P\u00ebr munges\u00eb konkurrence ngarkohet me p\u00ebrgjegj\u00ebsi KVO<\/span><\/p>\n<p><span style=\"color: #000000;\">Kontrolli i Lart\u00eb i Shtetit ka publikuar raportin p\u00ebrfundimtar p\u00ebr Auditimin e ushtruar n\u00eb \u201cTirana Parking, Bashkia Tiran\u00eb\u201d, ku jan\u00eb konstatuar nj\u00eb s\u00ebr\u00eb shkeljesh t\u00eb rregullave t\u00eb prokurimit publik dhe p\u00ebrqendrim i fondeve publike drejt nj\u00eb kompanie t\u00eb vetme. Sipas raportit \u201cnga verifikimi rezultoi se Tirana Parking, p\u00ebr vitin 2018, ka zhvilluar gjithsej 16 procedura prokurimi, dhe me p\u00ebrjashtim t\u00eb blerjeve me vler\u00eb t\u00eb vog\u00ebl, n\u00eb 5 procedura ka patur vet\u00ebm 1 OE (operator ekonomik) pjes\u00ebmarr\u00ebs dhe n\u00eb 2 procedura rezultojn\u00eb OE me ofert\u00eb m\u00eb t\u00eb ul\u00ebt t\u00eb s\u2019kualifikuar\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr vitin 2018, n\u00eb procedurat e zhvilluara sa m\u00eb sip\u00ebr me p\u00ebrjashtim t\u00eb blerjeve me vler\u00eb t\u00eb vog\u00ebl, jan\u00eb shpallur fitues n\u00eb total 6 OE nga t\u00eb cil\u00ebt 2 OE kan\u00eb fituar nga 2 procedura dhe konkretisht \u201cA.\u201d dhe \u201cP.\u201d \u00e7ka evidentohet shp\u00ebrndarje normale si rezultat i konkurrenc\u00ebs n\u00eb procedurat e prokurimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vlera m\u00eb e lart\u00eb e prokuruar dhe e fituar \u00ebsht\u00eb n\u00eb shum\u00ebn 8,568,981 lek\u00eb pa tvsh n\u00eb tenderin me objekt \u201cSh\u00ebrbime t\u00eb pastrimit dhe gjelb\u00ebrimit\u201d, me referenc\u00eb 49171, zhvilluar m\u00eb dat\u00eb 15\/03\/2018 ku \u00ebsht\u00eb shpallur fitues OE i vet\u00ebm n\u00eb gar\u00eb \u201cF.\u201d shpk.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb dokumantacionin e administruar n\u00eb dosjen e sistemit t\u00eb prokurimit elektronik n\u00eb APP (Ref.49-171) procedura me objekt; \u201cSh\u00ebrbime t\u00eb pastrimit dhe gjelb\u00ebrimit n\u00eb sheshe mbi e n\u00ebn tok\u00eb e terminale\u201d u konstatuan mosp\u00ebrputhje me k\u00ebrkesat ligjore n\u00eb fuqi konkretisht;<\/span><\/p>\n<p><span style=\"color: #000000;\">-N\u00ebp\u00ebrmjet njoftimit t\u00eb fituesit dat\u00eb 06.03.2018 konstatohet se, KVO ka kualifikuar dhe shpallur fituese ofert\u00ebn ekonomike e paraqitur e vetme n\u00eb konkurrim nga OE \u201cF.\u201dshpk me vler\u00eb 8,798,873 lek\u00eb pa tvsh, me argumentin se: kjo ofert\u00eb ka plot\u00ebsuar t\u00eb gjitha \u201cKriteret p\u00ebr kualifikim\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga auditimi dokumentacionit i administruar n\u00eb dosjen e procedur\u00ebs e pasqyruar n\u00eb sistemin e prokurimit elektronik n\u00eb APP konstatohet se; KVO ka kualifikuar ofert\u00ebn e vetme n\u00eb konkurim, nd\u00ebrsa referuar n\u00eb dokumentat e dor\u00ebzuara kjo ofert\u00eb e vetme e shpallur fituese, nuk i plot\u00ebson k\u00ebrkesat kualifikuese t\u00eb parashikuar m\u00eb analitike paraqiten sa m\u00eb posht\u00eb; -p\u00ebr shtojca (9) \u201cSpecifikime teknike\u201d; pika (3). Fshirja e Shesheve dhe Terminaleve me makineri teknologjike, n\u00ebnpika 3.5\u201cMjetet dhe pajisjet\u201d; g\u00ebrma (a) \u201cMakina teknologjike p\u00ebr fshirjen e shesheve dhe teminaleve, me kapacitet mbajt\u00ebs\u00a0 4-6 m3, te pajisura me 2 fshesa an\u00ebsore (majtas dhe dhjathtas) dhe nj\u00eb fshes\u00eb q\u00ebndrore rrul, sistem thith\u00ebs t\u00eb pluhurave (aspirator) dhe sistem sp\u00ebrkatje me uj\u00eb gjat\u00eb pun\u00ebs, mund\u00ebsisht me tub aspirimi t\u00eb jasht\u00ebm\u00a0 thith\u00ebs, i vitit t\u00eb prodhimit jo m\u00eb posht\u00eb se 2010\u201d, si dhe \u201cKritere te vecanta t\u00eb kualifikimit\u201d, pika 3.2 \u201cKapaciteti teknik\u201d, pika.12 \u201cOE duhet t\u00eb paraqes\u00eb deklarat\u00eb me shkrim se mjetet e paraqitura jan\u00eb n\u00eb p\u00ebrputhje me specifikimet teknike pjes\u00eb p\u00ebrb\u00ebr\u00ebse e k\u00ebtyre dokumenta tenderi\u201d, nd\u00ebrsa rezulton se; OE i vet\u00ebm n\u00eb konkurim me dokumentat kualifikuese bashk\u00eblidhur me ofert\u00eb ekonomike ka paraqitur;<\/span><\/p>\n<p><span style=\"color: #000000;\">-mjetin teknologjik p\u00ebr fshirje me foto e targ\u00eb AA833NF prodhim i vitit 2007, nd\u00ebrsa k\u00ebrkohet detyrimisht prodhim i vitit jo m\u00eb posht\u00eb se 2010, nj\u00ebkoh\u00ebsisht\u00eb ky mjet nuk ka t\u00eb instaluar fshes\u00eb q\u00ebndrore dhe aspirator thithje, p\u00ebr pasoj\u00eb nuk plot\u00ebson k\u00ebrkesat n\u00eb DST.<\/span><\/p>\n<p><span style=\"color: #000000;\">-mjetin me foto dhe targ\u00eb AA205TC kamjocin\u00eb me kazan t\u00eb mbyllur, nd\u00ebrsa nuk \u00ebsht\u00eb hermetik, p\u00ebr pasoj\u00eb nuk plot\u00ebson k\u00ebrkesat n\u00eb DST, etj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas KLSH, n\u00eb k\u00ebto kushte p\u00ebr mang\u00ebsi n\u00eb plot\u00ebsimin e k\u00ebrkesave kualifikuese t\u00eb paraqitura me ofert\u00ebn konkuruese e shpallur fituese KVO nuk duhej t\u00eb kishte vler\u00ebsuar k\u00ebt\u00eb ofert\u00eb, nd\u00ebrsa procedura e prokurimit duhej t\u00eb ishte anuluar p\u00ebr munges\u00eb konkurence, pasi n\u00eb gar\u00eb nuk duhej t\u00eb ngelej asnj\u00eb ofert\u00eb e vlefshme, n\u00eb mosp\u00ebrputhje me k\u00ebrkesat e parashikuara nga ligji nr.9643, dat\u00eb 20.11.2006 \u201cP\u00ebr prokurimin publik\u201d i ndryshuar, neni 2 \u201cParimet e p\u00ebrzgjedhjes\u201d, neni 20 \u201cMosdiskriminimi\u201d, neni 46 \u201cKualifikimi i ofertuesve\u201d, neni 52 \u201cHapja e ofertave\u201d pika (1); (6), neni 53 \u201cShqyrtimi i ofetave\u201d, neni 54 \u201cAlternativat\u201d, neni 55 \u201cKriteret e p\u00ebrcaktimit t\u00eb ofert\u00ebs fituese\u201d dhe VKM nr. 914, dat\u00eb 29.12.2014 \u201cP\u00ebr miratimin e rregullave t\u00eb prokurimit publik\u201d i ndryshuar, Kreu (VII) \u201cZyrtar\u00ebt e prokurimit dhe zhvillimi i procedurave\u201d; neni 64 \u201cHapja e ofertave\u201d; neni 66 \u201cShqyrtimi dhe vler\u00ebsimi i ofertave\u201d; neni 67 \u201cKlasifikimi i ofertave\u201d; neni 68 \u201cRaporti p\u00ebrmbledh\u00ebs\u201d; Kreu (VIII) \u201cKushte t\u00eb p\u00ebrgjithshme p\u00ebr zbatim\u201d, neni 73 \u201cMungesa e konkurrenc\u00ebs\u201d, neni 74 \u201cBashkimi i operator\u00ebve ekonomik\u00eb\u201d, p\u00ebr k\u00ebt\u00eb ngarkohet me p\u00ebrgjegj\u00ebsi Komisioni Vler\u00ebsimit t\u00eb Ofertave.<\/span><\/p>\n<p><span style=\"color: #000000;\">Auditimi u krye n\u00eb baz\u00eb t\u00eb programit t\u00eb auditimit nr. 34285\/1, dat\u00eb 25.10.2018, dhe p\u00ebrfshiu 2 periudha buxhetore, viti 2016 dhe viti 2017 p\u00ebrq\u00ebndruar kryesisht n\u00eb tre drejtime, vler\u00ebsimi i funksionimit t\u00eb kontrolleve t\u00eb brendshme, veprimtaria kontab\u00ebl dhe sakt\u00ebsia e paraqitjes s\u00eb pasqyrave financiare dhe p\u00ebrputhshm\u00ebria e procedurave t\u00eb prokurimit publik me k\u00ebrkesat dhe kriteret e kuadrit rregullator n\u00eb fuqi.
