Nd\u00ebrkoh\u00eb opozita i k\u00ebrkoi kreut t\u00eb shtetit t\u00eb mos e firmoste por ta kthente mbrapsht.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb nj\u00eb reagim ndaj opozit\u00ebs presidenca argumenton pretendimet e opozit\u00ebs dhe pse vendosi miratimin e ndryshimeve.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>&#8220;Pretendimi se ky ligj duhet t\u00eb ishte miratuar me konsensus nuk ka lidhje me ndonj\u00eb k\u00ebrkes\u00eb t\u00eb Kushtetut\u00ebs, ndaj Presidenti i Republik\u00ebs nuk mund ta kthej\u00eb at\u00eb p\u00ebr shqyrtim me shkakun se i mungon konsensusi&#8221;<\/em> argumenton presdienti<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">NJOFTIMI<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Presidenti i Republik\u00ebs nxori sot dekretin \u201cP\u00ebr shpalljen e ligjit nr.106\/2023, \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 8891, dat\u00eb 2.5.2002, \u201cP\u00ebr organizimin dhe funksionimin e komisioneve hetimore t\u00eb Kuvendit\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Trajtimit t\u00eb k\u00ebsaj praktike institucionale dit\u00ebt e fundit i \u00ebsht\u00eb dh\u00ebn\u00eb p\u00ebrmbajtje politike nga nj\u00eb num\u00ebr i kufizuar deputet\u00ebsh. P\u00ebr k\u00ebt\u00eb arsye, Institucioni i Presidentit t\u00eb Republik\u00ebs e gjen me vend t\u00eb informoj\u00eb opinionin publik, si vijon:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Shpallja e ligjeve nga Presidenti i Republik\u00ebs b\u00ebhet n\u00eb p\u00ebrfundim t\u00eb procedur\u00ebs s\u00eb kontrollit kushtetues, gjat\u00eb t\u00eb cilit institucioni verifikon kushtetutshm\u00ebrin\u00eb e dispozitave t\u00eb reja dhe t\u00eb procedur\u00ebs s\u00eb miratimit t\u00eb tyre. Kontrolli kushtetues nuk verifikon asnj\u00eb aspekt me p\u00ebrmbajtje politike t\u00eb ligjit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Argumenti m\u00eb me pesh\u00eb q\u00eb ngrihet nga nj\u00eb pjes\u00eb e eksponent\u00ebve t\u00eb opozit\u00ebs ka lidhje me pretendimin se hyrja n\u00eb fuqi e k\u00ebtij ligji mund t\u00eb minoj\u00eb dialogun mes pal\u00ebve politike n\u00eb Kuvend: \u2013 \u201cKy ligj i nj\u00ebansh\u00ebm duhet t\u00eb kthehet n\u00eb parlament dhe t\u00eb miratohet me konsensus\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Presidenti i Republik\u00ebs e \u00e7mon si tejet t\u00eb r\u00ebnd\u00ebsishme uljen n\u00eb negociat\u00eb p\u00ebr t\u00eb gjetur zgjidhje kompromisi p\u00ebr k\u00ebt\u00eb l\u00ebnd\u00eb, si p\u00ebr \u00e7do l\u00ebnd\u00eb tjet\u00ebr objekt debati, kontestimi apo konflikti politik. Zgjidhja e shpejt\u00eb e kund\u00ebrshtive p\u00ebr k\u00ebt\u00eb ligj do t\u00eb formonte nj\u00eb mund\u00ebsi serioze p\u00ebr t\u00eb nd\u00ebrtuar marr\u00ebdh\u00ebnie mir\u00ebbesimi mbi nj\u00eb shembull konkret bashk\u00ebpunimi. Kjo \u00ebsht\u00eb arsyeja pse Presidenti i Republik\u00ebs ftoi menj\u00ebher\u00eb eksponent\u00ebt m\u00eb t\u00eb z\u00ebsh\u00ebm t\u00eb opozit\u00ebs q\u00eb t\u00eb k\u00ebrkonin kompromisin me shumic\u00ebn parlamentare dhe t\u00eb shfryt\u00ebzonin nd\u00ebrkoh\u00ebn, deri n\u00eb p\u00ebrfundimin e afatit p\u00ebr shpalljen e ligjit, p\u00ebr t\u00eb zgjidhur n\u00eb dialog me shumic\u00ebn t\u00eb gjitha \u00e7\u00ebshtjet q\u00eb i shqet\u00ebsonin lidhur me ligjin e sapo miratuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb t\u00eb v\u00ebrtet\u00eb, periudha nga miratimi i ligjit, deri n\u00eb p\u00ebrfundimin e afatit 20-ditor p\u00ebr shpalljen e tij, u ezaurua pa asnj\u00eb demarsh p\u00ebr t\u00eb ofruar dhe gjetur zgjidhje kompromisi, gj\u00eb q\u00eb mban n\u00eb k\u00ebmb\u00eb si objektiv q\u00ebllimin p\u00ebr bllokimin e hyrjes n\u00eb fuqi t\u00eb ligjit, por rr\u00ebzon si t\u00eb paqen\u00eb objektivin p\u00ebr \u201cdiskutimin dhe miratimin konsensual t\u00eb ndryshimeve n\u00eb ligjin p\u00ebr komisionet hetimore\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr sa u takon pretendimeve p\u00ebr antikushtetutshm\u00ebri t\u00eb dispozitave t\u00eb reja ligjore, t\u00eb b\u00ebra publike nga disa eksponent\u00eb t\u00eb opozit\u00ebs, sqarojm\u00eb, si vijon:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>1.\u00cbsht\u00eb pretenduar se miratimi i projektligjit \u00ebsht\u00eb shoq\u00ebruar me parregullsi procedurale. Ky pretendim nuk i q\u00ebndron kontrollit kushtetues. Shkeljet procedurale nuk p\u00ebrb\u00ebjn\u00eb shkak t\u00eb vet\u00ebmjaftuesh\u00ebm p\u00ebr kthimin e ligjit p\u00ebr shqyrtim. Procedura e shqyrtimit dhe e miratimit t\u00eb projektligjeve \u00ebsht\u00eb \u00e7\u00ebshtje e Rregullores s\u00eb brendshme t\u00eb Kuvendit, kontrolli i zbatimit t\u00eb s\u00eb cil\u00ebs kryhet nga organet e brendshme t\u00eb Kuvendit, t\u00eb ngarkuara nga vet\u00eb Rregullorja p\u00ebr k\u00ebt\u00eb q\u00ebllim.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00cbsht\u00eb fakt publik se n\u00eb instancat e brendshme t\u00eb Kuvendit nuk \u00ebsht\u00eb depozituar asnj\u00eb k\u00ebrkes\u00eb me pretendime p\u00ebr shkelje procedurale t\u00eb lidhura me k\u00ebt\u00eb ligj. Shkeljet procedurale mund t\u00eb formojn\u00eb l\u00ebnd\u00eb p\u00ebr kontrollin kushtetues vet\u00ebm n\u00ebse shkeljet procedurale ngrihen n\u00eb nivelin e shkeljeve kushtetuese. I till\u00eb \u00ebsht\u00eb, p\u00ebr shembull, rasti kur nj\u00eb ligj, p\u00ebr t\u00eb cilin Kushtetuta k\u00ebrkon miratimin me shumic\u00eb t\u00eb cil\u00ebsuar, miratohet me nj\u00eb num\u00ebr m\u00eb t\u00eb vog\u00ebl votash. Asnj\u00ebra nga shkeljet procedurale t\u00eb pretenduara nuk ngrihet n\u00eb nivelin e nj\u00eb shkeljeje procedurale kushtetuese. P\u00ebr pasoj\u00eb, nuk e b\u00ebn k\u00ebt\u00eb ligj antikushtetues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Po k\u00ebshtu, pretendimi se ky ligj duhet t\u00eb ishte miratuar me konsensus nuk ka lidhje me ndonj\u00eb k\u00ebrkes\u00eb t\u00eb Kushtetut\u00ebs, ndaj Presidenti i Republik\u00ebs nuk mund ta kthej\u00eb at\u00eb p\u00ebr shqyrtim me shkakun se i mungon konsensusi.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>2.\u00cbsht\u00eb pretenduar se amendamentet e miratuara nuk kan\u00eb t\u00eb p\u00ebrfshir\u00eb q\u00ebndrimin e konsoliduar t\u00eb Gjykat\u00ebs Kushtetuese, sipas s\u00eb cilit shumica parlamentare \u00ebsht\u00eb e detyruar t\u00eb pranoj\u00eb ngritjen e komisionit hetimor dhe se ajo mund t\u00eb v\u00ebr\u00eb n\u00eb diskutim vet\u00ebm objektin e hetimit dhe vet\u00ebm n\u00ebse ka pretendime p\u00ebr cenim t\u00eb parimeve kushtetuese. P\u00ebrball\u00eb k\u00ebtij pretendimi q\u00ebndrojn\u00eb dy fakte thelb\u00ebsore, t\u00eb cilat mbrojn\u00eb kushtetutshm\u00ebrin\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb pari, detyrimi p\u00ebr ngritjen e komisionit hetimor, kur k\u00ebt\u00eb e k\u00ebrkojn\u00eb jo m\u00eb pak se 35 deputet\u00eb, \u00ebsht\u00eb detyrim q\u00eb buron nga neni 77 i Kushtetut\u00ebs dhe nuk ka dispozita t\u00eb k\u00ebtij ligji q\u00eb t\u2019i kund\u00ebrvihen.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb dyti, jurisprudenca e Gjykat\u00ebs Kushtetuese, q\u00eb ka p\u00ebrcaktuar edhe kufijt\u00eb e diskrecionit t\u00eb shumic\u00ebs parlamentare, n\u00eb k\u00ebt\u00eb rast, gjithashtu, nuk kund\u00ebrshtohet nga asnj\u00eb dispozit\u00eb e k\u00ebtij ligji. Opinioni se kjo \u00e7\u00ebshtje duhet t\u00eb ishte p\u00ebrfshir\u00eb n\u00eb tekstin e ligjit me formulime konkrete, sipas k\u00ebsaj linje, mund t\u00eb konsiderohet racional, por mungesa nuk e b\u00ebn ligjin antikushtetues, sikurse nuk i zhb\u00ebn detyrimet q\u00eb burojn\u00eb nga Kushtetuta dhe nga jurisprudenca e Gjykat\u00ebs Kushtetuese.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>3.\u00cbsht\u00eb pretenduar se p\u00ebrcaktimet e ligjit t\u00eb ri p\u00ebr rregullat p\u00ebr zhvillimin me dyer t\u00eb mbyllura t\u00eb mbledhjeve t\u00eb komisionit hetimor synojn\u00eb eliminimin e transparenc\u00ebs, e cila \u00ebsht\u00eb thelbi i pun\u00ebs s\u00eb tij. Formulimet q\u00eb p\u00ebrcaktojn\u00eb me num\u00ebrtim rastet kur mund t\u00eb zhvillohen mbledhjet me dyer t\u00eb mbyllura, i sh\u00ebrbejn\u00eb transparenc\u00ebs, sepse n\u00ebp\u00ebrmjet kufizimit t\u00eb rasteve disiplinojn\u00eb vendimmarrjen e komisionit dhe reduktojn\u00eb mund\u00ebsin\u00eb e abuzimit me k\u00ebt\u00eb mekaniz\u00ebm. Rastet e p\u00ebrmendura n\u00eb ligj jan\u00eb p\u00ebrjashtimore dhe secili prej tyre i sh\u00ebrben mbrojtjes s\u00eb nj\u00eb interesi tjet\u00ebr kushtetues ose ligjor. K\u00ebto dispozita nuk eliminojn\u00eb transparenc\u00ebn. Shkelja e tyre mund ta b\u00ebj\u00eb k\u00ebt\u00eb. Ligji nuk mund t\u00eb quhet antikushtetues. Veprimtaria n\u00eb kund\u00ebrshtim me t\u00eb, po.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>4.\u00cbsht\u00eb pretenduar se rregulli i ri p\u00ebr marrjen e provave dhe thirrjen me vendim t\u00eb nd\u00ebrmjet\u00ebm t\u00eb d\u00ebshmitar\u00ebve \u00ebsht\u00eb antikushtetues. Edhe ky pretendim nuk i q\u00ebndron kontrollit kushtetues. \u00cbsht\u00eb e v\u00ebrtet\u00eb se dispozita p\u00ebr marrjen e provave dhe thirrjen e d\u00ebshmitar\u00ebve me vendim t\u00eb nd\u00ebrmjet\u00ebm formon regres n\u00eb raport me ligjin e m\u00ebparsh\u00ebm, i cili, kryerjen e k\u00ebtyre procedurave nuk ia n\u00ebnshtronte votimit, por \u00e7\u00ebshtja n\u00eb vetvete nuk ka l\u00ebnd\u00eb kushtetuese. Nuk mund t\u00eb pretendohet, p\u00ebr shembull, q\u00eb n\u00eb k\u00ebt\u00eb rast kemi t\u00eb b\u00ebjm\u00eb me cenimin e nj\u00eb t\u00eb drejte t\u00eb fituar, sepse parimi kushtetues i mbrojtjes s\u00eb t\u00eb drejtave t\u00eb fituara vepron n\u00eb nj\u00eb fush\u00eb tjet\u00ebr dhe p\u00ebr subjekte krejt t\u00eb tjera. N\u00eb k\u00ebt\u00eb rast, jemi p\u00ebrpara dy zgjidhjeve ligjore, konkurruese me nj\u00ebra-tjetr\u00ebn, por t\u00eb dyja jan\u00eb kushtetuese.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nga ana tjet\u00ebr, rregullat p\u00ebr marrjen e d\u00ebshmis\u00eb dhe p\u00ebrmbajtjen e saj nuk mund t\u00eb konsiderohen kufizuese. Ato sqarojn\u00eb pozit\u00ebn procedurale t\u00eb d\u00ebshmitarit dhe jan\u00eb n\u00eb harmoni me legjislacionin shqiptar, (p\u00ebrfshir\u00eb modelet e huaja t\u00eb referenc\u00ebs).<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>5.P\u00ebr sa i p\u00ebrket k\u00ebrkes\u00ebs p\u00ebr p\u00ebrfshirjen e Presidentit t\u00eb Republik\u00ebs n\u00eb procesin e dialogut politik, kjo p\u00ebrb\u00ebn konsiderat\u00eb t\u00eb nj\u00eb natyre t\u00eb ndryshme nga konsideratat q\u00eb i takojn\u00eb procedur\u00ebs s\u00eb kontrollit kushtetues t\u00eb ligjeve. Kthimi i ligjeve p\u00ebr shqyrtim nuk \u00ebsht\u00eb instrumenti kushtetues q\u00eb i \u00ebsht\u00eb dh\u00ebn\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr t\u00eb leht\u00ebsuar dialogun. Ligjet nuk shpallen p\u00ebr hir t\u00eb \u201cdialogut politik mes pal\u00ebve\u201d, por si pjes\u00eb e procesit legjislativ, p\u00ebr shkakun se kalojn\u00eb me sukses filtrin kushtetues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Me k\u00ebt\u00eb rast, sjellim dhe nj\u00eb her\u00eb n\u00eb v\u00ebmendje mesazhin e Presidentit t\u00eb Republik\u00ebs drejtuar deputet\u00ebve me rastin e \u00e7eljes s\u00eb sesionit t\u00eb ri parlamentar dhe thirrjen e tij p\u00ebr dialog konstruktiv dhe bashk\u00ebpunim vullnetmir\u00eb midis forcave politike, si rruga e vetme q\u00eb i sh\u00ebrben t\u00eb mir\u00ebs s\u00eb p\u00ebrbashk\u00ebt, interesit komb\u00ebtar dhe konsolidimit t\u00eb pozitave t\u00eb Shqip\u00ebris\u00eb n\u00eb aren\u00ebn nd\u00ebrkomb\u00ebtare.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo thirrje \u00ebsht\u00eb e vlefshme edhe n\u00eb l\u00ebmin e ngritjes dhe funksionimit me sukses t\u00eb komisioneve hetimore parlamentare.<\/em><\/span><\/p>\n<p><img decoding=\"async\" src=\"https:\/\/shqiptarja.com\/uploads\/ckeditor\/65a911215ec1b53dffdc8-f558-416a-9d48-4ab69b02f3da.jpg\" \/><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Presidenti Bajram Begaj dekreton ligjin e ndryshuar p\u00ebr Komisionet Hetimore Parlamentare.
