Ky njoftim \u00ebsht\u00eb publikuar n\u00eb faqen zyrtare t\u00eb Kryeministris\u00eb dhe Ministris\u00eb s\u00eb Sh\u00ebndet\u00ebsis\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Duke mos qen\u00eb dakord me k\u00ebt\u00eb vendim t\u00eb marr\u00eb haptazi n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe Kodin Zgjedhor, k\u00ebrkojm\u00eb pran\u00eb jush, marrjen e mas\u00ebs s\u00eb sigurimit t\u00eb padis\u00eb ndaj vendimit t\u00eb dat\u00ebs 19.04.2021 t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve me objekt: \u201cVendosjen n\u00eb karantin\u00eb dy javore t\u00eb shtetasve shqiptar\u00eb q\u00eb vijn\u00eb nga Greqia dhe Maqedonia\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00c7\u00ebshtjet Ligjore dhe Arsyetimi i Padit\u00ebsit<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb parashikohet se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 3: \u201cPavar\u00ebsia e shtetit dhe t\u00ebr\u00ebsia e territorit t\u00eb tij, dinjiteti i njeriut, t\u00eb drejtat dhelirit\u00eb e tij, drejt\u00ebsia shoq\u00ebrore, rendi kushtetues, pluralizmi, identiteti komb\u00ebtar dhetrash\u00ebgimia komb\u00ebtare, bashk\u00ebjetesa fetare, si dhe bashk\u00ebjetesa dhe mir\u00ebkuptimi i shqiptar\u00ebve me pakicat jan\u00eb baza e k\u00ebtij shteti, i cili ka p\u00ebr detyr\u00eb t\u2019i respektoj\u00eb dhe t\u2019i mbroj\u00eb\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 17: \u201c1. Kufizime t\u00eb t\u00eb drejtave dhe lirive t\u00eb parashikuara n\u00eb k\u00ebt\u00eb Kushtetut\u00eb mund t\u00eb vendosen vet\u00ebm me ligj p\u00ebr nj\u00eb interes publik ose p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb t\u00eb tjer\u00ebve. Kufizimi duhet t\u00eb jet\u00eb n\u00eb p\u00ebrpjes\u00ebtim me gjendjen q\u00eb e ka diktuar at\u00eb. 2. K\u00ebto kufizime nuk mund t\u00eb c\u00ebnojn\u00eb thelbin e lirive dhe t\u00eb t\u00eb drejtave dhe n\u00ebasnj\u00eb rast nuk mund t\u00eb tejkalojn\u00eb kufizimet e parashikuara n\u00eb Konvent\u00ebn Europianep\u00ebr t\u00eb Drejtat e Njeriut\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 38. \u201c1. Kushdo ka t\u00eb drejt\u00eb t\u00eb zgjedh\u00eb vendbanimin si dhe t\u00eb l\u00ebviz\u00eb lirisht n\u00eb \u00e7do pjes\u00ebt\u00eb territorit t\u00eb shtetit.2. Askush nuk mund t\u00eb pengohet t\u00eb dal\u00eb lirisht jasht\u00eb shtetit\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 45. \u201c1. \u00c7do shtetas q\u00eb ka mbushur tet\u00ebmb\u00ebdhjet\u00eb vje\u00e7, qoft\u00eb edhe dit\u00ebn e zgjedhjeve,ka t\u00eb drejt\u00ebn t\u00eb zgjedh\u00eb dhe t\u00eb zgjidhet.2. P\u00ebrjashtohen nga e drejta e zgjedhjes shtetasit e deklaruar me vendim gjyq\u00ebsort\u00eb form\u00ebs s\u00eb prer\u00eb si t\u00eb paaft\u00eb mend\u00ebrisht.3. P\u00ebrjashtohen nga e drejta p\u00ebr t\u2019u zgjedhur shtetasit q\u00eb jan\u00eb d\u00ebnuar me burgim,me vendim p\u00ebrfundimtar t\u00eb form\u00ebs s\u00eb prer\u00eb, p\u00ebr kryerjen e nj\u00eb krimi, sipas rregullavet\u00eb p\u00ebrcaktuara me ligj t\u00eb miratuar me tri t\u00eb pestat e t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb Kuvendit.N\u00eb raste p\u00ebrjashtimore dhe t\u00eb justifikuara, ligji mund t\u00eb parashikoj\u00eb kufizime t\u00eb s\u00ebdrejt\u00ebs p\u00ebr t\u00eb zgjedhur t\u00eb shtetasve q\u00eb vuajn\u00eb d\u00ebnimin me heqje lirie, ose t\u00eb s\u00eb drejt\u00ebsp\u00ebr t\u2019u zgjedhur para dh\u00ebnies s\u00eb nj\u00eb vendimi p\u00ebrfundimtar apo kur shtetasit jan\u00ebd\u00ebbuar p\u00ebr nj\u00eb krim ose p\u00ebr cenim shum\u00eb t\u00eb r\u00ebnd\u00eb dhe serioz t\u00eb siguris\u00eb publike.4. Vota \u00ebsht\u00eb vetjake, e barabart\u00eb, e lir\u00eb dhe e fsheht\u00eb\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>&#8211; N\u00eb Kodin Zgjedhor t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb parashikohet se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 8 Periudha zgjedhore: \u201cZgjedhjet e p\u00ebrgjithshme p\u00ebr Kuvendin apo p\u00ebr nj\u00ebsit\u00eb e qeverisjes vendore zhvillohen nj\u00ebher\u00ebsh n\u00eb t\u00eb gjith\u00eb territorin e vendit brenda periudh\u00ebs q\u00eb shtrihet nga 15 prilli deri n\u00eb 15 maj ose nga 15 tetori deri n\u00eb 15 n\u00ebntor. B\u00ebjn\u00eb p\u00ebrjashtim nga ky rregull rastet e parashikuara n\u00eb pikat 5, 6, 7 dhe 8 t\u00eb nenit 9 t\u00eb k\u00ebtij ligji\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Me Dekretin e Presidentit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb nr. 11700, dat\u00eb 06.09.2020 \u00ebsht\u00eb dekretuar data 25 Prill 2021 si data e zgjedhjeve p\u00ebr Kuvendin e Shqip\u00ebris\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 44 Kriteret p\u00ebr p\u00ebrfshirjen e zgjedh\u00ebsit n\u00eb listat e zgjedh\u00ebsve: \u201c1. Lista e zgjedh\u00ebsve, sipas nenit 56, duhet t\u00eb mbahet edhe n\u00eb format elektronik. Kriteret p\u00ebr p\u00ebrfshirjen e nj\u00eb personi n\u00eb list\u00ebn e zgjedh\u00ebsve jan\u00eb:<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>a) t\u00eb ket\u00eb shtet\u00ebsin\u00eb shqiptare;<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>b) t\u00eb ket\u00eb mbushur mosh\u00ebn 18 vje\u00e7, qoft\u00eb edhe n\u00eb dat\u00ebn e zgjedhjeve;<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>c) Shfuqizuar;<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>\u00e7) t\u00eb jet\u00eb i regjistruar n\u00eb Regjistrin Komb\u00ebtar t\u00eb Gjendjes Civile (n\u00eb vijim RKGjC);<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>d) t\u00eb ket\u00eb vendbanimin e regjistruar n\u00eb territorin e nj\u00eb prej zonave t\u00eb qendrave t\u00eb votimit;<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>dh) t\u00eb regjistrohet zgjedh\u00ebs n\u00eb list\u00ebn e vet\u00ebm nj\u00eb zone qendre votimi.<\/em><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>Neni 46 Lista e zgjedh\u00ebsve: 1. Lista e zgjedh\u00ebsve hartohet p\u00ebr \u00e7do zon\u00eb qendre votimi dhe p\u00ebrmban t\u00eb gjith\u00eb zgjedh\u00ebsit q\u00eb kan\u00eb vendbanimin e regjistruar n\u00eb RKGjC n\u00eb at\u00eb zon\u00eb qendre votimi. P\u00ebrfshirja e zgjedh\u00ebsit n\u00eb list\u00eb b\u00ebhet mbi baz\u00ebn e kodit t\u00eb vendbanimit.<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>Nj\u00eb zon\u00eb qendre votimi ka jo m\u00eb pak se 300 dhe jo m\u00eb shum\u00eb se 1000 zgjedh\u00ebs me vendbanim n\u00eb territorin e saj.<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em> Lista e zgjedh\u00ebsve q\u00eb votojn\u00eb nga jasht\u00eb vendit p\u00ebrfshin vet\u00ebm zgjedh\u00ebsit me vendbanim jasht\u00eb vendit, t\u00eb cil\u00ebt deklarojn\u00eb vullnetin p\u00ebr t\u00eb ushtruar t\u00eb drejt\u00ebn e votimit, sipas rregullave t\u00eb dala n\u00eb zbatim t\u00eb nenit 24 t\u00eb k\u00ebtij ligji.<\/em><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>Neni 105, pika 1, Paraqitja e zgjedh\u00ebsit n\u00eb qendr\u00ebn e votimit: 1. Pas hyrjes s\u00eb zgjedh\u00ebsit n\u00eb qendr\u00ebn e votimit:<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>a) zgjedh\u00ebsi thot\u00eb emrin dhe paraqet para KQV-s\u00eb nj\u00eb nga dokumentet zyrtare t\u00eb vlefshme t\u00eb identitetit me t\u00eb dh\u00ebna biometrike, si m\u00eb posht\u00eb:<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>i) let\u00ebrnjoftim; ose<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>ii) pasaport\u00eb;<\/em><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>E nderuar Gjykat\u00eb,<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Si\u00e7 e kemi referuar m\u00ebsip\u00ebr, Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb parashikon se t\u00eb drejtat dhe lirit\u00eb e njeriut, pluralizmi, jan\u00eb baza e k\u00ebtij shteti, i cili ka p\u00ebr detyr\u00eb t\u2019i respektoj\u00eb dhe t\u2019i mbroj\u00eb ato. Shtetasi shqiptar ka t\u00eb drejt\u00eb t\u00eb l\u00ebviz\u00eb lirisht dhe t\u00eb zgjedh\u00eb sipas d\u00ebshir\u00ebs vendbanimin e tij brenda apo jasht\u00eb territorit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>M\u00eb tej akoma, Kushtetuta parashikon si t\u00eb drejt\u00eb dhe liri themelore t\u00eb shtetasit t\u00eb drejt\u00ebn t\u00eb zgjedh\u00eb dhe t\u00eb zgjidhet.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Me vendimmarrjen e tij p\u00ebr vendosjen n\u00eb karantin\u00eb dy javore t\u00eb shtetasve shqiptar\u00eb q\u00eb vijn\u00eb nga Greqia apo Maqedonia, n\u00eb thelb \u00ebsht\u00eb mohuar e drejta kushtetuese e zgjedh\u00ebsve shqiptar\u00eb me banim n\u00eb Greqi dhe Maqedoni p\u00ebr t\u00eb ushtruar t\u00eb drejt\u00ebn e tyre t\u00eb zgjedhin lirisht p\u00ebr zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb dat\u00ebs 25 Prill 2021.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb vendimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb Nr. 11, dat\u00eb 9.3.2021 p\u00ebrcaktohet se: dy jan\u00eb kushtet e kufizimit t\u00eb lirive dhe t\u00eb drejtave t\u00eb njeriut:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>1) Kufizimet Vendosen me Ligj;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>2) Kufizimet vendosen p\u00ebr interes publik.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Referuar aktit\/vendimit t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve rezulton e qart\u00eb dhe pa asnj\u00eb ekuivok se asnj\u00eb nga dy parakushtet e parashikuara n\u00eb nenin 17 t\u00eb Kushtetut\u00ebs dhe p\u00ebrcaktuar n\u00eb Vendimin e Gjykat\u00ebs Kushtetuese nuk p\u00ebrmbushet.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebt\u00eb akt administrativ ne e konsiderojm\u00eb t\u00eb marr\u00eb pa prova, me q\u00ebndrime t\u00eb nj\u00ebanshme dhe t\u00eb paligjshme nga pala e paditur, n\u00eb kund\u00ebrshtim, n\u00eb lajthitje, si dhe n\u00eb interpretim t\u00eb gabuar t\u00eb dispozitave ligjore t\u00eb ligjit dhe rregullave t\u00eb prokurimit publik.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Fillimisht, bazuar n\u00eb nenet 28, 29 e vijues t\u00eb Ligjit nr. 49\/2012 \u201cP\u00ebr Gjykatat Administrative dhe Gjykimin e Mosmarr\u00ebveshjeve Administrative\u201d, duke marr\u00eb n\u00eb konsiderat\u00eb natyr\u00ebn e \u00e7\u00ebshtjes objekt gjykimi \u2013 ankes\u00eb ndaj aktit\/vendimit t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve, si dhe referuar dekretit t\u00eb Presidentit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb p\u00ebr caktimin dhe zhvillimin e dat\u00ebs s\u00eb zgjedhjeve n\u00eb dat\u00ebn 25 Prill 2021, po paraqesim k\u00ebrkes\u00ebn p\u00ebr marrjen e mas\u00ebs s\u00eb sigurimit te padise, dhe m\u00eb pas brenda afatit ligjor, do t\u00eb paraqesim padin\u00eb e themelit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Partia \u201cL\u00ebvizja Socialiste P\u00ebr Integrim\u201d n\u00eb cil\u00ebsin\u00eb e subjektit zgjedhor ka interes t\u00eb ligjsh\u00ebm p\u00ebr ushtrimin e t\u00eb drejt\u00ebs kushtetuese t\u00eb zgjedhjes p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb dat\u00ebs 25 Prill 2021, nga ana e shtetasve shqiptar\u00eb q\u00eb jetojn\u00eb e banojn\u00eb n\u00eb Greqi dhe Maqedoni, paraqet k\u00ebrkes\u00ebn q\u00eb gjykata paraprakisht t\u00eb urdh\u00ebroj\u00eb pezullimin e zbatimit t\u00eb k\u00ebtij akti, pasi zbatimi i tij do ta b\u00ebnt\u00eb nul k\u00ebt\u00eb gjykim, c\u00ebnon interesat e pal\u00ebs padit\u00ebse t\u00eb cil\u00ebs i shkaktohet nj\u00eb d\u00ebm i pakthyesh\u00ebm, si edhe nuk c\u00ebnohet interesi publik.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebrkesa jon\u00eb p\u00ebr marrjen e mas\u00ebs s\u00eb siguris\u00eb bazohet n\u00eb nenin 28 e vijues t\u00eb Ligjit nr. 49\/2012, pasi gjat\u00eb koh\u00ebs s\u00eb nevojshme t\u00eb procesit, derisa t\u00eb arrihet n\u00eb marrjen e vendimit t\u00eb themelit, ekziston rreziku real dhe mund\u00ebsia e ardhjes s\u00eb nj\u00eb d\u00ebmi t\u00eb r\u00ebnd\u00eb e t\u00eb pariparuesh\u00ebm, q\u00eb rrjedh nga ekzekutimi i aktit\/vendimit administrativ p\u00ebr pengimin e t\u00eb drejt\u00ebs kushtetuese t\u00eb ushtrimit t\u00eb s\u00eb drejt\u00ebs s\u00eb zgjedhjes n\u00eb dat\u00eb 25 Prill 2021.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>C\u00ebshtja q\u00eb shtrohet \u00ebsht\u00eb e qart\u00eb: A i shkaktojn\u00eb d\u00ebm subjektit zgjedhor \u201cL\u00ebvizja Socialiste P\u00ebr Integrim\u201d &#8211; k\u00ebrkuesit (Pal\u00eb padit\u00ebse) vendimi i Komitetit Teknik t\u00eb Ekspert\u00ebve p\u00ebr karantimin dy javor t\u00eb shtetasve q\u00eb vijn\u00eb nga Greqia dhe Maqedonia ?<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjykata Administrative e Shkall\u00ebs s\u00eb par\u00eb Tiran\u00eb duhet t\u00eb vler\u00ebsoj\u00eb pik\u00ebrisht k\u00ebt\u00eb fakt, pra d\u00ebmin q\u00ebdo t\u00eb shkaktoj\u00eb jo vet\u00ebm ne si pal\u00eb padit\u00ebse por t\u00eb gjith\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, nga akti\/vendimi haptazi i paligjsh\u00ebm i Komitetit teknik t\u00eb ekspert\u00ebve, i cili \u00ebsht\u00eb mohimi i t\u00eb drejt\u00eb s\u00eb vot\u00ebs, pra \u00ebsht\u00eb nj\u00eb d\u00ebm i r\u00ebnd\u00eb i pakthyesh\u00ebm dhe i aty\u00e7astsh\u00ebm.Ky d\u00ebm provohet me t\u00eb gjitha provat shkresore t\u00eb depozituara n\u00eb gjykat\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Me zbatimin e vendimit t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve, pengohet p\u00ebrfundimisht e drejta kushtetuese e zgjedhjes e shtetasve shqiptar\u00eb q\u00eb vijn\u00eb nga Greqia dhe Maqedonia p\u00ebr zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb dat\u00ebs 25 Prill 2021, e pik\u00ebrisht kjo do t\u00eb ishte pasoja e menj\u00ebhershme dhe e pariparueshme e zbatimit t\u00eb vendimit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb k\u00ebt\u00eb k\u00ebndv\u00ebshtrim, n\u00eb kuptim t\u00eb ligjit dhe t\u00eb interpretimit t\u00eb zgjeruar q\u00eb b\u00ebn Vendimi Unifikues nr. 10 dat\u00eb 24.03.2004 i Kolegjeve t\u00eb Bashkuara t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, ku thuhet se \u201cn\u00ebp\u00ebrmjet mas\u00ebs s\u00eb sigurimit t\u00eb padis\u00eb synohet kryesisht q\u00eb t\u00eb mbahet e ngrir\u00eb gjendja faktike e mosmarr\u00ebveshjes, derisa gjykata t\u00eb zgjidh\u00eb p\u00ebrfundimisht \u00e7\u00ebshtjen n\u00eb themel.\u201d<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00cbsht\u00eb pik\u00ebrisht ajo q\u00eb ne k\u00ebrkojm\u00eb t\u00eb arrijm\u00eb me an\u00eb t\u00eb k\u00ebsaj mas\u00eb sigurimi, pra mbajtjen t\u00eb ngrir\u00eb t\u00eb gjendjes faktike t\u00eb mosmarr\u00ebveshjes. Me marrjen e mas\u00ebs s\u00eb sigurimit t\u00eb padise n\u00eb k\u00ebt\u00eb rast, do t\u00eb realizohej mbajtja e ngrir\u00eb e zbatimit t\u00eb vendimit t\u00eb paligjsh\u00ebm t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve dhe zbatimi i nj\u00eb prej lirive dhe t\u00eb drejtave themelore t\u00eb njeriut si\u00e7 \u00ebsht\u00eb e drejta e vote.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb referenc\u00eb dhe n\u00eb interpretim t\u00eb dispozitave t\u00eb m\u00ebsip\u00ebrme, n\u00eb gjykime t\u00eb k\u00ebtij lloji, n\u00eb m\u00ebnyr\u00eb q\u00eb gjykata t\u00eb vendos\u00eb p\u00ebr marrjen e nj\u00eb mase sigurimi padie (t\u00eb parashikuara k\u00ebto t\u00eb fundit n\u00eb nenin 206 te K.Pr.Civile), duhet t\u00eb paraqitet e provuar me prova shkresore ekzistenca e dy kushteve themelore:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>a- Ekzistenca e mundshme e nj\u00eb t\u00eb drejt\u00eb p\u00ebr t\u00eb cil\u00ebn k\u00ebrkohet mbrojtje gjat\u00eb procesit t\u00eb gjykimit t\u00eb padis\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>b- Ekzistenca e frik\u00ebs q\u00eb ekzekutimi i vendimit p\u00ebr t\u00eb drejt\u00ebn q\u00eb k\u00ebrkohet t\u00eb mbrohet do t\u00eb b\u00ebhet i pamundur ose i v\u00ebshtir\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sipas nenit 202 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, masa e sigurimit t\u00eb padis\u00eb duhet marr\u00eb kur ka arsye t\u00eb dyshohet se ekzekutimi i vendimit p\u00ebr t\u00eb drejtat e padit\u00ebsit do t\u00eb b\u00ebhet i pamundur ose i v\u00ebshtir\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Marrjen e mas\u00ebs s\u00eb sigurimit t\u00eb padis\u00eb e k\u00ebrkojm\u00eb p\u00ebr faktin se ekziston si e drejta p\u00ebr t\u00eb cil\u00ebn nek\u00ebrkojm\u00eb mbrojtje nga procesi gjyq\u00ebsor, ashtu edhe p\u00ebr faktin se ekzistojn\u00ebt\u00eb gjitha kushtet q\u00eb ekzekutimi i vendimit t\u00eb dh\u00ebn\u00eb nga gjykata t\u00eb jet\u00ebtejet i pamundur n\u00ebt\u00eb ardhmen duke na sjell\u00eb pasoja shum\u00eb t\u00eb r\u00ebnda dhe t\u00eb pariparueshme.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ligjv\u00ebn\u00ebsi ka parashikuar sigurimin e padis\u00eb jo vet\u00ebm p\u00ebr t\u00eb siguruar t\u00eb drejt\u00ebn, e cila p\u00ebrb\u00ebn dhe t\u00ebr\u00ebsin\u00eb e k\u00ebrkimeve t\u00eb padit\u00ebsit, por n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb k\u00ebt\u00eb parashikim e ka b\u00ebr\u00eb dhe me q\u00ebllimin q\u00eb t\u00eb siguroj\u00eb efektivitetin dhe dobishm\u00ebrin\u00eb e pro\u00e7esit gjyq\u00ebsor q\u00eb \u00ebsht\u00eb duke u realizuar mes pal\u00ebve.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>A ekziston nj\u00eb e drejt\u00eb p\u00ebr t\u00eb cil\u00ebn k\u00ebrkohet mbrojtje gjat\u00eb procesit t\u00eb gjykimit t\u00eb padis\u00eb?<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ne \u00e7mojm\u00eb se n\u00eb respektim t\u00eb Nenit 29, shkronja \u201ca\u201d t\u00eb Ligjit 49\/2012, por edhe t\u00eb Nenit 202, shkronja \u201ca\u201d t\u00eb Kodit t\u00eb Procedur\u00ebs Civile t\u00ebr\u00ebsia e provave shkresore q\u00eb paraqesim n\u00eb k\u00ebt\u00eb faz\u00eb, dhe t\u00eb cilat m\u00eb von\u00eb n\u00eb afatin procedurial t\u00eb p\u00ebrcaktuar n\u00eb ligj do t\u2019i n\u00ebnshtrohen hetimit dhe debatit gjyq\u00ebsor dhe q\u00eb shoq\u00ebrojn\u00eb k\u00ebt\u00eb k\u00ebrkim, jan\u00eb t\u00eb mjaftueshme p\u00ebr gjykat\u00ebn q\u00eb t\u00eb marr\u00eb mas\u00eb t\u00eb shpejt\u00eb p\u00ebr sigurimin e padis\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>A ekziston frik\u00eb q\u00eb ekzekutimi i vendimit p\u00ebr t\u00eb drejt\u00ebn q\u00eb k\u00ebrkohet t\u00eb mbrohet do t\u00eb b\u00ebhet i pamundur ose i v\u00ebshtir\u00eb?<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Masa e sigurimit t\u00eb padis\u00eb q\u00eb k\u00ebrkojm\u00eb t\u00eb merret nga Gjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb Tiran\u00eb \u00ebsht\u00eb e p\u00ebrshtatshme dhe e dobishme p\u00ebr t\u00eb mbrojtur pik\u00ebrisht t\u00eb drejtat e pretenduara t\u00eb Padit\u00ebsit. Kjo mas\u00eb q\u00eb k\u00ebrkojm\u00eb t\u00eb merret \u00ebsht\u00eb n\u00eb respektim t\u00eb nenit 30 t\u00eb Ligjit 49\/2012 dhe t\u00eb Nenit 206 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, si dhe Vendimit Unifikues t\u00eb Kolegjeve t\u00eb Bashkuara t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb nr.10, dat\u00eb 24.03.2004, ku shprehimisht parashikohet se: \u201cgjykata rast pas rasti ka<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>diskrecion t\u00eb vendos\u00eb nj\u00eb mas\u00eb t\u00eb natyr\u00ebs s\u00eb sigurimit t\u00eb padis\u00eb q\u00eb ajo e gjykon t\u00eb dobishme dhe t\u00eb p\u00ebrshtatshme p\u00ebr t\u00eb mbrojtur t\u00eb drejtat e padit\u00ebsit, por pa rrezikuar n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb mbrojtjen e t\u00eb drejtave dhe interesave t\u00eb ligjshme t\u00eb t\u00eb paditurit\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Masa e sigurimit q\u00eb k\u00ebrkojm\u00eb t\u00eb vendoset \u00ebsht\u00eb nj\u00eb mas\u00eb q\u00eb duhet t\u00eb merret me q\u00ebllimin e vet\u00ebm q\u00eb t\u00eb mund\u00ebsohet mbajtja e nj\u00eb gjendje juridike dhe faktike konstante, e cila mund\u00ebson q\u00eb t\u00eb drejtat potenciale t\u00eb padit\u00ebsit t\u00eb mbrohen nga b\u00ebrja e v\u00ebshtir\u00eb e ekzekutimit t\u00eb vendimit. Ky konkluzion vjen n\u00eb harmoni dhe n\u00eb p\u00ebrputhje me vendimin nr.10, dat\u00eb 24.3.2004 t\u00eb Kolegjeve t\u00eb Bashkuara t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, ku shprehimisht thuhet: \u201cMarrja e masave t\u00eb p\u00ebrkoh\u00ebshme t\u00eb sigurimit t\u00eb padis\u00eb synon \u201cta mbaj\u00eb gj\u00ebndjen ashtu si\u00e7 \u00ebsht\u00eb\u201d, apo \u201ct\u00eb ngrir\u00eb\u201d, deri n\u00eb zgjidhjen p\u00ebrfundimtare t\u00eb konfliktit, e cila, p\u00ebr vet\u00eb natyr\u00ebn e \u00e7\u00ebshtjes, duhet t\u00eb realizohet n\u00ebp\u00ebrmjet nj\u00eb pro\u00e7edure t\u00eb shpejt\u00eb dhe relativisht t\u00eb thjesht\u00eb, duke u kujdesur, gjith\u00ebsesi, q\u00eb t\u00eb respektohet nj\u00eb standart i pranuesh\u00ebm i nj\u00eb pro\u00e7esi t\u00eb rregullt ligjor\u201d.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjithashtu, referuar p\u00ebrcaktimit t\u00eb Nenit 29, pika b t\u00eb Ligjit nr 49\/2012, sqarojm\u00eb se pezullimi i k\u00ebsaj procedure nuk mund t\u00eb c\u00ebnoj\u00eb n\u00eb asnj\u00eb rast interesinpublik, p\u00ebrkundrazi \u00ebsht\u00eb totalisht n\u00eb p\u00ebrmbushje t\u00eb interest publik dhe kushtetues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sa m\u00eb sip\u00ebr, i drejtohemi Gjykat\u00ebs brenda afateve ligjore, dhe p\u00ebrfundimisht k\u00ebrkojm\u00eb:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Marrjen e Mas\u00ebs s\u00eb Sigurimit t\u00eb Padis\u00eb duke pezulluar zbatimin e vendimit t\u00eb Komitetit Teknik t\u00eb Ekspert\u00ebve t\u00eb dat\u00ebs 19.04.2021, me objekt: \u201cVendosjen n\u00eb karantin\u00eb dy javore t\u00eb shtetasve shqiptar\u00eb q\u00eb vijn\u00eb nga Greqia dhe Maqedonia\u201d, deri n\u00eb fund t\u00eb gjykimit dhe derisa vendimi gjyq\u00ebsor t\u00eb marr\u00eb form\u00eb t\u00eb prer\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>PADIT\u00cbS<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Partia L\u00ebvizja Socialiste p\u00ebr Integrim<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>KRYETAR<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>MONIKA KRYEMADHI<\/em><\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>LSI-ja ka \u00e7uar n\u00eb gjykat\u00eb Komitetin e Ekspert\u00ebve dhe Ministrin\u00eb e Sh\u00ebndet\u00ebsis\u00eb pas vendimit t\u00eb djesh\u00ebm, sipas t\u00eb cilit t\u00eb gjith\u00eb ata q\u00eb hyjn\u00eb n\u00eb Shqip\u00ebri nga Greqia apo Maqedonia e Veriut duhet t\u00eb q\u00ebndrojn\u00eb n\u00eb karantin\u00eb p\u00ebr dy jav\u00eb.
