Kontrolli i Lart\u00eb i Shtetit ka hartuar nj\u00eb raport me gjith\u00eb shkeljet e konstatuara gjat\u00eb auditimit t\u00eb projektit t\u00eb ngritjes s\u00eb nj\u00eb bar-kafe restoranti n\u00eb zon\u00ebn A t\u00eb Butrintit, duke zbardhur p\u00ebrfundimisht t\u00eb v\u00ebrtetat q\u00eb ish-ministrja Mirela Kumbaro dhe vart\u00ebsit e saj u p\u00ebrpoq\u00ebn t\u2019i fshihnin n\u00eb \u00e7do dalje publike, pavar\u00ebsisht disa fakteve dhe provave kompromentuese q\u00eb u shfaq\u00ebn q\u00eb n\u00eb ato vite. Nd\u00ebrkoh\u00eb, KLSH ka sugjeruar t\u00eb kryhet trajtimi i detajuar tekniko-juridik nga ana e Departamentit Juridik dhe Kontrollit t\u00eb Zbatimit t\u00eb Standardeve dhe Etik\u00ebs t\u00eb materialeve t\u00eb evidentuara nga grupi i auditimit p\u00ebr t\u00eb p\u00ebrcjell\u00eb indicie penale, p\u00ebr personat e ngarkuar me funksione ligjore n\u00eb procedur\u00ebn e shqyrtimit\/pranimit t\u00eb projektzbatimit \u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Qytetin Antik t\u00eb Butrintit\u201d<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">\u00a0Kontrata me Hakon<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">\u00a0Gjat\u00eb vitit 2016 \u2013 2017 Ministria e Kultur\u00ebs dhe Instituti i Monumenteve t\u00eb Kultur\u00ebs \u201cGani Strazimiri\u201d kan\u00eb shqyrtuar\/miratuar projektzbatimin \u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Qytetin Antik t\u00eb Butrintit\u201d, mb\u00ebshtetur n\u00eb \u201cPropozim t\u00eb pak\u00ebrkuar\u201d t\u00eb b\u00ebr\u00eb nga subjekti \u201cH\u201d sh.p.k. p\u00ebr marrjen me qira t\u00eb nj\u00eb objekti nd\u00ebrtimi, magazin\u00eb (e cila nuk \u00ebsht\u00eb monument kulture), pran\u00eb Qytetit Antik t\u00eb Butrintit me q\u00ebllim v\u00ebnien e saj n\u00eb shfryt\u00ebzim p\u00ebr aktivitet tregtar bar-kafe-restorant. Vendndodhja e k\u00ebtij objekti \u00ebsht\u00eb n\u00eb Parkun Komb\u00ebtar t\u00eb Butrintit (PKB), n\u00eb n\u00ebnzon\u00ebn \u201cA\u201d, n\u00eb t\u00eb cil\u00ebn zbatohet shkalla e par\u00eb e mbrojtjes. Gjat\u00eb auditimit t\u00eb k\u00ebsaj kontrate, KLSH ka v\u00ebrejtur se n\u00eb p\u00ebrgjith\u00ebsi arsyetimi p\u00ebr miratimin e projektzbatimit \u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Qytetin Antik t\u00eb Butrintit\u201d, bie ndesh me: Ligjin nr. 9048, dat\u00eb 7.4.2003 \u201cP\u00ebr trash\u00ebgimin\u00eb kulturore\u201d- nenin 30 n\u00eb t\u00eb cilin nd\u00ebr t\u00eb tjera \u00ebsht\u00eb p\u00ebrcaktuar se \u2026 Zonat arkeologjike, n\u00eb var\u00ebsi t\u00eb intensitetit dhe r\u00ebnd\u00ebsis\u00eb s\u00eb gjetjeve arkeologjike, kategorizohen n\u00eb zona \u201cA\u201d dhe zona \u201cB\u201d. Zonifikimi miratohet me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave, sipas propozimit t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr trash\u00ebgimin\u00eb kulturore. N\u00eb zonat arkeologjike \u201cA\u201d \u00ebsht\u00eb e ndaluar \u00e7do lloj nd\u00ebrhyrjeje me karakter nd\u00ebrtimor. &#8211; nenin 38 n\u00eb t\u00eb cilin \u00ebsht\u00eb p\u00ebrcaktuar se \u2026 \u00c7do vendim i marr\u00eb nga k\u00ebshillat e rregullimit te territoreve p\u00ebr nd\u00ebrhyrje ose nd\u00ebrtim ne zonat e shpallura monument kulture ose ne zon\u00ebn e mbrojtur pran\u00eb nj\u00eb monumenti kulture, pavar\u00ebsisht nga pron\u00ebsia, \u00ebsht\u00eb i pavlefsh\u00ebm. &#8211; VKM nr. 693, dat\u00eb 10.11.2005 \u201cP\u00ebr shpalljen e kompleksit ligatinor t\u00eb Butrintit \u201cPark Komb\u00ebtar\u201d i ndryshuar me VKM nr. 134, dat\u00eb 20.12.2013, n\u00eb t\u00eb cilin nd\u00ebr t\u00eb tjera \u00ebsht\u00eb p\u00ebrcaktuar se \u2026 N\u00ebnzona qendrore e sh\u00ebnuar n\u00eb hart\u00eb me shkronj\u00ebn \u201cA\u201d me sip\u00ebrfaqe prej 3,980 ha, q\u00eb p\u00ebrcaktohen si n\u00ebnzona me vlera t\u00eb m\u00ebdha p\u00ebr natyr\u00ebn dhe biodiversitetin. N\u00eb k\u00ebt\u00eb zon\u00eb zbatohet shkalla e par\u00eb e mbrojtjes \u2026 etj. &#8211; Kombinimin e p\u00ebrcaktimeve t\u00eb b\u00ebra midis nenit 4, pika 1, shkronja \u201cb\u201d, neni 5, 6 \u2026 t\u00eb ligjit 8906, dat\u00eb 6.6.2002 \u201cP\u00ebr zonat e mbrojtura\u201d i ndryshuar, VKM nr. 693, dat\u00eb 10.11.2005 \u201cP\u00ebr shpalljen e kompleksit ligatinor t\u00eb Butrintit \u201cPark Komb\u00ebtar\u201d ndryshuar me VKM nr. 134, dat\u00eb 20.12.2013 sipas t\u00eb cilit \u2026 n\u00eb PKB n\u00ebnzona qendrore (n\u00eb t\u00eb cilin ndodhet dhe objekti) zbatohet shkalla e par\u00eb e mbrojtjes \u2026 jan\u00eb t\u00eb ndaluara nd\u00ebrtime t\u00eb \u00e7do lloji \u2026 etj. Referuar Ligjit nr. 9048, dat\u00eb 7.4.2003 \u201cP\u00ebr trash\u00ebgimin\u00eb kulturore\u201d, nd\u00ebrtimi \u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Qytetin Antik t\u00eb Butrintit\u201d, nuk p\u00ebrb\u00ebn trash\u00ebgimi kulturore etj, n\u00eb kuptim t\u00eb Ligjit nr. 9048, dat\u00eb 7.4.2003, p\u00ebr rrjedhoj\u00eb, Ministria e Kultur\u00ebs (m\u00eb par\u00eb IMT dhe KKR), duhet ta refuzonin k\u00ebrkes\u00ebn e subjektit \u201cH\u201d sh.p.k. KLSH sugjeron q\u00eb Ministria e Kultur\u00ebs t\u00eb k\u00ebrkoj\u00eb\/anuloj\u00eb kontrat\u00ebn e enfiteoz\u00ebs nr. 360, dat\u00eb 2.6.2017 me objekt \u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Parkun Komb\u00ebtar t\u00eb Butrintit\u201d lidhur me subjektin \u201cH\u201d sh.p.k. me argumentet e m\u00ebsip\u00ebrme.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Indicie penale<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Nga auditimi i kryer n\u00eb Ministrin\u00eb e Kultur\u00ebs n\u00eb baz\u00eb t\u00eb programit t\u00eb auditimit nr. 1264\/2, dat\u00eb 14.12.2017, rezulton se Ministria e Kultur\u00ebs ka shqyrtuar\/miratuar projektzbatimin <em>\u201cP\u00ebr krijimin dhe funksionimin e Qendr\u00ebs Multifunksionale t\u00eb Sh\u00ebrbimeve n\u00eb Qytetin Antik t\u00eb Butrintit\u201d,<\/em> mb\u00ebshtetur kryesisht n\u00eb Udh\u00ebzimin e Ministris\u00eb s\u00eb Kultur\u00ebs nr. 5110, dat\u00eb 13.10.2015 <em>\u201cP\u00ebr dh\u00ebnien me qira dhe m\u00ebnyr\u00ebn e administrimit t\u00eb monumenteve t\u00eb kultur\u00ebs me q\u00ebllim rijet\u00ebzimi\u201d<\/em> i ndryshuar, n\u00eb p\u00ebrgjigje t\u00eb nj\u00eb <em>\u201cPropozim t\u00eb pak\u00ebrkuar\u201d<\/em> t\u00eb b\u00ebr\u00eb nga subjekti \u201cH\u201d sh.p.k. p\u00ebr marrjen me qira t\u00eb nj\u00eb objekti nd\u00ebrtimi, magazin\u00eb (e cila nuk \u00ebsht\u00eb monument kulture), pran\u00eb Qytetit Antik t\u00eb Butrintit me q\u00ebllim v\u00ebnien e saj n\u00eb shfryt\u00ebzim p\u00ebr aktivitet tregtar bar &#8211; kafe- restorant.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-271439\" src=\"https:\/\/hashtag.al\/wp-content\/uploads\/2019\/02\/punime.jpg\" alt=\"\" width=\"1000\" height=\"750\" srcset=\"https:\/\/www.hashtag.al\/wp-content\/uploads\/2019\/02\/punime.jpg 1000w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2019\/02\/punime-300x225.jpg 300w, https:\/\/www.hashtag.al\/wp-content\/uploads\/2019\/02\/punime-768x576.jpg 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p><span style=\"color: #000000;\">Vendndodhja e k\u00ebtij objekti \u00ebsht\u00eb n\u00eb Parkun Komb\u00ebtar t\u00eb Butrintit (PKB), n\u00eb n\u00ebnzon\u00ebn \u201cA\u201d, n\u00eb t\u00eb cil\u00ebn zbatohet shkalla e par\u00eb e mbrojtjes. Nd\u00ebrkoh\u00eb, nga verifikimi ligjshm\u00ebris\u00eb mbi t\u00eb cil\u00ebn ka operuar Ministria e Kultur\u00ebs p\u00ebr miratimin e k\u00ebtij projekti, KLSH vler\u00ebson se nxjerrja nga Ministria e Kultur\u00ebs t\u00eb Udh\u00ebzimit nr. 5110, dat\u00eb 13.10.2015 2015 <em>\u201cP\u00ebr dh\u00ebnien me qira dhe m\u00ebnyr\u00ebn e administrimit t\u00eb monumenteve t\u00eb kultur\u00ebs me q\u00ebllim rijet\u00ebzimi\u201d<\/em> i ndryshuar, \u00ebsht\u00eb b\u00ebr\u00eb pa pasur autorizim nga Ligji nr. 9048, dat\u00eb 7.4.2003, <em>\u201cP\u00ebr trash\u00ebgimin\u00eb kulturore\u201d<\/em>, p\u00ebr t\u00eb rregulluar dhe plot\u00ebsuar procedur\u00ebn e dh\u00ebnies me qira\/enfiteoz\u00eb si dhe m\u00ebnyr\u00ebn e administrimit t\u00eb monumenteve t\u00eb kultur\u00ebs, si i till\u00eb, nuk ka asnj\u00eb fuqi juridike. <\/span><\/p>\n<p><span style=\"color: #000000;\">KLSH konstaton po ashtu se kontrata e enfiteoz\u00ebs nr. 3681, dat\u00eb 02.06.2017, t\u00eb lidhur nd\u00ebrmjet subjektit \u201cH\u201d sh.p.k dhe Ministris\u00eb s\u00eb Kultur\u00ebs, nuk \u00ebsht\u00eb b\u00ebr\u00eb me akt noterial dhe nuk \u00ebsht\u00eb regjistruar n\u00eb ZVRPP., n\u00eb referenc\u00eb t\u00eb p\u00ebrcaktimeve t\u00eb b\u00ebra n\u00eb nenet 786 dhe 83 t\u00eb Kodit Civil, p\u00ebr rrjedhoj\u00eb kontrata \u00ebsht\u00eb e pavlefshme dhe nuk ka asnj\u00eb fuqi juridike.<em> \u201cKa pasakt\u00ebsi n\u00eb p\u00ebrcaktimin e sip\u00ebrfaqes s\u00eb sakt\u00eb t\u00eb pron\u00ebs n\u00eb m2 , e cila \u00e7on automatikisht n\u00eb pamund\u00ebsin\u00eb e llogaritjes s\u00eb sakt\u00eb t\u00eb vler\u00ebs s\u00eb detyrimit mujor. Nuk \u00ebsht\u00eb p\u00ebrcaktuar qart\u00eb vlera e investimit. Ekziston mosp\u00ebrputhjeve nd\u00ebrmjet afateve t\u00eb Plan Biznesit, Kontrat\u00ebs s\u00eb Enfiteoz\u00ebs lidhur midis pal\u00ebve, afatit t\u00eb koh\u00ebzgjatjes s\u00eb punimeve etj\u201d,<\/em> thot\u00eb raporti i KLSH.
