Komisioni i Konkurrenc\u00ebs njoftoi se n\u00eb p\u00ebrfundim t\u00eb \u201cprocedur\u00ebs s\u00eb hetimit t\u00eb thelluar n\u00eb tregun e importit dhe shitjes me shumic\u00eb t\u00eb plehrave kimike Dap, Nitrat dhe Ure, ndaj nd\u00ebrmarrjeve: ARLI INTERNACIONAL SHPK, AGRO BLEND SHPK, MBM SHPK, ECO-GREEN SHPK, LILA SHPK, AGRO-MENS SHPK, \u00c7A\u00c7A SHPK, IAM SHPK, AGROHELP-SA SHPK dhe BESNIKU SHPK\u201d, vendosi:<\/span><\/p>\n

\u2013 Gjobitjen e nd\u00ebrmarrjes AGRO BLEND SHPK n\u00eb shum\u00ebn 118,978,015 Lek\u00eb, p\u00ebr shkelje t\u00eb nenit 4, pika 1, germat a) dhe c), t\u00eb ligjit nr. 9121\/2003.<\/span><\/p>\n

\u2013 Gjobitjen e nd\u00ebrmarrjes MBM SHPK n\u00eb shum\u00ebn 66,088,573 Lek\u00eb, p\u00ebr shkelje t\u00eb nenit 4, pika 1, germat a) dhe c), t\u00eb ligjit nr. 9121\/2003.<\/span><\/p>\n

\u2013 Gjobitjen e nd\u00ebrmarrjes CACA SHPK n\u00eb shum\u00ebn 7,087,994 Lek\u00eb, p\u00ebr shkelje t\u00eb nenit 4, pika 1, germat a) dhe c), t\u00eb ligjit nr. 9121\/2003.<\/span><\/p>\n

Gati nj\u00eb viti m\u00eb par\u00eb, Komisioni i Konkurrenc\u00ebs, me Vendimin nr.783, dat\u00eb 12.03.2021, vendosi hapjen e hetimit paraprak n\u00eb tregun e importit dhe shitjes me shumic\u00eb t\u00eb plehrave kimike dhe inputeve bujq\u00ebsore, p\u00ebr t\u00eb vler\u00ebsuar n\u00ebse ka shenja t\u00eb kufizimit t\u00eb konkurrenc\u00ebs, sipas parashikimeve t\u00eb ligjit nr.9121\/2003 \u201cP\u00ebr Mbrojtjen e Konkurrenc\u00ebs\u201d.<\/span><\/p>\n

Referuar konkluzioneve t\u00eb hetimit paraprak, Komisioni i Konkurrenc\u00ebs me an\u00eb t\u00eb vendimit nr.806, dat\u00eb 04.06.2021, vendosi hapjen e procedur\u00ebs s\u00eb hetimit t\u00eb thelluar n\u00eb tregun e importit dhe shitjes me shumic\u00eb t\u00eb plehrave kimike DAP, Nitrat dhe Ure, ndaj nd\u00ebrmarrjeve: ARLI INTERNACIONAL SHPK, AGRO BLEND SHPK, MBM SHPK, ECO-GREEN SHPK, LILA SHPK, AGRO-MENS SHPK, \u00c7A\u00c7A SHPK, IAM SHPK, AGROHELP-SA SHPK dhe BESNIKU SHPK, p\u00ebr periudh\u00ebn kohore nga 01.01.2020 \u2013 30.09.2021.<\/span><\/p>\n

N\u00eb respekt t\u00eb ligjit \u201cP\u00ebr Mbrojtjen e Konkurrenc\u00ebs\u201d, p\u00ebr mbledhjen e fakteve dhe t\u00eb dh\u00ebnave t\u00eb nevojshme n\u00eb lidhje me hetimin dhe hartimin e raportit me gjetjet p\u00ebrfundimtare, Autoriteti i Konkurrenc\u00ebs k\u00ebrkoi t\u00eb dh\u00ebna dhe informacion nga: nd\u00ebrmarrjet q\u00eb operojn\u00eb n\u00eb tregun objekt hetimi; Drejtoria e P\u00ebrgjithshme e Doganave; Qendra Komb\u00ebtare e Biznesit; Ministria e Bujq\u00ebsis\u00eb dhe Zhvillimit Rural; Enti Shtet\u00ebror i Farave dhe Fidan\u00ebve; Drejtoria e P\u00ebrgjithshme e Tatimeve, si dhe zhvilloi seanca d\u00ebgjimore me p\u00ebrfaq\u00ebsues t\u00eb disa nd\u00ebrmarrjeve n\u00ebn hetim dhe t\u00eb Ministris\u00eb s\u00eb Bujq\u00ebsis\u00eb dhe Zhvillimit Rural.<\/span><\/p>\n

N\u00eb p\u00ebrfundim, referuar analiz\u00ebs s\u00eb provave indirekte n\u00eb lidhje me sjelljen e nd\u00ebrmarrjeve n\u00ebn hetim, t\u00eb tilla si: rritja e treguesve t\u00eb p\u00ebrqendrimit, rritja e nj\u00ebkohshme dhe n\u00eb m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme e \u00e7mimit t\u00eb shitjes me shumic\u00eb duke p\u00ebrcaktuar n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb \u00e7mimet e shitjes dhe duke ndar\u00eb tregjet, Komisioni i Konkurrenc\u00ebs vler\u00ebsoi se, sjellja e nd\u00ebrmarrjeve Agro Blend SHPK, MBM SHPK dhe CACA SHPK, gjat\u00eb periudh\u00ebs n\u00ebn hetim vinte n\u00eb kund\u00ebrshtim me nenin 4 pika 1, germa a) dhe c), t\u00eb ligjit nr. 9121\/2003 \u201cP\u00ebr Mbrojtjen e Konkurrenc\u00ebs\u201d.<\/span><\/p>\n

P\u00ebrtej gjobitjes s\u00eb tre nd\u00ebrmarrjeve t\u00eb sip\u00ebrcituara, Komisioni i Konkurrenc\u00ebs vendosi gjithashtu edhe vendosjen n\u00ebn monitorimin e tregut t\u00eb importit dhe shitjes me shumic\u00eb t\u00eb plehrave kimike DAP, Nitrat dhe Ure, p\u00ebr nj\u00eb periudh\u00eb 1 (nj\u00eb) vje\u00e7are nga data e daljes s\u00eb k\u00ebtij vendimi, thuhet n\u00eb njoftim.<\/span><\/p>\n
