dhe n\u00ebse kjo mbrojtje shtrihet n\u00eb p\u00ebrdorimin e t\u00eb dh\u00ebnave t\u00eb mbledhura n\u00eb ndjekje penale t\u00eb nisura n\u00eb Shtetin An\u00ebtar t\u00eb njoftuar. <\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata shpjegon se Neni 31, i cili parashikon p\u00ebrgjimet q\u00eb nuk k\u00ebrkojn\u00eb ndihm\u00eb teknike nga Shteti An\u00ebtar ku ndodh p\u00ebrgjimi, nuk bie n\u00ebn rrezen e urdhrave evropian\u00eb t\u00eb hetimit. N\u00eb vend t\u00eb k\u00ebsaj, ai fuqizon autoritetin kompetent t\u00eb Shtetit An\u00ebtar t\u00eb njoftuar p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00ebse p\u00ebrgjimi nuk do t\u00eb autorizohej brenda vendit. <\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu, Neni 31 synon t\u00eb garantoj\u00eb sovranitetin e Shtetit An\u00ebtar t\u00eb njoftuar dhe t\u00eb siguroj\u00eb nj\u00eb nivel t\u00eb garantimit t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb individ\u00ebve, duke p\u00ebrfshir\u00eb t\u00eb drejt\u00ebn p\u00ebr privat\u00ebsi dhe komunikim. Prandaj, \u00ebsht\u00eb vendosur se Neni 31 i Direktiv\u00ebs 2014\/41 n\u00eb t\u00eb v\u00ebrtet\u00eb synon t\u00eb mbroj\u00eb t\u00eb drejtat e individ\u00ebve t\u00eb prekur nga masat e p\u00ebrgjimit t\u00eb telekomunikacionit, duke p\u00ebrfshir\u00eb p\u00ebrdorimin e t\u00eb dh\u00ebnave t\u00eb mbledhura n\u00eb procedurat penale brenda Shtetit An\u00ebtar t\u00eb njoftuar.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\">Konkluzion<\/span>: Gjykata konfirmon se Neni 31 i Direktiv\u00ebs 2014\/41 synon t\u00eb mbroj\u00eb t\u00eb drejtat e individ\u00ebve n\u00eb masat e p\u00ebrgjimit t\u00eb telekomunikacionit, duke p\u00ebrfshir\u00eb p\u00ebrdorimin e t\u00eb dh\u00ebnave p\u00ebr ndjekje penale n\u00eb Shtetin An\u00ebtar t\u00eb njoftuar. Ne rastin e Shqip\u00ebris\u00eb p\u00ebrgjimi ka ndodhur pas nj\u00eb vendimi t\u00eb gjyqtarit t\u00eb Gjykat\u00ebs s\u00eb Lile (France) ndaj e v\u00ebshtire t\u00eb kontestohet niveli i garantimit t\u00eb t\u00eb drejtave t\u00eb njeriut tek ky vendim nga nj\u00eb gjykat\u00eb shqiptare.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"color: #0000ff;\">P\u00ebr pyetjen nr. 5-<\/span><\/em> \u201cCilat jan\u00eb pasojat ligjore t\u00eb marrjes s\u00eb provave kund\u00ebr ligjit t\u00eb BE-s\u00eb p\u00ebrmes nj\u00eb EIO, ve\u00e7an\u00ebrisht n\u00eb lidhje me ndalimin e p\u00ebrdorimit t\u00eb k\u00ebtyre provave dhe ndikimin e tyre n\u00eb proceset penale?\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Pyetja 5 konsideron n\u00ebse gjykatat penale komb\u00ebtare duhet t\u00eb p\u00ebrjashtojn\u00eb informacionin dhe provat e fituara n\u00eb shkelje t\u00eb parimeve t\u00eb ligjit t\u00eb BE-s\u00eb p\u00ebr efektivitetin. Gjykata u shpreh se n\u00ebn ligjin aktual t\u00eb BE-s\u00eb, sistemet ligjore komb\u00ebtare p\u00ebrcaktojn\u00eb kryesisht pranueshm\u00ebrin\u00eb dhe vler\u00ebsimin e k\u00ebsaj lloj prove. <\/span><\/p>\n<p><span style=\"color: #000000;\">Megjithat\u00eb, Neni 14(7) i Direktiv\u00ebs 2014\/41 k\u00ebrkon nga Shtetet An\u00ebtare t\u00eb garantoj\u00eb t\u00eb drejtat e mbrojtjes dhe rregullsin\u00eb n\u00eb procedurat penale kur vler\u00ebsojn\u00eb prova t\u00eb fituara p\u00ebrmes urdhrave evropian\u00eb t\u00eb hetimit, duke detyruar p\u00ebrjashtimin e provave n\u00ebse nj\u00eb pal\u00eb nuk mund t\u00eb p\u00ebrgjigjet efektivisht mbi to dhe n\u00ebse ato kan\u00eb nj\u00eb ndikim t\u00eb r\u00ebnd\u00eb sish\u00ebm n\u00eb gjetjet faktike. Ky p\u00ebrfundim n\u00ebnvizon r\u00ebnd\u00ebsin\u00eb e t\u00eb drejtave q\u00eb i garantohet t\u00eb pandehurit p\u00ebr nj\u00eb gjykim t\u00eb drejt\u00eb dhe nj\u00eb mbrojtje efektive n\u00eb kontekstin e provave t\u00eb marra p\u00ebrmes EIO, si\u00e7 sanksionohet nga legjislacioni i BE-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkluzion: Gjykatat penale komb\u00ebtare nuk duhet t\u2019i administrojn\u00eb ato prova ku personi i interesuar nuk mund t\u00eb shprehet mbi to dhe n\u00ebse provat kan\u00eb nj\u00eb ndikim t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb gjetjet faktike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pyetja e pest\u00eb \u00ebsht\u00eb ndoshta m\u00eb e r\u00ebnd\u00ebsishme dhe ka krijuar nj\u00eb konfuzitet tek gazetar\u00ebt ndoshta, ndaj sqarimi i plote i saj \u00ebsht\u00eb po aq i r\u00ebnd\u00ebsish\u00ebm. E para do duhet t\u00eb v\u00ebrtetohet se provat jan\u00eb marr\u00eb kund\u00ebr ligjit t\u00eb BE, dhe pastaj k\u00ebto prova duhet ti jepen diskrecion i plot\u00eb t\u00eb akuzuarve p\u00ebr t\u2019u shprehur. Kjo p\u00ebrgjigje e Gjykat\u00ebs nuk \u00ebsht\u00eb ndalim p\u00ebr p\u00ebrdorimin e provave por kusht p\u00ebr gjykatat vendase (t\u00eb vendeve an\u00ebtare) q\u00eb t\u00eb ndjekin k\u00ebt\u00eb procedur\u00eb q\u00eb provat e transmetuara nd\u00ebrmjet vendeve t\u00eb jen\u00eb t\u00eb p\u00ebrdorshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb p\u00ebrfundim, ky vendim \u00ebsht\u00eb pse i nj\u00eb gjykate e cila q\u00eb ka juridiksion vet\u00ebm mbi vendet an\u00ebtare t\u00eb BE, n\u00eb asnj\u00eb rresht t\u00eb vendimit t\u00eb saj nuk ka th\u00ebn\u00eb se bisedat e \u2018Sky EncroChat\u2019 nuk mund t\u00eb p\u00ebrdoren n\u00eb proceset penale n\u00eb vendet an\u00ebtare N\u00ebp\u00ebrmjet nj\u00eb vendimi paraprak ajo(ECJ), ne Interpretim te Direktiv\u00ebs 2014\/41t\u00eb BE ka qart\u00ebsuar kushtet e p\u00ebrdorimit t\u00eb k\u00ebtyre provave. <\/span><\/p>\n<p><span style=\"color: #000000;\">Por ky vendim i vendos n\u00eb sfide organet ligjzbatuese n\u00eb Shqip\u00ebri sepse ato duhet jo vet\u00ebm t\u00eb garantojn\u00eb t\u00eb drejtat e t\u00eb pandehurve n\u00eb proceset gjyq\u00ebsore, por dhe duhet t\u00eb lidhin interceptimet me faktet dhe grupfaktet konkrete t\u00eb ndodhura ose jo n\u00eb Shqip\u00ebri, pasi vet\u00ebm me tekstet e mesazheve v\u00ebshtire se mund t\u00eb bindin gjyqtar\u00ebt k\u00ebtu apo n\u00eb GJENDJ p\u00ebr t\u00eb v\u00ebrtetuar akuzat.
