K\u00ebto ndryshime jan\u00eb t\u00eb pajustifikuara, pasi m\u00ebnyra e re q\u00eb propozohet p\u00ebr kuorumin e nevojsh\u00ebm n\u00eb vendimmarrjet e K\u00ebshillave Bashkiake nuk garanton mbrojtjen e interesit publik n\u00eb procedurat e tjet\u00ebrsimit t\u00eb aseteve publike n\u00eb pron\u00ebsi t\u00eb pushtetit vendor.&#8221;, argumenton Meta.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Arsyet e plota t\u00eb kthimit t\u00eb ligjit n\u00eb shpjegimin e presidentit:<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb nderuar deputet\u00eb,<\/span><\/p>\n<p><span style=\"color: #000000;\">Kuvendi i Shqip\u00ebris\u00eb, n\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs 20 qershor 2019, ka miratuar nd\u00ebr t\u00eb tjera dhe ligjin nr. 38\/2019, \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Me shkres\u00ebn nr.2596 prot., dat\u00eb 26.06.2019 t\u00eb Kuvendit, ky ligj \u00ebsht\u00eb p\u00ebrcjell\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje, praktik\u00eb kjo e administruar me nr. 2003 prot., dat\u00eb 26.06.2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi i praktik\u00ebs parlamentare mbi propozimin, shqyrtimin dhe miratimin e k\u00ebtij projektligji rezulton se ligji i miratuar n\u00eb Kuvend \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d, ka si q\u00ebllim kryesor q\u00eb n\u00ebp\u00ebrmjet ndryshimeve t\u00eb propozuara sipas nenit 1 t\u00eb tij, ai synon t\u00eb nxis\u00eb dhe fuqizoj\u00eb bashk\u00ebpunimin n\u00eb t\u00eb gjitha fushat me shqiptar\u00ebt jasht\u00eb kufijve t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe shtetet ku ata banojn\u00eb, si dhe t\u00eb mbroj\u00eb interesat e shtetit brenda fushave t\u00eb p\u00ebrgjegj\u00ebsis\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gjat\u00eb zbatimit t\u00eb ligjit nr.139\/2015, \u00ebsht\u00eb evidentuar nevoja p\u00ebr implementimin e plot\u00eb t\u00eb dispozitave kushtetuese p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb shqiptar\u00ebve q\u00eb jetojn\u00eb jasht\u00eb kufijve, si edhe nevoja p\u00ebr krijimin e mekanizmave ligjor\u00eb n\u00eb nivel vendor sa i takon zhvillimit t\u00eb raporteve me diaspor\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht realizimi i k\u00ebtij q\u00ebllimi \u00ebsht\u00eb parashikuar me miratimin e nenit 1 dhe nenit 2 t\u00eb ligjit nr. 38\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nj\u00eb tjet\u00ebr ndryshim i propozuar me ligjin nr.38\/2019, \u00ebsht\u00eb edhe ndarja e kompetencave t\u00eb K\u00ebshillit Bashkiak n\u00eb rastet e tjet\u00ebrsimit t\u00eb pron\u00ebs me t\u00eb drejt\u00ebn p\u00ebr dh\u00ebnien n\u00eb p\u00ebrdorim. Nj\u00ebkoh\u00ebsisht me k\u00ebto ndryshime \u00ebsht\u00eb zgjeruar koncepti i tjet\u00ebrsimit t\u00eb pron\u00ebs publike duke shtuar brenda tij dhe t\u00eb drejt\u00ebn e zhvillimit t\u00eb pron\u00ebs nga organet e pushtetit vendor.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht n\u00ebp\u00ebrmjet ligjit nr.38\/2019, synohet t\u00eb ndryshohen nenet 54 dhe 55 t\u00eb ligjit nr.139\/2015 \u201cP\u00ebr vetqeverisjen vendore\u201d, q\u00eb parashikojn\u00eb detyrat dhe kompetencat e K\u00ebshillave Bashkiak\u00eb, m\u00ebnyr\u00ebn e vendimarrjes dhe kuorumin e nevojsh\u00ebm p\u00ebr \u00e7do lloj vendimmarrje t\u00eb k\u00ebtyre organeve p\u00ebrfshi k\u00ebtu dhe vendimmarrjet p\u00ebr tjet\u00ebrsimin e pron\u00ebs publike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga shqyrtimi i praktik\u00ebs parlamentare, rezulton se ndryshimet e propozara n\u00eb nenet 54-55 t\u00eb ligjit nr. 139\/2015, nuk jan\u00eb propozuar nga K\u00ebshilli i Ministrave, por ato jan\u00eb propozime t\u00eb paraqitura nga relatori i projektligjit n\u00eb Komisionin e \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut n\u00eb Kuvendin e Shqip\u00ebris\u00eb dhe t\u00eb mb\u00ebshtetura nga an\u00ebtar\u00ebt e Komisionit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky projektligj \u00ebsht\u00eb shqyrtuar n\u00eb dy komisione n\u00eb Kuvendin e Shqip\u00ebris\u00eb, konkretisht n\u00eb Komisionin p\u00ebr Politik\u00ebn e Jashtme q\u00eb kan\u00eb lidhje me nd\u00ebrhyrjet t\u00eb realizuara me nenin 1 t\u00eb ligjit nr. 38\/2019, si dhe n\u00eb Komisionin e \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut p\u00ebrsa i takon pjes\u00ebs tjet\u00ebr t\u00eb ligjit t\u00eb miratuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs shqyrtoi ligjin nr. 38\/2019, duke ju referuar p\u00ebrmbajtjes s\u00eb aktit t\u00eb d\u00ebrguar p\u00ebr dekretim dhe shpallje, praktik\u00ebs parlamentare t\u00eb ndjekur p\u00ebr k\u00ebt\u00eb q\u00ebllim dhe legjislacionit ekzistues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs vler\u00ebsoi p\u00ebrputhshm\u00ebrin\u00eb e k\u00ebtij ligji, duke b\u00ebr\u00eb nj\u00eb analiz\u00eb t\u00eb p\u00ebrmbajtjes s\u00eb aktit t\u00eb miratuar n\u00eb raport me interesin publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb p\u00ebrfundim t\u00eb k\u00ebtij shqyrtimi, Presidenti i Republik\u00ebs vler\u00ebson t\u00eb evidentoj\u00eb se dispozitat e nenit 1 t\u00eb ligjit nr. 38\/2019, jan\u00eb nj\u00eb hap shum\u00eb pozitiv i Kuvendit t\u00eb Shqip\u00ebris\u00eb n\u00eb drejtim t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb shqiptar\u00ebve q\u00eb jetojn\u00eb jasht\u00eb kufijve.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebp\u00ebrmjet dispozitave t\u00eb nenit 1 t\u00eb ligjit nr. 38\/2019, shteti shqiptar b\u00ebn nj\u00eb hap t\u00eb r\u00ebnd\u00ebsish\u00ebm drejt procesit t\u00eb implementimit t\u00eb reform\u00ebs ligjore dhe institucionale p\u00ebr nd\u00ebrtimin e marr\u00ebdh\u00ebnieve t\u00eb natyrshme t\u00eb atdheut me shtetasit e vet, n\u00ebp\u00ebrmjet dh\u00ebnies s\u00eb sh\u00ebrbimeve p\u00ebr diaspor\u00ebn dhe migracionin.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nisur nga k\u00ebto q\u00ebllime shum\u00eb positive Presidenti i Republik\u00ebs, shpreh dakord\u00ebsin\u00eb e tij p\u00ebr realizimin e shtesave n\u00eb ligjin ekzistues nr. 139\/2015, q\u00eb b\u00ebhen t\u00eb mundura n\u00ebp\u00ebrmjet dispozitave t\u00eb nenit 1 t\u00eb ligjit nr. 38\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga ana tjet\u00ebr, referuar p\u00ebrmbajtjes s\u00eb nenit 3 dhe nenit 4 t\u00eb ligjit nr. 38\/2019, objekt i k\u00ebtij shqyrtimi Presidenti i Republik\u00ebs, ka arritur n\u00eb p\u00ebrfundimin se propozimi i relatorit p\u00ebr realizimin e ndryshimeve ligjore n\u00eb nenin 54-55 t\u00eb ligjit nr. 139\/2015, <strong>cenon procesin vendimmarr\u00ebs s\u00eb K\u00ebshillave Bashkiake n\u00eb lidhje me tjet\u00ebrsimin e pronave t\u00eb tyre. K\u00ebto ndryshime jan\u00eb t\u00eb pajustifikuara, pasi m\u00ebnyra e re q\u00eb propozohet p\u00ebr kuorumin e nevojsh\u00ebm n\u00eb vendimmarrjet e K\u00ebshillave Bashkiake nuk garanton mbrojtjen e interesit publik n\u00eb procedurat e tjet\u00ebrsimit t\u00eb aseteve publike n\u00eb pron\u00ebsi t\u00eb pushtetit vendor.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Bazuar mbi k\u00ebt\u00eb arsyetim, t\u00eb shpjeguar si m\u00eb posht\u00eb vijon, n\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1 t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs, vler\u00ebson se ligj nr. 38\/2019\u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d, i duhet kthyer Kuvendit, me q\u00ebllim rishikimin e neneve 3 dhe 4 t\u00eb k\u00ebtij ligji.<\/span><\/p>\n<p><span style=\"color: me shumic\u00ebn e votave t\u00eb t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb k\u00ebshillit p\u00ebr rastet e parashikuara n\u00eb shkronjat \u201ca\u201d, \u201cb\u201d, \u201cc\u201d, \u201cd\u201d, \u201cdh\u201d, \u201cf\u201d, \u201cg\u201d, \u201cgj\u201d, \u201ci\u201d dhe \u201cj\u201d, t\u00eb nenit 54, t\u00eb k\u00ebtij ligji.<\/span><\/li>\n<li><span style=\"color: #000000;\">Vendimet merren me jo m\u00eb pak se tre t\u00eb pestat e numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb an\u00ebtar\u00ebve t\u00eb k\u00ebshillit p\u00ebr rastin e parashikuar n\u00eb shkronj\u00ebn \u201ce\u201d, t\u00eb nenit 54, t\u00eb k\u00ebtij ligji.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Pra si\u00e7 duket qart\u00eb, sipas dispozitave t\u00eb m\u00ebsip\u00ebrme ligjore, \u00ebsht\u00eb parashikuar shprehimisht n\u00eb ligj se K\u00ebshilli Bashkiak, p\u00ebr t\u00eb gjitha vendimet ku do t\u00eb trajtohen vendimmarrje t\u00eb tjet\u00ebrsimit ose dh\u00ebnies n\u00eb p\u00ebrdorim t\u00eb pronave n\u00eb favor t\u00eb t\u00eb tret\u00ebve, k\u00ebto vendime duhet t\u00eb merren dhe t\u00eb miratohen me nj\u00eb shumic\u00eb t\u00eb cil\u00ebsuar t\u00eb votave t\u00eb k\u00ebtij organi me jo m\u00eb pak se 3\/5 (tre t\u00eb pestat) e numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb an\u00ebtar\u00ebve t\u00eb k\u00ebshillit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebp\u00ebrmjet k\u00ebtyre dispozitave t\u00eb ligjit nr.139\/2015, ligjv\u00ebn\u00ebsi ka parashikuar se vendimmarrja p\u00ebr tjet\u00ebrsimin e pron\u00ebs publike, q\u00eb \u00ebsht\u00eb n\u00eb pron\u00ebsi t\u00eb pushtetit vendor, konsiderohet me shum\u00eb r\u00ebnd\u00ebsi dhe jetike p\u00ebr autonomin\u00eb e pushtetit vendor dhe vendimmarrja mbi k\u00ebto \u00e7\u00ebshtje duhet t\u00eb realizohet n\u00ebp\u00ebrmjet nj\u00eb shumice t\u00eb cil\u00ebsuar votash, duke diktuar k\u00ebshtu nj\u00eb mekaniz\u00ebm monitorues dhe shpreh\u00ebs t\u00eb vullnetit t\u00eb qytetar\u00ebve mbi veprimtarin\u00eb e pushtetit vendor.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligjv\u00ebn\u00ebsi ka qen\u00eb i kujdessh\u00ebm q\u00eb p\u00ebr k\u00ebto \u00e7\u00ebshtje, kontrolli dhe balanca brenda funksionimit t\u00eb vet organeve t\u00eb qeverisjes s\u00eb pushtetit vendor t\u00eb parashikohet me ligj dhe p\u00ebr k\u00ebt\u00eb, funksionimi dhe zbatimi i ligjit me objektivitet do t\u00eb rris\u00eb transparenc\u00ebn n\u00eb vendimmarrje t\u00eb k\u00ebsaj natyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Por ndryshe nga kjo frym\u00eb q\u00eb paraqet ligji ekzistues, rezulton se gjat\u00eb pun\u00ebs n\u00eb Komisionin e \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebn Publikd dhe t\u00eb Drejtat e Njeriut, \u00ebsht\u00eb b\u00ebr\u00eb nj\u00eb propozim i cili e prish k\u00ebt\u00eb regjim t\u00eb vendosur nga ligji ekzistues. Komisioni ka marr\u00eb n\u00eb shqyrtim dhe ka pranuar propozimin e paraqitur nga relatori p\u00ebr nd\u00ebrhyrje n\u00eb dispozitat e m\u00ebsip\u00ebrme q\u00eb trajtojn\u00eb kompetencat e K\u00ebshillit Bashkiak dhe vendimmarrjen e tij, n\u00eb kuad\u00ebr t\u00eb ushtrimit t\u00eb t\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb t\u00eb bashkive.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht sipas dispozitave t\u00eb nenit 3 dhe 4 t\u00eb ligjit nr. 38\/2019, t\u00eb miratuar, objekt i k\u00ebtij shqyrtimi, n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjes vendore\u201d, jan\u00eb miratuar k\u00ebto ndryshime:<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 3<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb nenin 54 b\u00ebhet ndryshimi dhe shtesa e m\u00ebposhtme:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Shkronja \u201ce\u201d ndryshohet si m\u00eb posht\u00eb:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u201ce) miraton tjet\u00ebrsimin e pronave t\u00eb tret\u00ebve\u201d.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\">Pas shkronj\u00ebs \u201ce\u201d shtohet shkronja \u201ce\/1\u201d me k\u00ebt\u00eb p\u00ebrmbajtje:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u201ce\/1) miraton dh\u00ebnien n\u00eb p\u00ebrdorim t\u00eb pronave t\u00eb tret\u00ebve ose dh\u00ebnien p\u00ebr zhvillim t\u00eb pron\u00ebs n\u00ebp\u00ebrmjet bashk\u00ebpunimit me subjekte private\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 4<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb nenin 55, pika 3, pas referenc\u00ebs n\u00eb shkronj\u00ebn \u201cd\u201d shtohet referenca n\u00eb shkronj\u00ebn \u201ce\/1\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si\u00e7 rezulton qart\u00ebsisht nga kjo nd\u00ebrhyrje q\u00eb propozohet t\u00eb realizohet, n\u00eb ligjin nr. 139\/2015, ky ndryshim n\u00eb ligj n\u00eb thelb krijon nj\u00eb kompetenc\u00eb t\u00eb re p\u00ebr K\u00ebshillat Bashkiak, q\u00eb \u00ebsht\u00eb e drejta e k\u00ebtyre t\u00eb fundit p\u00ebr t\u00eb hyr\u00eb n\u00eb marr\u00ebdh\u00ebnie juridike me persona t\u00eb tret\u00eb p\u00ebr zhvillimin e pron\u00ebs publike. Kjo kompetenc\u00eb nuk ka q\u00ebn\u00eb parashikuar m\u00eb par\u00eb n\u00eb ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas raportit t\u00eb Komisionit t\u00eb \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut n\u00eb Kuvendin e Shqip\u00ebris\u00eb, kjo nd\u00ebrhyrje b\u00ebhet e nevojshme p\u00ebr shkak t\u00eb dinamik\u00ebs s\u00eb zhvillimit infrastrukturor dhe urban t\u00eb qyteteve, ve\u00e7an\u00ebrisht n\u00eb dhjet\u00ebvje\u00e7arin e fundit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Parashikimi i nj\u00eb kompetence t\u00eb re p\u00ebr K\u00ebshillat Bashkiak, \u00ebsht\u00eb n\u00eb vler\u00ebsim t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb, i cili n\u00ebp\u00ebrmjet k\u00ebtij ndryshimi ligjor synon t\u00eb delegoj\u00eb m\u00eb shum\u00eb pushtet vendimmarr\u00ebs n\u00eb drejtim t\u00eb organeve t\u00eb qeverisjes vendore, por e r\u00ebnd\u00ebsishme \u00ebsht\u00eb q\u00eb kjo kompetenc\u00eb e re t\u00eb ushtrohet bazuar n\u00eb parashikime t\u00eb qarta ligjore q\u00eb rregullojn\u00eb m\u00ebnyr\u00ebn se si kjo komptenc\u00eb do t\u00eb ushtrohet, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb respektohen parimet kushtetuese t\u00eb nism\u00ebs s\u00eb lir\u00eb dhe konkurenc\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, konstaton se Kuvendi i Shqip\u00ebris\u00eb, me ndryshimet q\u00eb ka vendosur t\u00eb realizoj\u00eb n\u00ebp\u00ebrmjet nenit 3 dhe 4 t\u00eb ligjit nr. 38\/2019, po krijon nj\u00eb kompetenc\u00eb t\u00eb re p\u00ebr autoritetet vendore, por nuk ka parashikuar asnj\u00eb dispozit\u00eb mbi m\u00ebnyr\u00ebn ligjore se si k\u00ebto autoritete (K\u00ebshillat Bashkiak\u00eb) do t\u00eb formojn\u00eb vullnetin e tyre p\u00ebr t\u00eb p\u00ebrzgjedhur subjektin me t\u00eb cilin do t\u00eb hyjn\u00eb n\u00eb marr\u00ebdh\u00ebnie p\u00ebr t\u00eb zhvilluar pasurit\u00eb e paluajtshme n\u00eb pron\u00ebsi t\u00eb tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo gjendje paqart\u00ebsie, krijon shteg p\u00ebr abuzim dhe mund\u00ebsi q\u00eb n\u00eb praktik\u00eb kjo kompetenc\u00eb e re t\u00eb keqp\u00ebrdoret me pasoja t\u00eb pariparushme p\u00ebr pron\u00ebn publike dhe interesin publik.\u00a0<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Gjithashtu, e drejta p\u00ebr zhvillim e pron\u00ebs n\u00eb pron\u00ebsi t\u00eb pushtetit lokal \u00ebsht\u00eb drejtp\u00ebdrejt\u00eb nj\u00eb m\u00ebnyr\u00eb tjet\u00ebrsimi i pasuris\u00eb s\u00eb paluajtshme.<\/span><\/strong><\/p>\n<p><strong><span style=\"color: #000000;\">Pasuria e paluajtshme pron\u00eb publike n\u00eb pron\u00ebsi t\u00eb organeve t\u00eb qeverisjes vendore kur vendoset n\u00eb dispozicion t\u00eb zhvillimit t\u00eb projekteve t\u00eb p\u00ebrbashk\u00ebta me pronar\u00eb apo subjekte t\u00eb tjer\u00eb privat\u00eb, humbet funksionin fillestar t\u00eb saj, pasi p\u00ebrfshirja n\u00eb projekte t\u00eb p\u00ebrbashk\u00ebta zhvillimi b\u00ebn t\u00eb mundur krijimin e regjimeve t\u00eb reja t\u00eb t\u00eb drejtave t\u00eb pron\u00ebsis\u00eb apo bashk\u00ebpron\u00ebsis\u00eb dhe m\u00ebnyr\u00ebs s\u00eb p\u00ebrdorimit t\u00eb pasusis\u00eb s\u00eb re q\u00eb do t\u00eb p\u00ebrftohet nga ky zhvillim.<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb p\u00ebrfshirja e pasuris\u00eb pron\u00eb shtet\u00ebrore apo publike n\u00eb nj\u00eb marr\u00ebdh\u00ebnie zhvillimi me persona t\u00eb tret\u00eb p\u00ebrb\u00ebn n\u00eb thelb tjet\u00ebrsim t\u00eb saj, pasi nga ky proces ndryshohet marr\u00ebdh\u00ebnia e drejtp\u00ebdrejt\u00eb e pronarit (K\u00ebshillit Bashkiak) me pron\u00ebn e v\u00ebn\u00eb n\u00eb dispozicion, ashtu sikund\u00ebr ndryshojn\u00eb dhe raportet e pron\u00ebsis\u00eb mbi pasurin\u00eb, p\u00ebr shkak se ajo transformohet n\u00eb nj\u00eb pasuri tjet\u00ebr t\u00eb re ku marrin pjes\u00eb edhe persona t\u00eb tjer\u00eb me t\u00eb drejta pron\u00ebsie t\u00eb lidhura apo t\u00eb shkrira nd\u00ebrmjet tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb arsyetimi i b\u00ebr\u00eb nga Komisioni i \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut n\u00eb Kuvendin e Shqip\u00ebris\u00eb se e drejta e tjet\u00ebrsimit t\u00eb pron\u00ebs nuk p\u00ebrfshin t\u00eb drejt\u00ebn p\u00ebr dh\u00ebnien p\u00ebr zhvillim t\u00eb pron\u00ebs t\u00eb tret\u00ebve, nuk q\u00ebndron dhe \u00ebsht\u00eb t\u00ebr\u00ebsisht i pabazuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebto kushte edhe ndryshimet e realizuara n\u00eb nenin 4 t\u00eb ligjit nr. 38\/2019, n\u00ebp\u00ebrmjet t\u00eb cilave b\u00ebhet e mundur q\u00eb vendimet e K\u00ebshillit Bashkiak p\u00ebr miratimin e dh\u00ebnies p\u00ebr zhvillim t\u00eb pron\u00ebs n\u00ebp\u00ebrmjet bashk\u00ebpunimit me subjekte private, t\u00eb p\u00ebrfshihen n\u00eb ato vendime p\u00ebr t\u00eb cilat nevojitet nj\u00eb kuorum vendimmarr\u00ebs i thjesht\u00eb me shumic\u00ebn e an\u00ebtar\u00ebve t\u00eb K\u00ebshillit, si\u00e7 parashikon neni\u00a0 55, pika 3, e ligjit nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d, \u00ebsht\u00eb nj\u00eb vler\u00ebsim i gabuar dhe aspak objektiv.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebse Kuvendi i Shqip\u00ebris\u00eb, vler\u00ebson ti jap\u00eb autoriteteve vendore nj\u00eb kompetenc\u00eb t\u00eb re ligjore, q\u00eb p\u00ebrfshin t\u00eb drejt\u00ebn p\u00ebr t\u00eb bashk\u00ebpunuar me subjekte apo personave privat\u00eb p\u00ebr zhvillimin e pron\u00ebs n\u00eb pron\u00ebsi t\u00eb autoriteteve vendore, at\u00ebher\u00eb kjo e drejt\u00eb p\u00ebr t\u00eb zhvilluar pron\u00ebn, e cila p\u00ebrb\u00ebn nj\u00eb nga m\u00ebnyrat e tjet\u00ebrsimit t\u00eb pron\u00ebs, duhet t\u00eb p\u00ebrfshihet n\u00eb ato raste ku vendimi p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje duhet t\u00eb merret me nj\u00eb shumic\u00eb t\u00eb cil\u00ebsuar n\u00eb K\u00ebshillin Bashkiak, pra me 3\/5 e t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb k\u00ebshillit, si\u00e7 parashikon sot neni 54, germa \u201ce\u201d dhe pika 3 e nenit 55 t\u00eb ligjit nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ndryshimet e propozuara dhe t\u00eb miratuara n\u00eb nenin 54 dhe 55 t\u00eb ligjit nr. 139\/2015, c\u00ebnojn\u00eb kuorumin e nevojsh\u00ebm t\u00eb vendimmarrjes s\u00eb K\u00ebshillave Bashkiake p\u00ebr \u00e7\u00ebshtje t\u00eb tjet\u00ebrsimit dhe zhvillimit t\u00eb pron\u00ebs n\u00eb pron\u00ebsi t\u00eb pushtetit vendor, jan\u00eb t\u00eb pajustifikuara dhe nuk garantojn\u00eb mbrojtjen e interesit publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00ebp\u00ebrmjet k\u00ebtyre ndryshimeve q\u00eb realizohen n\u00ebp\u00ebrmjet nenit 3 dhe 4 t\u00eb ligjit nr. 38\/2019, ulet niveli vendimmarr\u00ebs i kontrollit t\u00eb organit kolegjial t\u00eb K\u00ebshillit Bashkiak ndaj propozimeve dhe veprimtaris\u00eb t\u00eb organit ekzekutiv t\u00eb Kryetarit t\u00eb Bashkis\u00eb, \u00e7\u2019ka krijon mund\u00ebsi q\u00eb zhvillimi i pronave t\u00eb shtetit n\u00eb bashk\u00ebpunim me persona t\u00eb tret\u00eb t\u00eb realizohet p\u00ebrkundrejt p\u00ebrfitimeve p\u00ebr shtetin q\u00eb nuk p\u00ebrkojn\u00eb me k\u00ebrkesat e ligjit, me realitetin dhe me kushtet q\u00eb ofron tregu.<\/span><\/p>\n<p><span style=\"color: #000000;\">T\u00eb nderuar deputet\u00eb t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb,<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr arsyet e parashtruara m\u00eb sip\u00ebr, n\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1, t\u00eb nenit 85 t\u00eb saj, kam vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr. 38\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 139\/2015 \u201cP\u00ebr vet\u00ebqeverisjen vendore\u201d\u201d, me q\u00ebllimin q\u00eb Kuvendi i Shqip\u00ebris\u00eb t\u00eb rishikoj\u00eb nenet 3 dhe 4 t\u00eb k\u00ebtij
