Dekretit 11841<\/span><\/p>\n<p><span style=\"color: #000000;\">Tiran\u00eb, m\u00eb 20.11.2020<\/span><\/p>\n<p><span style=\"color: #000000;\">PRESIDENTI I REPUBLIK\u00cbS<\/span><\/p>\n<p><span style=\"color: #000000;\">ILIR META<\/span><\/p>\n<p><span style=\"color: #000000;\">ARSYET E KTHIMIT<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00cb LIGJIT NR. 133\/2020 \u2018P\u00cbR DISA SHTESA DHE NDRYSHIME N\u00cb LIGJIN NR. 108\/2014 \u2018P\u00cbR POLICIN\u00cb E SHTETIT\u2019, T\u00cb NDRYSHUAR\u2019<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>T\u00eb nderuar deputet\u00eb,<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kuvendi i Shqip\u00ebris\u00eb n\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs 29.10.2020, ka miratuar nd\u00ebr t\u00eb tjera ligjin nr. 133\/2020 \u2018P\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky ligj me shkres\u00ebn me nr. 2826 prot., dat\u00eb 03.11.2020 t\u00eb Kuvendit, i \u00ebsht\u00eb p\u00ebrcjell\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Projektligji \u00ebsht\u00eb shqyrtuar n\u00eb Komisionin p\u00ebr Sigurin\u00eb Komb\u00ebtare n\u00eb cil\u00ebsin\u00eb e komisionit p\u00ebrgjegj\u00ebs dhe n\u00eb Komisionin p\u00ebr \u00c7\u00ebshtjet Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut, n\u00eb cil\u00ebsin\u00eb e komisionit p\u00ebr dh\u00ebnie mendimi, dhe vjen si nism\u00eb propozuese e K\u00ebshillit t\u00eb Ministrave dhe deputetit Alket Hyseni.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sipas raporteve t\u00eb komisioneve p\u00ebrkat\u00ebse ky projektligj ka si q\u00ebllim kryesor t\u00eb krijoj\u00eb mund\u00ebsin\u00eb ligjore q\u00eb strukturat e Policis\u00eb s\u00eb Shtetit t\u00eb p\u00ebrdorin me efektivitet masa t\u00eb ve\u00e7anta, duke b\u00ebr\u00eb ndryshime n\u00eb nenet 84 dhe 131, t\u00eb ligjit nr.108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar, n\u00eb luft\u00ebn kund\u00ebr krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda si dhe krimeve n\u00eb fush\u00ebn financiare, nd\u00ebrkoh\u00eb q\u00eb nj\u00eb qasje e till\u00eb e posa\u00e7me p\u00ebr k\u00ebto vepra penale, nuk \u00ebsht\u00eb aspak e p\u00ebrcaktuar n\u00eb tekstin e ligjit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ajo q\u00eb bie n\u00eb sy, \u00ebsht\u00eb fakti se, referuar Raportit t\u00eb Komisionit p\u00ebr \u00c7\u00ebshtjet Ligjore, Administrat\u00ebn Puvlike dhe t\u00eb Drejtat e Njeriut, nisma e par\u00eb nga K\u00ebshilli i Ministrave \u00ebsht\u00eb depozituar n\u00eb Kuvend q\u00eb n\u00eb dat\u00ebn 6 shkurt 2020. Nd\u00ebrsa propozimi i deputetit Alket Hyseni e q\u00eb lidhet ekskluzivisht me shtimin e nj\u00eb paragrafi q\u00eb p\u00ebrcakton rolin e Policis\u00eb s\u00eb Shtetit n\u00eb procesin zgjedhor, \u00ebsht\u00eb depozituar vet\u00ebm n\u00eb 22 shtator 2020.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>E megjithat\u00eb, kjo nism\u00eb \u00ebsht\u00eb shqyrtuar p\u00ebrfundimisht nga Kuvendi (duke bashkuar propozimet) pik\u00ebrisht n\u00eb muajin tetor (pra mbi 8 muaj pas depozitimit t\u00eb nism\u00ebs nga K\u00ebshilli i Ministrave).<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Presidenti i Republik\u00ebs pasi vler\u00ebsoi p\u00ebrputhshm\u00ebrin\u00eb e ligjit nr. 133\/2020 \u2018P\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar\u2019, me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, konstaton se ligji nr. 133\/2020:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Shkel parimin e ndarjes dhe balancimit t\u00eb pushteteve, duke cenuar pavar\u00ebsin\u00eb kushtetuese t\u00eb Prokuroris\u00eb s\u00eb P\u00ebrgjithshme dhe Prokuroris\u00eb s\u00eb Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Bie ndesh me parime t\u00eb r\u00ebnd\u00ebsishme q\u00eb q\u00ebndrojn\u00eb n\u00eb themelet e shtetit t\u00eb s\u00eb drejt\u00ebs t\u00eb p\u00ebrcaktuara ng\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe n\u00eb Konvent\u00ebn Europiane p\u00ebr t\u00eb Drejtat e Njeriut, q\u00eb lidhen me grancit\u00eb p\u00ebr ruajtjen e privat\u00ebsis\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Rrezikon ta kthej\u00eb Policin\u00eb e Shtetit n\u00eb nj\u00eb organ q\u00eb gjurmon qytetar\u00ebt jasht\u00eb nj\u00eb procesi penal dhe kontrollit t\u00eb organeve t\u00eb drejt\u00ebsis\u00eb, dhe ta v\u00ebr\u00eb n\u00ebn presionin qeveritar gjat\u00eb fushat\u00ebs dhe procesit zgjedhor, n\u00ebn urdhrat e vullnetit politik, duke cenuar edhe pavar\u00ebsin\u00eb operacionale t\u00eb saj;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Shkakton trajtim t\u00eb pabarabart\u00eb dhe pasiguri p\u00ebr vendin e pun\u00ebs, p\u00ebr punonj\u00ebsit e Policis\u00eb s\u00eb Shtetit, duke sanksionuar l\u00ebvizjen e tyre n\u00eb pozicione t\u00eb tjera, edhe pa miratim paraprak, me pasoj\u00eb humbjen e p\u00ebrftimeve q\u00eb kan\u00eb prej statusit t\u00eb ve\u00e7ant\u00eb p\u00ebr shkak t\u00eb detyr\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr arsyet, q\u00eb do t\u00eb parashtrohen n\u00eb vijim, n\u00eb bindje t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs s\u00eb parashikuar n\u00eb pik\u00ebn 1 t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs ka vendosur q\u00eb ligji nr. 133\/2020 \u2018P\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar\u2019, i duhet kthyer Kuvendit p\u00ebr rishqyrtim, pasi shkel n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb nenet 7, 17, 116, 148, t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe nenin 8, t\u00eb Konvent\u00ebs Europiane p\u00ebr Drejtat e Njeriut.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ligji nr. 133\/2020, me parashikimin e b\u00ebr\u00eb n\u00eb nenin 1 dhe 8 t\u00eb tij, e kthen Policin\u00eb e Shtetit n\u00eb nj\u00eb organ informativo- gjurmues, jash\u00eb kontrollit procedural t\u00eb gjykat\u00ebs, n\u00eb kund\u00ebrshtim me misionin dhe funksionin q\u00eb duhet t\u00eb ket\u00eb Policia e Shtetit, dhe n\u00eb shkelje t\u00eb t\u00eb drejtave dhe lirive t\u00eb qytetar\u00ebve q\u00eb mund t\u00eb survejohen pa asnj\u00eb lloj kufizimi.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 1 i ligjit nr. 133\/2020, parashikon nj\u00eb shtes\u00eb n\u00eb dispozit\u00ebn e nenit 6, duke parashikuar se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00a0\u20181. N\u00eb nenin 6 pas pik\u00ebs 29 shtohet pika 30 me k\u00ebt\u00eb p\u00ebrmbajtje:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u201830. \u2018Veprimtari informative\u2019 \u00ebsht\u00eb \u00e7do veprim apo mas\u00eb e Policis\u00eb s\u00eb Shtetit, p\u00ebrfshir\u00eb informacionet e marra nga p\u00ebrdorimi i teknikave t\u00eb gjurmimit apo mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb t\u00eb komunikimeve joelektronike, dokumentimin e tyre sipas legjislacionit n\u00eb fuqi, n\u00eb kuad\u00ebr t\u00eb parandalimit t\u00eb kryerjes s\u00eb veprave penale, hetimit penal apo ruajtjes s\u00eb rendit e t\u00eb siguris\u00eb publike.\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Para trajtimit t\u00eb problematik\u00ebs q\u00eb mbart p\u00ebrmbajtja e k\u00ebsaj shtese, shoq\u00ebruar me ndryshimet e b\u00ebra n\u00eb nenin 131, t\u00eb ligjit baz\u00eb, duhet theksuar paraprakisht se, edhe p\u00ebr nga ana e teknik\u00ebs legjislative, nd\u00ebrhyrja e b\u00ebr\u00eb n\u00eb dispozit\u00ebn e nenit 6, \u00ebsht\u00eb e gabuar!<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo p\u00ebr arsye se, neni 6, p\u00ebrmban 32 pika tashm\u00eb dhe jo 29, ku t\u00eb mund t\u00eb shtohej pika 30 si\u00e7 \u00ebsht\u00eb b\u00ebr\u00eb me ligjin nr. 133\/2020. Pikat 30 dhe 31, jan\u00eb shtuar me ligjin amendues nr. 85\/2017. Kurse pika 32, \u00ebsht\u00eb shtuar me ndryshimet e b\u00ebra me ligjin nr. 112\/2018.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Pra, shtesa e propozuar me ligjin nr. 133\/2020, nuk mund t\u00eb b\u00ebhet n\u00eb pik\u00ebn 30, q\u00eb aktualisht rregullon kuptimin e \u2018v\u00ebrtetimit t\u00eb besueshm\u00ebris\u00eb\u2019, por n\u00ebse duhej b\u00ebr\u00eb nj\u00eb shtes\u00eb n\u00eb dispozit\u00ebn e p\u00ebrkufizimeve, ajo duhej shtuar pas pik\u00ebs 32, apo p\u00ebrkat\u00ebsisht para apo pas pik\u00ebs 30, me num\u00ebr me fraksion, sipas rregullave t\u00eb teknik\u00ebs legjislative.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky fakt \u00ebsht\u00eb tregues se Komisionet p\u00ebrgjegj\u00ebse e m\u00eb pas edhe deputet\u00ebt q\u00eb e kan\u00eb votuar n\u00eb seanc\u00eb plenare, kan\u00eb punuar mbi verisonin e pakonsoliduar t\u00eb k\u00ebtij ligji. Kjo tregon munges\u00eb t\u00eb theksuar p\u00ebrgjegjshm\u00ebrie n\u00eb procesin ligjb\u00ebr\u00ebs, pasi kjo lloj nd\u00ebrhyrje e gabuar, shkakton munges\u00eb sigurie mbi norm\u00ebn juridike t\u00eb zbatueshme. re:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018Neni 131<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Masa t\u00eb ve\u00e7anta<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>Gjat\u00eb veprimtaris\u00eb informative-gjurmuese, me q\u00ebllim parandalimin e veprave penale, zbulimin e veprave penale, identifikimin apo lokalizimin e autor\u00ebve t\u00eb tyre, Policia e Shtetit merr, grumbullon, p\u00ebrpunon dhe dokumenton informacion dhe t\u00eb dh\u00ebna n\u00ebp\u00ebrmjet:<br \/>\n<\/em><\/span><span style=\"color: #000000;\"><em>a) mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb zanore t\u00eb komunikimeve joelektronike t\u00eb personave t\u00eb dyshuar n\u00eb ambiente publike apo t\u00eb hapura p\u00ebr publikun me autorizim t\u00eb prokurorit;<br \/>\n<\/em><\/span><span style=\"color: #000000;\"><em>b) mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb vizuale t\u00eb personave t\u00eb dyshuar n\u00eb vende publike apo t\u00eb hapura p\u00ebr publikun;<br \/>\n<\/em><\/span><span style=\"color: #000000;\"><em>c) gjurmimit ose mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb t\u00eb personave t\u00eb dyshuar n\u00ebp\u00ebrmjet #000000;\"><em>Kushtet, rregullat, procedurat dhe afatet q\u00eb zbatohen p\u00ebr p\u00ebrdorimin e masave t\u00eb ve\u00e7anta t\u00eb parashikuara n\u00eb pik\u00ebn 1 t\u00eb k\u00ebtij neni, p\u00ebrcaktohen me udh\u00ebzim t\u00eb p\u00ebrbashk\u00ebt t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr rendin dhe sigurin\u00eb publike, t\u00eb Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm dhe t\u00eb drejtuesit t\u00eb Prokuroris\u00eb s\u00eb Posa\u00e7me Kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar.<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>Ministri p\u00ebrgjegj\u00ebs p\u00ebr rendin dhe sigurin\u00eb publike, Prokurori i P\u00ebrgjithsh\u00ebm dhe drejtuesi i Prokuroris\u00eb s\u00eb Posa\u00e7me Kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar mund t\u00eb kontrollojn\u00eb n\u00eb \u00e7do koh\u00eb zbatimin e rregullave dhe procedurave t\u00eb parashikuara n\u00eb udh\u00ebzimin e p\u00ebrbashk\u00ebt t\u00eb p\u00ebrcaktuar n\u00eb pik\u00ebn 2 t\u00eb k\u00ebtij neni.\u2019. <\/em><\/span><em style=\"color: #000000;\">P\u00ebrmbajtja e k\u00ebtyre dy nd\u00ebrhyrjeve n\u00eb ligjin p\u00ebr Policin\u00eb e Shtetit, \u00ebsht\u00eb tep\u00ebr shqet\u00ebsuese, p\u00ebr arsyet q\u00eb p\u00ebrmbledhtazi po i sqarojm\u00eb n\u00eb vijim. <\/em><em style=\"color: #000000;\">Shqet\u00ebsuese \u00ebsht\u00eb fakti q\u00eb referuar dispozit\u00ebs s\u00eb re, dhe konkretisht pik\u00ebs 1, shkronja \u2018c\u2019, me k\u00ebt\u00eb p\u00ebrmbajtje:<br \/>\n<\/em><em style=\"color: #000000;\">c) gjurmimit ose mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb t\u00eb personave t\u00eb dyshuar n\u00ebp\u00ebrmjet p\u00ebrdorimit t\u00eb mjeteve, pajisjeve apo teknikave t\u00eb ve\u00e7anta p\u00ebr identifikimin ose lokalizimin e vendndodhjes s\u00eb tyre.\u2019,<\/em><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>Policia e Shtetit p\u00ebr k\u00ebt\u00eb lloj m\u00ebnyre gjurmimi dhe mbik\u00ebqyrje, nuk k\u00ebrkon dhe as ka detyrim t\u00eb pajiset me autorizimin e Prokurorit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Pra qart\u00ebsisht k\u00ebtu jemi p\u00ebrpara nj\u00eb procesi mbikqyr\u00ebs parandalues dhe jo procedural penal, por jan\u00eb ulur garancit\u00eb p\u00ebr kontrollin e veprimtaris\u00eb Policore nga Prokurori, q\u00eb garantonin t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Duke e krahasuar k\u00ebt\u00eb ndryshim me dispozit\u00ebn e m\u00ebparshme, rezulton se k\u00ebto garanci jan\u00eb hequr p\u00ebr k\u00ebt\u00eb m\u00ebnyr\u00eb mbik\u00ebqyrje dhe krijohet hap\u00ebsir\u00eb p\u00ebr keqp\u00ebrdorim t\u00eb mbik\u00ebqyrjes policore t\u00eb \u00e7do qytetari, pa ndonj\u00eb shkak t\u00eb ligjsh\u00ebm dyshimi, dhe t\u00eb pa verifikuar ligj\u00ebrisht nga organi i akuz\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb praktik\u00eb, kjo do t\u00eb thot\u00eb q\u00eb Policia mund t\u00eb mbik\u00ebqyr\u00eb k\u00ebdo dhe pa kufizim, duke e justifkuar tashm\u00eb m\u00eb ligj.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebto nd\u00ebrhyrje e kthejn\u00eb Policin\u00eb e Shtetit m\u00eb shum\u00eb n\u00eb nj\u00eb organ informativo-gjurmues, n\u00eb devijanc\u00eb t\u00eb misionit ligjor t\u00eb Policis\u00eb s\u00eb Shtetit, p\u00ebr ruajtjen e rendit e t\u00eb siguris\u00eb publike, garantimin e zbatimit t\u00eb ligjit, n\u00eb p\u00ebrputhje me Kushtetut\u00ebn dhe aktet nd\u00ebrkomb\u00ebtare, duke respektuar t\u00eb drejtat dhe lirit\u00eb e njeriut[1].<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo lloj kompetence, kur b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb institucion t\u00eb administrat\u00ebs shtet\u00ebrore n\u00eb var\u00ebsi administrative t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr \u00e7\u00ebshtjet e rendit dhe t\u00eb siguris\u00eb publike, kthehet n\u00eb nj\u00eb rrezik p\u00ebr t\u00eb drejtat dhe lirit\u00eb e njeriut.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Riformulimi i nenit 131 t\u00eb ligjit baz\u00eb, sa i takon veprimtaris\u00eb informative, shkon p\u00ebrtej detyr\u00ebs q\u00eb ka Policia e Shtetit p\u00ebr parandalimin, zbulimin dhe hetimin e veprave penale dhe autor\u00ebve t\u00eb dyshuar t\u00eb kryerjes s\u00eb tyre.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Me dispozit\u00ebn e riformuluar, synohet q\u00eb,<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>mbik\u00ebqyrja e ve\u00e7ant\u00eb vizuale e personave t\u00eb dyshuar n\u00eb vende publike apo t\u00eb hapura p\u00ebr publikun; dhe<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>gjurmimi ose mbik\u00ebqyrja e ve\u00e7ant\u00eb t\u00eb personave t\u00eb dyshuar n\u00ebp\u00ebrmjet p\u00ebrdorimit t\u00eb mjeteve, pajisjeve apo teknikave t\u00eb ve\u00e7anta p\u00ebr identifikimin ose lokalizimin e vendndodhjes s\u00eb tyre;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>t\u00eb kryhen pa nj\u00eb autorizim prokurori, pa nj\u00eb filt\u00ebr kontrolli paraprak, dhe nga m\u00ebnyra se si jan\u00eb formuluar, nuk grantojn\u00eb as nj\u00eb mekaniz\u00ebm kontrolli p\u00ebr p\u00ebrdorimin e t\u00eb dh\u00ebnave t\u00eb dala nga mbik\u00ebqyrja apo gjurmimi m\u00eb pas.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018Gjurmimi apo mbikqyrja e ve\u00e7ant\u00eb\u2019 e personave t\u00eb dyshuar si autor\u00eb t\u00eb nj\u00eb veprimtarie kriminale jan\u00eb veprime p\u00ebrb\u00ebr\u00ebse apo forma t\u00eb caktuara t\u00eb shfaqjes s\u00eb konceptit \u2018p\u00ebrgjim\u2019, ndaj dhe kontrolli apo leja nga autoritete gjyq\u00ebsore apo t\u00eb ushtrimit t\u00eb ndjekjes penale (Prokurori) duhet t\u00eb mos evitohet. Kjo sepse p\u00ebrgjat\u00eb k\u00ebsaj veprimtarie policore krijohen, ruhen, administrohen edhe t\u00eb dh\u00ebna sensitive q\u00eb konstatohen nga kjo veprimtari dhe veprimi policor pa kontroll, do t\u00eb krijonte shteg p\u00ebr abuzim me k\u00ebt\u00eb t\u00eb drejt\u00eb, me mund\u00ebsi reale q\u00eb t\u00eb dh\u00ebnat e administruara t\u00eb shp\u00ebrndahen dhe p\u00ebrdoren edhe p\u00ebr shantazh p\u00ebr arsye nga m\u00eb t\u00eb ndryshme.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo lloj veprimtarie q\u00eb nuk kalon n\u00eb kontrollin ex ante dhe ex post t\u00eb prokurorit apo gjykat\u00ebs, bie ndesh me vet\u00eb dispozitat e ligjit q\u00eb po ndryshohet, i cili n\u00eb nenin 17, pika 1, shkronja \u2018c)\u2019, sanksionon qart\u00eb se, detyrat e Policis\u00eb s\u00eb Shtetit jan\u00eb:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>c) parandalon, zbulon dhe heton, n\u00eb p\u00ebrputhje me legjislacionin penal dhe procedural penal, veprat penale dhe autor\u00ebt e dyshuar t\u00eb kryerjes s\u00eb tyre;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Legjislacioni procedural penal, ka rregulla, q\u00eb nga regjistrimi i nj\u00eb personi si \u2018i dyshuar\u2019, deri n\u00eb m\u00ebnyr\u00ebn se si jepet autorizimi p\u00ebr p\u00ebrgjimin (p\u00ebrfshir\u00eb mbik\u00ebqyrjen vizuale), n\u00eb var\u00ebsi t\u00eb llojit t\u00eb vepr\u00ebs penale q\u00eb dyshohet se \u00ebsht\u00eb konsumuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Jo vet\u00ebm se vet\u00eb ligji nr. 108\/2020, sipas dipozit\u00ebs s\u00eb sip\u00ebrcituar k\u00ebrkon q\u00eb \u00e7do lloj veprimtarie mbik\u00ebqyr\u00ebse apo gjurmuese, t\u00eb kryhet n\u00eb p\u00ebrputhje me parashikimet e ligjit procedural penal, por edhe vet\u00eb Kodi i Procedur\u00ebs Penale, n\u00eb Seksionin IV, k\u00ebrkon q\u00eb\u00a0 p\u00ebrgjimi i komunikimeve t\u00eb nj\u00eb personi ose t\u00eb nj\u00eb numri telefoni me telefon, faks, kompjuter ose me mjete t\u00eb tjera t\u00eb \u00e7do lloji, p\u00ebrgjimi i fsheht\u00eb me mjete teknike i bisedave n\u00eb vende private, p\u00ebrgjimi me audio dhe video n\u00eb vende private dhe regjistrimi i numrave t\u00eb telefonit, hyr\u00ebs dhe dal\u00ebs, lejohen vet\u00ebm me k\u00ebrkes\u00eb t\u00eb prokurorit, kur e autorizon gjykata (nenet 221 dhe 222 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale).<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Paragrafi 2, i nenit 221 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale, p\u00ebrcakton se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018regjistrimi i fsheht\u00eb fotografik, filmik ose me video i personave n\u00eb vende publike dhe p\u00ebrdorimi i pajisjeve gjurmuese t\u00eb vendndodhjes lejohen vet\u00ebm kur procedohet p\u00ebr vepra t\u00eb kryera me dashje, p\u00ebr t\u00eb cilat parashikohet d\u00ebnim me burgim jo m\u00eb pak, n\u00eb maksimum, se tre vjet.\u2019<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nd\u00ebrsa neni 222, pika 6, p\u00ebrcakton se s\u00ebrish se duhet vendim gjykate p\u00ebr t\u00eb realizuar p\u00ebrgjimin e fsheht\u00eb, fotografik ose me video, ose p\u00ebrgjimin e bisedave n\u00eb vende private[2].<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebrkundrejt k\u00ebtyre k\u00ebrkesave procedurale, ligji nr. 133\/2020, me parashikimet e b\u00ebra n\u00eb nenin 131 t\u00eb riformuluar, tashm\u00eb lejon si mbik\u00ebqyrjen e ve\u00e7ant\u00eb vizuale (ku mund t\u00eb p\u00ebrfshihet sipas rastit edhe p\u00ebrgjimi\/mbik\u00ebqyrja fotografike ose me video), edhe gjurmimin dhe mbik\u00ebqyrjen e ve\u00e7ant\u00eb p\u00ebrmes mjeteve, pajisjeve apo teknikave t\u00eb ve\u00e7anta p\u00ebr identifikimin ose lokalizimin e vendodhjes, jo sipas k\u00ebrkesave t\u00eb Kodit t\u00eb Procedur\u00ebs Penale dhe pa vendim gjykate.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky ligj, tashm\u00eb parashikon q\u00eb pa asnj\u00eb filt\u00ebr kontrolli gjyq\u00ebsor dhe pa veprime paraprake t\u00eb prokurorit (q\u00eb minimalisht duhet t\u00eb jet\u00eb ai q\u00eb regjistron emrin e personit q\u00eb i atribuohet vepra penale, sipas p\u00ebrcaktimit t\u00eb nenit 287[3] t\u00eb Kodit t\u00eb Procedur\u00ebs Penale dhe m\u00eb pas t\u00eb autorizoj\u00eb veprimet hetimore q\u00eb duhen kryer), por edhe n\u00ebn kamuflimin e justifikimit se b\u00ebhet fjal\u00eb p\u00ebr konceptin e mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb zanore t\u00eb komunikimeve jo-elektronike, shkel intimitetin e nj\u00eb personi, si n\u00eb ambient t\u00eb hapur, por edhe t\u00eb mbyllur privat (pasi nuk e p\u00ebrjashton shprehimisht).<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr m\u00eb tep\u00ebr, kur ende sot nuk kemi nj\u00eb parashikim t\u00eb qart\u00eb ligjor dhe shterues p\u00ebr p\u00ebrkufizimin e \u2018ambientit publik\u2019, situata e p\u00ebrdorimit t\u00eb nd\u00ebrhyrjeve ligjore p\u00ebr leht\u00ebsimin jasht\u00eb procedural t\u00eb survejimit t\u00eb jet\u00ebs private, n\u00eb praktik\u00eb kthehet n\u00eb nj\u00eb situat\u00eb alarmante dhe tep\u00ebr shqet\u00ebsuese, n\u00eb cenim t\u00eb t\u00eb drejtave dhe lirive themelore t\u00eb njeriut t\u00eb mbrojtura nga Kushtetuta dhe KEDNJ.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nj\u00eb p\u00ebrkufizim i till\u00eb do t\u00eb garantonte q\u00eb p\u00ebrtej k\u00ebtij p\u00ebrkufizimi, \u00e7do ambient tjet\u00ebr do t\u00eb konsiderohet privat dhe duhet t\u00eb jet\u00eb e pacenueshme privat\u00ebsia n\u00eb k\u00ebto ambiente, me p\u00ebrjashtim t\u00eb rasteve kur respektohet procedura e sanksionuar n\u00eb Kodin e Procedur\u00ebs Penale, me vendim t\u00eb gjykat\u00ebs!<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Metoda nd\u00ebrhyr\u00ebse t\u00eb tilla, pa miratim paraprak t\u00eb gjykat\u00ebs, apo pa autorizim paraprak t\u00eb prokurorit n\u00eb rastin e mbik\u00ebqyrjes\/gjurmimit parandalues, b\u00ebn q\u00eb tashm\u00eb nj\u00eb efektiv policie, n\u00ebp\u00ebrmjet nj\u00eb pajisjeje p\u00ebrgjimi si mikrofon p\u00ebr d\u00ebgjim, aprat fotografik, apo kamera, ose me nj\u00eb pajisje regjistrimi me vete ose v\u00ebn\u00eb nj\u00eb personi q\u00eb bashk\u00ebpunon, t\u00eb mbledh\u00eb informacion dhe t\u00eb dh\u00ebna p\u00ebr k\u00ebdo, pa asnj\u00eb kufizim. Dhe ajo q\u00eb \u00ebsht\u00eb m\u00eb sakndaloze akoma, t\u00eb mund t`i p\u00ebrdor\u00eb ato!<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky parashikim shkel n\u00eb m\u00ebnyr\u00ebn m\u00eb flagrante t\u00eb mundshme:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nenin 17, t\u00eb Kushtetut\u00ebs, q\u00eb sanksionon se, kufizime t\u00eb t\u00eb drejtave dhe lirive t\u00eb parashikuara n\u00eb k\u00ebt\u00eb Kushtetut\u00eb mund t\u00eb vendosen vet\u00ebm me ligj p\u00ebr nj\u00eb interes publik ose p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb t\u00eb tjer\u00ebve. K\u00ebto kufizime nuk mund t\u00eb cenojn\u00eb thelbin e lirive dhe t\u00eb t\u00eb drejtave dhe n\u00eb asnj\u00eb rast nuk mund t\u00eb tejkalojn\u00eb kufizimet e parashikuara n\u00eb Konvent\u00ebn Europiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nenin 8, t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, q\u00eb sanksionon se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018E drejta p\u00ebr respektimin e jet\u00ebs private dhe familjare<\/em><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><em>\u00c7dokush ka t\u00eb drejt\u00ebn e respektimit t\u00eb jet\u00ebs s\u00eb tij private dhe familjare, banes\u00ebs dhe korrespondenc\u00ebs s\u00eb tij.<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\"><em>Autoriteti publik nuk mund t\u00eb nd\u00ebrhyj\u00eb n\u00eb ushtrimin e k\u00ebsaj t\u00eb drejte, p\u00ebrve\u00e7se n\u00eb shkall\u00ebn e parashikuar nga ligji dhe kur \u00ebsht\u00eb e nevojshme n\u00eb nj\u00eb shoq\u00ebri demokratike, n\u00eb interes t\u00eb siguris\u00eb publike, p\u00ebr mbrojtjen e rendit publik, sh\u00ebndetit ose moralit ose p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive t\u00eb t\u00eb tjer\u00ebve.\u2019<\/em><\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><em>Bie ndesh me parashikimet e Kodit t\u00eb Procedur\u00ebs Penale, nj\u00eb ligj i miratuar me shumic\u00eb t\u00eb cil\u00ebsuar, duke b\u00ebr\u00eb q\u00eb t\u00eb shkelet dhe hierarkia e akteve e p\u00ebrcaktuar n\u00eb nenin 116, t\u00eb Kushtetut\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebto parashikime q\u00eb i japin Policis\u00eb s\u00eb Shtetit nj\u00eb rol n\u00eb shtremb\u00ebrim t\u00eb misionit dhe detyrave q\u00eb duhet t\u00eb ket\u00eb, duke e nxjerr\u00eb veprimtarin\u00eb e saj nga detyrimi p\u00ebr respektimin e procedur\u00ebs, p\u00ebrve\u00e7se cenojn\u00eb jet\u00ebn personale t\u00eb kujtdo q\u00eb nga nes\u00ebr mund t\u00eb b\u00ebhet objekt \u2018p\u00ebrndjekje\u2019 nga kushdo efektiv i thjesht\u00eb i Policis\u00eb, b\u00ebn q\u00eb qytetar\u00ebt t\u00eb zhvishen t\u00ebr\u00ebsisht nga disponueshm\u00ebria e mjeteve juridike q\u00eb u mund\u00ebson atyre t\u00eb sfidojn\u00eb ligj\u00ebrisht ligjshm\u00ebrin\u00eb e veprimeve t\u00eb kryera p\u00ebr veprimtarin\u00eb informativo- gjurmuese t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00ebse vet\u00eb ligji nr. 9157, dat\u00eb 4.12.2003 \u2018P\u00ebr p\u00ebrgjimin e komunikimeve elektronike\u2019, i ndryshuar, dhe Kodi i Procedur\u00ebs Penale njohin mjete ligjore q\u00eb garantojn\u00eb t\u00eb drejt\u00ebn p\u00ebr informim dhe mjetet procedurale t\u00eb ankimit, ligji nr. 133\/2020, b\u00ebn q\u00eb kund\u00ebr \u00e7do lloj veprimi arbitrar t\u00eb mbik\u00ebqyrjes e survejimit, t\u00eb mos ken\u00eb qytetar\u00ebt asnj\u00eb rrug\u00eb ankimi. Pasi kjo veprimtari kryhet t\u00ebr\u00ebsisht jasht\u00eb rregullave procedurale.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje kaq sensitive, \u00ebsht\u00eb shprehur qart\u00eb dhe Gjykata Europiane e t\u00eb Drejtave t\u00eb Njeriut, q\u00eb ka v\u00ebn\u00eb theksin n\u00eb domosdoshm\u00ebrin\u00eb e kontrollit gjyq\u00ebsor, qoft\u00eb ex ante, apo ex post, n\u00eb \u00e7\u00ebshtjet Szabo dhe Vissy kund\u00ebr Hungaris\u00eb[4], apo n\u00eb \u00e7\u00ebshtjen Zakharov kund\u00ebr Rusis\u00eb[5].<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Edhe n\u00eb rastet kur organeve ligjzbatueses u njihet e drejta t\u00eb p\u00ebrdorin mjetet e mbik\u00ebqyrjes s\u00eb ve\u00e7ant\u00eb, ligji duhet t\u00eb p\u00ebrcaktoj\u00eb standardet minimale q\u00eb garantojn\u00eb shmangien e abuzimeve, duke filluar q\u00eb nga lloji i veprave penale p\u00ebr t\u00eb cilat mund t\u00eb kryhet mbik\u00ebqyrja e gjurmimi, statusi q\u00eb duhet t\u00eb ket\u00eb subjekti q\u00eb do t`i n\u00ebnshtrohet mbik\u00ebqyrjes a gjurmimit, kufizimet kohore p\u00ebr k\u00ebt\u00eb veprimtari, e deri te procedura se si duhet trajtuar informacioni i marr\u00eb nga mbik\u00ebqyrja a gjurmimi, deri n\u00eb asgj\u00ebsimin e sigurit\u00eb t\u00eb tij. Ky p\u00ebrcaktim duhet b\u00ebr\u00eb drejtp\u00ebrdrejt\u00eb nga ligji dhe nuk mund t\u00eb lihet n\u00eb nivel udh\u00ebzimi, qoft\u00eb ai i p\u00ebrbashk\u00ebt me Pokurorin e P\u00ebrgjithsh\u00ebm dhe Drejtuesin e Prokuroris\u00eb s\u00eb Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>2.8 Kjo lloj veprimtarie gjurmuese q\u00eb synon t\u00eb jepet si veprimtari e kryer pa asnj\u00eb filt\u00ebr kontrolli Policis\u00eb s\u00eb Shtetit, \u00ebsht\u00eb nj\u00eb veprimtari q\u00eb mund t\u00eb kryhet vet\u00ebm p\u00ebr q\u00ebllime madhore t\u00eb siguris\u00eb komb\u00ebtare dhe nga strukturat informatore q\u00eb ka shteti shqiptar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Edhe vet\u00eb Kodi i Procedur\u00ebs Penale, n\u00eb lejimin e p\u00ebrgjimit dhe t\u00eb gjitha formave t\u00eb tij (p\u00ebrshir\u00eb mbik\u00ebqyrjen dhe gjurmimin), b\u00ebn nj\u00eb kategorizim t\u00eb llojit t\u00eb veprave penale p\u00ebr t\u00eb cilat lejohet, n\u00eb var\u00ebsi t\u00eb rrezikshm\u00ebris\u00eb shoq\u00ebrore q\u00eb ato paraqesin.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nd\u00ebrsa tani, p\u00ebrmes ligjit nr. 133\/2020, nuk mund t\u00eb shnd\u00ebrrohet Policia e Shtetit n\u00eb organin q\u00eb mbik\u00ebyqr k\u00ebdo, kurdo, dhe p\u00ebr \u00e7far\u00ebdo lloj arsyeje.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Veprimtaria informative- gjurmuese, q\u00eb p\u00ebrfshin p\u00ebrgjimin (apo mbik\u00ebqyrjen e ve\u00e7ant\u00eb zanore e vizuale, si\u00e7 shprehet neni 131 i ligjit nr. 133\/2020), mbetet gjithmon\u00eb nj\u00eb \u00e7\u00ebshtje shum\u00eb delikate, p\u00ebr sa koh\u00eb q\u00eb konsiston n\u00eb marrjen dhe fiksimin e nj\u00eb aktiviteti jet\u00ebsor t\u00eb shtetasve, pa dijenin\u00eb e tyre. P\u00ebr pasoj\u00eb, mund\u00ebsia p\u00ebr t\u00eb ceduar gjat\u00eb realizimit t\u00eb k\u00ebsaj veprimtarie \u00ebsht\u00eb e madhe, sado q\u00eb kjo veprimtari nga ana tjet\u00ebr p\u00ebrb\u00ebn nj\u00eb mjet efikas qoft\u00eb n\u00eb drejtim t\u00eb mbikqyrjes, por dhe parandalimit t\u00eb aktiviteteve t\u00eb paligjshme, apo p\u00ebr t\u00eb provuar n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb drejtp\u00ebrdrejt\u00eb nj\u00eb aktivitetit kriminal dhe d\u00ebnimin e autor\u00ebve.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Por kurrsesi nj\u00eb veprimtari e till\u00eb nuk mund t\u00eb lihet jasht\u00eb kontrollit t\u00eb gjykat\u00ebs (apo prokurorit p\u00ebr veprimtarin\u00eb parnadaluese), si i vetmi autoritet ligjor q\u00eb ka mund\u00ebsin\u00eb t\u00eb vler\u00ebsoj\u00eb nevoj\u00ebn p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive t\u00eb njeriut, n\u00eb raport me rrezikun potencial q\u00eb mund t\u00eb vij\u00eb p\u00ebr sigurin\u00eb komb\u00ebtare apo publike.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 2 i ligjit cenon nenin 7 dhe 148 t\u00eb Kushtetut\u00ebs, ku parashikohen parimet e ndarjes dhe balancimit t\u00eb pushteteve, si dhe t\u00eb pavar\u00ebsis\u00eb s\u00eb prokuror\u00ebve.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Neni 7 i Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqiup\u00ebris\u00eb parashikon, se sistemi i qeverisjes n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb bazohet n\u00eb ndarjen dhe balancimin nd\u00ebrmjet pushteteve ligjv\u00ebn\u00ebs, ekzekutiv dhe gjyq\u00ebsor.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Gjykata Kushtetuese, n\u00eb jurisprudenc\u00ebn e saj, duke iu referuar nenit 7 t\u00eb Kushtetut\u00ebs q\u00eb parashikon parimin e ndarjes s\u00eb pushteteve, ka theksuar se ky parim, n\u00eb demokraci, si form\u00eb e qeverisjes, synon kryesisht t\u00eb m\u00ebnjanoj\u00eb rrezikun e p\u00ebrqendrimit t\u00eb pushtetit n\u00eb duart e nj\u00eb organi apo t\u00eb personave t\u00eb caktuar, gj\u00eb q\u00eb praktikisht mbart me vete rrezikun e shp\u00ebrdorimit t\u00eb tij.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb baz\u00eb t\u00eb k\u00ebtij parimi, tri pushtetet qendrore (legjislativi, ekzekutivi dhe gjyq\u00ebsori) duhet t\u00eb ushtrohen jo vet\u00ebm n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, por edhe n\u00eb m\u00ebnyr\u00eb t\u00eb balancuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo gj\u00eb arrihet n\u00ebp\u00ebrmjet zgjidhjeve kushtetuese q\u00eb garantojn\u00eb kontroll t\u00eb nd\u00ebrsjell\u00eb midis pushteteve, pa cenuar dhe pa nd\u00ebrhyr\u00eb n\u00eb kompetencat e nj\u00ebri-tjetrit. Q\u00ebllimi i nj\u00eb koncepti t\u00eb till\u00eb kushtetues siguron q\u00eb t\u00eb parandaloj\u00eb \u00e7do deg\u00eb t\u00eb qeverisjes p\u00ebr t\u00eb ushtruar nj\u00eb pushtet t\u00eb pakufizuar.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nd\u00ebrsa angazhimi i Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm dhe Drejtuesit t\u00eb Prokuroris\u00eb s\u00eb Posa\u00e7me (apo p\u00ebrfaq\u00ebsueseve t\u00eb tyre) n\u00eb Komitetin Komb\u00ebtar t\u00eb Politikave p\u00ebr p\u00ebr Parandalimin dhe Luft\u00ebn kund\u00ebr Krimit t\u00eb Organizuar, komitet i cili kryesohet nga Ministria e Brendshme, krijon premisa p\u00ebr ndikim t\u00eb pap\u00ebrshtatsh\u00ebm nga ekzekutivi n\u00eb ushtrimin e profesionit t\u00eb pavarur t\u00eb tyre apo edhe premisa p\u00ebr presion t\u00eb fsheht\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo \u00ebsht\u00eb tep\u00ebr e d\u00ebmshme po t\u00eb kemi n\u00eb konsiderat\u00eb q\u00eb Prokuroria e Posa\u00e7me (SPAK) ka n\u00eb kompetenc\u00eb l\u00ebndor\u00eb hetimin dhe ndjekjen penale t\u00eb zyrtar\u00ebve t\u00eb nivelit t\u00eb lart\u00eb, p\u00ebrfshi k\u00ebtu edhe p\u00ebrfaq\u00ebsuesit e ekzekutivit n\u00eb k\u00ebt\u00eb Komitet Koordinues.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb nenin 148, pika 2 t\u00eb Kushtetut\u00ebs parashikohet pavar\u00ebsia e organit t\u00eb prokuroris\u00eb. Sipas k\u00ebsaj dispozite, \u2018Prokuroria \u00ebsht\u00eb organ i pavarur q\u00eb garanton mbar\u00ebvajtjen, kontrollin e veprimeve t\u00eb saj dhe respekton pavar\u00ebsin\u00eb e brendshme t\u00eb prokuror\u00ebve p\u00ebr hetimin dhe ndjekjen penale, sipas ligjit\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb pik\u00ebn 3 t\u00eb po k\u00ebsaj dispozite parashikohet se, \u2018Prokuroria \u00ebsht\u00eb organizuar dhe funksionon pran\u00eb sistemit gjyq\u00ebsor\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Edhe pse koordinimi dhe bashk\u00ebpunimi midis institucioneve \u00ebsht\u00eb i nevojsh\u00ebm, p\u00ebrfshirja e p\u00ebrfaq\u00ebsuesve t\u00eb Prokuroris\u00eb s\u00eb P\u00ebrgjithshme dhe Prokuroris\u00eb s\u00eb Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar sipas nenit 2 t\u00eb ligjit,\u00a0 si pjes\u00eb e Komitetit Komb\u00ebtar t\u00eb Politikave p\u00ebr p\u00ebr Parandalimin dhe Luft\u00ebn kund\u00ebr Krimit t\u00eb Organizuar q\u00eb krijohet dhe funksionon pran\u00eb ministrit, \u00ebsht\u00eb shkelje e k\u00ebtyre parashikimeve.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo struktur\u00eb \u00ebsht\u00eb pjes\u00eb e ekzekutivit dhe ka n\u00eb p\u00ebrb\u00ebrje po funksionar\u00eb t\u00eb ekzekutivit si ministrin e Drejt\u00ebsis\u00eb, ministrin e Financave dhe Ekonomis\u00eb, q\u00eb em\u00ebrohen dhe shkarkohen direkt nga Kryeministri dhe jan\u00eb subjekt i veprimtaris\u00eb s\u00eb vet\u00eb SPAK, apo dhe p\u00ebrfaq\u00ebsues t\u00eb Drejtoris\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u00c7do rregullim i ri ligjor \u00ebsht\u00eb vler\u00ebsuar nga Gjykata Kushtetuese se nuk \u00ebsht\u00eb i mjaftuesh\u00ebm n\u00ebse nuk garanton shmangien e ndikimeve q\u00eb mund t\u00eb ushtroj\u00eb pushteti ekzekutiv n\u00eb \u00e7\u00ebshtje q\u00eb lidhen me dh\u00ebnien e drejt\u00ebsis\u00eb nga gjykata.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebrcaktimi i kompetencave p\u00ebrtej standardeve kushtetuese do t\u00eb krijonte raporte t\u00eb pabalancuara nd\u00ebrmjet funksioneve e, p\u00ebr rrjedhoj\u00eb, edhe nd\u00ebrmjet pushteteve ku b\u00ebn pjes\u00eb secili prej tyre.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Prokuroria e P\u00ebrgjithshme dhe Prokuroria e Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar jan\u00eb organe kushtetuese t\u00eb pavarura. N\u00eb k\u00ebt\u00eb kontekst, edhe pika 5 e nenit 2, t\u00eb ligjit, cenon direkt Kushtetut\u00ebn, kur ngarkon Komitetin (pjes\u00eb e s\u00eb cilit parashikohet t\u00eb jen\u00eb dhe p\u00ebrfaq\u00ebsues t\u00eb k\u00ebtyre dy organeve) t\u00eb raportoj\u00eb t\u00eb pakt\u00ebn nj\u00eb her\u00eb n\u00eb tre muaj dhe t`i paraqes\u00eb raport periodik K\u00ebshillit t\u00eb Ministrave, apo t`i n\u00ebnshtrohet rregullave q\u00eb propozon ministri i Brendsh\u00ebm. Ky parashikim cenon r\u00ebnd\u00eb pavar\u00ebsin\u00eb e tyre dhe besueshm\u00ebrin\u00eb qoft\u00eb n\u00eb pamje t\u00eb par\u00eb.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Komiteti Komb\u00ebtar i Politikave p\u00ebr Parandalimin dhe Luft\u00ebn Kund\u00ebr Krimit t\u00eb Organizuar, n\u00eb var\u00ebsi t\u00eb ekzekutivit, ka detyrimin t\u00eb hartoj\u00eb sipas k\u00ebtij ligji, strategjit\u00eb dhe planin e masave p\u00ebr prandalimin e krimit t\u00eb organizuar. Pra, ky Komitet, synohet q\u00eb direkt t\u00eb ndikoj\u00eb dhe orientoj\u00eb luft\u00ebn kund\u00ebr krimit t\u00eb organizuar dhe korrupsionit, p\u00ebr luftimin e s\u00eb cil\u00ebs, Prokuroria e Posa\u00e7me (SPAK), duhet t\u00eb jet\u00eb e pavarur. P\u00ebr m\u00eb tep\u00ebr, m\u00eb pas duhet edhe t\u00eb raportoj\u00eb, periodikisht pran\u00eb K\u00ebshillit t\u00eb Ministrave.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nj\u00eb nd\u00ebrhyrje e till\u00eb, \u00ebsht\u00eb ndikim thelb\u00ebsor n\u00eb pavar\u00ebsin\u00eb e k\u00ebtij organi p\u00ebr t\u00eb ushtruar kompetencat e tij kushtetuese dhe ligjore.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb nenin 3 t\u00eb ligjit nr. 133\/2020, parashikohet t\u00eb shtohet nj\u00eb paragraf n\u00eb pik\u00ebn 1, t\u00eb nenit 17, t\u00eb ligjit nr. 108\/2014, q\u00eb rendit detyrat e Policis\u00eb s\u00eb Shtetit. Shtesa e parashikuar rendit edhe nj\u00eb detyr\u00eb t\u00eb re, duke p\u00ebrcaktuar se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018j) zbaton detyrat n\u00eb sh\u00ebrbim t\u00eb administrimit t\u00eb qet\u00eb dhe t\u00eb rregullt t\u00eb proceseve zgjedhore ose t\u00eb referendumeve, bashk\u00ebpunon me administrat\u00ebn zgjedhore dhe raporton p\u00ebr veprimtarin\u00eb e strukturave t\u00eb policis\u00eb n\u00eb zgjedhje ose n\u00eb referendume, sipas rregullave t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj, n\u00eb Kodin Zgjedhor dhe n\u00eb aktet n\u00ebnligjore t\u00eb miratuara nga Komisioni Qendror i Zgjedhjeve.\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo shtes\u00eb vjen si propozim i deputetit t\u00eb mazhoranc\u00ebs, Alket Hyseni, dhe n\u00eb realitet do t\u00eb krijonte nj\u00eb p\u00ebrplajse dhe paqart\u00ebsi se cili do t\u00eb ishte angazhimi konkret i Policis\u00eb s\u00eb Shtetit gjat\u00eb zhvillimit t\u00eb proceseve zgjedhore dhe cilat jan\u00eb m\u00ebnyrat dhe mjetet me t\u00eb cilat ky organ p\u00ebmbush detyrat e tij.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo paqart\u00ebsi vjen p\u00ebr shkak se kjo dispozit\u00eb p\u00ebrmes k\u00ebtij formulimi \u2018sipas rregullave t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj\u2019, referon direkt n\u00eb detyrimin p\u00ebr zbatim t\u00eb p\u00ebrcaktimeve t\u00eb ligjit nr. 108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar, p\u00ebrgjat\u00eb proceseve zgjedhore.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Pra Policia e Shtetit do ket\u00eb dy m\u00ebnyra m\u00ebnyra se si ajo t\u00eb veproj\u00eb p\u00ebrgjat\u00eb nj\u00eb procesi zgjedhor: &#8211; edhe sipas ligjit t\u00eb saj funksional nr. 108\/2014 \u2018P\u00ebr Policin\u00eb e Shtetit\u2019, t\u00eb ndryshuar, ku funksionon p\u00ebrmes urdh\u00ebresave t\u00eb brendshme q\u00eb ndjekin hierarkin\u00eb administrative brenda strukturave t\u00eb Policis\u00eb s\u00eb Shtetit; dhe<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>m\u00ebnyra tjet\u00ebr, sipas rregullave t\u00eb Kodit Zgjedhor dhe akteve n\u00ebnligjore t\u00eb miratuara nga Komisioni Qendror i Zgjedhjeve.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Pik\u00ebrisht kjo paqart\u00ebsi, krijon mund\u00ebsin\u00eb q\u00eb Policia e Shtetit t\u00eb aktivizohet n\u00eb procesin zgjedhor edhe p\u00ebrtej k\u00ebrkes\u00ebs objektive t\u00eb administrat\u00ebs zgjedhore dhe vler\u00ebsimit q\u00eb ajo i b\u00ebn situat\u00ebs n\u00eb terren.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo paqart\u00ebsi e veprimtaris\u00eb s\u00eb Policis\u00eb s\u00eb Shtetit p\u00ebrgjat\u00eb proceseve zgjedhore, e lidhur edhe me kompetenc\u00ebn tjet\u00ebr shtes\u00eb q\u00eb i jepet asaj p\u00ebrmes k\u00ebtij ligji p\u00ebr t\u00eb gjurmuar dhe mbik\u00ebqyrur \u00e7dok\u00ebnd e jasht\u00eb kontrollit gjyq\u00ebsor, krijon shteg q\u00eb n\u00eb praktik\u00eb, edhe p\u00ebrgjat\u00eb procesit zgjedhor, Policia e Shtetit mund t\u00eb keqp\u00ebrdoret p\u00ebr t\u00eb survejuar kund\u00ebrshtar\u00ebt politik t\u00eb forc\u00ebs qeveris\u00ebse dhe intimiduar qytetar\u00ebt apo mb\u00ebshtet\u00ebsit e tyre.\u00a0\u00a0<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nj\u00eb parashikim i till\u00eb n\u00eb k\u00ebt\u00eb ligj, synon t\u00eb cenoj\u00eb parimet baz\u00eb mbi t\u00eb cilat duhet t\u00eb veproj\u00eb Policia e Shtetit, si parimi i pavar\u00ebsis\u00eb operacionale dhe paanshm\u00ebris\u00eb politike[6].<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebsisoj, n\u00eb zbatim t\u00eb k\u00ebtyre parimeve, Policia e Shtetit e ka p\u00ebr detyr\u00eb t\u00eb mbroj\u00eb jet\u00ebn, sh\u00ebndetin, pron\u00ebn publike dhe private, t\u00eb ruaj\u00eb rendin dhe sigurin\u00eb publike, n\u00eb p\u00ebrditshm\u00ebrin\u00eb e saj, pavar\u00ebsisht procesve q\u00eb gjejn\u00eb zhvillim n\u00eb jet\u00ebn shoq\u00ebrore e politike n\u00eb vend.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebr rolin e Policis\u00eb s\u00eb Shtetit n\u00eb procesin zgjedhor n\u00eb ve\u00e7anti, u kodifikuan ndryshimet e nevojshme n\u00eb Kodin Zgjedhor t\u00eb dakord\u00ebsura nga K\u00ebshilli Politik n\u00eb 30 qershor 2020.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo marr\u00ebveshje e kodifikuar kaloi p\u00ebrmes procedur\u00ebs parlamentare n\u00eb Kuvendin e Shqip\u00ebris\u00eb pa asnj\u00eb ndryshim, i cili n\u00eb dat\u00ebn 23 korrik 2020, miratoi ligjin nr.101\/2020 \u2018P\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 10 019, dat\u00eb 29.12.2008 \u2018Kodi Zgjedhor i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u2019, i ndryshuar\u2019.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>P\u00ebrmes k\u00ebtij ligji, n\u00eb Kodin Zgjedhor, n\u00eb nenin 3 q\u00eb rendit \u2018Parimet e p\u00ebrgjithshme\u2019, u shtua parashikimi se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018Policia e Shtetit i ushtron detyrat e veta n\u00eb sh\u00ebrbim t\u00eb zgjedhjeve n\u00eb paanshm\u00ebri t\u00eb plot\u00eb ndaj subjekteve zgjedhore. Veprimtaria e saj zhvillohet sipas rregullave t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj dhe n\u00eb aktet n\u00ebnligjore t\u00eb miratuara nga KQZ-ja.\u2019<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Po ashtu, n\u00eb Kodin Zgjedhor (rikujtojm\u00eb q\u00eb \u00ebsht\u00eb nj\u00eb ligj i miratuar me shumic\u00eb t\u00eb cil\u00ebsuar), u parashikua n\u00eb nenin 79, t\u00eb riformuluar se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018[&#8230;]5. Kjo p\u00ebr arsye se:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>N\u00eb nenin 19, ndryshimet e b\u00ebra synojn\u00eb q\u00eb struktura dhe organika e policis\u00eb n\u00eb nivel qendror dhe vendor, si dhe strukturat e ve\u00e7anta, t\u00eb miratohen nga ministri, me propozimin e Drejtorit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Struktura dhe organika e policis\u00eb n\u00eb nivel vendor dhe i strukturave t\u00eb ve\u00e7anta sipas ligjit n\u00eb fuqi miratohen nga Drejtori i P\u00ebrgjithsh\u00ebm i Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky ndryshim n\u00eb m\u00ebnyr\u00ebn e miratimit t\u00eb strukturave q\u00eb n\u00eb thelb jan\u00eb operacionale, nga ministri i Brendsh\u00ebm, \u00ebsht\u00eb nj\u00eb p\u00ebrpjekje m\u00eb shum\u00eb q\u00eb deformon struktur\u00ebn unike dhe t\u00eb centralizuar t\u00eb Policis\u00eb s\u00eb Shtetit, duke b\u00ebr\u00eb q\u00eb indirekt t\u00eb kaloj\u00eb var\u00ebsia, ve\u00e7an\u00ebrisht ajo operacionale, n\u00ebn mbikqyrjen dhe vullnetin e autoritetit politik t\u00eb ministrit t\u00eb Brendsh\u00ebm.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky parashikim bie ndesh me vet\u00eb p\u00ebrcaktimet q\u00eb ka ligji baz\u00eb nr. 108\/2014, q\u00eb n\u00eb nenin 7, p\u00ebrcakton rolin e Ministrit n\u00eb raport me Policin\u00eb e Shtetit, si autoriteti q\u00eb vet\u00ebm harton dhe mbik\u00ebqyr zbatimin e politikave t\u00eb veprimtaris\u00eb s\u00eb Policis\u00eb s\u00eb Shtetit, me q\u00ebllim garantimin e rendit e t\u00eb siguris\u00eb publike; apo p\u00ebrcakton drejtimet strategjike dhe objektivat e Policis\u00eb s\u00eb Shtetit. Nd\u00ebrkoh\u00eb q\u00eb kjo dispozit\u00eb p\u00ebrcakton qart\u00eb n\u00eb pik\u00ebn 3, se: Ministri nuk nd\u00ebrhyn n\u00eb pavar\u00ebsin\u00eb operacionale t\u00eb sh\u00ebrbimit t\u00eb policis\u00eb dhe nuk p\u00ebrfshihet n\u00eb drejtimin operacional t\u00eb saj.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nd\u00ebrsa Drejtori i P\u00ebrgjithsh\u00ebm i Policis\u00eb s\u00eb Shtetit, q\u00eb \u00ebsht\u00eb me ligj autoriteti m\u00eb i lart\u00eb ekzekutiv, administrativ e operacional i policis\u00eb[7], dhe ka p\u00ebr detyr\u00eb sipas nenit 9, pika 2, shkronja \u2018b)\u2019, e ligjit nr. 108\/2014, t\u00eb \u2018menaxhoj\u00eb burimet njer\u00ebzore\u2019, nuk mundet t\u00eb miratoj\u00eb struktur\u00ebn dhe organik\u00ebn!<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ky ndryshim, q\u00eb \u00ebsht\u00eb dhe n\u00eb mosp\u00ebrputhje me vet\u00eb dispozitat e ligjit nr. 108\/2014, e q\u00eb cenon p\u00ebr pasoj\u00eb edhe parimin e siguris\u00eb juridike q\u00eb imponon qart\u00ebsin\u00eb e dispozitave dhe rregullave t\u00eb zbatueshme, synon nga ana tjet\u00ebr dob\u00ebsimin e rolit t\u00eb Drejtorit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb Policis\u00eb s\u00eb Shtetit dhe forcimin e rolit t\u00eb ministrit t\u00eb Brendsh\u00ebm n\u00eb veprimtarin\u00eb e pavarur dhe t\u00eb paanshme operacionale t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Ndryshimi i m\u00ebsip\u00ebrm, shoq\u00ebruar me shtimin e nenit 45\/1 n\u00eb ligjin nr. 108\/2014, q\u00eb mund\u00ebson transferimin e punonj\u00ebsit t\u00eb policis\u00eb n\u00eb struktura t\u00eb tjera shtet\u00ebrore, e b\u00ebn edhe m\u00eb t\u00eb dob\u00ebt dhe t\u00eb pasigurt punonj\u00ebsin e Policis\u00eb s\u00eb Shtetit p\u00ebrball\u00eb presionit t\u00eb mundsh\u00ebm politik.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kjo p\u00ebr arsye se, referuar pik\u00ebs 3, t\u00eb nenit 45\/1 q\u00eb shtohet, p\u00ebrcaktohet se punonj\u00ebsi mund t\u00eb transferohet kur \u2018kjo k\u00ebrkohet ose miratohet nga autoritetet zyrtare p\u00ebrgjegj\u00ebse, n\u00eb p\u00ebrputhje me kriteret e parashikuara p\u00ebr \u00e7do funksion.\u2019<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Lidh\u00ebza \u2018ose\u2019 n\u00eb k\u00ebt\u00eb parashikim, do t\u00eb thot\u00eb q\u00eb n\u00eb zbatimin e k\u00ebsaj dispozite t\u00eb re, transferimi i nj\u00eb punonj\u00ebsi t\u00eb Policis\u00eb mund t\u00eb kryhet pa miratim t\u00eb tij, vet\u00ebm me vendimmarrjen e zyrtarit p\u00ebrgjegj\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Nj\u00eb parashikim i till\u00eb, minon t\u00ebr\u00ebsisht garancit\u00eb q\u00eb synonte t`i jepte ligji nr. 108\/2014, kur u miratua, punonj\u00ebsve t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Akoma m\u00eb i r\u00ebnd\u00eb, \u00ebsht\u00eb parashikimi i pik\u00ebs 4, t\u00eb k\u00ebsaj dispozite, q\u00eb me transferimin e punonj\u00ebsit t\u00eb Policis\u00eb, edhe pa miratimin e tij, ai nuk do t\u00eb g\u00ebzoj\u00eb m\u00eb as t\u00eb drejtat q\u00eb i lindin nga statusi i ve\u00e7ant\u00eb i punonj\u00ebsit t\u00eb Policis\u00eb s\u00eb Shtetit.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Esht\u00eb momenti t\u00eb sjellim n\u00eb v\u00ebmendjen tuaj, t\u00eb publikut e ve\u00e7an\u00ebrisht t\u00eb forcave t\u00eb Policis\u00eb s\u00eb Shtetit, se statusi i punonj\u00ebsit t\u00eb Policis\u00eb s\u00eb Shtetit, lidhet posa\u00e7\u00ebrisht me m\u00ebnyr\u00ebn e trajtimit t\u00eb personelit dhe p\u00ebrfitimeve q\u00eb vet\u00eb ligji ua njeh k\u00ebsaj kategorie, p\u00ebrfshir\u00eb, por pa u kufizuar n\u00eb:<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Koh\u00ebn e pun\u00ebs dhe t\u00eb pushimit;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kujdesin p\u00ebr grat\u00eb shtatz\u00ebna;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Lejen e lindjes;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Lejen pa t\u00eb drejt\u00eb page;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Trajtimin financiar gjat\u00eb q\u00ebndrimit n\u00eb pun\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>T\u00eb drejt\u00ebn p\u00ebr sigurim sh\u00ebndet\u00ebsor t\u00eb ve\u00e7ant\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>T\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitim kredie me interesa t\u00eb but\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Kompensimin p\u00ebr strehim;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Sigurimin e jet\u00ebs;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Mbrojtjen e ve\u00e7ant\u00eb;<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Trajtimin financiar pas nd\u00ebrprerjes s\u00eb marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs; apo<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>Vjet\u00ebrsin\u00eb p\u00ebr trajtim financiar pas nd\u00ebrprerjes s\u00eb marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>T\u00eb gjitha k\u00ebto t\u00eb drejta, nj\u00eb punonj\u00ebs q\u00eb transferohet, pa k\u00ebrkes\u00eb dhe miratimin e tij, nuk mund t`i g\u00ebzoj\u00eb m\u00eb, duke b\u00ebr\u00eb q\u00eb punonj\u00ebsit e Policis\u00eb s\u00eb Shtetit t\u00eb jen\u00eb leht\u00ebsisht t\u00eb l\u00ebvizsh\u00ebm nga detyra, e duke cenuar k\u00ebsisoj pavar\u00ebsin\u00eb dhe paan\u00ebsin\u00eb e tyre n\u00eb ushtrimin e detyrave funksionale.<\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>K\u00ebto ndryshime t\u00eb marra s\u00eb bashku, q\u00eb nga m\u00ebnyra e miratimit t\u00eb struktur\u00ebs, deri te mund\u00ebsia e transferimit, si dhe parashikimi p\u00ebr detyrimin e posa\u00e7\u00ebm q\u00eb shtohet mbi zbatimin e urdhrave p\u00ebrgjat\u00eb proceseve zgjedhore, ve\u00e7an\u00ebrisht kur kjo nd\u00ebrhyrje nuk \u00ebsht\u00eb k\u00ebrkuar dhe as vler\u00ebsuar si e nevojshme nga K\u00ebshilli Politik, p\u00ebrb\u00ebjn\u00eb rrezik t\u00eb shtuar p\u00ebr keqp\u00ebrdorimin e forcave t\u00eb Policis\u00eb s\u00eb Shtetit p\u00ebr q\u00ebllime politike.
