[Neni 171.1]. \u00cbsht\u00eb pik\u00ebrisht \u201cadministrimi indirekt\u201dq\u00eb u \u00e7el shtegun <strong>\u201cfondacioneve t\u00eb posa\u00e7me t\u00eb trash\u00ebgimis\u00eb kulturore\u201d<\/strong>[Neni 171.3.a].K\u00ebto krijohen sipas Nenit 172, i cili atyre u jep kompetenca shum\u00eb t\u00eb gjera administrimi. Dispozita u hap rrug\u00eb k\u00ebtyre fondacioneve t\u00eb posa\u00e7me q\u00eb, n\u00eb trajt\u00ebn e personave fizik\u00eb ose juridik\u00eb privat\u00eb <strong>\u201ct\u00eb huaj\u201d<\/strong>, t\u00eb fitojn\u00eb tagrin e marrjes s\u00eb Butrintit, \u201cn\u00eb p\u00ebrdorim t\u00eb drejtp\u00ebrdrejt\u00eb, dhe \u201cn\u00eb m\u00ebnyr\u00eb jo shteruese\u201d. E th\u00ebn\u00eb ndryshe, p\u00ebrmes akrobacive t\u00eb habitshme juridike q\u00eb nd\u00ebrmarrin kap\u00ebrcimin alogjik nga \u201cadministrimi indirekt\u201d tek \u201cp\u00ebrdorimi i drejtp\u00ebrdrejt\u00eb\u201d,\u00a0 k\u00ebto tri nene b\u00ebjn\u00eb q\u00eb Butrinti n\u00eb t\u00eb ardhmen t\u00eb menaxhohet jo m\u00eb nga institucionet e shtetit shqiptar, por n\u00eb thelb nga nj\u00eb fondacion i huaj.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">2. Ligji shqiptar n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn dhe Konvent\u00ebn e Parisit<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Dispozitat q\u00eb mund\u00ebsojn\u00eb menaxhimin e Parkut Komb\u00ebtar t\u00eb Butrintit nga fondacione t\u00eb huaja private, pavar\u00ebsisht nga fasadat apo instrumentet juridike t\u00eb p\u00ebrdorura, jan\u00eb n\u00eb kund\u00ebrshtim t\u00eb hapur me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, si dhe me frym\u00ebn dhe g\u00ebrm\u00ebn e Konvent\u00ebs s\u00eb Trash\u00ebgimis\u00eb Bot\u00ebrore t\u00eb v. 1972, ku Shqip\u00ebria \u2013 por edhe SHBA \u2013 jan\u00eb pal\u00eb. Me t\u00eb v\u00ebrtet\u00eb, Kushtetuta e Shqip\u00ebris\u00eb, Neni 5, p\u00ebrcakton se \u201cRepublika e Shqip\u00ebris\u00eb zbaton t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare t\u00eb detyrueshme p\u00ebr t\u00eb.\u201d M\u00eb tej, Neni 116 i Kushtetut\u00ebs p\u00ebrcakton se, sipas hierarkis\u00eb juridike, marr\u00ebveshjet nd\u00ebrkomb\u00ebtare t\u00eb ratifikuara kan\u00eb ep\u00ebrsi ndaj ligjeve. Pra, ligji shqiptar p\u00ebr trash\u00ebgimin\u00eb kulturore duhet t\u00eb jet\u00eb detyrimisht n\u00eb pajtim me Konvent\u00ebn e Trash\u00ebgimis\u00eb Bot\u00ebrore t\u00eb Parisit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke kaluar tek Konventa e Parisit, parimi themelor i saj \u00ebsht\u00eb roli i padiskutuesh\u00ebm par\u00ebsor i shteteve an\u00ebtare, [\u201cShtete Pal\u00eb\u201d], n\u00eb administrimin e pasurive kulturore dhe natyrore n\u00eb territoret e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 4 i Konvent\u00ebs shprehet m\u00ebse qart\u00eb se \u201cdetyra\u201d [the duty], p\u00ebr t\u00eb siguruar identifikimin, mbrojtjen, konservimin, prezantimin dhe p\u00ebrcjelljen p\u00ebr brezat e ardhsh\u00ebm t\u00eb trash\u00ebgimis\u00eb kulturore dhe natyrore[\u2026] q\u00eb ndodhet n\u00eb territorin e tij <strong>i takon n\u00eb m\u00ebnyr\u00eb par\u00ebsore atij Shteti.\u201d<\/strong>. Fondacionet private vet\u00ebm mund t\u00eb nxisin donacione<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Konventa e Trash\u00ebgimis\u00eb Bot\u00ebrore p\u00ebrkufizon fare qart\u00eb edhe rolin e fondacioneve t\u00eb ndryshme \u201cpublike ose private\u201d n\u00eb mbrojtjen e trash\u00ebgimis\u00eb kulturore dhe natyrore. Sipas Nenit 17 t\u00eb Konvent\u00ebs, k\u00ebto fondacione, s\u00eb pari, duhet t\u00eb jen\u00eb vendase, pra jo t\u00eb huaja [dhe n\u00eb fakt Konventa p\u00ebrdor termin \u201cnational\u201d]; s\u00eb dyti, ato mund t\u00eb angazhohen vet\u00ebm p\u00ebr q\u00ebllime filantropike. Vet\u00ebm kaq. Konventa nuk p\u00ebrmend\u00a0 askund se fondacionet vendase, [t\u00eb huajat jo se jo], t\u00eb angazhohen n\u00eb \u00e7far\u00ebdolloj m\u00ebnyre p\u00ebr q\u00ebllime drejtimi, menaxhimi, administrimi, t\u00eb dh\u00ebnies s\u00eb asistenc\u00ebs p\u00ebr hartim legjislacioni, etj. P\u00ebr qart\u00ebsi po p\u00ebrcjellim t\u00eb plot\u00eb tekstin e Nenit 17 t\u00eb Konvent\u00ebs s\u00eb Parisit, n\u00eb shqip dhe anglisht:<\/span><\/p>\n<p><em><span style=\"color: #000000;\">\u201cShtetet Pal\u00eb t\u00eb k\u00ebsaj Konvente do t\u00eb marrin n\u00eb konsiderat\u00eb ose do t\u00eb inkurajojn\u00eb ngritjen e fondacioneve ose shoqatave <strong>vendase<\/strong> publike ose private, q\u00ebllimi i t\u00eb cilave \u00ebsht\u00eb <strong>t\u00eb ftojn\u00eb donacione<\/strong> p\u00ebr mbrojtjen e trash\u00ebgimis\u00eb kulturore dhe natyrore sikurse p\u00ebrcaktohet n\u00eb Nenin 1 dhe 2 t\u00eb Konvent\u00ebs\u201d. Me t\u00eb v\u00ebrtet\u00eb, Paragrafi 15, \u201cduke respektuar t\u00ebr\u00ebsisht sovranitetin e \u201cShteteve Pal\u00eb\u201d n\u00eb territorin e t\u00eb cilave ndodhet trash\u00ebgimia kulturore dhe natyrore\u201d, rithekson se ato mund \u201ct\u00eb konsiderojn\u00eb dhe inkurajojn\u00eb ngritjen e fondacioneve publike dhe private vendase p\u00ebr t\u00eb leht\u00ebsuar donacionet p\u00ebr mbrojtjen e Trash\u00ebgimis\u00eb Bot\u00ebrore\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Partneriteti me \u201corganizata\u201d private p\u00ebrmendet vet\u00ebm n\u00eb Paragrafin 40, dhe vet\u00ebm n\u00eb kuadrin e \u201cinteresit\u201d p\u00ebrkonservimin dhe menaxhimin e Parqeve, <strong>bazuar n\u00eb Deklarat\u00ebn e OKB-s\u00eb p\u00ebr t\u00eb Drejtat e Popujve Indigjen\u00eb<\/strong>, pra parqeve t\u00eb ndodhura kryesisht n\u00eb shtete ish-koloniale q\u00eb zot\u00ebrohen nga popullsi indigjene. Partneriteti me \u201cfondacione\u201d vendase, dhe aq m\u00eb pak \u201cfondacione\u201d t\u00eb huaja nuk parashikohet aspak n\u00eb Udh\u00ebzimet Operacionale.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">4. Roli i \u00e7uditsh\u00ebm i AADF-s\u00eb<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr habi, v\u00ebrejm\u00eb se Fondacioni Shqiptaro Amerikan i Zhvillimit [American Albanian Development Foundation \u2013 AADF], nj\u00eb fondacion i huaj privat i organizuar sipas ligjeve t\u00eb shtetit Dela\u00ebare n\u00eb SHBA, i paska v\u00ebn\u00eb vetes tagrin t\u00eb nd\u00ebrhyj\u00eb n\u00eb politikat sovrane kulturore t\u00eb shtetit shqiptar, \u00e7ka ve n\u00eb pik\u00ebpyetje detyrimin e padiskutuesh\u00ebm t\u00eb \u201cShtetit Pal\u00eb\u201d sipas s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare dhe t\u00eb brendshme, p\u00ebr zbatimin e dispozitave t\u00eb Konvent\u00ebs s\u00eb Parisit p\u00ebr Trash\u00ebgimin\u00eb Kulturore Bot\u00ebrore t\u00eb v. 1972.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo gj\u00eb shfaqet m\u00ebse qart\u00eb nga nj\u00eb hulumtim i faqeve zyrtare t\u00eb AADF-s\u00eb, ku del se kjo e fundit paska pasur si synim, qysh m\u00eb 2014, hartimin e Ligjit problematik p\u00ebr Trash\u00ebgimin\u00eb Kulturore dhe Muzet\u00eb, madje ka sponsorizuar draftet e k\u00ebtij ligji. Nga njoftime t\u00eb shtypit m\u00ebsojm\u00eb edhe faktin e \u00e7uditsh\u00ebm, q\u00eb mund t\u00eb interpretohet edhe si trysni e t\u00ebrthort\u00eb e nj\u00eb shtetasi t\u00eb huaj ndaj institucioneve t\u00eb nj\u00eb vendi sovran, se n\u00eb seanc\u00ebn e miratimit nga Kuvendi i Shqip\u00ebris\u00eb me 17 maj 2018 t\u00eb ligjit t\u00eb m\u00ebsip\u00ebrm, paska qen\u00eb i pranish\u00ebm edhe vet\u00eb Kryetari i Bordit t\u00eb AADF-s\u00eb, z. Michael Granoff. Me interes t\u00eb ve\u00e7ant\u00eb do t\u00eb ishte b\u00ebrja publike e nj\u00eb instrumenti tjet\u00ebr dypal\u00ebsh, Marr\u00ebveshjes Mirela Kumbaro \u2013 Martin Mata t\u00eb 18 korrikut 2018, midis Ministris\u00eb s\u00eb Kultur\u00ebs dhe AADF-s\u00eb, e cila qenka \u201crrjedhoj\u00eb e mb\u00ebshtetjes q\u00eb AADF-ja ofron p\u00ebr zhvillimin e q\u00ebndruesh\u00ebm t\u00eb siteve t\u00eb trash\u00ebgimis\u00eb kulturore dhe turizmit n\u00eb Shqip\u00ebri.
