Shfuqizimin e ligjit nr. 51\/2022, dat\u00eb 09.06.2022 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 9, dat\u00eb 11.05.2022 \u201cP\u00ebr nj\u00eb shtes\u00eb n\u00eb aktin normativ nr. 7, dat\u00eb 18.03.2022 t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr transparenc\u00ebn dhe monitorimin e \u00e7mimit p\u00ebr disa produkte ushqimore baz\u00eb dhe produkte t\u00eb tjera t\u00eb lidhura me to si pasoj\u00eb e situat\u00ebs s\u00eb ve\u00e7ant\u00eb t\u00eb krijuar n\u00eb treg\u201d\u201d\u201d, si i papajtuesh\u00ebm me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\">Lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje, Gjykata vler\u00ebsoi se aktet normative me fuqin\u00eb e ligjit nr. 7, dat\u00eb 18.03.2022 t\u00eb K\u00ebshillit t\u00eb Ministrave \u201cP\u00ebr transparenc\u00ebn dhe monitorimin e \u00e7mimit p\u00ebr disa produkte ushqimore baz\u00eb dhe produkte t\u00eb tjera t\u00eb lidhura me to si pasoj\u00eb e situat\u00ebs s\u00eb ve\u00e7ant\u00eb t\u00eb krijuar n\u00eb treg\u201d dhe nr. 9, dat\u00eb 11.05.2022 \u201cP\u00ebr nj\u00eb shtes\u00eb n\u00eb aktin normativ nr. 7, dat\u00eb 18.03.2022 t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr transparenc\u00ebn dhe monitorimin e \u00e7mimit p\u00ebr disa produkte ushqimore baz\u00eb dhe produkte t\u00eb tjera t\u00eb lidhura me to si pasoj\u00eb e situat\u00ebs s\u00eb ve\u00e7ant\u00eb t\u00eb krijuar n\u00eb treg\u201d\u201d nuk plot\u00ebsojn\u00eb kriteret kushtetuese t\u00eb parashikuara n\u00eb nenin 101 t\u00eb Kushtetut\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb arsye, Gjykata Kushtetuese e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, bazuar n\u00eb nenet 131, pika 1, shkronja \u201cc\u201d dhe 134, pika 1, shkronja \u201cc\u201d, t\u00eb Kushtetut\u00ebs, si dhe nenin 49, pika 1, t\u00eb ligjit nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar, me shumic\u00eb votash,<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">VENDOSI:<\/span><\/p>\n<p><span style=\"color: #000000;\">1.Pranimin e k\u00ebrkes\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.Shfuqizimin e ligjit nr. 41\/2022, dat\u00eb 21.04.2022 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 7, dat\u00eb 18.03.2022 t\u00eb K\u00ebshillit t\u00eb Ministrave \u201cP\u00ebr transparenc\u00ebn dhe monitorimin e \u00e7mimit p\u00ebr disa produkte ushqimore baz\u00eb dhe produkte t\u00eb tjera t\u00eb lidhura me to si pasoj\u00eb e situat\u00ebs s\u00eb ve\u00e7ant\u00eb t\u00eb krijuar n\u00eb treg\u201d\u201d, si i papajtuesh\u00ebm me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">3.Shfuqizimin e ligjit nr. 51\/2022, dat\u00eb 09.06.2022 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 9, dat\u00eb 11.05.2022 \u201cP\u00ebr nj\u00eb shtes\u00eb n\u00eb aktin normativ nr. 7, dat\u00eb 18.03.2022 t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr transparenc\u00ebn dhe monitorimin e \u00e7mimit p\u00ebr disa produkte ushqimore baz\u00eb dhe produkte t\u00eb tjera t\u00eb lidhura me to si pasoj\u00eb e situat\u00ebs s\u00eb ve\u00e7ant\u00eb t\u00eb krijuar n\u00eb treg\u201d\u201d\u201d, si i papajtuesh\u00ebm me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky vendim \u00ebsht\u00eb p\u00ebrfundimtar dhe hyn n\u00eb fuqi dit\u00ebn e botimit n\u00eb Fletoren Zyrtare.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimi p\u00ebrfundimtar do t\u00eb shPallet i arsyetuar brenda afateve ligjore t\u00eb parashikuara nga ligji nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, i ndryshuar dhe nga Rregullorja p\u00ebr Procedurat Gjyq\u00ebsore t\u00eb Gjykat\u00ebs Kushtetuese.\u2019- njofton Gjykata.<\/span><\/p>\n<p><span style=\"color: #000000;\">Bordi i ushqimeve hyri n\u00eb fuqi m\u00eb 1 prill dhe detyra ishte monitorimi i \u00e7mimeve t\u00eb produkteve t\u00eb shport\u00ebs dhe p\u00ebrcaktimin e marzheve t\u00eb fitimit t\u00eb bizneseve t\u00eb k\u00ebtij sektori. \u00c7mimet monitorohen \u00e7do jav\u00eb.\u00a0 T\u00eb gjitha subjektet q\u00eb importojn\u00eb dhe prodhojn\u00eb produkte ushqimore sipas vendimit jan\u00eb t\u00eb detyruar t\u00eb marrin masa p\u00ebr t\u00eb ofruar furnizim t\u00eb pand\u00ebrprer\u00eb.
