Si\u00e7 dihet, ky ligj, p\u00ebrmes modelit \u201crisor\u201d t\u00eb \u201cadministrimit indirekt\u201d t\u00eb pahasur ndokund tjet\u00ebr n\u00eb bot\u00eb, ia kalon Vendin e Trash\u00ebgimis\u00eb Bot\u00ebrore t\u00eb Butrintit n\u00eb kontroll dhe administrim thuajse t\u00ebr\u00ebsor t\u00eb ashtuquajturit Fondacion p\u00ebr Menaxhimin e Butrintit.[1] Shkurt, \u00e7el\u00ebsat e Butrintit i kalojn\u00eb t\u00eb ashtuquajturit Fondacion, nd\u00ebrsa shtetit shqiptar i mbeten n\u00eb dor\u00eb vet\u00ebm \u00e7el\u00ebsat e kasht\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Tem\u00ebn e kemi trajtuar edhe m\u00eb her\u00ebt n\u00eb faqet e k\u00ebsaj reviste, ku m\u00eb 1 qershor 2020 kemi ngritur mosp\u00ebrputhjet e hapura me Kushtetut\u00ebn dhe Konvent\u00ebn e Parisit t\u00eb vitit 1972, dhe m\u00eb 16 maj 2022 kemi komentuar juridikisht nism\u00ebn e guximshme ligjv\u00ebn\u00ebse t\u00eb deputetes Ina Zhupa p\u00ebr mbylljen e shtegut juridik dhe abrogimin\u00a0 \/ ndryshimin e Neneve 171-173 t\u00eb Ligjit 27\/2018 P\u00ebr Trash\u00ebgimin\u00eb Kulturore dhe Muzet\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si\u00e7 dihet, K\u00ebrkesa p\u00ebr shqyrtim kushtetues e 36 deputet\u00ebve u regjistrua m\u00eb 15.11.2022. M\u00eb dat\u00eb 22.12.2022 u mbajt Mbledhja e Gjyqtar\u00ebve, q\u00eb vendosi kalimin e \u00e7\u00ebshtjes n\u00eb seanc\u00eb plenare publike.\u00a0 Gjykata Kushtetuese do t\u00eb shqyrtoj\u00eb, pra, kushtetueshm\u00ebrin\u00eb e akteve t\u00eb ekzekutivit dhe t\u00eb legjislativit q\u00eb bien ndesh me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare publike t\u00eb ratifikuar dhe t\u00eb zbatuar n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb, si dhe me disa dispozita kushtetuese. Sipas njoftimit p\u00ebrkat\u00ebs, Gjykata i ka k\u00ebrkuar pal\u00ebs k\u00ebrkuese q\u00eb, brenda dat\u00ebs 23 janar 2023, t\u00eb paraqes\u00eb \u201cparashtrime me shkrim, n\u00ebse kan\u00eb argumente shtes\u00eb p\u00ebr k\u00ebrkes\u00ebn e paraqitur\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Domosdoshm\u00ebria e pezullimit t\u00eb aktit objekt shqyrtimi<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Mir\u00ebpo n\u00eb K\u00ebrkes\u00ebn e 36 deputet\u00ebve \u00ebsht\u00eb k\u00ebrkuar edhe pezullimi i zbatimit t\u00eb Ligjit 50\/2022. Si do t\u00eb vepronte Gjykata n\u00eb k\u00ebt\u00eb rast?<\/span><\/p>\n<p><span style=\"color: #000000;\">Me rregullore, Gjykata Kushtetuese e shqyrton k\u00ebrkes\u00ebn p\u00ebr pezullim brenda 10 dit\u00ebve nga data e vendimit t\u00eb Kolegjit q\u00eb ka kaluar \u00e7\u00ebshtjen p\u00ebr shqyrtim n\u00eb seanc\u00eb plenare. Me fjal\u00eb t\u00eb tjera, Gjykata Kushtetuese duhet t\u00eb shprehet deri m\u00eb 6 janar 2023 p\u00ebr K\u00ebrkes\u00ebn e grupit t\u00eb deputet\u00ebve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas ligjit dhe rregullores p\u00ebrkat\u00ebse t\u00eb Gjykat\u00ebs Kushtetuese[2], n\u00eb rast se pranohet k\u00ebrkesa p\u00ebr pezullim, data e seanc\u00ebs plenare caktohet n\u00eb dat\u00ebn m\u00eb t\u00eb af\u00ebrt t\u00eb mundshme, duke respektuar afatet procedurale t\u00eb zbatueshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata ka diskrecion t\u00eb gjer\u00eb p\u00ebr nisjen dhe shqyrtimin e K\u00ebrkes\u00ebs p\u00ebr pezullim, kryesisht (sua sponte) e n\u00eb \u00e7do faze t\u00eb gjykimit.[3] Edhe pala k\u00ebrkuese mund ta paraqes\u00eb k\u00ebrkes\u00eb pezullimi n\u00eb koh\u00eb t\u00eb m\u00ebvon\u00eb. K\u00ebrkesa p\u00ebr pezullim mund t\u00eb riparaqitet n\u00eb seanc\u00eb plenare n\u00eb rast se Mbledhja e Gjyqtar\u00ebve ka vendosur rr\u00ebzimin e saj p\u00ebrpara fillimit t\u00eb shqyrtimit gjyq\u00ebsor. Vendimi p\u00ebr marrjen e mas\u00ebs s\u00eb pezullimit n\u00eb \u00e7do rast arsyetohet dhe u njoftohet brenda dit\u00ebs pal\u00ebve n\u00eb proces, organit q\u00eb ka nxjerr\u00eb ligjin ose aktin, publikohet n\u00eb faqen zyrtare t\u00eb Gjykat\u00ebs Kushtetuese, si dhe d\u00ebrgohet p\u00ebr botim n\u00eb Fletoren Zyrtare.<\/span><\/p>\n<p><span style=\"color: #000000;\">Marr\u00ebveshja midis Ministris\u00eb s\u00eb Kultur\u00ebs dhe t\u00eb ashtuquajturit Fondacion parashikon nj\u00eb periudh\u00eb transitore si dhe dor\u00ebzimin dhe transferimin tek i ashtuquajturi Fondacion t\u00eb pasuris\u00eb kulturore t\u00eb paluajtshme, q\u00eb sot \u00ebsht\u00eb n\u00ebn pron\u00ebsin\u00eb dhe administrimin ekskluziv t\u00eb shtetit shqiptar. Veprimet e parashikuara n\u00eb Marr\u00ebveshjen, e cila sot ka marr\u00eb forc\u00ebn e ligjit, e b\u00ebjn\u00eb t\u00eb\u00a0 domosdoshme pezullimin e aktit objekt shqyrtimi, konkretisht t\u00eb Ligjit nr. 50\/2022 n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb shmangen t\u00eb gjitha pasojat q\u00eb mund t\u00eb prekin interesat shtet\u00ebrore e shoq\u00ebrore n\u00eb administrimin \/ menaxhimin e Parkut Komb\u00ebtar t\u00eb Butrintit, gjegj\u00ebsisht zon\u00ebs A\/3 nga ana e t\u00eb ashtuquajturit Fondacion.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Shtet brenda shtetit?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Dihet se Ligji 8577\/2000 P\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Shqip\u00ebris\u00eb p\u00ebrcakton si shkak pezullimi t\u00eb aktit objekt shqyrtimi n\u00ebse priten \u201cpasoja [t\u00eb mundshme] q\u00eb prekin interesa shtet\u00ebrore, shoq\u00ebrore ose t\u00eb individit\u201d. Lind pyetja, a jemi n\u00eb kushtet kur zbatimi i m\u00ebtejsh\u00ebm i ligjit 50\/2022 mund t\u00eb prek\u00eb interesat shtet\u00ebrore e shoq\u00ebrore?<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb Shtojc\u00ebn 1 t\u00eb Marr\u00ebveshjes [ff 45-58], t\u00eb inkorporuar n\u00eb Ligjin 50\/2022, jepet harta e sip\u00ebrfaqes s\u00eb zon\u00ebs A\/3 q\u00eb do t\u00eb transferohet p\u00ebr administrim tek i ashtuquajturi Fondacion si dhe koordinatat p\u00ebrkat\u00ebse t\u00eb saj. Zona, me nj\u00eb hap\u00ebsir\u00eb prej 1500 hektar\u00ebsh (sipas nj\u00eb zyrtari t\u00eb AADF-s\u00eb), p\u00ebrb\u00ebn nj\u00eb thel\u00eb jo t\u00eb vog\u00ebl gjeografike t\u00eb territorit sovran t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb rast se k\u00ebt\u00eb cop\u00eb territori e merr n\u00ebn administrim i ashtuquajturi Fondacion gj\u00ebrat n\u00eb Butrint nuk do t\u00eb jen\u00eb si\u00e7 kan\u00eb qen\u00eb deri m\u00eb sot. K\u00ebsisoj, i ashtuquajturi Fondacion do t\u00eb ket\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">t\u00eb drejt\u00ebn p\u00ebr posedimin, p\u00ebrdorimin, shfryt\u00ebzimin dhe g\u00ebzimin (por jo pron\u00ebsin\u00eb, e cila n\u00eb let\u00ebr i mbetet shtetit shqiptar), dhe t\u00eb drejt\u00ebn e Administrimit t\u00eb Pasuris\u00eb Kulturore, \u2026,pa asnj\u00eb barr\u00eb, detyrim apo kufizim,\u201d dhe me ndonj\u00eb p\u00ebrjashtim t\u00eb vog\u00ebl;<\/span><\/p>\n<p><span style=\"color: #000000;\">t\u00eb drejt\u00ebn p\u00ebr kalim mbi dhe n\u00ebn, si edhe hyrjen dhe daljen nga dhe n\u00eb \u00e7do vend t\u00eb Pasuris\u00eb Kulturore t\u00eb Paluajtshme, pa nd\u00ebrhyrje t\u00eb panevojshme nga ndonj\u00eb pal\u00eb e tret\u00eb p\u00ebr q\u00ebllimin e zbatimit t\u00eb Marr\u00ebveshjes (\u201cE Drejta e Kalimit\u201d).[4]<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas Marr\u00ebveshjes, shteti shqiptar ruan vet\u00ebm tagre sip\u00ebrfaq\u00ebsore monitorimi dhe kontrolli. K\u00ebshtu, brenda 10 dit\u00ebve nga data e marrjes n\u00ebn administrim t\u00eb Butrintit nga i ashtuquajturi Fondacion, Ministria ngre nj\u00eb \u201cnj\u00ebsi monitorimi\u201d, por \u00ebsht\u00eb e detyruar t\u2019i jap\u00eb t\u00eb ashtuquajturit Fondacion list\u00ebn e emrave p\u00ebrb\u00ebr\u00ebs.\u00a0 Nj\u00eb her\u00eb n\u00eb vit, n\u00eb qershor, i ashtuquajturi Fondacion p\u00ebr Menaxhimin e Butrintit ka detyrimin p\u00ebr t\u2019i paraqitur nj\u00eb raport vjetor nj\u00ebsis\u00eb s\u00eb monitorimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb nga dispozitat m\u00eb flagrante dhe m\u00eb p\u00ebrul\u00ebse n\u00eb Marr\u00ebveshje \u00ebsht\u00eb ajo sipas s\u00eb cil\u00ebs shteti shqiptar heq dor\u00eb nga e drejta p\u00ebr t\u00eb ushtruar kontrolle t\u00eb p\u00ebrgjithshme, t\u00eb pavarura dhe t\u00eb befasishme n\u00eb Butrint. Me t\u00eb v\u00ebrtet\u00eb, Ministria ka t\u00eb drejt\u00eb \u201ct\u00eb ushtroj\u00eb kontroll n\u00eb Butrint\u201d \u2013 n\u00eb baz\u00eb t\u00eb nj\u00eb udh\u00ebzimi t\u00eb ardhsh\u00ebm t\u00eb titullarit\/titullares \u2013 vet\u00ebm me k\u00ebto objekte dhe kushte:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cp\u00ebr vler\u00ebsimin e gjendjes s\u00eb konservimit t\u00eb raportuar nga Fondacioni\u201d;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cp\u00ebr t\u00eb verifikuar p\u00ebrmbushjen e detyrimeve t\u00eb Fondacionit n\u00eb kuadrin e k\u00ebsaj Marr\u00ebveshjeje\u201d;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cn\u00eb prani t\u00eb nj\u00eb p\u00ebrfaq\u00ebsuesi t\u00eb autorizuar t\u00eb Fondacionit\u201d;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cbazuar n\u00eb nj\u00eb njoftim me shkrim drejtuar Fondacionit t\u00eb pakt\u00ebn 15 (pes\u00ebmb\u00ebdhjet\u00eb) dit\u00eb p\u00ebrpara\u201d;[5]<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra, shteti shqiptar, Pal\u00eb sovrane n\u00eb Konvent\u00ebn e Parisit t\u00eb v. 1972, duhet t\u00eb njoftoj\u00eb paraprakisht t\u00eb ashtuquajturin Fondacion n\u00ebse do t\u00eb kryej\u00eb kontroll n\u00eb Butrint dhe kontrolli shtet\u00ebror s\u2019mund t\u00eb kryhet pa qen\u00eb i pranish\u00ebm nj\u00eb p\u00ebrfaq\u00ebsues i t\u00eb ashtuquajturit Fondacion privat.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 28 i Marr\u00ebveshjes parashikon edhe rastet kur shteti shqiptar detyrohet t\u00eb \u201cnd\u00ebrhyj\u00eb\u201d n\u00eb Butrint duke marr\u00eb n\u00eb dor\u00eb administrimin e tij. Kjo kryhet vet\u00ebm n\u00eb raste t\u00eb (i) braktisjes s\u00eb Butrintit; (ii) p\u00ebr \u201cruajtjen e siguris\u00eb komb\u00ebtare\u201d ose (iii) n\u00eb rastet e forc\u00ebs madhore. Mir\u00ebpo, si n\u00eb rastin e monitorimit dhe kontrollit, edhe nd\u00ebrhyrja duhet t\u00eb b\u00ebhet p\u00ebrmes nj\u00eb njoftimi me shkrim. Pra nj\u00eb shtet sovran detyrohet t\u2019i b\u00ebj\u00eb t\u00eb ditur me shkrim nj\u00eb t\u00eb ashtuquajturi Fondacion privat p\u00ebr (i) arsyen e nd\u00ebrhyrjes shtet\u00ebrore; (ii) p\u00ebrshkrimin e veprimit urgjent nd\u00ebrhyr\u00ebs: (iii) dat\u00ebn e nd\u00ebrhyrjes; (iv) periudh\u00ebn kohore gjat\u00eb s\u00eb cil\u00ebs zgjat nd\u00ebrhyrja; apo (v) detyrimet e t\u00eb ashtuquajturit Fondacion gjat\u00eb nd\u00ebrhyrjes shtet\u00ebrore.[6]<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga sa m\u00eb sip\u00ebr natyrsh\u00ebm lind pyetja: me t\u00eb marr\u00eb n\u00eb dor\u00eb Butrintin, a mund t\u00eb thuhet se i ashtuquajturi Fondacion kthehet n\u00eb nj\u00eb far\u00eb shteti brenda shtetit (status in statu)?<\/span><\/p>\n<p><span style=\"color: #000000;\">M\u00eb tej, n\u00eb Shtojc\u00ebn 2 t\u00eb Marr\u00ebveshjes [ff. 59-65] jepet lista e pasurive kulturore t\u00eb paluajtshme q\u00eb kalojn\u00eb n\u00ebn administrimin e t\u00eb ashtuquajturit Fondacion. K\u00ebtu b\u00ebhet fjal\u00eb p\u00ebr t\u00eb pakt\u00ebn 100 z\u00ebra\/objekte t\u00eb pasuris\u00eb s\u00eb paluajtshme kulturore t\u00eb shtetit shqiptar, me vlera t\u00eb jasht\u00ebzakonshme, t\u00eb paz\u00ebvend\u00ebsueshme dhe t\u00eb pallogaritshme p\u00ebr historin\u00eb e kombit ton\u00eb, pa p\u00ebrmendur vlerat e tyre kulturore universale.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kuptohet q\u00eb dor\u00ebzimi dhe transferimi i gjith\u00eb k\u00ebsaj hap\u00ebsire territoriale si dhe t\u00eb pakt\u00ebn 100 objekteve t\u00eb paluajtshme t\u00eb pasuris\u00eb kulturore komb\u00ebtare nga duart e shtetit shqiptar p\u00ebr tek administrimi i t\u00eb ashtuquajturit Fondacion, nd\u00ebrkoh\u00eb q\u00eb Ligji 50\/2022 \u00ebsht\u00eb objekt shqyrtimi nga ana e Gjykat\u00ebs Kushtetuese, do t\u00eb krijonte pasoja t\u00eb r\u00ebnda a t\u00eb pariparueshme p\u00ebr t\u00eb gjith\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Prandaj, edhe n\u00eb zbatim t\u00eb Nenit 45 t\u00eb Ligjit 8577\/2000 si dhe t\u00eb nenit 27 t\u00eb Rregullores \u201cP\u00ebr procedurat gjyq\u00ebsore t\u00eb Gjykat\u00ebs Kushtetuese\u201d do t\u00eb ishte krejt logjike dhe e arsyeshme marrja parasysh dhe pranimi i k\u00ebrkes\u00ebs s\u00eb 36 deputet\u00ebve t\u00eb opozit\u00ebs p\u00ebr pezullimin e ligjit objekt shqyrtimi deri n\u00eb shpalljen e vendimit p\u00ebrkat\u00ebs nga ana e Gjykat\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi kushtetues fitojn\u00eb t\u00eb gjith\u00eb, p\u00ebrve\u00e7\u2026<\/span><\/p>\n<p><span style=\"color: #000000;\">Pavar\u00ebsisht nga vendimi p\u00ebrfundimtar i Gjykat\u00ebs Kushtetuese, fituese e v\u00ebrtet\u00eb e \u00e7\u00ebshtjes \u00ebsht\u00eb demokracia shqiptare. Jemi para nj\u00eb rasti t\u00eb nj\u00eb ushtrimi t\u00eb mir\u00ebfillt\u00eb demokratik. Konkretisht, dihet se shqet\u00ebsimet dhe vullneti i popullit dhe i zgjedh\u00ebsve t\u00eb Sarand\u00ebs nuk jan\u00eb marr\u00eb parasysh nga administrata pavar\u00ebsisht se deputetja e Sarand\u00ebs Ina Zhupa i ka p\u00ebrcjell\u00eb ato n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb, t\u00eb p\u00ebrs\u00ebritur dhe me vendosm\u00ebri n\u00eb Kuvendin e Shqip\u00ebris\u00eb. Deputetja e Sarand\u00ebs i k\u00ebrkoi edhe Presidentit t\u00eb Republik\u00ebs q\u00eb t\u00eb mos ta dekretonte ligjin. Edhe pse kjo ndodhi, Kuvendi e rr\u00ebzoi aktin e Kreut t\u00eb Shtetit dhe e miratoi ligjin. Prandaj, edhe n\u00eb em\u00ebr t\u00eb zgjedh\u00ebsve t\u00eb vet e n\u00eb kuadrin e parimit t\u00eb p\u00ebrfaq\u00ebsimit t\u00eb vullnetit t\u00eb tyre n\u00eb Kuvend, deputetja e Sarand\u00ebs nd\u00ebrmori (i) hapin ligjv\u00ebn\u00ebs p\u00ebr abrogimin e neneve problematike 171-173 t\u00eb Ligjit 27\/2018 dhe (ii) kontrollin dhe shqyrtimin e kushtetueshm\u00ebris\u00eb t\u00eb Ligjit 50\/2022.\u00a0 E th\u00ebn\u00eb ndryshe, vullneti i kartonit detyrohet t\u2019ia ler\u00eb vendin shqyrtimit kushtetues, si dhe debatit t\u00eb hapur e demokratik n\u00eb mbar\u00eb opinionin publik n\u00eb vend.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0Paradoksalisht, shqyrtimi i K\u00ebrkes\u00ebs nga Gjykata Kushtetuese i jep mund\u00ebsin\u00eb e rrall\u00eb administrat\u00ebs q\u00eb \u201ct\u00eb nus\u00ebroj\u00eb edhe nj\u00ebher\u00eb\u201d. E th\u00ebn\u00eb ndryshe, administrata ka nj\u00eb shans tjet\u00ebr t\u00eb t\u00ebrhiqet dhe t\u00eb anuloj\u00eb Marr\u00ebveshjen.
