Dekretit 11457<\/span><\/p>\n<p><span style=\"color: #000000;\">Tiran\u00eb, m\u00eb 26.03.2020<\/span><\/p>\n<p><span style=\"color: #000000;\">PRESIDENTI I REPUBLIK\u00cbS<\/span><\/p>\n<p><span style=\"color: #000000;\">ILIR META<\/span><\/p>\n<p><span style=\"color: #000000;\">ARSYET E KTHIMIT<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00cb LIGJIT NR. 20\/2020 \u201cP\u00cbR P\u00cbRFUNDIMIN E PROCESEVE KALIMTARE T\u00cb PRON\u00cbSIS\u00cb N\u00cb REPUBLIK\u00cbN E SHQIP\u00cbRIS\u00cb\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb nderuar deputet\u00eb t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb,<\/span><\/p>\n<p><span style=\"color: #000000;\">Kuvendi i Shqip\u00ebris\u00eb, n\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs 5 mars 2020, ka miratuar ligjin nr. 20\/2020 \u201cP\u00ebr p\u00ebrfundimin e proceseve kalimtare t\u00eb pron\u00ebsis\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d. Ky ligj n\u00eb dat\u00ebn 10.03.2020 i \u00ebsht\u00eb p\u00ebrcjell\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo nism\u00eb ligjore nuk kaloi p\u00ebr miratim si paket\u00eb bashk\u00eb me ligjin nr. 111\/2018 \u201cP\u00ebr Kadastr\u00ebn\u201d, si\u00e7 u propozua, nd\u00ebrkoh\u00eb q\u00eb u k\u00ebrkua opinioni i Komisionit t\u00eb Venecias p\u00ebr dispozita t\u00eb projektligjit, t\u00eb cilat kishin t\u00eb b\u00ebnin me kriteret p\u00ebr konfirmimin e t\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb p\u00ebr tok\u00ebn bujq\u00ebsore p\u00ebr personat q\u00eb dispononin Akte t\u00eb Marrjes s\u00eb Tok\u00ebs n\u00eb Pron\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ligj ka t\u00eb deklaruar si q\u00ebllim t\u00eb tij krijimin e baz\u00ebs ligjore t\u00eb thjeshtuar e t\u00eb harmonizuar p\u00ebr p\u00ebrfundimin e proceseve kalimtare administrativo- ligjore t\u00eb trajtimit t\u00eb pron\u00ebs s\u00eb paluajtshme t\u00eb shtetit dhe pron\u00ebs private, q\u00ebllim ky i mir\u00ebpritur nga Presidenti i Republik\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs vler\u00ebsoi p\u00ebrputhshm\u00ebrin\u00eb e ligjit nr. 20\/2020 \u201cP\u00ebr p\u00ebrfundimin e proceseve kalimtare t\u00eb pron\u00ebsis\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d me Kushtetut\u00ebn dhe kuadrin ligjor n\u00eb fuqi dhe n\u00eb p\u00ebrfundim t\u00eb shqyrtimit, \u00e7mon se disa nene t\u00eb k\u00ebtij ligji duhen rishikuar nga Kuvendi i Shqip\u00ebris\u00eb, pasi p\u00ebrmbajtja e tyre n\u00eb formulimin aktual:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 cenon parimin e siguris\u00eb juridike;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 bie ndesh me dispozita kushtetuese;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 rrezikon t\u00eb krijoj\u00eb tension kushtetues;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 si dhe nuk \u00ebsht\u00eb n\u00eb harmoni me jurisprudenc\u00ebn e Gjykat\u00ebs Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebto arsye, n\u00eb bindje t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs s\u00eb parashikuar n\u00eb pik\u00ebn 1, t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs ka vendosur q\u00eb ligji nr. 20\/2020 \u201cP\u00ebr p\u00ebrfundimin e proceseve kalimtare t\u00eb pron\u00ebsis\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, i duhet kthyer p\u00ebr rishqyrtim Kuvendit, me q\u00ebllim rishikimin dhe p\u00ebrmir\u00ebsimin e tij n\u00eb disa dispozita, mb\u00ebshtetur n\u00eb argumentet e renditura si m\u00eb posht\u00eb.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">P\u00ebrcaktimi i nenit 12, pika 1, shkronja \u201ca\u201d, n\u00ebnparagrafi \u201ciii\u201d, mbivendoset dhe trajton pik\u00ebrisht disa prej \u00e7\u00ebshtjeve q\u00eb trajtohen dhe jan\u00eb objekt dhe q\u00ebllim i ligjit nr. 133\/2015 \u201cP\u00ebr trajtimin e pron\u00ebs dhe p\u00ebrfundimin e procesit t\u00eb kompensimit t\u00eb pronave\u201d.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">N\u00eb nenin 12, pika 1, shkronja \u201ca\u201d, n\u00ebnparagrafi \u201ciii\u201d, p\u00ebrcaktohet se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c1. P\u00ebrfitojn\u00eb kalimin n\u00eb pron\u00ebsi, pa shp\u00ebrblim, t\u00eb tok\u00ebs bujq\u00ebsore, subjektet q\u00eb plot\u00ebsojn\u00eb, nj\u00ebkoh\u00ebsisht, k\u00ebto kushte:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">a) jan\u00eb p\u00ebrfitues t\u00eb tok\u00ebs n\u00eb pron\u00ebsi ose p\u00ebrdorim, sipas akteve n\u00ebnligjore q\u00eb kan\u00eb rregulluar marr\u00ebdh\u00ebniet juridike t\u00eb ndarjes apo dh\u00ebnies n\u00eb p\u00ebrdorim t\u00eb tok\u00ebs bujq\u00ebsore t\u00eb vitit 1991 e n\u00eb vazhdim. Subjekte p\u00ebrfituese jan\u00eb edhe:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">[\u2026] iii) personat q\u00eb iu \u00ebsht\u00eb hequr e drejta e pron\u00ebsis\u00eb me krijimin e ish-kooperativave bujq\u00ebsore apo ish-nd\u00ebrmarrjeve bujq\u00ebsore, ose trash\u00ebgimtar\u00ebt e tyre\u201d;\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb edhe ligji nr. 133\/2015, si q\u00ebllim t\u00eb tij ka pik\u00ebrisht \u201cp\u00ebrfundimin, n\u00eb p\u00ebrputhje me k\u00ebt\u00eb ligj, t\u00eb procesit t\u00eb trajtimit n\u00ebp\u00ebrmjet njohjes dhe kompensimit t\u00eb pronave t\u00eb subjekteve, t\u00eb cilave u jan\u00eb shpron\u00ebsuar, shtet\u00ebzuar ose konfiskuar pronat, sipas akteve ligjore e n\u00ebnligjore, vendimeve penale t\u00eb gjykatave ose t\u00eb marra me \u00e7do m\u00ebnyr\u00eb tjet\u00ebr t\u00eb padrejt\u00eb nga shteti komunist prej dat\u00ebs 29.11.1944\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra duket sikur p\u00ebrmes nenit 12, pika 1, shkronja \u201ca\u201d, n\u00ebnparagrafi \u201ciii\u201d, t\u00eb ligjit nr. 20\/2020, Kuvendi ka dashur q\u00eb p\u00ebrfshij\u00eb edhe njohjen dhe rikthimin e pron\u00ebs s\u00eb shtet\u00ebzuar gjat\u00eb procesit t\u00eb krijimit t\u00eb kooperativave bujq\u00ebsore apo nd\u00ebrmarrjeve bujq\u00ebsore, nd\u00ebrkoh\u00eb q\u00eb trajtimi i t\u00eb drejtave pron\u00ebsore t\u00eb hequra n\u00eb \u00e7do m\u00ebnyr\u00eb t\u00eb padrejt\u00eb nga shteti, pas dat\u00ebs 29.11.1944 \u00ebsht\u00eb \u00e7\u00ebshtje e nj\u00eb natyre t\u00eb ndryshme dhe i takon p\u00ebr trajtim nj\u00eb organi tjet\u00ebr si Agjencia e Trajtimit t\u00eb Pronave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky konstatim rezulton i evientuar s\u00ebrish edhe n\u00eb dispozitat tranzitore, neni 68, pika 6, t\u00eb ligjit nr. 20\/2020, ku p\u00ebrcaktohet pik\u00ebrisht se: \u201cP\u00ebr zbatimin e kreut II, t\u00eb k\u00ebtij ligji, bashkit\u00eb dhe DAMT-t\u00eb pran\u00eb k\u00ebshillave t\u00eb qarqeve i dor\u00ebzojn\u00eb ASHK-s\u00eb respektivisht kopje t\u00eb dokumentacionit arkivor p\u00ebr procesin e ndarjes s\u00eb tok\u00ebs bujq\u00ebsore dhe t\u00eb hartave\/regjistrave t\u00eb kadastr\u00ebs s\u00eb tok\u00ebs nga viti 1991 e n\u00eb vazhdim. K\u00ebto organe dor\u00ebzojn\u00eb gjithashtu kopje t\u00eb list\u00eb-pron\u00ebsive dhe dokumentacionit t\u00eb reform\u00ebs agrare t\u00eb vitit 1946 [\u2026].\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra pik\u00ebrisht at\u00eb dokumentacion q\u00eb \u00ebsht\u00eb krijuar nga aplikimi i reform\u00ebs agrare 1946, pasuria objekt e s\u00eb cil\u00ebs \u00ebsht\u00eb fush\u00eb e veprimtaris\u00eb, q\u00ebllimit dhe objektit t\u00eb ligjit nr. 133\/2015 \u201cP\u00ebr trajtimin e pron\u00ebs dhe p\u00ebrfundimin e procesit t\u00eb kompensimit t\u00eb pronave\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Edhe pse t\u00eb dy k\u00ebto procese, q\u00eb kan\u00eb lidhje me konsolidimin e t\u00eb drejtave pron\u00ebsore mbi tok\u00ebn nga nj\u00ebra an\u00eb njohja dhe kompensimi i pron\u00ebs, dhe nga ana tjet\u00ebr kalimi n\u00eb pron\u00ebsi e tok\u00ebs bujq\u00ebsore p\u00ebr \u00e7\u00ebshtjet e ngelura pezull nga zbatimi i ligjit nr. 7501\/1991, jan\u00eb procese q\u00eb trajtojn\u00eb fasha t\u00eb ndryshme t\u00eb subjekteve p\u00ebrfitues, q\u00eb duhet t\u00eb p\u00ebrfundojn\u00eb sa m\u00eb par\u00eb, dhe p\u00ebr t\u00eb cilat Kuvendi ka vendosur q\u00eb k\u00ebto dy procese do t\u00eb realizohen nga institucione t\u00eb ndara nga njeri- tjetri, por n\u00eb koordinim dhe bashk\u00ebpunim institucional midis tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Aq e fort\u00eb ka qen\u00eb kjo qasje nd\u00ebr vite, saq\u00eb Kuvendi s\u00ebrish n\u00eb nenin 56 t\u00eb ligjit nr. 20\/2020 objekt shqyrtimi, ka p\u00ebrs\u00ebritur se: \u201cP\u00ebrfundimi i procesit t\u00eb njohjes dhe kompensimit p\u00ebr subjektet, t\u00eb cilave u jan\u00eb shpron\u00ebsuar, shtet\u00ebzuar ose konfiskuar pronat, sipas akteve ligjore e n\u00ebnligjore, vendimeve penale t\u00eb gjykatave, ose q\u00eb u jan\u00eb marr\u00eb me \u00e7do m\u00ebnyr\u00eb tjet\u00ebr, t\u00eb padrejt\u00eb, nga shteti komunist, prej dat\u00ebs 29.11.1944, realizohet nga Agjencia e Trajtimit t\u00eb Pron\u00ebs, sipas rregullave t\u00eb p\u00ebrcaktuara n\u00eb legjislacionin p\u00ebr trajtimin e pron\u00ebs dhe p\u00ebrfundimin e procesit t\u00eb kompensimit t\u00eb pronave\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, \u00ebsht\u00eb e nevojshme q\u00eb parashikimi i b\u00ebr\u00eb n\u00eb nenin 12 t\u00eb ligjit nr. 20\/2020 t\u00eb rivler\u00ebsohet edhe nj\u00eb her\u00eb n\u00ebse duhet t\u00eb jet\u00eb ose jo, pjes\u00eb e ligjit nr. 20\/2020. Kjo dispozit\u00eb e vendosur apo renditur n\u00eb m\u00ebnyr\u00eb t\u00eb gabuar n\u00eb dispozitat e k\u00ebtij ligji do t\u00eb krijonte pasoja t\u00eb r\u00ebnda, dhe mbivendosje kompetencash midis dy organeve, \u00e7ka do t\u00eb sillte ve\u00e7 t\u00eb tjerash, trajtimin e subjekteve t\u00eb t\u00eb nj\u00ebjtit ligj n\u00eb m\u00ebnyr\u00eb t\u00eb pabarabart\u00eb dhe krejt\u00ebsisht t\u00eb ndryshme, duke shkaktuar diskriminim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata Kushtetuese, n\u00ebp\u00ebrmjet jurisprudenc\u00ebs s\u00eb saj, n\u00eb disa vendime ka interpretuar nenin 18 t\u00eb Kushtetut\u00ebs, si dhe ka theksuar se parimi i barazis\u00eb synon q\u00eb t\u00eb gjith\u00eb t\u00eb jen\u00eb t\u00eb barabart\u00eb n\u00eb\/p\u00ebrpara ligjit, jo vet\u00ebm n\u00eb t\u00eb drejtat themelore t\u00eb parashikuara n\u00eb Kushtetut\u00eb, por edhe n\u00eb t\u00eb drejtat e tjera ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht, ajo \u00ebsht\u00eb shprehur se: \u201cBarazia n\u00eb ligj dhe para ligjit nuk do t\u00eb thot\u00eb q\u00eb t\u00eb ket\u00eb zgjidhje t\u00eb nj\u00ebllojta p\u00ebr individ\u00eb, ose kategori personash q\u00eb jan\u00eb n\u00eb kushte objektivisht t\u00eb ndryshme. Barazia para ligjit dhe n\u00eb ligj presupozon barazin\u00eb e individ\u00ebve q\u00eb jan\u00eb n\u00eb kushte t\u00eb barabarta\u201d, si dhe \u201cVet\u00ebm n\u00eb raste p\u00ebrjashtimore dhe p\u00ebr shkaqe t\u00eb arsyeshme e objektive mund t\u00eb p\u00ebrligjet trajtimi i ndrysh\u00ebm i kategorive t\u00eb caktuara q\u00eb p\u00ebrfitojn\u00eb nga kjo e drejt\u00eb\u201d.[1]<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb rikujtojm\u00eb se, ligji nr. 133\/2015, \u00ebsht\u00eb nj\u00eb ligj q\u00eb \u00ebsht\u00eb miratuar n\u00eb mb\u00ebshtetje t\u00eb neneve 41, 78, 83, pika 1, dhe 181 t\u00eb Kushtetut\u00ebs. Ve\u00e7an\u00ebrisht neni 181 autorizonte Kuvendin p\u00ebr rregullimin e drejt\u00eb t\u00eb \u00e7\u00ebshtjeve t\u00eb ndryshme q\u00eb lidhen me shpron\u00ebsimet dhe konfiskimet e kryera para miratimit t\u00eb k\u00ebsaj Kushtetute, duke u udh\u00ebhequr nga kriteret e nenit 41.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Neni 24 i ligjit, i p\u00ebrfshir\u00eb brenda kreut t\u00eb ligjit q\u00eb rregullon procesin e legalizimit t\u00eb objekteve informale, ka nj\u00eb problematik\u00eb t\u00eb theksuar lidhur me p\u00ebrputhshm\u00ebrin\u00eb me parashikimet kushtetuese sa i takon respektimit t\u00eb s\u00eb drejtave t\u00eb pron\u00ebsis\u00eb dhe d\u00ebmshp\u00ebrblimin e drejt\u00eb n\u00eb rast shpron\u00ebsimi.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Ky nen q\u00eb parashikon procedurat e kompensimit t\u00eb pronar\u00ebve t\u00eb trojeve t\u00eb z\u00ebna q\u00eb kompesohen, nuk jep asnj\u00eb afat garancie p\u00ebr shp\u00ebrblimin e pronarit, prona e t\u00eb cilit \u00ebsht\u00eb e z\u00ebn\u00eb nga nj\u00eb nd\u00ebrtim informal q\u00eb u n\u00ebnshtrohet procedurave dhe legalizohet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra askush nga pronar\u00ebt e pasurive pron\u00eb private truall, q\u00eb g\u00ebzojn\u00eb nj\u00eb t\u00eb drejt\u00eb pron\u00ebsie t\u00eb ligjshme dhe t\u00eb regjistruar n\u00eb regjstrat e kadastr\u00ebs, prona e t\u00eb cilit \u00ebsht\u00eb e z\u00ebn\u00eb me nj\u00eb nd\u00ebrtim informal, nuk mund t\u00eb informohet sakt\u00ebsisht me k\u00ebt\u00eb nen t\u00eb ligjit se kur ai dhe trash\u00ebgimtar\u00ebt e tjer\u00eb do t\u00eb d\u00ebmshp\u00ebrblehen p\u00ebr pron\u00ebn q\u00eb i \u00ebsht\u00eb z\u00ebn\u00eb prej vitesh dhe q\u00eb po prej vitesh, nuk e ka zot\u00ebruar\/g\u00ebzuar at\u00eb. \u00cbsht\u00eb e v\u00ebrtet\u00eb se afati i p\u00ebrmbylles s\u00eb t\u00eb gjith\u00eb proceseve tranzitore sipas nenit 82 t\u00eb k\u00ebtij ligjit parashikohet t\u00eb p\u00ebrfundoj\u00eb m\u00eb dat\u00eb 31 dhjetor 2028, por ky rregull \u00ebsht\u00eb i p\u00ebrcaktuar p\u00ebr t\u00eb gjith\u00eb proceset q\u00eb ky ligj trajton. \u00cbsht\u00eb e nevojshme q\u00eb p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje Kuvendi t\u00eb ket\u00eb nj\u00eb vullnet t\u00eb shprehur t\u00eb qart\u00eb, p\u00ebr t\u00eb caktuar nj\u00eb afat me ligj se kur do t\u00eb p\u00ebrfundoj\u00eb procesi i kompensimit financiar i pronar\u00ebve, prona e t\u00eb cil\u00ebve shpron\u00ebsohet p\u00ebr efekt t\u00eb procesit t\u00eb legalizimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb form\u00ebn se si dispozita e nenit 24 t\u00eb ligjit nr. 20\/2020 \u00ebsht\u00eb miratuar, p\u00ebr shkak t\u00eb paqart\u00ebsis\u00eb s\u00eb saj, sjell s\u00ebrish munges\u00eb t\u00eb siguris\u00eb juridike se kur do t\u00eb kompensohet ky pronar p\u00ebrmes nj\u00eb mase shp\u00ebrblimi t\u00eb drejt\u00eb p\u00ebr pron\u00ebn e tij, nd\u00ebrkoh\u00eb q\u00eb zot\u00ebruesi real i saj, edhe mund t\u00eb legalizoj\u00eb objektin e tij, ashtu si\u00e7 mund t\u00eb kryej\u00eb transaksione p\u00ebr objektin e legalizuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo gjendje e tejzgjatur, e cila ka nisur t\u00eb trajtohet ligj\u00ebrisht q\u00eb prej vitit 2004-2005, k\u00ebrkon patjet\u00ebr n\u00eb k\u00ebt\u00eb moment t\u00eb g\u00ebzoj\u00eb nj\u00eb v\u00ebmendje t\u00eb ve\u00e7ant\u00eb nga Kuvendi i Shqip\u00ebris\u00eb, pasi pronar\u00ebve t\u00eb k\u00ebtyre trojeve, prona iu \u00ebsht\u00eb z\u00ebn\u00eb prej shum\u00eb vitesh, nd\u00ebrkoh\u00eb q\u00eb prej 15 vitesh presin trajtimin financiar t\u00eb tyre sipas ligjit dhe s\u00ebrish duket se nuk do ta marrin at\u00eb brenda nj\u00eb afati t\u00eb arsyesh\u00ebm t\u00eb p\u00ebrcaktuar me ligj p\u00ebr p\u00ebrfundimin e procesit t\u00eb legalizimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebto arsye, neni 24 cenon parimin e siguris\u00eb juridike dhe barazis\u00eb p\u00ebrpara ligjit dhe duhet rishikuar nga Kuvendi i Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">III. Pasiguri t\u00eb theksuar juridike sjell edhe neni 33, pika 1 i ligjit nr.20\/2020. Ky nen trajton at\u00eb fash\u00eb t\u00eb subjekteve zot\u00ebruese t\u00eb nj\u00eb objekti informal, q\u00eb nuk mund t\u00eb p\u00ebrfitoj\u00eb legalizim sipas k\u00ebtij ligji. Kjo dispozit\u00eb nuk ofron asnj\u00eb garanci reale t\u00eb trajtimit social apo financiar n\u00eb p\u00ebrputhje me pritshm\u00ebrit\u00eb legjitime q\u00eb zot\u00ebruesi i objektit ka krijuar n\u00eb bindjen e tij se nj\u00eb dit\u00eb, ai do t\u00eb b\u00ebhej pronar dhe do t\u00eb pajisej me nj\u00eb titull pron\u00ebsie p\u00ebr pron\u00ebn e krijuar, duke marr\u00eb n\u00eb konsiderat\u00eb faktin se ka qen\u00eb zot\u00ebrues i pand\u00ebrprer\u00eb p\u00ebr m\u00eb shum\u00eb se 20 vite i saj. K\u00ebt\u00eb pritshm\u00ebri legjitime e krijoi zot\u00ebruesi apo nd\u00ebrtuesi i objektit informal, por me kalimin e viteve, ai\/ajo ka krijuar familje dhe numri i personave q\u00eb e kan\u00eb krijuar k\u00ebt\u00eb pritshm\u00ebri, \u00ebsht\u00eb rritur. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, pasojat sociale q\u00eb krijon kjo \u00e7\u00ebshtje jan\u00eb shum\u00eb t\u00eb m\u00ebdha dhe me efekte t\u00eb shum\u00ebfishta.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky nen nuk p\u00ebrcakton asnj\u00eb mas\u00eb p\u00ebrfitimi, kriter apo ndonj\u00eb parim, por as edhe ndonj\u00eb referenc\u00eb t\u00eb sakt\u00eb ligjore mbi \u00e7far\u00eb do t\u00eb munden t\u00eb p\u00ebrfitojn\u00eb personat q\u00eb nuk u legalizohet objekti dhe m\u00ebnyr\u00ebn se si do t\u00eb kryhet ky proces, duke b\u00ebr\u00eb q\u00eb kjo dispozit\u00eb t\u00eb mos jet\u00eb as referuese dhe as deleguese, p\u00ebr sa koh\u00eb nuk p\u00ebrmbush k\u00ebrkesat e nenit 118 t\u00eb Kushtetut\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb dispozit\u00eb parashikohet sip\u00ebrfaq\u00ebsisht se zot\u00ebruesit e nd\u00ebrtimeve pa leje q\u00eb nuk legalizohen, sipas nenit 18 dhe pik\u00ebs 4, t\u00eb nenit 29 t\u00eb k\u00ebtij ligji, trajtohen nga shteti n\u00ebp\u00ebrmjet shp\u00ebrblimit financiar, programeve sociale t\u00eb strehimit, ose formave t\u00eb tjera alternative t\u00eb trajtimit dhe K\u00ebshilli i Ministrave p\u00ebrcakton m\u00ebnyrat e trajtimit e t\u00eb p\u00ebrllogaritjes s\u00eb mas\u00ebs s\u00eb shp\u00ebrblimit financiar, format alternative t\u00eb trajtimit, si dhe rregullat dhe afatet p\u00ebr realizimin e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky autorizim q\u00eb neni 33, pika 2 e ligjit i jep K\u00ebshillit t\u00eb Ministrave, nuk p\u00ebrmbush k\u00ebrkesat dhe kriteret e nenit 118, paragrafi 2 i Kushtetut\u00ebs q\u00eb p\u00ebrcakton se: Ligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mungesa e parimeve baz\u00eb n\u00eb nenin 33, pika 2, mbi t\u00eb cilat do t\u00eb udh\u00ebhiqej nxjerrja e akteve n\u00ebnligjore nga K\u00ebshilli i Ministrave, mbi mas\u00ebn dhe m\u00ebnyr\u00ebn e p\u00ebrfitimit t\u00eb k\u00ebtyre subjekte, e b\u00ebn k\u00ebt\u00eb dispozit\u00eb q\u00eb t\u00eb cenoj\u00eb parimin e siguris\u00eb juridike. \u00cbsht\u00eb e v\u00ebrtet\u00eb se kjo dispozit\u00eb p\u00ebrmban faktin q\u00eb edhe pse nj\u00eb objekt nuk legalizohet, pronari\/poseduesi i saj do t\u00eb kompensohet. Kjo \u00ebsht\u00eb nj\u00eb risi e k\u00ebtij ligji, por ky vullnet do t\u00eb duhet t\u00eb jet\u00eb i shprehur qart\u00eb me ligj se me \u00e7far\u00eb kriteri apo metodologjie do t\u00eb realizohet ky kompensim. Sjellim n\u00eb v\u00ebmendjen tuaj se kan\u00eb qen\u00eb pik\u00ebrisht k\u00ebto \u00e7\u00ebshtje q\u00eb kan\u00eb krijuar problematik\u00eb n\u00eb t\u00eb shkuar\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mungesa e qart\u00ebsis\u00eb s\u00eb vullnetit t\u00eb shprehur t\u00eb ligjv\u00ebn\u00ebsit mbi k\u00ebt\u00eb \u00e7\u00ebshtje kaq delikate, krijon nj\u00eb gjendje t\u00eb theksuar pasigurie tek individ\u00ebt zot\u00ebrues t\u00eb objekteve informale q\u00eb nuk do t\u00eb mund t\u00eb legalizohen.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo norm\u00eb e paqart\u00eb dhe vet\u00ebm deklarative, l\u00eb shteg q\u00eb n\u00eb t\u00eb ardhmen t\u00eb krijohen s\u00ebrish pasoja t\u00eb r\u00ebnda sociale apo konflikte t\u00eb strukturave shtet\u00ebrore me qytetar\u00ebt, si\u00e7 ka ndodhur n\u00eb rastin e zgjatimit t\u00eb bulevardit \u201cZogu I\u201d, \u201cUnaz\u00ebn e Madhe\u201d, \u201cPallatin me Shigjeta\u201d, rrethrrotullimin \u201cShqiponja\u201d apo investime t\u00eb tjera infrastrukturore q\u00eb kan\u00eb prekur nd\u00ebrtime informale t\u00eb palegalizuara, ku konflikti i forcave t\u00eb rendit me qytetar\u00ebt ka krijuar jo pak pasoja t\u00eb r\u00ebnda dhe p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb rregullim i till\u00eb i paqart\u00eb \u00e7on n\u00eb cenimin e siguris\u00eb juridike si pasoj\u00eb e ometimit legjislativ, nd\u00ebrkoh\u00eb q\u00eb siguria mbi t\u00eb drejt\u00ebn e pron\u00ebs si e drejt\u00eb themelore kushtetuese \u00ebsht\u00eb thelb\u00ebsore pasi i shtyn individ\u00ebt t\u00eb investojn\u00eb p\u00ebr zhvillimin dhe p\u00ebrdorimin e pron\u00ebs n\u00eb p\u00ebrmir\u00ebsimin e jetes\u00ebs s\u00eb tyre. Ky investim ushqen efi\u00e7enc\u00ebn dhe mir\u00ebqenien e shoq\u00ebris\u00eb.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Neni 48 pika 1, me hap\u00ebsir\u00ebn dhe paqart\u00ebsin\u00eb q\u00eb p\u00ebrmban, krijon terren p\u00ebr t\u00eb ligj\u00ebruar \u00e7do veprim t\u00eb kundraligjsh\u00ebm t\u00eb kryer nd\u00ebr vite. Duke i dh\u00ebn\u00eb p\u00ebrpar\u00ebsi gjendjes faktike t\u00eb pozicionit t\u00eb ndrysh\u00ebm nga dokumentacioni i miratuar nga autoriteti i planifikimit, kufiri i zon\u00ebs s\u00eb stimuluar de facto ngelet i pap\u00ebrcaktuar dhe krijohet mund\u00ebsia e zmadhimit t\u00eb sip\u00ebrfaqes s\u00eb truallit q\u00eb nj\u00eb subjekt mund t\u00eb uzurpoj\u00eb n\u00eb vijim\u00ebsi apo p\u00ebrgjat\u00eb procedurave q\u00eb do t\u00eb ndiqen nga Agjencia Shtet\u00ebrore e Kadastr\u00ebs.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Kur nj\u00eb subjekt ka zgjeruar kufirin e zon\u00ebs s\u00eb stimuluar pa t\u00eb drejt\u00eb nga ajo \u00e7far\u00eb ka marr\u00eb me qera\/enfiteoz\u00eb, mund ta zot\u00ebroj\u00eb e ta ligj\u00ebroj\u00eb k\u00ebt\u00eb pron\u00eb t\u00eb zaptuar tashm\u00eb p\u00ebrmes k\u00ebtij neni.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Trajtimi q\u00eb neni 49 i b\u00ebn procesit t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb mbi truallin e nj\u00ebsive nd\u00ebrtimore t\u00eb nd\u00ebrtuara nga subjektet e stimuluara, \u00ebsht\u00eb favorizues dhe krijon kushtet e trajtimit preferencial, pasi e gjith\u00eb procedura si dhe \u00e7mimi se sa kushton trualli q\u00eb do t\u00eb marr\u00eb n\u00eb pron\u00ebsi \u00ebsht\u00eb parashikuar t\u00eb p\u00ebrcaktohet me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb, duke e krahasuar me parashikimet e nenit 10 t\u00eb po k\u00ebtij ligji, zot\u00ebruesit e tok\u00ebs bujq\u00ebsore q\u00eb do t`u kaloj\u00eb n\u00eb pron\u00ebsi sip\u00ebrfaqe tep\u00ebr e tok\u00ebs bujq\u00ebsore, do t\u00eb duhet ta paguajn\u00eb at\u00eb me \u00e7mimin sipas hart\u00ebs s\u00eb vler\u00ebs t\u00eb miratuar tashm\u00eb me vendimin e K\u00ebshillit t\u00eb Ministrave. I nj\u00ebjti standard evidentohet edhe n\u00eb nenin 63, pika 1, shkronja \u201cb\u201d e po k\u00ebtij ligji ku kalimi i pron\u00ebsis\u00eb p\u00ebr sip\u00ebrfaqet e trojeve, sipas k\u00ebtij kreu, realizohet me vendim t\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs, sipas \u00e7mimit t\u00eb p\u00ebrcaktuar n\u00eb hart\u00ebn e vler\u00ebs s\u00eb pron\u00ebs, t\u00eb miratuar me vendim t\u00eb K\u00ebshilli t\u00eb Ministrave, p\u00ebr trojet e nd\u00ebrtesave me funksion social-ekonomik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb sipas nenit 49, kalimi i pron\u00ebsis\u00eb tek personi i stimuluar apo subjekteve t\u00eb tjera q\u00eb kan\u00eb t\u00eb drejta mbi nj\u00ebsit\u00eb nd\u00ebrtimore b\u00ebhet sipas:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cRregullave t\u00eb holl\u00ebsishme p\u00ebr kalimin e pron\u00ebsis\u00eb, afatet, m\u00ebnyra e llogaritjes dhe e njoftimit t\u00eb pages\u00ebs, zbritjet q\u00eb p\u00ebrfitohen dhe modeli i aktit p\u00ebr kalimin e pron\u00ebsis\u00eb p\u00ebrcaktohen me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb e qart\u00eb q\u00eb ky delegim ka synuar favorizimin e asaj shtrese t\u00eb popullsis\u00eb q\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 ose ka qen\u00eb n\u00eb cil\u00ebsin\u00eb e personit t\u00eb stimuluar (biznes);<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 ose jan\u00eb persona q\u00eb kan\u00eb siguruar t\u00eb drejta pron\u00ebsie n\u00eb fshatrat turistik\u00eb, t\u00eb cil\u00ebt kan\u00eb pasur dhe kan\u00eb t\u00eb ardhura dhe pasurit\u00eb e blera jan\u00eb krijuar jo p\u00ebr nevoja strehimi, por si sht\u00ebpi pushimi (t\u00eb dyta).<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb shtresa tjet\u00ebr e shoq\u00ebris\u00eb, ajo q\u00eb mbahet nga toka bujq\u00ebsore, p\u00ebr disa sip\u00ebrfaqe shtes\u00eb do t\u00eb duhet t\u00eb paguaj\u00eb sipas \u00e7mimeve t\u00eb tregut.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht ky trajtim p\u00ebrb\u00ebn shkelje t\u00eb parimit kushtetues t\u00eb barazis\u00eb p\u00ebrpara ligjit. Kjo \u00e7\u00ebshtje duhet t\u00eb jet\u00eb n\u00eb fokusin e Kuvendit p\u00ebr rishikim, pasi ky vullnet i shprehur me ligj, nuk \u00ebsht\u00eb n\u00eb nderin e tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky autorizim q\u00eb neni 49 i ligjit i jep K\u00ebshillit t\u00eb Ministrave, nuk p\u00ebrmbush as k\u00ebrkesat dhe kriteret e nenit 118, paragrafi 2 i Kushtetut\u00ebs q\u00eb p\u00ebrcakton se: Ligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrkundrazi, neni 49, jo vet\u00ebm q\u00eb tregon nj\u00eb qasje t\u00eb diferencuar n\u00eb tajtimin e \u00e7\u00ebshtjeve t\u00eb ngjashme si m\u00eb sip\u00ebr evidentuar, por autorizon nxjerrjen e nj\u00eb akti n\u00ebnligjor pa p\u00ebrcaktuar asnj\u00eb parim orientues q\u00eb duhet t\u00eb respektojn\u00eb rregullat p\u00ebr kalimin e pron\u00ebsis\u00eb n\u00eb k\u00ebt\u00eb rast.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Parashikimet e nenit 59, pika 1 t\u00eb ligjit nr.20\/2020, jan\u00eb shum\u00eb problematike, pasi mund t\u00eb p\u00ebrdoren p\u00ebr t\u00eb legjitimuar apo fshehur nj\u00eb s\u00ebr\u00eb problematikash apo veprimesh t\u00eb paligjshme t\u00eb kryera nga institucionet shtet\u00ebrore n\u00eb \u00e7\u00ebshtjet e trajtimit t\u00eb pronave apo regjistrimit t\u00eb tyre nd\u00ebr vite me q\u00ebllim p\u00ebrftimin e paligjsh\u00ebm.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">P\u00ebrve\u00e7 t\u00eb tjerave, ky parashikim bie ndesh edhe me vet\u00eb p\u00ebrmbajtjen e dispozitave t\u00eb k\u00ebtij ligji, q\u00eb detyrojn\u00eb ASHK-n\u00eb t`i k\u00ebrkoj\u00eb Avokatur\u00ebs s\u00eb Shtetit, ngritjen e padive gjyq\u00ebsore kur konstatojn\u00eb problematika n\u00eb regjistrin e pasurive t\u00eb paluajtshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky nen krijon nj\u00eb paqart\u00ebsi se cili \u00ebsht\u00eb vullneti i shprehur i Kuvendit, mbi k\u00ebto procese tranzitore n\u00ebp\u00ebr t\u00eb cilat ka kaluar vendi n\u00eb krijimin e titujve t\u00eb pron\u00ebsis\u00eb. N\u00ebse \u00ebsht\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 legjitimi\/amnistimi i \u00e7do paligjshm\u00ebrie t\u00eb kryer deri m\u00eb tani;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 skanimi t\u00ebr\u00ebsor i situat\u00ebs s\u00eb \u00e7\u00ebshtjeve t\u00eb pron\u00ebsis\u00eb tashm\u00eb q\u00eb t\u00eb gjitha institucionet e m\u00ebparshme, jan\u00eb shkrir\u00eb n\u00eb nj\u00eb t\u00eb vet\u00ebm (ASHK); apo<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 verifikimi rast pas rasti i \u00e7do regjistrimi t\u00eb kryer.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kur dispozitat e ligjit krijojn\u00eb p\u00ebrplasje t\u00eb k\u00ebsaj natyre midis tyre, ku diku paligjshm\u00ebria tolerohet e diku tjet\u00ebr parregullsia kund\u00ebrshtohet n\u00eb rrug\u00eb gjyq\u00ebsore, at\u00ebher\u00eb shtohet mund\u00ebsia q\u00eb administrata apo t\u00eb interesuarit t\u00eb shfryt\u00ebzojn\u00eb k\u00ebto mund\u00ebsi t\u00eb shum\u00ebfishta q\u00eb vet\u00eb ligji i ofron p\u00ebr t\u00eb mbuluar apo legjitimuar paligjshm\u00ebrit\u00eb e tyre t\u00eb kryera nd\u00ebr vite.<\/span><\/p>\n<p><span style=\"color: #000000;\">VII. Neni 60 dhe 65, pika 2, shkronja \u201ca\u201d p\u00ebrmes s\u00eb cilave ASHK-s\u00eb, i jepet si kompetenc\u00eb \u201ckorrigjimi i pasakt\u00ebsive hartografike dhe gabimet e tjera materiale t\u00eb titujve t\u00eb pron\u00ebsis\u00eb, q\u00eb kan\u00eb si origjin\u00eb titulli pron\u00ebsie aktet administrative t\u00eb l\u00ebshuara nga institucionet shtet\u00ebrore, p\u00ebrpara hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji\u201d, \u00ebsht\u00eb nj\u00eb nga \u00e7\u00ebshtjet m\u00eb problematike t\u00eb k\u00ebtij ligji.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo dispozit\u00eb cenon hapur parimin e siguris\u00eb juridike n\u00eb lidhje me t\u00eb drejt\u00ebn e pron\u00ebs dhe bie ndesh me jurisprudenc\u00ebn e Gjykat\u00ebs Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb e nevojshme t\u00eb sillet n\u00eb v\u00ebmendje se mbi k\u00ebt\u00eb \u00e7\u00ebshtje Presidenti i Republik\u00ebs, ka mbajtur nj\u00eb q\u00ebndrim t\u00eb qart\u00eb n\u00eb Dekretin nr. 11055, dat\u00eb 15.01.2019 p\u00ebr kthimin n\u00eb Kuvend t\u00eb ligjit nr. 111\/2018 \u201cP\u00ebr kadastr\u00ebn\u201d, me q\u00ebllim rishqyrtimin e tij.[2]<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me k\u00ebt\u00eb kompetenc\u00eb t\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs, mbahet i nj\u00ebjtin q\u00ebndrim si n\u00eb Dekretin nr. 11055\/2019, se cenohet parimi i siguris\u00eb juridike n\u00eb respektimin e t\u00eb drejtave pron\u00ebsore dhe bie ndesh me jurisprudenc\u00ebn kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebp\u00ebrmjet k\u00ebtij neni ASHK-s\u00eb tashm\u00eb i jepet e drejta q\u00eb jo vet\u00ebm t\u00eb korrigjoj\u00eb dhe p\u00ebrmir\u00ebsoj\u00eb t\u00eb dh\u00ebnat n\u00eb regjistrin publik t\u00eb pasurive t\u00eb paluajtshme, por tashm\u00eb ASHK do t\u00eb ket\u00eb t\u00eb drejt\u00eb q\u00eb t\u00eb korrigjoj\u00eb\/sakt\u00ebsoj\u00eb dhe aktet e fitimit t\u00eb pron\u00ebsis\u00eb t\u00eb nxjerra nga institucionet shtet\u00ebrore, pra n\u00eb titujt e fitimit t\u00eb pron\u00ebsis\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Referuar p\u00ebrmbajtjes s\u00eb nenit 60, kuptohet se nj\u00eb titull pron\u00ebsie i dh\u00ebn\u00eb nga ish-komisionet e Kthimit dhe Kompensimit t\u00eb Pronave nd\u00ebr vite, Kontratat e Privatizimit t\u00eb Pron\u00ebs Publike, Lejeve t\u00eb Legalizimit, Akteve t\u00eb Marrjes s\u00eb Tok\u00ebs n\u00eb Pron\u00ebsi, apo \u00e7do akti tjet\u00ebr administrativ q\u00eb ka krijuar nj\u00eb titull pron\u00ebsie, tashm\u00eb mund t\u00eb korrigjohet nga ASHK referuar procesit t\u00eb p\u00ebrmir\u00ebsimit t\u00eb t\u00eb dh\u00ebnave q\u00eb administrohen n\u00eb regjistrin publik t\u00eb pasurive t\u00eb paluajtshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo logjik\u00eb mund t\u00eb vler\u00ebsohet deri diku e pranueshme p\u00ebr titujt e pron\u00ebsis\u00eb t\u00eb dh\u00ebna nga Agjencia e Legalizimit, Urbanizimit dhe Integrimit t\u00eb Nd\u00ebrtimeve Informale (Leje Legalizimi), duke qen\u00eb se ASHK-ja \u00ebsht\u00eb organ pasues i veprimtaris\u00eb shtet\u00ebrore t\u00eb ALUIZNI-t. Nd\u00ebrkoh\u00eb situata kushtetuese e nenit 60, komplikohet sepse sipas p\u00ebrmbajtjes s\u00eb tij pretendohet t\u00eb korrigjohen\/sakt\u00ebsohen edhe tituj pron\u00ebsie t\u00eb l\u00ebshuar nga organe t\u00eb tjera q\u00eb p\u00ebr nga natyra e tyre jan\u00eb t\u00eb nj\u00eb karakteri t\u00eb ve\u00e7ant\u00eb dhe nuk hyjn\u00eb n\u00eb sfer\u00ebn e atyre akteve p\u00ebr t\u00eb cilat ASHK-ja mund t\u00eb ket\u00eb autoritet sipas Kodit t\u00eb Procedurave Administrative.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht, n\u00ebse Agjencia Shtet\u00ebrore e Kadastr\u00ebs do t\u00eb merrte n\u00ebp\u00ebrmjet k\u00ebtij neni t\u00eb drejt\u00ebn e korrigjimit t\u00eb nj\u00eb vendimi t\u00eb dh\u00ebn\u00eb nga ish-Komisionet e Kthimit dhe Kompensimit t\u00eb Pronave apo t\u00eb organeve t\u00eb tjera administrative pasuese t\u00eb tyre, at\u00ebher\u00eb automatikisht ASHK-ja, do t\u00eb nd\u00ebrhynte n\u00eb p\u00ebrmbajtjen e k\u00ebtyre vendimeve\/akteve. Ndryshimi i k\u00ebtyre akteve t\u00eb fitimit t\u00eb pron\u00ebsis\u00eb, p\u00ebrb\u00ebn nj\u00eb veprim i cili bie ndesh me jurisprudenc\u00ebn Gjykat\u00ebs Kushtetuese t\u00eb krijuar nd\u00ebr vite n\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht, Gjykata Kushtetuese e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, me vendimet e saj nr. 27, dat\u00eb 26.05.2010 dhe nr. 43, dat\u00eb 06.10.2011 \u00ebsht\u00eb shprehur qart\u00eb n\u00eb lidhje me ndryshimet q\u00eb mund t\u00eb p\u00ebsojn\u00eb vendimet e dh\u00ebna nga organet q\u00eb kan\u00eb funksionuar n\u00eb procesin e njohjes, kthimit apo kompensimit t\u00eb pron\u00ebs nd\u00ebr vite.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb pik\u00ebn 46 t\u00eb Vendimit nr. 24\/2010, Gjykata Kushtetuese citon nd\u00ebr t\u00eb tjera se: \u201cP\u00ebr sa m\u00eb sip\u00ebr, vendimet e organeve administrative, q\u00eb kan\u00eb pasur si kompetenc\u00eb kthimin dhe kompensimin e pronave, n\u00eb vite, nuk mund t\u00eb konsiderohen akte administrative, n\u00eb kuptimin normal juridik t\u00eb termit (strictu sensu), por akte sui generis t\u00eb nxjerra nga nj\u00eb organ sui generis, p\u00ebr t\u00eb cilin Gjykata Evropiane e t\u00eb Drejtave t\u00eb Njeriut ka p\u00ebrdorur termin e ri leksikor, quasi gjykat\u00eb\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjykata Kushtetuese vazhdon arsyetimin e saj n\u00eb pik\u00ebn 52 t\u00eb po k\u00ebtij vendimi ku citon se: \u201cP\u00ebr sa m\u00eb sip\u00ebr, zbatimi, nga nj\u00eb organ administrativ si AKKP, i parimeve t\u00eb revokimit dhe shfuqizimit t\u00eb akteve t\u00eb ish-KKKP-s\u00eb \u00ebsht\u00eb i pabazuar, pasi mungon nj\u00eb interes i ligjsh\u00ebm shtet\u00ebror dhe aktet q\u00eb shfuqizohen ose revokohen nuk jan\u00eb akte tipike administrative t\u00eb nj\u00eb organi tipik administrativ. Drejtori i AKKP-s\u00eb \u00ebsht\u00eb nj\u00eb organ n\u00eb vart\u00ebsi t\u00eb K\u00ebshillit t\u00eb Ministrave dhe n\u00eb k\u00ebt\u00eb kuptim vendimi i marr\u00eb prej tij p\u00ebr t\u00eb nd\u00ebrhyr\u00eb mbi interesa civile t\u00eb shtetasve, n\u00eb kuptim t\u00eb Konvent\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut \u00ebsht\u00eb i pajustifikuar\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Bazuar n\u00eb nj\u00eb interpretim shterues t\u00eb parashtruar n\u00eb k\u00ebt\u00eb vendim (shiko vendimin nr. 24\/2010) Gjykata Kushtetuese ka vler\u00ebsuar se vendimet e Agjencis\u00eb s\u00eb Kthimit dhe Kompensimit t\u00eb Pronave p\u00ebr t\u00eb shfuqizuar vendimet e ish-Komisioneve t\u00eb Kthimit dhe Kompensimit t\u00eb Pronave, p\u00ebrb\u00ebjn\u00eb cenim t\u00eb parimit t\u00eb siguris\u00eb juridike.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, duke qen\u00eb se Agjencia Shtet\u00ebrore e Kadastr\u00ebs \u00ebsht\u00eb nj\u00eb institucion publik administrativ n\u00eb var\u00ebsi t\u00eb Kryeministrit, asaj nuk mund t\u2019i jepen tagra q\u00eb t\u00eb nd\u00ebrhyj\u00eb n\u00eb p\u00ebrmbajtjen e k\u00ebtyre vendimeve. Parashikimet e nenit 60 t\u00eb ligjit nr. 20\/2020, t\u00eb l\u00ebn\u00eb t\u00eb kuptosh se sakt\u00ebsimet apo korrigjimet do t\u00eb b\u00ebhen n\u00eb vet\u00eb aktin e fitimit t\u00eb pron\u00ebsis\u00eb (vendimin) dhe dokumentacionin q\u00eb shoq\u00ebron at\u00eb q\u00eb \u00ebsht\u00eb dokumentacioni hartografik.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb t\u00eb dy rastet, do t\u00eb kishim humbjen e vler\u00ebs s\u00eb aktit administrativ\/vendimit p\u00ebr nj\u00eb pjes\u00eb t\u00eb tij, dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb n\u00eb kuptim edhe shfuqizimin e pjessh\u00ebm t\u00eb tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht ky veprim dhe kjo e drejt\u00eb q\u00eb i jepet ASHK-s\u00eb, konsiderohet se p\u00ebrb\u00ebn cenim t\u00eb parimit t\u00eb siguris\u00eb juridike. Kjo sepse zbatimi nga nj\u00eb organ administrativ i korrigjimit\/sakt\u00ebsimit t\u00eb akteve t\u00eb ish-KKKP-ve, t\u00eb cilat nuk jan\u00eb akte tipike administrative t\u00eb nj\u00eb organi tipik administrativ apo i nd\u00ebrhyrjes s\u00eb ASHK-s\u00eb p\u00ebr sakt\u00ebsimin e titujve t\u00eb pron\u00ebsis\u00eb t\u00eb l\u00ebshuar nga organe t\u00eb tjera shtet\u00ebrore q\u00eb nuk mund t\u00eb realizohen n\u00eb p\u00ebrputhje me dispozitat e Kodit t\u00eb Procedur\u00ebs Administrative, vler\u00ebsohet nd\u00ebrhyrje e pajustifikuar mbi t\u00eb drejtat civile t\u00eb shtetasve, t\u00eb cilat cenojn\u00eb parimin e siguris\u00eb juridike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Agjencia Shtet\u00ebrore e Kadastr\u00ebs referuar praktik\u00ebs s\u00eb Gjykat\u00ebs Kushtetuese, mund t\u00eb korrigjoj\u00eb\/p\u00ebrmir\u00ebsoj\u00eb aktet e prodhuara prej saj, si dhe t\u00eb dh\u00ebnat n\u00eb regjistrin e pasurive t\u00eb paluajtshme n\u00eb p\u00ebrputhje me standardet kushtetuese, por kurrsesi nuk mundet t\u00eb nd\u00ebrhyj\u00eb p\u00ebr t\u00eb sakt\u00ebsuar akte t\u00eb tjera t\u00eb fitimit t\u00eb pron\u00ebsis\u00eb, t\u00eb cilat nuk p\u00ebrfshihen n\u00eb sfer\u00ebn e zbatimit t\u00eb dispozitave t\u00eb Kodit t\u00eb Procedurave Administrative, apo ato akte p\u00ebr t\u00eb cilat Gjykata Kushtetuese ka mbajtur nj\u00eb q\u00ebndrim rreth natyr\u00ebs s\u00eb ve\u00e7ant\u00eb dhe m\u00ebnyr\u00ebs s\u00eb kund\u00ebrshtimit t\u00eb tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">VIII. Parashikimet e nenit 68, pika 7, shkelin parimin e barazis\u00eb p\u00ebrpara ligjit, shqyrtimin e gj\u00ebs\u00eb s\u00eb gjykuar dhe p\u00ebrmbysin teorin\u00eb e veprimit t\u00eb ligjit n\u00eb koh\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb dispozit\u00eb citohet se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c7. K\u00ebrkesat p\u00ebr kalimin n\u00eb pron\u00ebsi t\u00eb tok\u00ebs bujq\u00ebsore, t\u00eb subjekteve q\u00eb nuk legjitimoheshin, sipas akteve ligjore e n\u00ebnligjore p\u00ebr tok\u00ebn bujq\u00ebsore, t\u00eb cilat jan\u00eb refuzuar p\u00ebrpara hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji, rishqyrtohen sipas kushteve t\u00eb nenit 12 t\u00eb k\u00ebtij ligji.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse nj\u00eb dispozit\u00eb e till\u00eb ngelet n\u00eb fuqi, at\u00ebher\u00eb e gjith\u00eb reforma e tok\u00ebs n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb duhet rishikuar, dhe i nj\u00ebjti parim do k\u00ebrkohet t\u00eb ndiqet edhe p\u00ebr trajtimin e \u00e7\u00ebshtjes s\u00eb subjekteve t\u00eb shpron\u00ebsuar n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb nga shtetit dhe p\u00ebr gjith\u00eb proceset administrative n\u00eb Agjencin\u00eb e Trjatimit t\u00eb Pronave, q\u00eb duhet t\u00eb rikthehen nga e para.<\/span><\/p>\n<ol start=\"30\">\n<li><span style=\"color: #000000;\">Neni 69, pika 4, bie n\u00eb kund\u00ebrshtim me parashikimet e Kushtetut\u00ebs, Kodit t\u00eb Procedurave Administrative, ligjit nr. 90\/2012 \u201cP\u00ebr organizimin dhe funksionimin e administrat\u00ebs shtet\u00ebrore\u201d, apo dhe ligjit nr. 9000, dat\u00eb 30.01.2003 \u201cP\u00ebr organizimin dhe funksionimin e K\u00ebshillit t\u00eb Ministrave\u201d.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">P\u00ebrmes k\u00ebsaj dispozite parashikohet n\u00eb thelb se, nj\u00eb p\u00ebrcaktim i elementeve t\u00eb titullit t\u00eb pron\u00ebsis\u00eb i b\u00ebr\u00eb me vendim i K\u00ebshillit t\u00eb Ministrave, do t\u00eb mund t\u00eb ndryshohet nga nj\u00eb organ n\u00eb var\u00ebsi t\u00eb Kryeministrit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht n\u00eb nenin 69 pika 4 t\u00eb ligjit p\u00ebrcaktohet se: \u201cVendimet e K\u00ebshillit t\u00eb Ministrave \u201cP\u00ebr kalimin n\u00eb pron\u00ebsi t\u00eb parcelave nd\u00ebrtimore\u201d, t\u00eb miratuara p\u00ebrpara hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji, nuk rishikohen p\u00ebr efekt t\u00eb ndryshimit t\u00eb t\u00eb dh\u00ebnave t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb s\u00eb parcelave nd\u00ebrtimore. K\u00ebto ndryshime realizohen n\u00ebp\u00ebrmjet aktit t\u00eb legalizimit q\u00eb miratohet sipas k\u00ebtij ligji\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra Drejtori Rajonal i Kadastr\u00ebs ka kompetenc\u00eb t\u00eb ndryshoj\u00eb at\u00eb q\u00eb ka vendosur organi m\u00eb i lart\u00eb i administrat\u00ebs: K\u00ebshilli i Ministrave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimet e K\u00ebshillit t\u00eb Ministrave jan\u00eb akte q\u00eb nxirren n\u00eb baz\u00eb dhe p\u00ebr zbatim t\u00eb ligjit, sipas autorizimit specifik t\u00eb tij. Ky rregull \u00ebsht\u00eb p\u00ebrcaktuar qart\u00eb n\u00eb nenin 118 t\u00eb Kushtetut\u00ebs. Paragrafi 3, i k\u00ebtij neni t\u00eb Kushtetut\u00ebs sanksionon se: Organi i autorizuar me ligj p\u00ebr t\u00eb nxjerr\u00eb akte n\u00ebnligjore, si\u00e7 specifikohet n\u00eb paragrafin 2 t\u00eb k\u00ebtij neni, nuk mund t\u2019ia delegoj\u00eb kompetenc\u00ebn e tij nj\u00eb organi tjet\u00ebr. Nd\u00ebrsa pika 4 e nenit 69, jo vet\u00ebm q\u00eb shkel k\u00ebt\u00eb parashikim, duke lejuar ndryshimin e vendimeve t\u00eb K\u00ebshillit t\u00eb Ministrave t\u00eb dala n\u00eb baz\u00eb dhe p\u00ebr zbatim t\u00eb ligjit, me nj\u00eb akt administrative t\u00eb nj\u00eb organi m\u00eb t\u00eb ul\u00ebt, por cenon r\u00ebnd\u00eb dhe nenin 116 t\u00eb Kushtetut\u00ebs q\u00eb p\u00ebrcakton hierarkin\u00eb e akteve.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Parashikimi i nenit 69, pika 9, s\u00ebrish krijon nj\u00eb situat\u00eb trajtimi t\u00eb pabarabart\u00eb. N\u00eb thelb, ky nen realizon nj\u00eb rihapje edhe nj\u00eb her\u00eb t\u00eb procesit t\u00eb legalizimit p\u00ebr nd\u00ebrtimet pa leje t\u00eb kryera pas muajit qershor 2014, afat ky i p\u00ebrcaktuar si afat fundor p\u00ebr t\u00eb pranuar trajtimin e objekteve pa leje t\u00eb nd\u00ebrtuara deri n\u00eb k\u00ebt\u00eb dat\u00eb.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht ky leht\u00ebsim shkon n\u00eb adres\u00eb t\u00eb shoq\u00ebrive nd\u00ebrtimore dhe investitor\u00ebve, t\u00eb cilat mund t\u00eb ken\u00eb shkelur lejen e nd\u00ebrtimit, nd\u00ebrkoh\u00eb q\u00eb p\u00ebr t\u00eb nj\u00ebjtat veprime por pa q\u00ebllim fitimi, shum\u00eb qytetar\u00eb p\u00ebr arsye familjare, p\u00ebr shkak t\u00eb punimeve pa leje t\u00eb kryera n\u00eb banesat e tyre, jan\u00eb nd\u00ebshkuar nga shteti si n\u00eb rrug\u00eb administrative, ashtu dhe me d\u00ebnime penale.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb p\u00ebr t\u00eb ardhur keq q\u00eb ky vullnet me kaq impakt \u00ebsht\u00eb mbajtur i fsheht\u00eb dhe \u00ebsht\u00eb b\u00ebr\u00eb fal\u00eb nj\u00eb propozimi vet\u00ebm nj\u00eb dit\u00eb p\u00ebrpara zhvillimit t\u00eb seanc\u00ebs plenare, nga Kryetari i Grupit Parlamentar Taulant Balla, person ky i cili p\u00ebr k\u00ebt\u00eb propozim nuk ka arsyetuar aspak nevoj\u00ebn dhe shkakun e propozimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Shtyrja e afatit t\u00eb legalizimit \u00ebsht\u00eb ve\u00e7 t\u00eb tjerash nj\u00eb qasje e pasinqert\u00eb politike, pasi nga nj\u00ebra an\u00eb trumpetohet se nuk do t\u00eb lejohet asnj\u00eb nd\u00ebrtim pa leje n\u00eb territor, nd\u00ebrkoh\u00eb q\u00eb nga ana tjet\u00ebr sa her\u00eb ndryshon ligji i legalizimit kemi nj\u00eb rihapje t\u00eb procesit dhe ligj\u00ebrim t\u00eb k\u00ebtyre veprimeve t\u00eb kryera n\u00eb kund\u00ebrshtim me ligjin me q\u00ebllimin q\u00eb procesi i legalizimeve jo vet\u00ebm t\u00eb mos p\u00ebrfundoj\u00eb kurr\u00eb, por t\u00eb jet\u00eb nj\u00eb hap\u00ebsir\u00eb t\u00eb cil\u00ebn qeveria t\u00eb mund ta shfryt\u00ebzoj\u00eb politikisht p\u00ebr abuzime elektorale.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky ndryshim i paarsyetuar, i b\u00ebr\u00eb pak or\u00eb para miratimit t\u00eb ligjit, \u00ebsht\u00eb shembulli tipik i korrupsionit q\u00eb shfaqet n\u00eb procesin legjislativ, kur zgjedhjet ligjore me vet\u00ebdije u hapin rrug\u00eb praktikave korruptive dhe klienteliste.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb, \u00ebsht\u00eb detyr\u00eb e ligjv\u00ebn\u00ebsit q\u00eb gjat\u00eb hartimit dhe miratimit t\u00eb ligjeve, t\u00eb zbulohen dhe minimizohen p\u00ebr sa \u00ebsht\u00eb e mundur rreziqet e korrupsionit, q\u00eb fillon p\u00ebrmes parashikimeve evazive ligjore q\u00eb l\u00ebn\u00eb me dashje hap\u00ebsira interpretimi.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Parashikimet e nenit 68, pika 5, jan\u00eb tep\u00ebr problematike.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Kjo pik\u00eb p\u00ebrcakton se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c5. ASHK-ja heq dor\u00eb nga padia n\u00eb t\u00eb gjitha gjykimet n\u00eb proces p\u00ebrpara hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji, p\u00ebrve\u00e7 rasteve kur shkaku ligjor i padis\u00eb \u00ebsht\u00eb sipas p\u00ebrcaktimeve t\u00eb nenit 7, pika 1, t\u00eb k\u00ebtij ligji\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb parashikim i till\u00eb krijon hap\u00ebsira p\u00ebr d\u00ebmtimin e interesave t\u00eb shtetit dhe krijimin e pasojave t\u00eb r\u00ebnda ekonomike apo humbjen e pasuris\u00eb publike t\u00eb patjet\u00ebrsueshme q\u00eb mund t\u00eb jet\u00eb n\u00eb proces gjyq\u00ebsor.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb jasht\u00eb \u00e7do logjike q\u00eb ASHK-s\u00eb t\u2019i jepet me ligj nj\u00eb kompetenc\u00eb e till\u00eb. Ajo mund t\u00eb ket\u00eb administruar nga institucionet q\u00eb kan\u00eb pushuar s\u00eb ekzistuari nj\u00eb mori \u00e7\u00ebshtjesh gjyq\u00ebsore me fatur\u00eb ekonomike t\u00eb lart\u00eb, \u00e7\u00ebshtje k\u00ebto q\u00eb mund t\u00eb jen\u00eb fituar, por edhe mund t\u00eb jen\u00eb humbur n\u00eb shkall\u00ebn e par\u00eb dhe \u00e7\u00ebshtja \u00ebsht\u00eb n\u00eb apel.<\/span><\/p>\n<p><span style=\"color: #000000;\">Natyrsh\u00ebm lind pyetja se: Si mundet Kuvendi t\u00eb orientoj\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje drejt nj\u00eb zgjidhje t\u00eb till\u00eb, duke anashkaluar sistemin gjyq\u00ebsor, provat dhe faktet q\u00eb jan\u00eb administruar n\u00eb proces dhe q\u00eb mund t\u00eb \u00e7ojn\u00eb n\u00eb fitimin e \u00e7\u00ebshtjeve me shum\u00eb r\u00ebnd\u00ebsi n\u00eb favor t\u00eb shtetit. Humbja e k\u00ebtyre interesave prej heqjes dor\u00eb nga procesi, p\u00ebrkthehet direkt n\u00eb d\u00ebm financiar dhe p\u00ebr pasoj\u00eb, n\u00eb d\u00ebm t\u00eb interesave publike.<\/span><\/p>\n<p><span style=\"color: #000000;\">XII. Parashikimet e nenit 71, pika 2, heqin \u00e7do mund\u00ebsi t\u00eb shtetit p\u00ebr t\u00eb vjel\u00eb detyrimet e prapambetura t\u00eb personave t\u00eb stimuluar nd\u00ebr vite.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb dispozit\u00eb p\u00ebrcaktohet tekstualisht se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c2. Detyrimet e prapambetura, q\u00eb burojn\u00eb nga marr\u00ebveshjet e qirave dhe t\u00eb zhvillimit, mbarten nga personat e stimuluar dhe nuk pengojn\u00eb procedurat e kalimit t\u00eb pron\u00ebsis\u00eb dhe legalizimit, sipas kreut V t\u00eb k\u00ebtij ligji.
