Kujtojm\u00eb se Meta pak dit\u00eb m\u00eb par\u00eb deklaroi se do b\u00ebnte nj\u00eb kall\u00ebzim penal ndaj kreut t\u00eb KED-s\u00eb Ardian Dvorani, me arsyetimin se ai ka shkelur Kushtetut\u00ebn dhe me veprimet e tij ka \u00e7uar n\u00eb nj\u00eb p\u00ebrplasje t\u00eb q\u00ebllimt\u00eb mes Presidentit dhe Kuvendit, p\u00ebr vendet vakante n\u00eb Gjykat\u00ebn Kushtetuese.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">REAGIMI I PLOT\u00cb I AVOKATIT T\u00cb POPULLIT:<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">GJETJE PARAPRAKE TE INSTITUCIONIT TE AVOKATIT TE POPULLIT NE ROLIN E TIJ SI VEZHGUES NE VEPRIMTARINE E KESHILLIT TE EMERIMEVE NE DREJTESI<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana e institucionit t\u00eb Avokatit t\u00eb Popullit \u00ebsht\u00eb ndjekur me v\u00ebm\u00ebndje dhe dedikim t\u00eb posa\u00e7\u00ebm zbatimi i reform\u00ebs n\u00eb drejt\u00ebsi n\u00eb p\u00ebrgjith\u00ebsi, por edhe procedura e krijimit t\u00eb nj\u00eb prej institucioneve m\u00eb t\u00eb rendesishme n\u00eb vend: Gjykat\u00ebs Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">Roli i institucionit t\u00eb Avokatit t\u00eb Popullit n\u00eb kete rast \u00ebsht\u00eb i dyfisht\u00eb, jo vetem si institucion Kushtetues i parashikuar p\u00ebr mbrojtjen dhe garantimin e Lirive dhe t\u00eb Drejtave t\u00eb Njeriut, por edhe si nj\u00eb institucion t\u00eb cilit Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe legjislacioni p\u00ebr Reform\u00ebn n\u00eb Drejt\u00ebsi i ka dh\u00ebn\u00eb rol dhe kompetenca t\u00eb caktuara n\u00eb k\u00ebt\u00eb proces n\u00eb m\u00ebnyr\u00eb t\u00eb posa\u00e7me.<\/span><\/p>\n<p><span style=\"color: #000000;\">Institucioni i Avokatit t\u00eb Popullit, si institucion komb\u00ebtar i t\u00eb drejtave t\u00eb njeriut \u00ebsht\u00eb garant i respektimit t\u00eb standardeve m\u00eb t\u00eb larta t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs n\u00eb Shqip\u00ebri. Roli i kahersh\u00ebm i institucionit t\u00eb Avokatit t\u00eb Popullit si monitorues i \u00e7do procesi q\u00eb lidhet me t\u00eb drejtat e njeriut \u00ebsht\u00eb theksuar edhe m\u00eb tep\u00ebr n\u00ebn drit\u00ebn e ndryshimeve t\u00eb reja kushtetuese, t\u00eb cilat i kan\u00eb caktuar k\u00ebtij institucioni nj\u00eb mandat specifik i cili lidhet pik\u00ebrisht me nevoj\u00ebn e monitorimit t\u00eb pun\u00ebs s\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, organ i cili nuk mund t\u00eb vishet kurrsesi me kompetenca t\u00eb plota e t\u00eb pakufizuara p\u00ebr ushtrimin e funksioneve t\u00eb tij n\u00eb mbledhje me dyer t\u00eb mbyllura. Th\u00ebn\u00eb kjo, vlen t\u00eb theksohet se Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe ligji e kan\u00eb ngarkuar institucionin e Avokatit t\u00eb Popullit me kompetenca v\u00ebzhguese e monitoruese jo vet\u00ebm n\u00eb aspektin formal, por me pik\u00ebsynimin p\u00ebr ta veshur k\u00ebt\u00eb institucion me legjitimitetin e nevojsh\u00ebm p\u00ebr t\u00eb luajtur nj\u00eb rol proaktiv, q\u00eb synon t\u00eb siguroj\u00eb pik\u00ebrisht garantimin e respektimit t\u00eb standardeve m\u00eb t\u00eb larta t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs dhe t\u00eb mir\u00ebqeverisjes.<\/span><\/p>\n<p><span style=\"color: #000000;\">M\u00eb konkretisht neni 149\/d pika 3 e Kushtetutes, parashikon se \u00ab \u2026Avokati i Popullit merr pjes\u00eb si v\u00ebzhgues n\u00eb procedur\u00ebn e hedhjes s\u00eb shortit, si dhe n\u00eb mbledhjet dhe veprimtarin\u00eb e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi\u201d.Gjithashtu sipas nenit 233 t\u00eb ligjit nr. 115\/2016 \u201cP\u00ebr organet e qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb\u201d: \u201c1. Mbledhjet e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi jan\u00eb t\u00eb mbyllura. Avokati i Popullit merr pjes\u00eb n\u00eb mbledhjet dhe veprimtarin\u00eb e K\u00ebshillit. \u2026 \u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga interpretimi i dispozitave t\u00eb m\u00ebsip\u00ebrme rezulton se Kushtetuta ka vendosur q\u00eb procedurat e p\u00ebrzgjedhjes s\u00eb k\u00ebtyre kandidat\u00ebve t\u00eb behen n\u00eb mbledhje t\u00eb mbyllura, pa pranin\u00eb e personave t\u00eb interesuar (media apo organizata t\u00eb shoq\u00ebris\u00eb civile q\u00eb ndjekin procesin) por t\u00eb garantohet transparenca n\u00ebp\u00ebrmjet pranis\u00eb n\u00eb mbledhje dhe veprimtari t\u00eb Avokatit t\u00eb Popullit . Duke qen\u00eb se veprimtaria e KED-s\u00eb ka lidhje t\u00eb drejt\u00ebp\u00ebrdrejt\u00eb me ngritjen dhe mir\u00ebfunksionimin e Gjykat\u00ebs Kushtetuese dhe p\u00ebrzgjedhjen e Inspektorit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb, n\u00eb kuad\u00ebr t\u00eb detyrimeve ligjore q\u00eb aktet e sip\u00ebrcituara parashikojn\u00eb p\u00ebr institucionin ton\u00eb, Avokati i Popullit po p\u00ebrgatit nj\u00eb raport t\u00eb ve\u00e7ant\u00eb p\u00ebr ushtrimin e k\u00ebtij mandati t\u00eb dh\u00ebn\u00eb n\u00eb m\u00ebnyr\u00eb specifike nga Kushtetuta dhe ligji, por p\u00ebr interesin e publikut dhe nisur nga kriza e re n\u00eb vend n\u00eb lidhje me k\u00ebt\u00eb proces, e gjejm\u00eb t\u00eb nevojshme t\u00eb paraqesim k\u00ebt\u00eb raport me gjetjet tona paraprake si v\u00ebzhgues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Referuar p\u00ebrcaktimit n\u00eb literatur\u00ebn bashk\u00ebkohore t\u00eb konceptit t\u00eb \u201cv\u00ebzhgimit\u201d apo \u201cstatusit t\u00eb v\u00ebzhguesit\u201d, ai p\u00ebrkufizohet si \u201d\u2026aft\u00ebsia p\u00ebr t\u2019u kushtuar shum\u00eb v\u00ebmendje gj\u00ebrave dhe p\u00ebr t\u00eb v\u00ebrejtur m\u00eb shum\u00eb rreth tyre, sesa shumica e njer\u00ebzve\u2026\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Zakonisht, t\u00eb qenit me statusin e v\u00ebzhguesit pran\u00eb nj\u00eb organi t\u00eb administrimit t\u00eb drejt\u00ebsis\u00eb (n\u00eb k\u00ebt\u00eb rast organit t\u00eb KED), procesi i v\u00ebzhgimit p\u00ebrfshin disa q\u00ebllime. N\u00eb ve\u00e7anti, p\u00ebr t\u00eb gjeneruar prova empirike p\u00ebr nj\u00eb analiz\u00eb m\u00eb t\u00eb gjer\u00eb t\u00eb sistemit t\u00eb administrimit t\u00eb drejt\u00ebsis\u00eb n\u00eb nj\u00eb vend t\u00eb caktuar, p\u00ebr t\u00eb mb\u00ebshtetur p\u00ebrpjekjet p\u00ebr t\u00eb reformuar sistemin e drejt\u00ebsis\u00eb dhe p\u00ebr t\u00eb komunikuar shqet\u00ebsime n\u00eb lidhje me nj\u00eb \u00e7\u00ebshtje apo proces t\u00eb ve\u00e7ant\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Parimet e v\u00ebzhgimit p\u00ebrfshijn\u00eb paanshm\u00ebrin\u00eb dhe v\u00ebzhgimin e informuar, si dhe pun\u00ebn n\u00eb m\u00ebnyr\u00eb konstruktive me organin ndaj t\u00eb cilit ushtrohet vezhgimi (KED), por jo vet\u00ebm. \u201cV\u00ebzhgimi\u201d do t\u00eb thot\u00eb kryesisht t\u00eb jesh i pranish\u00ebm n\u00eb mbledhjet e organit q\u00eb v\u00ebzhgohet duke par\u00eb e ndjekur nga af\u00ebr veprimtarin\u00eb e tij administrative, pra duke u njohur n\u00eb thelb me t\u00eb gjith\u00eb produktin e k\u00ebsaj veprimtarie (d.m.th. me \u00e7do akt t\u00eb prodhuar prej tij, si procesverbalet e mbledhjeve, etj).<\/span><\/p>\n<p><span style=\"color: #000000;\">Institucioni t\u00eb cilit i \u00ebsht\u00eb ngarkuar detyra e ushtrimit t\u00eb detyr\u00ebs s\u00eb v\u00ebzhguesit, duhet t\u00eb shfaq\u00eb nivelet m\u00eb t\u00eb larta t\u00eb profesionalizmit, diskrecionit dhe njohuris\u00eb. Ky institucion, pra Avokati i Popullit duhet t\u00eb jet\u00eb gjithnj\u00eb i paansh\u00ebm dhe t\u00eb shihet si i paansh\u00ebm, ve\u00e7an\u00ebrisht, duke mos komentuar publikisht p\u00ebr procedurat n\u00eb zhvillim e sip\u00ebr.<\/span><\/p>\n<p><span style=\"color: #000000;\">Shpesh her\u00eb, koncepti i monitorimit mbivendoset me \u201cv\u00ebzhgimin\u201d. Monitorimi n\u00eb vetvete i referohet kryesisht procesit t\u00eb shtrir\u00eb n\u00eb koh\u00eb, q\u00eb n\u00eb fakt mund t\u00eb p\u00ebrfshij\u00eb raste t\u00eb shumta t\u00eb v\u00ebzhgimit t\u00eb veprimtaris\u00eb administrative t\u00eb organit q\u00eb v\u00ebzhgohet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht, raportimi p\u00ebr v\u00ebzhgimin e veprimtaris\u00eb s\u00eb KED \u00ebsht\u00eb nj\u00eb mekaniz\u00ebm i r\u00ebnd\u00ebsish\u00ebm, jo vet\u00ebm p\u00ebr paraqitjen e gjetjeve n\u00eb m\u00ebnyr\u00eb efektive p\u00ebr publikun (si tregues p\u00ebr p\u00ebrmbushjen me sukses nga ana e AP t\u00eb k\u00ebsaj detyre kushtetuese dhe ligjore), por edhe p\u00ebr krijimin e rekomandimeve ky\u00e7e p\u00ebr ecjen p\u00ebrpara t\u00eb reform\u00ebs s\u00eb sistemit gjyq\u00ebsor n\u00eb shina kushtetuese dhe ligjore, si dhe p\u00ebr fillimin e dialogut me pal\u00ebt e interesuara dhe aktor\u00eb n\u00eb k\u00ebt\u00eb reform\u00eb, n\u00ebse konstatohet devijim nga kjo rrug\u00eb.<\/span><br \/>\n<span style=\"color: #000000;\">***<\/span><br \/>\n<span style=\"color: #000000;\">Detyrat tona specifike p\u00ebr k\u00ebt\u00eb pro\u00e7es, lidhen fillimisht me monitorimin e hedhjes s\u00eb shortit p\u00ebr zgjedhjen e anetareve t\u00eb K\u00ebshillit t\u00eb Emerimeve n\u00eb Drejt\u00ebsi. N\u00eb lidhje me hedhjen e shortit, konform detyrimit t\u00eb parashikuar nga neni 284, pika 6 e ligjit nr. 115\/2016 \u201cP\u00ebr Organet e Qeverisjes s\u00eb Sistemit t\u00eb Drejt\u00ebsis\u00eb\u201d, sipas t\u00eb cilit: \u201c\u2026 Procedurat e shortit zhvillohen n\u00eb prani t\u00eb Avokatit t\u00eb Popullit, i cili harton dhe b\u00ebn publik nj\u00eb raport monitorimi mbi procedur\u00ebn e shortit\u201d, institucioni yn\u00eb ka hartuar dhe b\u00ebr\u00eb publike tre raporte monitorimi, respektivisht p\u00ebr shortet e zhvilluara p\u00ebr K\u00ebshillat e Emerimeve n\u00eb Drejtesi n\u00eb: dhjetor 2016, dhjetor 2017 dhe dhjetor 2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me hedhjen e shortit p\u00ebr krijimin e KED-ve, vlen p\u00ebr t\u2019u theksuar se shqet\u00ebsimet e ngritura nga institucioni yn\u00eb n\u00eb Raportimin e vitit 2017, nuk na rezulton t\u00eb jen\u00eb shqyrtuar, ndaj disa prej problematikave t\u00eb konstatuara nga ne gjat\u00eb hedhjes s\u00eb shortit n\u00eb dhjetor 2017, u p\u00ebrs\u00ebrit\u00ebn s\u00ebrish edhe gjate hedhjes s\u00eb shortit n\u00eb dhjetor 2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">Problematikat n\u00eb lidhje me shortet p\u00ebrmblidhen n\u00eb elementet thelb\u00ebsore si vijon:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Sipas nenit 179, pika 11 t\u00eb dispozitave kalimtare t\u00eb Kushetut\u00ebs: \u00abPresidenti i Republik\u00ebs, brenda pes\u00eb dit\u00ebve nga hyrja n\u00eb fuqi e k\u00ebtij ligji, zgjedh me short an\u00ebtar\u00ebt e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, sipas nenit 149\/d, pika 3, t\u00eb Kushtetut\u00ebs\u00bb. Pas nj\u00eb diskutimi publik t\u00eb b\u00ebr\u00eb n\u00eb Presidenc\u00eb me jurist\u00eb e konstitucionalist\u00eb dhe pas takimeve t\u00eb Presidentit me krer\u00ebt e grupeve parlamentare, kriteret e p\u00ebrcaktuara n\u00eb Kushtetut\u00eb u konsideruan shum\u00eb gjeneraliste dhe p\u00ebr k\u00ebt\u00eb arsye pati konsensus q\u00eb p\u00ebr ngritjen e KED do t\u00eb duhet t\u00eb miratohej ligji p\u00ebr organet e qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, i cili do t\u00eb p\u00ebrcaktonte kritere specifike. N\u00eb k\u00ebt\u00eb menyr\u00eb KED nuk u krijua sipas afatit t\u00eb parashikuar n\u00eb Kushtetut\u00eb.<\/span><\/li>\n<li><span style=\"color: #000000;\">N\u00eb dhjetor 2016, pasi u hyri n\u00eb fuqi ligji nr. 115\/2016 \u201cP\u00ebr Organet e Qeverisjes s\u00eb Sistemit t\u00eb Drejt\u00ebsis\u00eb\u201d, u hodh shorti i par\u00eb p\u00ebr ngritjen e KED, short i cili krijoi edhe K\u00ebshillin e par\u00eb t\u00eb Emerimeve n\u00eb Drejt\u00ebsi. Ky K\u00ebshill nuk u mblodh p\u00ebr asnj\u00eb rast pasi kryetarja e k\u00ebtij organi, anetarja e Gjykat\u00ebs s\u00eb Lart\u00eb, hoqi dor\u00eb nga detyra e gjyqtarit, e p\u00ebr k\u00ebt\u00eb arsye K\u00ebshilli nuk u konstituua (shiko m\u00eb holl\u00ebsisht edhe paragrafin e m\u00ebposht\u00ebm n\u00eb lidhje me numrin e an\u00ebtar\u00ebve t\u00eb KED-s\u00eb).<\/span><\/li>\n<li><span style=\"color: #000000;\">N\u00eb dhjetor 2017, u hodh shorti i dyt\u00eb p\u00ebr p\u00ebrzgjedhjen e an\u00ebtar\u00ebve t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, i cili nxori problematika si n\u00eb lidhje me natyr\u00ebn e K\u00ebshillit, ashtu edhe se cili ishte organi q\u00eb d\u00ebrgonte listat e gjyqtar\u00ebve q\u00eb duhet t\u00eb futeshin n\u00eb shortin p\u00ebr t\u00eb q\u00ebn\u00eb an\u00ebtar\u00eb t\u00eb k\u00ebtij K\u00ebshilli. K\u00ebshilli nuk u mblodh m\u00eb, pasi nj\u00eb pjes\u00eb e mir\u00eb e an\u00ebtar\u00ebve t\u00eb tij, nuk arrit\u00ebn t\u00eb kalonin procesin e vetting-ut, gj\u00eb q\u00eb e b\u00ebri t\u00eb pamundur pun\u00ebn e K\u00ebshillit.<\/span><br \/>\n<span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb duhet theksuar se vakancat p\u00ebr an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese kan\u00eb qen\u00eb t\u00eb hapura p\u00ebr t\u2019u plot\u00ebsuar qysh n\u00eb vitin 2017 dhe organet e em\u00ebrtes\u00ebs kishin paqart\u00ebsi se si dhe ku do t\u00eb b\u00ebhej dor\u00ebzimi i materialeve p\u00ebr sa koh\u00eb q\u00eb K\u00ebshilli nuk ishte konstituuar.<\/span><\/li>\n<li><span style=\"color: #000000;\">Kushtet dhe kriteret p\u00ebr t\u2019u p\u00ebrfshir\u00eb n\u00eb shortin p\u00ebr zgjedhjen e an\u00ebtar\u00ebve t\u00eb K\u00ebshillit dhe procedurat e p\u00ebrzgjedhjeste percaktuar nga neni 221 pika 1e ligjit nr. 115\/2016 \u201cP\u00ebr Organet e Qeverisjes s\u00eb Sistemit t\u00eb Drejt\u00ebsis\u00eb\u201d, jan\u00eb taksative, nd\u00ebrkohe q\u00eb pika 2 e k\u00ebtij neni p\u00ebrmban nj\u00eb parashikim p\u00ebrjashtues dhe m\u00eb konkretisht parashikon se: \u00abKandidat\u00ebt q\u00eb nuk plot\u00ebsojn\u00eb nj\u00eb nga k\u00ebto kushte p\u00ebrjashtohen nga shorti\u00bb.<\/span><\/li>\n<li><span style=\"color: #000000;\">Pavar\u00ebsisht k\u00ebtij parashikimi ligjor, ai nuk u zbatua as n\u00eb shortin e hedhur n\u00eb dhjetor 2016, as n\u00eb at\u00eb dhjetor 2017 dhe as n\u00eb dhjetor 2018.<\/span><\/li>\n<li><span style=\"color: #000000;\">Zbatimi i t\u00eb t\u00ebra kritereve do t\u00eb zvog\u00eblonte shum\u00eb, p\u00ebr t\u00eb mos th\u00ebn\u00eb do t\u00eb p\u00ebrjashtonte mund\u00ebsin\u00eb e p\u00ebrzgjedhjes me short, pasi p\u00ebr disa grupe t\u00eb p\u00ebrfaqesuara s\u2019do kish m\u00eb shum\u00eb se nj\u00eb kandidat q\u00eb plot\u00ebsonte t\u00eb t\u00ebr\u00eb kriteret.<\/span><\/li>\n<li><span style=\"color: #000000;\">N\u00eb shum\u00eb raste interpretimet e ligjit nga Misioni Euralius mbi baz\u00ebn e k\u00ebrkes\u00ebs s\u00eb Kuvendit, apo nga Komisioni i Monitorimit t\u00eb Reformes n\u00eb Drejt\u00ebsi, apo edhe Komisioni p\u00ebr \u00c7\u00ebshtjet Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut n\u00eb Kuvend b\u00ebheshin p\u00ebr t\u00eb mos bllokuar ecurine e reform\u00ebs, e n\u00eb rastin konkret p\u00ebr ngritjen e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, por n\u00eb vler\u00ebsimin ton\u00eb p\u00ebrcaktimi i kritereve strikte, ka qen\u00eb vullnet i qart\u00eb i grupit t\u00eb pun\u00ebs q\u00eb hartoi legjislacionin p\u00ebr reform\u00ebn n\u00eb drejt\u00ebsi dhe q\u00eb m\u00eb pas u miratua nga Kuvendi. Interpretimi i k\u00ebtyre dispozitave n\u00eb lidhje me kriteret, ka q\u00ebn\u00eb shkas edhe p\u00ebr nj\u00eb deklarat\u00eb t\u00eb r\u00ebnd\u00ebsishme publike t\u00eb ish-Ambasadorit t\u00eb Shteteve t\u00eb bashkuara z.Donald Lu, n\u00eb lidhje m\u00eb kriteret e zbatuara nga organet q\u00eb duhet t\u00eb dergonin listat e kandidat\u00ebve p\u00ebr t\u00eb p\u00ebrzgjedhur an\u00ebtar\u00ebt e KED.<\/span><\/li>\n<li><span style=\"color: #000000;\">Gjetjet tona n\u00eb m\u00ebnyr\u00eb t\u00eb holl\u00ebsishme jan\u00eb n\u00eb raportet e monitorimit t\u00eb hedhjes s\u00eb shortit, t\u00eb bera publike menj\u00ebher\u00eb pas shortit dhe rezulton se nuk jan\u00eb zbatuar kriteret e ligjit p\u00ebr t\u00eb b\u00ebr\u00eb listat e paraqitura nga organet q\u00eb duhet t\u2019i d\u00ebrgojn\u00eb ato dhe pa asnj\u00eb shpjegim, p\u00ebr disa organe e kategori t\u00eb p\u00ebrfaqesuara jan\u00eb p\u00ebrdorur kriteret m\u00eb t\u00eb kufizuara e p\u00ebr disa jo. Fakt \u00ebsht\u00eb q\u00eb, qysh prej me fillimit t\u00eb pun\u00ebs KED nuk kishte numrin e an\u00ebtar\u00ebve t\u00eb caktuar me ligj, e konkretisht 9 an\u00ebtar\u00eb.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Neni 149\/d, pika 3 e Kushtetut\u00ebs parashikon q\u00eb KED duhet t\u00eb p\u00ebrb\u00ebhet nga 9 an\u00ebtar\u00eb t\u00eb p\u00ebrzgjedhur me short nga gjyqtar\u00ebt e prokuror\u00ebt, ndaj t\u00eb cil\u00ebve nuk \u00ebsht\u00eb dh\u00ebn\u00eb nj\u00eb mas\u00eb disiplinore, nd\u00ebsa pika 5 po e ketij neni, referon tek ligji i ve\u00e7ant\u00eb p\u00ebr p\u00ebrcaktimin e kritereve t\u00eb tjera. M\u00eb konkretisht k\u00ebto kritere p\u00ebrcaktohen nga neni 221 i ligjit nr. 115\/2016, ndersa neni 229\/1 po i ketij ligjit parashikon se pjes\u00ebmarrja n\u00eb mbledhjet e KED \u00ebsht\u00eb e detyrueshme dhe se an\u00ebtar\u00ebt q\u00eb mungojn\u00eb z\u00ebvend\u00ebsohen nga an\u00ebtar\u00ebt z\u00ebvend\u00ebsues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas neni 220 t\u00eb ligjit nr. 115\/2016 K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi p\u00ebrb\u00ebhet nga 9 an\u00ebtar\u00eb si vijon: a) dy gjyqtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese; b) nj\u00eb gjyqtar i Gjykat\u00ebs s\u00eb Lart\u00eb; c) nj\u00eb prokuror nga Prokuroria e P\u00ebrgjithshme; \u00e7) dy gjyqtar\u00eb nga gjykatat e apelit; d) dy prokuror\u00eb nga zyrat e prokuroris\u00eb pran\u00eb gjykatave t\u00eb apelit; dh) nj\u00eb gjyqtar nga gjykatat administrative; t\u00eb cil\u00ebt q\u00ebndrojn\u00eb n\u00eb detyr\u00eb p\u00ebr 1 vit nga data 1 janar e \u00e7do viti kalendarik. Pjes\u00ebmarrja n\u00eb mbledhjet e K\u00ebshillit \u00ebsht\u00eb e detyrueshme dhe kur an\u00ebtar\u00ebt mungojn\u00eb, z\u00ebvend\u00ebsohen nga an\u00ebtar\u00ebt z\u00ebvend\u00ebsues.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrve\u00e7 an\u00ebtar\u00ebve nga Gjykata Kushtetuese, an\u00ebtaret e tjer\u00eb duhet t\u00eb ken\u00eb gezuar statusin magjistrat p\u00ebr nj\u00eb peridhe 10 vje\u00e7are dhe magjistrati duhet t\u00eb kishte mbaruar shkoll\u00ebn e magjistratur\u00ebs. Keto dy kritere t\u00eb p\u00ebrcaktuara nga ligji nr. 115\/2016 e zvog\u00ebluan shum\u00eb numrin e kandidat\u00ebve nga organet e larta t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, si Gjykata e Lart\u00eb, Prokuroria e P\u00ebrgjithshme apo Prokurorit\u00eb e Apelit, pasi nuk ka nj\u00eb num\u00ebr t\u00eb lart\u00eb prokuror\u00ebsh apo gjyqtar\u00ebsh n\u00eb k\u00ebto organe, q\u00eb t\u00eb ken\u00eb mbaruar Shkoll\u00ebn e Magjistratures, ose an\u00ebtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb q\u00eb t\u00eb ken\u00eb q\u00ebn\u00eb 10 vite magjistrat\u00eb . Problematik\u00eb jo e vog\u00ebl, n\u00eb lidhje me an\u00ebtar\u00ebt e KED n\u00eb drejt\u00ebsi rezultoi \u00e7\u00ebshtja se cdo t\u00eb ndodhe n\u00ebse numri i an\u00ebtar\u00ebve binte nga 9 an\u00ebtar\u00eb p\u00ebr shkaqe t\u00eb ndryshme.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nese gjat\u00eb pun\u00ebs s\u00eb K\u00ebshillit, numri i an\u00ebtar\u00ebve do t\u00eb bjer\u00eb n\u00ebn 9, e ulja e numrit nuk zgjidhet as nga koncepti i an\u00ebtar\u00ebve z\u00ebvend\u00ebsues. Pra, a do duhet q\u00eb t\u00eb hidhet p\u00ebrs\u00ebri shorti p\u00ebr t\u00eb plot\u00ebsuar numrin e an\u00ebtar\u00ebve q\u00eb humbasin vendin n\u00eb K\u00ebshill p\u00ebr arsye t\u00eb ndryshme, por n\u00eb \u00e7do rast n\u00eb mund\u00ebsin\u00eb dhe eventualitetin e moskalimit me sukses t\u00eb procedures s\u00eb vetingut? A ka m\u00eb shum\u00eb pesh\u00eb n\u00eb arkitektur\u00ebn e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi numri i an\u00ebtar\u00ebve i p\u00ebrcaktuar n\u00eb Kushtetut\u00eb, apo koha e hedhjes s\u00eb shortit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pa dashur t\u00eb zgjatemi n\u00eb analiz\u00ebn n\u00eb lidhje me k\u00ebto pyetje, ka nj\u00eb interpretim t\u00eb b\u00ebr\u00eb k\u00ebsaj \u00e7\u00ebshtjeje nga Minisioni Euralius mbi baz\u00ebn e k\u00ebrkes\u00ebs s\u00eb Kuvendit, sipas t\u00eb cilit \u00ebsht\u00eb konkluduar se nuk mund t\u00eb ket\u00eb shorte t\u00eb tjera gjat\u00eb periudh\u00ebs nj\u00eb vje\u00e7are t\u00eb q\u00ebndrimit n\u00eb detyr\u00eb t\u00eb KED edhe n\u00ebse numri i an\u00ebtar\u00ebve bie n\u00ebn 9 dhe an\u00ebtar\u00ebt z\u00ebvend\u00ebsues nuk e plot\u00ebsojn\u00eb q\u00ebllimin p\u00ebr t\u00eb cilin ata jan\u00eb parashikuar. Nd\u00ebrkohe nuk \u00ebsht\u00eb dh\u00ebn\u00eb opinion p\u00ebr rastin se \u00e7far\u00eb ndodh kur numri i an\u00ebtar\u00ebve bie n\u00ebn 5, q\u00eb \u00ebsht\u00eb numri minimal i nevojsh\u00ebm p\u00ebr vendimarrje.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb gjykimin ton\u00eb, shorti nga listat me kandidat\u00eb q\u00eb jan\u00eb p\u00ebrdorur n\u00eb muajin dhjetor t\u00eb \u00e7do viti, do ishte e udh\u00ebs t\u00eb p\u00ebrdoreshin p\u00ebr t\u00eb p\u00ebrzgjedhur an\u00ebtar\u00eb t\u00eb rinj, q\u00eb do t\u00eb q\u00ebndronin n\u00eb detyr\u00eb n\u00eb vendin e an\u00ebtarit q\u00eb ka humbur mandatin p\u00ebr shkak t\u00eb largimit nga detyra, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb sigurohet an\u00ebtar\u00ebsia e K\u00ebshillit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si konkluzion mund t\u00eb themi se parashikimet Kushtetuese dhe ato t\u00eb ligjit nr. 115\/2016 \u201cP\u00ebr Organet e Qeverisjes s\u00eb Sistemit t\u00eb Drejt\u00ebsis\u00eb\u201d, ishin shum\u00eb komplekse, parashikonin ngritjen e nj\u00eb numri organesh t\u00eb reja, t\u00eb cilat do t\u00eb duhet t\u00eb b\u00ebnin nj\u00eb pun\u00eb gati t\u00eb pamundur n\u00eb kushtet e p\u00ebrcaktuara nga Kushtetuta dhe ligji. Interpretimet e zgjeruara (apo lejuese), p\u00ebr t\u00eb anashkaluar disa parashikime t\u00eb ligjit, nuk mund t\u00eb zgjidhin problemin e nj\u00eb ligji tep\u00ebr kompleks dhe vendimi i gjithsecilit p\u00ebr t\u2019i dh\u00ebn\u00eb nj\u00eb klauzole ligjore m\u00eb shum\u00eb p\u00ebrpar\u00ebsi se nj\u00eb tjetre, nuk ndihmon q\u00eb organet e reja q\u00eb u ngrit\u00ebn t\u00eb marrin q\u00eb n\u00eb fillim besimin e nevojsh\u00ebm t\u00eb publikut dhe aktor\u00ebve t\u00eb tjer\u00eb q\u00eb kan\u00eb asistuar n\u00eb hartimin e reform\u00ebs n\u00eb drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana tjet\u00ebr, q\u00ebndrimi strikt i parashikimeve ligjore do t\u00eb b\u00ebnte t\u00eb pamundur zbatimit e reform\u00ebs, jo vet\u00ebm p\u00ebr shkak t\u00eb nj\u00eb numri jo t\u00eb vog\u00ebl parashikimesh kondradiktore apo p\u00ebrjashtuese me nj\u00ebra tjetr\u00ebn, por edhe p\u00ebr shkak t\u00eb afateve t\u00eb vendosura n\u00eb Kushtetut\u00eb e ligje, t\u00eb cilat kan\u00eb rezultuar t\u00eb pamundura p\u00ebr t\u2019u zbatuar. K\u00ebshtu p.sh. sipas nenit 221 pika 3: \u201cJo m\u00eb von\u00eb se data 15 n\u00ebntor e \u00e7do viti kalendarik, Gjykata Kushtetuese, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor dhe K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb verifikojn\u00eb n\u00ebse kandidat\u00ebt p\u00ebr an\u00ebtar\u00eb t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi plot\u00ebsojn\u00eb kushtet e parashikuara n\u00eb pik\u00ebn 1, t\u00eb k\u00ebtij neni, dhe i paraqesin Presidentit t\u00eb Republik\u00ebs dhe Kuvendit list\u00ebn e kandidat\u00ebve q\u00eb plot\u00ebsojn\u00eb kushtet\u201d. N\u00eb kushtet kur Gjykata Kushtetuese ishte jo-funksionale dhe kur dy organet e tjera (KLGJ dhe KLP) nuk ishin krijuar ende, edhe kjo dispozit\u00eb nuk kishte mund\u00ebsi t\u00eb zbatohej.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjithashtu ka rezultuar i zgjatur edhe afati i caktuar n\u00eb ligjin nr. 115\/2016 \u201cP\u00ebr Organet e Qeverisjes s\u00eb Sistemit t\u00eb Drejt\u00ebsis\u00eb\u201d, sipas te cilit K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejtesi, do t\u00eb duhej t\u00eb kishte mbaruar procedurat e verifikimit dhe vler\u00ebsimit t\u00eb kandidat\u00ebve, q\u00eb nga momenti i d\u00ebrgimit t\u00eb listave me kandidat\u00eb nga organet e em\u00ebrtes\u00ebs, p\u00ebr \u00e7do vakanc\u00eb n\u00eb Gjykat\u00ebn Kushtetuese.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr sa i p\u00ebrket veprimtaris\u00eb s\u00eb pun\u00ebs s\u00eb KED-s\u00eb gjat\u00eb vitit 2019, duhet t\u00eb theksohet q\u00eb n\u00eb krye t\u00eb her\u00ebs, se asaj i ra barra e jasht\u00ebzakonshme p\u00ebr t\u00eb verifikuar e vler\u00ebsuar lista me kandidat\u00eb p\u00ebr shum\u00eb vakanca nj\u00ebherazi. Kjo KED kishte gjithashtu edhe presionin e jasht\u00ebzakonsh\u00ebm t\u00eb publikut, pasi vendi ishte pa Gjykat\u00eb Kushtetuese funksionale.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebshtu q\u00eb puna e KED-s\u00eb nisi menj\u00ebher\u00eb dhe me nj\u00eb p\u00ebrgjegjshm\u00ebri t\u00eb lart\u00eb. N\u00eb t\u00eb t\u00ebra mbledhjet e zhvilluara kan\u00eb q\u00ebn\u00eb t\u00eb pranishem si institucioni i Avokatit t\u00eb Popullit (n\u00eb cil\u00ebsin\u00eb e p\u00ebrcaktuar nga ligji si v\u00ebzhgues n\u00eb mbledhje dhe veprimtari). N\u00eb cil\u00ebsin\u00eb e t\u00eb ftuarit edhe p\u00ebrfaqesuesi i Presidentit t\u00eb Republik\u00ebs ka marr\u00eb pjes\u00eb n\u00eb t\u00eb gjitha mbledhjet pa asnj\u00eb p\u00ebrjashtim. P\u00ebrfaq\u00ebsuesi i Kuvendit ka marr\u00eb pjes\u00eb rregullisht deri n\u00eb shpalljen e vendeve vakante p\u00ebr Inspektor t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb, e me tej kan\u00eb marr\u00eb pjes\u00eb n\u00eb mbledhjet q\u00eb kan\u00eb konsideruara t\u00eb p\u00ebrshtatshme. Komisioni p\u00ebr \u00e7\u00ebshtjet ligjore i Kuvendit n\u00eb cil\u00ebsin\u00eb e t\u00eb ftuarit ka marr\u00eb pjes\u00eb i p\u00ebrfaq\u00ebsuar gjegj\u00ebsisht nga Kryetari e Sekretari i Komisionit deri n\u00eb mars 2019. Edhe niveli i pjes\u00ebmarrjes s\u00eb t\u00eb gjitha institucioneve t\u00eb p\u00ebrmendura m\u00eb sip\u00ebr ka q\u00ebn\u00eb i lart\u00eb, Institucioni i Avokatit t\u00eb Popullit ka marr\u00eb pjes\u00eb duke u p\u00ebrfaq\u00ebsuar n\u00eb nivelin m\u00eb t\u00eb lart\u00eb hierarkik, n\u00eb rreth 95% t\u00eb aktivitetit t\u00eb KED. Po ashtu Kuvendi \u00ebsht\u00eb p\u00ebrfaq\u00ebsuar nga Sekretari i p\u00ebrgjithsh\u00ebm dhe n\u00eb shumic\u00ebn e rasteve nga nj\u00eb k\u00ebshilltar ligjor, nd\u00ebrsa institucioni i Presidentit \u00ebsht\u00eb p\u00ebrfaqesuar nga k\u00ebshilltari i tij ligjor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duhet t\u00eb n\u00ebnvizohet gjithashtu se problemet organizative nuk ishin t\u00eb vogla, jo vetem p\u00ebr sa i takon hartimit t\u00eb akteve mbi t\u00eb cilat do t\u00eb funksiononte K\u00ebshilli, por edhe n\u00eb lidhje me ngarkesen jo t\u00eb vog\u00ebl t\u00eb pun\u00ebs q\u00eb an\u00ebtar\u00ebt do t\u00eb duhej t\u00eb kryenin n\u00eb funksion t\u00eb veprimtaris\u00eb t\u00eb KED n\u00eb mbledhje e jasht\u00eb mbledhjeve (procedurat e secilit relator n\u00eb lidhje me veprimet verifikuese q\u00eb ai kryente p\u00ebr kandidat\u00ebt). K\u00ebta an\u00ebtar\u00eb nuk parashikohet nga ligji t\u00eb leht\u00ebsohen nga ushtrimi i aktivitetit t\u00eb tyre par\u00ebsor, pra detyr\u00ebs s\u00eb tyre si gjyqtar\u00eb n\u00eb gjykatat p\u00ebrkatese gjat\u00eb k\u00ebsaj periudhe. P\u00ebr m\u00eb tep\u00ebr ulja e numrit t\u00eb gjyqtar\u00ebve n\u00eb sistem, nuk ka ndihmuar n\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje. Problem do t\u00eb mbetet gjithnj\u00eb an\u00ebtar\u00ebsia n\u00eb K\u00ebshill e titullar\u00ebve t\u00eb institucioneve t\u00eb Gjykat\u00ebs Kushtetuese si: kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb, Gjykat\u00ebs Kushtetuese, apo Prokuror i P\u00ebrgjithsh\u00ebm, pasi detyrave t\u00eb tyre funksionale shum\u00eb impenjative, do t\u00eb duhet t\u2019u shtohen edhe funksioni i tyre si an\u00ebtar\u00eb t\u00eb KED, si dhe fakti q\u00eb ende edhe n\u00eb momentin e p\u00ebrgatitjes s\u00eb k\u00ebtij raporti paraprak, jan\u00eb ende edhe 5 vakanca t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr t\u2019u plot\u00ebsuar. Puna e K\u00ebshillit n\u00eb vitin 2020 mendohet t\u00eb jet\u00eb po aq impenjative sa ajo e vitit 2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00cbsht\u00eb p\u00ebr t\u2019u p\u00ebrshendetur fakti se p\u00ebr her\u00eb t\u00eb par\u00eb K\u00ebshilli i Ministrave miratoi nj\u00eb fond t\u00eb ve\u00e7ant\u00eb p\u00ebr shp\u00ebrblimin e pun\u00ebs s\u00eb an\u00ebtar\u00ebve t\u00eb K\u00ebshillit t\u00eb Emerimeve n\u00eb Drejt\u00ebsi. Kjo ishte hera e par\u00eb q\u00eb K\u00ebshilli i Ministrave miratoi nj\u00eb fond shtes\u00eb p\u00ebr shp\u00ebrblimin e pun\u00ebs s\u00eb anetar\u00ebve t\u00eb nj\u00eb organi t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi, i cili nuk \u00ebsht\u00eb organ i mbledhur n\u00eb m\u00ebnyr\u00eb permanente por ad hoc (pra n\u00ebse ka vakanca t\u00eb hapura).<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana e institucionit t\u00eb Avokatit t\u00eb Popullit, gjat\u00eb ndjekjes s\u00eb veprimtaris\u00eb s\u00eb KED-se jan\u00eb ngritur edhe problematikat n\u00eb vijim:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Gjat\u00eb hartimit t\u00eb Rregulloreve t\u00eb funksionimit t\u00eb k\u00ebtij organi, u konstatua nj\u00eb p\u00ebrpjekje p\u00ebr t\u00eb kufizuar kompetencat ligjore t\u00eb institucionit t\u00eb Avokatit t\u00eb Popullit. Fal\u00eb argumentave t\u00eb dh\u00ebna nga ne, u arrit fillimisht t\u00eb kufizohej kjo tendenc\u00eb, por s\u00ebrish disa prej Rregulloreve n\u00eb versionet e tyre p\u00ebrfundimtare t\u00eb publikuara n\u00eb faqen zyrtare t\u00eb KED-s\u00eb, kufizuan kompetencat e institucionit ton\u00eb p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb mbedhje e veprimtari, si\u00e7 e parashikon Kushtetuta dhe ligji 115\/2016, duke parashikuar nj\u00eb kufizim t\u00eb m\u00ebtejshem t\u00eb transparenc\u00ebs s\u00eb K\u00ebshillit.<\/span><\/p>\n<p><span style=\"color: #000000;\">M\u00eb konkretisht, KED ka miratuar nj\u00eb rregullore n\u00eb t\u00eb cil\u00ebn prezanton konceptin e dhom\u00ebs s\u00eb k\u00ebshillimit n\u00eb mbledhjet e k\u00ebtij organi administrativ, gj\u00eb e cila jo vet\u00ebm nuk \u00ebsht\u00eb e parashikuar n\u00eb ligj, por edhe n\u00ebse do i referoheshim teoris\u00eb t\u00eb s\u00eb drejt\u00ebs, \u00ebsht\u00eb nj\u00eb koncept i p\u00ebrdorur n\u00eb procedurat gjyq\u00ebsore dhe jo n\u00eb ato administrative. K\u00ebshtu, sipas pik\u00ebs 41 t\u00eb Vendimit t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, nr.4 dat\u00eb 11.03.2019 \u201cP\u00ebr procedur\u00ebn e verifikimit t\u00eb kandidat\u00ebve p\u00ebr pozicionet vakante n\u00eb Gjykat\u00ebn Kushtetuese dhe t\u00eb Inspektorit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb\u201d, \u00ebsht\u00eb vendosur q\u00eb: \u201cBisedimet e \u00e7\u00ebshtjes, si dhe votimi i vendimit, b\u00ebhen vet\u00ebm me pranin\u00eb e an\u00ebtar\u00ebve t\u00eb K\u00ebshillit\u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke vler\u00ebsuar nj\u00eb parashikim t\u00eb till\u00eb n\u00eb kund\u00ebrshtim me kompetencat q\u00eb Kushtetuta dhe ligji q\u00eb cituam m\u00eb siper i kan\u00eb dh\u00ebn\u00eb institucionit ton\u00eb, ne kemi p\u00ebrgatitur padin\u00eb p\u00ebrkat\u00ebse p\u00ebr t\u00eb goditur k\u00ebt\u00eb akt n\u00ebnligjor, por p\u00ebr t\u00eb mos penguar procesin e krijimit t\u00eb Gjykat\u00ebs Kushtetuese, kemi pritur p\u00ebr depozitimin e padis\u00eb deri n\u00eb p\u00ebrfundimin e procesit nga ana e K\u00ebshillit p\u00ebr t\u00eb evidentuar t\u00ebr\u00ebsisht problematikat q\u00eb mund t\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb padi, por edhe p\u00ebr t\u00eb mos d\u00ebmtuar imazhin e reformes s\u00eb drejt\u00ebsi. Pra, shum\u00eb shpejt ne do t\u00eb paraqesim k\u00ebt\u00eb padi n\u00eb gjykat\u00ebn administrative t\u00eb apelit, me objekt shfuqizimin e disa prej neneve t\u00eb dy prej rregulloreve t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Fakti i p\u00ebrjashtimit t\u00eb institucionit t\u00eb Avokatit t\u00eb Popullit nga veprimtaria e KED-s\u00eb, nuk pasqyrohet as n\u00eb Vendimet e KED-s\u00eb. N\u00eb pjes\u00ebn hyr\u00ebse t\u00eb k\u00ebtyre vendimeve thuhet se Avokati i Popullit ka q\u00ebn\u00eb prezent, n\u00eb pjes\u00ebn arsyetuese thuhen mendimet e dh\u00ebna nga Avokati i Popullit p\u00ebr \u00e7\u00ebshtjen n\u00eb fjal\u00eb, por n\u00eb asnj\u00eb rresht t\u00eb k\u00ebtyre vendimeve nuk thuhet q\u00eb Avokati i Popullit, nuk ka q\u00ebn\u00eb prezent (p\u00ebr shkak t\u00eb parashikimit t\u00eb Rregullores nr. 4 t\u00eb KED-s\u00eb \u00abP\u00ebr procedurat e verifikimit t\u00eb kandidat\u00ebve\u201d, q\u00eb cituam m\u00eb sip\u00ebr), n\u00eb momentin e diskutimeve p\u00ebr problematikat e ndryshme q\u00eb mund t\u00eb rezultojn\u00eb p\u00ebr kandidat\u00ebt, apo n\u00eb momentin e votimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Formati i vendimeve t\u00eb relatorit p\u00ebr verifikimin e plot\u00ebsimit t\u00eb kritereve dhe\/ose relacioni i relator\u00ebve p\u00ebr vler\u00ebsimin, paraqesin n\u00eb holl\u00ebsi veprimet proceduriale t\u00eb kryera nga relatori, por nuk b\u00ebhet apo jepet asnj\u00eb analiz\u00eb p\u00ebr gjetjet p\u00ebrkat\u00ebse, n\u00ebse ka. N\u00eb \u00e7do rast mendojm\u00eb se arsyetimi i vendimeve dhe ose relacioneve do t\u00eb rriste transparenc\u00ebn e vendimarrjes s\u00eb KED, e cila form\u00eb t\u00eb vetme t\u00eb komunikimit me publikun ka Vendimet. N\u00eb t\u00eb nj\u00ebjt\u00ebn linj\u00eb \u00ebsht\u00eb edhe mungesa e \u00e7do informacioni n\u00eb vendimet e verifikimit, n\u00ebse vendimi ka q\u00ebn\u00eb unanim apo jo. Deri n\u00eb momentin e hartimit t\u00eb k\u00ebtij raporti paraprak, nuk kemi arritur t\u00eb gjejm\u00eb t\u00eb publikuar ndonj\u00eb vendim pakice, bashk\u00eb me vendimet p\u00ebr kalimin e procedur\u00ebs se verifikimit p\u00ebr an\u00ebtaret e Gjykat\u00ebs Kushtetuese, ndaj supozojm\u00eb se vendimet duhet t\u00eb ken\u00eb q\u00ebn\u00eb unanime.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Nj\u00eb konstatim tjet\u00ebr i yni ka q\u00ebn\u00eb edhe niveli jo i duhur i transparenc\u00ebs nga ana e kryetarit t\u00eb KED-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas nenit 226 g\u00ebrma d t\u00eb ligjit nr.115\/2016 \u201cP\u00ebr organet e qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb\u201d: Kryetari i KED \u00absiguron q\u00eb mbledhja e K\u00ebshillit t\u00eb regjistrohet n\u00eb sistemin audio dhe q\u00eb nj\u00eb p\u00ebrmbledhje e procesverbalit t\u00eb mbledhjes s\u00eb K\u00ebshillit mbahet dhe b\u00ebhet publik n\u00eb faqen e internetit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb. P\u00ebrmbledhja e procesverbalit u vihet n\u00eb dispozicion an\u00ebtar\u00ebve t\u00eb K\u00ebshillit p\u00ebrpara se t\u00eb b\u00ebhet publike.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb rast se ndonj\u00ebri prej an\u00ebtar\u00ebve ka dyshime p\u00ebr sakt\u00ebsin\u00eb e p\u00ebrmbledhjes s\u00eb procesverbalit, Kryetari i K\u00ebshillit urdh\u00ebron ballafaqimin e p\u00ebrmbledhjes me regjistrimin audio dhe ndryshimin e saj n\u00eb qoft\u00eb se dyshimi i an\u00ebtarit rezulton i justifikuar\u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke q\u00ebn\u00eb se n\u00eb kund\u00ebrshtim me nenin e sip\u00ebrcituar, n\u00eb faqen e internetit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb KED-s\u00eb nuk botoheshin proces-verbalet e mbledhjeve, ne k\u00ebrkuam t\u00eb na viheshin n\u00eb dispozicion k\u00ebto proces-verbale (ose n\u00eb versionin audio, ose n\u00eb versionin e zbardhur). Pavar\u00ebsisht k\u00ebrkesave tona t\u00eb p\u00ebrs\u00ebritura b\u00ebr\u00eb n\u00eb mbledhjet e k\u00ebtij organi, por edhe k\u00ebrkesave me shkrim drejtuar kryetarit t\u00eb KED-s\u00eb, ne nuk na u vun\u00eb asnj\u00ebher\u00eb n\u00eb dispozicion proces-verbalet e disa mbledhjeve (qoft\u00eb edhe n\u00eb version audio, q\u00eb nuk k\u00ebrkon pun\u00eb shtes\u00eb p\u00ebr zbardhjen).<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb gjykimin e Avokatit t\u00eb Popullit, mosadresimi i k\u00ebrkesave t\u00eb b\u00ebra prej nesh n\u00eb lidhje me transparenc\u00ebn dhe\/ose \u00e7\u00ebshtje t\u00eb tjera q\u00eb ne kemi ngritur, kan\u00eb kufizuar duksh\u00ebm mund\u00ebsin\u00eb ton\u00eb p\u00ebr t\u00eb b\u00ebr\u00eb detyr\u00ebn e ngarkuar nga Kushtetuta dhe ligji. N\u00eb leximin q\u00eb ne i b\u00ebjm\u00eb Kushtetut\u00ebs dhe ligjit nuk na rezulton i justifikuar apo legjitim q\u00ebndrimi i mosmarrjes n\u00eb shqyrtim t\u00eb k\u00ebrkesave t\u00eb v\u00ebzhguesit dhe trajtimi i tyre jo n\u00eb prani t\u00eb tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Po p\u00ebr sa i p\u00ebrket transparenc\u00ebs, ne kemi konstatuar se vendimet e arsyetura t\u00eb kandidat\u00ebve nuk u publikuan n\u00eb koh\u00ebn duhur n\u00eb faqen zyrtare t\u00eb KED-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Sigurimi i nj\u00eb transparence m\u00eb t\u00eb madhe n\u00eb lidhje me mbledhjet e K\u00ebshillit, pasi jemi t\u00eb mendimit se \u00ebsht\u00eb cenuar transparenca p\u00ebr shkak t\u00eb mospublikimit fare, ose jo n\u00eb koh\u00eb t\u00eb materialeve t\u00eb mbledhjeve, si dhe t\u00eb munges\u00ebs s\u00eb informacionit, apo t\u00eb dh\u00ebnies s\u00eb nj\u00eb informacioni tep\u00ebr t\u00eb kufizuar p\u00ebr publikun, q\u00eb ka si t\u00eb vetmen m\u00ebnyr\u00eb informimi faqen zyrtare t\u00eb KED-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">M\u00eb konkretisht nuk jan\u00eb publikuar n\u00eb faqen zyrtare t\u00eb KED-s\u00eb procesverbalet e mbledhjeve. N\u00eb k\u00ebt\u00eb faqe n\u00eb rastin m\u00eb t\u00eb mir\u00eb jepet vet\u00ebm nj\u00eb p\u00ebrmbledhje shum\u00eb e shkurt\u00ebr dhe jo e mjaftueshme e zhvillimit t\u00eb tyre, nd\u00ebrkohe q\u00eb sipas nenit 233\/3, t\u00eb ligjit nr. 115\/2016 \u201cK\u00ebshilli komunikon me publikun pas \u00e7do mbledhjeje p\u00ebrmes nj\u00eb komunikate p\u00ebr mediat e cila informon s\u00eb paku p\u00ebr:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">a) koh\u00ebn e mbledhjes;<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">b)pjes\u00ebmarrjen;<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">c) kandidat\u00ebt, jet\u00ebshkrimin e p\u00ebrdit\u00ebsuar t\u00eb tyre, pozicionet p\u00ebr t\u00eb cilat ata kandidojn\u00eb dhe institucionet propozuese;<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u00e7) nj\u00eb shpjegim t\u00eb shkurt\u00ebr t\u00eb procedurave dhe t\u00eb metod\u00ebs s\u00eb ndjekur p\u00ebr verifikimin kushteve ligjore dhe t\u00eb kritereve t\u00eb p\u00ebrdorura p\u00ebr renditjen e kandidat\u00ebve; d) aktin p\u00ebrfundimtar t\u00eb verifikimit dhe renditjes s\u00eb kandidat\u00ebve\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Duke qen\u00eb se procedurat e KED-s\u00eb n\u00eb disa raste kan\u00eb q\u00ebn\u00eb atipike dhe t\u00eb pakryera m\u00eb par\u00eb, ka pasur jo pak \u00e7\u00ebshtje p\u00ebr t\u00eb cilat ka dal\u00eb nevoja e b\u00ebrjes s\u00eb ndryshimeve ligjore, pasi ka ometim n\u00eb nj\u00eb num\u00ebr \u00e7\u00ebshtjesh, t\u00eb cilat do t\u00eb paraqiten t\u00eb plota n\u00eb raportin p\u00ebrfundimtar, por n\u00eb k\u00ebndv\u00ebshtrimin e Avokatit t\u00eb Popullit mendojm\u00eb se duhet t\u00eb evidentohen q\u00eb n\u00eb k\u00ebt\u00eb moment p\u00ebr t\u00eb b\u00ebr\u00eb adresimet p\u00ebrkat\u00ebse p\u00ebr pun\u00ebn e KED n\u00eb vitin 2020 edhe:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 P\u00ebrcaktim i qart\u00eb i kompetencave t\u00eb Kryetarit t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi n\u00eb lidhje me an\u00ebtar\u00ebt, por edhe me t\u00eb tret\u00ebt, n\u00eb funksion t\u00eb ligjit p\u00ebr t\u00eb drejt\u00ebn e informimit;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Vendosja e afateve ligjore p\u00ebr publikimin e procesverbaleve;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Ndryshimi i disa prej afateve proceduriale p\u00ebr paraqitjen e nj\u00eb pjese t\u00eb dokumentacionit p\u00ebr verifikimin e pasuris\u00eb, pasi nj\u00eb afat i till\u00eb i shkurt\u00ebr nuk lejon pjes\u00ebmarrjen e nj\u00eb numri t\u00eb mjaftuesh\u00ebm kandidat\u00ebsh;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Parashikimi i m\u00ebnyr\u00ebs s\u00eb nd\u00ebrveprimit midis gjetjeve t\u00eb ILDKPKI dhe vendimarrjes s\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Parashikimi i nj\u00eb procedure administrative p\u00ebr kandidat\u00ebt q\u00eb t\u00eb ken\u00eb mund\u00ebsi t\u00eb adresojn\u00eb n\u00eb ILDKPKI gjetjet e k\u00ebtij organi dhe\/ose parashikimin e pjes\u00ebmarrjes s\u00eb kandidat\u00ebve n\u00eb seancat e verifikimit p\u00ebr t\u2019iu dh\u00ebn\u00eb mund\u00ebsia p\u00ebr t\u00eb kund\u00ebrshtuar apo mbrojtur gjetjet e ILDKPKI-s\u00eb. N\u00eb keto seanca duhet t\u00eb parashikohet edhe prania e p\u00ebrfaq\u00ebsuesve t\u00eb ILDKPKI p\u00ebr t\u00eb argumentuar gjetjet e tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 P\u00ebrgjith\u00ebsisht K\u00ebshilli ka pasur bashk\u00ebpunimin e organeve apo institucioneve t\u00eb ndryshme n\u00eb p\u00ebrgjigje t\u00eb k\u00ebrkesave t\u00eb b\u00ebra p\u00ebr informacion. Rezulton se vet\u00ebm disa institucione (SHISH dhe SHIU) nuk kan\u00eb d\u00ebrguar informacion n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00ebp\u00ebrdrejt\u00eb n\u00eb K\u00ebshill, por e kan\u00eb b\u00ebr\u00eb at\u00eb n\u00ebp\u00ebrmjet DSIK. Filtrimi ose jo i informacioneve, nga nj\u00eb organ n\u00ebn var\u00ebsin\u00eb e ekzekutivit, mund t\u00eb ngrinte pikpyetje n\u00eb lidhje me sakt\u00ebsin\u00eb e informacionit.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr k\u00ebt\u00eb arsye duhet t\u00eb gjenden zgjidhjet e duhura ligjore q\u00eb t\u00eb jepet informacioni, por edhe t\u00eb adresohet p\u00ebrgjegj\u00ebsia n\u00eb rast mos d\u00ebrgimi i informacionit. Problem mund t\u00eb paraqiste n\u00eb k\u00ebt\u00eb kuad\u00ebr edhe pajisja me certifikat\u00eb sigurie e an\u00ebtar\u00ebve t\u00eb Keshillit, duke konsideruar se K\u00ebshilli ushtron detyr\u00ebn p\u00ebr nj\u00eb periudh\u00eb relativisht t\u00eb shkurt\u00ebr dhe mundet q\u00eb procedura e paisjes me certifikat\u00eb, t\u00eb shkurtoj\u00eb edhe m\u00eb shum\u00eb mundesin\u00eb e ushtrimit efektiv t\u00eb detyr\u00ebs nga ana e an\u00ebtar\u00ebve t\u00eb K\u00ebshillit.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Duhet t\u00eb b\u00ebhen rregullime n\u00eb ligj p\u00ebr t\u00eb trajtuar natyr\u00ebn e disa parashikimeve ligjore q\u00eb lidhen me kushtet individuale dhe ato t\u00eb p\u00ebrgjithshme q\u00eb lidhen me Gjykat\u00ebn Kushtetuese, psh parashikimet e b\u00ebra n\u00eb lidhje me numrin e kandidat\u00ebve q\u00eb duhet t\u00eb vijn\u00eb nga gjyq\u00ebsori, me balanc\u00ebn gjinore t\u00eb gjyktat\u00ebs, me fushat e ndryshme t\u00eb ekspertiz\u00ebs, si dhe me numrin maksimal t\u00eb hapjes s\u00eb thirrjeve p\u00ebr vakancat, n\u00eb rast se kandidat\u00ebt q\u00eb i vijn\u00eb Keshillit nuk b\u00ebjn\u00eb t\u00eb mundur plot\u00ebsimin e k\u00ebtyre kritereve ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Avokati i Popullit gjykon se ka r\u00ebndesi themelore t\u00eb trajtohen k\u00ebto probleme dhe t\u00eb ket\u00eb arsyetim n\u00eb vendimarrjet p\u00ebrkat\u00ebse, t\u00eb cilat t\u00eb adresojn\u00eb pamund\u00ebsin\u00eb e plot\u00ebsimit t\u00eb k\u00ebrkesave ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Duhet t\u00eb b\u00ebhen rregullime n\u00eb rregulloret e K\u00ebshillit p\u00ebr t\u00eb p\u00ebrcaktuar koh\u00ebn dhe afatin brenda t\u00eb cilit duhet t\u00eb d\u00ebrgohen listat p\u00ebrkat\u00ebse n\u00eb organin e em\u00ebrtes\u00ebs;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Duhet t\u00eb b\u00ebhen amendamente ligjore p\u00ebr t\u00eb rregulluar ometimin ligjor n\u00eb lidhje me organin q\u00eb ka kompetenc\u00eb p\u00ebr t\u00eb konstatuar mos-ushtrimin e t\u00eb drejt\u00ebs p\u00ebr t\u00eb zgjedhur nga ndonj\u00eb prej organeve t\u00eb em\u00ebrtes\u00ebs dhe procedur\u00ebn e nevojshme n\u00eb k\u00ebt\u00eb rast.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013 Mund\u00ebsimi i kandidat\u00ebve p\u00ebr t\u2019u njohur n\u00eb koh\u00eb me gjetjet e relatorit n\u00eb procesin e tij t\u00eb verifikimit, gjetje t\u00eb cilat duhet t\u00eb shoqerohen edhe me argumentim p\u00ebrkat\u00ebs p\u00ebr t\u2019i mund\u00ebsuar kandidatit t\u00eb b\u00ebj\u00eb nj\u00eb mbrojtje sa m\u00eb efektive.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb lidhje me procesin e shqyrtimit t\u00eb kandidaturave, institucioni yn\u00eb ka b\u00ebr\u00eb prezent (si me shkrim, ashtu edhe gjat\u00eb mbledhjeve) shqet\u00ebsimin q\u00eb materialet pothuajse asnj\u00ebher\u00eb, nuk jan\u00eb sjell\u00eb sipas afateve t\u00eb parashikuara n\u00eb Rregulloren e Brendshme t\u00eb miratuar nga kjo KED (duke pasur parasysh se dokumentet q\u00eb lidhen vet\u00ebm me nj\u00eb kandidat shpesh jan\u00eb rreth 10.000 flet\u00eb, mosl\u00ebnia e koh\u00ebs s\u00eb duhur p\u00ebr shqyrtimin e dokumentacionit, ka v\u00ebn\u00eb n\u00eb pozit\u00eb shum\u00eb t\u00eb v\u00ebshtir\u00eb institucionin ton\u00eb, p\u00ebr dh\u00ebnien e nj\u00eb mendimi t\u00eb plot\u00eb, e profesional) dhe si shpjegim p\u00ebr k\u00ebto vonesa nga kryetari i KED-s\u00eb (i cili sipas ligjit 115\/2016 \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr k\u00ebt\u00eb pjes\u00eb t\u00eb procesit), na \u00ebsht\u00eb th\u00ebn\u00eb se kjo b\u00ebhet p\u00ebr p\u00ebrmbushjen e afateve dhe ngritjen sa m\u00eb par\u00eb t\u00eb institucioneve t\u00eb reja. E v\u00ebrteta \u00ebsht\u00eb q\u00eb institucioni yn\u00eb \u00ebsht\u00eb v\u00ebn\u00eb n\u00eb pamund\u00ebsi p\u00ebr t\u00eb par\u00eb dosjet p\u00ebrkat\u00ebse me seriozitetin e nevojsh\u00ebm q\u00eb ky proces k\u00ebrkon.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr m\u00eb tep\u00ebr, materialet e d\u00ebrguara nuk jan\u00eb d\u00ebrguar me nj\u00eb list\u00eb inventari pavar\u00ebsisht k\u00ebrkes\u00ebs s\u00eb p\u00ebrs\u00ebritur p\u00ebr nj\u00eb gj\u00eb t\u00eb till\u00eb p\u00ebr t\u00eb na mund\u00ebsuar identifikimin e akteve q\u00eb na jan\u00eb d\u00ebrguar dhe atyre q\u00eb nuk na jan\u00eb d\u00ebrguar.<\/span><br \/>\n<span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb, teksti i vendimeve n\u00eb lidhje me pasqyrimin p\u00ebrmbledhtas korrekt t\u00eb q\u00ebndrimit t\u00eb Avokatit t\u00eb Popullit \u00ebsht\u00eb konsultuar me ne p\u00ebr vendimarrjet n\u00eb lidhje me verifikimin, por jo n\u00eb lidhje me vendimarrjet p\u00ebr procesin e vler\u00ebsimit. Procesi i vler\u00ebsimit \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb munges\u00eb t\u00ebr\u00ebsore t\u00eb transparenc\u00ebs dhe vet\u00ebm publikimi p\u00ebrfundimtar i vendimit t\u00eb miratimit t\u00eb listave, \u00ebsht\u00eb p\u00ebrpjekur t\u00eb p\u00ebrmbush\u00eb elementin e transparenc\u00ebs.<\/span><br \/>\n<span style=\"color: #000000;\">N\u00eb dat\u00ebn 21 shtator 2019, mbi baz\u00ebn e nj\u00eb njoftimi t\u00eb b\u00ebr\u00eb vet\u00ebm nj\u00eb dit\u00eb m\u00eb par\u00eb, K\u00ebshilli ka zhvilluar mbledhjen e tij t\u00eb fundit n\u00eb lidhje me detyr\u00ebn e tij, paraqitjen e renditjes p\u00ebr secil\u00ebn nga vakancat. N\u00eb at\u00eb mbledhje ne kemi adresuar t\u00eb t\u00ebra problematikat q\u00eb kemi evidentuar p\u00ebr natyr\u00ebn e vendimarrjeve dhe argumetimin ligjor t\u00eb faktit q\u00eb d\u00ebrgimi i listave p\u00ebr num\u00ebr t\u00eb pamjaftuesh\u00ebm kandidat\u00ebsh po paraqiste anomali jo t\u00eb vogla.<\/span><br \/>\n<span style=\"color: #000000;\">Pas asaj mbledhjeje nuk pati m\u00eb asnj\u00eb njoftim nga ana e kryetarit t\u00eb K\u00ebshillit n\u00eb lidhje me p\u00ebrfundimin e procedur\u00ebs, pra d\u00ebrgimin e listave t\u00eb organet e em\u00ebrtes\u00ebs dhe d\u00ebrgimin e tyre n\u00eb m\u00ebnyr\u00ebn e logjik\u00ebs s\u00eb ligjit, pra t\u00eb mund\u00ebsimit n\u00eb mas\u00ebn me t\u00eb madhe t\u00eb mundshme t\u00eb organeve t\u00eb em\u00ebrtes\u00ebs p\u00ebr t\u00eb zgjedhur midis disa kandidat\u00ebve, p\u00ebr t\u00eb shuar \u00e7do dyshim se K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi po paracaktonte an\u00ebtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb, p\u00ebrtej komptenc\u00ebs s\u00eb vet, pra po kufizonte mund\u00ebsin\u00eb e p\u00ebrzgjedhjes midis t\u00eb pakt\u00ebn 3 kandidat\u00ebsh t\u00eb listuar t\u00eb par\u00ebt dhe pamund\u00ebsis\u00eb s\u00eb b\u00ebrjes s\u00eb dy listave, si\u00e7 k\u00ebrkon ligji p\u00ebr rastet kur ka m\u00eb shum\u00eb se nj\u00eb vakanc\u00eb, e konkretisht nj\u00eb list\u00eb me kandidat\u00eb gjyqtar\u00eb, e nj\u00eb list\u00eb me kandidat\u00eb jo gjyqtar\u00eb.<\/span><br \/>\n<span style=\"color: #000000;\">Pavar\u00ebsisht sa m\u00eb sip\u00ebr, nuk pati asnj\u00eb njoftim publik p\u00ebr d\u00ebrgimin n\u00eb koh\u00eb t\u00eb ndryshme dhe as shkakun e k\u00ebtij d\u00ebrgimi t\u00eb ndrysh\u00ebm, si pjes\u00eb e nj\u00eb procedure administrative e kryetarit t\u00eb K\u00ebshillit, pa vendimarrje t\u00eb K\u00ebshillit n\u00eb lidhje me sa m\u00eb sip\u00ebr. Deri m\u00eb sot, p\u00ebr m\u00eb tep\u00ebr, me gjith\u00eb k\u00ebrkes\u00ebn e institucionit ton\u00eb p\u00ebr t\u00eb na treguar shkakun p\u00ebr t\u00eb cilin ishte kryer ky veprim, i cili jo vet\u00ebm q\u00eb nuk u jepte mund\u00ebsi organeve t\u00eb em\u00ebrtes\u00ebs t\u00eb kishin zgjedhje me t\u00eb madhe midis kandidateve, por p\u00ebrkundrazi m\u00eb t\u00eb vog\u00ebl, nuk kemi pasur asnj\u00eb p\u00ebrgjigje.<\/span><br \/>\n<span style=\"color: #000000;\">Shteti i s\u00eb drejt\u00ebs, kontribuon n\u00eb instalimin e nj\u00eb mir\u00ebqeverisjeje, ka si premis\u00eb kryesore t\u00eb tij parimin e legjitimitetit, \u00e7ka do t\u00eb thot\u00eb veprim dhe zbatim i nj\u00ebllojt\u00eb i ligjeve dhe i normave t\u00eb s\u00eb drejt\u00ebs mbi t\u00eb gjith\u00eb subjektet e s\u00eb drejt\u00ebs, qofshin k\u00ebta individ\u00eb, sip\u00ebrmarrje private apo edhe vet\u00eb shteti. Shteti i s\u00eb drejt\u00ebs p\u00ebr realizimin e k\u00ebtij objektivi k\u00ebrkon nj\u00eb gjyq\u00ebsor t\u00eb pavarur e t\u00eb paansh\u00ebm, nj\u00eb administrat\u00eb dhe nj\u00eb polici t\u00eb pakorruptueshme. Mir\u00ebqeverisja n\u00eb kuptimin e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb qytetarit k\u00ebrkon q\u00eb institucionet qeveris\u00ebse, proceset vendimmarr\u00ebse dhe zbatimi i vendimeve t\u00eb jen\u00eb n\u00eb sh\u00ebrbim t\u00eb t\u00eb gjith\u00ebve, madje brenda nj\u00eb afati sa m\u00eb t\u00eb shpejt\u00eb kohor.<\/span><br \/>\n<span style=\"color: #000000;\">Mir\u00ebqeverisja duhet t\u00eb siguroj\u00eb barazin\u00eb dhe gjith\u00ebp\u00ebrfshirjen e pjes\u00ebtar\u00ebve t\u00eb komunitetit, t\u00eb cil\u00ebt duhet ta ndjejn\u00eb veten aktor\u00eb t\u00eb proceseve vendimmarr\u00ebse dhe realizues e zbatues t\u00eb vendimeve t\u00eb miratuara. N\u00eb k\u00ebto procese duhet t\u00eb p\u00ebrfshihen t\u00eb gjith\u00eb, duke b\u00ebr\u00eb kujdes sidomos p\u00ebr grupet e margjinalizuara.<\/span><br \/>\n<span style=\"color: #000000;\">Me mir\u00ebqeverisjeje, sistemi i te drejtave t\u00eb njeriut p\u00ebrfiton gjer\u00ebsisht nga konsolidimi i shtetit t\u00eb s\u00eb drejt\u00ebs, i cili sjell me vete rritjen e shkall\u00ebs s\u00eb llogaridh\u00ebnies, shtimin e efektivitetit t\u00eb institucioneve publike, sigurimin e aksesit dhe d\u00ebgjimit t\u00eb z\u00ebrit t\u00eb qytetar\u00ebve, uljen e nivelit t\u00eb korrupsionit etj.<\/span><br \/>\n<span style=\"color: #000000;\">P\u00ebr fat t\u00eb keq konstatojm\u00eb se puna shum\u00eb e madhe dhe me dedikim e t\u00eb t\u00ebr\u00eb an\u00ebtar\u00ebve, e pjes\u00ebmarr\u00ebsve t\u00eb tjer\u00eb n\u00eb mbledhje, por edhe e k\u00ebshilltar\u00ebve ligjor e sekretaris\u00eb s\u00eb KED-s\u00eb, nuk arriti t\u00eb realizonte nj\u00eb pro\u00e7es t\u00eb pat\u00ebmet\u00eb, p\u00ebr p\u00ebrzgjedhjen e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese. Q\u00eb gjat\u00eb muajit gusht 2019 u identifikuan disa problematika n\u00eb lidhje me numrin e kandidaturave q\u00eb K\u00ebshillit i kishin mbetur p\u00ebr t\u00eb vler\u00ebsuar, pas kryerjes s\u00eb pro\u00e7esit t\u00eb verifikimit t\u00eb kandidaturave.<\/span><br \/>\n<span style=\"color: #000000;\">P\u00ebr t\u00eb t\u00ebr\u00eb pjes\u00ebmarr\u00ebsit n\u00eb k\u00ebt\u00eb pro\u00e7es, nuk ka asnj\u00eb shpjegim t\u00eb asnj\u00eb lloji (as publik dhe as n\u00eb mbledhje pa pranin\u00eb e t\u00eb tret\u00ebve), se \u00e7far\u00eb shkaktoi d\u00ebrgimin e listave p\u00ebrfundimtare p\u00ebr te organet e em\u00ebrtes\u00ebs gjegj\u00ebsisht dit\u00eb pas dat\u00ebs 21.9.2019, (pra pas 15 dit\u00ebsh Presidentit t\u00eb Republik\u00ebs dhe 21 dit\u00ebsh Kuvendit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb).<\/span><br \/>\n<span style=\"color: #000000;\">P\u00ebr m\u00eb tep\u00ebr t\u00eb dyja vakancat e Kuvendit, kishin m\u00eb pak kandidat\u00eb n\u00eb list\u00eb se ato t\u00eb Presidentit t\u00eb Republik\u00ebs dhe secila prej kandidat\u00ebve n\u00eb listat e Kuvendit ishte edhe n\u00eb ato t\u00eb Presidentit. Pra nuk rezulton t\u00eb ket\u00eb asnj\u00eb mund\u00ebsi, q\u00eb t\u00eb mos jen\u00eb t\u00eb nj\u00ebjtat materiale t\u00eb listuara dhe vendime t\u00eb arsyetuara, q\u00eb tregon se nuk ka asnj\u00eb arsye objektive q\u00eb listat Kuvendit t\u2019i d\u00ebrgoheshin me 6 dit\u00eb vones\u00eb, n\u00eb krahasim me ato t\u00eb d\u00ebrguara Presidentit t\u00eb Republik\u00ebs.<\/span><br \/>\n<span style=\"color: #000000;\">Ka r\u00ebnd\u00ebsi t\u00eb kujtojm\u00eb edhe se vlera e afateve t\u00eb caktuara n\u00eb Kushtetut\u00eb apo ligjet e reform\u00ebs, jan\u00eb trajtuar deri m\u00eb tash, si nj\u00eb element m\u00eb pak i vlefsh\u00ebm krahasimisht me plot\u00ebsimin e thelbit, apo aspektin material t\u00eb \u00e7\u00ebshtjes. K\u00ebshtu nuk ka q\u00ebn\u00eb e mundur t\u00eb zbatohen mjaft afate t\u00eb parashikuara n\u00eb Kushtetut\u00eb, p\u00ebr ngritjen e organeve t\u00eb reja t\u00eb parashikuara n\u00eb legjislacionin e Reform\u00ebs n\u00eb Drejt\u00ebsi (K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor, K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb, K\u00ebshilli i Emerimeve ne Drejt\u00ebsi, Inspektorati i Lart\u00eb i Drejt\u00ebsis\u00eb), apo ristrukturimin e organeve t\u00eb tjera (si psh rasti i Gjykat\u00ebs Kushtetuese).<\/span><br \/>\n<span style=\"color: #000000;\">Pa dashur t\u00eb ndalemi n\u00eb r\u00ebnd\u00ebsin\u00eb jetike t\u00eb institucionit t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr vendin ton\u00eb, d\u00ebshirojm\u00eb t\u00eb kujtojm\u00eb se nj\u00eb nga arsyet p\u00ebr t\u00eb cilat u ideua dhe u b\u00eb Reforma n\u00eb Drejt\u00ebsi, ishte humbja e besimit t\u00eb publikut tek institucionet e Drejt\u00ebsis\u00eb. Pik\u00ebrisht p\u00ebr k\u00ebt\u00eb arsye jemi t\u00eb mendimit se puna mjaft e madhe e b\u00ebr\u00eb nga shum\u00eb institucione shtet\u00ebrore, si p\u00ebr pro\u00e7esin e vetingut t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve, ashtu edhe at\u00eb t\u00eb ngritjes s\u00eb institucioneve t\u00eb reja t\u00eb parashikuara nga legjislacioni i Reform\u00ebs n\u00eb Drejt\u00ebsi, po dob\u00ebsohet pik\u00ebrisht nga p\u00ebrplasjet institucionale t\u00eb ndodhura gjat\u00eb pro\u00e7esit p\u00ebr ngritjen dhe funksionimin e Gjykat\u00ebs Kushtetuese.<\/span><br \/>\n<span style=\"color: #000000;\">Avokati i Popullit e konsideron shum\u00eb t\u00eb madh e t\u00eb pajustifikuar presionin n\u00eb t\u00eb cilin u vun\u00eb kandidat\u00ebt p\u00ebr an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese, thjesht p\u00ebr faktin se kan\u00eb kandiduar, kur veprimet e p\u00ebrzgjedhjes apo renditjes jan\u00eb p\u00ebrtej mund\u00ebsis\u00eb s\u00eb tyre t\u00eb vendimarrjes.<\/span><br \/>\n<span style=\"color: #000000;\">P\u00ebr sa m\u00eb sip\u00ebr, Avokati i Popullit u b\u00ebn thirrje t\u00eb gjitha institucioneve shtet\u00ebrore, t\u00eb cilat legjislacioni i ka ngarkuar me kompetenca p\u00ebr ngritjen e Gjykat\u00ebs Kushtetuese, t\u00eb bashk\u00ebpunojn\u00eb me nj\u00ebri tjetrin, me q\u00ebllim ngritjen konform ligjit t\u00eb k\u00ebtij institucioni.<\/span><br \/>\n<span style=\"color: #000000;\">S\u00eb fundmi, duam t\u00eb theksojm\u00eb edhe nj\u00eb her\u00eb cili ishte q\u00ebllimi i k\u00ebtij modeli p\u00ebr t\u00eb zgjedhur an\u00ebtar\u00ebt e Gjykat\u00ebs Kushtetuese. N\u00eb koh\u00ebn e hartimit t\u00eb ndryshimeve Kushtetuese, Shqip\u00ebria vinte nga nj\u00eb situat\u00eb krize n\u00eb em\u00ebrimin e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb dhe\/ose Kushtetuese. Q\u00eb prej shtatorit 2013 Kuvendi nuk kishte miratuar asnj\u00eb prej kandidaturave t\u00eb propozura nga Presidenti i Republik\u00ebs.<\/span><br \/>\n<span style=\"color: #000000;\">Numri i parashikuar n\u00eb ligj p\u00ebr Gjykat\u00ebn e Lart\u00eb nuk u plot\u00ebsua asnj\u00ebher\u00eb, ndaj rezultoi e nevojshme t\u00eb mos kishte nj\u00eb organ i vet\u00ebm t\u00eb drejt\u00ebn e propozimit apo em\u00ebrimit t\u00eb kandidat\u00ebve. P\u00ebr k\u00ebt\u00eb arsye u adoptua modeli aktual, i cili i njeh t\u00eb drejt\u00ebn 3 institucioneve Kushtetuese t\u00eb ndryshme, t\u00eb drejt\u00ebn e em\u00ebrimit secili t\u00eb 3 an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese. Kjo e drejt\u00eb nuk \u00ebsht\u00eb e pakufizuar, ajo kufizohet nga puna verifikuese dhe rendit\u00ebse e nj\u00eb organi t\u00eb ri, q\u00eb \u00ebsht\u00eb pik\u00ebrisht K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi. P\u00ebr secil\u00ebn vakanc\u00eb verifikimi dhe renditja e kandidat\u00ebve b\u00ebhet nga K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi, i cili duhet t\u2019u krijoj\u00eb organeve t\u00eb em\u00ebrtes\u00ebs mund\u00ebsi zgjedhjeje t\u00eb mjaftueshme midis kandidat\u00ebve, t\u00eb cil\u00ebt n\u00eb rast se ka m\u00eb shum\u00eb se nj\u00eb vakanc\u00eb t\u00eb hapur, duhet t\u00eb jen\u00eb t\u00eb tilla q\u00eb t\u00eb sigurojn\u00eb p\u00ebrzgjedhjen midis 3 gjyqtar\u00ebve dhe 3 jo gjyqtar\u00ebve. Nuk ka asnj\u00eb dyshim se KED duhet t\u00eb ushtroj\u00eb detyr\u00ebn e saj p\u00ebr t\u00eb b\u00ebr\u00eb t\u00eb mundur q\u00eb organet e em\u00ebrtes\u00ebs t\u00eb ken\u00eb nj\u00eb mund\u00ebsi t\u00eb v\u00ebrtet\u00eb p\u00ebrzgjedhjeje. Sigurisht q\u00eb K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi nuk mund t\u00eb krijoj\u00eb kandidat\u00eb, K\u00ebshilli duhet t\u00eb zbatoj\u00eb me p\u00ebrpikm\u00ebri kriteret e ligjit, n\u00eb lidhje me kushtet q\u00eb duhet t\u00eb plot\u00ebsojn\u00eb kandidat\u00ebt dhe t\u00eb b\u00ebj\u00eb vler\u00ebsimin sipas parametrave t\u00eb treguar n\u00eb Metodologjin\u00eb e Vler\u00ebsimit .<\/span><br \/>\n<span style=\"color: #000000;\">Nga ana tjet\u00ebr, as KED si organ kushtetues dhe aq m\u00eb pak nj\u00eb an\u00ebtar i vet\u00ebm i saj nuk mund t\u00eb ngushtoj\u00eb mund\u00ebsin\u00eb e p\u00ebrzgjedhjes t\u00eb organeve t\u00eb em\u00ebrtes\u00ebs, t\u00eb cilat jan\u00eb t\u00eb sanksionuara si t\u00eb tilla nga Kushtetuta.
