K\u00ebto ndryshime kushtetutese n\u00eb ve\u00e7anti zhb\u00ebjn\u00eb disa nene t\u00eb Marr\u00ebveshjes s\u00eb 5 Qershorit, p\u00ebrmes t\u00eb cilave jo vet\u00ebm ruhen koalicionet parazgjedhore si subjekt zgjedhor, por edhe \u00e7do parti brenda koalicionit vazhdon t\u00eb ruaj\u00eb t\u00eb drejt\u00ebn dhe mund\u00ebsin\u00eb t\u00eb konkuroj\u00eb me listat e veta t\u00eb ve\u00e7anta. Ndryshimi i nj\u00ebnansh\u00ebm i PS, prek jo vet\u00ebm element\u00eb t\u00eb qen\u00ebsish\u00ebm t\u00eb sistemit q\u00eb kan\u00eb impakt t\u00eb drejtp\u00ebrdrejt\u00eb tek rezultati, por gjithashtu prek t\u00eb gjith\u00eb procesin e administrimit zgjedhor.<\/span><\/li>\n<li><span style=\"color: #000000;\">Propozimi i nj\u00ebansh\u00ebm i PS ndryshon element\u00ebt baz\u00eb t\u00eb sistemit zgjedhor:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">a) Duke hequr koalicionet parazgjedhore si subjekt zgjedhor dhe duke ndryshuar p\u00ebr rrjedhoj\u00eb formul\u00ebn e ndarjes s\u00eb mandateve;<\/span><\/p>\n<p><span style=\"color: #000000;\">b) Duke ndryshuar konceptin e ndarjes administrative t\u00eb zonave zgjedhore dhe organizimit elektoral;<\/span><\/p>\n<p><span style=\"color: #000000;\">c) Duke krijuar mund\u00ebsin\u00eb p\u00ebr ndryshimin e pragut elektoral; dhe<\/span><\/p>\n<p><span style=\"color: #000000;\">d) Duke futur element\u00eb t\u00eb rinj n\u00eb hartimin e listave dhe procesin e votimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb gjith\u00eb k\u00ebto element\u00eb jan\u00eb p\u00ebrcaktues n\u00eb rezultatin e zgjedhjeve.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\">N\u00eb Kodin e Praktikave t\u00eb Mira Zgjedhore, q\u00eb \u00ebsht\u00eb standardi i vet\u00ebm i gjith\u00ebpranuar p\u00ebr zgjedhje demokratike n\u00eb vendet e K\u00ebshillit t\u00eb Europ\u00ebs, thuhet shprehimisht se: \u201cQ\u00ebndrueshmeria e ligjit ka r\u00ebnd\u00ebsi kritike p\u00ebr besueshm\u00ebrin\u00eb e pro\u00e7esit zgjedhor, i cili \u00ebsht\u00eb me r\u00ebnd\u00ebsi jetike p\u00ebr konsolidimin e demokracis\u00eb. Praktikisht nuk ka shum\u00eb nevoj\u00eb p\u00ebr mbrojtjen e parimeve baz\u00eb (ka pak t\u00eb ngjar\u00eb q\u00eb t\u00eb ket\u00eb diskutime p\u00ebr to), por q\u00ebndrueshmeria e disa rregullave specifike t\u00eb ligjit elektoral, ve\u00e7an\u00ebrisht ato q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me vet\u00eb sistemin elektoral dhe hartimin e kufinjve t\u00eb zonave zgjedhore, q\u00eb me apo pa t\u00eb drejt\u00eb, konsiderohet si faktor vendimtar p\u00ebr rezultatet e zgjedhjeve, duhet t\u00eb tregohet kujdes jo vet\u00ebm p\u00ebr shmangien e manipulimeve n\u00eb favor te partis\u00eb n\u00eb pushtet, por edhe \u00e7do perceptim, sado i vog\u00ebl, p\u00ebr manipulim. Problemi nuk konsiston n\u00eb ndryshimin e sistemeve zgjedhore \u2013 ato gjithmon\u00eb mund t\u00eb ndryshojn\u00eb duke u p\u00ebrmir\u00ebsuar \u2013 por rishikimi i tyre i shpesht\u00eb ose p\u00ebrpara (brenda nj\u00eb viti) zgjedhjeve. Edhe sikur q\u00ebllimi t\u00eb mos jet\u00eb manipulimi, p\u00ebrs\u00ebri do t\u00eb duket sikur ndryshimet jane diktuar nga interesat konjukturale politike&#8230;&#8230;Nj\u00eb zgjidhje tjet\u00ebr m\u00eb fleksib\u00ebl do t\u00eb ishte t\u00eb theksohej n\u00eb Kushtetut\u00eb se, n\u00ebqoft\u00ebse do t\u00eb ndryshohet ligji elektoral, p\u00ebr zgjedhjet e ardhshme do t\u00eb aplikohet sistemi i vjet\u00ebr \u2013 t\u00eb pakt\u00ebn n\u00ebqoft\u00ebse k\u00ebto zgjedhje do t\u00eb zhvillohen brenda vitit t\u00eb ardhsh\u00ebm \u2013 dhe pas k\u00ebsaj do t\u00eb hyj\u00eb n\u00eb fuqi sistemi i ri.\u201d.<\/span><\/li>\n<li><span style=\"color: #000000;\">N\u00eb p\u00ebrputhje me k\u00ebto standarte nd\u00ebrkomb\u00ebtare:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u00a0a ) Nuk mund t\u00eb ndryshohen 7 apo 8 muaj p\u00ebrpara zgjedhjeve, rregullat q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me vet\u00eb sistemin elektoral dhe hartimin e kufinjve t\u00eb zonave zgjedhore, q\u00eb me apo pa t\u00eb drejt\u00eb, konsiderohet si faktor vendimtar p\u00ebr rezultatet e zgjedhjeve;<\/span><\/p>\n<p><span style=\"color: #000000;\">b) Nuk mund t\u00eb ndryshohen 7 apo 8 muaj p\u00ebrpara zgjedhjeve, rregullat q\u00eb lidhen me koalicionet parazgjedhore dhe formul\u00ebn e ndarjes s\u00eb mandateve, duke u nisur nga interesat e nj\u00ebr\u00ebs pal\u00eb lidhur me konfigurimin politik q\u00eb \u00ebsht\u00eb krijuar n\u00eb momentin para zgjedhjeve t\u00eb rradh\u00ebs. Ky ndryshim i nj\u00ebansh\u00ebm nuk ka asnj\u00eb lidhje me q\u00ebllimin p\u00ebr hapjen e listave;<\/span><\/p>\n<p><span style=\"color: #000000;\">c) Nuk mund t\u00eb ndryshohen 7 apo 8 muaj p\u00ebrpara zgjedhjeve, rregullat p\u00ebr ndarjen e zonave zgjedhore, (koncepti \u201cRajone\u201d \u00ebsht\u00eb i pap\u00ebrcaktuar n\u00eb ligjin n\u00eb fuqi dhe heqja e referimit tek ndarja aktuale administrative \u00ebsht\u00eb e papranueshme dhe e pakuptimt\u00eb). Ky ndryshim i nj\u00ebansh\u00ebm nuk ka asnj\u00eb lidhje me q\u00ebllimin p\u00ebr hapjen e listave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Hapja e listave nuk p\u00ebrb\u00ebn asnj\u00eb arsye p\u00ebr t\u00eb ndryshuar formul\u00ebn ekzistuese t\u00eb koalicioneve parazgjedhore dhe ndarjen e zonave zgjedhore. Koalicionet jan\u00eb nj\u00eb mekaniz\u00ebm ligjor q\u00eb garanton mund\u00ebsin\u00eb e partive politike p\u00ebr t\u2019u grupuar s\u00ebbashku dhe p\u00ebr t\u00eb ruajtur t\u00eb padeformuar vullnetin e qytetar\u00ebve. Hapja e listave nuk ka asnj\u00eb lidhje me formul\u00ebn e koalicioneve apo m\u00ebnyr\u00ebn e shp\u00ebrndarjes s\u00eb mandateve brenda koalicioneve, por ka t\u00eb b\u00ebj\u00eb vet\u00ebm me gar\u00ebn brenda list\u00ebs s\u00eb nj\u00eb partie politike.<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"color: #000000;\">Opozita e Bashkuar propozon se n\u00ebse kalohet n\u00eb listat e hapura, at\u00ebher\u00eb t\u00eb kalohet n\u00eb nj\u00eb mekaniz\u00ebm me lista t\u00eb plota 100 % t\u00eb hapura, me kusht q\u00eb t\u00eb mos b\u00ebhet asnj\u00eb ndryshim tjet\u00ebr sa i takon formul\u00ebs ekzistuese t\u00eb koalicioneve parazgjedhore dhe shp\u00ebrndarjes s\u00eb mandateve.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">P\u00ebr Opozit\u00ebn e Bashkuar \u00ebsht\u00eb e papranueshme q\u00eb 1\/3 fituese e listave t\u00eb jet\u00eb e mbyllur, nd\u00ebrsa 2\/3 t\u00eb jen\u00eb t\u00eb hapura, sic propozon PS. Kjo do t\u00eb thot\u00eb n\u00eb praktik\u00eb q\u00eb pjes\u00ebn d\u00ebrrmuese fituese ta zgjedhin partit\u00eb dhe jo votuesit. Ku \u00ebsht\u00eb risia k\u00ebtu? Pra rreth 100 deputet\u00eb t\u00eb jen\u00eb t\u00eb paracaktuar, dhe vet\u00ebm afro 40 deputet\u00eb t\u00eb jen\u00eb me vot\u00eb parap\u00eblqyese.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr m\u00eb shum\u00eb, kjo do t\u00eb sillte si efekt q\u00eb n\u00eb disa zona me num\u00ebr t\u00eb vog\u00ebl mandatesh, si p.sh. Dibra, Kuk\u00ebsi, Gjirokastra, Berati, etj, vota parap\u00eblqyese e qytetar\u00ebve t\u00eb mos ket\u00eb asnj\u00ebfar\u00eb vlere, nd\u00ebrsa n\u00eb disa zona t\u00eb tjera vota parap\u00eblqyese e qytetar\u00ebve t\u00eb ket\u00eb vler\u00eb t\u00eb kufizuar. N\u00eb vetvete kjo krijon pabarazi mes votuesve, disa kan\u00eb t\u00eb drejt\u00eb t\u00eb ndikojn\u00eb n\u00eb p\u00ebrzgjedhje, nd\u00ebrsa disa t\u00eb tjer\u00eb t\u00eb mos ndikojn\u00eb n\u00eb p\u00ebrzgjedhje. Disa kandidat\u00eb jan\u00eb t\u00eb zgjedhur automatikisht, nd\u00ebrsa disa t\u00eb tjer\u00eb n\u00eb sistem preferencial.<\/span><\/p>\n<ol start=\"6\">\n<li><span style=\"color: #000000;\">N\u00eb p\u00ebrputhje me Marr\u00ebveshjen politike t\u00eb 14 Janarit, kjo \u00e7\u00ebshtje duhet t\u00eb trajtohet me gjith\u00ebp\u00ebrfshirje n\u00eb K\u00ebshillin Politik. Marr\u00ebveshja politike e 14 Janarit detyron pal\u00ebt q\u00eb: Pika 2, paragrafi 3: \u201cP\u00ebr \u00e7\u00ebshtjet t\u00eb cilat nuk gjendet dakord\u00ebsi do t\u00eb k\u00ebrkohet mendim dhe asistenc\u00eb nga ekspertiza nd\u00ebrkomb\u00ebtare e OSBE-ODIHR, me q\u00ebllim gjetjen e nj\u00eb zgjidhje t\u00eb pranueshme\u201d.
