Objekt i hetimit ishte kryesisht sjellja e nd\u00ebrmarrjeve Fondi Besa, IuteCredit Albania, Raiffeisen Leasing, Mogo Albania, Tirana Factoring&amp;Lease dhe Union Financiar Tiran\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb p\u00ebrfundim t\u00eb hetimit, Komisioni i Konkurrenc\u00ebs ka arritur n\u00eb p\u00ebrfundimin se n\u00eb secilin prej tregjeve t\u00eb m\u00ebsip\u00ebrme ekziston fuqi dominuese e nj\u00eb firme, por n\u00eb asnj\u00eb rast nuk \u00ebsht\u00eb provuar abuzimi me fuqin\u00eb dominuese n\u00eb treg.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb kuptimin e ligjit \u201cP\u00ebr mbrojtjen e konkurrenc\u00ebs\u201d, abuzim me pozit\u00ebn dominuese mund t\u00eb jet\u00eb ve\u00e7an\u00ebrisht vendosja, n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb ose t\u00eb t\u00ebrthort\u00eb, e \u00e7mimeve t\u00eb padrejta t\u00eb<\/span><\/p>\n<p><span style=\"color: #000000;\">blerjes ose shitjes apo e kushteve t\u00eb tjera t\u00eb padrejta t\u00eb tregtimit; kufizimi i prodhimit, tregjeve ose zhvillimit teknik; zbatimi i kushteve t\u00eb pabarabarta p\u00ebr veprime tregtare t\u00eb nj\u00ebjta me pal\u00ebt, duke i vendosur ato n\u00eb gjendje t\u00eb pafavorshme konkurrence; vendosja e kushteve p\u00ebr lidhjen e kontratave me pal\u00ebt e tjera, q\u00eb k\u00ebto t\u00eb fundit t\u00eb pranojn\u00eb detyrime shtes\u00eb, t\u00eb cilat, p\u00ebr vet\u00eb natyr\u00ebn e tyre ose sipas praktikave tregtare, nuk kan\u00eb lidhje me objektin e kontratave n\u00eb fjal\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga hetimi i thelluar, nuk ka rezultuar q\u00eb asnj\u00eb nga nd\u00ebrmarrjet t\u00eb ket\u00eb manifestuar sjelljet e p\u00ebrmendura m\u00eb sip\u00ebr.<\/span><\/p>\n<p><span style=\"color: #000000;\">Megjithat\u00eb, t\u00eb gjitha firmat objekt hetimi e kan\u00eb kund\u00ebrshtuar konkluzionin e Autoritetit t\u00eb Konkurrenc\u00ebs p\u00ebr ekzistenc\u00ebn e pozit\u00ebs s\u00eb tyre dominuese n\u00eb tregjet p\u00ebrkat\u00ebse.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas firmave, analiza e secilit prej tregjeve t\u00eb m\u00ebsip\u00ebrme nuk mund t\u00eb b\u00ebhet vet\u00ebm p\u00ebr pjes\u00ebn q\u00eb zot\u00ebrojn\u00eb SFJB-t\u00eb, por tregu duhet trajtuar si i t\u00ebr\u00eb, duke p\u00ebrfshir\u00eb edhe subjektet e tjera q\u00eb ofrojn\u00eb t\u00eb nj\u00ebjtat produkte apo sh\u00ebrbime.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pothuajse t\u00eb gjitha produktet dhe sh\u00ebrbimet q\u00eb ofrohen nga SFJB-t\u00eb, n\u00eb fakt, ofrohen edhe nga subjekte t\u00eb tjera, kryesisht banka, por edhe kompanit\u00eb e sh\u00ebrbimeve utilitare, n\u00eb rastin e pagesave. Kompanit\u00eb gjykojn\u00eb se konstatimi i fuqis\u00eb dominuese nuk \u00ebsht\u00eb korrekt, sepse \u00ebsht\u00eb b\u00ebr\u00eb i kufizuar mbi llojin e licenc\u00ebs (vet\u00ebm p\u00ebr pjes\u00ebn q\u00eb ofrohet nga SFJB-t\u00eb) dhe jo mbi nj\u00eb vler\u00ebsim t\u00eb plot\u00eb t\u00eb tregut t\u00eb produktit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb mbyllje t\u00eb hetimit, Autoriteti i Konkurrenc\u00ebs i ka rekomanduar Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u00eb hartoj\u00eb raporte t\u00eb ve\u00e7anta mbik\u00ebqyrjeje p\u00ebr SFJB-t\u00eb, duke p\u00ebrcaktuar pjes\u00ebt respektive t\u00eb tregut dhe duke i publikuar ato.<\/span><\/p>\n<p><span style=\"color: #000000;\">Autoriteti i Konkurrenc\u00ebs rekomandon gjithashtu q\u00eb BSH t\u00eb hartoj\u00eb nj\u00eb rregullore t\u00eb ve\u00e7ant\u00eb \u201cp\u00ebr p\u00ebrcaktimin dhe miratimin e rregullave p\u00ebr kredin\u00eb konsumatore, mikrokredin\u00eb, faktoringun, qiran\u00eb financiare, p\u00ebr mir\u00ebfunksionimin e tregut ku veprojn\u00eb SFJB-t\u00eb\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Megjith\u00ebse rekomandimi ka nj\u00eb natyr\u00eb t\u00eb p\u00ebrgjithshme, Autoriteti i Konkurrenc\u00ebs duket se insiston lidhur me at\u00eb aplikimin e nj\u00eb rregullimi n\u00eb nivel t\u00eb segmentit t\u00eb tregut t\u00eb SFJB-ve dhe jo n\u00eb nivel t\u00eb produkteve, si\u00e7 ndodh aktualisht.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu, Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb i k\u00ebrkohet t\u00eb bashk\u00ebpunoj\u00eb me Autoritetin e Konkurrenc\u00ebs, n\u00eb rastet kur konstatohen shenja t\u00eb kufizimit t\u00eb konkurrenc\u00ebs. \/E.Shehu<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #ff0000;\"><strong>VINI RE<\/strong><\/span>: Ky material \u00ebsht\u00eb pron\u00ebsi intelektuale e <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.monitor.al\/autoriteti-i-konkurrences-mbyll-hetimin-per-institucionet-financiare-nuk-gjen-shkelje-te-ligjit-te-konkurrences\/\">Monitor<\/a><\/span><\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Autoriteti i Konkurrenc\u00ebs ka mbyllur hetimin e thelluar n\u00eb tregun e subjekteve financiare jo banka (SFJB), pa evidentuar shklje t\u00eb ligjit p\u00ebr mbrojtjen e konkurrenc\u00ebs.
