k\u00ebrkesat e tyre, Meta ka arritur n\u00eb p\u00ebrfundimin se hartimi projektit p\u00ebr Unaz\u00ebn e Madhe \u00ebsht\u00eb kryer n\u00eb munges\u00eb t\u00eb plot\u00eb t\u00eb konsultimit publik dhe transparenc\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em>\u201cPresidenti i Republik\u00ebs, vler\u00ebson se kjo sjellje e institucioneve publike p\u00ebr mosdh\u00ebnien e informacionit t\u00eb k\u00ebrkuar nga Kreu i Shtetit \u00ebsht\u00eb jasht\u00eb \u00e7do llogjike normale t\u00eb funksionimit t\u00eb institucioneve shtet\u00ebrore n\u00eb nj\u00eb vend demokratik.\u201d,<\/em> thuhet n\u00eb njoftim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sipas Met\u00ebs, gjat\u00eb procesit ka patur nj\u00eb s\u00ebr\u00eb shkeljesh ligjore, q\u00eb nga \u201cShqiponja\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, sot ka pritur nj\u00eb p\u00ebrfaq\u00ebsi t\u00eb banor\u00ebve t\u00eb Unaz\u00ebs se Madhe, t\u00eb cil\u00ebt i kan\u00eb parashtruar atij t\u00eb gjitha shqet\u00ebsimet dhe kund\u00ebrshtimet e tyre, si dhe i kan\u00eb v\u00ebn\u00eb n\u00eb dispozicion t\u00eb dh\u00ebna t\u00eb cilat hedhin m\u00eb shum\u00eb drit\u00eb mbi problematikat p\u00ebr realizimin e k\u00ebtij projekti.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs n\u00eb q\u00ebndrimet e Tij publike, q\u00eb prej dat\u00ebs 14 n\u00ebntor 2018 e n\u00eb vijim\u00ebsi, i ka k\u00ebrkuar autoriteteve p\u00ebrgjegj\u00ebse q\u00eb:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0T\u00eb tregojn\u00eb p\u00ebrgjegjshm\u00ebri p\u00ebr trajtimin e k\u00ebtij rasti;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0T\u00eb b\u00ebjn\u00eb transparenc\u00eb t\u00eb plot\u00eb p\u00ebr t\u00eb gjith\u00eb procesin e m\u00eb jetike t\u00eb qytetar\u00ebve q\u00eb preken.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0T\u00eb tregojn\u00eb p\u00ebrgjegjshm\u00ebri n\u00eb respektimin e plot\u00eb t\u00eb t\u00eb drejtave dhe lirive themelore t\u00eb njeriut t\u00eb cilat g\u00ebzojn\u00eb nj\u00eb mbrojtje t\u00eb ve\u00e7ant\u00eb nga Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidentit t\u00eb Republik\u00ebs i jan\u00eb paraqitur n\u00eb m\u00ebnyr\u00eb t\u00eb vazhduar peticione me shkrim, ankesa, dhe t\u00eb dh\u00ebna t\u00eb tjera nga banor\u00ebt e zon\u00ebs s\u00eb Unaz\u00ebs s\u00eb Re n\u00ebp\u00ebrmjet t\u00eb cilave ata paraqesin kund\u00ebrshtimet e tyre p\u00ebr realizimin e k\u00ebtij projekti n\u00eb form\u00ebn q\u00eb \u00ebsht\u00eb miratuar ku denoncojn\u00eb problematikat e theksuara ligjore t\u00eb realizimit t\u00eb k\u00ebtij projekti nga autoritetet p\u00ebrkat\u00ebse publike.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, n\u00eb dat\u00ebn 14 n\u00ebntor 2018,\u00a0i ka k\u00ebrkuar\u00a0Avokatit t\u00eb Popullit q\u00eb t\u00eb angazhohet edhe m\u00eb shum\u00eb n\u00eb verifikimin e gjith\u00eb procedurave dhe sjelljes s\u00eb autoriteteve publike mbi k\u00ebt\u00eb \u00e7\u00ebshtje.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, ka ndjekur me v\u00ebmendje gjithashtu edhe denoncimin publik, si dhe debatin pasues mbi rastin e fallsifikimeve t\u00eb dokumentave zyrtar\u00eb t\u00eb institucioneve t\u00eb larta t\u00eb Shteteve t\u00eb Bashkuara t\u00eb Amerik\u00ebs, nga nj\u00eb kompani fantaz\u00ebm shqiptare dhe m\u00ebnyr\u00ebn se si kjo kompani kishte arritur t\u00eb fitonte disa kontrata publike me shtetin shqiptar, ku p\u00ebrfshihet edhe realizimi i punimeve n\u00eb zon\u00ebn e Unaz\u00ebs s\u00eb Re Astirit sipas projektit p\u00ebr nd\u00ebrtimin e segmentit rrugor sipas projektit\u00a0\u201cRehabilitimi i segmentit rrugor mbikalimi i Pallatit me Shigjeta \u2013 Rrethrrotullimi i sheshit \u201cShqiponja\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Institucioni\u00a0 i Presidenti i Republik\u00ebs, m\u00eb dat\u00eb 06 dhjetor 2018 i ka p\u00ebrcjell\u00eb Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm p\u00ebr ndjekje dhe vler\u00ebsim prej k\u00ebtij organi shqet\u00ebsimet e paraqitura nga disa qytetar\u00eb Shqiptaro-Amerikan n\u00eb lidhje me dhun\u00ebn dhe presionin psikologjik t\u00eb ushtruar nga autoritetet shtet\u00ebrore p\u00ebrkundrejt c\u00ebnimit t\u00eb t\u00eb drejtave t\u00eb tyre t\u00eb pron\u00ebsis\u00eb q\u00eb preken nga ky projekt.<\/span><\/p>\n<p><span style=\"color: #000000;\">Presidenti i Republik\u00ebs, n\u00eb zbatim t\u00eb kompetencave Kushtetuese t\u00eb parashikuara n\u00eb nenin 92\/h, t\u00eb Kushtetut\u00ebs, m\u00eb dat\u00eb 19 n\u00ebntor 2018, me shkres\u00eb zyrtare i ka k\u00ebrkuar informacion dhe t\u00eb dh\u00ebna me shkrim drejtuesve t\u00eb institucioneve shtet\u00ebrore p\u00ebr \u00e7\u00ebshtjet q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me detyrat e tyre n\u00eb lidhje me k\u00ebt\u00eb projekt. Konkretisht i \u00ebsht\u00eb k\u00ebrkuar informacion k\u00ebtyre institucioneve:<\/span><\/p>\n<p><span style=\"color: Informale<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Zyr\u00ebs Q\u00ebndrore t\u00eb Regjistrimit t\u00eb Pasurive t\u00eb Paluajtshme<\/span><\/p>\n<p><span style=\"color: #000000;\">Disa nga k\u00ebto institucione edhe sot m\u00eb dat\u00eb\u00a003.02.2019,\u00a0kur kan\u00eb\u00a0kaluar m\u00eb shum\u00eb se 75 dit\u00eb\u00a0nga k\u00ebrkesa fillestare e Presidentit, nuk kan\u00eb kthyer ende nj\u00eb p\u00ebrgjigje mbi informacionin e k\u00ebrkuar, edhe pse k\u00ebrkesa e Presidentit \u00ebsht\u00eb rip\u00ebrs\u00ebritur n\u00eb adres\u00eb t\u00eb tyre.<\/span><\/p>\n<p><span style=\"color: #000000;\">Institucionet q\u00eb nuk kan\u00eb dh\u00ebn\u00eb informacion ndaj Presidentit t\u00eb Republik\u00ebs, dhe nuk kan\u00eb kthyer nj\u00eb p\u00ebrgjigje konform k\u00ebrkes\u00ebs jan\u00eb :<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Agjencia e Legalizimit, Urbanizimit\/Integrimit t\u00eb Nd\u00ebrtimeve\/Zonave Informale<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Zyra Q\u00ebndrore e Regjistrimit t\u00eb Pasurive t\u00eb Paluajtshme<\/span><\/p>\n<p><span style=\"color: pasi kan\u00eb shmangur zbatimin dhe detyrimin kushtetues dhe ligjor me mosdh\u00ebnien e informacionit ndaj Presidentit t\u00eb Republik\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mosdh\u00ebnia e informacionit ndaj Presidentit t\u00eb Republik\u00ebs, i cili \u00ebsht\u00eb k\u00ebrkuar n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrs\u00ebritur prej Tij, forcon bindjen se, k\u00ebtij projekti i ka munguar q\u00ebllimisht transparenca n\u00eb \u00e7do hallk\u00eb t\u00eb procesit n\u00eb kund\u00ebrshtim me rendin kushtetues dhe juridik t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">PROBLEMATIKA E KONSTATUAR NGA PRESIDENTI REPUBLIK\u00cbS<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Nga gjith\u00eb informacioni q\u00eb \u00ebsht\u00eb administruar deri m\u00eb tani dhe i \u00ebsht\u00eb v\u00ebn\u00eb n\u00eb dispozicion Kreut t\u00eb Shtetit, Presidenti i Republik\u00ebs, ka arritur n\u00eb bindjen se projekti p\u00ebr\u00a0\u201cRehabilitimin e segmentit rrugor mbikalimi i Pallatit me Shigjeta \u2013 Rrethrrotullimi i sheshit \u201cShqiponja\u201d, paraqet shkelje t\u00eb shumta ligjore t\u00eb cilat k\u00ebrkojn\u00eb detyrimisht nj\u00eb rishikim t\u00eb plot\u00eb dhe t\u00eb menj\u00ebhersh\u00ebm t\u00eb vendimarrjes shtet\u00ebrore n\u00eb m\u00ebnyr\u00eb q\u00eb ky projekt\u00a0t\u00eb realizohet p\u00ebrkundrejt nj\u00eb zgjidhjeje t\u00eb drejt\u00eb dhe t\u00eb arsyeshme n\u00eb interesin m\u00eb t\u00eb mir\u00eb publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Konkretisht, Presidenti\u00a0 i Republik\u00ebs konstaton se:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Hartimi i k\u00ebtij projekti \u00ebsht\u00eb kryer n\u00eb munges\u00eb t\u00eb plot\u00eb t\u00eb konsultimit publik dhe transparenc\u00ebs. ARRSH n\u00eb lidhje me ket\u00eb konstatim justifikohet se, nuk ka kryer konsultim publik pasi ky segment rrugor nuk i n\u00ebnshtrohet vler\u00ebsimit mjedisor t\u00eb thelluar n\u00eb kushtet kur ky segment rrugor \u00ebsht\u00eb me gjat\u00ebsi m\u00eb t\u00eb vog\u00ebl se 10 km.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Ky vler\u00ebsim i ARRSH-s\u00eb \u00ebsht\u00eb spekullativ dhe i gabuar pasi segmenti rrugor \u201cPallati me Shigjeta \u2013 Rrethrrotullimi i sheshit \u201cShqiponja\u201d \u00ebsht\u00eb pjes\u00eb integrale e projektit t\u00eb \u201cUnaz\u00ebs s\u00eb Madhe t\u00eb Tiran\u00ebs\u201d i cili n\u00eb t\u00ebr\u00ebsin\u00eb e tij ka nj\u00eb gjat\u00ebsi 27 km.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Pamund\u00ebsia financiare shtet\u00ebrore p\u00ebr t\u00eb realizuar nj\u00eb projekt t\u00ebr\u00ebsor duke i ndar\u00eb dhe financuar ato vit pas viti me lote dhe t\u00eb fragmentarizuar, nuk mund t\u00eb p\u00ebrb\u00ebj\u00eb kurr\u00ebsesi shkak ligjor p\u00ebr t\u00eb shmangur procesin e konsultimit publik, kur nj\u00eb gj\u00eb e till\u00eb \u00ebsht\u00eb e detyrueshme me ligj.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0P\u00ebr m\u00eb tep\u00ebr, ky projekt duhet t\u00eb p\u00ebrfshinte jo vet\u00ebm vler\u00ebsimin mjedisor t\u00eb detyruesh\u00ebm sipas ligjit, por edhe vler\u00ebsimin socialo-ekonomik, pasi efektet q\u00eb sjell implementimi i tij prekin veprimtarin\u00eb t\u00ebr\u00ebsore t\u00eb qytetit t\u00eb Tiran\u00ebs dhe n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00ebp\u00ebrdrejt\u00eb interesat jetik\u00eb t\u00eb banor\u00ebve t\u00eb k\u00ebsaj zone.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Veprimi i ARRSH p\u00ebr t\u00eb hartuar nj\u00eb Projekt Rehabilitimi p\u00ebr k\u00ebt\u00eb segment rrugor, pa kryer nj\u00eb konsultim publik t\u00eb hapur me banor\u00ebt si pal\u00eb t\u00eb interesuar, p\u00ebrve\u00e7 se \u00ebsht\u00eb nj\u00eb shkelje e ligjit dhe akteve n\u00ebnligjore, krijon bindjen se \u00ebsht\u00eb kryer me q\u00ebllim p\u00ebr t\u00eb shmangur d\u00ebgjesat publike dhe opinionet q\u00eb mund t\u00eb paraqiteshin n\u00eb funksion t\u00eb p\u00ebrmir\u00ebsimit t\u00eb projektit n\u00eb t\u00eb gjitha aspektet.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Rezulton se, projekti i\u00a0\u201cStudim projektim rehabilitimi i segmentit rrugor Pallati me Shigjeta \u2013 Rrethrrotullimi Shqiponja\u201d,\u00a0\u00ebsht\u00eb hartuar nga nj\u00eb kompani private konsulence, pa gar\u00eb dhe me k\u00ebrkes\u00eb t\u00eb ARRSH-s\u00eb n\u00ebp\u00ebrmjet nj\u00eb kontrate sponsorizimi t\u00eb lidhur m\u00eb dat\u00eb 25 maj 2018. Kjo praktik\u00eb e ndjekur nga ARRSH, \u00ebsht\u00eb n\u00eb kund\u00ebrshtim t\u00eb plot\u00eb me ligjin p\u00ebr prokurimin publik dhe parimet q\u00eb udh\u00ebheqin konkurenc\u00ebn e lir\u00eb dhe t\u00eb ndershme.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0N\u00ebse hartimi i k\u00ebtij projekti do t\u00eb ishte realizuar me nj\u00eb gar\u00eb me procedura t\u00eb hapura dhe transparente, mund t\u00eb ishin administruar propozime teknike, zgjidhje, apo ide alternative objektive dhe konkuruese. N\u00eb ket\u00eb m\u00ebnyr\u00eb, investimi p\u00ebr k\u00ebt\u00eb vep\u00ebr publike do t\u00eb mund t\u00eb realizohej me kosto m\u00eb efi\u00e7ente p\u00ebr buxhetin e shtetit, si dhe me impakt sa m\u00eb t\u00eb pranuesh\u00ebm social dhe ekonomik p\u00ebr qytetar\u00ebt.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0P\u00ebrzgjedhja e nj\u00eb procedure sponsorizimi me arsyetimin se \u00ebsht\u00eb kursyer buxheti i shtetit, \u00ebsht\u00eb vet\u00ebm nj\u00eb alibi. Nj\u00eb projekt i dhuruar krijon rrezik q\u00eb p\u00ebrllogaritja e impaktit social dhe ekonomik t\u00eb mos jet\u00eb n\u00eb v\u00ebmendjen e zbatuesit t\u00eb detyr\u00ebs s\u00eb projektimit, duke rritur n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb koston e investimit p\u00ebr vepr\u00ebn publike.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Ky projekt i dhuruar, pa gar\u00eb dhe i pakonsultuar me publikun nuk reflekton shqet\u00ebsimet dhe interesat e komunitetit dhe gjith\u00eb pal\u00ebve t\u00eb interesuara, duke qen\u00eb se nuk parashikon objektivisht p\u00ebrllogaritjen e kostove q\u00eb burojn\u00eb nga problemet sociale dhe ekonomike q\u00eb krijohen nga shembja e banesave, pron\u00ebs s\u00eb qytetar\u00ebve, si dhe nga proceset gjyq\u00ebsore q\u00eb mund t\u00eb lindin si pasoj\u00eb e gjith\u00eb veprimeve arbitrare t\u00eb administrat\u00ebs publike n\u00eb k\u00ebt\u00eb drejtim.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nga informacioni i shtator 2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Procesi i tenderimit nga ARRSH p\u00ebr nd\u00ebrtimin e k\u00ebsaj vepre publike \u00ebsht\u00eb hapur\u00a0shtator 2018\u00a0dhe fituesi \u00ebsht\u00eb p\u00ebrzgjedhur dhe njoftuar n\u00eb buletinin publik, nr.44,\u00a0dat\u00eb 5 n\u00ebntor 2018, nd\u00ebrkoh\u00eb q\u00eb zhvillimi i k\u00ebsaj vepre \u00ebsht\u00eb miratuar nga K\u00ebshillit Komb\u00ebtar i Territorrit\u00a0vet\u00ebm m\u00eb dat\u00eb\u00a020 n\u00ebntor t\u00eb ligjit nr.107\/2014 \u201cP\u00ebr planifikimin dhe zhvillimin e terrirorit\u201d, dhe nenit 9, 10\/1, t\u00eb VKM nr. 408\/2018 \u201cP\u00ebr miratimin e rregullores s\u00eb zhvillimit t\u00eb territorit\u201d, i ndryshuar n\u00eb rastin konkret autoriteti p\u00ebrgjegj\u00ebs sipas ligjit q\u00eb miraton me Vendim, Projektiden\u00eb mbi m\u00ebnyr\u00ebn se si nj\u00eb pjes\u00eb e territorit dhe nj\u00eb rrug\u00eb e k\u00ebsaj kategorie do t\u00eb zhvillohet, \u00ebsht\u00eb K\u00ebshilli Komb\u00ebtar i Territorit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Hapja e procedurave t\u00eb tenderimit, pa nj\u00eb vendim t\u00eb autoritetit vendimarr\u00ebs p\u00ebr miratimin ligjor t\u00eb projektit K\u00ebshilli Komb\u00ebtar i Territorit, p\u00ebrve\u00e7 se \u00ebsht\u00eb shkelje e r\u00ebnd\u00eb ligjore, krijon bindjen se ky proces ka qen\u00eb selektiv, i paracaktuar dhe n\u00eb kushte ekstreme t\u00eb kap\u00ebrcimit me dashje direkte t\u00eb procedurave t\u00eb detyrueshme ligjore.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nd\u00ebrkoh\u00eb n\u00eb zbatim t\u00eb ligjit nr.10164, dt 15.10.2009 \u201cP\u00ebr Autoritetin Rrugor Shqiptar\u201d, K\u00ebshilli Teknik i ARRSH-s\u00eb nuk parashikohet si institucion vendimarr\u00ebs i ARRSH-s\u00eb, dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb vendimet e marra prej tij nuk kan\u00eb fuqi detyruese.<\/span><\/p>\n<p><span style=\"color: Rrug\u00ebve dhe Akseve Komb\u00ebtare t\u00eb k\u00ebsaj r\u00ebnd\u00ebsie.\u00a0Kjo \u00ebsht\u00eb dhe arsyeja q\u00eb K\u00ebshilli Teknik e ka miratuar k\u00ebt\u00eb projekt n\u00eb parim.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nd\u00ebrkoh\u00eb, \u00ebsht\u00eb denoncuar dhe faktuar publikisht, procedurat e prokurimit q\u00eb ka zhvilluar ARRSH jan\u00eb shum\u00eb problematike sepse realizimi i k\u00ebtij projekti \u00ebsht\u00eb ndar\u00eb subjektivisht n\u00eb 3-lote t\u00eb ve\u00e7anta.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Ky fakt \u00a0krijon bindjen se ndarja n\u00eb 3 lote \u00ebsht\u00eb b\u00ebr\u00eb me q\u00ebllim fragmentarizimin e fondeve n\u00eb dispozicion, ruajtjen e kufijve monetar\u00eb me q\u00ebllim shmangien e kompanive nd\u00ebrkomb\u00ebtare n\u00eb k\u00ebt\u00eb proces tenderimi, si dhe \u00e7do veprim \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me ligjin p\u00ebr prokurimin publik dhe rregullat e miratuara nga K\u00ebshilli i Ministrave p\u00ebr k\u00ebt\u00eb fush\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si\u00e7 \u00ebsht\u00eb faktuar publikisht konkurimi n\u00eb t\u00eb tre lotet ka qen\u00eb fiktiv. N\u00eb \u00e7do lot kan\u00eb konkuruar dy kompani, ku e nj\u00ebjta kompani n\u00eb t\u00eb tre lotet ka dh\u00ebn\u00eb ofert\u00eb ekonomike me vler\u00eb zero! Kjo provon qartazi realizimin e nj\u00eb procesi tenderimi t\u00eb trukuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nj\u00eb nga kompanit\u00eb fituese t\u00eb tenderit (DH Albania) ka rezultuar nj\u00eb kompani e krijuar rishtazi me nj\u00eb historik fiktiv dhe me dokumenta t\u00eb paraqitura t\u00eb fallsifikuara, \u00e7ka ka detyruar ARRSH-n\u00eb dhe Ministrin\u00eb e Insfrasktruktur\u00ebs q\u00eb pas publikimit t\u00eb skandaleve n\u00eb k\u00ebt\u00eb drejtim dhe konfirmimit publik t\u00eb fakteve t\u00eb fallsifikuara nga autoritetet Amerikane t\u00eb zgjidhin n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebanashme kontrat\u00ebn.<\/span><\/p>\n<p><span style=\"color: #000000;\">Vendimarrja e qeveris\u00eb dhe ARRSH-s\u00eb, p\u00ebr t\u00eb rihapur procesin e tenderimit p\u00ebr realizimin e k\u00ebsaj vepre, pas zgjidhjes s\u00eb kontrat\u00ebs p\u00ebr k\u00ebt\u00eb segment rrugor, e krahasuar kjo me faktet e denoncuara publikisht,vler\u00ebsohet si nj\u00eb veprim i nxituar dhe aspak objektiv. Kjo sepse, aktualisht organi i Prokuroris\u00eb \u00ebsht\u00eb duke kryer hetime n\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje, dhe nga ky hetim mund t\u00eb zbulohen fakte dhe rrethana t\u00eb cilat mund t\u00eb sjellin pasoja t\u00eb drejt\u00ebp\u00ebrdrejta q\u00eb ndikojn\u00eb n\u00eb m\u00ebnyr\u00ebn se si kjo vep\u00ebr duhet realizuar.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0ARRSH, referuar nenit 78, Kodit t\u00eb Procedurave Administrative n\u00eb kushtet kur Prokuroria ishte\/\u00ebsht\u00eb duke hetuar duhet t\u00eb kishte pezulluar t\u00eb gjitha veprimet p\u00ebr zhvillimin e nj\u00eb tenderi t\u00eb ri, me q\u00ebllim q\u00eb t\u00eb shmangte \u00e7do mund\u00ebsi p\u00ebr shkaktimin e nj\u00eb d\u00ebmi t\u00eb pariparuesh\u00ebm mbi interesat publike, apo t\u00eb mbulimit t\u00eb fakteve dhe rrethanave q\u00eb pengojn\u00eb zbulimin e s\u00eb v\u00ebrtet\u00ebs.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Rezulton se K\u00ebshilli Komb\u00ebtar i Territorit, ka shqyrtuar propozimin e ARRSH, dhe me\u00a0Vendimin nr.1, dat\u00eb 20.11.2018,\u00a0ka miratuar\u00a0vet\u00ebm Lejen Zhvillimore\u00a0\u201cRabilitimi i Segmentit Rrugor \u201cMbikalimi i Pallatit me Shigjeta, rrethrrotullimi Shqiponja, Bashkia Tiran\u00eb\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">Rezulton se vet\u00ebm 1 (nj\u00eb) dit\u00eb pasi Presidenti i Republik\u00ebs ka k\u00ebrkuar informacion shkresor mbi k\u00ebt\u00eb \u00e7\u00ebshtje, K\u00ebshilli Komb\u00ebtar i Territorit, mblidhet p\u00ebr miratimin e vendimit p\u00ebr t\u00eb p\u00ebrcaktuar si do t\u00eb zhvillohej ky projekt.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nga informacioni q\u00eb jepet nga Agjencia e Zhvillimit t\u00eb Territorit, Leja e Zhvillimit e miratuar m\u00eb dt 20 n\u00ebntor 2018, \u00ebsht\u00eb dh\u00ebn\u00eb pa nj\u00eb informacion t\u00eb plot\u00eb dhe t\u00eb sakt\u00eb mbi statusin e pron\u00ebsis\u00eb s\u00eb pasurive t\u00eb paluajtshme mbi t\u00eb cilat do t\u00eb nd\u00ebrtohet vepra.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Sipas k\u00ebrkesave t\u00eb ligjit nr. 107\/2014 \u201cP\u00ebr planifikimin dhe zhvillimin e territorit\u201d, dhe VKM nr. 408\/2018 \u201cP\u00ebr miratimin e rregullores s\u00eb zhvillimit t\u00eb territorit\u201d, i ndryshuar, informacioni mbi statusin e pron\u00ebsis\u00eb dhe rregullimi i marr\u00ebdh\u00ebnieve n\u00eb truallin objekt nd\u00ebrtimi \u00ebsht\u00eb nj\u00eb k\u00ebrkes\u00eb e detyrueshme p\u00ebr zbatim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Rezulton se, K\u00ebshilli Komb\u00ebtar i Territorit me urgjenc\u00eb ka miratuar n\u00eb dat\u00eb 20.11.2018, Lejen e Zhvillimit p\u00ebr k\u00ebt\u00eb projekt, pa verifikuar statusin e pron\u00ebsis\u00eb t\u00eb pasurive ku shtrihet ky projekt.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Leja e Zhvillimit dhe informacion i sakt\u00eb mbi t\u00eb drejtat pron\u00ebsore q\u00eb prekeshin nga ky projekt do t\u00eb sh\u00ebrbenin p\u00ebr nisjen e procedurave t\u00eb shpron\u00ebsimit p\u00ebr interes publik.<\/span><\/p>\n<p><span style=\"color: #000000;\">Nd\u00ebrkoh\u00eb q\u00eb autoritetet publike kan\u00eb realizuar nd\u00ebrhyrje p\u00ebr prishjen e objekteve n\u00eb terren, pa ndjekur procedurat ligjore dhe pa asnj\u00eb njoftim paraprak zyrtar, duke sjell\u00eb nj\u00eb situat\u00eb tensioni dhe pasigurie jetike tek secili prej banor\u00ebve t\u00eb prekur nga ky projekt.<\/span><\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, jan\u00eb shkelur r\u00ebnd\u00eb dhe me kok\u00ebfort\u00ebsi t\u00eb drejtat themelore kushtetuese t\u00eb njeriut. P\u00ebr m\u00eb tep\u00ebr, kjo sjellje presioni, intimidimi mbi banor\u00ebt, familjar\u00ebt dhe f\u00ebmij\u00ebt e tyre kan\u00eb shkaktuar trauma psikologjike me pasoja sh\u00ebndetsore dhe sociale.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Vendimi i K\u00ebshillit Komb\u00ebtar t\u00eb Territorit (KKT) i dat\u00ebs 20 n\u00ebntor 2018, p\u00ebr dh\u00ebnien e Lejes s\u00eb Zhvillimit, sipas ligjit nr.107\/2014, duhet t\u00eb pasohej me dh\u00ebnien e Lejes s\u00eb Nd\u00ebrtimit.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Leja e Nd\u00ebrtimit \u00ebsht\u00eb akti i vet\u00ebm sipas ligjit q\u00eb legjitimon fillimin e punimeve dhe ky akt n\u00eb rastin konkret duhet t\u00eb l\u00ebshohet nga K\u00ebshilli Komb\u00ebtar i Territorit. Punime si heqja e simbolit Shqiponja n\u00eb Rrethrrotulimin me t\u00eb nj\u00ebjtin em\u00ebr, heqja e trafikndar\u00ebsve n\u00eb gjith\u00eb segmentin rrugor, heqja e ndri\u00e7imit dhe e pem\u00ebve, g\u00ebrmime, etj. K\u00ebto nd\u00ebrhyrje p\u00ebrb\u00ebjn\u00eb shkak edhe p\u00ebr aksidente t\u00eb mundshme automobilistike, me pasoja p\u00ebr jet\u00ebn dhe sh\u00ebndetin e qytetar\u00ebve.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pra nj\u00eb t\u00ebr\u00ebsi punimesh jan\u00eb kryer n\u00eb munges\u00eb t\u00eb Lejes s\u00eb Nd\u00ebrtimit p\u00ebr k\u00ebt\u00eb projekt, gj\u00eb e cila \u00ebsht\u00eb nj\u00eb tjet\u00ebr shkelje e r\u00ebnd\u00eb p\u00ebr ARRSH-n\u00eb si autoritet zhvillues i projektit dhe i gjith\u00eb strukturave t\u00eb tjera q\u00ebndrore dhe vendore q\u00eb monitorojn\u00eb dhe ruajn\u00eb zhvillimet dhe nd\u00ebrtimet n\u00eb territor (IKMT, IMT Tiran\u00eb, Policia Bashkiake, Policia e Shtetit).<\/span><\/p>\n<p><span style=\"color: #000000;\">Procedurat e shpron\u00ebsimit p\u00ebr interes publik n\u00eb momentin e denoncimit t\u00eb skandalit mbi procedurat e tenderimit t\u00eb k\u00ebtij projekti nuk kishin filluar ende nga Ministria e Infrastruktur\u00ebs dhe Energjis\u00eb. Edhe sot m\u00eb dat\u00eb 3 shkurt 2019 procedurat e shpron\u00ebsimit nuk kan\u00eb p\u00ebrfunduar.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb t\u00eb gjitha njoftimet jo zyrtare, veprimet, dhe nd\u00ebrhyrjet, pa akt t\u00eb shkruar dhe zyrtar t\u00eb autoriteve publike p\u00ebrkundrejt pronar\u00ebve dhe banesave t\u00eb tyre, me q\u00ebllim vendosjen e tyre n\u00eb presion se pronat e tyre do t\u00eb prisheshin, \u00ebsht\u00eb i pajustifikuar dhe abuziv. T\u00eb gjitha k\u00ebto veprime bien n\u00eb kund\u00ebrshtim t\u00eb hapur me nenet 41, 42 t\u00eb Kushtetut\u00ebs dhe legjislacionit t\u00eb brendsh\u00ebm t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nga informacioni i siguruar rezulton se nga ky projekt preken nj\u00eb num\u00ebr i lart\u00eb nd\u00ebrtesash nd\u00ebrmjet t\u00eb cilave mbi 120 objekte pa dokumentacion pron\u00ebsie t\u00eb cil\u00ebt jan\u00eb n\u00eb proces legalizimi.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Procesi i trajtimit t\u00eb k\u00ebtyre objekteve sipas ligjit t\u00eb legalizimit \u00ebsht\u00eb t\u00ebr\u00ebsisht jasht\u00eb cdo llogjike t\u00eb funksionimit t\u00eb shtetit ligjor,\u00a0pasi ka nj\u00eb munges\u00eb t\u00eb theksuar t\u00eb transparenc\u00ebs n\u00eb k\u00ebt\u00eb drejtim.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Nga ankesat e parashtruara p\u00ebrpara Presidentit nga banor\u00ebt, rezulton se ALUIZNI ka skualifikuar, nga procesi i legalizimit shum\u00eb objekte informale, duke e bazuar vendimmarrjen n\u00eb projektin e miratuar nga K\u00ebshilli Komb\u00ebtar i Territorit, me\u00a0Vendim nr.1, dat\u00eb\u00a020 n\u00ebntor 2018.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Kjo vendimmarrje ngre nj\u00eb pik\u00ebpyetje shum\u00eb t\u00eb madhe mbi ecurin\u00eb e vet\u00eb procesit t\u00eb legalizimit n\u00eb k\u00ebt\u00eb zon\u00eb nga ALUIZNI dhe Qeveria, se p\u00ebrse k\u00ebto objekte nuk jan\u00eb p\u00ebrfshir\u00eb n\u00eb legalizim dhe nuk jan\u00eb pajisur me Leje Legalizimi p\u00ebrpara k\u00ebsaj date (20 n\u00ebntor 2018).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Sipas ligjit t\u00eb legalizimit k\u00ebto objekte, t\u00eb nd\u00ebrtuara prej m\u00eb shum\u00eb se 25 vitesh dhe t\u00eb deklaruara p\u00ebr legalizim q\u00eb n\u00eb vitin 2005-2006, duhet t\u00eb kishin p\u00ebrfunduar procesin e plot\u00eb t\u00eb legalizimit.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Vlen t\u00eb theksohet se, gjat\u00eb gjith\u00eb k\u00ebsaj periudhe kohore prej m\u00eb shum\u00eb se 25 vitesh, banor\u00ebt kan\u00eb paguar t\u00eb gjitha tarifat dhe taksat q\u00ebndrore dhe vendore, duke u sjell dhe konsideruar si banor\u00eb dhe pronar t\u00eb ligjsh\u00ebm t\u00eb pronave t\u00eb tyre.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0P\u00ebrpos k\u00ebtij fakti nga informacioni q\u00eb vjen nga banor\u00ebt, s\u00eb fundmi Inspektoriati Komb\u00ebtar i Mbrojtjes s\u00eb Territorit (IKMT) ka filluar aplikimin e nd\u00ebshkimit administrativ me gjob\u00eb n\u00eb shum\u00ebn 500 000 lek\u00eb, ndaj poseduesve t\u00eb objekteve informale. t\u00eb b\u00ebj\u00eb me p\u00ebrjashtimin e objekteve nga procesi i legalizimit apo i prishjes s\u00eb nd\u00ebrtimeve, referuar projektit ekzistues;<\/span><\/p>\n<p><span style=\"color: t\u00eb hequr n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme, pasi mungesa e tij \u00ebsht\u00eb b\u00ebr\u00eb burim aksident\u00ebsh me pasoja sh\u00ebndetin dhe jet\u00ebn e rigorozitet procedurat e shpron\u00ebsimit publik pran\u00eb Ministris\u00eb s\u00eb Infrastruktur\u00ebs dhe Energjis\u00eb, sipas k\u00ebrkesave q\u00eb dikton ligji;<\/span><\/p>\n<p><span style=\"color: #000000;\">\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Gjat\u00eb ndjekjes s\u00eb procedurave t\u00eb shpron\u00ebsimit, n\u00eb rast se preken pasuri pron\u00eb private q\u00eb nuk \u00ebsht\u00eb pajisur me dokument pron\u00ebsie dhe ndodhen ende n\u00eb proces legalizimi, t\u00eb b\u00ebhet nj\u00eb vler\u00ebsim i baz\u00ebs ligjore ekzistuese dhe n\u00ebse ajo vler\u00ebsohet e mang\u00ebt t\u00eb krijohet shtrati i nevojsh\u00ebm ligjor me q\u00ebllim trajtimin me shp\u00ebrblim t\u00eb t\u00eb gjith\u00eb qytetar\u00ebve n\u00eb m\u00ebnyr\u00eb sa m\u00eb t\u00eb drejt\u00eb, duke ruajtur interesin publik dhe t\u00eb drejtat themelore t\u00eb tyre t\u00eb pron\u00ebs s\u00eb krijuar dhe poseduar prej nj\u00eb kohe t\u00eb Zogu I, pjesa tjet\u00ebr e Unaz\u00ebs s\u00eb Madhe (segmenti Pallati me Shigjeta \u2013Kopshti Zoologjik), si dhe Unaza hyr\u00ebse e qytetit t\u00eb Vlor\u00ebs, t\u00eb cilat n\u00eb munges\u00eb t\u00eb kuadrit ligjor p\u00ebr rregullimin e \u00e7\u00ebshtjeve t\u00eb pron\u00ebsis\u00eb t\u00eb objekteve q\u00eb prekeshin, kan\u00eb b\u00ebr\u00eb t\u00eb mundur q\u00eb qeveria me VKM
