Por cilat jan\u00eb ndryshimet q\u00eb jan\u00eb b\u00ebr\u00eb n\u00eb kodin e ri.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb pari, me ndryshimet b\u00ebhet rregullimi ligjor i p\u00ebrdorimit t\u00eb hap\u00ebsir\u00ebs ajrore shqiptare dhe t\u00eb marr\u00ebdh\u00ebnieve juridike n\u00eb fush\u00ebn e aviacionit civil.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb dyti, b\u00ebhet rregullimi i veprimtaris\u00eb s\u00eb avion\u00ebve civil\u00eb t\u00eb regjistruar n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb, t\u00eb avion\u00ebve p\u00ebr t\u00eb cil\u00ebt Republika e Shqip\u00ebris\u00eb merr p\u00ebrgjegj\u00ebsi sipas dispozitave t\u00eb k\u00ebtij Kodi, n\u00eb p\u00ebrputhje me nenin 83 bis t\u00eb Konvent\u00ebs s\u00eb \u00c7ikagos, dhe t\u00eb avion\u00ebve t\u00eb regjistruar n\u00eb nj\u00eb shtet tjet\u00ebr, por q\u00eb operojn\u00eb me licenc\u00ebn e operimit t\u00eb l\u00ebshuar nga autoriteti kompetent licencues i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb treti, sjell n\u00eb v\u00ebmendje organizimin e hap\u00ebsir\u00ebs ajrore dhe p\u00ebrdorimin fleksib\u00ebl t\u00eb saj, duke sqaruar konceptin e k\u00ebtij p\u00ebrdorimi. \u201cKoncepti i p\u00ebrdorimit fleksib\u00ebl t\u00eb hap\u00ebsir\u00ebs ajrore do t\u00eb zbatohet n\u00eb tri nivele t\u00eb menaxhimit t\u00eb hap\u00ebsir\u00ebs ajrore (strategjik, pretaktik dhe taktik). P\u00ebr koordinimin e veprimeve brenda fush\u00ebveprimit t\u00eb kompetencave t\u00eb tyre, lidhur me p\u00ebrdorimin e hap\u00ebsir\u00ebs ajrore dhe kontrollin e zonave t\u00eb siguris\u00eb rreth aeroporteve civile, krijohet komiteti p\u00ebr p\u00ebrdorimin fleksib\u00ebl t\u00eb hap\u00ebsir\u00ebs ajrore shqiptare, me p\u00ebrfaq\u00ebsues t\u00eb Ministris\u00eb p\u00ebrgjegj\u00ebse p\u00ebr Transportin dhe t\u00eb ministris\u00eb p\u00ebrgjegj\u00ebse p\u00ebr Mbrojtjen\u201d do t\u00eb sqarohej m\u00eb her\u00ebt gjat\u00eb diskutimeve t\u00eb Kodit n\u00eb Parlament.<\/span><\/p>\n<p><span style=\"color: #000000;\">Lidhur me operimet n\u00eb transportin ajror jan\u00eb shtuar disa dispozita p\u00ebr disa kategori t\u00eb caktuara operimi lidhur me sh\u00ebrbimet ajrore t\u00eb programuara, jo t\u00eb programuara, fluturimet sportive, fluturimet p\u00ebr q\u00ebllime private, pun\u00ebt ajrore. N\u00eb lidhje me certifikat\u00ebn e operatorit ajror, kodi i ri p\u00ebrcakton se l\u00ebshimi b\u00ebhet nga Autoriteti i Aviacionit Civil.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb nenin 29 \u201c\u00c7mimet dhe tarifat\u201d, n\u00eb p\u00ebrputhje me rregulloren p\u00ebrkat\u00ebse europiane (1008\/2008) p\u00ebrcaktohet q\u00eb transportuesit ajror\u00eb t\u00eb caktojn\u00eb lirisht \u00e7mimet e tarifat e sh\u00ebrbimeve ajrore dhe, mbi baz\u00ebn e reciprocitetit, t\u00eb zbatojn\u00eb dispozitat p\u00ebrkat\u00ebse t\u00eb marr\u00ebveshjeve dypal\u00ebshe dhe marr\u00ebveshjes shum\u00ebpal\u00ebshe. K\u00ebto parashikime m\u00eb shum\u00eb sakt\u00ebsojn\u00eb ato q\u00eb jan\u00eb n\u00eb ligjin ekzistues. N\u00eb k\u00ebt\u00eb kapitull jan\u00eb vendosur disa parashikime baz\u00eb p\u00ebr fluturimet sportive, pun\u00ebt ajrore apo fluturimet private, t\u00eb cilat n\u00eb ligjin n\u00eb fuqi nuk trajtohen.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sa i takon kapitullit \u201cP\u00ebrgjegj\u00ebsia dhe t\u00eb drejtat e pasagjer\u00ebve\u201d. Dispozitat e k\u00ebtij kapitulli t\u00eb ndar\u00eb n\u00eb gjasht\u00eb n\u00ebnkapituj jan\u00eb t\u00eb nj\u00ebjta me ato t\u00eb ligjit aktual, \u00ebsht\u00eb shtuar neni 154 \u201cSigurimi p\u00ebr pasagjer\u00ebt, bagazhet dhe ngarkes\u00ebn\u201d, p\u00ebr t\u00eb b\u00ebr\u00eb m\u00eb t\u00eb qart\u00eb nenet e tjera q\u00eb lidhen me sigurimin e detyruar. Ky nen sakt\u00ebson shum\u00ebn minimale t\u00eb mbulimit t\u00eb sigurimit p\u00ebr p\u00ebrgjegj\u00ebsin\u00eb ndaj pasagjer\u00ebve, bagazheve dhe t\u00eb ngarkes\u00ebs, kjo edhe sipas rregullores 785\/2004 p\u00ebr sigurimin e detyruesh\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\">Tek kapitulli \u201cKund\u00ebrvajtjet dhe gjobat\u201d (neni 160-162) p\u00ebrcaktohen konkretisht ato shkelje, t\u00eb cilat p\u00ebrb\u00ebjn\u00eb kund\u00ebrvajtje administrative dhe masa e gjob\u00ebs q\u00eb variojn\u00eb nga 500 000 (pes\u00ebqind mij\u00eb) lek\u00eb deri n\u00eb 2 000 000 (dy milion\u00eb) lek\u00eb p\u00ebr subjektet dhe deri n\u00eb 200 000 lek\u00eb p\u00ebr individ\u00ebt.
