13 prill pas nj\u00eb urdhri t\u00eb ministres s\u00eb Arsimit, Shahini. <\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas kreut t\u00eb shtetit, vendimi i marr\u00eb nga ministrja Shahini ka pasur nj\u00eb s\u00ebr\u00eb shkeljesh t\u00eb cilat i ka renditur n\u00eb argumentimin e publikuar n\u00eb dekretin e firmosur prej tij.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Meta propozimin e Ministrit t\u00eb Arsimit, Sportit dhe Rinis\u00eb nr. 4158\/2 prot., dat\u00eb 12.04.2019, administruar n\u00eb Institucionin e Presidentit t\u00eb Republik\u00ebs me nr.1169 prot., dat\u00eb 15.04.2019, n\u00ebp\u00ebrmjet t\u00eb cil\u00ebs propozohet shkarkimi nga detyra t\u00eb Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs (UT), zotit Mynyr Koni, p\u00ebr shkak t\u00eb pretendimeve p\u00ebr shkelje t\u00eb r\u00ebnda t\u00eb ligjit dhe akteve n\u00ebnligjore n\u00eb fuqi.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb shqyrtimin e k\u00ebtij propozimi, Presidenti i Republik\u00ebs, vler\u00ebsoi t\u00eb gjith\u00eb dokumentacionin shoq\u00ebrues t\u00eb paraqitur nga Ministri i Arsimit, Sportit dhe Rinis\u00eb (MASR), si dhe d\u00ebgjoi sqarimet p\u00ebrkat\u00ebse gjat\u00eb takimit me t\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, gjithashtu administroi dhe vler\u00ebsoi pretendimet me shkrim dhe dokumentacionin shoq\u00ebrues t\u00eb p\u00ebrcjell\u00eb zyrtarisht nga Rektori i Universitetit t\u00eb Tiran\u00ebs, zotit Mynyr Koni, si dhe d\u00ebgjoi t\u00eb gjitha shpjegimet dhe sqarimet e tij t\u00eb dh\u00ebna n\u00eb nj\u00eb takim t\u00eb realizuar me t\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs kreu nj\u00eb vler\u00ebsim t\u00eb thelluar dhe gjith\u00ebp\u00ebrfshir\u00ebs t\u00eb t\u00eb gjith\u00eb kuadrit kushtetues, ligjor dhe n\u00ebnligjor q\u00eb rregullon veprimtarin\u00eb n\u00eb institucionet e arsimit t\u00eb lart\u00eb jo vet\u00ebm duke iu referuar praktik\u00ebs dokumentare t\u00eb k\u00ebtij propozimi, por dhe praktik\u00ebs dokumentare t\u00eb administruar n\u00eb vijim\u00ebsi mbi problematikat dhe situatat konfliktuale midis strukturave drejtuese akademike dhe administrative n\u00eb Universitetin e Tiran\u00ebs p\u00ebrgjat\u00eb viteve 2017-2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, vler\u00ebson se, n\u00eb kushtet aktuale, bazuar n\u00eb propozimin e b\u00ebr\u00eb, pas shqyrtimit t\u00eb \u00e7\u00ebshtjes, v\u00ebren se procesi i zhvilluar nga Ministria e Arsimit, Sportit dhe Rinis\u00eb (MASR), ka patur ;<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Grupi i pun\u00ebs, i ngritur me urdhrin nr.715, dat\u00eb 25.10.2018, ka p\u00ebrmbyllur funksionet e tij n\u00eb dat\u00ebn 04.12.2018 n\u00ebp\u00ebrmjet raportit t\u00eb hartuar drejtuar Ministrit t\u00eb Arsimit, Sportit dhe Rinis\u00eb. Konstatohet se kjo detyr\u00eb \u00ebsht\u00eb p\u00ebrmbushur p\u00ebrtej afatit t\u00eb parashikuar n\u00eb pik\u00ebn 2 t\u00eb urdhrit t\u00eb ministrit, i cili ishte data 11.11.2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nga praktika e administruar, konstatohet se Ministri i Arsimit, Sportit dhe Rinis\u00eb, me shkres\u00ebn nr.11215\/1 prot., dat\u00eb 07.12.2018, ka b\u00ebr\u00eb vet\u00ebm p\u00ebrcjelljen e k\u00ebtij raporti pran\u00eb Universitetit t\u00eb Tiran\u00ebs, pa shprehur q\u00ebndrimin e tij. Q\u00ebndrimi i Ministrit t\u00eb Arsimit, ishte i nevojsh\u00ebm dhe i detyruesh\u00ebm, pasi ai \u00ebsht\u00eb autoriteti epror i grupit t\u00eb pun\u00ebs, ndaj gjetjeve dhe konstatimeve t\u00eb t\u00eb cilit Rektori i Universitetit t\u00eb Tiran\u00ebs kishte paraqitur n\u00eb vijim\u00ebsi pretendime dhe kund\u00ebrshtime p\u00ebrgjat\u00eb gjith\u00eb periudh\u00ebs qoft\u00eb gjat\u00eb periudh\u00ebs kontrolluese fillestare, ashtu dhe t\u00eb verifikimit t\u00eb plot\u00ebsimit t\u00eb rekomandimeve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, konstaton se t\u00eb dy raportet e grupit t\u00eb pun\u00ebs si raporti nr.8359\/1 prot., dat\u00eb 31.07.2018, ashtu edhe raporti i dat\u00ebs 04.12.2018, nuk reflektojn\u00eb asnj\u00eb q\u00ebndrim t\u00eb shprehur t\u00eb Ministrit t\u00eb Arsimit, Sportit dhe Rinis\u00eb, e p\u00ebr m\u00eb tep\u00ebr k\u00ebto akte nuk p\u00ebrmbajn\u00eb as n\u00ebnshkrimin e k\u00ebtij autoriteti (Ministrit).<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ndryshim t\u00ebr\u00ebsor q\u00ebndrimi t\u00eb mbajtur nga ish-Ministri i Arsimit, Sportit dhe Rinis\u00eb n\u00eb muajin dhjetor 2018, dhe Ministria e Arsimit, Sportit dhe Rinis\u00eb n\u00eb muajin prill 2019, e cila nd\u00ebrmori nj\u00eb tjet\u00ebr angazhim p\u00ebr t\u00eb rivler\u00ebsuar edhe nj\u00eb her\u00eb q\u00ebndrimin mbi plot\u00ebsimin e rekomandimeve t\u00eb l\u00ebna nga grupi i pun\u00ebs n\u00eb raportin e dat\u00ebs 31.07.2018 dhe konstatimeve n\u00eb raportin e dat\u00ebs 04.12.2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht, i nj\u00ebjti grup pune i p\u00ebrcaktuar me urdhrin nr.715, dat\u00eb 25.10.2018 \u201cP\u00ebr verifikimin e zbatimit t\u00eb rekomandimeve sipas raportit nr.8359 prot., dat\u00eb 31.07.2018 n\u00eb Universitetin e Tiran\u00ebs\u201d dhe q\u00eb kishte hartuar nj\u00eb her\u00eb raportin e dat\u00ebs 04.12.2018, riaktivizohet s\u00ebrish, duke hartuar tashm\u00eb nj\u00eb\u00a0 relacion me em\u00ebrtimin \u201cMbi shkeljet e konstatuara n\u00eb UT gjat\u00eb ushtrimit t\u00eb detyr\u00ebs nga Rektori i Universitetit t\u00eb Tiran\u00ebs, zoti Mynyr Koni, bazuar n\u00eb raportet dhe rekomandimet e grupit t\u00eb pun\u00ebs q\u00eb ka ushtruar kontrolle n\u00eb k\u00ebt\u00eb institucion\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konstatohet se riaktivizimi i grupi t\u00eb pun\u00ebs dhe veprimtaria e tij \u00ebsht\u00eb p\u00ebrtej afateve, procedurave dhe objektit n\u00eb shkelje t\u00eb urdhrit t\u00eb ministrit nr.715, dat\u00eb 25.10.2018. Sipas akteve t\u00eb administruara, nuk rezulton asnj\u00eb urdh\u00ebr tjet\u00ebr i ministrit q\u00eb t\u00eb riaktivizonte k\u00ebt\u00eb grup pune me q\u00ebllim rivler\u00ebsimin e \u00e7\u00ebshtjes.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sa m\u00eb sip\u00ebr, konstatohet se ky proces pune, i p\u00ebrfunduar n\u00eb muajin dhjetor 2018, tashm\u00eb rifillon edhe nj\u00eb her\u00eb n\u00eb muajin prill 2019, por k\u00ebt\u00eb her\u00eb, pa ndonj\u00eb akt t\u00eb Ministrit t\u00eb Arsimit, q\u00eb t\u00eb urdh\u00ebronte realizimin e nj\u00eb detyre t\u00eb till\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebsisoj provohet qart\u00eb se, riaktivizimi vetiu i grupit t\u00eb pun\u00ebs q\u00eb e kishte p\u00ebrmbyllur funksionin e tij, prej m\u00eb se 4 muajve, tregon se ky grup pune ka vepruar p\u00ebrtej kompetencave t\u00eb tij, jasht\u00eb afatit t\u00eb p\u00ebrcaktuar t\u00eb veprimtaris\u00eb dhe i diktuar nga autoriteti i Ministrit t\u00eb Arsimit p\u00ebr arritjen e nj\u00eb q\u00ebllimi t\u00eb caktuar q\u00eb do t\u00eb finalizohej me propozimin p\u00ebr shkarkim t\u00eb Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, zotit Mynyr Koni.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo qasje subjektive dhe arbitrare provohet edhe nga fakti se ky relacion i ri, i hartuar vetiu dhe pa ndonj\u00eb k\u00ebrkes\u00eb zyrtare t\u00eb ministrit, q\u00eb n\u00eb titull dhe n\u00eb p\u00ebrmbajtjen e tij, nuk trajton evidentimin e p\u00ebrgjegj\u00ebsis\u00eb p\u00ebr gjith\u00eb organet drejtuese t\u00eb Universitetit t\u00eb Tiran\u00ebs, por vet\u00ebm p\u00ebrgjegj\u00ebsit\u00eb n\u00eb adres\u00eb t\u00eb Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, si organi i vet\u00ebm drejtues q\u00eb sipas tyre ka shfaqur problematik\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kushtetut\u00eb-b\u00ebr\u00ebsi i ka dh\u00ebn\u00eb Presidentit t\u00eb Republik\u00ebs kompetenca p\u00ebr em\u00ebrimin dhe shkarkimin e rektor\u00ebve t\u00eb institucioneve t\u00eb arsimit t\u00eb lart\u00eb me propozim t\u00eb Ministrit t\u00eb Arsimit, pik\u00ebrisht p\u00ebr t\u00eb garantuar zbatimin e parimit kushtetues t\u00eb ndarjes e balancimit t\u00eb pushteteve, me q\u00ebllim shmangien e ndikimit t\u00eb ekzekutivit n\u00eb k\u00ebto institucione, n\u00eb m\u00ebnyr\u00eb q\u00eb, t\u00eb garantohet sa m\u00eb mir\u00eb qoft\u00eb autonomia dhe liria akademike n\u00eb institucionet e arsimit t\u00eb lart\u00eb, por dhe neutraliteti politik i tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs evidenton se Ministri i Arsimit, n\u00eb nd\u00ebrmarrjen e k\u00ebtij propozimi p\u00ebr shkarkimin e Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, nuk \u00ebsht\u00eb konsultuar apo nuk ka komunikuar paraprakisht me Presidentin e Republik\u00ebs. Konsultimi dhe diskutimi paraprak mbi k\u00ebto propozime nuk \u00ebsht\u00eb nj\u00eb detyrim i shprehur n\u00eb ligjin nr.80\/2015, por Presidenti i Republik\u00ebs vler\u00ebson se n\u00eb k\u00ebto \u00e7\u00ebshtje me r\u00ebnd\u00ebsi t\u00eb lart\u00eb shtet\u00ebrore dhe publike, autoritetet kushtetuese, q\u00eb n\u00eb rastin konkret jan\u00eb Ministri i Arsimit dhe Presidenti, p\u00ebrgjat\u00eb ushtrimit t\u00eb kompetencave t\u00eb tyre, bazuar n\u00eb parimin e luajalitetit kushtetues, duhet t\u00eb bashk\u00ebpunojn\u00eb n\u00eb m\u00ebnyr\u00eb q\u00eb nd\u00ebrmarrja e nismave t\u00eb k\u00ebsaj natyre t\u00eb jet\u00eb n\u00eb p\u00ebrputhje me kriteret ligjore, n\u00eb koh\u00ebn e duhur dhe n\u00eb funksion t\u00eb p\u00ebrmir\u00ebsimit t\u00eb funksionimit t\u00eb institucioneve t\u00eb arsimit t\u00eb lar\u00eb dhe garantimit t\u00eb pavar\u00ebsis\u00eb s\u00eb tyre akademike.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Presidenti i Republik\u00ebs, vler\u00ebson se p\u00ebrpara propozimit p\u00ebr shkarkim, Ministri i Arsimit, Sportit dhe Rinis\u00eb, duhej t\u00eb kishte realizuar nj\u00eb takim paraprak me Rektorin e Universitetit t\u00eb Tiran\u00ebs, me q\u00ebllim q\u00eb t\u00eb kishte d\u00ebgjuar pretendimet apo sqarimet e tij, p\u00ebrpara vendimmarrjes ekstreme t\u00eb propozimit p\u00ebr shkarkimin e tij. Nga t\u00eb dh\u00ebnat dhe shpjegimet e dh\u00ebna n\u00eb takimin e realizuar me Ministrin e Arsimit, por dhe me Rektorin e Universitetit t\u00eb Tiran\u00ebs, rezulton se nd\u00ebrmjet Ministrit t\u00eb Arsimit dhe Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, nuk \u00ebsht\u00eb realizuar asnj\u00eb takim, por ka pasur vet\u00ebm nj\u00eb komunikim telefonik t\u00eb dat\u00ebs 13 prill 2019, disa minuta m\u00eb par\u00eb se Ministri i Arsimit, t\u00eb b\u00ebnte publik vendimmarrjen e tij p\u00ebr pezullimin e rektorit dhe propozimin e shkarkimit t\u00eb tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ministri i Arsimit, ka n\u00ebnshkruar urdhrin e pezullimit dhe propozimin p\u00ebr shkarkim n\u00eb dat\u00eb 12 prill 2019 dhe, p\u00ebr t\u00eb b\u00ebr\u00eb ditur publikisht k\u00ebt\u00eb vendimmarrje t\u00eb tij, Ministri i Arsimit m\u00eb dat\u00eb 13.04.2019, dit\u00eb e shtun\u00eb, ka mbajtur nj\u00eb deklarat\u00eb p\u00ebr mediat, nd\u00ebrkoh\u00eb q\u00eb, propozimi shkresor zyrtar nuk ishte paraqitur p\u00ebrpara autoritetit t\u00eb Presidentit t\u00eb Republik\u00ebs, pasi ky propozim \u00ebsht\u00eb dor\u00ebzuar n\u00eb Institucionin e Presidentit t\u00eb Republik\u00ebs, dit\u00ebn e h\u00ebn\u00eb, m\u00eb 15 prill 2019, administruar me nr.1169 prot., dat\u00eb 15.04.2019. Nd\u00ebrkoh\u00eb, q\u00eb edhe vet\u00eb Rektoratit t\u00eb Universitetit t\u00eb Tiran\u00ebs, q\u00eb do t\u00eb duhej t\u00eb zbatonte urdhrin nr.223, dat\u00eb 12.04.2019 t\u00eb MASR-s\u00eb, \u201cP\u00ebr pezullimin nga detyra t\u00eb Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs\u201d, praktika zyrtare i \u00ebsht\u00eb p\u00ebrcjell\u00eb me shkres\u00eb nr.4158\/3, prot., dat\u00eb 15.04.2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht kjo ka sjell\u00eb si pasoj\u00eb q\u00eb Rektori i Universitetit t\u00eb Tiran\u00ebs, zoti Mynyr Koni, t\u00eb mos realizoj\u00eb as t\u00eb drejt\u00ebn e tij p\u00ebr t\u2019u njoftuar mbi aktet administrative, n\u00eb ngarkim t\u00eb tij, duke cenuar k\u00ebshtu edhe parimin kushtetues p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor.<\/span><\/p>\n<p><span style=\"color: #000000;\">E drejta e individit p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor \u00ebsht\u00eb nj\u00eb e drejt\u00eb kushtetuese dhe p\u00ebrfshin edhe at\u00eb me karakter disiplinor administrativ.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Mosp\u00ebrputhje ligjore me urdhrin nr.223, dat\u00eb 12.04.2019 t\u00eb Ministrit t\u00eb Arsimit, Sportit dhe Rinis\u00eb p\u00ebr pezullimin nga detyra t\u00eb Rektorit t\u00eb UT-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb pik\u00ebn 3 t\u00eb k\u00ebtij akti, Ministri i Arsimit ka urdh\u00ebruar: \u201cCaktohet zoti Bernard Dosti me detyr\u00eb Z\u00ebvend\u00ebs rektor n\u00eb Universitetin e Tiran\u00ebs q\u00eb t\u00eb z\u00ebvend\u00ebsoj\u00eb rektorin e pezulluar, deri n\u00eb p\u00ebrfundimin e \u00e7\u00ebshtjes me vendim t\u00eb form\u00ebs s\u00eb prer\u00eb\u201d.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo vendimmarrje e Ministrit t\u00eb Arsimit \u00ebsht\u00eb n\u00eb kund\u00ebrshtim t\u00eb hapur dhe flagrant me parashikimet kushtetuese dhe me vet\u00eb ligjin nr.80\/2015, i cili nuk parashikon asnj\u00eb t\u00eb drejt\u00eb t\u00eb Ministrit t\u00eb Arsimit, q\u00eb t\u00eb komandoj\u00eb apo t\u00eb caktoj\u00eb nj\u00eb Z\u00ebvend\u00ebs rektor, q\u00eb t\u00eb ushtroj\u00eb n\u00eb k\u00ebt\u00eb rast kompetencat e rektorit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Neni 39, pika 10 e ligjit nr.80\/2015, parashikon se \u201cN\u00eb rastet e kryerjes s\u00eb veprave penale flagrante ose t\u00eb shkeljeve t\u00eb r\u00ebnda t\u00eb ligjit, t\u00eb pamund\u00ebsis\u00eb p\u00ebr t\u00eb kryer detyr\u00ebn dhe p\u00ebr rastet e parashikuara n\u00eb Kodin e Etik\u00ebs s\u00eb institucionit t\u00eb arsimit t\u00eb lart\u00eb, ministri pezullon rektorin dhe i propozon Presidentit t\u00eb Republik\u00ebs shkarkimin e tij, i cili shprehet brenda nj\u00eb muaji. N\u00eb rast se Presidenti i Republik\u00ebs nuk shprehet brenda k\u00ebtij afati, propozimi i ministrit konsiderohet i miratuar n\u00eb heshtje. Pas dekretimit t\u00eb shkarkimit, ministri shpall zgjedhje t\u00eb parakohshme brenda gjasht\u00eb muajve nga data e shkarkimit.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra kjo dispozit\u00eb nuk parashikon se cili \u00ebsht\u00eb autoriteti q\u00eb vendos mbi komandimin apo caktimin e nj\u00eb z\u00ebvend\u00ebsuesi p\u00ebr t\u00eb realizuar detyrat e rektorit kur ai pezullohet. Kjo munges\u00eb e parashikimit n\u00eb k\u00ebt\u00eb nen t\u00eb ligjit, nuk mund t\u2019i jap\u00eb t\u00eb drejt\u00eb Ministrit t\u00eb Arsimit, pra nj\u00eb funksionari politik q\u00eb t\u00eb komandoj\u00eb n\u00eb detyr\u00ebn e rektorit nj\u00eb funksionar tjet\u00ebr me nj\u00eb afat t\u00eb pacaktuar.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ka tjet\u00ebrsim t\u00eb pabazuar q\u00ebndrimi nga Ministri i Arsimit\u00a0 Konkretisht, n\u00eb t\u00eb dy aktet e para t\u00eb kontrollit t\u00eb dat\u00ebs 31.07.2018 dhe 04.12.2018, grupi pun\u00ebs evidenton se p\u00ebr plot\u00ebsimin e rekomandimit nr.3, p\u00ebr vendosjen n\u00eb gjendje pune t\u00eb sistemit informatik t\u00eb Universitetit t\u00eb Tiran\u00ebs kjo \u00ebsht\u00eb nj\u00eb detyr\u00eb dhe p\u00ebrgjegj\u00ebsi e Administratorit t\u00eb UT-s\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky q\u00ebndrim \u00ebsht\u00eb i nj\u00ebjt\u00eb edhe n\u00eb pjes\u00ebn hyr\u00ebse (faqen 2) t\u00eb raportit nr.4158\/2 prot., dat\u00eb 12.04.2019, por n\u00eb m\u00ebnyr\u00eb t\u00eb pajustifikuar n\u00eb faqen 5 t\u00eb k\u00ebtij dokumenti ku pasqyrohet se kush \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje, Ministri i Arsimit dhe grupi i pun\u00ebs, ndryshojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb papritur q\u00ebndrimin e tyre, duke b\u00ebr\u00eb p\u00ebrgjegj\u00ebs p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje Rektorin e Universitetit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ky tjet\u00ebrsim i papritur i q\u00ebndrimit t\u00eb Ministrit t\u00eb Arsimit dhe grupit t\u00eb pun\u00ebs, q\u00eb vihet re leht\u00ebsisht, \u00ebsht\u00eb i pamb\u00ebshtetur n\u00eb prova dhe n\u00eb asnj\u00eb dispozit\u00eb ligjore. Ky tjet\u00ebrsim i q\u00ebndrimit zyrtar, duke i ngarkuar rektorit Koni, nj\u00eb p\u00ebrgjegj\u00ebsi t\u00eb paqen\u00eb jo vet\u00ebm q\u00eb \u00ebsht\u00eb i pa drejt\u00eb, por \u00ebsht\u00eb keqp\u00ebrdorur edhe mediatikisht me q\u00ebllim q\u00eb publikut t\u00eb gjer\u00eb t\u2019i p\u00ebrcillet nj\u00eb informacion i rrem\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb e gjith\u00eb p\u00ebrgjegj\u00ebsia e mosfunksionimit t\u00eb sistemit informatik t\u00eb Universitetit t\u00eb Tiran\u00ebs, publikisht t\u2019i transferohet Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 N\u00eb lidhje me Rekomandimin nr. 5, rezulton se Rektori ti UT-s\u00eb ka qen\u00eb aktiv dhe ka treguar gatishm\u00ebri n\u00eb p\u00ebrmbushjen e k\u00ebtij rekomandimi t\u00eb Ministris\u00eb s\u00eb Arsimit dhe pretendimi se Rektori nuk ka vepruar n\u00eb k\u00ebt\u00eb drejtim, nuk q\u00ebndron dhe \u00ebsht\u00eb rrjedhoj\u00eb e nj\u00eb vler\u00ebsimi jo t\u00eb thelluar.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebr m\u00eb tep\u00ebr, konstatohet se referenca ligjore e nenit 102 t\u00eb ligjit nr. 80\/2015, e cituar n\u00eb relacion dhe e pretenduar se \u00ebsht\u00eb shkelur nga Rektori i Universitetit t\u00eb Tiran\u00ebs, nuk p\u00ebrkon aspak me gjetjen konkrete, t\u00eb trajtuar n\u00eb k\u00ebt\u00eb rekomandim.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 N\u00eb lidhje me Rekomandimin nr. 6, konstatohet se referenca ligjore e nenit 102, t\u00eb ligjit nr. 80\/2015, e cituar n\u00eb relacion dhe e pretenduar se \u00ebsht\u00eb shkelur nga Rektori i Universitetit t\u00eb Tiran\u00ebs, nuk p\u00ebrkon aspak me gjetjen konkrete, t\u00eb trajtuar n\u00eb k\u00ebt\u00eb rekomandim.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 N\u00eb lidhje me Rekomandimin nr. 11 dhe 12, rezulton se Rektori i Universitetit t\u00eb Tiran\u00ebs, n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme ka mbajtur nj\u00eb q\u00ebndrim q\u00eb nuk mund t\u00eb zbatoj\u00eb rekomandimet nr.11 dhe nr.12, pasi ato jan\u00eb n\u00eb kund\u00ebrshtim me ligjin dhe kur pala tjet\u00ebr, grupi i pun\u00ebs dhe Ministria e Arsimit, Sportit dhe Rinis\u00eb, k\u00ebrkojn\u00eb me insistim q\u00eb Rektori UT-s\u00eb t\u00eb nxjerr\u00eb akt administrativ p\u00ebr t\u00eb konstatuar pavlefshm\u00ebris\u00eb absolute t\u00eb disa akteve q\u00eb nj\u00ebra pal\u00eb pretendon se jan\u00eb nxjerr\u00eb n\u00eb p\u00ebrputhje me ligjin, nd\u00ebrsa pala tjet\u00ebr pretendon se jan\u00eb nxjerr\u00eb n\u00eb kap\u00ebrcim t\u00eb ligjit,<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, vler\u00ebson se pal\u00ebt duhet t\u2019i ishin drejtuar gjykat\u00ebs kompetente p\u00ebr t\u00eb zgjidhur k\u00ebt\u00eb konflikt dhe n\u00ebse ende nuk e kan\u00eb b\u00ebr\u00eb, ato mund t\u2019i drejtohen aktualisht.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Neni 39, pika 10, i ligjit nr.80\/2015, parashikon se: \u201cn\u00eb rastet e kryerjes s\u00eb veprave penale flagrante ose t\u00eb shkeljeve t\u00eb r\u00ebnda t\u00eb ligjit, &#8230;&#8230;, ministri pezullon rektorin dhe i propozon Presidentit t\u00eb Republik\u00ebs shkarkimin e tij, i cili shprehet brenda nj\u00eb muaji.\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ligji nr.80\/2015, nuk p\u00ebrcakton n\u00eb asnj\u00eb dispozit\u00eb t\u00eb tij, se cilat veprime apo mosveprime t\u00eb organeve drejtuese konkretisht t\u00eb Rektorit t\u00eb Universitetit q\u00eb p\u00ebrb\u00ebjn\u00eb \u201cshkelje t\u00eb r\u00ebnd\u00eb\u201d n\u00eb kuptim t\u00eb ligjit, mbi t\u00eb cilat mund t\u00eb nd\u00ebrmerret nisma p\u00ebr t\u00eb propozuar shkarkimin e tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">Parashikimet e nenit 39 nuk qart\u00ebsojn\u00eb p\u00ebr asnj\u00eb \u00e7ast se cilat jan\u00eb ato raste t\u00eb shkeljeve t\u00eb r\u00ebnda, kush veprim do t\u00eb konsiderohet i till\u00eb dhe cili \u00ebsht\u00eb ai mekaniz\u00ebm konkret institucional, i pavarur politikisht, me t\u00eb cilin ministri p\u00ebrgjegj\u00ebs p\u00ebr arsimin, konsultohet, shqyrton dhe, n\u00eb p\u00ebrfundim, vendos nd\u00ebrmarrjen e nism\u00ebs ekstreme p\u00ebr t\u00eb propozuar tek Presidenti i Republik\u00ebs shkarkimin e Rektorit t\u00eb Universitetit, funksionar ky, q\u00eb sipas Kushtetut\u00ebs, em\u00ebrohet nga Presidenti i Republik\u00ebs, por q\u00eb zgjidhet p\u00ebrmes vot\u00ebs nga asamblet\u00eb e personelit akademik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht kjo paqart\u00ebsi q\u00eb paraqet neni 39, pika 10, i ligjit nr.80\/2015, rezulton se ka krijuar edhe n\u00eb k\u00ebt\u00eb rast, terren t\u00eb p\u00ebrshtatsh\u00ebm q\u00eb autoriteti politik i ministrit, bazuar n\u00eb nj\u00eb dispozit\u00eb t\u00eb ve\u00e7uar t\u00eb ligjit nr.80\/2015 (neni 7, pika 2\/e) t\u00eb nxjerr\u00eb urdhrin nr.77, dat\u00eb 16.02.2018 dhe urdhrin nr.715, dat\u00eb 25.10.2018, duke krijuar nj\u00eb struktur\u00eb t\u00eb posa\u00e7me \u201cad-hoc\u201d, me p\u00ebrb\u00ebrje t\u00ebr\u00ebsore nga punonj\u00ebs t\u00eb Ministris\u00eb s\u00eb Arsimit.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">N\u00eb vijim, kjo struktur\u00eb e posa\u00e7me (ad-hoc), pas mbylljes dhe d\u00ebrgimit t\u00eb Raportit p\u00ebrfundimtar t\u00eb dat\u00ebs 04.12.2018, rezulton se \u00ebsht\u00eb shfryt\u00ebzuar s\u00ebrish nga Ministri i Arsimit, p\u00ebr t\u00eb hartuar nj\u00eb relacion drejtuar atij, me q\u00ebllim vler\u00ebsimin e nivelit t\u00eb shkeljeve t\u00eb pretenduara, n\u00eb cil\u00ebsin\u00eb e \u201cshkeljes s\u00eb r\u00ebnd\u00eb\u201d, p\u00ebr t\u00eb ligj\u00ebruar k\u00ebshtu nism\u00ebn dhe p\u00ebr t\u00eb plot\u00ebsuar, n\u00eb fakt, at\u00eb q\u00eb ligji nr.80\/2015, nuk e parashikon shprehimisht.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 P\u00ebr t\u00eb realizuar nj\u00eb shqyrtim objektiv dhe t\u00eb balancuar t\u00eb rastit, duke krahasuar dhe vler\u00ebsuar pretendimet e t\u00eb dy pal\u00ebve, Presidenti i Republik\u00ebs, i \u00ebsht\u00eb referuar standardit m\u00eb t\u00eb lart\u00eb t\u00eb vendosur nga Gjykata Kushtetuese n\u00eb k\u00ebt\u00eb drejtim.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb jurisprudenc\u00ebn e Gjykat\u00ebs Kushtetuese, kryesisht n\u00eb vendimet e saj q\u00eb kan\u00eb shqyrtuar \u00e7\u00ebshtje t\u00eb procedurave t\u00eb shkarkimit nga detyra t\u00eb organeve t\u00eb zgjedhur t\u00eb pushtetit vendor (shiko vendimet nr.67\/2016, nr.15\/2011, 22\/2008, 25\/2000, 50\/2000) \u00ebsht\u00eb mbajtur q\u00ebndrimi se;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201c Shkarkimi i organeve t\u00eb zgjedhura \u00ebsht\u00eb nj\u00eb mas\u00eb ekstreme e procedurave t\u00eb kontrollit dhe ajo duhet t\u00eb merret pas nj\u00eb vler\u00ebsimi t\u00eb kujdessh\u00ebm t\u00eb disa elementeve t\u00eb zhvilluara n\u00eb jurisprudenc\u00ebn e k\u00ebsaj Gjykate, sipas s\u00eb cil\u00ebs kuptimi i sakt\u00eb dhe i drejt\u00eb i konceptit \u201cshkelje e r\u00ebnd\u00eb e ligjit\u201d vler\u00ebsohet n\u00eb t\u00ebr\u00ebsin\u00eb e tij nga disa faktor\u00eb, t\u00eb cil\u00ebt kan\u00eb t\u00eb b\u00ebjn\u00eb me r\u00ebnd\u00ebsin\u00eb e ligjit t\u00eb shkelur, pasojat e ardhura nga shkelja e tij, koh\u00ebzgjatjen e k\u00ebtyre pasojave si dhe vet\u00eb q\u00ebndrimin subjektiv q\u00eb mban personi konkret ndaj shkeljes s\u00eb kryer\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Referuar k\u00ebtij q\u00ebndrimi, t\u00eb Gjykat\u00ebs Kushtetuese, nga vler\u00ebsimi i t\u00eb gjith\u00eb faktor\u00ebve n\u00eb dispozicion, vler\u00ebsohet se n\u00eb rastin konkret nuk ekzistojn\u00eb kushtet q\u00eb t\u00eb pranohet propozimi i Ministrit t\u00eb Arsimit, p\u00ebr shkarkimin e Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, mb\u00ebshtetur n\u00eb argumentin se ai ka kryer shkelje t\u00eb r\u00ebnda t\u00eb ligjit, sipas nenit 39, pika 10 t\u00eb ligjit nr.80\/2015.<\/span><\/p>\n<p><span style=\"color: #000000;\">P\u00ebrpos sa m\u00eb sip\u00ebr,\u00a0 Presidenti i Republik\u00ebs, e fton Ministrin\u00eb e Arsimit, Sportit dhe Rinis\u00eb, q\u00eb t\u00eb b\u00ebj\u00eb nj\u00eb analiz\u00eb shteruese t\u00eb problematikave q\u00eb kan\u00eb lindur nga zbatimi i ligjit t\u00eb ri nr.80\/2015 \u201cP\u00ebr arsimin e lart\u00eb&#8230;\u201d, dhe n\u00ebp\u00ebrmjet K\u00ebshillit t\u00eb Ministrave t\u2019i propozoj\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb, nj\u00eb nism\u00eb legjislative p\u00ebr plot\u00ebsimin e gjith\u00eb hap\u00ebsirave t\u00eb ligjit, korrigjimin apo qart\u00ebsimin e dispozitave t\u00eb caktuara t\u00eb tij.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Mbi situat\u00ebn e miratimit t\u00eb akteve n\u00ebnligjore n\u00eb zbatim t\u00eb ligjit nr.80\/2015 \u201cP\u00ebr arsimin e lart\u00eb dhe k\u00ebrkimin shkencor n\u00eb institucionet e arsimit t\u00eb lart\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d Konstatohet se t\u00eb gjitha aktet n\u00ebnligjore jan\u00eb nxjerr\u00eb, p\u00ebrtej afatit 9-mujor ku disa prej tyre, jan\u00eb miratuar me nj\u00eb koh\u00eb vonese n\u00eb 28, 25, 19, 17, 16, 10 muaj, pas hyrjes n\u00eb fuqi t\u00eb ligjit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo gjendje \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e drejtp\u00ebrdrejt\u00eb e Ministris\u00eb s\u00eb Arsimit, Sportit dhe Rinis\u00eb, dhe K\u00ebshillit t\u00eb Ministrave, t\u00eb cil\u00ebt me pakujdesin\u00eb dhe neglizhenc\u00ebn e tyre, kan\u00eb sjell\u00eb p\u00ebr pasoj\u00eb q\u00eb dhe q\u00ebllimi i vet\u00eb ligjit nr.80\/2015 t\u00eb mos p\u00ebrmbushet n\u00eb koh\u00ebn e k\u00ebrkuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">Kjo ka sjell\u00eb jo vet\u00ebm shkelje t\u00eb parashikimeve t\u00eb vet\u00eb ligjit, por dhe nj\u00eb paqart\u00ebsi n\u00eb organizimin dhe funksionimin e strukturave akademike dhe administrative, duke krijuar terren p\u00ebr interpretime t\u00eb ndryshme n\u00eb ushtrim t\u00eb detyrave dhe p\u00ebrgjegj\u00ebsive nga strukturat drejtuese t\u00eb institucioneve t\u00eb arsimit t\u00eb lart\u00eb, por dhe nga strukturat mbik\u00ebqyr\u00ebse, t\u00eb cil\u00ebt t\u00eb gjith\u00eb kan\u00eb operuar n\u00eb nj\u00eb terren pa nj\u00eb kuad\u00ebr rregullues t\u00eb fort\u00eb p\u00ebr zbatim.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebto kushte, Ministria e Arsimit, ka p\u00ebrgjegj\u00ebsin\u00eb e saj t\u00eb drejtp\u00ebrdrejt\u00eb n\u00eb mos-nxjerrjen n\u00eb koh\u00ebn e duhur t\u00eb aktit n\u00ebnligjor \u201cP\u00ebr strukturat e brendshme akademike dhe administrative n\u00eb institucionet publike t\u00eb arsimit t\u00eb lart\u00eb\u201d, gj\u00eb e cila ka ndikuar edhe n\u00eb rastin konkret n\u00eb zbatim t\u00eb pa unifikuar t\u00eb ligjit nga strukturat akademike dhe administrative, duke prodhuar konflikt midis tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht vonesa n\u00eb nxjerrjen e k\u00ebtij akti n\u00ebnligjor nga Ministri i Arsimit, Sportit dhe Rinis\u00eb, e b\u00ebn t\u00eb papranuesh\u00ebm edhe p\u00ebr k\u00ebt\u00eb arsye propozimin e tij p\u00ebr shkarkimin e Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, mbi pretendimin se ka tejkaluar kompetencat n\u00eb drejtim edhe t\u00eb administrimit t\u00eb Universitetit t\u00eb Tiran\u00ebs, kjo sepse situata e paqart\u00eb ligjore \u00ebsht\u00eb krijuar nga mosveprimi i vet\u00eb propozuesit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mos nxjerrja e akteve n\u00ebnligjore n\u00eb koh\u00eb ka krijuar terren q\u00eb n\u00eb institucionet e arsimit t\u00eb lart\u00eb, pra edhe n\u00eb Rektoratin e Universitetit t\u00eb Tiran\u00ebs, t\u00eb krijohen situata q\u00eb prodhojn\u00eb konflikte midis strukturave akademike dhe administrative, si n\u00eb rastin konkret q\u00eb kan\u00eb prodhuar kall\u00ebzime penale n\u00eb organin e Prokuroris\u00eb, padi gjyq\u00ebsore n\u00eb Gjykat\u00ebn Administrative, dhe situata ndeshjeje t\u00eb drejtp\u00ebrdrejta me p\u00ebrplasje midis autoriteteve drejtuese akademike dhe administrative ku pal\u00ebt i jan\u00eb referuar dhe e kan\u00eb interpretuar, nj\u00eb her\u00eb, drejtp\u00ebrdrejt ligjin nr.80\/2015 dhe, her\u00eb tjet\u00ebr, aktet e vjetra n\u00ebnligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">K\u00ebt\u00eb mund\u00ebsi p\u00ebr t\u00eb zbatuar aktet n\u00ebnligjore t\u00eb vjetra e jepte neni 142, pika 2 i ligjit nr. 80\/2015, n\u00eb t\u00eb cil\u00ebn parashikohej se, \u201cAktet n\u00ebnligjore, t\u00eb miratuara para hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji dhe q\u00eb nuk bien ndesh me t\u00eb, do t\u00eb zbatohen derisa nuk jan\u00eb miratuar aktet e n\u00ebnligjore t\u00eb parashikuara n\u00eb nenin 139 t\u00eb k\u00ebtij ligji\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb situat\u00eb t\u00eb rr\u00ebmujshme rregulluese, \u00e7do pretendim se p\u00ebrgjegj\u00ebs p\u00ebr shkeljet e ligjit nr.80\/2015 apo akteve n\u00ebnligjore \u00ebsht\u00eb vet\u00ebm Rektori i Universitetit t\u00eb Tiran\u00ebs, nuk \u00ebsht\u00eb aspak objektiv.<\/span><\/p>\n<p><span style=\"color: #000000;\">Propozimi duket sikur k\u00ebrkon ta faturoj\u00eb gjith\u00eb p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr gjendjen e sistemit arsimor tek Rektori i Universitetit, gj\u00eb e cila nuk \u00ebsht\u00eb e drejt\u00eb n\u00eb situat\u00ebn e krijuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Mbi bashk\u00ebpunimin dhe marr\u00ebdh\u00ebniet nd\u00ebrmjet Rektorit t\u00eb UT-s\u00eb, Bordit t\u00eb Administrimit dhe Ministris\u00eb s\u00eb Arsimit, nga shqyrtimi i p\u00ebrmbajtjes s\u00eb akteve, d\u00ebrguar Bordit t\u00eb Administrimit, por dhe nga intensiteti kohor i k\u00ebtij komunikimi, provohet se Rektori i Universitetit t\u00eb Tiran\u00ebs, ka qen\u00eb aktiv dhe ka k\u00ebrkuar gjithmon\u00eb mb\u00ebshtetje apo nd\u00ebrhyrje nga Bordi i Administrimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb pretendimi i Ministris\u00eb s\u00eb Arsimit, i deklaruar edhe n\u00eb takimin me Presidentin e Republik\u00ebs, se Bordi i Administrimit, ka p\u00ebrmbushur \u00e7do k\u00ebrkes\u00eb dhe Rektori nuk ka paraqitur \u00e7\u00ebshtje p\u00ebr trajtim, pran\u00eb tij, jo vet\u00ebm q\u00eb nuk q\u00ebndron, por \u00ebsht\u00eb nj\u00eb deklarim i rrem\u00eb, p\u00ebrball\u00eb autoritetit m\u00eb t\u00eb lart\u00eb t\u00eb shtetit, si\u00e7 \u00ebsht\u00eb Presidenti i Republik\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 N\u00eb lidhje me proceset penale dhe gjyq\u00ebsore t\u00eb filluara nga autoritetet drejtuese t\u00eb Universitetit t\u00eb Tiran\u00ebs, referuar akteve dhe informacionit t\u00eb administruar n\u00eb Institucionin e Presidentit t\u00eb Republik\u00ebs, rezulton se Rektori i UT-s\u00eb, ka paraqitur kall\u00ebzimin penal nr.1787 prot., dat\u00eb 16.04.2018 pran\u00eb Prokuroris\u00eb s\u00eb Krimeve t\u00eb R\u00ebnda p\u00ebr vepr\u00ebn penale t\u00eb shp\u00ebrdorimit t\u00eb detyr\u00ebs n\u00eb bashk\u00ebpunim ndaj t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb grupit t\u00eb pun\u00ebs t\u00eb ngritur me urdhrin nr.77, dat\u00eb 16.02.2018 t\u00eb Ministrit t\u00eb Arsimit, i cili ka hartuar raportin dhe, m\u00eb pas, relacionin ku \u00ebsht\u00eb mb\u00ebshtetur pezullimi nga detyra e Rektorit t\u00eb UT-s\u00eb dhe propozohet shkarkimi i tij, \u00e7\u00ebshtje penale kjo ende n\u00eb hetim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Referuar k\u00ebtyre t\u00eb dh\u00ebnave, \u00ebsht\u00eb e pritshme q\u00eb organi i Prokuroris\u00eb brenda afateve t\u00eb p\u00ebrcaktuara n\u00eb Kodin e Procedur\u00ebs Penale, duhet t\u00eb p\u00ebrfundoj\u00eb hetimet apo verifikimet mbi kall\u00ebzimet e paraqitura, dhe t\u00eb dal\u00eb me nj\u00eb vendim p\u00ebr t\u00eb proceduar me d\u00ebrgimin e \u00e7\u00ebshtjes n\u00eb gjyq dhe vijimin e procedimit penal t\u00eb personave t\u00eb kall\u00ebzuar apo pushimin e akuzave p\u00ebr \u00e7\u00ebshtjet dhe faktet penale, p\u00ebr t\u00eb cilat \u00ebsht\u00eb parashtruar ky kall\u00ebzim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht rezultatet e hetimeve penale dhe t\u00eb dh\u00ebnat q\u00eb mund t\u00eb zbulohen nga k\u00ebto procese, mund t\u00eb ndikojn\u00eb n\u00eb v\u00ebnien n\u00eb pah t\u00eb provave apo rrethanave q\u00eb mb\u00ebshtesin pretendimet qoft\u00eb t\u00eb Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs apo t\u00eb Ministris\u00eb s\u00eb Arsimit, Sportit dhe Rinis\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pik\u00ebrisht kjo p\u00ebrb\u00ebn nj\u00eb shkak tjet\u00ebr q\u00eb propozimi i Ministrit t\u00eb Arsimit, p\u00ebr shkarkimin e Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, n\u00eb situat\u00ebn ligjore dhe faktike t\u00eb parashtruar m\u00eb sip\u00ebr, nuk mund t\u00eb pranohet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, vler\u00ebson se n\u00eb kushtet aktuale, bazuar n\u00eb propozimin e b\u00ebr\u00eb, marrja e nj\u00eb vendimi p\u00ebr shkarkimin e Rektorit t\u00eb Universitetit t\u00eb Tiran\u00ebs, do t\u00eb cenonte r\u00ebnd\u00eb dhe, n\u00eb t\u00ebr\u00ebsi, autonomin\u00eb e institucioneve t\u00eb arsimit t\u00eb lart\u00eb dhe lirin\u00eb akademike t\u00eb vendosur dhe t\u00eb mbrojtur nga Kushtetuta, por dhe nga jurisprudenca e Gjykat\u00ebs Kushtetuese, pasi ushtrimi i kompetencave kontrolluese nga Ministri i Arsimit n\u00eb k\u00ebt\u00eb rast p\u00ebr gjith\u00eb sa u parashtrua m\u00eb sip\u00ebr nuk \u00ebsht\u00eb kryer n\u00eb m\u00ebnyr\u00eb objektive, shteruese, proporcionale dhe transparente.<\/span><\/p>\n<p><span style=\"color: #000000;\">Bazuar n\u00eb k\u00ebt\u00eb arsyetim, Presidenti i Republik\u00ebs me Dekretin nr.11183, dat\u00eb 06.05.2018, ka vendosur ;<\/span><\/p>\n<p><span style=\"color: #000000;\">Rr\u00ebzimin e propozimit nr.4158\/2 prot, dat\u00eb 12.04.2019, t\u00eb Ministrit t\u00eb Arsimit, Sportit dhe Rinis\u00eb, p\u00ebr shkarkimin nga detyra t\u00eb Rektorit t\u00eb
