Ky \u00ebsht\u00eb ligji i radh\u00ebs q\u00eb kreu i shtetit i kthen shumic\u00ebs p\u00ebr rishqyrtim. <\/span><\/p>\n<p><span style=\"color: #000000;\">Disa nga arsyet e kthimit t\u00eb ligjit jan\u00eb Mosp\u00ebrcaktimi i kritereve t\u00eb qarta t\u00eb licencimit t\u00eb institucioneve t\u00eb pagesave; Mosp\u00ebrcaktimi i shkeljeve konkrete q\u00eb \u00e7ojn\u00eb n\u00eb vendimmarrjen p\u00ebr heqjen e licenc\u00ebs t\u00eb institucioneve t\u00eb pagesave; Mosp\u00ebrcaktimi i funksioneve t\u00eb qarta dhe shteruese mbik\u00ebqyr\u00ebse t\u00eb autoritetit licencues dhe mekanizmave mbi m\u00ebnyr\u00ebn e ushtrimit t\u00eb k\u00ebsaj mbik\u00ebqyrjeje, etj.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Dekreti<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs shqyrtoi ligjin nr. 55\/2020 \u201cP\u00ebr sh\u00ebrbimet e pagesave\u201d duke iu referuar p\u00ebrmbajtjes s\u00eb aktit t\u00eb d\u00ebrguar p\u00ebr dekretim dhe shpallje, praktik\u00ebs parlamentare t\u00eb ndjekur p\u00ebr k\u00ebt\u00eb q\u00ebllim, duke b\u00ebr\u00eb nj\u00eb vler\u00ebsim dhe analiz\u00eb t\u00eb kujdesshme t\u00eb parashikimeve t\u00eb aktit, edhe n\u00eb raport me rekomandimet q\u00eb duhet t\u00eb p\u00ebrmbush\u00eb Republika e Shqip\u00ebris\u00eb n\u00eb kuad\u00ebr t\u00eb raporteve t\u00eb organizmave nd\u00ebrkomb\u00ebtare p\u00ebr eleminimin e rreziqeve p\u00ebr parandalimin e pastrimit t\u00eb parave dhe luft\u00ebs s\u00eb financimit t\u00eb terrorizmit, p\u00ebrfshir\u00eb rekomandimet e Komitetit t\u00eb Moneyval t\u00eb K\u00ebshillit t\u00eb Evrop\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Rregullimi i sh\u00ebrbimeve t\u00eb pagesave me ligj t\u00eb posa\u00e7\u00ebm \u00ebsht\u00eb shum\u00eb i mir\u00ebpritur, ve\u00e7an\u00ebrisht kur ky ligj, duke parashikuar mund\u00ebsin\u00eb e operator\u00ebve t\u00eb tjer\u00eb ekonomik\u00eb p\u00ebr t\u00eb zhvilluar aktivitet n\u00eb fush\u00ebn e sh\u00ebrbimit t\u00eb pagesave p\u00ebrkundrejt licenc\u00ebs p\u00ebrkat\u00ebse, rrit konkurrenc\u00ebn n\u00eb treg. Rritja e konkurrenc\u00ebs patjet\u00ebr q\u00eb do t\u00eb ndikoj\u00eb si n\u00eb uljen e kostos s\u00eb transaksioneve t\u00eb pagesave, si n\u00eb rritjen e cil\u00ebsis\u00eb s\u00eb sh\u00ebrbimit, ashtu dhe n\u00eb rritjen e aksesit n\u00eb informacion t\u00eb qytetar\u00ebve mbi mund\u00ebsit\u00eb e kryerjes s\u00eb pagesave p\u00ebrmes k\u00ebtij sh\u00ebrbimi. Gjithashtu, ky ligj vler\u00ebsohet pasi ofron nj\u00eb mund\u00ebsi m\u00eb shum\u00eb zgjedhjeje p\u00ebr konsumatorin. Nd\u00ebrsa parashikimi i krijimit t\u00eb nj\u00eb zyre t\u00eb ve\u00e7ant\u00eb p\u00ebr shqyrtimin e ankesave t\u00eb konsumatorit, forcon edhe m\u00eb shum\u00eb mbrojtjen e tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por nga ana tjet\u00ebr, n\u00eb raport me vet\u00eb procesin e licencimit dhe mbik\u00ebqyrjes s\u00eb shoq\u00ebrive t\u00eb licencuara q\u00eb do t\u00eb zhvillojn\u00eb aktivitetin n\u00eb fush\u00ebn e sh\u00ebrbimit t\u00eb pagesave, ligji paraqet disa problematika t\u00eb cilat krijohen nga paqart\u00ebsia e disa dispozitave; mungesa e harmonis\u00eb s\u00eb tyre me legjislacionin ekzistues; apo nga hap\u00ebsira q\u00eb disa dispozita krijojn\u00eb p\u00ebr keqzbatim n\u00eb praktik\u00eb, t\u00eb cilat do t\u00eb shtjellohen n\u00eb vijim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Reflektimi mbi k\u00ebto problematika dhe adresimi i tyre nga Kuvendi i Shqip\u00ebris\u00eb do t\u00eb ofroj\u00eb nj\u00eb terren m\u00eb t\u00eb sigurt\u00eb ligjor p\u00ebr operator\u00ebt ekonomik\u00eb dhe n\u00eb ruajtjen t\u00eb pacenuar t\u00eb interesit publik n\u00eb t\u00ebr\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb q\u00ebllim, n\u00eb bindje t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1, t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs ka vendosur q\u00eb ky ligj i duhet kthyer p\u00ebr rishqyrtim Kuvendit, p\u00ebr argumentet e renditura si m\u00eb posht\u00eb, pasi n\u00eb disa dispozita, ky ligj paraqet k\u00ebto mang\u00ebsi:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Mosp\u00ebrcaktimi i kritereve t\u00eb qarta t\u00eb licencimit t\u00eb institucioneve t\u00eb pagesave;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Mosp\u00ebrcaktimi i shkeljeve konkrete q\u00eb \u00e7ojn\u00eb n\u00eb vendimmarrjen p\u00ebr heqjen e licenc\u00ebs t\u00eb institucioneve t\u00eb pagesave;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Mosp\u00ebrcaktimi i funksioneve t\u00eb qarta dhe shteruese mbik\u00ebqyr\u00ebse t\u00eb autoritetit licencues dhe mekanizmave mbi m\u00ebnyr\u00ebn e ushtrimit t\u00eb k\u00ebsaj mbik\u00ebqyrjeje.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb gjitha k\u00ebto mang\u00ebsi t\u00eb konstatuara cenojn\u00eb parimet kushtetuese t\u00eb siguris\u00eb juridike, liris\u00eb s\u00eb ushtrimit t\u00eb veprimtaris\u00eb ekonomike, trajtimit t\u00eb barabart\u00eb p\u00ebrpara ligjit, duke mos garantuar plot\u00ebsisht jo vet\u00ebm sigurin\u00eb e administrimit t\u00eb fondeve q\u00eb qarkullojn\u00eb p\u00ebrmes institucioneve t\u00eb pagesave, por edhe duke krijuar rrezikun potencial t\u00eb keqp\u00ebrdorimit t\u00eb tyre me q\u00ebllime kriminale, si ato t\u00eb pastrimit t\u00eb parave apo t\u00eb financimit t\u00eb terrorizmit.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr m\u00eb tep\u00ebr, n\u00eb disa dispozita t\u00eb tij, ligji nr. 55\/2020:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 nuk \u00ebsht\u00eb n\u00eb harmoni me legjislacionin penal t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, duke krijuar problematik\u00eb n\u00eb pun\u00ebn e organeve ligjzbatuese n\u00eb ushtrimin e ndjekjes penale p\u00ebr vepra penale q\u00eb mund t\u00eb konsumohen nga subjekte, q\u00eb p\u00ebrdorin sh\u00ebrbimet sipas k\u00ebtij ligjit apo p\u00ebrmes veprimtaris\u00eb ekonomik\u00eb t\u00eb lejuar prej tij;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 si dhe krijon mbivendosje me legjislacionin aktual n\u00eb fuqi duke l\u00ebn\u00eb hap\u00ebsira q\u00eb p\u00ebr t\u00eb nj\u00ebjt\u00ebn shkelje, ofruesi i sh\u00ebrbimeve t\u00eb penalizohet dy her\u00eb, nga dy organe t\u00eb ndryshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Nj\u00eb nd\u00ebr objektet e ligjit nr. 55\/2020 \u00ebsht\u00eb dhe krijimi, licencimi, organizimi, veprimtaria dhe mbik\u00ebqyrja e institucioneve t\u00eb pagesave. Sa i p\u00ebrket licencimit, si hapi i par\u00eb p\u00ebr lejimin e ushtrimit t\u00eb veprimtaris\u00eb n\u00eb fush\u00ebn e sh\u00ebrbimit t\u00eb pagesave, ligji ka p\u00ebrcaktuar n\u00eb nenin 7 t\u00eb tij, t\u00eb dh\u00ebnat q\u00eb duhet t\u00eb shoq\u00ebrojn\u00eb k\u00ebrkes\u00ebn p\u00ebr licencimin si institucion i pagesave. Nj\u00eb nd\u00ebr k\u00ebrkesat p\u00ebr licencimin n\u00eb k\u00ebt\u00eb fush\u00eb, \u00ebsht\u00eb dhe zot\u00ebrimi i kapitalit fillestar minimal t\u00eb k\u00ebrkuar (sipas nenit 7, shkronja \u201cc)\u201d e ligjit). Po p\u00ebr p\u00ebrmbushjen e k\u00ebtij kriteri, n\u00eb nenin 9 t\u00eb ligjit p\u00ebrcaktohet se: \u201cBanka e Shqip\u00ebris\u00eb p\u00ebrcakton me akt n\u00ebnligjor shum\u00ebn e kapitalit fillestar minimal t\u00eb k\u00ebrkuar p\u00ebr institucionin e pagesave dhe p\u00ebrcakton elementet p\u00ebrb\u00ebr\u00ebse t\u00eb tij\u201d.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">P\u00ebr sa koh\u00eb q\u00eb zot\u00ebrimi i shum\u00ebs minimale t\u00eb kapitalit fillestar lidhet direkt me aksesin n\u00eb pajisjen me licenc\u00eb, nd\u00ebrsa nga ana tjet\u00ebr, zot\u00ebrimi i k\u00ebsaj shume sh\u00ebrben si garanci p\u00ebr stabilitetin financiar t\u00eb nj\u00eb shoq\u00ebrie q\u00eb vepron n\u00eb k\u00ebt\u00eb fush\u00eb, n\u00eb funksion t\u00eb mbrojtjes s\u00eb parimit t\u00eb siguris\u00eb juridike, ligji duhet t\u00eb ket\u00eb t\u00eb p\u00ebrcaktuar qart\u00eb parime p\u00ebr p\u00ebrcaktimin e k\u00ebtij kufiri minimal monetar, apo nivele konkrete orientuese minimale.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vet\u00ebm k\u00ebshtu mund t\u00eb balancohet nevoja p\u00ebr akses n\u00eb k\u00ebt\u00eb lloj veprimtarish ekonomike, me k\u00ebrkesat p\u00ebr q\u00ebndrueshm\u00ebrin\u00eb dhe sigurin\u00eb e fondeve t\u00eb qytetar\u00ebve p\u00ebr kryerjen e pagesave, q\u00eb qarkullojn\u00eb p\u00ebrmes k\u00ebtyre veprimtarive.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra, p\u00ebr t\u00eb ofruar garanci maksimale p\u00ebr qarkullimin p\u00ebrmes institucioneve t\u00eb pagesave, ligjv\u00ebn\u00ebsi mund t\u00eb kishte p\u00ebrcaktuar n\u00eb k\u00ebt\u00eb ligj vler\u00ebn minimale dhe maksimale t\u00eb garancis\u00eb q\u00eb nj\u00eb subjekt duhet t\u00eb p\u00ebrmbush\u00eb si kusht n\u00eb momentin e shqyrtimit t\u00eb k\u00ebrkes\u00ebs s\u00eb tij p\u00ebr licensim. Nd\u00ebrkoh\u00eb q\u00eb brenda k\u00ebtij marzhi t\u00eb vendosur nga Kuvendi me ligj, Banka e Shqip\u00ebris\u00eb mund t\u00eb sakt\u00ebsoj\u00eb nivelin minimal t\u00eb shum\u00ebs dhe elementet p\u00ebrb\u00ebr\u00ebse t\u00eb tij p\u00ebr \u00e7do lloj licence p\u00ebr t\u00eb cil\u00ebn subjekti aplikon.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo m\u00ebnyr\u00eb ofron garanci m\u00eb t\u00eb lart\u00eb p\u00ebr qytetar\u00ebt dhe krijon nj\u00eb terren t\u00eb sigurt\u00eb ligjor.<\/span><\/p>\n<p><span style=\"color: #000000;\">1.2 P\u00ebr t\u00eb nj\u00ebjtat arsye si m\u00eb sip\u00ebr, ligji duhet t\u00eb p\u00ebrcaktoj\u00eb qoft\u00eb n\u00eb m\u00ebnyr\u00eb orientuese, nivelet mbi kapitalin rregullator t\u00eb detyruesh\u00ebm p\u00ebr t\u2019u mbajtur n\u00eb \u00e7do koh\u00eb nga nj\u00eb institucion i pagesave, pavar\u00ebsisht kapitalit fillestar minimal. Ky orientim mungon n\u00eb pik\u00ebn 1, t\u00eb nenit 11.<\/span><\/p>\n<p><span style=\"color: #000000;\">1.3 N\u00eb pik\u00ebn 2, t\u00eb nenit 11, k\u00ebrkohet q\u00eb Banka e Shqip\u00ebris\u00eb, bazuar n\u00eb nj\u00eb vler\u00ebsim t\u00eb proceseve t\u00eb administrimit t\u00eb rrezikut, rrezikut t\u00eb humbjes s\u00eb t\u00eb dh\u00ebnave baz\u00eb dhe t\u00eb mekanizmave t\u00eb kontrollit t\u00eb brendsh\u00ebm t\u00eb institucionit t\u00eb pagesave, mund t\u2019i k\u00ebrkoj\u00eb institucionit t\u00eb pagesave q\u00eb t\u00eb mbaj\u00eb nj\u00eb shum\u00eb kapitali rregullator (fonde t\u00eb veta) deri n\u00eb 20 % m\u00eb t\u00eb lart\u00eb se shuma e llogaritur sipas p\u00ebrcaktimit n\u00eb aktin n\u00ebnligjor t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb pik\u00eb, mungojn\u00eb kriteret p\u00ebr kryerjen e k\u00ebtij vler\u00ebsimi, q\u00eb \u00e7ojn\u00eb n\u00eb legjitimimin e Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u2019i k\u00ebrkoj\u00eb nj\u00eb institucioni t\u00eb pagesave rritjen e shum\u00ebs s\u00eb kapitalit rregullator. Nj\u00eb parashikim i till\u00eb, pa asnj\u00eb kriter mbi llojin e rrezikut mbi proceset administrative q\u00eb mund t\u00eb \u00e7oj\u00eb Bank\u00ebn e Shqip\u00ebris\u00eb n\u00eb k\u00ebt\u00eb vendimmarrje, cenon parimin e siguris\u00eb juridike, duke shkaktuar pasiguri t\u00eb theksuar n\u00eb ushtrimin e veprimtaris\u00eb ekonomike nga subjektet e licencuara.<\/span><\/p>\n<p><span style=\"color: #000000;\">1.4 E nj\u00ebjta pasiguri si m\u00eb sip\u00ebr vjen edhe nga parashikimi i nenit 25, pika 4 t\u00eb ligjit, q\u00eb p\u00ebrcakton se Banka e Shqip\u00ebris\u00eb, n\u00eb rast se vler\u00ebson se ushtrimi i veprimtarive t\u00eb tjera t\u00eb ndryshme nga veprimtaria e sh\u00ebrbimit t\u00eb pagesave d\u00ebmton, ose mund t\u00eb d\u00ebmtoj\u00eb q\u00ebndrueshm\u00ebrin\u00eb financiare t\u00eb institucionit t\u00eb pagesave, n\u00eb p\u00ebrputhje me pik\u00ebn 2, t\u00eb k\u00ebtij neni, i k\u00ebrkon institucionit t\u00eb pagesave kapital t\u00eb mjaftuesh\u00ebm, krahas k\u00ebrkesave sipas neneve 9, 10 e 11, t\u00eb k\u00ebtij ligji. K\u00ebto kritere mungojn\u00eb edhe n\u00eb nenin 13, pika 4, t\u00eb ligjit, q\u00eb nuk rendit n\u00eb m\u00ebnyr\u00eb shteruese kushtet minimale q\u00eb duhet t\u00eb plot\u00ebsoj\u00eb subjekti dhe as nuk p\u00ebrcakton m\u00ebnyr\u00ebn e vler\u00ebsimit t\u00eb p\u00ebrmbushjes s\u00eb k\u00ebtyre kushteve nga autoriteti licencues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Modeli i dokumentacionit shoq\u00ebrues t\u00eb k\u00ebrkes\u00ebs p\u00ebr licencim, n\u00eb form\u00eb \u201cp\u00ebrshkrimi\u201d q\u00eb b\u00ebhet n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebanshme nga subjekti aplikues, pa kritere t\u00eb qarta q\u00eb ai duhet t\u00eb p\u00ebrmbush\u00eb, b\u00ebn t\u00eb paqart\u00eb procesin e vler\u00ebsimit nga autoriteti licencues, duke l\u00ebn\u00eb hap\u00ebsira p\u00ebr zbatimin e k\u00ebtij ligji n\u00eb m\u00ebnyr\u00eb selektive dhe diskriminuese. Pra sipas k\u00ebtyre dispozitave autoriteti licencues mund t\u00eb vler\u00ebsoj\u00eb subjektivisht k\u00ebrkesat p\u00ebr licencim dhe kjo m\u00ebnyr\u00eb veprimi \u00ebsht\u00eb t\u00ebr\u00ebsisht e mb\u00ebshtetur n\u00eb ligj, por jo n\u00eb nivelin objektiv t\u00eb vler\u00ebsimit q\u00eb k\u00ebrkohet p\u00ebr veprimtari t\u00eb tilla, q\u00eb mund t\u00eb ken\u00eb pesh\u00eb dhe ndikim n\u00eb q\u00ebndrueshm\u00ebrin\u00eb ekonomike t\u00eb vendit, apo ndikim n\u00eb krijimin e situat\u00ebs monopolizuese n\u00eb k\u00ebt\u00eb treg.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb, n\u00eb asnj\u00eb dispozit\u00eb t\u00eb ligjit nuk p\u00ebrcaktohet se si autoriteti licencues, n\u00eb k\u00ebt\u00eb rast Banka e Shqip\u00ebris\u00eb, do t\u00eb kryej\u00eb vler\u00ebsimin e k\u00ebtyre \u201cp\u00ebrshkrimeve\u201d deklarative.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebto dispozita p\u00ebr pasoj\u00eb, p\u00ebr shkak t\u00eb paqart\u00ebsis\u00eb s\u00eb normave t\u00eb zbatueshme nga subjektet, cenojn\u00eb nenin 11 dhe 18 t\u00eb Kushtetut\u00ebs, lirin\u00eb e veprimtaris\u00eb ekonomike dhe barazin\u00eb p\u00ebrpara ligjit.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.2 Neni 7, shkronjat \u201ci)\u201d dhe \u201cj)\u201d, p\u00ebrcaktojn\u00eb n\u00eb list\u00ebn e dokumenteve q\u00eb duhen dor\u00ebzuar, edhe:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 identitetin e aksioner\u00ebve\/ortak\u00ebve me pjes\u00ebmarrje influencuese n\u00eb kapital n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb ose t\u00eb t\u00ebrthort\u00eb, sipas p\u00ebrcaktimit n\u00eb legjislacionin n\u00eb fuqi p\u00ebr bankat, madh\u00ebsin\u00eb e pjes\u00ebmarrjes n\u00eb kapital dhe evidenc\u00eb mbi reputacionin e tyre, p\u00ebr t\u00eb siguruar nj\u00eb administrim t\u00eb q\u00ebndruesh\u00ebm dhe t\u00eb kujdessh\u00ebm t\u00eb institucionit t\u00eb pagesave;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 identitetin e administratorit t\u00eb institucionit t\u00eb pagesave, sipas p\u00ebrcaktimeve n\u00eb legjislacionin n\u00eb fuqi, dhe t\u00eb personave p\u00ebrgjegj\u00ebs p\u00ebr administrimin e veprimtaris\u00eb s\u00eb sh\u00ebrbimeve t\u00eb pagesave, si dhe informacion p\u00ebr kualifikimin, reputacionin dhe p\u00ebrvoj\u00ebn e tyre p\u00ebr t\u00eb kryer sh\u00ebrbime pagese, si\u00e7 p\u00ebrcaktohet n\u00eb k\u00ebt\u00eb ligj dhe n\u00eb aktet n\u00ebnligjore t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb;<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb fush\u00ebn e sh\u00ebrbimit t\u00eb pagesave, kur veprimtaria lidhet me leht\u00ebsimin e transaksioneve financiare, identiteti dhe integriteti i aksioner\u00ebve dhe administrator\u00ebve \u00ebsht\u00eb thelb\u00ebsor n\u00eb ofrimin e garancis\u00eb s\u00eb nevojshme jo vet\u00ebm p\u00ebr sa lidhet me administrimin e shumave q\u00eb destinohen p\u00ebr kryerjen e pagesave, por edhe p\u00ebr sa i p\u00ebrket nevoj\u00ebs p\u00ebr transparenc\u00eb n\u00eb kuad\u00ebr t\u00eb parandalimit t\u00eb pastrimit t\u00eb parave dhe t\u00eb financimit t\u00eb terrorizmit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb kontekst lindin pyetjet: Cilat do t\u00eb jen\u00eb ato evidenca mbi t\u00eb cilat do t\u00eb b\u00ebhet vler\u00ebsimi i reputacionit t\u00eb subjekteve k\u00ebrkuese p\u00ebr licencim? A do t\u00eb p\u00ebrfshijn\u00eb k\u00ebto evidenca historikun, veprimtarin\u00eb, gjendjen gjyq\u00ebsore apo t\u00eb veprimtaris\u00eb s\u00eb individit aksioner\/administrator, apo t\u00eb shoq\u00ebris\u00eb? Cili do t\u00eb jet\u00eb institucioni q\u00eb certifikon v\u00ebrtet\u00ebsin\u00eb e k\u00ebtyre t\u00eb dh\u00ebnave informative apo evidencave mbi reputacionin?<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb k\u00ebto dy pika, n\u00eb m\u00ebnyr\u00ebn si jan\u00eb formuluar, paraqesin edhe k\u00ebto paqart\u00ebsi:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">a) Identifikimi nominal i aksioner\u00ebve \u00ebsht\u00eb i nevojsh\u00ebm, p\u00ebr t\u00eb gjith\u00eb aksioner\u00ebt, pavar\u00ebsisht pjes\u00ebmarrjes n\u00eb kapital. K\u00ebt\u00eb garanci, ky ligj nuk e jep n\u00eb asnj\u00eb dispozit\u00eb.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00eb veprimtari t\u00eb tilla q\u00eb vler\u00ebsohen si veprimtari me rrezik, p\u00ebrcaktimi i mekanizmave t\u00eb qart\u00eb q\u00eb p\u00ebrshkruajn\u00eb m\u00ebnyr\u00ebn p\u00ebr marrjen e informacionit me q\u00ebllim identifikimin e p\u00ebrfituesit real nga aksionet\/kuotat e zot\u00ebruara, \u00ebsht\u00eb domosdoshm\u00ebri p\u00ebr t\u00eb shkuar deri tek individi q\u00eb ushtron kontrollin e v\u00ebrtet\u00eb mbi personin juridik.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">b) Autoritetit licencues: Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb, i lihet nj\u00eb hap\u00ebsir\u00eb e madhe vler\u00ebsuese mbi nj\u00eb kriter tep\u00ebr subjektiv, si\u00e7 \u00ebsht\u00eb \u201creputacioni\u201d i aksioner\u00ebve\/ortak\u00ebve dhe administrator\u00ebve. Ligji duhet t\u00eb ket\u00eb t\u00eb p\u00ebrcaktuar qart\u00eb cilat jan\u00eb kriteret vler\u00ebsuese mbi t\u00eb cilat do t\u00eb bazohet autoriteti licencues p\u00ebr t\u00eb pik\u00ebzuar nj\u00eb aplikim dhe p\u00ebr t\u00eb vendosur p\u00ebr dh\u00ebnien e licenc\u00ebs. Po kaq qart\u00eb, duhet t\u00eb jen\u00eb t\u00eb p\u00ebrcaktuara nivelet minimale t\u00eb p\u00ebrvoj\u00ebs dhe kualifikimit q\u00eb duhet t\u00eb ket\u00eb administratori i nj\u00eb shoq\u00ebrie t\u00eb till\u00eb, duke mbajtur n\u00eb konsiderat\u00eb q\u00eb ai ka ndikim direkt deri n\u00eb politikat q\u00eb ndjek dhe zbaton nj\u00eb shoq\u00ebri tregtare.<\/span><\/li>\n<li><span style=\"color: #000000;\">c) Ligji nuk p\u00ebrcakton kriterin m\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm q\u00eb duhet t\u00eb p\u00ebrmbushin aksioner\u00ebt\/ortak\u00ebt dhe administrator\u00ebt: T\u00eb mos ken\u00eb q\u00ebn\u00eb t\u00eb d\u00ebnuar p\u00ebr kryerjen e veprave penale q\u00eb lidhen me mashtrimet, pastrimin e produkteve t\u00eb veprave penale ose veprimtaris\u00eb kriminale, apo veprat penale q\u00eb lidhen me financimin e terrorizmit.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00eb t\u00eb tilla veprimtari, p\u00ebrmes procesit ligjb\u00ebr\u00ebs dhe zbatimit t\u00eb tij n\u00eb praktik\u00eb, shteti nuk duhet t\u00eb krijoj\u00eb asnj\u00eb shteg q\u00eb n\u00eb fush\u00ebn e ofrimit t\u00eb sh\u00ebrbimeve financiare, t\u00eb mund t\u00eb lejohen q\u00eb t\u00eb ushtrojn\u00eb veprimtari shoq\u00ebri apo aksioner\u00eb t\u00eb saj, t\u00eb cil\u00ebt n\u00eb historikun e jet\u00ebs s\u00eb tyre individuale apo t\u00eb veprimtaris\u00eb s\u00eb shoq\u00ebris\u00eb, t\u00eb ken\u00eb treguar se jan\u00eb t\u00eb prirur p\u00ebr t\u00eb kryer veprimtari kriminale. Kjo k\u00ebrkon q\u00eb filtri ligjor dhe zbatimi i tij n\u00eb praktik\u00eb t\u00eb jet\u00eb i rrept\u00eb dhe pa asnj\u00eb mund\u00ebsi p\u00ebr hap\u00ebsira interpretative.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mosp\u00ebrcaktimi i kritereve t\u00eb qarta q\u00eb vler\u00ebsohen nga Banka e Shqip\u00ebris\u00eb p\u00ebr dh\u00ebnien e licenc\u00ebs, l\u00eb hap\u00ebsira p\u00ebr intrepretime dhe zbatime subjektive t\u00eb norm\u00ebs juridike, duke \u00e7uar n\u00eb trajtim jo t\u00eb barabart\u00eb e diskriminues. Banka e Shqip\u00ebris\u00eb refuzon dh\u00ebnien e licenc\u00ebs, n\u00ebse aksionar\u00ebt ose ortak\u00ebt q\u00eb kan\u00eb pjes\u00ebmarrje influencuese nuk jan\u00eb t\u00eb p\u00ebrshtatsh\u00ebm p\u00ebr t\u00eb siguruar administrimin e kujdessh\u00ebm e t\u00eb q\u00ebndruesh\u00ebm t\u00eb institucionit t\u00eb pagesave.<\/span><\/p>\n<ol start=\"7\">\n<li><span style=\"color: #000000;\">Banka e Shqip\u00ebris\u00eb jep licenc\u00ebn vet\u00ebm n\u00ebse krijon bindjen se ekzistenca e lidhjeve t\u00eb ngushta nd\u00ebrmjet institucionit t\u00eb pagesave dhe personave t\u00eb tjer\u00eb fizik\u00eb apo juridik\u00eb, nuk pengon ushtrimin efektiv t\u00eb funksioneve t\u00eb saj mbik\u00ebqyr\u00ebse.\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Pra, p\u00ebr t\u00eb garantuar barazin\u00eb p\u00ebrpara ligjit dhe lirin\u00eb e veprimtaris\u00eb ekonomike, ashtu si dhe integritetin e subjekteve q\u00eb angazhohen n\u00eb k\u00ebt\u00eb lloj veprimtarie q\u00eb lidhet direkt me interesat financiare t\u00eb shtetasve, ligji duhet t\u00eb p\u00ebrcaktoj\u00eb qart\u00eb se p\u00ebrmbushja e cilave kritere i b\u00ebn \u201ct\u00eb p\u00ebrshtatsh\u00ebm\u201d aplikuesit p\u00ebr licenc\u00eb, dhe q\u00eb ndihmon Bank\u00ebn e Shqip\u00ebris\u00eb n\u00eb \u201ckrijimin e bindjes\u201d se ekzistenca e lidhjeve t\u00eb ngushta nd\u00ebrmjet institucionit t\u00eb pagesave dhe personave t\u00eb tjer\u00eb fizik\u00eb apo juridik\u00eb, nuk pengon ushtrimin efektiv t\u00eb funksioneve t\u00eb saj mbik\u00ebqyr\u00ebse.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji duhet t\u00eb jet\u00eb i qart\u00eb, objektiv dhe asnj\u00eban\u00ebs n\u00eb p\u00ebrcaktimin e kushteve, kritereve dhe kompetencave t\u00eb subjekteve dhe jo t\u00eb p\u00ebrdor\u00eb terma q\u00eb hyjn\u00eb n\u00eb kategorin\u00eb e vler\u00ebsimeve subjektive, \u00e7ka rrezikon t\u00eb shkaktoj\u00eb pasiguri dhe diskriminim n\u00eb zbatim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Paqart\u00ebsia n\u00eb k\u00ebt\u00eb drejtim rrezikon t\u00eb sjell\u00eb si pasoj\u00eb q\u00eb autoriteti licencuese ta ket\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb krijoj\u00eb nj\u00eb korniz\u00eb unike p\u00ebr t\u00eb vler\u00ebsuar pronar\u00ebt\/aksioner\u00ebt dhe administrator\u00ebt, nga nj\u00eb perspektiv\u00eb e bazuar n\u00eb nivelin e rrezikut t\u00eb mundsh\u00ebm, me synim shtrirjen dhe thellimin e kontrolleve t\u00eb duhura n\u00eb baz\u00eb t\u00eb sinjaleve t\u00eb munges\u00ebs s\u00eb transparenc\u00ebs n\u00eb pron\u00ebsi, ose transaksioneve p\u00ebr q\u00ebllime apo me elemente kriminale.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"color: #000000;\">Neni 12, pika 1, shkronja \u201ca)\u201d, parashikon se:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u201cFondet e p\u00ebrdoruesve t\u00eb sh\u00ebrbimit t\u00eb pagesave nuk duhet t\u00eb bashkohen n\u00eb asnj\u00eb rast me fondet e vet\u00eb institucionit t\u00eb pagesave apo t\u00eb ndonj\u00eb personi fizik apo juridik, t\u00eb ndrysh\u00ebm nga p\u00ebrdoruesit e sh\u00ebrbimit t\u00eb pagesave, n\u00eb em\u00ebr t\u00eb t\u00eb cil\u00ebve jan\u00eb mbajtur fondet, dhe n\u00eb rastet kur ato ende mbahen nga institucioni i pagesave dhe kur nuk jan\u00eb dor\u00ebzuar ende te p\u00ebrfituesi i pages\u00ebs ose nuk jan\u00eb transferuar ende te nj\u00eb ofrues tjet\u00ebr i sh\u00ebrbimit t\u00eb pagesave deri n\u00eb fund t\u00eb dit\u00ebs s\u00eb pun\u00ebs q\u00eb pason dit\u00ebn kur fondet jan\u00eb pranuar, ato depozitohen n\u00eb nj\u00eb llogari t\u00eb ve\u00e7ant\u00eb n\u00eb bank\u00eb ose investohen n\u00eb aktivitete t\u00eb sigurta, me rrezik t\u00eb ul\u00ebt, si\u00e7 p\u00ebrcaktohet me akt n\u00ebnligjor t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb. [\u2026]\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Fondet e p\u00ebrdoruesve t\u00eb sh\u00ebrbimit t\u00eb pagesave, qarkullohen nga p\u00ebrdoruesi i sh\u00ebrbimit t\u00eb pagesave n\u00eb cil\u00ebsin\u00eb e paguesit, p\u00ebrmes transaksioneve t\u00eb pagesave, me q\u00ebllimin e kryerjes s\u00eb operacioni t\u00eb transfert\u00ebs s\u00eb fondeve te p\u00ebrfituesi. Ndaj dhe devijimi q\u00eb lejohet n\u00eb k\u00ebt\u00eb pik\u00eb p\u00ebr \u201cinvestimin n\u00eb aktivitete t\u00eb sigurta\u201d t\u00eb k\u00ebtyre fondeve q\u00eb kan\u00eb q\u00ebllimin e p\u00ebrcaktuar t\u00eb p\u00ebrdorimit, \u00ebsht\u00eb nj\u00eb devijim q\u00eb del jasht\u00eb q\u00ebllimit p\u00ebr t\u00eb cilin jepet licenca si institucion i sh\u00ebrbimit t\u00eb pagesave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb parashikim i till\u00eb nuk merr n\u00eb konsiderat\u00eb as riskun q\u00eb mund t\u00eb krijohet nga investimi i k\u00ebtyre fondeve n\u00eb aktive, n\u00eb m\u00ebnyr\u00eb t\u00eb paautorizuar nga b\u00ebr\u00ebsi i pages\u00ebs, duke cenuar jo vet\u00ebm marr\u00ebdh\u00ebnien q\u00eb lidhet mes p\u00ebrdoruesit t\u00eb sh\u00ebrbimit t\u00eb pagesave dhe ofruesit t\u00eb k\u00ebtij sh\u00ebrbimi, por sjell pasiguri edhe n\u00eb p\u00ebrdorimin e k\u00ebtyre fondeve q\u00eb q\u00ebllimin p\u00ebr t\u00eb cilin jan\u00eb dh\u00ebn\u00eb, e kan\u00eb t\u00eb p\u00ebrcaktuar.<\/span><\/p>\n<ol start=\"4\">\n<li><span style=\"color: #000000;\">Neni 15 i ligjit p\u00ebrcakton dispozit\u00ebn e \u201cShfuqizimit t\u00eb licenc\u00ebs\u201d, duke parashikuar kompetenc\u00ebn e Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb p\u00ebr shfuqizimin e licenc\u00ebs s\u00eb dh\u00ebn\u00eb n\u00eb 7 raste specifike, mes t\u00eb cilave renditen:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u2013 kur institucioni i pagesave \u201cp\u00ebrb\u00ebn k\u00ebrc\u00ebnim p\u00ebr stabilitetin ose besimin e sistemit t\u00eb pagesave, n\u00ebse do t\u00eb vazhdonte veprimtarin\u00eb e sh\u00ebrbimeve t\u00eb pagesave\u201d;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 kur konstatohet ose ka prova t\u00eb besueshme se aksioner\u00ebt ose administratori i institucionit t\u00eb pagesave jan\u00eb p\u00ebrfshir\u00eb n\u00eb veprimtari t\u00eb jasht\u00ebligjshme, kan\u00eb kryer mashtrime ose kan\u00eb p\u00ebrfituar personalisht n\u00eb m\u00ebnyr\u00eb t\u00eb jasht\u00ebligjshme; ose<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 kategorizohet n\u00eb ndonj\u00eb nga rastet e tjera, p\u00ebr t\u00eb cilat legjislacioni shqiptar ose i huaj parashikon heqjen e licenc\u00ebs apo ndalimin e kryerjes s\u00eb veprimtaris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ashtu si kriteret p\u00ebr dh\u00ebnien e licenc\u00ebs, edhe rastet p\u00ebr heqjen e saj, si nj\u00eb e drejt\u00eb e fituar, duhet t\u00eb jen\u00eb t\u00eb p\u00ebrcaktuara qart\u00eb, duke renditur dhe kush jan\u00eb veprimet q\u00eb konsiderohen shkelje e q\u00eb \u00e7ojn\u00eb n\u00eb marrjen e k\u00ebsaj mase. P\u00ebrdorimi i parashikimeve si \u201cp\u00ebrb\u00ebn k\u00ebrc\u00ebnim p\u00ebr stabilitetin apo besimin\u201d; apo \u201cprova t\u00eb besueshme\u201d jan\u00eb p\u00ebrcaktime t\u00eb paqarta dhe q\u00eb nuk ofrojn\u00eb sigurin\u00eb juridike t\u00eb nevojshme p\u00ebr ushtrimit t\u00eb veprimtaris\u00eb ekonomike n\u00eb m\u00ebnyr\u00eb t\u00eb qet\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji duhet t\u00eb rendis\u00eb qart\u00eb, n\u00eb m\u00ebnyr\u00eb thuajse shteruese, shkeljet q\u00eb \u00e7ojn\u00eb n\u00eb heqjen e licenc\u00ebs, dhe jo t\u00eb lihet n\u00eb vler\u00ebsimin rast pas rasti t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb, n\u00ebse n\u00eb nj\u00eb moment t\u00eb caktuar nj\u00eb fakt mund t\u00eb p\u00ebrb\u00ebj\u00eb k\u00ebrc\u00ebnim p\u00ebr stabilitetin e sistemit t\u00eb pagesave, apo jo. Ndaj shkronjat \u201cd)\u201d, \u201cdh)\u201d dhe \u201ce)\u201d t\u00eb k\u00ebtij neni nuk mund t\u00eb konsiderohen si kritere apo raste p\u00ebr heqjen e licenc\u00ebs, por i japin Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb n\u00eb rolin e autoritetit licencues, nj\u00eb marzh t\u00eb gjer\u00eb, deri t\u00eb pakufizuar veprimi, kur pjes\u00eb e k\u00ebsaj vendimmarrjeje apo vler\u00ebsimi jan\u00eb interesat e subjektit q\u00eb ushtron nj\u00eb veprimtari ekonomike n\u00eb nj\u00eb fush\u00eb q\u00eb k\u00ebrkon licencimin.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ligj duhet t\u00eb p\u00ebrcaktoj\u00eb qart\u00eb funksionet mbik\u00ebqyr\u00ebse t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe kompetencat q\u00eb lidhen me t\u00eb drejtat e subjekteve tregtare, pas momentit t\u00eb marrjes s\u00eb licenc\u00ebs p\u00ebr ushtrimin e veprimtari\u00eb ekonomike n\u00eb fush\u00ebn e sh\u00ebrbimeve t\u00eb pagesave.<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"color: #000000;\">Neni 19, parashikon n\u00eb pik\u00ebn 4 se, institucionet e pagesave mund t\u00eb japin kredi lidhur me sh\u00ebrbimet e pagesave, sipas disa kushteve q\u00eb p\u00ebrcakton ligji.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Dh\u00ebnia e kredive, edhe pse \u00ebsht\u00eb nj\u00eb veprimtari q\u00eb mbik\u00ebqyret po nga Banka e Shqip\u00ebris\u00eb, k\u00ebrkon p\u00ebrmbushjen e kritereve dhe kushteve t\u00eb caktuara sipas legjislacionit t\u00eb posa\u00e7\u00ebm.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndaj nuk mundet t\u00eb ushtrojn\u00eb edhe k\u00ebt\u00eb aktivitet, pa iu n\u00ebnshtruar t\u00eb gjitha verifikimeve sipas ligjit t\u00eb posa\u00e7\u00ebm, nd\u00ebrkoh\u00eb q\u00eb licenca p\u00ebr t\u00eb ushtruar veprimtari n\u00eb sh\u00ebrbimet e pagesave, k\u00ebrkon p\u00ebrmbushjen e kushteve dhe kritereve t\u00eb tjera. Ky p\u00ebrcaktim krijon mbivendosje t\u00eb parashikimeve ligjore.<\/span><\/p>\n<ol start=\"6\">\n<li><span style=\"color: #000000;\">N\u00eb nenin 21, pika 7, parashikon se: \u201cBanka e Shqip\u00ebris\u00eb ka t\u00eb drejt\u00eb t\u00eb refuzoj\u00eb, brenda 3 muajve nga marrja n\u00eb dijeni, marr\u00ebveshjen me t\u00eb tret\u00ebt p\u00ebr transferimin e funksioneve t\u00eb r\u00ebnd\u00ebsishme operacionale, p\u00ebrfshir\u00eb dhe sistemet e teknologjis\u00eb s\u00eb informacionit, n\u00eb rast se d\u00ebmtohet materialisht cil\u00ebsia e kontrollit t\u00eb brendsh\u00ebm t\u00eb institucionit t\u00eb pagesave, si dhe pengohet Banka e Shqip\u00ebris\u00eb n\u00eb monitorimin e p\u00ebrputhshm\u00ebris\u00eb s\u00eb institucionit t\u00eb pagesave me t\u00eb gjitha detyrimet e p\u00ebrcaktuara nga ky ligj dhe n\u00eb aktet n\u00ebnligjore n\u00eb zbatim t\u00eb tij.\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Ky parashikim lidhur me kompetenc\u00ebn refuzuese t\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb, nuk zb\u00ebrthehet si\u00e7 duhet as n\u00eb paragrafin 8 vijues t\u00eb k\u00ebtij neni. Sa her\u00eb q\u00eb ligji p\u00ebrcakton kufizime t\u00eb drejtash, duhet t\u2019i p\u00ebrcaktoj\u00eb k\u00ebto kufizime apo atributet kufizuese t\u00eb organeve t\u00eb caktuara, n\u00eb terma konkrete dhe shteruese p\u00ebr t\u00eb shmangur marzhet e gjera t\u00eb vler\u00ebsimit, q\u00eb n\u00eb munges\u00eb t\u00eb kritereve objektive p\u00ebr zbatim, \u00e7ojn\u00eb n\u00eb trajtim t\u00eb pabarabart\u00eb dhe cenim t\u00eb liris\u00eb s\u00eb veprimtaris\u00eb ekonomike.<\/span><\/p>\n<ol start=\"7\">\n<li><span style=\"color: #000000;\">Neni 23, i ligjit nr. 55\/2020, nuk \u00ebsht\u00eb n\u00eb harmoni me legjislacionin penal t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb. Ky nen parashikon se: \u201cInstitucionet e pagesave ruajn\u00eb t\u00eb gjitha t\u00eb dh\u00ebnat e nevojshme, p\u00ebr q\u00ebllime t\u00eb k\u00ebtij titulli, p\u00ebr nj\u00eb periudh\u00eb pes\u00ebvje\u00e7are.\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00eb nj\u00eb fush\u00eb kaq t\u00eb r\u00ebnd\u00ebsishme q\u00eb lidhet me transaksionet financiare t\u00eb qytetar\u00ebve, ruajtja e t\u00eb dh\u00ebnave nga institucionet e pagesave \u00ebsht\u00eb nj\u00eb k\u00ebrkes\u00eb e domosdoshme, kur t\u00eb tilla veprimtari gjenden para rrezikut potencial p\u00ebr t\u2019u p\u00ebrdorur n\u00eb funksion t\u00eb skemave t\u00eb pastrimit t\u00eb parave, financimit t\u00eb terrorizmit apo edhe t\u00eb mashtrimit financiar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb Kodi yn\u00eb Penal, p\u00ebr vepr\u00ebn penale t\u00eb \u201cPastrimi i produkteve t\u00eb vepr\u00ebs penale ose veprimtaris\u00eb kriminale\u201d p\u00ebrcakton afatin kohor dhjet\u00ebvje\u00e7ar p\u00ebr parashkrimin e ndjekjes penale, nuk mundet q\u00eb ligji nr. 55\/2020, t\u00eb krijoj\u00eb k\u00ebt\u00eb hap\u00ebsir\u00eb kaq t\u00eb ngusht\u00eb kohore p\u00ebr ruajtjen e t\u00eb dh\u00ebnave t\u00eb transfertave p\u00ebrmes sh\u00ebrbimit t\u00eb pagesave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb afat kaq i ngusht\u00eb kohor ndikon drejtp\u00ebrdrejt\u00eb n\u00eb cil\u00ebsin\u00eb e hetimit dhe gjurmimit t\u00eb veprave penale q\u00eb konsumohen duke p\u00ebrdorur k\u00ebto sh\u00ebrbime. Pra n\u00eb realitet, kjo dispozit\u00eb do t\u00eb shuante mund\u00ebsin\u00eb e ruajtjes s\u00eb prov\u00ebs q\u00eb ka prodhuar veprimtaria kriminale, nd\u00ebrkoh\u00eb q\u00eb mund\u00ebsia kohore p\u00ebr t\u00eb hetuar at\u00eb vep\u00ebr ekziston sipas ligjit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb periudh\u00eb kaq e shkurt\u00ebr p\u00ebr ruajtjen e t\u00eb dh\u00ebnave, nuk shkon as n\u00eb p\u00ebrputhje me zhvillimet aktuale, kur n\u00eb vendin ton\u00eb aktualisht po zbatohen procese t\u00eb rivler\u00ebsimit kalimtar t\u00eb magjistrat\u00ebve dhe t\u00eb efektiv\u00ebve t\u00eb Policis\u00eb s\u00eb Shtetit, procese k\u00ebto q\u00eb n\u00eb vijim do t\u00eb kryhen periodikisht nga organet e ngarkuara me ligj dhe q\u00eb k\u00ebrkojn\u00eb dhe hetojn\u00eb burimet e pasurive dhe l\u00ebvizjet financiare p\u00ebr periudha t\u00eb shtrira shum\u00eb n\u00eb koh\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndaj nj\u00eb p\u00ebrcaktim i till\u00eb jo vet\u00ebm q\u00eb tregon p\u00ebr aplikimin e standardeve t\u00eb dyfishta dhe duket sikur \u00e7on n\u00eb nj\u00eb amnisti p\u00ebr veprime t\u00eb paligjshme q\u00eb mund t\u00eb kryhen p\u00ebrmes sh\u00ebrbimit t\u00eb pagesave, por edhe rrezikon t\u00eb cenoj\u00eb pun\u00ebn e organeve ligjzbatuese n\u00eb hetimin dhe ndjekjen penale, apo t\u00eb v\u00ebshtir\u00ebsoj\u00eb pun\u00ebn e institucioneve kushtetuese n\u00eb verifikimin e past\u00ebrtis\u00eb s\u00eb figur\u00ebs s\u00eb funksionar\u00ebve publik\u00eb.<\/span><\/p>\n<ol start=\"8\">\n<li><span style=\"color: #000000;\">Neni 25 i ligjit, parashikon n\u00eb pik\u00ebn 3, se: Banka e Shqip\u00ebris\u00eb, n\u00eb rast se konstaton shkelje t\u00eb k\u00ebrkesave t\u00eb k\u00ebtij ligji ose t\u00eb akteve n\u00ebnligjore t\u00eb nxjerra n\u00eb zbatim t\u00eb tij, urdh\u00ebron institucionin e pagesave ose personat, t\u00eb cil\u00ebt efektivisht kontrollojn\u00eb veprimtarin\u00eb e institucionit t\u00eb pagesave, t\u00eb nd\u00ebrpresin veprimet n\u00eb kund\u00ebrvajtje, si dhe t\u00eb ndreqin shkeljet e konstatuara.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Q\u00eb kjo dispozit\u00eb t\u00eb gjej\u00eb zbatim dhe q\u00eb autoriteti licencues t\u00eb ket\u00eb nj\u00eb funksion efektiv mbik\u00ebqyr\u00ebs, ligji duhet t\u00eb p\u00ebrcacaktoj\u00eb qart\u00eb se cilat jan\u00eb ato veprime q\u00eb konsiderohen shkelje dhe q\u00eb \u00e7ojn\u00eb n\u00eb mbajtjen e p\u00ebrgjegj\u00ebsis\u00eb, deri n\u00eb heqjen e licenc\u00ebs.<\/span><\/p>\n<ol start=\"9\">\n<li><span style=\"color: #000000;\">Neni 27 i ligjit njeh t\u00eb drejt\u00ebn e Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u00eb p\u00ebrjashtoj\u00eb personat fizik\u00eb ose juridik\u00eb q\u00eb ofrojn\u00eb ose k\u00ebrkojn\u00eb t\u00eb ofrojn\u00eb sh\u00ebrbimet e pagesave t\u00eb listuara n\u00eb pikat 1 deri n\u00eb 6, t\u00eb aneksit 1, t\u00eb ligjit, nga zbatimi i t\u00eb gjitha ose t\u00eb nj\u00eb pjese t\u00eb k\u00ebrkesave dhe kushteve t\u00eb p\u00ebrcaktuara n\u00eb seksionet 1, 2 e 3, t\u00eb kreut I, t\u00eb titullit II, t\u00eb ligjit, me p\u00ebrjashtim t\u00eb neneve 16, 24, 26 e 97.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Pjes\u00eb e k\u00ebtij p\u00ebrjashtimi \u00ebsht\u00eb dhe licencimi. N\u00ebse dispozita ka q\u00ebllimin e dyt\u00eb, at\u00ebher\u00eb nj\u00eb p\u00ebrcaktim i till\u00eb duhet ripar\u00eb n\u00eb funksion t\u00eb p\u00ebrcaktimit t\u00eb qart\u00eb t\u00eb nevoj\u00ebs s\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave personale.<\/span><\/li>\n<li><span style=\"color: #000000;\">P\u00ebrcaktimi i pik\u00ebs 2, t\u00eb nenit 35 t\u00eb ligjit, q\u00eb autorizon Bank\u00ebn e Shqip\u00ebris\u00eb se me akt n\u00ebnligjor t\u00eb mund t\u00eb ul\u00eb ose t\u00eb dyfishoj\u00eb limit e transaksioneve p\u00ebr p\u00ebrjashtimin nga k\u00ebrkesat p\u00ebr informim, sipas p\u00ebrcaktimeve q\u00eb b\u00ebn vet\u00eb pika 1 e nenit, \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me hierarkin\u00eb e akteve t\u00eb p\u00ebrcaktuar n\u00eb nenin 116 t\u00eb Kushtetut\u00ebs. Nj\u00eb rregullim i b\u00ebr\u00eb n\u00eb nj\u00eb akt, mund t\u00eb ndryshohet vet\u00ebm nga nj\u00eb akt tjet\u00ebr q\u00eb ka t\u00eb nj\u00ebjt\u00ebn fuqi juridike si akti i par\u00eb.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Hierarkia e akteve, e p\u00ebrcaktuar nga neni 116 i Kushtetut\u00ebs, p\u00ebr t\u00eb nj\u00ebjt\u00ebn arsye si m\u00eb sip\u00ebr, p\u00ebrmbyset edhe nga parashikimi i nenit 56, pika 2, t\u00eb ligjit.<\/span><\/p>\n<ol start=\"12\">\n<li><span style=\"color: #000000;\">Neni 39, shkronja \u201cb)\u201d, dhe neni 42, shkronja \u201ca)\u201d e ligjit, n\u00eb momentin e referimit n\u00eb informacionin q\u00eb mund t\u00eb aksesoj\u00eb p\u00ebrfituesi i pages\u00ebs, kur referon n\u00eb informacionin mbi identifikimin e paguesit, p\u00ebrdor togfjal\u00ebshin \u201ckur \u00ebsht\u00eb e mundur\u201d.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Pamund\u00ebsia e identifikimit t\u00eb paguesit, n\u00eb rastin e transfertave individuale, pavar\u00ebsisht se p\u00ebrfituesi ka mund\u00ebsin\u00eb e refuzimit t\u00eb pages\u00ebs, mund t\u00eb paraqes\u00eb problem n\u00eb identifikimin e subjekteve q\u00eb hyjn\u00eb n\u00eb k\u00ebto marr\u00ebdh\u00ebnie, ve\u00e7an\u00ebrisht kur p\u00ebrmes k\u00ebtyre pagesave mund t\u00eb ushtrohet veprimtaria e dyshimt\u00eb financiare p\u00ebr q\u00ebllime po t\u00eb dyshimta apo t\u00eb paligjshme.<\/span><\/p>\n<ol start=\"13\">\n<li><span style=\"color: #000000;\">Neni 56, q\u00eb p\u00ebrmban dispozit\u00ebn me titullin \u201cP\u00ebrjashtimi p\u00ebr instrumentet e pagesave me vlera t\u00eb vogla dhe p\u00ebr paran\u00eb elektronike\u201d, nd\u00ebrkoh\u00eb q\u00eb paraja elektronike nuk rregullohet nga ky ligj, n\u00eb pikat 3 dhe 4, referon n\u00eb p\u00ebrjashtime q\u00eb lidhen me nenet 66 dhe 67 t\u00eb ligjit.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">K\u00ebto parashikime nuk e kan\u00eb vendin n\u00eb k\u00ebt\u00eb dispozit\u00eb, pasi teknikisht duhet t\u00eb ishin p\u00ebrfshir\u00eb n\u00eb fund ose pas neneve 66 dhe 67, meq\u00eb b\u00ebjn\u00eb fjal\u00eb p\u00ebr p\u00ebrjashtime nga zbatimi i rregullimeve t\u00eb k\u00ebtyre dy dispozitave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb shp\u00ebrndarje e till\u00eb e parashikimve n\u00eb ligj, duket se krijon konfuzion t\u00eb q\u00ebllimt\u00eb p\u00ebr regjimin e posa\u00e7\u00ebm q\u00eb u jepet p\u00ebrmes k\u00ebtij ligji, transaksioneve me paran\u00eb elektronike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vet\u00eb neni 66 dhe 67, flasin p\u00ebr p\u00ebrgjegj\u00ebsin\u00eb e ofruesit t\u00eb sh\u00ebrbimeve t\u00eb pagesave p\u00ebr transaksionet e pagesave t\u00eb paautorizuara dhe p\u00ebr p\u00ebrgjegj\u00ebsit\u00eb e paguesit p\u00ebr k\u00ebto transaksione t\u00eb paautorizuara. Ndaj \u00e7do rregullim q\u00eb lidhet me p\u00ebrjashtime nga zbatimi i k\u00ebtyre neneve duhet t\u00eb jet\u00eb i p\u00ebrcaktuar qart\u00eb n\u00eb p\u00ebrmbajtje t\u00eb tyre, ose fill pas tyre, pa krijuar \u00e7orientim p\u00ebrmes referencave t\u00eb shumta n\u00eb dispozita t\u00eb brendshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 66 dhe 67 rregullojn\u00eb pasojat dhe p\u00ebrgjegj\u00ebsit\u00eb n\u00eb rastet e pagesave t\u00eb paautorizuara nga p\u00ebrdoruesi i sh\u00ebrbimit t\u00eb pagesave. P\u00ebrjashtimi nga k\u00ebto rregullime i transaksioneve me paran\u00eb elektronike, b\u00ebn t\u00eb paqart\u00eb se cili \u00ebsht\u00eb regjimi ligjor q\u00eb zbatohet n\u00eb raste t\u00eb tilla p\u00ebr transaksionet me paran\u00eb elektronike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Lidhur me rregullimet q\u00eb b\u00ebn ky ligj p\u00ebr paran\u00eb elektronike, konstatojm\u00eb se dispozitat jan\u00eb t\u00eb shp\u00ebrndara n\u00eb ligj n\u00eb form\u00ebn e p\u00ebrjashtimeve nga rregullimet e p\u00ebrgjithshme, nd\u00ebrkoh\u00eb q\u00eb mungon nj\u00eb rregullim specifik i strukturuar n\u00eb grup dispozitash q\u00eb lidhen me k\u00ebt\u00eb objekt. Kjo zgjedhje e Kuvendit, nuk \u00ebsht\u00eb e p\u00ebrshtatshme p\u00ebr nga teknika legjislative dhe krijon automatikisht p\u00ebshtjellim t\u00eb t\u00eb kuptuarit dhe t\u00eb zbatuarit t\u00eb vet\u00eb ligjit.<\/span><\/p>\n<ol start=\"14\">\n<li><span style=\"color: #000000;\">Dispozita e nenit 88, synon t\u00eb normoj\u00eb m\u00ebnyr\u00ebn e administrimit t\u00eb rreziqeve operacionale dhe t\u00eb siguris\u00eb gjat\u00eb veprimtaris\u00eb t\u00eb ofruesve t\u00eb sh\u00ebrbimeve t\u00eb pagesave. Nd\u00ebrkoh\u00eb q\u00eb pika 3 e k\u00ebtij neni parashikon se: \u201cBanka e Shqip\u00ebris\u00eb nxjerr akte n\u00ebnligjore n\u00eb zbatim t\u00eb k\u00ebrkesave t\u00eb k\u00ebtij neni, mb\u00ebshtetur n\u00eb praktikat m\u00eb t\u00eb mira nd\u00ebrkomb\u00ebtare dhe n\u00eb standardet teknike rregullatore t\u00eb fush\u00ebs.\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Nj\u00eb formulim i till\u00eb i autorizimit delegues p\u00ebr rregullimin e \u00e7\u00ebshtjeve me akt n\u00ebnligjor nga Banka e Shqip\u00ebris\u00eb, p\u00ebr m\u00eb tep\u00ebr kur lidhet me p\u00ebrmbajtjen q\u00eb duhet t\u00eb ket\u00eb kuadri rregullativ me masat e kontrollit p\u00ebr administrimin e rreziqeve operacionale dhe t\u00eb siguris\u00eb, nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me nenin 118, paragrafi 2 i Kushtetut\u00ebs, q\u00eb sanksionon se, ligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndryshe nga kjo dispozit\u00eb autorizuese e formuluar n\u00eb kund\u00ebrshtim me nenin 118, t\u00eb Kushtetut\u00ebs, p\u00ebr ilustrim, neni 91, i ligjit, q\u00eb \u00ebsht\u00eb s\u00ebrish nj\u00eb dispozit\u00eb autorizuese p\u00ebr nxjerrjen e anj\u00eb akti n\u00ebnligjor nga Banka e Shqip\u00ebris\u00eb, ka p\u00ebrcaktuar me detaje si \u00e7\u00ebshtjet q\u00eb duhen rregulluar, ashtu dhe k\u00ebrkesat minimale e parimet q\u00eb duhet t\u00eb respektoj\u00eb rregullimi me akt n\u00ebnligjor.<\/span><\/p>\n<ol start=\"15\">\n<li><span style=\"color: #000000;\">N\u00eb nenin 92, pika 5, p\u00ebrdorimi i termit \u201cweb\u201d n\u00eb p\u00ebrmbajtje t\u00eb dispozit\u00ebs, nj\u00eb em\u00ebrtim jo n\u00eb gjuh\u00ebn shqipe, bie n\u00eb kund\u00ebrshtim me nenin 14, paragrafi 1, t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebri, q\u00eb p\u00ebrcakton se: \u201cGjuha zyrtare n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb \u00ebsht\u00eb shqipja.\u201d Kjo fjal\u00eb e huaj mund t\u00eb z\u00ebvend\u00ebsohet me em\u00ebrtimin p\u00ebrkat\u00ebs n\u00eb gjuh\u00ebn shqipe si \u201cfaqe zyrtare\u201d.<\/span><\/li>\n<li><span style=\"color: #000000;\">Neni 94, pika 2, shkronja \u201c\u00e7)\u201d e ligjit, parashikon si kundravajtje administrative t\u00eb d\u00ebnueshme me gjob\u00eb, kur ofruesi i sh\u00ebrbimit t\u00eb pagesave, nuk ka krijuar rregulla, procedura dhe sisteme t\u00eb p\u00ebrshtatshme dhe gjith\u00ebp\u00ebrfshir\u00ebse p\u00ebr drejtimin e kontrollin e brendsh\u00ebm, si\u00e7 parashikohet n\u00eb pik\u00ebn 4, t\u00eb nenit 13, t\u00eb k\u00ebtij ligji.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Nj\u00eb parashikim i till\u00eb shkakton paqart\u00ebsi mbi llojet e shkeljeve q\u00eb pasohen nga sanksione administrative, kur krijimi i rregullave, procedurave dhe sistemeve sipas nenit 13, pika 4, \u00ebsht\u00eb kriter dhe k\u00ebrkes\u00eb p\u00ebr pajisjen me licenc\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse ky parashikim nuk p\u00ebrmbushet, k\u00ebrkesa p\u00ebr licenc\u00eb nuk mund dhe nuk duhet t\u00eb miratohet. Edhe n\u00eb rastin kur k\u00ebto rregulla, procedura dhe sisteme n\u00eb nj\u00eb moment t\u00eb caktuar nuk jan\u00eb m\u00eb n\u00eb funksion\/zbatim, \u00ebsht\u00eb tregues q\u00eb kriteret q\u00eb kan\u00eb \u00e7uar n\u00eb licencim nuk p\u00ebrmbushen m\u00eb dhe licenca duhet hequr nga autoriteti licencues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndaj sillet n\u00eb v\u00ebmendjen tuaj s\u00ebrish, nevoja p\u00ebr p\u00ebrcaktimin qart\u00eb n\u00eb ligj t\u00eb kushteve dhe kritereve p\u00ebr licencim dhe shkeljeve q\u00eb \u00e7ojn\u00eb n\u00eb heqjen e licenc\u00ebs. Kjo n\u00eb funksion t\u00eb mbrojtjes s\u00eb parimeve t\u00eb trajtimit t\u00eb barabart\u00eb para ligjit, liris\u00eb s\u00eb veprimtaris\u00eb ekonomike, parime k\u00ebto t\u00eb mbrojtura nga Kushtetuta, dhe p\u00ebr garantimin e t\u00eb drejtave t\u00eb shtetasve n\u00eb kryerjen e transaksioneve, p\u00ebr sa koh\u00eb b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb veprimtari t\u00eb licencuar n\u00ebn mbik\u00ebqyrjen e institucioneve shtet\u00ebrore.<\/span><\/p>\n<ol start=\"17\">\n<li><span style=\"color: #000000;\">Po lidhur me dispozit\u00ebn e kundravajtjeve administrative, pika 3, e nenit 94, shkronja \u201cll)\u201d, parashikon se Banka e Shqip\u00ebris\u00eb vendos gjob\u00eb nga 50 000 (pes\u00ebdhjet\u00eb mij\u00eb) lek\u00eb deri n\u00eb 250 000 (dyqind e pes\u00ebdhjet\u00eb mij\u00eb) lek\u00eb p\u00ebr ofruesin e sh\u00ebrbimeve t\u00eb pagesave, kur nuk respekton k\u00ebrkesat p\u00ebr ruajtjen e konfidencialitetit t\u00eb t\u00eb dh\u00ebnave, n\u00eb kund\u00ebrshtim me p\u00ebrcaktimet e k\u00ebtij ligji.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Sjellim n\u00eb v\u00ebmendjen tuaj se, ky ligj p\u00ebrmban nj\u00eb kre m\u00eb vete (kreu IV \u2013 Mbrojtja e t\u00eb dh\u00ebnave personale), me nj\u00eb dispozit\u00eb t\u00eb vetme, neni 87 \u201cMbrojtja dhe p\u00ebrpunimi i t\u00eb dh\u00ebnave personale\u201d, q\u00eb parashikon se p\u00ebrpunimi i t\u00eb dh\u00ebnave personale, p\u00ebr q\u00ebllime t\u00eb k\u00ebtij ligji, kryhet n\u00eb p\u00ebrputhje me legjislacionin n\u00eb fuqi p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse p\u00ebrsa sa i takon aspektit t\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave personale (q\u00eb lidhen pandashm\u00ebrisht me konceptin e konfidencialitetit t\u00eb t\u00eb dh\u00ebnave), ligji ka prashikuar referimin n\u00eb legjislacionin e posa\u00e7\u00ebm p\u00ebr mbrotjen e t\u00eb dh\u00ebnave personale, \u00ebsht\u00eb ai legjislacion q\u00eb p\u00ebrcakton autoritetin kontrollues, shkeljet administrative dhe sanksionet p\u00ebrkat\u00ebse.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb rast, parashikimi i shkronj\u00ebs \u201cll)\u201d, t\u00eb pik\u00ebs 3, t\u00eb nenit 94, krijon mbivendosje duke l\u00ebn\u00eb hap\u00ebsira q\u00eb p\u00ebr t\u00eb nj\u00ebjt\u00ebn shkelje, ofruesi i sh\u00ebrbimeve t\u00eb penalizohet dy her\u00eb, nga dy organe t\u00eb ndryshme.<\/span><\/p>\n<ol start=\"18\">\n<li><span style=\"color: #000000;\">Parashikimi i nenit 95, t\u00eb ligjit q\u00eb p\u00ebrcakton dispozit\u00ebn e publikimit t\u00eb sanksioneve administrative, p\u00ebrve\u00e7se i l\u00eb nj\u00eb diskrecion t\u00eb zgjeruar Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb n\u00eb mospublikimin e sanksioneve administrative p\u00ebr raste t\u00eb caktuara, pa p\u00ebrcaktuar asnj\u00eb kriter orientues apo parim q\u00eb duhet respektuar n\u00eb k\u00ebt\u00eb diferencim t\u00eb publikimit t\u00eb sanksioneve ose jo; gjithashtu nuk merr n\u00eb konsiderat\u00eb faktin se publikimi i sanksioneve pa pritur marrjen form\u00eb t\u00eb prer\u00eb t\u00eb tyre pas shqyrtimit administrativ dhe gjyq\u00ebsor, mund t\u00eb cenoj\u00eb imazhin e subjekteve q\u00eb veprojn\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb, duke ndikuar drejtp\u00ebrdrejt n\u00eb veprimtarin\u00eb e tyre ekonomike.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">T\u00eb nderuar deputet\u00eb t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb,<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr gjith\u00eb sa u parashtrua m\u00eb sip\u00ebr, n\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb zbatim t\u00eb nenit 85, pika 1, t\u00eb saj, kam vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr. 55\/2020 \u201cP\u00ebr sh\u00ebrbimet e pagesave\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Shqet\u00ebsimet e parashtruara m\u00eb sip\u00ebr p\u00ebr nenet 7, 9, 11, 12, 15, 19, 21, 23, 25, 27, 30, 35, 39, 42, 56, 66, 67, 88, 92, 94, 95, dhe \u00e7\u00ebshtjet e tjera t\u00eb ngritura n\u00eb k\u00ebt\u00eb arsyetim, duhet t\u00eb merren n\u00eb shqyrtim nga ana juaj p\u00ebr t\u00eb p\u00ebrcaktuar rregullime t\u00eb qarta dhe transparente sa i p\u00ebrket m\u00ebnyr\u00ebs \u00eb licencimit dhe t\u00eb ushtrimit t\u00eb mbik\u00ebqyrjes ndaj subjekteve q\u00eb do t\u00eb ushtrojn\u00eb aktivitetin e tyre n\u00eb fush\u00ebn e sh\u00ebrbimit t\u00eb pagesave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kuvendi i Shqip\u00ebris\u00eb duhet t\u00eb gjej\u00eb vullnetin p\u00ebr t\u2019u p\u00ebrqendruar n\u00eb shqet\u00ebsimet e Presidentit t\u00eb Republik\u00ebs p\u00ebr ligjin nr. 55\/2020, pasi ato kan\u00eb shum\u00eb r\u00ebnd\u00ebsi n\u00eb mbar\u00ebvajtjen e veprimtaris\u00eb ekonomike n\u00eb fusha t\u00eb tilla kaq delikate e me kaq ndikim p\u00ebr jet\u00ebn n\u00eb vend dhe ruajtjen e interesave t\u00eb shtetit dhe t\u00eb qytetar\u00ebve t\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>Presidenti Meta i ka kthyer Kuvendit ligjin p\u00ebr sh\u00ebrbimet\u00a0 e pagesave.
