Miratimi i k\u00ebtij akti normativ n\u00eb shkelje t\u00eb procedur\u00ebs kushtetuese dhe t\u00eb disa t\u00eb drejtave dhe parimeve themelore t\u00eb mbrojtura nga Kushtetuta.<\/p>\n<p><strong>II.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d,<strong> bie ndesh me nenin 7 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/strong><\/p>\n<p><strong>III.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d,<strong> i miratuar n\u00eb kund\u00ebrshtim me nenin 7 dhe k\u00ebrkesat e nenit 101 t\u00eb Kushtetut\u00ebs<\/strong>, ka b\u00ebr\u00eb q\u00eb t\u00eb shkelen dhe neni 30 i Kushtetut\u00ebs, q\u00eb sanksionon parimin e prezumimit t\u00eb pafaj\u00ebsis\u00eb, parim q\u00eb mbrohet edhe nga Neni 6 (2) i Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut dhe Neni 11 (1) i Deklarat\u00ebs Universale t\u00eb t\u00eb Drejtave t\u00eb Njeriut, si dhe neni 41 i Kushtetut\u00ebs.<\/p>\n<p><strong>IV.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d, <strong>bie ndesh me nenin 17 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/strong><\/p>\n<p><strong>V.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d,<strong> bien ndesh me nenin 27 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/strong><\/p>\n<p><strong>VI.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d, <strong>bie ndesh me nenin 42 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/strong><\/p>\n<p><strong>VII.<\/strong> Ligji nr. 18\/2020 \u201cP\u00ebr miratimin e aktit normativ, me fuqin\u00eb e ligjit, nr. 1, dat\u00eb 31.1.2020, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u2018P\u00ebr masat parandaluese n\u00eb kuad\u00ebr t\u00eb forcimit t\u00eb luft\u00ebs kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimeve t\u00eb r\u00ebnda dhe konsolidimit t\u00eb rendit e siguris\u00eb publike\u201d\u201d, t\u00eb ndryshuar\u2019\u201d, <strong>bie ndesh me nenin 135, paragrafi 2, nenin 148\/2 dhe nenin 149\/\u00e7 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/strong><\/p>\n<p><strong>VIII.Mungesa e konsultimit<\/strong><br \/>\nNisma e nxituar p\u00ebr miratimin e k\u00ebtyre rregullave, ka shmangur procesin e konsultimit publik, t\u00eb sanksionuar me ligj t\u00eb posa\u00e7\u00ebm.
