P\u00ebr sa i p\u00ebrket marr\u00ebveshjes p\u00ebr administrimin e Parkut Komb\u00ebtar t\u00eb Butrintit nd\u00ebrmjet Ministris\u00eb s\u00eb Kultur\u00ebs dhe Fondacionit p\u00ebr Menaxhimin e Butrintit, pavar\u00ebsisht natyr\u00ebs jo normative t\u00eb k\u00ebtij akti, Gjykata pranoi juridiksionin e saj p\u00ebr shqyrtimin e tij. N\u00eb k\u00ebt\u00eb drejtim, Gjykata pati parasysh jo vet\u00ebm se ky akt ka veshje formale me ligj p\u00ebr shkak t\u00eb miratimit nga Kuvendi, por edhe natyr\u00ebn kushtetuese t\u00eb pretendimeve t\u00eb ngritura nga k\u00ebrkuesi, t\u00eb cilat ajo i ka konsideruar si p\u00ebrcaktuese t\u00eb juridiksionit kushtetues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Lidhur me pretendimet e paraqitura nga k\u00ebrkuesi, Gjykata vler\u00ebsoi:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr pretendimin p\u00ebr cenimin e parimit t\u00eb ligjshm\u00ebris\u00eb, bazuar n\u00eb nenin 118 t\u00eb Kushtetut\u00ebs, p\u00ebr shkak t\u00eb dh\u00ebnies s\u00eb statutit partner strategjik t\u00eb AADF-s\u00eb me nj\u00eb akt n\u00ebnligjor, Gjykata vler\u00ebsoi se nuk ka juridiksion ratione materiae p\u00ebr shkak t\u00eb natyr\u00ebs individuale t\u00eb k\u00ebtij akti.\u00a0 <\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr pretendimin p\u00ebr cenimin e parimit t\u00eb kontrollit t\u00eb financave publike Gjykata vler\u00ebsoi se \u00ebsht\u00eb haptazi i pabazuar, pasi bazuar n\u00eb aktet e administruara dhe q\u00ebndrimet e pal\u00ebve n\u00eb gjykim ajo arriti n\u00eb p\u00ebrfundimin se nuk vihet n\u00eb diskutim ushtrimi i kompetenc\u00ebs s\u00eb KLSH-s\u00eb p\u00ebr t\u00eb kontrolluar financat publike, pavar\u00ebsisht llojit t\u00eb entitetit q\u00eb i administron ato.\u00a0 <\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr pretendimin p\u00ebr cenimin e parimit t\u00eb ndarjes s\u00eb pushteteve dhe t\u00eb autonomis\u00eb vendore, Gjykata vler\u00ebsoi se argumentet e paraqitura kan\u00eb t\u00eb b\u00ebjn\u00eb me p\u00ebrplasje mes akteve ligjore n\u00eb fuqi, p\u00ebr rrjedhoj\u00eb nuk b\u00ebjn\u00eb pjes\u00eb n\u00eb juridiksionin kushtetues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjykata mori n\u00eb shqyrtim n\u00eb themel vet\u00ebm pretendimet p\u00ebr cenimin e identitetit komb\u00ebtar dhe t\u00eb trash\u00ebgimis\u00eb kulturore t\u00eb lidhur me parimin e shtetit t\u00eb s\u00eb drejt\u00ebs dhe t\u00eb hierarkis\u00eb s\u00eb akteve ligjore.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebto pretendime t\u00eb k\u00ebrkuesit jan\u00eb mb\u00ebshtetur n\u00eb Konvent\u00ebn e Parisit, sipas s\u00eb cil\u00ebs shteti duhet t\u00eb ruaj\u00eb rolin e tij par\u00ebsor p\u00ebr mbrojtjen dhe konservimin e pasuris\u00eb s\u00eb trash\u00ebgimis\u00eb kulturore, kjo e par\u00eb edhe n\u00eb k\u00ebndv\u00ebshtrimin se Parku Komb\u00ebtar i Butrintit b\u00ebn pjes\u00eb jo vet\u00ebm n\u00eb trash\u00ebgimin\u00eb kuturore komb\u00ebtare, p\u00ebr rrjedhoj\u00eb \u00ebsht\u00eb pjes\u00eb e identitetit komb\u00ebtar, por edhe n\u00eb fondin e pasuris\u00eb s\u00eb trash\u00ebgimis\u00eb bot\u00ebrore t\u00eb UNESCO-s. <\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjykata vler\u00ebsoi se pavar\u00ebsisht transferimit t\u00eb kompetencave me natyr\u00eb administrative (menaxhuese) tek Fondacioni p\u00ebr Menaxhimin e Butrintit, shteti vijon t\u00eb ruaj\u00eb atributet e tij sovrane p\u00ebr sa koh\u00eb q\u00eb ruan pron\u00ebsin\u00eb mbi k\u00ebt\u00eb pasuri ashtu edhe administrimin indirekt, n\u00eb p\u00ebrputhje me standardet dhe parimet kushtetuese.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nd\u00ebrkoh\u00eb, Gjykata, p\u00ebr t\u00eb arritur n\u00eb p\u00ebrfundimin n\u00ebse kompetencat e Fondacionit sipas marr\u00ebveshjes bien ndesh me detyrimin konventor p\u00ebr ruajtjen e rolit par\u00ebsor t\u00eb shtetit n\u00eb administrimin e pasuris\u00eb s\u00eb trash\u00ebgimis\u00eb kulturore komb\u00ebtare, e par\u00eb kjo n\u00eb k\u00ebndv\u00ebshtrimin e ruajtjes dhe konservimit, vler\u00ebsoi se marr\u00ebveshja, n\u00eb t\u00ebr\u00ebsin\u00eb e saj, ka krijuar mekanizma garantues, pasi:<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>i) s\u00eb pari, Fondacionit i p\u00ebrket vet\u00ebm administrimi i zakonsh\u00ebm i pasuris\u00eb, nd\u00ebrkoh\u00eb q\u00eb \u00e7do veprimtari q\u00eb kalon kufijt\u00eb e administrimit t\u00eb zakonsh\u00ebm dhe lidhet me nd\u00ebrhyrjet ruajt\u00ebse dhe mbrojt\u00ebse n\u00eb k\u00ebt\u00eb pasuri i p\u00ebrket shtetit;<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>ii) s\u00eb dyti, \u00e7do akt i Fondacionit \u00ebsht\u00eb subjekt i kontrollit t\u00eb drejtp\u00ebrdrejt\u00eb t\u00eb organeve shtet\u00ebrore sipas fush\u00ebs s\u00eb kompetenc\u00ebs t\u00eb p\u00ebrcaktuar me ligj. M\u00eb konkretisht, Fondacioni nuk p\u00ebrjashtohet nga p\u00ebrmbushja e \u00e7do detyrimi ligjor q\u00eb ka sipas legjislacionit \u00e7do entitet tjet\u00ebr shtet\u00ebror apo publik, si\u00e7 jan\u00eb marrja e lejeve ose licencave p\u00ebrkat\u00ebse nga autoritetet kompetente p\u00ebr fillimin e punimeve nd\u00ebrtimore apo nd\u00ebrhyrjet ruajt\u00ebse dhe mbrojt\u00ebse n\u00eb k\u00ebt\u00eb pasuri, sipas marr\u00ebveshjes;<\/em><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>iii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 s\u00eb treti, marr\u00ebveshja p\u00ebrcakton, gjithashtu, detyrimin e Fondacionit p\u00ebr t\u00eb raportuar n\u00eb m\u00ebnyr\u00eb periodike p\u00ebr gjendjen e konservimit t\u00eb pasuris\u00eb kulturore, nd\u00ebrkoh\u00eb q\u00eb ministria ngre bordin e monitorimit, i cili mund t\u00eb ushtroj\u00eb kontroll n\u00eb vend p\u00ebr vler\u00ebsimin e gjendjes s\u00eb konservimit t\u00eb pasuris\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb p\u00ebrfundim, p\u00ebr sa m\u00eb sip\u00ebr, Gjykata, me shumic\u00eb votash, vendosi rr\u00ebzimin e k\u00ebrkes\u00ebs.<\/em><\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Gjykata Kushtetuese rr\u00ebzoi sot k\u00ebrkes\u00ebn e Partis\u00eb Demokratike p\u00ebr shfuqizimin e ligjit p\u00ebr administrimin e parkut komb\u00ebtar t\u00eb Butrintit.
