Nuk \u00ebsht\u00eb detyr\u00eb e Komisionit t\u00eb Venecias t\u00eb analizoj\u00eb sjelljen e pal\u00ebve n\u00eb raport me zbatimin e ligjit, por e autoriteteve kompetente shqiptare. \u00cbsht\u00eb detyra jon\u00eb si ligjv\u00ebn\u00ebs q\u00eb opinionet t\u00eb mos i lexojm\u00eb me disa fjali t\u00eb shk\u00ebputura, por n\u00eb t\u00ebr\u00ebsin\u00eb e tyre. Parlamenti si p\u00ebrfaq\u00ebsues i sovranitetit t\u00eb popullit ka p\u00ebrgjegj\u00ebsi q\u00eb jo vet\u00ebm t\u00eb zb\u00ebrthej\u00eb \u00e7do rekomandim t\u00eb opinioneve por edhe t\u00eb adresoj\u00eb hapat e duhur p\u00ebr zbatimin e tyre.\u201d<\/em> &#8211; tha Balla.<\/span><\/p>\n<p><span style=\"color: #000000;\">Balla shtoi m\u00eb tej se procesi nuk mund t\u00eb jet\u00eb nj\u00eb proces ekzaltimi q\u00eb minimizohet vet\u00ebm n\u00eb kush ka t\u00eb drejt\u00eb dhe se kjo qasje bashk\u00eb me p\u00ebrkthimet e gabuara e t\u00eb s\u00ebrvirura n\u00eb media sipas interesit nuk i sh\u00ebrbejn\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u201c Si i till\u00eb ky proces nuk mund t\u00eb jet\u00eb nj\u00eb proces ekzaltimi q\u00eb minimizohet vet\u00ebm n\u00eb \u2018kush ka t\u00eb drejt\u00eb\u2019 por vet\u00eb publiku do t\u00eb mund t\u2019i lexoj\u00eb e t\u00eb na gjykoj\u00eb. Kush nuk e kupton k\u00ebt\u00eb dhe e sheh Venecian me \u2018kush fiton\u2019, nuk ka shqet\u00ebsim as demokracin\u00eb, as ligjin dhe as standardet. As kjo qasje, as p\u00ebrkthimet e gabuara e t\u00eb servirura n\u00eb media sipas interesit nuk i sh\u00ebrbejn\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.\u201d<\/em> &#8211; shtoi Balla.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Deklarata e Ball\u00ebs<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Komisioni i Venecias dje m\u00eb dat\u00eb 19.06.2020 miratoi dy opinione Nr 978\/2020 dhe nr 980\/2020 mbi em\u00ebrimet e gjyqtar\u00ebve n\u00eb Gjykat\u00ebn Kushtetuese dhe mbi draft-ligjin e mediave.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebto opinione i sh\u00ebrbejn\u00eb ecuris\u00eb s\u00eb m\u00ebtejshme te\u00eb reform\u00ebs n\u00eb drejt\u00ebsi si dhe nevoj\u00ebs imediate p\u00ebr t\u00eb rregulluar nj\u00eb sektor t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb demokracis\u00eb n\u00eb vend si\u00e7 \u00ebsht\u00eb ai i medias.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebto opinione demonstrojn\u00eb tradit\u00ebn e gjat\u00eb e t\u00eb sukseshme t\u00eb bashk\u00ebpunimit ton\u00eb me Komisionin e Venecias p\u00ebr konsulenc\u00ebn e vyer n\u00eb forcimin e institucioneve demokratike dhe shtetin ligjor.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">Dua t\u00eb fal\u00ebnderoj k\u00ebtu ekipin n\u00eb Kuvend q\u00eb bahk\u00ebpunuan n\u00eb nj\u00eb komunikim disa-mujor me Komisionin e Venecias.<\/span><\/p>\n<p><span style=\"color: #000000;\">Opinionet duhen lexuar e analizuar me v\u00ebmendje, pa euforin\u00eb si tifoz\u00eb t\u00eb ndonj\u00eb ekipi t\u00eb kategoris\u00eb s\u00eb tret\u00eb dhe me q\u00ebllimin e vet\u00ebm q\u00eb t&#8217;i sh\u00ebrbejn\u00eb zbatimit t\u00eb shpejt\u00eb t\u00eb reformave n\u00eb vend, reforma t\u00eb shum\u00ebpritura nga shqiptaret.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nuk \u00ebsht\u00eb detyr\u00eb e Komisionit t\u00eb Venecias t\u00eb analizoj\u00eb sjelljen e pal\u00ebve n\u00eb raport me zbatimin e ligjit por e autoriteteve kompetente shqiptare.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb detyra jon\u00eb si ligjv\u00ebn\u00ebs q\u00eb opinionet t\u00eb mos i lexojm\u00eb me disa fjali t\u00eb shk\u00ebputura, por n\u00eb t\u00ebr\u00ebsin\u00eb e tyre. As kjo qasje, as p\u00ebrkthimet e gabuara e t\u00eb servirura n\u00eb media sipas interesit nuk i sh\u00ebrbejn\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Venecia \u00ebsht\u00eb nj\u00eb trup\u00eb profesionist\u00ebsh t\u00eb spikatur q\u00eb ka mision t\u00eb kontribuoj\u00eb n\u00eb forcimin e demokracis\u00eb p\u00ebrmes ligjit duke ndihmuar me opinionet e tyre shtetet an\u00ebtare t\u00eb KiE e m\u00eb gjer\u00eb t\u00eb vendosin standardet m\u00eb t\u00eb mira p\u00ebr \u00e7\u00ebshtjet q\u00eb lipset mendim.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">N\u00eb rastin e zhbllokimit e funksionalitetit t\u00eb Gjykat\u00ebs Kushtetuese, iu drejtuam Venecias p\u00ebr rekomandime dhe sqarimin e \u00e7\u00ebshtjeve q\u00eb lidhen me reform\u00ebn n\u00eb drejt\u00ebsi si n\u00eb zbatueshm\u00ebrin\u00eb e mekanizmave zhbllokues &#8211; parashikime ligjore q\u00eb konsiderojn\u00eb em\u00ebrimin e gjyqtarit kushtetues t\u00eb kryer automatikisht n\u00eb rast mungese veprimi brenda nj\u00eb afati q\u00eb cakton ligji, nga kuvendi apo presidenti.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kemi k\u00ebrkuar t\u00eb sqarojm\u00eb gjithashtu n\u00ebse moszbatimi i ketyre mekanizmave zhbllokuese e c\u00ebnon parimin se qytetar\u00ebt duhet t\u00eb gjykohen nga gjykata e krijuar me ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb opinion Komisioni i Venecias konstaton se:<\/span><\/p>\n<p><span style=\"color: #000000;\">Bllokimi i funksionalitetit t\u00eb Gjykat\u00ebs Kushtetuese dhe vonesat n\u00eb em\u00ebrimet e reja n\u00eb k\u00ebt\u00eb Gjykat\u00eb<\/span><\/p>\n<p><span style=\"color: #000000;\">-Si pasoj\u00eb e vettingut disa nga an\u00ebtar\u00ebt e Gjykat\u00ebs Kushtetuese u shkarkuan nga detyra; disa t\u00eb tjer\u00eb dhan\u00eb dor\u00ebheqjen apo u mbaroi mandati;<\/span><\/p>\n<p><span style=\"color: #000000;\">-Mosfunksionim i KED p\u00ebr vitin 2007 dhe 2008 p\u00ebr shkak se pjesa e m\u00eb e madhe e an\u00ebtar\u00ebve t\u00eb tyre ishin t\u00eb pavetuar; Kushtetuat parashikon q\u00eb an\u00ebtar\u00ebt e KED t\u00eb vetohen menj\u00ebher\u00eb;<\/span><\/p>\n<p><span style=\"color: #000000;\">-Vende vakante t\u00eb krijuara n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb n\u00eb Gjykat\u00ebn Kushtetuese;<\/span><\/p>\n<p><span style=\"color: #000000;\">-Num\u00ebr i kufizuar i kandidat\u00ebve p\u00ebr gjyqtar\u00eb kushtetues p\u00ebr shum\u00eb vende vakante;<\/span><\/p>\n<p><span style=\"color: #000000;\">-Barrier\u00eb n\u00eb bashk\u00ebpunimin midis Kuvendit dhe Presidentit n\u00eb kushtet e zhvillimit t\u00eb procedur\u00ebs s\u00eb shkarkimit t\u00eb Presidentit;<\/span><\/p>\n<p><span style=\"color: #000000;\">-Dispozita t\u00eb paqarta n\u00eb Kushtetut\u00eb;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0Komisioni i Venecias Rekomandon<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Rekomandime p\u00ebr procesin e vettingut<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Nd\u00ebrsa reforma e gjyq\u00ebsorit dhe procedura e vettingut mbeten prioritet dhe duhet t\u00eb \u00e7ohen n\u00eb nj\u00eb p\u00ebrfundim t\u00eb mir\u00eb, duhet t\u00eb vler\u00ebsohet n\u00ebse rregullat si\u00e7 zbatohen lejojn\u00eb nj\u00eb p\u00ebrfundim t\u00eb shpejt\u00eb t\u00eb procesit t\u00eb vettingut, ve\u00e7an\u00ebrisht n\u00eb rast se verifikimi i gjyqtar\u00ebve \u00e7on n\u00eb gjykata jofunksionale, ve\u00e7an\u00ebrisht ato t\u00eb larta.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\">Rekomandime n\u00eb lidhje me procesin e em\u00ebrimit t\u00eb gjyqtar\u00ebve kushtetues<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Sekuenca &#8211; Radha e em\u00ebrimeve n\u00eb Gjykat\u00eb Kushtetuese nga Presidenti, Parlamenti dhe Gjykata e Lart\u00eb<\/span><\/p>\n<p><span style=\"color: #000000;\">Radha p\u00ebr em\u00ebrimet n\u00eb Gjykat\u00eb Kushtetuese nga Presidenti, Parlamenti dhe Gjykata e Lart\u00eb i referohet alokimit t\u00eb vendeve vakante dhe jo radh\u00ebs s\u00eb vendimeve aktuale t\u00eb em\u00ebrimit t\u00eb gjyqtar\u00ebve. Tre autoritetet jan\u00eb t\u00eb pavarura dhe mund t\u00eb veprojn\u00eb n\u00eb m\u00ebnyr\u00eb autonome n\u00eb em\u00ebrimet p\u00ebrkat\u00ebse. Mungesa e em\u00ebrimit t\u00eb anetar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese nga Gjykata e Lart\u00eb nuk pengon Kuvendin dhe Presidentin t\u00eb zgjedhin\/em\u00ebrojn\u00eb an\u00ebtar\u00ebt p\u00ebrkat\u00ebs t\u00eb Gjykat\u00ebs Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mekanizmi zhbllokues<\/span><\/p>\n<p><span style=\"color: #000000;\">Mekanizmi zhbllokues p\u00ebr em\u00ebrimet nga Presidenti dhe Gjykata e Lart\u00eb, i parashikuar n\u00eb Ligjin e Gjykat\u00ebs Kushtetuese duket se ka ndikuar n\u00eb krijimin e nj\u00eb konflikti. Nd\u00ebrsa ky mekaniz\u00ebm \u00ebsht\u00eb n\u00eb fuqi dhe detyrues, rekomandohet t\u00eb vihet n\u00eb tekstin e Kushtetut\u00ebs, sic \u00ebsht\u00eb p\u00ebr Kuvendin.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pezullimi i afatit 30 ditor t\u00eb mekanizmit zhbllokues<\/span><\/p>\n<p><span style=\"color: #000000;\">Pezullimi i k\u00ebtij afati nuk parashikohet n\u00eb Kushtetut\u00eb e n\u00eb ligj. Pezullimi mund t\u00eb justifikohet n\u00ebse ka nj\u00eb vakum ligjor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas Venecias bllokimet e q\u00ebllimshme dhe me vullnet t\u00eb keq mund t\u00eb konsiderohen si pezullime t\u00eb paarsyeshme t\u00eb afatit t\u00eb nj\u00eb mekanizmi zhbllokues. Gjithsesi nj\u00eb parashikim i till\u00eb nuk gjendet n\u00eb ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nisma e mazhoranc\u00ebs p\u00ebr betimin e gjyqtarit Kushtetues para Presidentit<\/span><\/p>\n<p><span style=\"color: #000000;\">Parashikimet q\u00eb p\u00ebrmban draftligji p\u00ebr betimin, n\u00ebse \u00e7mohen t\u00eb nevojshme p\u00ebr t\u00eb evituar bllokimet e mundshme n\u00eb t\u00eb ardhmen dhe abuzimet me t\u00eb drejt\u00ebn e betimit nga ana e Presidentit, si nj\u00eb e drejt\u00eb formale ceremoniale, t\u00eb parashikohen n\u00eb Kushtetut\u00eb.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\">Rekomandime n\u00eb lidhje me pun\u00ebn e KED<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">&#8211; ndryshim i rregullores s\u00eb KED, duke mund\u00ebsuar qe Avokati i Popullit t\u00eb marr\u00eb pjes\u00eb dhe n\u00eb mbledhjet (dhom\u00eb k\u00ebshillimi) ku KED merr vendime p\u00ebr kandidat\u00ebt. Kjo p\u00ebr hir t\u00eb rritjes s\u00eb transparenc\u00ebs s\u00eb KED. Ky rekomandim p\u00ebr t\u2019u adresuar k\u00ebrkon ndryshime n\u00eb Ligjin n.115\/2016 \u201cP\u00ebr organet e qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb\u201d dhe legjislacionit n\u00eb fuqi p\u00ebr organet kolegjiale.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; T\u00eb botoj\u00eb sa m\u00eb par\u00eb procesverbalet e mbledhjeve.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; KED duhet t\u00eb kryej\u00eblistimin e kandidat\u00ebve vet\u00ebm kur dosjet e te\u00eb gjith\u00eb kandidat\u00ebve n\u00eb list\u00eb jan\u00eb t\u00eb plota dhe se Kryetari i KED duhet t\u00eb dergoj\u00eb list\u00ebn s\u00eb bashku me dosjet menj\u00ebher\u00eb te t\u00eb gjitha institucionet p\u00ebrkat\u00ebse pa vones\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211; T\u00eb propozoj\u00eb kandidat\u00eb t\u00eb vetuar.<\/span><\/p>\n<ol start=\"4\">\n<li><span style=\"color: #000000;\">Nevoja p\u00ebr bashk\u00ebpunimi institucional<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Venecia nxit bashk\u00ebpunim midis Kuvendit dhe Presidentit, n\u00eb ve\u00e7anti kur ka pak kandidat\u00eb p\u00ebr shum\u00eb vende vakante, me q\u00ebllim dakord\u00ebsin\u00eb p\u00ebr zbatimin e procedurave q\u00eb zhbllokojn\u00eb situata problematike.<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"color: #000000;\">Nevoja p\u00ebr ndryshime Kushtetuese<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Venecia rekomandon ndryshime t\u00eb Kushtetut\u00ebs p\u00ebr ta qart\u00ebsuar dhe leht\u00ebsuar procedur\u00ebn e em\u00ebrimit t\u00eb gjyqtar\u00ebve kushtetues si dhe garantimin e mandatit t\u00eb plot\u00eb 9-vje\u00e7ar p\u00ebr secilin prej tyre.<\/span><\/p>\n<ol start=\"6\">\n<li><span style=\"color: #000000;\">T\u00eb tjera<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Em\u00ebrimi i gjyqtarit t\u00eb fundit nga Presidenti<\/span><\/p>\n<p><span style=\"color: #000000;\">Mungesa e kandidat\u00ebve, fakti q\u00eb lista e KED d\u00ebrguar Presidentit mbeti pa kandidat\u00eb pas em\u00ebrimit nga Kuvendi t\u00eb dy an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese dhe paqart\u00ebsit\u00eb n\u00eb dispozitat ligjore kushtetuese sipas Venecias, mund t\u00eb konsiderojn\u00eb t\u00eb arsyeshme em\u00ebrimin e fundit t\u00eb Presidentit kryer tej afatit 30 ditor dhe jasht\u00eb list\u00ebs me tre kandidat\u00ebt e renditur t\u00eb par\u00ebt nga KED, dhe pse vet\u00eb Venecia pranon se pezullimi i mekanizmit zhbllokues nuk p\u00ebrligjet n\u00eb asnj\u00eb dispozit\u00eb ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrgjigja e pyetjes: \u201cA jemi para c\u00ebnimit t\u00eb parimit t\u00eb gjykat\u00ebs s\u00eb krijuar me ligj\u201d:<\/span><\/p>\n<p><span style=\"color: #000000;\">Nuk ka p\u00ebrgjigje p\u00ebr k\u00ebt\u00eb pyetje nga Komisioni i Venecias n\u00eb opinion e vet.
