Ky ligj me shkres\u00ebn me nr. 1183prot., dat\u00eb 29.04.2020 t\u00eb Kuvendit, i \u00ebsht\u00eb p\u00ebrcjell\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi i praktik\u00ebs parlamentare q\u00ebllimi i propozimit dhe miratimit t\u00eb ligjit nr. 43\/2020 \u201cP\u00ebr aktivitetet e turizmit detar\u201d, \u00ebsht\u00ebp\u00ebrcaktimi i rregullave dhe i kritereve t\u00eb veprimtarive t\u00eb turizmit detar, llojet e mjeteve lundruese turistike, infrastruktur\u00ebn e nevojshme p\u00ebr ushtrimin e tyre si edhe p\u00ebrcaktimin e p\u00ebrgjegj\u00ebsive insitucionale p\u00ebr zhvillimin e k\u00ebtyre veprimtarive.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs vler\u00ebson nism\u00ebn e qeveris\u00eb dhe t\u00eb Kuvendit p\u00ebr t\u00eb rregulluar kuadrin ligjor, n\u00eb t\u00eb cilin do t\u00eb duhet t\u00eb ushtrohen veprimtarit\u00eb e turizmit detar, sepse garancia n\u00eb ushtrimin e k\u00ebtyre veprimtarive, si nga k\u00ebndv\u00ebshtrimin ekonomik, ashtu dhe nga k\u00ebndv\u00ebshtrimi i nj\u00eb sh\u00ebrbimi m\u00eb t\u00eb sigurt q\u00eb u ofrohet qytetar\u00ebve n\u00eb zonat turistike, ka r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb p\u00ebr nxitjen e turizmit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Megjithat\u00eb, ligji nr. 43\/2020 \u201cP\u00ebr aktivitetet e turizmit detar\u201d, pavar\u00ebsisht objektivave t\u00eb deklaruar n\u00eb nenin 1, p\u00ebr shkak t\u00eb formulimevet\u00eb paqarta t\u00eb disa dispozitave t\u00eb tij, duket se nuk shkon kah p\u00ebrmbushjes s\u00eb k\u00ebtyre objektivave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ligj, p\u00ebr shkak t\u00eb \u00e7\u00ebshtjeve q\u00eb do t\u00eb shtjellohen n\u00eb vijim t\u00eb k\u00ebtij materiali shoq\u00ebrues, ka nevoj\u00eb p\u00ebr p\u00ebrmir\u00ebsim dhe duhet t\u00eb rishqyrtohet n\u00eb t\u00ebr\u00ebsi nga Kuvendi i Shqip\u00ebris\u00eb, n\u00eb p\u00ebrputhje me rregullat, parimet kushtetuese dhe legjislacionin n\u00eb fuqi n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji nr. 43\/2020, n\u00eb disa dispozita t\u00eb tij, bie ndesh me nenet 3, 11, 14\/1, 116, 118 t\u00eb Kushtetut\u00ebs dhe nuk \u00ebsht\u00eb n\u00eb harmoni me disa dispozita t\u00eb Kodit t\u00eb Procedur\u00ebs Civile. P\u00ebr k\u00ebto arsye q\u00eb shpjegohen n\u00eb vijim, Presidenti i Republik\u00ebs ka vendosur kthimin e tij n\u00eb Kuvend p\u00ebr rishqyrtim.<\/span><\/p>\n<p><span style=\"color: #000000;\">1.Ligji nr. 43\/2020, duke filluar nga dispozita e p\u00ebrkufizimeve, apo n\u00eb tekstin integral t\u00eb tij p\u00ebrmban terma dhe fjal\u00eb q\u00eb nuk jan\u00eb n\u00eb gjuh\u00ebn shqipe.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb m\u00ebnyr\u00eb joshteruese, po rendisim disa prej k\u00ebtyre termave:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">\u201csurf\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201cwindsurf\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201cwakeboard\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201ckitesurfing\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201cbareboat\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201ckro\u00e7era\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201csurf\u201d-et me vela;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201ckanoat\u201d;<\/span><\/li>\n<li><span style=\"color: #000000;\">\u201con-line\u201d.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Kuptimi i k\u00ebtyre em\u00ebrtimeve sipas p\u00ebrmbajtjes s\u00eb ligjit p\u00ebrb\u00ebn thelbin e tij,pasi nj\u00ebra prej arsyeve kryesore se p\u00ebrse ky ligj \u00ebsht\u00eb propozuar p\u00ebr t\u2019u miratuar,\u00ebsht\u00ebrregullimi i veprimtarive t\u00eb lejueshme n\u00eb zonat kushtuar turizmit detar, q\u00eblidhet pandashm\u00ebrisht edhe me m\u00ebnyr\u00ebn se si duhen ushtruar veprimtariapo sporte t\u00eb caktuara.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligjv\u00ebn\u00ebsi, n\u00eb nenin 3\u00ebsht\u00eb p\u00ebrpjekur t\u00eb jap\u00eb edhe shpjegime n\u00eb form\u00ebn e nj\u00eb p\u00ebrkufizimi p\u00ebr k\u00ebto terma, por k\u00ebto terma nuk jan\u00eb n\u00eb gjuh\u00ebn shqipe, duke b\u00ebr\u00eb q\u00eb k\u00ebto \u00e7\u00ebshtje t\u00eb paraqesinproblemet\u00eb nj\u00eb niveli kushtetues:<\/span><\/p>\n<p><span style=\"color: #000000;\">1.1P\u00ebrdorimi i termave n\u00eb gjuh\u00eb t\u00eb huaj, b\u00ebn q\u00eb ligji n\u00eb t\u00ebr\u00ebsi t\u00eb jet\u00ebn\u00eb kund\u00ebrshtim me nenin 14, paragrafi 1, t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebri, q\u00eb p\u00ebrcakton se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cGjuha zyrtare n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb \u00ebsht\u00eb shqipja.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 14, pika 1, p\u00ebrmban nj\u00eb parim t\u00eb renditur mes parimeve themelore t\u00eb shtetit ton\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrdorimi i em\u00ebrtimeve n\u00eb gjuh\u00eb t\u00eb huaj, n\u00eb nj\u00eb ligj, pra n\u00eb aktin m\u00eb t\u00eb lart\u00eb me fuqi detyruese q\u00eb nxjerr Kuvendi i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, q\u00eb p\u00ebrb\u00ebn aktin zyrtar baz\u00eb pas ligjit themeltar t\u00eb vendit: Kushtetut\u00ebs, jo vet\u00ebm shkel parimin se gjuha zyrtare n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u00ebsht\u00eb gjuha shqipe, por cenon drejtp\u00ebrdrejt\u00eb dhe identitetin komb\u00ebtar, t\u00eb mbrojtur posa\u00e7\u00ebrisht q\u00eb nga preambula e Kushtetut\u00ebs son\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky detyrim kushtetues k\u00ebrkon q\u00eb m\u00eb s\u00eb pari, qeveria dhe Kuvendi i Shqip\u00ebris\u00eb t\u00eb jen\u00eb shum\u00eb t\u00eb kujdessh\u00ebm p\u00ebrgjat\u00eb miratimit t\u00eb ligjeve n\u00eb m\u00ebnyr\u00eb q\u00eb t\u2019i n\u00ebnshtrohet rregullave t\u00eb drejtshkrimit q\u00eb mb\u00ebshteten sa m\u00eb gjer\u00eb n\u00eb trajtat e p\u00ebrbashk\u00ebta t\u00eb gjuh\u00ebs komb\u00ebtare shqipe.<\/span><\/p>\n<p><span style=\"color: #000000;\">1.2P\u00ebrdorimi i em\u00ebrtimeve n\u00eb gjuh\u00eb t\u00eb huaj, duke u p\u00ebrpjekur t\u2019u jepen edhe p\u00ebrkufizime, bie ndesh edhe me \u00e7do rregull t\u00eb teknik\u00ebs legjislative, q\u00eb dispozit\u00ebn e p\u00ebrkufizimeve e njeh si nj\u00eb dispozit\u00ebjo p\u00ebr t\u00eb p\u00ebrkthyer terma t\u00eb huaj n\u00eb nj\u00eb ligj, sikur t\u00eb jet\u00eb fjalor, por p\u00ebr t\u00eb zb\u00ebrthyer p\u00ebr zbatuesin e ligjit, kuptimin e nj\u00eb em\u00ebrtimi gjithmon\u00eb n\u00eb gjuh\u00ebn shqipe, duke dh\u00ebn\u00eb nj\u00eb shpjegim t\u00eb p\u00ebrmbledhur, qoft\u00ebedhe shkencor, t\u00eb p\u00ebrmbajtjes dhe kuptimit t\u00eb nj\u00eb fjale.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb ligj, n\u00eb p\u00ebrmbajtjen e t\u00eb cilit ka em\u00ebrtime jo n\u00eb gjuh\u00ebn shqipe, \u00ebsht\u00eb i papranuesh\u00ebm, qoft\u00eb dhe n\u00ebn k\u00ebndv\u00ebshtrimin e p\u00ebrafrimit t\u00eb legjislacionit n\u00eb kuad\u00ebr t\u00eb proceseve t\u00eb integrimit evropian, procese q\u00eb k\u00ebrkojn\u00eb p\u00ebrputhshm\u00ebri t\u00eb legjislacionit shqiptar me acquis-in, por n\u00eb asnj\u00eb rast huazim t\u00eb em\u00ebrtimeve t\u00eb huaja duke i b\u00ebr\u00eb pjes\u00eb t\u00eb nj\u00eb ligji, dhe p\u00ebr pasoj\u00eb, pjes\u00eb t\u00eb fjalorit t\u00eb brendsh\u00ebm t\u00eb gjuh\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb detyr\u00eb e hartuesit t\u00eb nj\u00eb nisme si vler\u00ebsuesit e miratuesit t\u00eb saj q\u00eb t\u00eb kujdeset p\u00ebr gjuh\u00ebn shqipe n\u00eb nj\u00eb dokument zyrtar.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse p\u00ebr rregullimin e nj\u00eb fushe t\u00eb caktuar, relativisht t\u00eb re p\u00ebr ekonomin\u00eb e vendit ton\u00eb, lind nevoja e p\u00ebrdorimit t\u00eb em\u00ebrtimeve q\u00eb nuk jan\u00eb t\u00eb p\u00ebrafruara n\u00eb gjuh\u00ebn shqipe, ka institucione t\u00eb specializuara q\u00eb mund t\u00eb ndihmojn\u00eb n\u00eb k\u00ebt\u00eb drejtim, duke filluar nga Instituti i Gjuh\u00ebsis\u00eb dhe Let\u00ebrsis\u00eb pran\u00eb Akademis\u00eb s\u00eb Studimeve Albanologjike, katedrat p\u00ebrb\u00ebr\u00ebse t\u00eb fakulteteve t\u00eb gjuh\u00ebs, shkencave sociale, gazetaris\u00eb etj., t\u00eb cilat mund t\u00eb ken\u00eb propozime konkrete p\u00ebr problematika konkrete lidhur me p\u00ebrdorimin e termave n\u00eb ligj sipas standardeve t\u00eb gjuh\u00ebs shqipe, deri te Akademia e Shkencave, q\u00eb sipas ligjit nr. 53\/2019 \u201cP\u00ebr Akademin\u00eb e Shkencave n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, neni 4, ka funksion kryesor t\u00eb nd\u00ebrtoj\u00eb strategji dhe zbatoj\u00eb politika p\u00ebr p\u00ebrdorimin e nj\u00ebsuar t\u00eb gjuh\u00ebs shqipe zyrtare, t\u00eb terminologjive bashk\u00ebkohore t\u00eb shkenc\u00ebs dhe teknik\u00ebs, si dhe p\u00ebr konsolidimin e gjuh\u00ebs shqipe n\u00eb t\u00eb gjitha fushat e shkenc\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, sjell n\u00eb v\u00ebmendje t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb se p\u00ebrgjat\u00eb procesit legjislativ duhet t\u2019u referohet parimeve t\u00eb p\u00ebrcaktuara nga Rezoluta e Kongresit t\u00eb Drejtshkrimit t\u00eb Gjuh\u00ebs Shqipe (viti 1972) ku jan\u00eb p\u00ebrcaktuar qart\u00eb parimet, mbi t\u00eb cilat duhet t\u00eb udh\u00ebhiqet p\u00ebrcaktimi dhe zbatimi i rregullave t\u00eb drejtshkrimit t\u00eb shqipes.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr ta b\u00ebr\u00eb m\u00eb t\u00eb thjesht\u00eb p\u00ebr deputet\u00ebt e Kuvendit t\u00eb Shqip\u00ebris\u00eb dhe qytetar\u00ebt, po p\u00ebrzgjedhim tri fjal\u00eb t\u00eb huaja t\u00eb vendosura n\u00eb k\u00ebt\u00eb ligj. Cila ka qen\u00eb ideja e Kuvendit mbi m\u00ebnyr\u00ebn e leximit n\u00eb shqip t\u00eb fjal\u00ebs \u201csurf\u201d? Do t\u00eb lexohet drejtp\u00ebrdrejt sipas shqiptimit t\u00eb shkronjave shqipeq\u00eb p\u00ebrb\u00ebjn\u00eb k\u00ebt\u00eb fjal\u00eb, apo n\u00eb gjuh\u00ebn angleze ku shqiptimi i k\u00ebsaj fjale \u00ebsht\u00eb \u201cs\u00ebrf\u201d?<\/span><\/p>\n<p><span style=\"color: #000000;\">Po p\u00ebr fjal\u00ebt e p\u00ebrdorura n\u00eb ligj \u201cwindsurf\u201d dhe \u201cwakeboard\u201d, t\u00eb cilat kan\u00eb n\u00eb p\u00ebrb\u00ebrjen e tyre shkronj\u00ebn \u201cw\u201d, shkronj\u00eb kjo q\u00eb nuk p\u00ebrfshihet n\u00eb alfabetin e gjuh\u00ebs shqipe, do t\u00eb lexohen n\u00eb gjuh\u00ebn angleze \u201cuinds\u00ebrf\u201d dhe \u201cueikbord\u201d?<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebto dy shembuj i parashtrohen Kuvendit, p\u00ebr t`i sjell\u00eb n\u00eb v\u00ebmendje r\u00ebnd\u00ebsin\u00ebq\u00eb ka kjo \u00e7\u00ebshtje, q\u00eb nuk mund t\u00eb kaloj\u00eb rutin\u00eb n\u00eb praktik\u00ebn parlamentare, duke vendosur fjal\u00eb t\u00eb huaja n\u00eb tekstin e nj\u00eb ligji. Mbi k\u00ebt\u00eb \u00e7\u00ebshtje \u00ebsht\u00eb e nevojshme q\u00eb Kuvendi i Shqip\u00ebris\u00eb t`u referohet parimeve dhe rregullave t\u00eb vendosura nga Kongresi i Drejtshkrimit t\u00eb Gjuh\u00ebs Shqipe 1972, ku nd\u00ebr t\u00eb tjera p\u00ebrcaktohet se p\u00ebr shkrimin e fjal\u00ebve dhe t\u00eb emrave me prejardhje t\u00eb huaj:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">P\u00ebr fjal\u00ebt me burim nga gjuh\u00ebt klasike, drejtshkrimi i shqipes t\u00eb bazohet n\u00eb trajtat e k\u00ebtyre gjuh\u00ebve dhe jo n\u00eb trajta q\u00eb paraqesin ve\u00e7ori fonetike t\u00eb k\u00ebsaj ose asaj gjuhe, n\u00ebp\u00ebrmjet s\u00eb cil\u00ebs ka ardhur fjala n\u00eb gjuh\u00ebn shqipe.<\/span><\/li>\n<li><span style=\"color: #000000;\">P\u00ebr ata tipa fjal\u00ebsh, shqiptimi letrar i t\u00eb cil\u00ebve \u00ebsht\u00eb i nj\u00ebsuar dhe i p\u00ebrgjith\u00ebsuar me koh\u00eb, ky kriter t\u00eb jet\u00eb vendimtar n\u00eb caktimin e trajt\u00ebs s\u00eb tyre drejtshkrimore; k\u00ebshtu t\u00eb shkruhet: aksion, funksion, bi\u00e7iklet\u00eb, \u00e7imento, kontroll, llogari etj.<\/span><\/li>\n<li><span style=\"color: #000000;\">Tek fjal\u00ebt e huaja q\u00eb kan\u00eb n\u00eb trup t\u00eb tyre: \u201cia\u201d, \u201cie\u201d, \u201cio\u201d, \u201ciu\u201d me \u201ci\u201d t\u00eb patheksuar, t\u00eb ruhet n\u00eb shkrim zanorja \u201ci\u201d, pavar\u00ebsisht nga shqiptimi i saj si \u201cj\u201d n\u00eb disa prej k\u00ebtyre fjal\u00ebve.<\/span><\/li>\n<li><span style=\"color: #000000;\">Emrat e p\u00ebrve\u00e7\u00ebm t\u00eb huaj t\u00eb shkruhen duke u mb\u00ebshtetur n\u00eb tradit\u00ebn e p\u00ebrdorimit t\u00eb tyre n\u00eb gjuh\u00ebn shqipe dhe duke marr\u00eb parasysh shqiptimin n\u00eb gjuh\u00ebn p\u00ebrkat\u00ebse.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Referuar problematik\u00ebs s\u00eb m\u00ebsip\u00ebrme dhe nevoj\u00ebs p\u00ebr p\u00ebrmir\u00ebsimin e k\u00ebtyre \u00e7\u00ebshtjeve, Presidenti i Republik\u00ebs ka vendosur kthimin e ligjit nr. 43\/2020, p\u00ebr rishqyrtim n\u00eb Kuvendin e Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.Ligji nr. 43\/2020 \u201cP\u00ebr aktivitetet e turizmit detar\u201d nuk p\u00ebrcakton rregulla t\u00eb qarta dhe t\u00eb kuptueshme, referuar t\u00eb drejtave dhe detyrimeve q\u00eb kan\u00eb subjektet e k\u00ebtij ligji duke b\u00ebr\u00eb q\u00eb shum\u00eb dispozita t\u00eb tij deleguese p\u00ebr rregullimin e \u00e7\u00ebshtjeve me akte n\u00ebnligjore, t\u00eb jen\u00eb n\u00eb kund\u00ebrshtim me nenin 11 dhe 118 t\u00eb Kushtetut\u00ebs, duke sjell\u00eb dhe implikime q\u00eb lidhen me pasigurin\u00eb juridike dhe cenimin e liris\u00ebs\u00eb veprimtaris\u00eb ekonomike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 118, paragrafi 2 i Kushtetut\u00ebs p\u00ebrcakton se: Ligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrsa objekti i ligjit sipas nenit 1, \u00ebsht\u00eb p\u00ebrcaktimi i:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 rregullave;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 kushtevedhekritereve p\u00ebr veprimtarit\u00eb e turizmit detar;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 i mjeteve lundruese p\u00ebr q\u00ebllime turistike dhe arg\u00ebtim;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 infrastruktur\u00ebs s\u00eb nevojshme p\u00ebr ushtrimin e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi i p\u00ebrmbajtjes s\u00eb disa dispozitave t\u00eb cilat duhet t\u00eb materializonin parashikime t\u00eb qarta, konkrete p\u00ebr p\u00ebrmbushjen e objektit t\u00eb ligjit, konstatohet se n\u00eb k\u00ebto dispozita nuk rregullohet ky objekt n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb.M\u00eb konkretisht:<\/span><\/p>\n<p><span style=\"color: #000000;\">2.1Neni 4, i ligjit, n\u00eb pik\u00ebn 1 t\u00eb tij, rendit cilat jan\u00eb veprimtarit\u00eb turistike detare q\u00eb kryhen n\u00ebp\u00ebrmjet mjeteve lundruese p\u00ebr q\u00ebllime turistike dhe arg\u00ebtimi n\u00eb vij\u00ebn bregdetare, hap\u00ebsir\u00ebn detare dhe n\u00eb uj\u00ebrat e brendshme n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb. Nd\u00ebrsa n\u00eb pik\u00ebn 2, t\u00eb k\u00ebtij neni, p\u00ebrcaktohet se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c2. Rregulla m\u00eb t\u00eb holl\u00ebsishme p\u00ebr zhvillimin e aktiviteteve t\u00eb parashikuara n\u00eb pik\u00ebn 1, t\u00eb k\u00ebtij neni, me p\u00ebrjashtim t\u00eb shkronj\u00ebs \u201cb\u201d, p\u00ebrcaktohen me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave, me propozimin e ministrit p\u00ebrgjegj\u00ebs p\u00ebr turizmin dhe t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr transportet.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Si\u00e7 konstatohet p\u00ebrkundrejt karakterit detyrues t\u00eb objektit t\u00eb ligjit nr. 43\/2020 ku n\u00eb nenin 1 t\u00eb tij, p\u00ebrcaktohet qart\u00eb se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cObjekt i ligjit \u00ebsht\u00eb p\u00ebrcaktimi i rregullave, kushteve dhe kritereve p\u00ebr aktivitetet e turizmit detar, i mjeteve lundruese p\u00ebr q\u00ebllime turistike dhe arg\u00ebtim, infrastruktur\u00ebs s\u00eb nevojshme p\u00ebr ushtrimin e tyre dhe p\u00ebrcaktimi i p\u00ebrgjegj\u00ebsive institucionale p\u00ebr k\u00ebt\u00eb fush\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, n\u00eb nenin 4 po t\u00eb k\u00ebtij ligji nuk p\u00ebrcakohet asnj\u00eb rregull, kusht apo kriter, porkjo detyr\u00eb delegohet te K\u00ebshilli i Ministrave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mungesa e qart\u00ebsis\u00eb s\u00eb vullnetit t\u00eb shprehur t\u00eb ligjv\u00ebn\u00ebsit, q\u00eb rregullat q\u00eb duhet t\u00eb p\u00ebrcaktohen n\u00eb ligj, ia ka deleguar p\u00ebr rregullim me akt n\u00ebnligjor K\u00ebshillit t\u00eb Ministrave, pa p\u00ebrcaktuar \u00e7\u00ebshtjet konkrete q\u00eb duhen rregulluar dhe parimet q\u00eb do t\u00eb udh\u00ebheqin nxjerrjen e k\u00ebtyre rregullave, jo vet\u00ebm q\u00eb cenon k\u00ebrkesat e nenit 118, paragrafi 2, i Kushtetut\u00ebs, porkrijon dhe nj\u00eb gjendje t\u00eb theksuar pasigurieligjore p\u00ebr operator\u00ebt e veprimtarive t\u00eb turizmit detar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo gjendje pasigurie do t\u2019i shoq\u00ebroj\u00eb ata, sepse n\u00eb \u00e7do koh\u00eb rregullat mund t\u00eb ndryshojn\u00eb, aq shpesh, duke rritur edhe rrezikune trajtimit preferencial se cil\u00ebt nga k\u00ebta operator\u00eb do t\u00eb mb\u00ebshteten mbi kriteret subjektive q\u00eb qeveria her\u00eb pas here mund t\u2019i ndryshoj\u00eb, sipas vullnetit politik t\u00eb koh\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.2 Neni 5i ligjit parashikon seveprimtarit\u00eb e turizmit detar p\u00ebr q\u00ebllime \u00e7lodh\u00ebse dhe arg\u00ebtuese, me p\u00ebrjashtim t\u00eb peshkimit turistik, ofrohen vet\u00ebm nga operator\u00ebt e turizmit detar t\u00eb licencuar dhe q\u00eb ofrojn\u00eb p\u00ebr klient\u00ebt sh\u00ebrbime p\u00ebr ushtrimin e veprimtarive t\u00eb p\u00ebrcaktuara nga ky ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pika 2 e k\u00ebtij neni p\u00ebrcakton seoperatori i turizmit detar \u00ebsht\u00eb operatori turistik i licencuar n\u00eb p\u00ebrputhje me ligjin p\u00ebr turizmin, ligjin p\u00ebr licencat, autorizimet dhe lejet n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb dhe parashikimet e k\u00ebtij ligji, me kusht q\u00eb t\u00eb ofroj\u00eb sh\u00ebrbime p\u00ebr, t\u00eb pakt\u00ebn, nj\u00eb nga veprimtarit\u00eb e p\u00ebrcaktuara n\u00eb pik\u00ebn 1, t\u00eb nenit 3, t\u00eb k\u00ebtij ligji.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrsa pika 3 e k\u00ebtij neni sanksionon: \u201cOperatori i turizmit detar, para fillimit t\u00eb aktiviteteve t\u00eb turizmit detar, pajiset me certifikat\u00eb p\u00ebr ushtrimin e k\u00ebtyre veprimtarive nga ministria p\u00ebrgjegj\u00ebse p\u00ebr turizmin. Kriteret dhe procedura p\u00ebr certifikimin p\u00ebrcaktohen me udh\u00ebzim t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr turizmin.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky nen, n\u00eb pik\u00ebn 2 t\u00eb tij b\u00ebn nj\u00eb referim t\u00eb gabuarn\u00eb nenin 3 t\u00eb ligjit, pasi neni 3 p\u00ebrmban dispozit\u00ebn e p\u00ebrkufizimeve, dhe nuk p\u00ebrcakton list\u00ebn e veprimtarive turistike detare. Kjo list\u00eb p\u00ebrcaktohet n\u00eb nenin 4 t\u00eb ligjit. Megjithat\u00eb, p\u00ebrve\u00e7se k\u00ebtij gabimi n\u00ebreferencat e brendshme gjat\u00eb zbardhjes s\u00eb ligjit, kjo dispozit\u00eb, me parashikimin e pik\u00ebs 3 t\u00eb saj, q\u00eb delegon te ministri p\u00ebrgjegj\u00ebs p\u00ebr turizmin p\u00ebrcaktimin e kritereve dhe procedurave p\u00ebr certifikimin e operator\u00ebve turistik\u00eb, pa p\u00ebrcaktuar vet\u00eb asnj\u00eb kriter apo parim qoft\u00eb dhe orientues p\u00ebr k\u00ebt\u00eb organ, cenon nenin 118, paragrafi 2, i Kushtetut\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky lloj delegimi i pakufizuar dhe shmangia nga p\u00ebrcaktimi n\u00eb k\u00ebt\u00eb ligj i kritereve dhe procedurave t\u00eb certifikimit, q\u00eb lidhen direkt me t\u00eb drejt\u00ebn p\u00ebr t\u00eb ushtruar veprimtarin\u00eb si operator i turizmit detar, krijon pasiguri juridike p\u00ebr ndryshimin e k\u00ebtyre kritereve dhe procedurave sipas vullnetit politik t\u00eb nj\u00eb ministri, duke sjell\u00eb implikime direkte ndaj liris\u00eb s\u00eb veprimtaris\u00eb ekonomike, t\u00eb mbrojtur nga neni 11 i Kushtetut\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb e qart\u00eb se p\u00ebrmes k\u00ebtij ligji, Kuvendi i Shqip\u00ebris\u00eb ka hequr dor\u00eb nga ushtrimi i p\u00ebrgjegj\u00ebsive t\u00eb veta kushtetuese, pasi \u00e7do parim, kusht dhe kriter q\u00eb do t\u00eb duhej ta p\u00ebrcaktonte me ligj, ia ka l\u00ebn\u00eb n\u00eb dor\u00eb qeveris\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pajustifikuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Krijimi i k\u00ebsaj hap\u00ebsire vepruese p\u00ebr qeverin\u00eb, bie ndesh me nenin 118, paragrafi 2 i Kushtetut\u00ebs q\u00eb p\u00ebrcakton se: Ligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluarsi dhe parimet, n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.3Neni 24 i ligjit nr. 43\/2020 q\u00eb trajton kundravajtjet administrative dhe m\u00ebnyr\u00ebn se si masat administrative nd\u00ebshkimore do t\u00eb aplikohen, bie ndesh me dispozitat e Kodit t\u00eb Procedur\u00ebs Civile, dhe paraqet problematik\u00eb dhe pasiguri t\u00eb theksuar juridike. P\u00ebr m\u00eb tep\u00ebr, procedura ligjore se si do t\u00eb aplikohet nj\u00eb mas\u00eb administrative e heqjes s\u00eb lejes\/licenc\u00ebs\/certifikat\u00ebs, nuk \u00ebsht\u00eb parashikuar n\u00ebk\u00ebt\u00eb ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr shkak se si \u00ebsht\u00eb formuluar pika 3 e k\u00ebtij neni, sanksionet administrative me gjob\u00eb p\u00ebr ato raste q\u00eb jan\u00eb vler\u00ebsuar nga ligjv\u00ebn\u00ebsi si veprime q\u00eb duhen penalizuar, rrezikojn\u00eb t\u00eb mbeten t\u00eb paaplikueshme. Citojm\u00eb se kjo pik\u00eb p\u00ebrcakton konkretisht: \u201cSubjektet e gjobitura paguajn\u00eb gjob\u00ebn brenda 10 dit\u00ebve, nga data kur vendimi i d\u00ebnimit me gjob\u00eb \u00ebsht\u00eb b\u00ebr\u00eb titull ekzekutiv\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ekzekutimi i detyruesh\u00ebm i titujve ekzekutiv\u00eb p\u00ebrcaktohet n\u00eb nenin 510 e vijues t\u00eb Kodit t\u00eb Procedur\u00ebs Civile.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vet\u00eb neni 510 i k\u00ebtij Kodi, p\u00ebrcakton se, ekzekutimi i detyruesh\u00ebm mund t\u00eb b\u00ebhet vet\u00ebm n\u00eb baz\u00eb t\u00eb nj\u00eb titulli ekzekutiv. Cilat jan\u00eb aktet q\u00eb p\u00ebrb\u00ebjn\u00eb titull ekzekutiv, renditen n\u00eb m\u00ebnyr\u00eb shteruese n\u00eb k\u00ebt\u00eb nen t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, q\u00eb n\u00eb shkronj\u00ebn \u201ce)\u201d, t\u00eb tij ka p\u00ebrcaktuar se, titull ekzekutiv jan\u00eb dhe \u201caktet e tjera q\u00eb sipas ligjeve t\u00eb ve\u00e7anta quhen tituj ekzekutiv\u00eb\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndaj n\u00ebse synimi i ligjv\u00ebn\u00ebsit \u00ebsht\u00eb q\u00eb gjobat p\u00ebr kundravajtjet administrative t\u00eb kryera n\u00eb shkelje t\u00eb parashikimeve t\u00eb k\u00ebtij ligji, t`i konsideroj\u00eb si \u201ctituj ekzekutiv\u00eb\u201d p\u00ebr t\u2019ua n\u00ebnshtruar m\u00eb pas procesit t\u00eb ekzekutimit t\u00eb detyruesh\u00ebm p\u00ebr vjeljen e tyre, do t\u00eb duhej ta p\u00ebrcaktonte qart\u00eb n\u00eb ligj, n\u00ebse k\u00ebto gjoba, jan\u00eb ose jo titull ekzekutiv.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por n\u00ebse ligji nuk e p\u00ebrcakton n\u00eb k\u00ebt\u00eb form\u00eb, vendimi i d\u00ebnimit me gjob\u00eb b\u00ebhet titull ekzekutiv, pasi akti administrativ p\u00ebr v\u00ebnien e gjob\u00ebs i \u00ebsht\u00eb n\u00ebnshtruar shqyrtimit gjyq\u00ebsor t\u00eb themelit dhe vendimi gjyq\u00ebsor ka marr\u00eb form\u00eb t\u00eb prer\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb rast, p\u00ebr sa koh\u00eb q\u00eb b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb gjykim administrativ, sipas nenit 65, t\u00eb ligjit nr. 49\/2012 \u201cP\u00ebr gjykatat administrative dhe gjykimin e mosmarr\u00ebveshjeve administrative\u201d, i ndryshuar, vendimi p\u00ebrfundimtar i gjykat\u00ebs administrative, q\u00eb ka marr\u00eb form\u00eb t\u00eb prer\u00eb, vihet direkt n\u00eb ekzekutim nga p\u00ebrmbaruesi gjyq\u00ebsor me k\u00ebrkes\u00ebn e kreditorit, duke nisur k\u00ebshtu po direkt ekzekutimi i detyruesh\u00ebm, pa l\u00ebn\u00eb mund\u00ebsin\u00eb p\u00ebr pagimin e gjob\u00ebs \u201cbrenda fatit 10 ditor\u201d si\u00e7 p\u00ebrcakton pika 3, e nenit 24, t\u00eb ligjit nr. 43\/2020.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndaj edhe kjo dispozit\u00eb ka nevoj\u00eb p\u00ebr t\u2019u qart\u00ebsuar dhe p\u00ebr t\u2019u riformuluar n\u00eb koherenc\u00eb me parashikimet e legjislacionit n\u00eb fuqi, pasi me p\u00ebrmbajten e paqart\u00eb t\u00eb saj, krijon pasiguri juridike dhe rrezikon q\u00eb gjat\u00eb zbatimit n\u00eb praktik\u00eb, masat nd\u00ebshkuese administrative t\u00eb aplikohen n\u00eb m\u00ebnyr\u00eb preferenciale ndaj operator\u00ebve t\u00eb ndrysh\u00ebm q\u00eb do t\u00eb operojn\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb fjalia e fundit e pik\u00ebs 3, po t\u00eb nenit 24, ka nj\u00eb problematik\u00eb t\u00eb nj\u00eb natyre tjer\u00ebr, edhe m\u00eb t\u00eb paqart\u00eb. N\u00eb k\u00ebt\u00eb fjali parashikohet se: \u201cN\u00eb rast p\u00ebrs\u00ebritje t\u00eb shkeljeve t\u00eb m\u00ebsip\u00ebrme, subjektet u n\u00ebnshtrohen procedurave ligjore deri n\u00eb shfuqizimin e lejes\/licenc\u00ebs\/certifikat\u00ebs p\u00ebrkat\u00ebse\u201d.Por ky ligj nuk parashikon asnj\u00eb procedur\u00eb apo mjetet e ankimit se si mund t\u00eb zhvillohet ky proces administrativ deri n\u00eb vendimmarrjen p\u00ebrfundimtare p\u00ebr heqjen e lejes\/licenc\u00ebs\/certifikat\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">2.5 T\u00eb nj\u00ebjt\u00ebn nevoj\u00eb p\u00ebr rishikim ka dhe dispozita e nenit 27 q\u00eb parashikon se: \u201c\u00c7do dispozit\u00eb e akteve ligjore, q\u00eb bie ndesh me parashikimet e k\u00ebtij ligji, shfuqizohet dhe institucionet p\u00ebrgjegj\u00ebse ngarkohen p\u00ebr rishikimin e kuadrit ligjor n\u00eb fuqi.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb parashikim i till\u00eb, shkel nenin 116 t\u00eb Kushtetut\u00ebs q\u00eb p\u00ebrcakton hierarkin\u00eb e akteve ligjore n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb. Sjellim n\u00eb v\u00ebmendjen tuaj se, nj\u00eb pjes\u00eb e akteve ligjore jan\u00eb t\u00eb miratuara me shumic\u00eb t\u00eb cil\u00ebsuar.N\u00ebse k\u00ebto akte t\u00eb miratuara me #000000;\">P\u00ebrkundrazi, p\u00ebr shkak t\u00eb hierarkis\u00eb s\u00eb akteve sipas s\u00eb cil\u00ebs jan\u00eb miratuar, hierarki q\u00eb e ka p\u00ebrcaktuar vet\u00eb Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, kan\u00eb p\u00ebrpar\u00ebsi n\u00eb zbatim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana tjet\u00ebr, nj\u00eb formulim i till\u00eb nxjerr n\u00eb pah nxitimin n\u00eb procesin e ligjb\u00ebrjes, kur p\u00ebr hartimin, propozimin dhe miratimin e ligjeve t\u00eb reja nuk b\u00ebhet nj\u00ebanaliz\u00eb e mir\u00ebfillt\u00eb e ndikimit t\u00eb nism\u00ebs, jo vet\u00ebm n\u00eb terma t\u00eb ndikimit n\u00eb mjedis, ndikimit ekonomik apo social, por edhe ndikimin n\u00eb legjislacionin n\u00eb fuqi.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb miratimin e ligjeve t\u00eb reja q\u00eb rregullojn\u00eb fusha t\u00eb parregulluara m\u00eb par\u00eb, \u00ebsht\u00eb domosdoshm\u00ebri identifikimi i akteve n\u00eb fuqi q\u00eb preken, p\u00ebr t\u00eb vler\u00ebsuar n\u00eb koh\u00eb nevoj\u00ebn e ndryshimit t\u00eb tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky \u00ebsht\u00eb element i r\u00ebnd\u00ebsish\u00ebm q\u00eb s\u00ebrish lidhet me sigurin\u00eb juridike t\u00eb normave t\u00eb reja dhe atyre n\u00eb fuqi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sepse lind pyetja:P\u00ebrve\u00e7 Kuvendit t\u00eb Shqip\u00ebris\u00eb, cili \u00ebsht\u00eb autoriteti tjet\u00ebr q\u00eb mund t\u00eb arrij\u00eb n\u00eb nj\u00eb vler\u00ebsim, n\u00ebse nj\u00eb ligj detare, paraqitet jo i plot\u00eb p\u00ebr sa koh\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Cenon nenin 3, 11, 14, 116, dhe 118 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Cenon parimin e veprimtaris\u00eb dhe liris\u00eb ekonomike dhe t\u00eb hierarkis\u00eb s\u00eb akteve n\u00eb m\u00eb lart, n\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb zbatim t\u00eb nenit 85, pika 1, t\u00eb saj, kam vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr. 43\/2020 \u201cP\u00ebr aktivitetet e turizmit detar\u201d, pasi ky ligj bie ndesh me parimet e mbrojtura nga Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sa m\u00eb sip\u00ebr, jan\u00eb shqet\u00ebsime q\u00eb duhet t\u00eb merren n\u00eb konsiderat\u00eb nga ligjv\u00ebn\u00ebsit gjat\u00eb rishqyrtimit t\u00eb k\u00ebtij ligji, duke mbajtur n\u00eb v\u00ebmendje nevoj\u00ebn p\u00ebr p\u00ebrcaktimin e rregullave t\u00eb qarta dhe transparente n\u00eb rregullimin e veprimtarive t\u00eb turizmit detar, si nj\u00eb fush\u00eb e r\u00ebnd\u00ebsishme e ekonomis\u00eb s\u00eb nj\u00eb vendi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Shqet\u00ebsimet p\u00ebr t\u00eb cilat ky ligj kthehet p\u00ebr rishqyrtim, duhen mbajtur n\u00eb v\u00ebmendje p\u00ebr procesin ligjb\u00ebr\u00ebs n\u00eb vazhdim\u00ebsi, duke i kushtuar r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb gjuh\u00ebs s\u00eb akteve t\u00eb miratuara,
