Po kjo vep\u00ebr, kur ka sjell\u00eb pasoja t\u00eb r\u00ebnda apo e kryer p\u00ebr q\u00ebllime fitimi, d\u00ebnohet me burgim nga tre deri n\u00eb tet\u00eb vjet\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kodi penal q\u00eb prevalon mbi t\u00eb gjitha ligjet \u00ebsht\u00eb rr\u00ebzuar me nj\u00eb vendim t\u00eb fundit t\u00eb K\u00ebshillit t\u00eb Ministrave q\u00eb u botua sot n\u00eb fletoren zyrtar, n\u00ebp\u00ebrmjet t\u00eb cilit pronar\u00ebt q\u00eb nd\u00ebrtuan pa leje pallate disa katesh n\u00eb mes t\u00eb Tiran\u00ebs kan\u00eb mund\u00ebsi t\u00eb m\u00ebnjanojn\u00eb burgun, duke dor\u00ebzuar pron\u00ebn n\u00eb shtet ose duke e parapaguar at\u00eb kundrejt nj\u00eb \u00e7mimi q\u00eb do t\u00eb p\u00ebrcaktohet me udh\u00ebzime t\u00eb m\u00ebvonshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Parapagimi do t\u00eb jet\u00eb nj\u00eb lloj legalizimi i ri p\u00ebr k\u00ebto banesa.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Procedurat p\u00ebr konfiskimin dhe parablerjen<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Sot hyn\u00eb fuqi, rregullat dhe procedurat p\u00ebr konfiskimin p\u00ebr interes publik t\u00eb objekteve t\u00eb nd\u00ebrtuara pa leje me q\u00ebllim fitimi n\u00eb p\u00ebrputhje me parashikimet e ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d, t\u00eb ndryshuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimi i qeveris\u00eb p\u00ebrcakton se, p\u00ebrpara fillimit t\u00eb procedur\u00ebs s\u00eb konfiskimit, t\u00eb k\u00ebtij vendimi, dhe deri n\u00eb marrjen e vendimit t\u00eb konfiskimit nga ana e K\u00ebshillit Komb\u00ebtar t\u00eb Territorit, zhvilluesi apo \u00e7do subjekt i autorizuar prej tij, me akt noterial kalon n\u00eb favor t\u00eb shtetit, me kontrat\u00eb premtim shitjeje me vler\u00eb 1 euro, shprehimisht ministris\u00eb p\u00ebrgjegj\u00ebse p\u00ebr administrimin e pronave shtet\u00ebrore t\u00eb drejt\u00ebn e pron\u00ebs t\u00eb sip\u00ebrfaqeve t\u00eb nd\u00ebrtuara pa leje ose n\u00eb tejkalim t\u00eb lejes s\u00eb nd\u00ebrtimit, me q\u00ebllim p\u00ebrdorimin e tyre p\u00ebr nevoja t\u00eb strehimit social apo p\u00ebr interes publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sip\u00ebrfaqet q\u00eb kalojn\u00eb n\u00eb pron\u00ebsi t\u00eb shtetit nuk konsistojn\u00eb n\u00eb realizimin nga subjekti zhvillues t\u00eb detyrimit n\u00eb kuptim t\u00eb nenit 19, t\u00eb ligjit nr.22\/2018, \u201cP\u00ebr strehimin social\u201d. Shpenzimet noteriale mbulohen nga subjekti zhvillues.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse k\u00ebrkesa pranohet, K\u00ebshilli Komb\u00ebtar i Territorit vendos ndryshimin e lejes p\u00ebrkat\u00ebse t\u00eb nd\u00ebrtimit duke njohur t\u00eb drejt\u00ebn e ministris\u00eb p\u00ebrkat\u00ebse p\u00ebr administrimin e pronave shtet\u00ebrore si bashk\u00ebp\u00ebrfituese e objektit t\u00eb ri, i cili do t\u00eb konsiderohet si objekt i nd\u00ebrtuar n\u00eb kushtet e lejes s\u00eb nd\u00ebrtimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrtimet e konfiskuara vendimi mund t\u2019i transferohen me t\u00eb drejt\u00eb parablerjeje subjektit zhvillues t\u00eb objektit apo \u00e7do subjekti t\u00eb autorizuar prej tij, p\u00ebr nj\u00eb vler\u00eb jo m\u00eb t\u00eb vog\u00ebl se \u00e7mimi i tregut, dhe fondet e siguruara p\u00ebrdoren p\u00ebr shpron\u00ebsim, trajtim t\u00eb posa\u00e7\u00ebm apo kompensime me q\u00ebllim realizimin e pun\u00ebve publike. Pagesa e \u00e7mimit t\u00eb punimeve n\u00eb tejkalim t\u00eb lejes nuk e \u00e7liron subjektin nga detyrimi i pages\u00ebs s\u00eb gjob\u00ebs s\u00eb parashikuar nga pika 1, e nenit 52, t\u00eb ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d, t\u00eb ndryshuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga momenti i kryerjes se aktit t\u00eb konstatimit t\u00eb paligjshm\u00ebris\u00eb n\u00eb nd\u00ebrtim deri n\u00eb p\u00ebrfundim t\u00eb procedur\u00ebs s\u00eb konfiskimit, punimet pezullohen me urdh\u00ebr t\u00eb drejtorit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb inspektoratit Komb\u00ebtar t\u00eb Mbrojtjes s\u00eb Territorit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Procedura e konfiskimit p\u00ebr interes publik fillon me propozimin e inspektoratit Komb\u00ebtar t\u00eb Mbrojtjes s\u00eb Territorit (IKMT) pran\u00eb K\u00ebshillit Komb\u00ebtar t\u00eb Territorit, n\u00eb vijim t\u00eb inspektimeve periodike t\u00eb kryera kryesisht apo pas marrjes s\u00eb njoftimit nga iMT-ja vendore sipas fush\u00ebs s\u00eb p\u00ebrgjegj\u00ebsis\u00eb, n\u00eb p\u00ebrputhje me legjislacionin sektorial p\u00ebr inspektimin, propozim i cili, nd\u00ebr t\u00eb tjera, p\u00ebrmban dokumentacionin e m\u00ebposht\u00ebm:<\/span><\/p>\n<p><span style=\"color: #000000;\">a) Raportin p\u00ebrmbledh\u00ebs p\u00ebr q\u00ebllimin, shkakun e konfiskimit;<\/span><\/p>\n<p><span style=\"color: #000000;\">b) Dokumentet q\u00eb kan\u00eb shoq\u00ebruar procedur\u00ebn e inspektimit p\u00ebr verifikimin e respektimit t\u00eb k\u00ebrkesave ligjore sipas ligjit nr.107\/2014;<\/span><\/p>\n<p><span style=\"color: #000000;\">c) Nj\u00eb planvendosje bashk\u00eblidhur e cila evidenton pjes\u00ebt takuese t\u00eb cilat konfiskohen si dhe pjes\u00ebt takuese q\u00eb mbeten n\u00eb pron\u00ebsi t\u00eb zhvilluesit, t\u00eb shprehura n\u00eb sip\u00ebrfaqe, volum dhe n\u00eb t\u00eb dh\u00ebna teknike p\u00ebrkat\u00ebse p\u00ebr rastet sipas n\u00ebnndarjes \u201ciii\u201d, t\u00eb shkronj\u00ebs \u201ce\u201d, t\u00eb pik\u00ebs 1, t\u00eb nenit 52, t\u00eb ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e7) Nj\u00eb planvendosje bashk\u00eblidhur e cila evidenton sip\u00ebrfaqet, volumet dhe t\u00eb dh\u00ebna teknike t\u00eb objektit q\u00eb konfiskohet p\u00ebr rastet sipas n\u00ebnndarjes \u201civ\u201d, t\u00eb shkronj\u00ebs \u201ce\u201d, t\u00eb pik\u00ebs 1, t\u00eb nenit 52, t\u00eb ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d; Fletorja Zyrtare Viti 2022 \u2013 Numri 122 Faqe|15910 d) Aktin e ekspertimit nga instituti i Nd\u00ebrtimit, ku t\u00eb p\u00ebrcaktohet se p\u00ebr shkak t\u00eb q\u00ebndrueshm\u00ebris\u00eb s\u00eb objektit \u00ebsht\u00eb e pamundur prishja e tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">IMT-t\u00eb vendore kan\u00eb detyrimin e raportimit pran\u00eb iKMT-s\u00eb kur gjat\u00eb inspektimit konstatojn\u00eb paligjshm\u00ebri dhe shkelje t\u00eb legjislacionit n\u00eb fuqi n\u00eb fush\u00ebn e nd\u00ebrtimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">IKMT-ja p\u00ebrcjell dokumentacionin e parashikuar n\u00eb pik\u00ebn 6, t\u00eb k\u00ebtij vendimi, pran\u00eb Agjencis\u00eb s\u00eb Zhvillimit t\u00eb Territorit, e cila e administron n\u00eb cil\u00ebsin\u00eb e sekretariatit teknik t\u00eb K\u00ebshillit Komb\u00ebtar t\u00eb Territorit dokumentacionin e sip\u00ebrcituar dhe kryen p\u00ebrgatitjet p\u00ebr shqyrtimin e propozimit nga ana e KKT-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebshilli Komb\u00ebtar i Territorit b\u00ebn shqyrtimin e dokumentacionit p\u00ebr konfiskimin p\u00ebr interes publik t\u00eb objektit nd\u00ebrtim pa leje, merr vendim p\u00ebr konfiskim, i cili, nd\u00ebr t\u00eb tjera, parashikon:<\/span><\/p>\n<p><span style=\"color: #000000;\">a) t\u00eb dh\u00ebna identifikuese p\u00ebr objektin q\u00eb konfiskohet;<\/span><\/p>\n<p><span style=\"color: #000000;\">b) nj\u00eb planvendosje bashk\u00eblidhur e cila evidenton pjes\u00ebt takuese t\u00eb cilat konfiskohen si dhe pjes\u00ebt takuese q\u00eb mbeten n\u00eb pron\u00ebsi t\u00eb zhvilluesit, t\u00eb shprehura n\u00eb sip\u00ebrfaqe, volum dhe n\u00eb t\u00eb dh\u00ebna teknike p\u00ebrkat\u00ebse p\u00ebr rastet e n\u00ebnndarjes \u201ciii\u201d, t\u00eb shkronj\u00ebs \u201ce\u201d, t\u00eb pik\u00ebs 1, t\u00eb nenit 52, t\u00eb ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d, ose nj\u00eb planvendosje bashk\u00eblidhur e cila evidenton sip\u00ebrfaqet, volumet dhe t\u00eb dh\u00ebna teknike t\u00eb objektit q\u00eb konfiskohet, p\u00ebr rastet sipas n\u00ebnndarjes \u201civ\u201d, t\u00eb shkronj\u00ebs \u201ce\u201d, t\u00eb pik\u00ebs 1, t\u00eb nenit 52, t\u00eb ligjit nr.107\/2014, \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d; <\/span><\/p>\n<p><span style=\"color: #000000;\">c) n\u00eb rastet e zbatimit t\u00eb parashikimeve t\u00eb pik\u00ebs 4, t\u00eb k\u00ebtij vendimi, ndryshimin e lejes s\u00eb nd\u00ebrtimit dhe\/ose subjektit zhvillues duke reflektuar shtes\u00ebn e volumeve dhe\/ose sip\u00ebrfaqes q\u00eb tejkalon lejen n\u00ebse subjekti ndodhet n\u00eb kushtet e pikave 3 e 4, t\u00eb k\u00ebtij vendimi, apo vullnetin e subjektit aplikues;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e7) detyrimin e organit kompetent q\u00eb gjat\u00eb procedur\u00ebs s\u00eb l\u00ebshimit t\u00eb certifikat\u00ebs s\u00eb p\u00ebrdorimit t\u00eb parashikoj\u00eb edhe pjes\u00ebt e konfiskuara\/kaluara n\u00eb favor t\u00eb shtetit, referuar aktit noterial t\u00eb parashikuar n\u00eb pik\u00ebn 2, t\u00eb k\u00ebtij vendimi, apo t\u00eb vendimit t\u00eb konfiskimit dhe hart\u00ebs bashk\u00eblidhur tij;<\/span><\/p>\n<p><span style=\"color: #000000;\">d) detyrimin e Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs p\u00ebr regjistrimin e vendimit t\u00eb konfiskimit s\u00eb bashku me certifikat\u00ebn e p\u00ebrdorimit, e cila, p\u00ebrve\u00e7 pjes\u00ebve t\u00eb objektit q\u00eb jan\u00eb nd\u00ebrtuar konform lejes s\u00eb nd\u00ebrtimit dhe q\u00eb mbeten n\u00eb pron\u00ebsi t\u00eb zhvilluesit ka t\u00eb parashikuar edhe pjes\u00ebt e konfiskuara\/kaluara n\u00eb favor t\u00eb shtetit, referuar vendimit t\u00eb konfiskimit, t\u00eb l\u00ebshuar nga K\u00ebshilli Komb\u00ebtar i Territorit.<\/span><\/p>\n<p><span style=\"color: #000000;\">dh) pasqyrimin n\u00eb lejen e nd\u00ebrtimit t\u00eb pjes\u00ebs takuese t\u00eb shtetit n\u00eb p\u00ebrqindje, n\u00eb raport me investitorin.<\/span><\/p>\n<p><span style=\"color: #000000;\">10. Sekretariati i K\u00ebshillit Komb\u00ebtar t\u00eb Territorit p\u00ebrcjell vendimin e KKT-s\u00eb p\u00ebr konfiskimin e objektit pran\u00eb ministris\u00eb p\u00ebrgjegj\u00ebse p\u00ebr administrimin e pronave shtet\u00ebrore, me q\u00ebllim vijimin e marrjes s\u00eb masave t\u00eb nevojshme p\u00ebr zbatimin e vendimit t\u00eb konfiskimit dhe regjistrimin pran\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs si dhe marrjen n\u00eb dor\u00ebzim t\u00eb objektit. Procedura dhe afatet e k\u00ebtij vendimi, do t\u00eb miratohen me vendim t\u00eb K\u00ebshillit Komb\u00ebtar t\u00eb Territorit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ministri p\u00ebrgjegj\u00ebs p\u00ebr administrimin e pronave shtet\u00ebrore, brenda 7 (shtat\u00eb) dit\u00ebve nga njoftimi i vendimit t\u00eb K\u00ebshillit Komb\u00ebtar t\u00eb Territorit, nxjerr urdhrin p\u00ebr zbatimin e tij, i cili, nd\u00ebr t\u00eb tjera, p\u00ebrmban:<\/span><\/p>\n<p><span style=\"color: #000000;\">a) autoritetin p\u00ebrgjegj\u00ebs p\u00ebr ndjekjen e procedur\u00ebs s\u00eb konfiskimit t\u00eb objektit;<\/span><\/p>\n<p><span style=\"color: #000000;\">b) t\u00eb dh\u00ebna identifikuese p\u00ebr objektin q\u00eb po konfiskohet;<\/span><\/p>\n<p><span style=\"color: #000000;\">c) masat n\u00eb zbatim t\u00eb parashikimeve t\u00eb pikave 2, 3 dhe 4, t\u00eb k\u00ebtij vendimi, dhe shprehjen e vullnetit t\u00eb subjektit zhvillues;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e7) parashikimet p\u00ebr ndalimin e tjet\u00ebrsimit t\u00eb destinacionit t\u00eb objektit deri n\u00eb zbatimin nga ana e subjektit zhvillues t\u00eb detyrimit ligjor q\u00eb rrjedh nga ky vendim.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse subjekti shpreh interesin p\u00ebr t\u00eb parabler\u00eb punimet pa leje, ministri p\u00ebrgjegj\u00ebs p\u00ebr administrimin e pronave shtet\u00ebrore kryen procedur\u00ebn e parablerjes dhe b\u00ebn derdhjen e fondit p\u00ebrkat\u00ebs n\u00eb llogarin\u00eb e t\u00eb ardhurave t\u00eb thesarit n\u00eb deg\u00eb me destinacion llogarin\u00eb speciale t\u00eb shpron\u00ebsimeve pran\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Autoriteti p\u00ebrgjegj\u00ebs p\u00ebr ndjekjen e procedur\u00ebs s\u00eb konfiskimit t\u00eb objektit, sipas p\u00ebrcaktimeve t\u00eb pik\u00ebs 11, brenda 7 (shtat\u00eb) dit\u00ebve nga nxjerrja e urdhrit t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr administrimin e pronave shtet\u00ebrore, i njofton mas\u00ebn e konfiskimit t\u00eb objektit personave apo subjekteve q\u00eb preken nga masa<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjat\u00eb konfiskimit t\u00eb objektit, autoriteti p\u00ebrgjegj\u00ebs p\u00ebr ndjekjen e procedur\u00ebs s\u00eb konfiskimit Fletorja Zyrtare Viti 2022 \u2013 Numri 122 Faqe|15911 t\u00eb objektit mban nj\u00eb akt konfiskimi, n\u00eb t\u00eb cilin p\u00ebrcaktohen qart\u00eb: a) t\u00eb dh\u00ebnat p\u00ebr subjektin q\u00eb i kryhet konfiskimi; b) vendndodhjen e objektit t\u00eb konfiskuar; c) sip\u00ebrfaqen e objektit t\u00eb konfiskuar; \u00e7) pamjen e brendshme dhe t\u00eb jashtme t\u00eb objektit t\u00eb konfiskuar; d) detaje t\u00eb objektit (numrin e mureve, t\u00eb dritareve etj.); dh) detaje t\u00eb punimeve t\u00eb objektit; e) \u00e7do t\u00eb dh\u00ebn\u00eb tjet\u00ebr q\u00eb \u00ebsht\u00eb karakteristik\u00eb apo e ve\u00e7ant\u00eb p\u00ebr objektin e konfiskuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Agjencia Shtet\u00ebrore e Kadastr\u00ebs siguron q\u00eb t\u00eb reflektoj\u00eb n\u00eb certifikat\u00ebn e pron\u00ebsis\u00eb pron\u00ebsin\u00eb e zhvilluesit dhe pron\u00ebsin\u00eb e shtetit mbi pron\u00ebn e konfiskuar, sipas pjes\u00ebve takuese p\u00ebrkat\u00ebse, pasi t\u00eb jet\u00eb l\u00ebshuar certifikata e p\u00ebrdorimit nga sekretariati teknik i KKT-s\u00eb apo nj\u00ebsia e qeverisjes vendore sipas fush\u00ebs s\u00eb p\u00ebrgjegj\u00ebsis\u00eb n\u00eb p\u00ebrputhje me legjislacionin p\u00ebr planifikimin dhe zhvillimin e territorit. Certifikata e p\u00ebrdorimit, si p\u00ebr pjes\u00ebn e objektit konform lejes, ashtu edhe p\u00ebr pjes\u00ebn e konfiskuar me vendim t\u00eb KKT-s\u00eb, do t\u00eb l\u00ebshohet konform legjislacionit p\u00ebr kontrollin dhe disiplinimin e punimeve t\u00eb nd\u00ebrtimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb gjitha t\u00eb ardhurat e p\u00ebrftuara nga p\u00ebrdorimi i objekteve t\u00eb konfiskuara, t\u00eb ndryshme nga ato t\u00eb parashikuara n\u00eb pik\u00ebn 12, t\u00eb k\u00ebtij vendimi, kalojn\u00eb n\u00eb buxhetin e shtetit.
