Mund t\u00eb konsiderohet non sens dhe logjikisht nj\u00eb lajthitje ligjore e Presidentit. <\/em><\/span><\/p>\n<p><span style=\"color: #000000;\"><em>S\u00eb dyti, parashikimet p\u00ebr p\u00ebrzgjedhjen e an\u00ebtar\u00ebve nga Presidenti jan\u00eb t\u00eb qarta. Ai ushtron t\u00eb drejt\u00ebn e zgjedhjes s\u00eb gjyqtarit kushtetues brenda 30 dit\u00ebve nga marrja e list\u00ebs nga KED. Presidenti e ushtron k\u00ebt\u00eb n\u00eb dy forma, o me dekret, o me heshtje. Q\u00ebllimi i vendosjes s\u00eb k\u00ebtij afati ka qen\u00eb shmangia e bllokimit t\u00eb zgjedhjes s\u00eb an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese nga politika. Afati 30 ditor i Presidentit p\u00ebrfundoi dhe Presidenti nuk e ushtroi t\u00eb drejt\u00ebn e tij brenda afatit. Me kalimin e k\u00ebtij afati b\u00ebhet automatik em\u00ebrimi i kandidatit q\u00eb \u00ebsht\u00eb renditur i pari. P\u00ebr k\u00ebt\u00eb shkak, Arta Vorpsi, q\u00eb ishte renditur e para n\u00eb list\u00eb, konsiderohet e zgjedhur automatikisht an\u00ebtare e Gjykat\u00ebs Kushtetuese. Zgjedhja e saj nga ligji \u00ebsht\u00eb b\u00ebr\u00eb m\u00eb 8 n\u00ebntor 2019.\u2019<\/em> &#8211; tha Gjonaj<\/span><\/p>\n<p><span style=\"color: #000000;\">M\u00eb tej, ministrja e Drejt\u00ebsis\u00eb paraqiti edhe dy argumentet e fundit, nga kat\u00ebr q\u00eb ishin gjithsej. <\/span><\/p>\n<p><span style=\"color: #000000;\">Ajo shton se e shtuna dhe e diela jan\u00eb dit\u00eb q\u00eb figurojn\u00eb n\u00eb Fletoren Zyrtare, duke iu p\u00ebrgjigjur akuz\u00ebs s\u00eb Met\u00ebsp\u00ebr botimin e nj\u00eb vendimi t\u00eb shtun\u00ebn. <\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrsa p\u00ebr sa i p\u00ebrket argumentit t\u00eb kat\u00ebrt Gjonaj thot\u00eb se Kuvendi i ka p\u00ebrcjell\u00eb ministris\u00eb faktin q\u00eb afati 30 ditor i presidentit ka p\u00ebrfunduar e k\u00ebsisoj n\u00eb Kushtetuese zgjidhej kandidati i par\u00eb n\u00eb list\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u2018S\u00eb treti, Presidenti paraqet pa pushim nj\u00eb rr\u00ebfim me natyr\u00eb policeske lidhur me botimin n\u00eb Fletoren Zyrtare zgjedhjen e Vorpsit. B\u00ebrthama e rr\u00ebfimit \u00ebsht\u00eb thjesht dita e shtun\u00eb, pra fakti q\u00eb botimi \u00ebsht\u00eb b\u00ebr\u00eb t\u00eb shtun\u00ebn. Kjo i ka mjaftuar presidentit t\u00eb dal\u00eb n\u00eb p\u00ebrfundimin se jemi para nj\u00eb grushti shteti. E kam shum\u00eb t\u00eb v\u00ebshtir\u00eb n\u00ebse Presidenti e beson vet\u00eb k\u00ebt\u00eb version. Sikur Presidenti apo k\u00ebshilltar\u00ebt e ti t\u00eb kishin b\u00ebr\u00eb nj\u00eb k\u00ebrkim, do kishin m\u00ebsuar se e shtuna dhe e diela jan\u00eb dit\u00eb q\u00eb figurojn\u00eb n\u00eb Fletoren Zyrtare. S\u00eb kat\u00ebrti, Presidenti deklaron se grupi i struktura n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb ka shkelur ligjin se ka botuar nj\u00eb vendim q\u00eb nuk kishte kompetenca. N\u00eb fakt \u00ebsht\u00eb krejt e kund\u00ebrta. Kuvendi i ka p\u00ebrcjell\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb faktin q\u00eb afati 30 ditor i Presidentit ka p\u00ebrfunduar dhe p\u00ebr k\u00ebt\u00eb shkak kandidati i par\u00eb n\u00eb list\u00eb zgjidhet automatikisht.\u2019<\/em> &#8211; tha Gjonaj.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Deklarata e plot\u00eb e Gjonajt<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Sot jam n\u00eb k\u00ebt\u00eb komunikim me ju, dhe n\u00ebp\u00ebrmjet jush, p\u00ebrpara opinionit publik, p\u00ebr t\u00eb shtjelluar me p\u00ebrgjegj\u00ebsin\u00eb time t\u00eb plot\u00eb politike, profesionale e qytetare, nj\u00eb tem\u00eb q\u00eb \u00ebsht\u00eb kthyer n\u00eb thirrje p\u00ebr protest\u00eb nga as m\u00eb shum\u00eb dhe as m\u00eb pak, po vet\u00eb Presidenti i Republik\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nuk e kam b\u00ebr\u00eb k\u00ebt\u00eb shtjellim m\u00eb par\u00eb, sepse kam gjykuar q\u00eb i duhej l\u00ebn\u00eb Presidentit koha dhe hap\u00ebsira e plot\u00eb mediatike p\u00ebr t\u00eb ezauruar t\u00eb gjitha serit\u00eb e spektaklit t\u00eb tij politik mbi \u201cgrupin armiq\u00ebsor dhe kriminal\u201d n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nuk e b\u00ebj k\u00ebt\u00eb sqarim sot as p\u00ebr t\u2019iu p\u00ebrgjigjur Presidentit, p\u00ebr morin\u00eb e akuzave dhe as p\u00ebr tju p\u00ebrgjigjur fjal\u00ebve t\u00eb padenja q\u00eb ka l\u00ebshuar publikisht n\u00eb drejtimin tim, personalisht apo p\u00ebrmes z\u00ebdh\u00ebn\u00ebsve t\u00eb tij. Une u rezervoj t\u00eb gjith\u00eb keqardhjen time p\u00ebr hallin e madh q\u00eb i motivon n\u00eb luften kund\u00ebr Reform\u00ebs n\u00eb Drejt\u00ebsi, por akuzat ndaj meje nuk i leht\u00ebson nga pozita e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti ka krijuar nj\u00eb kauz\u00eb fiktive n\u00eb funksion t\u00eb betejave t\u00eb tij politike, q\u00eb n\u00eb \u00e7do rast nuk jan\u00eb n\u00eb p\u00ebrputhje me p\u00ebrgjegj\u00ebsit\u00eb e tij t\u00eb larta kushtetuese, si p\u00ebrfaq\u00ebsues i unitetit t\u00eb popullit, n\u00eb momentin e r\u00ebnd\u00ebsish\u00ebm q\u00eb po kalon Shqip\u00ebria n\u00eb prag t\u00eb negociatave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Deformimet e r\u00ebnda faktike, juridike dhe logjike t\u00eb k\u00ebtij show politik presidencial mbi gjoja rr\u00ebmbimin e kompetencave t\u00eb Presidentit jan\u00eb mbres\u00eblenese p\u00ebr k\u00ebdo q\u00eb i di faktet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Per shembull, kujt dhe per \u00e7far\u00eb i drejtohet n\u00eb thirrjen e tij t\u00eb d\u00ebshp\u00ebruar zoti President, mbi zgjedhjen e anetar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese, kur sot gjyqtarja e zgjedhur prej tij me nj\u00eb procedur\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn dhe t\u00eb paligjshme ushtron funksionin si an\u00ebtare e GJK?<\/span><\/p>\n<p><span style=\"color: #000000;\">Dhe pik\u00ebrisht p\u00ebr nj\u00eb informim korrekt mbi faktet, t\u00eb kujtdo q\u00eb d\u00ebshiron t\u00eb dije si q\u00ebndron e v\u00ebrteta e t\u00ebr\u00eb k\u00ebsaj orvajtje t\u00eb d\u00ebshp\u00ebruar kund\u00ebr Reform\u00ebs n\u00eb Drejt\u00ebsi, sipas Kushtetut\u00ebs, ligjit dhe praktik\u00ebs q\u00eb po nd\u00ebrtohet gjat\u00eb k\u00ebtyre viteve, po vijoj si m\u00eb posht\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb pari: Presidenti artikulon papushim p\u00ebr t\u00eb drejt\u00ebn e tij p\u00ebr t\u00eb pezulluar num\u00ebrimin e dit\u00ebve t\u00eb afatit qe i jep ligji kushtetues, p\u00ebr p\u00ebrzgjedhjen e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese. Pezullimi i nj\u00eb afati prekluziv q\u00eb as nuk pezullohet dhe as ndryshohet nga institucioni q\u00eb duhet t\u00eb veproj\u00eb sipas afatit, \u00ebsht\u00eb nj\u00eb koncept q\u00eb faktikisht nuk ekziston n\u00eb asnj\u00eb praktik\u00eb kushtetuese. Pra juridikisht mund t\u00eb konsiderohet nonsens dhe logjikisht m\u00eb s\u00eb paku nj\u00eb lajthitje ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb dyti: parashikimet ligjore dhe kushtetuese p\u00ebr p\u00ebrzgjedhjen e an\u00ebtarit t\u00eb GJK nga Presidenti jan\u00eb shum\u00eb t\u00eb qart\u00eb. Sipas parashikimeve t\u00eb ligjit p\u00ebr Gjykat\u00ebn Kushtetuese, Presidenti ushtron t\u00eb drejt\u00ebn e zgjedhjes s\u00eb gjyqtarit kushtetues brenda 30 dit\u00ebve nga marrja e list\u00ebs prej K\u00ebshillit t\u00eb Em\u00ebrimeve ne Drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti e ushtron t\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb n\u00eb dy forma, a) ose n\u00ebp\u00ebrmjet dekretit ose b) n\u00eb m\u00ebnyr\u00eb t\u00eb heshtur, duke pranuar q\u00eb kandidati i renditur i pari nga K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi t\u00eb konsiderohet i em\u00ebruar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Q\u00ebllimi i vendosjes s\u00eb k\u00ebtij afati apo mekanizmi zhbllokues ka q\u00ebn\u00eb pik\u00ebrisht shmangia e bllokimit t\u00eb zgjedhjes s\u00eb an\u00ebtarit t\u00eb gjykat\u00ebsit kushtetues p\u00ebr shkaqe politike apo teknike. Kjo ishte edhe nj\u00eb nga risit\u00eb e reform\u00ebs n\u00eb drejt\u00ebsi e p\u00ebrkrahur edhe nga Komisioni I Venecias.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por \u00e7far\u00eb ndodhi? Afati 30 ditor i Presidentit p\u00ebr t\u00eb zgjedhur an\u00ebtarin e Gjykat\u00ebs Kushtetuese p\u00ebrfundoi dhe Presidenti nuk e shfryt\u00ebzoi kohen 30 ditore. Theksoj se ky \u00ebsht\u00eb nj\u00eb afat prekluziv, pra i pandryshuesh\u00ebm dhe i pa-pezulluesh\u00ebm, p\u00ebr shkak se vet\u00eb ligji e ka lidhur kalimin e k\u00ebtij afati me ardhjen e nj\u00eb pasoje. Pra, me kalimin e k\u00ebtij afati, b\u00ebhet automatik em\u00ebrimi si an\u00ebtar i Gjykat\u00ebs Kushtetuese i kandidatit q\u00eb \u00ebsht\u00eb renditur i pari.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb shkak, Arta Vorpsi, q\u00eb ishte renditur e para nga KED si institucion I pavarur, konsiderohet e zgjedhur gjyqtare Kushtetuese automatikisht nga ligji (ex lege) me dat\u00eb 08.11.2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb treti: Presidenti paraqet papushim nj\u00eb rr\u00ebfim me natyr\u00eb policeske, lidhur me botimin n\u00eb Fletoren Zyrtare t\u00eb zgjedhjes s\u00eb zonj\u00ebs Arta Vorpsi. B\u00ebrthama e rr\u00ebfimit \u00ebsht\u00eb thjesht\u00eb dita e shtun\u00eb. Pra fakti se botimi n\u00eb Fletoren Zyrtare \u00ebsht\u00eb b\u00ebr\u00eb t\u00eb shtun\u00ebn, i ka mjaftuar zotit President t\u00eb dal n\u00eb konkluzionin se jemi p\u00ebrpara nj\u00eb konspiracioni armiq\u00ebsor, p\u00ebrmes t\u00eb cilit synohet nj\u00eb grusht shteti.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sinqerisht e kam shum\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb besoj se Presidenti i Republik\u00ebs e beson vet\u00eb k\u00ebt\u00eb version kaq ekstremist p\u00ebr imagjinat\u00ebn e \u00e7do njeriu normal, t\u00eb nj\u00eb konspiracioni me finalitetin e nj\u00eb grushti shteti, i cili provohet me argumentin se dit\u00ebn e shtun\u00eb, grupi armiq\u00ebsor n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb \u00ebsht\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje duke synuar t\u00eb p\u00ebrfitoj\u00eb nga fakti se shteti \u00ebsht\u00eb pushim. Sikur Presidenti t\u00eb kishte b\u00ebr\u00eb nj\u00eb k\u00ebrkim krejt sip\u00ebrfaq\u00ebsor n\u00eb arkiv\u00eb, do t\u00eb kishte m\u00ebsuar se jo vet\u00ebm e shtuna po edhe e diela, jan\u00eb dit\u00eb q\u00eb figurojn\u00eb\u00a0 m\u00eb par\u00eb n\u00eb Fletoren Zyrtare.<\/span><\/p>\n<p><span style=\"color: #000000;\">S\u00eb kat\u00ebrti: Si q\u00ebndron konkretisht fakti i Botimit n\u00eb Fletoren Zyrtare i vendimit t\u00eb KED-se p\u00ebr an\u00ebtarin e zgjedhur ex lege?<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti deklaron se grupi I strukturuar I Ministris\u00eb s\u00eb drejt\u00ebsis\u00eb, ka shkelur ligjin se ka botuar n\u00eb FZ nj\u00eb vendim q\u00eb s\u2019kishte kompetenca p\u00ebr ta botuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por n\u00eb fakt \u00ebsht\u00eb krejt e kund\u00ebrta:<\/span><\/p>\n<p><span style=\"color: #000000;\">Pas informacionit q\u00eb KED i ka d\u00ebrguar Kuvendit, ky i fundit i ka p\u00ebrcjell\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb informacionin mbi praktik\u00ebn e ndjekur nga KED dhe faktin q\u00eb afati 30 ditor i em\u00ebrimit t\u00eb an\u00ebtarit t\u00eb gjykat\u00ebs Kushtetuese nga Presidenti kishte p\u00ebrfunduar dhe p\u00ebr k\u00ebt\u00eb shkak kandidati i renditur i pari n\u00eb baz\u00eb t\u00eb vendimit t\u00eb KED-s\u00eb, konsiderohej i em\u00ebruar ex lege (automatikisht).<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa koh\u00eb q\u00eb \u00ebsht\u00eb nj\u00eb an\u00ebtar I em\u00ebruar nga ligji, Ministria e Drejt\u00ebsis\u00eb i d\u00ebrgoi Qendr\u00ebs s\u00eb Botimeve Zyrtare p\u00ebr publikim vendimin e KED p\u00ebr renditjen e kandidat\u00ebve.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Pse Ministria e Drejt\u00ebsis\u00eb?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 4 i ligjit p\u00ebr qendr\u00ebn e botimeve zyrtare dhe ligjit organik t\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb parashikohet se Ministria e drejt\u00ebsis\u00eb \u00ebsht\u00eb organi epror i QBZ dhe sh\u00ebrben p\u00ebr rregullimin e veprimtaris\u00eb s\u00eb saj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Po ashtu Ministria e Drejt\u00ebsis\u00eb dhe institucionet e saj t\u00eb var\u00ebsis\u00eb duhet t\u00eb garantojn\u00eb aksesin efektiv p\u00ebr njohjen e legjislacionit dhe ushtrimin e t\u00eb drejt\u00ebs p\u00ebr informim t\u00eb personave fizike dhe juridike, brenda dhe jasht\u00eb vendit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ministria e drejt\u00ebsis\u00eb ashtu si dhe \u00e7do organ publik, ka detyrimit t\u00eb p\u00ebrmbush\u00eb me rigorozitet pushtetet q\u00eb Kushtetuta dhe ligji i kan\u00eb dh\u00ebn\u00eb duke u bazuar mbi parimet e ligjshm\u00ebris\u00eb dhe transparenc\u00ebs n\u00eb kryerjen e funksionit brenda kufijve t\u00eb kompetencave dhe n\u00eb p\u00ebrputhje me q\u00ebllimin e dh\u00ebn\u00eb t\u00eb k\u00ebtyre kompetencave.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0N\u00eb nj\u00eb koh\u00eb q\u00eb vendimi I KED-s\u00eb q\u00eb b\u00ebhet fjal\u00eb ka renditur kandidat\u00ebt p\u00ebr an\u00ebtar t\u00eb Gjykat\u00ebs Kushtetuese, pavar\u00ebsisht se nuk reflektohet n\u00eb nenin 6 t\u00eb ligjit p\u00ebr botimet zyrtare specifikisht, sipas nenit 3 t\u00eb po k\u00ebtij ligji \u00ebsht\u00eb nj\u00eb akt q\u00eb nuk mund t\u00eb p\u00ebrjashtohet nga p\u00ebrkufizimi I \u201cakteve t\u00eb botueshme\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ashtu si\u00e7 nuk reflektohen t\u00eb gjitha aktet q\u00eb p\u00ebr nga natyra e tyre, duhet t\u00eb jen\u00eb t\u00eb botueshme, p\u00ebrfshir\u00eb k\u00ebtu edhe ky vendim i KED-s\u00eb apo \u00e7do lloj vendimi tjet\u00ebr q\u00eb do t\u00eb jet\u00eb si pasoj\u00eb e mekanizmit zhbllokues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji p\u00ebr organet e qeverisjes ka parashikuar detyrimin q\u00eb KED t\u00eb botoj\u00eb menj\u00ebher\u00eb n\u00eb faqen e gjykat\u00ebs s\u00eb lart\u00eb, \u00e7do vendim q\u00eb ai merr, me q\u00ebllim garantimin e transparenc\u00ebs p\u00ebr publikun.
