Ky projektligj ka marr\u00eb nj\u00eb koh\u00eb t\u00eb gjat\u00eb n\u00eb hartimin e tij, nd\u00ebrkoh\u00eb q\u00eb \u00ebsht\u00eb depozituar n\u00eb Kuvendin e Shqip\u00ebris\u00eb nga K\u00ebshilli i Ministrave n\u00eb 6 janar 2021.<\/span><\/p>\n<p><span style=\"color: #000000;\">Me shkres\u00ebn e Kuvendit nr. 835 prot., dat\u00eb 18.03.2021, ky ligj i \u00ebsht\u00eb p\u00ebrcjell\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs kushtetuese t\u00eb parashikuar nga neni 85, pika 1, e Kushtetut\u00ebs, ligji nr. 32\/2021 \u201cP\u00ebr sigurimin e detyruesh\u00ebm n\u00eb sektorin e transportit\u201d, iu n\u00ebnshtrua shqyrtimit t\u00eb tij, duke marr\u00eb n\u00eb vler\u00ebsim t\u00eb kujdesh\u00ebm praktik\u00ebn parlamentare, diskutimet e deputet\u00ebve, q\u00ebndrimet publike q\u00eb kan\u00eb hasur disa nene t\u00eb ve\u00e7anta t\u00eb ligjit q\u00eb prej hartimit t\u00eb projektligjit nga Agjencia e Mbik\u00ebqyrjes Financiare, deri n\u00eb miratimin e tij, nga Kuvendi i Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Referuar praktik\u00ebs parlamentare, hartimi i nj\u00eb ligji t\u00eb ri p\u00ebr sigurimin e detyruesh\u00ebm n\u00eb sektorin e transportit \u00ebsht\u00eb b\u00ebr\u00eb i nevojsh\u00ebm p\u00ebr k\u00ebto arsye kryesore:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 S\u00eb pari, p\u00ebr t\u00eb reflektuar zhvillimet e vrullshme q\u00eb kan\u00eb ndodhur, nd\u00ebr vite, n\u00eb k\u00ebt\u00eb sektor, si n\u00eb vendin ton\u00eb, ashtu edhe n\u00eb vendet e rajonit e t\u00eb Europ\u00ebs;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 S\u00eb dyti, p\u00ebr t\u00eb zbatuar detyrimin e p\u00ebrcaktuara n\u00eb MSA, n\u00eb drejtim t\u00eb p\u00ebrafrimit t\u00eb legjislacionit me direktivat e BE-s\u00eb, e konkretisht, me direktiv\u00ebn 2009\/103\/KE t\u00eb Parlamentit Europian dhe t\u00eb K\u00ebshillit, dat\u00eb 16 shtator 2009. Hartimi i k\u00ebtij ligji \u00ebsht\u00eb k\u00ebrkuar edhe nga Komisioni Europian n\u00eb Raportet e Progresit p\u00ebr vendin ton\u00eb.<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 S\u00eb treti, hartimi i k\u00ebtij ligji \u00ebsht\u00eb k\u00ebrkes\u00eb e rezolutave t\u00eb Kuvendit p\u00ebr vitet e fundit;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 S\u00eb kat\u00ebrti, hartimi i k\u00ebtij ligji \u00ebsht\u00eb rekomanduar edhe nga KLSH;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 S\u00eb pesti, hartimi i k\u00ebtij ligji \u00ebsht\u00eb i nevojsh\u00ebm p\u00ebr zgjidhjen e disa problematikave, t\u00eb konstatuara gjat\u00eb zbatimit n\u00eb praktik\u00eb t\u00eb ligjit ekzistues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Para s\u00eb gjithash dhe duke ju referuar q\u00ebllimit t\u00eb hartimit dhe propozimit t\u00eb k\u00ebsaj nisme ligjore, Presidenti i Republik\u00ebs vler\u00ebson hartimin e nj\u00eb ligji t\u00eb ri n\u00eb fush\u00ebn e sigurimit t\u00eb detyruesh\u00ebm n\u00eb sektorin e transportit, pasi \u00e7do nism\u00eb q\u00eb i p\u00ebrshtatet zhvillimeve t\u00eb tregut, k\u00ebrkesave t\u00eb koh\u00ebs, duke p\u00ebrmir\u00ebsuar nj\u00ebkoh\u00ebsisht edhe sigurin\u00eb juridike dhe masat respektive p\u00ebr mbrojtjen e jet\u00ebs, sh\u00ebndetit dhe interesave t\u00eb qytetar\u00ebve, \u00ebsht\u00eb gjithmon\u00eb e mir\u00ebpritur.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ligj p\u00ebrmban n\u00eb t\u00ebr\u00ebsin\u00eb e tij 61 nene, nga t\u00eb cilat vet\u00ebm disa prej tyre jan\u00eb konstatuar si dispozita problematike, apo q\u00eb paraqesin shqet\u00ebsim, t\u00eb cilat duhet t\u00eb merren edhe nj\u00eb her\u00eb n\u00eb shqyrtim nga Kuvendi i Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrimi i p\u00ebrmbajtjes s\u00eb ligjit n\u00eb krahasim me praktik\u00ebn parlamentare , rezulton se nj\u00eb nga nenet q\u00eb ka hasur diskutime t\u00eb gjera, p\u00ebrgjat\u00eb pun\u00ebs n\u00eb Komisionin p\u00ebr Ekonomin\u00eb dhe Financat, n\u00eb cil\u00ebsin\u00eb e komisionit p\u00ebrgjegj\u00ebs, apo Komisionin p\u00ebr Veprimtarin\u00eb Prodhuese, Tregtin\u00eb dhe Mjedisin, \u00ebsht\u00eb dispozita e nenit 8 t\u00eb ligjit nr. 32\/2021, dispozit\u00eb e cila \u00ebsht\u00eb prezantuar nga qeveria si nj\u00eb nd\u00ebr risit\u00eb kryesore, q\u00eb synon t\u00eb v\u00ebr\u00eb n\u00eb zbatim efektivisht sistemin e ri p\u00ebr p\u00ebrcaktimin e nivelit t\u00eb primit t\u00eb sigurimit t\u00eb detyruesh\u00ebm motorik, bazuar n\u00eb historikun e d\u00ebmeve t\u00eb t\u00eb siguruarit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi me kujdes i p\u00ebrmbajtjes s\u00eb k\u00ebtij neni, Presidenti i Republik\u00ebs, vler\u00ebson se Kuvendi i Shqip\u00ebris\u00eb, pavar\u00ebsisht asaj q\u00eb deklarohet n\u00eb praktik\u00ebn parlamentare, n\u00eb fakt, p\u00ebr nga formulimi konkret i dispozit\u00ebs, nuk ka mundur t`i jap\u00eb zgjidhje k\u00ebsaj problematike, pasi p\u00ebrmbajtja e dispozit\u00ebs s\u00eb nenit 8, nuk garanton zbatimin n\u00eb praktik\u00eb edhe p\u00ebr nj\u00eb koh\u00eb shum\u00eb t\u00eb gjat\u00eb t\u00eb sistemit bonus-malus.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse kjo dispozit\u00eb do t\u00eb q\u00ebndroj\u00eb sipas p\u00ebrmbajtjes s\u00eb miratuar nga Kuvendi, at\u00ebher\u00eb ky sistem i ri (bonus-malus), nuk b\u00ebhet i zbatuesh\u00ebm, por do t\u00eb ngelet n\u00eb d\u00ebshir\u00ebn e shoq\u00ebrive t\u00eb sigurimit, e p\u00ebr pasoj\u00eb, s\u00ebrish ky nen mbetet n\u00eb ligj vet\u00ebm si nj\u00eb dispozit\u00eb deklarative.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr ta risjell\u00eb n\u00eb kujtes\u00ebn tuaj se cili \u00ebsht\u00eb defekti i m\u00ebnyr\u00ebs s\u00eb formulimit t\u00eb k\u00ebsaj dispozite, dhe t\u00eb arsyeve se p\u00ebrse vullneti i Qeveris\u00eb dhe i Kuvendit, ka ndryshuar n\u00eb rrug\u00eb e sip\u00ebr p\u00ebr miratim e k\u00ebsaj dispozite, evidentojm\u00eb se:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">N\u00eb nenin 3, parashikohen kuptimet e termave sipas ligjit nr. 32\/2021. N\u00eb pik\u00ebn 27, t\u00eb k\u00ebtij neni, jepet ky p\u00ebrkufizim:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">27.\u201cSistemi bonus-malus\u201d \u00ebsht\u00eb faktor p\u00ebr p\u00ebrcaktimin e nivelit t\u00eb primit t\u00eb sigurimit t\u00eb detyruesh\u00ebm motorik, ku primi i aplikuar \u00ebsht\u00eb i varur nga historiku i numrit t\u00eb d\u00ebmeve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb n\u00eb nenin 8, t\u00eb ligjit nr. 32\/2021, parashikohet m\u00ebnyra se si aplikohet ky sistem nga kompanit\u00eb e sigurimit. Konkretisht ky nen ka k\u00ebt\u00eb p\u00ebrmbajtje:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cNeni 8<\/span><br \/>\n<span style=\"color: #000000;\">Sistemi bonus-malus<\/span><br \/>\n<span style=\"color: #000000;\">1. Sistemi bonus-malus \u00ebsht\u00eb sistemi p\u00ebr p\u00ebrcaktimin e nivelit t\u00eb primit t\u00eb sigurimit t\u00eb detyruesh\u00ebm motorik, bazuar n\u00eb historikun e d\u00ebmeve t\u00eb t\u00eb siguruarit.<\/span><br \/>\n<span style=\"color: #000000;\">2. Sistemi bonus-malus \u00ebsht\u00eb nj\u00eb nga faktor\u00ebt e riskut, t\u00eb cilin shoq\u00ebrit\u00eb e sigurimit kan\u00eb t\u00eb drejt\u00eb ta zbatojn\u00eb n\u00eb tarifimin e sigurimit t\u00eb p\u00ebrgjegj\u00ebsis\u00eb s\u00eb t\u00eb siguruarit t\u00eb mjetit motorik, p\u00ebr d\u00ebmet e shkaktuara pal\u00ebve t\u00eb treta nga p\u00ebrdorimi i k\u00ebtij mjeti.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\">Shoq\u00ebria e sigurimit \u00ebsht\u00eb e detyruar t\u00eb v\u00ebr\u00eb n\u00eb dispozicion t\u00eb t\u00eb siguruarve certifikat\u00ebn e historikut t\u00eb d\u00ebmeve sipas formatit, metod\u00ebs, afateve kohore dhe p\u00ebrmbajtjes s\u00eb p\u00ebrcaktuar me rregulla t\u00eb miratuara nga Autoriteti\u201d.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Sipas k\u00ebtij formulimi, synohet q\u00eb \u00e7do person (i siguruari), do t\u00eb duhet t\u00eb paguaj\u00eb prim\u00ebn e sigurimit t\u00eb detyruesh\u00ebm, \u201cbazuar n\u00eb t\u00eb dh\u00ebnat q\u00eb faktojn\u00eb historikun e d\u00ebmeve t\u00eb shkaktuar prej t\u00eb siguruarit\u201d. Nj\u00eb qasje e till\u00eb \u00ebsht\u00eb e drejt\u00eb, pasi synon q\u00eb primi i sigurimit p\u00ebr secilin t\u00eb sigruar, t\u00eb p\u00ebrcaktohet n\u00eb var\u00ebsi t\u00eb:<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 m\u00ebnyr\u00ebs se si nj\u00eb i siguruar ka p\u00ebrdorur t\u00eb drejt\u00ebn p\u00ebr drejtimin e nj\u00eb automjeti;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 a \u00ebsht\u00eb nj\u00eb p\u00ebrdorues i rregullt i k\u00ebsaj t\u00eb drejte;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 sa aksidente ka kryer dhe cilat kan\u00eb qen\u00eb pasojat e tyre;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 a paraqet rrisk p\u00ebr shkakimin e aksidenteve, apo d\u00ebmeve s\u00ebrish, n\u00eb t\u00eb ardhmen etj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra, sjellja e nj\u00eb p\u00ebrdoruesi t\u00eb mjetit t\u00eb transportit, n\u00eb praktik\u00eb do t\u00eb b\u00ebj\u00eb t\u00eb mundur p\u00ebrcaktimin e nivelit t\u00eb primit, n\u00eb var\u00ebsi t\u00eb d\u00ebmeve t\u00eb shkaktuara nga p\u00ebrdoruesi i mjetit n\u00eb t\u00eb shkuar\u00ebn, t\u00eb dh\u00ebna k\u00ebto q\u00eb duhet t\u00eb reflektohen detyrimisht n\u00eb nj\u00eb regjist\u00ebr publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb rregullim i till\u00eb q\u00eb synon diferencimin e primit t\u00eb sigurimit n\u00eb proporcion me riskun q\u00eb paraqet nj\u00eb p\u00ebrdorues, p\u00ebrkundrejt tarifave uniforme dhe t\u00eb larta t\u00eb aplikuara deri m\u00eb tani, \u00ebsht\u00eb nj\u00eb risi shum\u00eb pozitive, dhe mir\u00ebpritet nga t\u00eb gjith\u00eb.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\">Nd\u00ebrmarrja e nism\u00ebs propozuese nga AMF, p\u00ebr p\u00ebrmir\u00ebsimin e situat\u00ebs ligjore n\u00eb k\u00ebt\u00eb drejtim, ka ardhur si pasoj\u00eb e problematikave n\u00eb praktik\u00eb. Konkretisht, n\u00eb relacionin dhe raportin e komisionit p\u00ebrgjegj\u00ebs citohet se:<\/span><br \/>\n<span style=\"color: #000000;\">\u201cProblematikat e evidentuara lidhur me sigurimin e detyruesh\u00ebm n\u00eb sektorin e transportit.<\/span><br \/>\n<span style=\"color: #000000;\">Gjat\u00eb zbatimit t\u00eb ligjit ekzistues jan\u00eb evidentuar k\u00ebto problematika kryesore:<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 Ndryshimi i shpesht\u00eb i primit t\u00eb sigurimit;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 Qarkullimi i nj\u00eb pjese t\u00eb mjeteve t\u00eb transportit pa pasur kontrat\u00ebn e sigurimit t\u00eb detyruesh\u00ebm;<\/span><br \/>\n<span style=\"color: #000000;\">\u2013 P\u00ebrcaktimi i primit t\u00eb sigurimit pa marr\u00eb n\u00eb konsidetat\u00eb historikun e drejtimit t\u00eb automjetit dhe d\u00ebmet e kryera, sipas sistemit bonus-malus;<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u2013 (\u2026)\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, \u00ebsht\u00eb e qart\u00eb se Kuvendi i Shqip\u00ebris\u00eb, ka synuar t\u00eb p\u00ebrmir\u00ebsoj\u00eb norm\u00ebn lidhur me sistemin e ri bonus-malus, sepse nd\u00ebr vite kjo \u00e7\u00ebshtje, pra p\u00ebrcaktimi i primit t\u00eb sigurimit pa marr\u00eb n\u00eb konsiderat\u00eb historikun e drejtimit t\u00eb mjetit dhe d\u00ebmet e shkaktuara, \u00ebsht\u00eb evidentuar si nd\u00ebr problematikat kryesore q\u00eb ka patur impakt direkt edhe n\u00eb mas\u00ebn e siguracionit t\u00eb paguar.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\">Edhe pse Kuvendi ka dashur t`i jap\u00eb zgjidhje k\u00ebsaj \u00e7\u00ebshtjeje, me miratimin e pik\u00ebs 2, t\u00eb nenit 8, e ka l\u00ebn\u00eb at\u00eb s\u00ebrish pa zgjidhje.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Kjo pik\u00eb konkretisht p\u00ebrcakton se:<\/span><br \/>\n<span style=\"color: #000000;\">\u201c2. Sistemi bonus-malus \u00ebsht\u00eb nj\u00eb nga faktor\u00ebt e riskut, t\u00eb cilin shoq\u00ebrit\u00eb e sigurimit kan\u00eb t\u00eb drejt\u00eb ta zbatojn\u00eb n\u00eb tarifimin e sigurimit t\u00eb p\u00ebrgjegj\u00ebsis\u00eb s\u00eb t\u00eb siguruarit t\u00eb mjetit motorik, p\u00ebr d\u00ebmet e shkaktuara pal\u00ebve t\u00eb treta nga p\u00ebrdorimi i k\u00ebtij mjeti.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 8, n\u00eb t\u00ebr\u00ebsin\u00eb e tij, por ve\u00e7an\u00ebrisht pika 2 e k\u00ebtij neni, p\u00ebrmes p\u00ebrdorimit t\u00eb togfjal\u00ebshit \u201cshoq\u00ebrit\u00eb e sigurimit kan\u00eb t\u00eb drejt\u00eb ta zbatojn\u00eb\u201d, nuk e b\u00ebn k\u00ebt\u00eb parashikim t\u00eb detyruesh\u00ebm e ta kthej\u00eb n\u00eb nj\u00eb rregull t\u00eb p\u00ebrgjithsh\u00ebm sistemin bonus-malus, por p\u00ebrkundrazi kjo u lihet n\u00eb dor\u00eb shoq\u00ebrive t\u00eb sigurimit q\u00eb sipas d\u00ebshir\u00ebs s\u00eb tyre mund ta p\u00ebrfshijn\u00eb sistemin bonus-malus n\u00eb p\u00ebrcaktimin e tarifave t\u00eb primit t\u00eb sigurimit t\u00eb detyruesh\u00ebm t\u00eb mjeteve t\u00eb transportit n\u00eb tregun e brendsh\u00ebm MTPL.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, shteti ka hequr dor\u00eb nga forca shtr\u00ebnguese e tij p\u00ebr ta b\u00ebr\u00eb t\u00eb detyruesh\u00ebm sistemin e ri bonus-malus, duke ngelur k\u00ebshtu n\u00eb t\u00eb drejt\u00ebn (d\u00ebshir\u00ebn), dhe jo n\u00eb detyrimin e shoq\u00ebrive t\u00eb sigurimit p\u00ebr aplikim.<\/span><\/p>\n<ol start=\"4\">\n<li><span style=\"color: #000000;\">Sipas asaj q\u00eb relatohet nga Komisioni i Ekonomis\u00eb dhe Financave n\u00eb Raportin e dat\u00ebs 11.03.2021, dhe referuar p\u00ebrmbajtjes s\u00eb nenit 8, t\u00eb ligjit t\u00eb miratuar nr. 32\/2021, rezulton se:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u201cShoq\u00ebria e sigurimit mund t\u00eb p\u00ebrfshij\u00eb sistemin bonus-malus n\u00eb p\u00ebrcaktimin e tarifave t\u00eb primeve t\u00eb sigurimeve t\u00eb detyrueshme p\u00ebr d\u00ebmet e shkaktuara pal\u00ebve t\u00eb treta nga p\u00ebrdorimi i mjetit motorik, me p\u00ebrjashtim t\u00eb polic\u00ebs kufitare dhe t\u00eb kartonit jeshil\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse shteti p\u00ebrmes procesit ligjb\u00ebr\u00ebs e ka trajtuar sistemin bonus-malus si nj\u00eb opsion q\u00eb edhe mund t\u00eb aplikohet, si dhe duke ju referuar tradit\u00ebs s\u00eb formimit t\u00eb nd\u00ebrgjegjes juridike p\u00ebr zbatimin e nj\u00eb dispozite opsionale t\u00eb ligjit, \u00ebsht\u00eb qart\u00ebsisht e kuptueshme q\u00eb ky sistem i ri rrezikon t\u00eb mos aplikohet n\u00eb praktik\u00eb.<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"color: #000000;\">Kjo situat\u00eb e till\u00eb ligjore, n\u00eb praktik\u00eb do t\u00eb sjell\u00eb situata paradoksale kur shoq\u00ebri t\u00eb ndryshme sigurimi, mund ta aplikojn\u00eb sistemin bonus- malus, e shoq\u00ebri t\u00eb tjera jo. Kjo padyshim krijon nj\u00eb situat\u00eb t\u00eb paqart\u00eb juridike tek qytetar\u00ebt n\u00eb t\u00ebr\u00ebsi, e p\u00ebr p\u00ebrdorues t\u00eb mjeteve motorrike, pasi n\u00eb \u00e7do moment kan\u00eb pik\u00ebpyetjen n\u00ebse ky sistem \u00ebsht\u00eb i aplikuesh\u00ebm ose jo, \u00e7ka do t\u00eb keqorientojn\u00eb edhe sjelljen e tyre n\u00eb vijim\u00ebsi.<\/span><\/li>\n<li><span style=\"color: #000000;\">Nga ana tjet\u00ebr, edhe n\u00ebse nj\u00eb shoq\u00ebri sigurimesh zgjedh ta aplikoj\u00eb k\u00ebt\u00eb risi t\u00eb ligjit, at\u00ebher\u00eb kjo do t\u00eb ndikoj\u00eb edhe n\u00eb \u00e7ekuilibrim t\u00eb tregut, pasi n\u00eb dukje, primi i sigurimit, do t\u00eb jet\u00eb i ndrysh\u00ebm n\u00eb kompani t\u00eb ndryshme. Nj\u00eb person me historik d\u00ebmesh n\u00eb drejtimin e mjetit, n\u00ebse do t\u00eb zgjedh\u00eb t\u00eb sigurohet n\u00eb nj\u00eb kompani q\u00eb nuk e aplikon k\u00ebt\u00eb sistem, do t\u00eb paguaj\u00eb \u00e7mimin minimal t\u00eb p\u00ebrcaktuar p\u00ebr sigurimin e detyruesh\u00ebm, nd\u00ebrkoh\u00eb q\u00eb n\u00ebse i drejtohet nj\u00eb kompanie tjet\u00ebr m\u00eb t\u00eb konsoliduar q\u00eb ka p\u00ebrmir\u00ebsuar cil\u00ebsin\u00eb e sh\u00ebrbimit t\u00eb sigurimeve t\u00eb detyrueshme kundrejt konsumator\u00ebve, ai do t\u00eb lidh\u00eb kontrat\u00ebn e sigurimit me nj\u00eb \u00e7mim m\u00eb t\u00eb lart\u00eb, p\u00ebr shkak t\u00eb historikut t\u00eb tij.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00eb praktik\u00eb, kjo situat\u00eb e \u00e7mimeve t\u00eb diferencuara t\u00eb ofruara nga kompani t\u00eb ndryshme p\u00ebr t\u00eb nj\u00ebjtin individ, \u00ebsht\u00eb e pashmangshme q\u00eb t\u00eb orientoj\u00eb edhe kompanit\u00eb m\u00eb t\u00eb konsoliduara q\u00eb t\u00eb t\u00ebrhiqen nga aplikimi i k\u00ebtij sistemi, me q\u00ebllim q\u00eb t\u00eb mos humbasin klientel\u00ebn e tyre, duke e b\u00ebr\u00eb sistemin e ri, t\u00eb paaplikuesh\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\">Jo vet\u00ebm kaq, por kjo situat\u00eb do t\u00eb shkaktoj\u00eb edhe nj\u00eb situat\u00eb konkurrence t\u00eb pandershme e konfliktuale n\u00eb terren midis agjent\u00ebve t\u00eb secil\u00ebs kompani, t\u00eb cil\u00ebt t\u00eb prirur p\u00ebr mbajtjen apo zgjerimin e fash\u00ebs s\u00eb klient\u00ebve, gjithmon\u00eb do t\u00eb tentojn\u00eb t\u00eb ofrojn\u00eb kontrata t\u00eb primit t\u00eb sigurimit t\u00eb detyruesh\u00ebm, p\u00ebrkundrejt \u00e7mimeve minimale, e duke l\u00ebn\u00eb t\u00eb paaplikuesh\u00ebm sistemin bonus-malus.<\/span><\/p>\n<p><span style=\"color: #000000;\">E gjith\u00eb kjo situat\u00eb, q\u00eb krijohet p\u00ebr shkak t\u00eb parashikimeve ligjore opsionale dhe jo detyruese, nuk do t\u00eb kontribuoj\u00eb n\u00eb rritjen e cil\u00ebsis\u00eb s\u00eb sh\u00ebrbimit n\u00eb tregun e sigurimeve, apo n\u00eb cil\u00ebsin\u00eb e siguris\u00eb n\u00eb transport n\u00eb t\u00ebr\u00ebsi, nd\u00ebrkoh\u00eb q\u00eb statistikat zyrtare reflektojn\u00eb qart\u00eb se nevojat e shoq\u00ebris\u00eb shqiptare dhe aktualiteti yn\u00eb i p\u00ebrbashk\u00ebt k\u00ebrkon detyrimisht shprehjen e vullnetit shtet\u00ebror dhe ushtrimin e forc\u00ebs shtr\u00ebnguese t\u00eb ligjit edhe p\u00ebr zgjidhje t\u00eb tilla.<\/span><\/p>\n<ol start=\"7\">\n<li><span ka qen\u00eb dhe mbetet nj\u00eb nga k\u00ebrkesat kryesore t\u00eb paraqitura n\u00eb rezolutat e Kuvendit p\u00ebr vler\u00ebsimin e veprimtaris\u00eb s\u00eb AMF-s\u00eb, s\u00ebrish \u00ebsht\u00eb po Kuvendi i Shqip\u00ebris\u00eb, q\u00eb e ka l\u00ebn\u00eb at\u00eb pa zgjidhje.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Ky vullnet i Kuvendit reflekton nj\u00eb marr\u00ebdh\u00ebnie t\u00eb pasinqert\u00eb me qytetar\u00ebt shqiptar\u00eb, t\u00eb cil\u00ebve po i ofrohet nj\u00eb \u201crisi\u201d e ligjit vet\u00ebm p\u00ebrmes nj\u00eb dispozite parazitare, deklarative, q\u00eb mbetet n\u00eb d\u00ebshir\u00ebn e kompanive t\u00eb sigurimit p\u00ebr t`u aplikuar, ose jo.<\/span><\/p>\n<ol start=\"8\">\n<li><span style=\"color: #000000;\">Kjo qasje jo objektive, jo konsistente, dhe jo realiste e Kuvendit p\u00ebrkundrejt k\u00ebrkesave dhe nevojave t\u00eb shoq\u00ebris\u00eb, konstatohet edhe n\u00eb nj\u00eb moment tjet\u00ebr procedurial, kur Kuvendi p\u00ebr t\u00eb mos l\u00ebn\u00eb asnj\u00eb gjurm\u00eb detyrimi p\u00ebr kompanit\u00eb e sigurimeve p\u00ebr aplikimin e k\u00ebtij sistemi t\u00eb ri, n\u00eb mbledhjen e Komisionit t\u00eb Ekonomis\u00eb dhe Financave, t\u00eb dat\u00ebs 11 mars 2021, ka b\u00ebr\u00eb nj\u00eb ndryshim n\u00eb draftin final q\u00eb do t`i propozohej p\u00ebr votim seanc\u00ebs plenare, duke ndryshuar nenin 7, t\u00eb projektligjit q\u00eb kishte paraqitur K\u00ebshilli i Ministrave, dhe duke hequr nga p\u00ebrmbajtja e k\u00ebtij neni pik\u00ebn 9, q\u00eb parashikonte shprehimisht se:<\/span><br \/>\n<span style=\"color: #000000;\">\u201cAutoriteti p\u00ebrcakton parimet e sistemit bonus-malus, kategorit\u00eb e mjeteve ku zbatohet, si dhe t\u00eb dh\u00ebnat e nevojshme p\u00ebr zbatimin e k\u00ebtij sistemi\u201d.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">Heqja e k\u00ebtij parashikimi i cili ishte nj\u00eb mekaniz\u00ebm shtes\u00eb p\u00ebr sakt\u00ebsimin e aplikimit t\u00eb sistemit bonus-malus, provon se, Kuvendi i Shqip\u00ebris\u00eb, edhe k\u00ebt\u00eb her\u00eb, nuk \u00ebsht\u00eb treguar transparent dhe objektiv n\u00eb marr\u00ebdh\u00ebnie me qytetar\u00ebt dhe p\u00ebrkundrejt interesave t\u00eb tyre , por me vendimmarrjen e tij ka anuar haptazi n\u00eb favor t\u00eb interesit t\u00eb kompanive t\u00eb sigurimit, \u00e7\u2019ka ka sjell\u00eb dhe reagim publik n\u00eb media t\u00eb aktor\u00ebve t\u00eb ndrysh\u00ebm .<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky favorizim \u00ebsht\u00eb b\u00ebr\u00eb duke hequr dhe \u00e7do parashikim q\u00eb mund t\u00eb materializonte me akte n\u00ebnligjore aplikimin e sistemit bonus-malus, dhe duke e kthyer t\u00ebr\u00ebsisht nenin 8 t\u00eb ligjit, n\u00eb nj\u00eb dispozit\u00eb parazite, q\u00eb vet\u00ebm e njeh nj\u00eb t\u00eb drejt\u00eb n\u00eb parim, por nuk delegon rregullimin e m\u00ebnyr\u00ebs se si do t\u00eb aplikohet e zbatohet kjo e drejt\u00eb, q\u00eb n\u00eb thelbin e saj, leht\u00ebson qytetar\u00ebt q\u00eb respektojn\u00eb rregullat e transportit rrugor, por nga ana tjet\u00ebr \u00ebsht\u00eb nj\u00eb mekaniz\u00ebm shtes\u00eb q\u00eb p\u00ebrmir\u00ebson sjelljen n\u00eb qarkullimin rrugor t\u00eb t\u00eb gjith\u00eb drejtuesve t\u00eb automjeteve apo n\u00eb fush\u00ebn e transportit n\u00eb t\u00ebr\u00ebsi.<\/span><\/p>\n<ol start=\"9\">\n<li><span style=\"color: #000000;\">Referuar koh\u00ebs q\u00eb ka marr\u00eb hartimi i k\u00ebtij projektligji, por dhe debatit publik q\u00eb Ministria e Financave, K\u00ebshilli i Ministrave dhe Kuvendi i Shqip\u00ebris\u00eb, duket se nuk kan\u00eb mundur t`i rezistojn\u00eb presionit t\u00eb kompanive t\u00eb sigurimit, duke p\u00ebrmbushur k\u00ebshtu s\u00ebrish nj\u00eb k\u00ebrkes\u00eb jo objektive t\u00eb kompanive t\u00eb sigurimit.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Referuar koh\u00ebs s\u00eb gjat\u00eb q\u00eb ka marr\u00eb hartimi i k\u00ebij projektligji, historikut t\u00eb ndryshimit t\u00eb drafteve t\u00eb projektligjit n\u00eb raport me p\u00ebrmbajtjen e ligjit e miratuar, del po kaq qart\u00eb n\u00eb drit\u00eb fakti se, lobimi kund\u00ebr sistemit bonus-malus, ja ka arritur q\u00ebllimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Edhe k\u00ebsaj here, Kuvendi i Shqip\u00ebris\u00eb, ka treguar p\u00ebr t\u00eb disat\u00ebn her\u00eb se nuk \u00ebsht\u00eb p\u00ebr t\u00eb p\u00ebrmbushur k\u00ebrkesat e shoq\u00ebris\u00eb shqiptare, por p\u00ebrball\u00eb interesave t\u00eb qytetar\u00ebve me ato t\u00eb biznesit, t\u00ebrhiqet dhe anon nga pakica, duke l\u00ebn\u00eb s\u00ebrish shtigje t\u00eb hapura, dhe kle\u00e7ka ligjore q\u00eb tregu i sigurimeve t\u00eb mos rregullohet sipas orientimit dhe forc\u00ebs shtr\u00ebnguese t\u00eb ligjit, standarteve nd\u00ebrkomb\u00ebtare, por sipas d\u00ebshir\u00ebs apo dakord\u00ebsis\u00eb t\u00eb p\u00ebrmban n\u00eb m\u00ebnyr\u00eb shteruese e t\u00eb qart\u00eb parashikimin n\u00ebse kjo qend\u00ebr ka ose jo t\u00eb drejt\u00eb t\u00eb mbledh\u00eb dhe t\u00eb krijoj\u00eb si informacion, historikun e aksidenteve apo d\u00ebmeve t\u00eb shkatuara nga nj\u00eb i siguruar, n\u00eb m\u00ebnyr\u00eb q\u00eb k\u00ebt\u00eb informacion zyrtar t`ia shp\u00ebrndaj\u00eb kompanive t\u00eb sigurimit p\u00ebr t\u00eb mund\u00ebsuar implementimin e sistemit bonus-malus.<\/span><\/li>\n<li><span style=\"color: #000000;\">N\u00eb mbledhjen e Komisionit t\u00eb Veprimtarive Prodhuese, kur \u00ebsht\u00eb disktuar p\u00ebrmbajtja e nenit 8 t\u00eb ligjit, deputet\u00ebt e k\u00ebtij komisioni kan\u00eb hezituar ta votojn\u00eb k\u00ebt\u00eb nen t\u00eb ligjit, pik\u00ebrisht nga mungesa e sinqeritetit dhe paqart\u00ebsia q\u00eb ofronte p\u00ebrmbajtja e k\u00ebsaj dispozite.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00ebse Kuvendi i Shqip\u00ebris\u00eb, d\u00ebshiron ta vendos\u00eb plot\u00ebsisht n\u00eb zbatim k\u00ebt\u00eb sistem t\u00eb ri (bonus \u2013malus) , i cili si\u00e7 referohet nga vet Kuvendi, n\u00eb vendet europiane ka dh\u00ebn\u00eb efekte n\u00eb uljen e numrit t\u00eb aksidenteve, mbrojtjen e jet\u00ebs s\u00eb qytetar\u00ebve dhe garantimin e nj\u00eb \u00e7mimi m\u00eb t\u00eb drejt\u00eb n\u00eb policat e sigurimit TPL, at\u00ebher\u00eb \u00ebsht\u00eb e nevojshme q\u00eb Kuvendi ta rishikoj\u00eb n\u00eb t\u00ebr\u00ebsi nenin 8, por ve\u00e7an\u00ebrisht p\u00ebrmbajtjen e pik\u00ebs 2, ku togfjal\u00ebshin \u201ct\u00eb cilin shoq\u00ebrit\u00eb e sigurimit kan\u00eb t\u00eb drejt\u00eb ta zbatojn\u00eb n\u00eb tarifimin e sigurimit t\u00eb p\u00ebrgjegj\u00ebsis\u00eb\u201d, duhet ta ndryshoj\u00eb duke parashikuar detyrimin e shoq\u00ebrive t\u00eb sigurimit q\u00eb ta zbatojn\u00eb n\u00eb tarifimin e sigurimit t\u00eb p\u00ebrgjegj\u00ebsis\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, mb\u00ebshtet qasjen q\u00eb, n\u00ebse ky sistem do t\u00eb aplikohet edhe n\u00eb Shqip\u00ebri, ashtu si dhe n\u00eb vendet europiane, do vendit dhe konstaton se neni 8 i k\u00ebtij ligji, nuk i jep zgjidhje p\u00ebrfundimtare problematikave t\u00eb konstatuara, dhe as p\u00ebrmbush objektivin e vet ligjv\u00ebn\u00ebsit p\u00ebrkundrejt impelemenimit t\u00eb sistemit bonus-malus n\u00eb sigurimin e detyruesh\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kuvendi i Shqip\u00ebris\u00eb, ka gabuar n\u00eb hartimin dhe miratimin e nenit 8, t\u00eb ligjit nr. 32\/2021, pasi nuk ka b\u00ebr\u00eb zgjedhjen e duhur p\u00ebr t\u00eb zbatuar apo konkretizuar si\u00e7 duhet qasjen p\u00ebrkundrejt fush\u00ebs s\u00eb sigurimit t\u00eb detyrush\u00ebm dhe p\u00ebrmir\u00ebsimit t\u00eb jet\u00ebs n\u00eb vend.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrve\u00e7 k\u00ebsaj, Kuvendi, p\u00ebrmes nenit 8 t\u00eb ligjit nr. 32\/2021, nuk ka p\u00ebrmbushur detyr\u00ebn dhe p\u00ebrgjegj\u00ebsin\u00eb e tij p\u00ebr t`iu p\u00ebrgjigjur me realiz\u00ebm dhe sa m\u00eb drejt, prioriteteve ose problemeve t\u00eb ndryshme q\u00eb ka shfaqur kjo fush\u00eb e jet\u00ebs shoq\u00ebrore n\u00eb vend.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nevoja p\u00ebr p\u00ebrmbushjen e objektivave social\u00eb t\u00eb shtetit shqiptar, dhe shfryt\u00ebzimi i \u00e7do mund\u00ebsie p\u00ebr p\u00ebrmir\u00ebsimin e legjislacionin t\u00eb brendsh\u00ebm me q\u00ebllim garantimin sa m\u00eb mir\u00eb t\u00eb jet\u00ebs dhe sh\u00ebndetit t\u00eb qytetar\u00ebve, jan\u00eb arsye objektive dhe argument i mjaftuesh\u00ebm q\u00eb Kuvendi i Shqip\u00ebris\u00eb ta rimarr\u00eb edhe nj\u00eb her\u00eb n\u00eb shqyrtim nenin 8 t\u00eb ligjit nr. 32\/2021, p\u00ebr ta p\u00ebrmir\u00ebsuar at\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e tij, n\u00eb funksion t\u00eb p\u00ebrmir\u00ebsimit t\u00eb cil\u00ebsis\u00eb edhe n\u00eb k\u00ebt\u00eb drejtim, duke garantuar p\u00ebrdorimin e detyruesh\u00ebm t\u00eb k\u00ebtij mekanizmi si p\u00ebr bonusin, ashtu dhe p\u00ebr malusin.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb \u00e7do rast, ligjet q\u00eb Kuvendi duhet t\u00eb miratoj\u00eb duhet q\u00eb jo vet\u00ebm t\u00eb mos bien ndesh me dispozitat kushtetuese dhe parimet themelore t\u00eb mbrojtura prej saj, por nga ana tjet\u00ebr Kuvendi ka p\u00ebrgjegj\u00ebsin\u00eb kryesore q\u00eb ta orientoj\u00eb dhe zhvilloj\u00eb jet\u00ebn shoq\u00ebrore n\u00eb vend, duke p\u00ebrmir\u00ebsuar kuadrin e brendsh\u00ebm ligjor dhe duke synuar p\u00ebrmbushjen e objektivave ekonomik\u00eb dhe social\u00eb q\u00eb vet\u00eb Kushtetuta mbron.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu, nisur nga fakti i mund\u00ebsis\u00eb q\u00eb Presidenti i Republik\u00ebs po i krijon Kuvendit t\u00eb Shqip\u00ebri\u00eb p\u00ebr rishikimin e k\u00ebtij ligji, \u00ebsht\u00eb momenti i p\u00ebrshtatsh\u00ebm q\u00eb ky i fundit, s\u00eb bashku me Qeverin\u00eb, p\u00ebrve\u00e7 nenit 8, t\u00eb rivler\u00ebsojn\u00eb edhe nj\u00eb her\u00eb \u00e7\u00ebshtjet e trajtuara n\u00eb nenet 19 dhe 25, t\u00eb ligjit nr. 32\/2021, sa i takon kufirit minimal t\u00eb p\u00ebrgjegj\u00ebsis\u00eb s\u00eb shoq\u00ebris\u00eb s\u00eb sigurimit dhe shum\u00ebs s\u00eb siguruar p\u00ebr vler\u00ebn e d\u00ebmit pasuror dhe jopasuror, vler\u00ebn e d\u00ebmit biologjik, vler\u00ebn e d\u00ebmit moral, dhe vler\u00ebn e d\u00ebmit ekzistencial.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pavar\u00ebsisht se ligji i ri duket se parashikon vlera n\u00eb rritje t\u00eb kufirit minimal t\u00eb
