KLSH-s\u00eb<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Jan\u00eb regjistruar prona n\u00eb kund\u00ebrshtim me ligjin buz\u00eb autostrad\u00ebs, leje nd\u00ebrtimi q\u00eb nuk jan\u00eb dh\u00ebn\u00eb sipas ligjit nga Bashkia Mirdit\u00eb, regjistruar koncensione Hec-e pa u ark\u00ebtuar detyrimet, ndryshuar lloji i pasuris\u00eb nga ranishte n\u00eb truall,\u00a0rritur fiktivisht sip\u00ebrfaqen takuese dhe p\u00ebrfituar m\u00eb tep\u00ebr, kryer veprime dhe regjistruar pasuri, n\u00eb munges\u00eb t\u00eb AMTP-s\u00eb origjinale\u00a0p\u00ebr sip\u00ebrfaqe 122400m2,\u00a0\u00a0regjistrimi i objektit \u00ebsht\u00eb kryer n\u00eb munges\u00eb t\u00eb marr\u00ebdh\u00ebnieve m\u00eb truallin, pasi trualli \u00ebsht\u00eb n\u00eb pron\u00ebsi \u201cshtet\u201d, nuk p\u00ebrputhet gjurma e objektit me objektet e legalizuar dhe nd\u00ebrtuara, kryer d\u00ebm ekonomik n\u00eb buxhetin e shtetit\u00a0n\u00eb vlerat 2,800 mij\u00eb lek\u00eb, ndikimit n\u00eb infrastruktur\u00eb, etj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kontrolli i Lart\u00eb t\u00eb Shtetit, n\u00eb zbatim t\u00eb programit t\u00eb tij t\u00eb auditimit\u00a0nr.\u00a0900\/1, dat\u00eb 14\/11\/2019, ndryshuar ne nr. 900\/2, dat\u00eb 24\/01\/2020\u00a0, me objekt:\u201cAuditimi p\u00ebrputhshm\u00ebrie p\u00ebr vitin 2017 -2019\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Me Vendimin nr.39, dat\u00eb 16.05.2010 t\u00eb Kryetarit t\u00eb KLSH-s\u00eb \u00ebsht\u00eb miratuar Raporti P\u00ebrfundimtar i Auditimit dhe i jan\u00eb rekomanduar masat Zyr\u00ebs Vendore t\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs\u00a0Mirdit\u00eb\u00a0, p\u00ebr p\u00ebrmir\u00ebsimin e gjendjes dhe parandalimin e veprimeve t\u00eb kundraligjshme n\u00eb transaksionet me pronat.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ky auditim, u konstatuan nj\u00eb s\u00ebr\u00eb shkeljesh dhe parregullsi t\u00eb dispozitave ligjore n\u00eb fuqi, duke c\u00ebnuar interesin publik e q\u00eb konsistojn\u00eb n\u00eb regjistrime e tjet\u00ebrsime t\u00eb pronave nga shteti n\u00eb persona privat n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme, regjistruar Leje nd\u00ebrtimi t\u00eb dh\u00ebn\u00eb nga Bashkia Mirdit\u00eb n\u00eb af\u00ebrsi t\u00eb autostrad\u00ebs, kryer transaksione dhe mos ark\u00ebtuar detyrimet me vler\u00eb t\u00eb park\u00ebtuar 18.064 mij\u00eb l\u00ebk\u00eb dhe d\u00ebm ekonomik n\u00eb vler\u00eb 2.800 mij\u00eb lek\u00eb,\u00a0\u00a0\u00a0p\u00ebr t\u00eb cilat KLSH\u00a0p\u00ebr shkeljet e konstatuara dhe pasqyruara n\u00eb Raportin P\u00ebrfundimtar t\u00eb Adutimit, n\u00eb kuptim t\u00eb referencave t\u00eb Kodit Penal, ka d\u00ebrguar p\u00ebr kallzim penal z. A.P ish-Regjistrues dhe J.P me detyr\u00eb Drejtor i ZV ASHK Mirdit\u00eb dhe t\u00eb gjith\u00eb materialin e p\u00ebrgatitur, p\u00ebr t\u00eb evidentuar p\u00ebrgjegj\u00ebsin\u00eb individuale dhe nivelin e shkeljeve ligjore\u00a0,\u00a0kryesisht\u00a0p\u00ebr\u00a0shkeljet:<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; N\u00eb 17 raste,\u00a0kan\u00eb regjistruar pasuri truall + nd\u00ebrtes\u00eb, t\u00eb p\u00ebrfituara me vendime t\u00eb pushtetit vendor\u00a0me shkelje t\u00eb dispozitave ligjore, mungon dokumentacioni q\u00eb pasqyron hartografisht gjendjen e pasuris\u00eb para vitit 1991.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0&#8211; N\u00eb 10 raste,\u00a0kan\u00eb regjistruar pasuri truall + nd\u00ebrtes\u00eb, q\u00eb rrjedhin nga vendimet e Bashkis\u00eb Mirdit\u00eb n\u00eb kund\u00ebrshtim me k\u00ebrkesat ligjore, pa paguar detyrimet financiare p\u00ebr truallin e p\u00ebrfituar, si e ardhur e munguar n\u00eb buxhetin e shtetit n\u00eb vler\u00ebn totale\u00a0\u00a0\u00a08,406 mij\u00eb, lek\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb 5 raste p\u00ebr sip\u00ebrfaqe 1037 m2\u00a0ka kryer veprime, duke mos zbatuar k\u00ebrkesat ligjore, pasi dokumentacioni i origjin\u00ebs s\u00eb fitimit t\u00eb pron\u00ebsis\u00eb(Vendimi i KKKP-s\u00eb p\u00ebrkat\u00ebs), nuk \u00ebsht\u00eb origjinal, por fotokopje i pa noterizuar, si dhe jan\u00eb hequr kufizimet mbi k\u00ebto pasuri, n\u00eb kushtet e mos plot\u00ebsimit t\u00eb k\u00ebrkesave.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; N\u00eb 8 raste, n\u00eb ZK 1666, ka regjistruar pasurit\u00eb e paluajtshme\u00a0me sip\u00ebrfaqe\u00a02700 m2\u00a0dhe nd\u00ebrtesa me sip\u00ebrfaqe totale\u00a0613 m2,\u00a0n\u00eb zona urbane t\u00eb fshati, pasi\u00a0mungon dokumenti q\u00eb sh\u00ebrben si akt administrativ p\u00ebr fitimin e pron\u00ebsis\u00eb, duke regjistruar n\u00eb total\u00a0truallin.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; N\u00eb 15 raste, n\u00eb ZK 1666 ka regjistruar pasurit\u00eb e paluajtshme p\u00ebr poseduesit e AMTP-ve p\u00ebrkat\u00ebse,\u00a0duke mos\u00a0zbatuar k\u00ebrkesat ligjore, pasi \u00ebsht\u00eb regjistruar\u00a0nj\u00eb sip\u00ebrfaqe toke n\u00eb total prej\u00a095600 m2,\u00a0m\u00eb tep\u00ebr se sip\u00ebrfaqja takuese sipas AMTP-ve p\u00ebrkat\u00ebse,<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb 20 raste\u00a0t\u00eb evidentuara jan\u00eb regjistruar dhe kryer veprime p\u00ebr pasuri t\u00eb regjistruara sipas AMTP\u00a0por nuk jan\u00eb zbatuar kriteret ligjore,\u00a0\u00a0pasi nuk jan\u00eb b\u00ebr\u00eb m\u00eb par\u00eb diferencat LN-AMTP dhe ka rezultuar nj\u00eb sip\u00ebrfaqe m\u00eb e madhe se ajo e evidentuar me LN prej\u00a053639 m2.\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb 2 rast n\u00eb\u00a0ZK 3563,\u00a0\u00a0kan\u00eb regjistruar me\u00a0t\u00eb dh\u00ebnat e aktit (sip\u00ebrfaqja n\u00eb m2) t\u00eb korrigjuara duksh\u00ebm dhe\u00a0sip\u00ebrfaqja e t\u00eb gjitha pasurive dh\u00ebn\u00eb me\u00a0AMTP, del e ndryshme nga sip\u00ebrfaqja e regjistrimit fillestar t\u00eb k\u00ebtyre pasurive, e pasqyruar n\u00eb KPP, duke regjistruar m\u00eb shum\u00eb nj\u00eb sip\u00ebrfaqe prej 4750 m2.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0\u00a0\u00a0\u00a0\u00a0N\u00eb 3 raste, n\u00eb ZK 3224, ka regjistruar pasurit\u00eb e paluajtshme dhe ka kryer veprime p\u00ebr k\u00ebto pasuri,\u00a0\u00a0\u00a0duke hequr kufizimet, pa u korrigjuar parregullsit\u00eb dhe shkeljet e konstatuara m\u00eb par\u00eb, t\u00eb llojit \u201cmungon dosja e privatizimit, mungon marr\u00ebdh\u00ebnia me truallin po k\u00ebshtu dhe me pasuri me kufizim nga Agjencia e Trajtimit Kredive per detyrimin 2.299 mij\u00eb lek\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kan\u00eb kryer veprime n\u00eb regjistrat e pasurive t\u00eb paluajtshme n\u00eb kushtet me persona t\u00eb pautorizuar,\u00a0\u00ebsht\u00eb b\u00ebr\u00eb ndryshimi i llojit t\u00eb pasuris\u00eb nga lum\u00eb n\u00eb truall, pasuri t\u00eb cilat jan\u00eb t\u00eb pa tjet\u00ebrsueshme dhe nuk i n\u00ebnshtrohen asnj\u00eb lloj regjimi juridik tjet\u00ebrsimi. Dokumentacioni n\u00eb dosje nuk \u00ebsht\u00eb origjinal.<\/span><\/p>\n<p><span style=\"color: #000000;\">Jan\u00eb kryer veprime fiktive regjistrimi objekte Hec-i,\u00a0\u00a0pa u nd\u00ebrtuar asnj\u00eb objekt, nd\u00ebrkoh\u00eb q\u00eb \u00ebsht\u00eb hedhur n\u00eb planshet\u00eb hart\u00eb kadastrale, nj\u00eb objekt q\u00eb nuk ekziston.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00a0\u00eb 6 raste kan\u00eb regjistruar pasurit\u00eb e paluajtshme me parregullsi\u00a0,\u00a0pasi dokumentacioni ligjor urbanistik nuk \u00ebsht\u00eb origjinal, por fotokopje i panoterizuar, ka pasakt\u00ebsi t\u00eb dh\u00ebnash, si dhe \u00ebsht\u00eb kryer n\u00eb munges\u00eb t\u00eb marr\u00ebdh\u00ebnieve me truallin,\u00a0\u00a0\u00a0jan\u00eb kryer veprime n\u00eb kushtet kufizimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb 2 raste\u00a0nuk p\u00ebrputhen sip\u00ebrfaqet nd\u00ebrmjet sheshit nd\u00ebrtimit dhe vendosjes s\u00eb objekteve vendosja e objektit 2-3 katesh e, rezulton q\u00eb gjysma e tij \u00ebsht\u00eb pozicionuar jasht\u00eb pasuris\u00eb .<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb t\u00eb gjitha rastet\u00a0\u00a0n\u00eb ZK 3224, kan\u00eb regjistruar pasurit\u00eb e paluajtshme bazuar n\u00eb Leje legalizimi, ku rezulton se regjistrimi \u00ebsht\u00eb kryer me parregullsi, pasi p\u00ebr poseduesit e lejeve t\u00eb legalizimit jan\u00eb miratuar parcela nd\u00ebrtimore q\u00eb rezultojn\u00eb si prona t\u00eb bashkis\u00eb,mungon miratimin nga Bashkia Mirdit\u00eb si pronare e ligjshme e pasuris\u00eb.\u00a0N\u00eb 6 raste pasuri t\u00eb p\u00ebrfituara me leje legalizimi rezultoi se p\u00ebr pasurit\u00eb e regjistruara nuk ka certifikat\u00eb familjare.\u00a0\u00a0\u00a0Jan\u00eb kryer veprimet n\u00eb (KPP) p\u00ebrshkrimi i pasuris\u00eb, duke ndryshuar llojin e saj nga ranishte n\u00eb truall, pa ndjekur procedur\u00ebn e ndryshimit t\u00eb kategoris\u00eb s\u00eb tok\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb\u00a0\u00a0\u00a08 raste p\u00ebr 8 subjekte,\u00a0sipas referencave\u00a0\u00ebsht\u00eb regjistruar nj\u00eb sip\u00ebrfaqe trualli 1765 m2\u00a0dhe nd\u00ebrtimi 589 m2, n\u00eb zbatim t\u00eb VKM nr. 608, dat\u00eb 05.09.2012, rezulton se regjistrimi \u00ebsht\u00eb kryer me shkelje t\u00eb dispozitave ligjore, pasi mungon dokumentacioni nga arkivi teknik i nd\u00ebrtimit, q\u00eb pasqyron hartografisht gjendjen e pasuris\u00eb para vitit 1991 dhe nuk ka asnj\u00eb dokument tjet\u00ebr kofirmues(lidhur me ekzistenc\u00ebn e objektit para vitit 1991) me efekt financiar n\u00eb vler\u00eb\u00a0\u00a02,800,000 lek\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">KLSH ka kryer kallzim penal p\u00ebr A.P ish regjistrues dhe J.P me detyr\u00eb Drejtor i ZV ASHK Mirdit\u00eb\u00a0p\u00ebr shkeljet e konstatuara dhe pasqyruara n\u00eb Raportin P\u00ebrfundimtar t\u00eb Auditimit, n\u00eb kuptim t\u00eb referencave t\u00eb Kodit Penal,\u00a0duke i\u00a0p\u00ebrcjell\u00eb\u00a0me shkres\u00ebn\u00a0 nr.900\/11, dat\u00eb 24.06.2020, p\u00ebr shkelje t\u00eb ligjit n\u00eb regjistrimet e paligjshme t\u00eb pronave, tjet\u00ebrsimin e tyre n\u00eb kund\u00ebrshtim me ligjin, etj., duke\u00a0\u00a0d\u00ebrguar\u00a0t\u00eb gjitha provat dhe dokumentet
