N\u00eb fakt, k\u00ebt\u00eb t\u00eb drejt\u00eb koalicionet parazgjedhore nuk e kan\u00eb patur n\u00eb Kodin Zgjedhor q\u00eb nga viti 2003, sepse sipas Kodit Zgjedhor kandidat\u00ebt mund t\u00eb propozoheshin vet\u00ebm nga zgjedh\u00ebsit dhe partit\u00eb politike. N\u00eb k\u00ebt\u00eb kuptim, ndryshimi i nj\u00eb ansh\u00ebm kushtetutes nuk ka b\u00ebr\u00eb asgj\u00eb tjet\u00ebr vet\u00ebm sa ka rregulluar nj\u00eb situat\u00eb faktike dhe q\u00eb ka ekzistuar si e till\u00eb q\u00eb nga viti 2003!<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb arsye dispozitat e Kodit Zgjedhor n\u00eb fuqi lidhur me rregullat e koalicioneve parazgjedhore dhe formul\u00ebs s\u00eb shp\u00ebrndarjes s\u00eb mandateve jan\u00eb t\u00ebr\u00ebsisht n\u00eb p\u00ebrputhje me Kushtetut\u00ebn n\u00eb fuqi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana tjet\u00ebr, ndryshimet e m\u00ebsip\u00ebrme kushtetutese nuk kan\u00eb hequr nga Kushtetuta koalicionin si nj\u00eb e drejt\u00eb dhe form\u00eb organizimi politik, p\u00ebrfshir\u00eb n\u00eb konkurimin zgjedhor. Neni 96 i Kushtetut\u00ebs parashikon q\u00eb pas zgjedhjeve, koalicionet t\u00eb propozojn\u00eb mandatarin p\u00ebr Kryeminist\u00ebr. Neni 68, i ndryshuar m\u00eb 30 korrik 2020, apo ndonj\u00eb dispozit\u00eb tjet\u00ebr kushtetuese, gjithashtu nuk p\u00ebrcaktojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb shprehur ndonj\u00eb lloj t\u00eb posa\u00e7\u00ebm koalicioni q\u00eb duhet zbatuar n\u00eb Kodin Zgjedhor. Kushtetuta nuk e ka p\u00ebrcaktuar kurr\u00eb di\u00e7ka t\u00eb till\u00eb, sepse kjo ka qen\u00eb gjithmon\u00eb e rregulluar nga Kodi Zgjedhor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndryshimet e Kodit Zgjedhor t\u00eb miratuara me konsensus m\u00eb 30 qershor 2020 nga K\u00ebshilli Politik mbi baz\u00ebn e marr\u00ebveshjes s\u00eb 5 qershorit 2020 dhe t\u00eb miratuara nga Kuvendi m\u00eb 23 korrik 2020 jan\u00eb tashm\u00eb n\u00eb fuqi. K\u00ebto ndryshime konfirmuan modelin e koalicionit zgjedhor si\u00e7 ka qen\u00eb miratuar me konsensus n\u00eb vitin 2003. <\/span><\/p>\n<p><span style=\"color: #000000;\">Asnj\u00eb raport i OSBE\/ODIHR-it apo vler\u00ebsim i p\u00ebrbashk\u00ebt i Kodit Zgjedhor i kryer nga OSBE\/ODIHR dhe Komisioni i Venecias pas adoptimit t\u00eb modelit n\u00eb fuqi t\u00eb koalicioneve nuk e ka gjetur at\u00eb model dhe dispozitat p\u00ebrkat\u00ebse n\u00eb kund\u00ebrshtim me Angazhimet e OSBE-s\u00eb dhe standartet e K\u00ebshillit t\u00eb Evrop\u00ebs p\u00ebr zgjedhje demokratike.<\/span><\/p>\n<p><span style=\"color: #000000;\"> P\u00ebr rrjedhoj\u00eb reformat konsensuale t\u00eb viteve 2004, 2008, 2012 dhe ajo e p\u00ebrmbyllur m\u00eb 23 korrik kan\u00eb konfirmuar me konsensus modelin e koalicionit t\u00eb vitit 2003. Ky model ka funksionuar pa asnj\u00eb ng\u00ebr\u00e7 me sistemin zgjedhor q\u00eb ka qen\u00eb n\u00eb fuqi nga viti 1998 dri n\u00eb vitin 2008, si dhe me at\u00eb q\u00eb ka qen\u00eb n\u00eb fuqi nga 2008 e deri m\u00eb sot.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kodi Zgjedhor p\u00ebrcakton qartazi se koalicioni zgjedhor i partive politike \u00ebsht\u00eb ai me \u201clist\u00eb t\u00eb p\u00ebrb\u00ebr\u00eb\u201d, i cili i jep t\u00eb drejt\u00ebn e propozimit t\u00eb kandidat\u00ebv\u00eb secil\u00ebs parti an\u00ebtare t\u00eb koalicionit, dhe jo koalicionit. P\u00ebr rrjedhoj\u00eb, modeli n\u00eb fuqi dhe dispozitat p\u00ebrkat\u00ebse p\u00ebr regjistrimin e koalicionit, shfaqjen n\u00eb flet\u00ebn e votimit, marrjen e votave, p\u00ebrllogaritjen e rezultatit dhe shp\u00ebrndarjen e mandatit, t\u00eb gjitha k\u00ebto pjes\u00eb t\u00eb sistemit zgjedhor n\u00eb kuptimin e ngusht\u00eb t\u00eb fjal\u00ebs, jan\u00eb n\u00eb p\u00ebrputhje t\u00eb plot\u00eb me Kushtetut\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb propozimet p\u00ebr ndryshime n\u00eb Kodin Zgjedhor, me justifikimin se Kushtetuta ju detyron t\u00eb ndryshoni dispozitat e koalicionit, ju propozoni nj\u00eb model krejt t\u00eb ndrysh\u00ebm t\u00eb koalicionit. Me k\u00ebt\u00eb propozim, ju k\u00ebrkoni q\u00eb modeli i koalicionit t\u00eb jet\u00eb ai me \u201clist\u00eb t\u00eb p\u00ebrbashk\u00ebt\u201d. Theksojm\u00eb se ky model u shfuqizua me konsensus PS-PD n\u00eb reform\u00ebn e vitit 2003, dhe u z\u00ebvend\u00ebsua me modelin n\u00eb fuqi. Justifikimi juaj se k\u00ebt\u00eb jua dikton ndryshimi i nj\u00ebansh\u00ebm kushtetues \u00ebsht\u00eb i pabaz\u00eb. Ritheksojm\u00eb se neni 68, i ndryshuar m\u00eb 30 korrik 2020, apo ndonj\u00eb dispozit\u00eb tjet\u00ebr kushtetuese, nuk p\u00ebrcaktojn\u00eb ndonj\u00eb lloj t\u00eb posa\u00e7\u00ebm koalicioni q\u00eb duhet zbatuar n\u00eb Kodin Zgjedhor, dhe as diktojn\u00eb ndryshimin apo modifikimin e mekanzimit ekzistues t\u00eb funksionimit t\u00eb koalicioneve dhe shp\u00ebrndarjes s\u00eb mandateve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Me k\u00ebt\u00eb propozim ndryshohen dhe dispozitat p\u00ebrkat\u00ebse p\u00ebr regjistrimin e koalicionit, shfaqjen n\u00eb flet\u00ebn e votimit, marrjen e votave, formul\u00ebn dhe m\u00ebnyr\u00ebn e p\u00ebrllogaritjes s\u00eb rezultatit dhe shp\u00ebrndarjes s\u00eb mandateve, t\u00eb gjitha k\u00ebto pjes\u00eb t\u00eb sistemit zgjedhor n\u00eb kuptimin e ngusht\u00eb t\u00eb fjal\u00ebs. N\u00eb m\u00ebnyr\u00eb t\u00eb posa\u00e7me, propozimi i juaj i jep koalicionit t\u00eb drejt\u00ebn e propozimit t\u00eb kandidat\u00ebve, nd\u00ebrkoh\u00eb q\u00eb ndryshimi i nj\u00ebansh\u00ebm kushtetutes ia hoqi k\u00ebt\u00eb t\u00eb drejt\u00eb. P\u00ebr k\u00ebt\u00eb arsye, propozimi juaj \u00ebsht\u00eb n\u00eb kund\u00ebrshtim t\u00eb hapur me dispozitat kushtetutese n\u00eb fuqi<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs ka dekretuar m\u00eb 6 shtator 2020 q\u00eb zgjedhjet p\u00ebr Kuvendin t\u00eb mbahen m\u00eb 25 prill 2021. Kodi Zgjedhor p\u00ebrcakton se regjistrimi i partive politike si subjekte zgjedhore t\u00eb b\u00ebhet jo m\u00eb von\u00eb se 70 dit\u00eb para dat\u00ebs s\u00eb zgjedhje, pra jo m\u00eb von\u00eb se data 17 shkurt 2021. Vet\u00eb dekreti i Presidentit sh\u00ebnon nisjen e procesit zgjedhor. Duke filluar nga data 7 shtator, partive politike u ka lindur e drejta p\u00ebr t\u2019u regjistruar n\u00eb KQZ, si dhe t\u00eb regjistrojn\u00eb koalicione sipas ligjit n\u00eb fuqi. Kjo \u00ebsht\u00eb nj\u00eb e drejt\u00eb e fituar, mbi baz\u00ebn e t\u00eb cil\u00ebs konkurent\u00ebt zgjedhor\u00eb hartojn\u00eb strategjit\u00eb dhe taktikat zgjedhore t\u00eb garimit, me q\u00ebllim mbledhjen e vota q\u00eb m\u00eb pas do t\u00eb kthehen n\u00eb mandate.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00c7do ndryshim n\u00eb k\u00ebt\u00eb faz\u00eb i rregullave p\u00ebr koalicionet do t\u00eb ndikonte tek nj\u00eb e drejt\u00eb e fituar, gj\u00eb q\u00eb c\u00ebnon parimin kushtetues t\u00eb siguris\u00eb juridike e mbi t\u00eb gjitha, parimin e OSBE-s\u00eb dhe t\u00eb K\u00ebshillit t\u00eb Europ\u00ebs p\u00ebr \u201cstabilitetin e legjislacionit zgjedhor\u201d e ve\u00e7an\u00ebrisht t\u00eb element\u00ebve themelor\u00eb t\u00eb tij si\u00e7 p\u00ebrcaktohen Kodin e Praktikave t\u00eb Mira n\u00eb \u00c7\u00ebshtjet Zgjedhore dhe parimin e \u201cfush\u00ebs s\u00eb barabart\u00eb t\u00eb loj\u00ebs\u201d. Pik\u00ebrisht p\u00ebr t\u00eb mbrojtur k\u00ebto parime themelore q\u00eb garantojn\u00eb ndershm\u00ebrin\u00eb e zgjedhjeve kund\u00ebr p\u00ebrpjekjeve p\u00ebr manipulim t\u00eb sistemit n\u00eb avantazh t\u00eb mazhoranc\u00ebs qeveris\u00ebse, Kodi i Praktikave t\u00eb Mira n\u00eb \u00c7\u00ebshtjet Zgjedhore p\u00ebrcakton si afat t\u00eb fundit p\u00ebr ndryshime t\u00eb tilla nj\u00eb vit para dat\u00ebs s\u00eb zgjedhjeve. Ky \u00ebsht\u00eb nj\u00eb nga element\u00ebt ky\u00e7 q\u00eb OSBE-ODIHR t\u00eb vler\u00ebsoj\u00eb se zgjedhjet n\u00eb nj\u00eb vend an\u00ebtar t\u00eb OSBE jan\u00eb demokratike.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa m\u00eb sip\u00ebr, Opozita e p\u00ebrfaq\u00ebsuar n\u00eb K\u00ebshillin Politik sipas marr\u00ebveshjes s\u00eb 14 janarit 2020 konsideron se propozimet e Partis\u00eb Socialiste t\u00eb depozituara n\u00eb Kuvend dhe p\u00ebrpara K\u00ebshillit Politik jan\u00eb n\u00eb kund\u00ebrshtim me parimet europiane p\u00ebr zgjedhje demokratike dhe n\u00eb kund\u00ebrshtim flagrant me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb. P\u00ebr k\u00ebto arsye, Opozita e kund\u00ebrshton k\u00ebt\u00eb ndryshim ligjor t\u00eb modelit koalicioneve t\u00eb propozuar nga Partia Socialiste dhe tekstin legjislativ q\u00eb e zbaton at\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, pal\u00ebt ndajn\u00eb q\u00ebndrime t\u00eb ndryshime dhe kund\u00ebrshtuese t\u00eb nj\u00ebra-tjetr\u00ebs, p\u00ebr nj\u00eb nga element\u00ebt themelor\u00eb t\u00eb procesit zgjedhor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndryshimi i propozuar nga ju modifikon pa asnj\u00eb shkak t\u00eb ligjsh\u00ebm rregullat p\u00ebr mbledhjen e votave dhe kthimin e tyre n\u00eb mandate, jo vet\u00ebm pasi ka kaluar afati nj\u00eb vje\u00e7ar i p\u00ebrcaktuar nga standarti i OSBE-s\u00eb dhe K\u00ebshillit t\u00eb Evrop\u00ebs, por i ndryshon ato pasi ka nisur procesi zgjedhor duke c\u00ebnuar t\u00eb drejta t\u00eb fituara t\u00eb partive politike p\u00ebr garim t\u00eb lir\u00eb e t\u00eb ndersh\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndodhur p\u00ebrpara k\u00ebsaj mosmarr\u00ebveshje midis pal\u00ebve n\u00eb K\u00ebshillin Politik, Opozita ka k\u00ebrkuar zyrtarisht zbatimin e mekanizmit t\u00eb zgjidhjes s\u00eb mosmarr\u00ebveshjeve t\u00eb parashikuar nga Marr\u00ebveshja e 14 Janarit 2020, ku theksohet se \u201cn\u00eb rast mosdakord\u00ebsie p\u00ebr \u00e7\u00ebshtje t\u00eb caktuara, K\u00ebshilli Politik i drejtohet p\u00ebr asistenc\u00eb t\u00eb specializuar OSBE\/ODIHR-it, me q\u00ebllim gjetjen e nj\u00eb zgjidhje t\u00eb pranueshme\u201d. \u00c7do p\u00ebrpjekje nga ana e juaj p\u00ebr t\u00eb penguar k\u00ebt\u00eb rrug\u00eb t\u00eb gjetjes s\u00eb nj\u00eb zgjidhje t\u00eb pranueshme p\u00ebr t\u00eb gjitha pal\u00ebt, n\u00eb p\u00ebrputhje me parimet europiane p\u00ebr zgjedhje demokratike, c\u00ebnon marr\u00ebveshjen e 14 Janarit 2020.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb q\u00ebllim, n\u00eb mir\u00ebbesim dhe me vullnetin e mir\u00eb p\u00ebr t\u00eb p\u00ebrfunduar sa m\u00eb par\u00eb Reform\u00ebn Zgjedhore, q\u00eb \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme edhe p\u00ebr nisjen e bisedimeve t\u00eb antar\u00ebsimit me BE, opozita ju percjell propozimin e m\u00ebposht\u00ebm legjislativ p\u00ebr hapjen e v\u00ebrtet\u00eb t\u00eb listave duke ruajtur modelin e koalicionit si\u00e7 \u00ebsht\u00eb sot n\u00eb fuqi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sa m\u00eb sip\u00ebr dhe referuar projekt-k\u00ebrkes\u00ebs drejtuar ODIHR, t\u00eb cil\u00ebn opozita e ka paraqitur zyrtarisht n\u00eb mbledhjen e dat\u00ebs 22 shtator, ju ftojm\u00eb q\u00eb s\u00eb bashku t\u2019i drejtohemi OSBE\/ODIHR-it duke i parashtruar p\u00ebr vler\u00ebsim p\u00ebrputhshm\u00ebrie me standartet e OSBE-s\u00eb dhe standartet e tjera europiane p\u00ebr zgjedhje, dispozitat ligjore n\u00eb fuqi p\u00ebr rregullat e koalicioneve parazgjedhore dhe formul\u00ebn e shp\u00ebrndarjes s\u00eb mandateve, si dhe propozimin tuaj ligjor p\u00ebr ndryshimin e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb pritje t\u00eb p\u00ebrgjigjes tuaj,<\/span><\/p>\n<p><span style=\"color: #000000;\">Oerd Bylykbashi<\/span><\/p>\n<p><span style=\"color: #000000;\">Petrit Vasili<\/span><\/p>\n<p><span style=\"color: #000000;\">PROJEKTLIGJ<\/span><\/p>\n<p><span style=\"color: #000000;\">Nr. ____\/2020<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00cbR DISA SHTESA DHE NDRYSHIME N\u00cb LIGJIN NR. 10 019, DAT\u00cb 29.12.2008, \u201cKODI ZGJEDHOR I REPUBLIK\u00cbS S\u00cb SHQIP\u00cbRIS\u00cb\u201d, I NDRYSHUAR<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb mb\u00ebshtetje t\u00eb neneve 81 dhe 83, pika 1, t\u00eb Kushtetut\u00ebs, me propozimin e nj\u00eb grupi deputet\u00ebsh,<\/span><\/p>\n<p><span style=\"color: #000000;\">KUVENDI\u00a0I REPUBLIK\u00cbS SE SHQIP\u00cbRIS\u00cb\u00a0VENDOSI<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb ligjin nr. 10019, dat\u00eb 29.12.2008 \u201cKodi Zgjedhor i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, i ndryshuar, b\u00ebhen k\u00ebto shtesa dhe ndryshime:<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 1<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb nenin 67, pikat 4 dhe 5 ndryshohen si m\u00eb posht\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">Emrat n\u00eb list\u00ebn shumem\u00ebrore t\u00eb subjektit zgjedhor paraqiten t\u00eb renditura sipas rendit alfabetik, duke filluar nga g\u00ebrma \u201ca\u201d.
