{"id":664377,"date":"2024-03-29T10:35:05","date_gmt":"2024-03-29T09:35:05","guid":{"rendered":"https:\/\/www.hashtag.al\/?p=664377"},"modified":"2024-03-29T10:35:05","modified_gmt":"2024-03-29T09:35:05","slug":"ligji-i-ri-do-te-forcoje-kompetencat-e-akep-per-te-nderhyre-ne-tarifat-me-pakice-te-komunikimit","status":"publish","type":"post","link":"https:\/\/www.hashtag.al\/index.php\/2024\/03\/29\/ligji-i-ri-do-te-forcoje-kompetencat-e-akep-per-te-nderhyre-ne-tarifat-me-pakice-te-komunikimit\/","title":{"rendered":"Ligji i ri do t\u00eb forcoj\u00eb kompetencat e AKEP p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00eb tarifat me pakic\u00eb t\u00eb komunikimit","gt_translate_keys":[{"key":"rendered","format":"text"}]},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-664378\" src=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/03\/akep.jpg\" alt=\"\" width=\"1248\" height=\"702\" srcset=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/03\/akep.jpg 1248w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/03\/akep-300x169.jpg 300w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/03\/akep-1024x576.jpg 1024w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2024\/03\/akep-768x432.jpg 768w\" sizes=\"auto, (max-width: 1248px) 100vw, 1248px\" \/><\/p>\n<p><span style=\"color: #000000;\">Qeveria ka paraqitur p\u00ebr miratim n\u00eb Kuvend projektligjin e ri \u201cP\u00ebr komunikimet elektronike n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb nga risit\u00eb kryesore t\u00eb projektligjit \u00ebsht\u00eb p\u00ebrcaktimi i dispozitave t\u00eb posa\u00e7me p\u00ebr kontrollin rregullator t\u00eb sh\u00ebrbimeve me pakic\u00eb t\u00eb komunikimeve elektronike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas nenit 109 t\u00eb projektligjit, Autoriteti i Komunikimeve Elektronike dhe Postare (AKEP) mund t\u00eb vendos\u00eb detyrime rregullatore p\u00ebr sip\u00ebrmarr\u00ebsit e shpallur me fuqi t\u00eb ndjeshme n\u00eb treg, n\u00eb nj\u00eb treg me pakic\u00eb, n\u00ebse nga rezultatet e analiz\u00ebs s\u00eb tregut AKEP krijon bindjen se tregu p\u00ebrkat\u00ebs nuk \u00ebsht\u00eb n\u00eb konkurrenc\u00eb efektive dhe arrin n\u00eb p\u00ebrfundimin se detyrimet e vendosura p\u00ebr tregun e lidhur me shumic\u00eb nuk jan\u00eb t\u00eb mjaftueshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas projektligjit, detyrimet e vendosura duhet t\u00eb bazohen n\u00eb natyr\u00ebn e problemit t\u00eb identifikuar dhe t\u00eb jen\u00eb proporcionale dhe t\u00eb justifikuara.<\/span><\/p>\n<p><span style=\"color: #000000;\">Detyrimet e vendosura p\u00ebrfshijn\u00eb k\u00ebrkesa q\u00eb sip\u00ebrmarr\u00ebsit e identifikuar \u201ct\u00eb mos ofrojn\u00eb \u00e7mime t\u00eb larta, t\u00eb cilat pengojn\u00eb hyrjen n\u00eb treg ose kufizojn\u00eb konkurrenc\u00ebn, ose duke vendosur \u00e7mime grabitqare t\u00eb mos tregojn\u00eb preferenca t\u00eb panevojshme ndaj p\u00ebrdoruesve fundor\u00eb specifik\u00eb ose sh\u00ebrbime paket\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb paarsyeshme\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">AKEP mund t\u00eb zbatoj\u00eb ndaj k\u00ebtyre sip\u00ebrmarr\u00ebsve masat e duhura t\u00eb kufirit t\u00eb \u00e7mimit t\u00eb shitjes me pakic\u00eb, masat p\u00ebr t\u00eb kontrolluar tarifat individuale ose masat p\u00ebr orientimin e tarifave drejt kostove ose \u00e7mimeve n\u00eb tregje t\u00eb krahasueshme p\u00ebr t\u00eb mbrojtur interesat e p\u00ebrdoruesve fundor\u00eb dhe p\u00ebr t\u00eb nxitur konkurrenc\u00ebn efektive.<\/span><\/p>\n<p><span style=\"color: #000000;\">AKEP siguron q\u00eb, kur nj\u00eb sip\u00ebrmarr\u00ebs i n\u00ebnshtrohet rregullimit t\u00eb tarifave me pakic\u00eb ose rregullimeve t\u00eb tjera p\u00ebrkat\u00ebse t\u00eb shitjes me pakic\u00eb, t\u00eb zbatohen sistemet e nevojshme dhe t\u00eb p\u00ebrshtatshme t\u00eb kontabilitetit t\u00eb kostos.<\/span><\/p>\n<p><span style=\"color: #000000;\">AKEP do t\u00eb specifikoj\u00eb formatin dhe metodologjin\u00eb e kontabilitetit q\u00eb p\u00ebrdoret. Pajtueshm\u00ebria me sistemin e kontabilitetit t\u00eb kostos do t\u00eb verifikohet nga nj\u00eb organ i pavarur i kualifikuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimi p\u00ebr rregullimin e tarifave duhet t\u00eb p\u00ebrfshij\u00eb dispozita q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me nj\u00eb afat t\u00eb arsyesh\u00ebm kohor, detyrimin p\u00ebr dh\u00ebnien e informacionit, kushtet p\u00ebr koh\u00ebn e aplikimit n\u00eb treg t\u00eb tarifave t\u00eb miratuara, kushtet shoq\u00ebruese, n\u00eb rast se nj\u00eb tarif\u00eb zbatohet ndryshe nga ajo e<\/span><\/p>\n<p><span style=\"color: #000000;\">miratuar ose ajo ndryshohet pas miratimit, detyrimet p\u00ebr rregullimin e tarifave t\u00eb miratuara, n\u00eb rast se ndryshojn\u00eb tarifat e aksesit dhe t\u00eb interkoneksionit, kushtet p\u00ebr njoftimin e ndryshimeve n\u00eb tarifat sipas \u00e7mimeve t\u00eb rregulluara.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb dokumentin fundit t\u00eb analiz\u00ebs s\u00eb tregut celular, AKEP shprehej se struktura e re duopol shtron rreziqe n\u00eb rritje p\u00ebr konkurrenc\u00ebn n\u00eb tregun e komunikimeve celulare.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas AKEP, nj\u00eb treg me num\u00ebr t\u00eb kufizuar lojtar\u00ebsh mund t\u00eb mbetet konkurrues, vet\u00ebm n\u00ebse roli rregullator i fush\u00ebs AKEP p\u00ebrforcohet n\u00eb aspektin e ndryshimeve ligjore p\u00ebr nd\u00ebrhyrjet ex-ante (parandaluese), pasi nj\u00eb situate e till\u00eb, ve\u00e7an\u00ebrisht situata duopol n\u00eb tregun celular, krijon rreziqe t\u00eb reja p\u00ebr prezenc\u00ebn e sjelljeve bashk\u00ebrenduese nd\u00ebrmjet nd\u00ebrmarrjeve n\u00eb treg n\u00eb d\u00ebm t\u00eb konurrenc\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas AKEP, sjelljet bashk\u00ebrenduese mund t\u00eb shfaqen kryesisht n\u00ebp\u00ebrmjet strategjive t\u00eb \u00e7mimit dhe rritjes s\u00eb dyshemes\u00eb s\u00eb \u00e7mimit p\u00ebr t\u00eb nj\u00ebjtin sh\u00ebrbim, p\u00ebrfshir\u00eb k\u00ebtu edhe tarifimin e sh\u00ebrbimeve t\u00eb tjera shtes\u00eb q\u00eb ndikojn\u00eb drejtp\u00ebrdrejt\u00eb sh\u00ebrbimin par\u00ebsor t\u00eb kontraktuar nga pajtimtari, sh\u00ebrbime t\u00eb cilat jan\u00eb jasht\u00eb sfer\u00ebs s\u00eb rregullimit dhe fokusit t\u00eb nd\u00ebrhyrjeve ex-ante (parandaluese) t\u00eb rregullatorit t\u00eb fush\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb fakt, edhe ligji aktualisht n\u00eb fuqi nuk e ndalon AKEP p\u00ebr nd\u00ebrhyrjen n\u00eb tarifat me pakic\u00eb t\u00eb sh\u00ebrbimeve t\u00eb komunikimit. Megjithat\u00eb, dispozitat e reja q\u00eb AKEP ka propozuar t\u00eb shtoj\u00eb n\u00eb ligjin e ri nuk duket se lidhen edhe aq me shqet\u00ebsimin p\u00ebr tarifa t\u00eb larta me pakic\u00eb, por kryesisht me aplikimin e \u00e7mimeve n\u00ebn kosto apo grabitqare nga operator\u00eb t\u00eb ve\u00e7ant\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji aktual nuk parashikon kompetenca eksplicite p\u00ebr rregullatorin n\u00eb nj\u00eb rast t\u00eb till\u00eb.
